			 that allows the public to obtain electronic copies of certain
			 legislatively requested reports of the Department of Veterans Affairs, and
			 for other purposes.</official-title></form>
	<legis-body id="H19E4BC9F1063422B8501931973D01C64" style="OLC">
 <section id="HDE4A4D3D644440259B1387FDF161A885" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Reporting Transparency Act</short-title></quote>.</text> </section><section id="H050EC99073854E3496126F3E077EFD8A"><enum>2.</enum><header>Requiring public access through Department of Veterans Affairs website to legislatively requested reports of the Department</header> <subsection id="HC3B604DC3B0C4679B597949E644AF24C"><enum>(a)</enum><header>Requirement To allow access online</header> <paragraph id="HB9F7001D5273454DBF223CA09EF84F8E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, the Secretary shall establish and maintain a website of the Department that allows the public to obtain electronic copies of all legislatively requested reports.</text>
 </paragraph><paragraph id="HD8270DFBF7194E03A8AFDBC07F017400"><enum>(2)</enum><header>Existing resources</header><text>To the extent possible, the Secretary shall carry out paragraph (1) by using existing online resources administered by the Secretary.</text>
 </paragraph></subsection><subsection id="H0AFFE4A162D54AD6BB13974BD4D68276"><enum>(b)</enum><header>Content and function</header><text>The Secretary shall ensure that the website includes the following:</text> <paragraph id="H5F4721B7B4B24A08BB12AE6EED8AB2CD"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to each legislatively requested report, each of the following:</text>
 <subparagraph id="H60998D09690C47689EF59463CFA940C9"><enum>(A)</enum><text>A citation to the statute requiring the report.</text> </subparagraph><subparagraph id="HC59A01AB965A47FC8FBCD1FDF3B1D832"><enum>(B)</enum><text display-inline="yes-display-inline">An electronic copy of the report, including any transmittal letter associated with the report, that is platform independent and available to the public without restrictions, including restrictions that would impede the reuse of the information in the report. Where practicable, the report shall be in an open format.</text>
 </subparagraph><subparagraph id="HBB90E98911014CFABB50D80D783B92AE"><enum>(C)</enum><text>The ability to retrieve a report, to the extent practicable, through searches based on each, and any combination, of the following:</text>
 <clause id="H4714A68B699846CFB8C8472D8913AA99"><enum>(i)</enum><text>The title of the report.</text> </clause><clause id="H99E516492E184A5AB8C9A8CBE8C60B97"><enum>(ii)</enum><text>The date of publication.</text>
 </clause><clause id="H018E68F679C4490DA43C91B3D2E067BD"><enum>(iii)</enum><text>Any congressional committee or subcommittee receiving the report.</text> </clause><clause commented="no" id="HBD05205BF95849DAB599FAE608EEF8C1"><enum>(iv)</enum><text>The Act of Congress or con­fer­ence report that requests the report.</text>
 </clause><clause id="H4B8ECB173725452FB0BC259B33434F37"><enum>(v)</enum><text>Subject tags.</text> </clause><clause id="HB192CE1C64BC4EBA9839BB40A0A7BD9D"><enum>(vi)</enum><text>A unique alphanumeric identifier for the report that is consistent across report editions.</text>
 </clause><clause id="H55FCC187865547219D074BC9E15252AB"><enum>(vii)</enum><text>Any serial number, Su­per­in­ten­dent of Documents number, or other identification number for the report.</text>
 </clause><clause id="HDC7D46C9D19C4AAFAC3838721884357F"><enum>(viii)</enum><text>Key words.</text> </clause><clause id="H4FB99A0403B44690A32FCD598B08910C"><enum>(ix)</enum><text>Full text search.</text>
 </clause><clause id="H34B1935DDC534344B23D3668E893C0F5"><enum>(x)</enum><text>Any other information the Secretary determines appropriate.</text> </clause></subparagraph><subparagraph id="H9F3A47A7FA324508BB2683723911941F"><enum>(D)</enum><text>The date on which the report was required to be submitted to the website.</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H2649DCD746DF4885A3D550E9FA45DC8A"><enum>(E)</enum><text>The date on which the report was submitted to the website.</text> </subparagraph><subparagraph id="H82BE39103C364892AD04C50DE7709B1B"><enum>(F)</enum><text>To the extent practicable, a permanent means of accessing the report electronically.</text>
 </subparagraph></paragraph><paragraph id="H09CF0286E4D848FA8C71377AC350B159"><enum>(2)</enum><text display-inline="yes-display-inline">A means for bulk download of all legislatively requested reports.</text> </paragraph><paragraph id="H2F6DB4D46ED245D89E6E97358E4A2000"><enum>(3)</enum><text>A means for downloading individual reports as the result of a search.</text>
 </paragraph><paragraph id="H361D8F29EA064ED3BD46CDBE3CA379B1"><enum>(4)</enum><text display-inline="yes-display-inline">In tabular form, a list of all legislatively requested reports that can be searched, sorted, and downloaded by—</text>
 <subparagraph id="H2A6717CE6D894BABA6EF5E1E73D2C047"><enum>(A)</enum><text>reports submitted within the required time;</text> </subparagraph><subparagraph id="HE2FF783D8FB04E858C4AA8E337D8E08D"><enum>(B)</enum><text>reports submitted after the date on which such reports were required to be submitted; and</text>
 </subparagraph><subparagraph id="H79DB1FD04C734D7B93EC187FD450C82A"><enum>(C)</enum><text>reports not submitted.</text> </subparagraph></paragraph></subsection><subsection id="H65DF7D2693F24E98A3B013AF56961215"><enum>(c)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Secretary shall ensure that information required to be published on the website under this Act with respect to a legislatively requested report submitted after the period under subsection (a)(1) is published not later than three calendar days after the report is submitted.</text>
 </subsection><subsection id="HD8929BC9723948F986DDDC30C265E8B7"><enum>(d)</enum><header>Notice on website of withheld reports</header><text display-inline="yes-display-inline">If a report is withheld from submission to or publication on the website at the request of a recipient committee or subcommittee, the Secretary shall post on the website a statement that the report is withheld at the request of such committee or subcommittee.</text>
 </subsection><subsection id="H448CF6AEE04F4DF4A0735610EBBB3580"><enum>(e)</enum><header>Free access</header><text>The Secretary may not charge a fee, require registration, or impose any other limitation in exchange for access to the website.</text>
			</subsection></section><section id="HFC50BC209768493EADBD05C1AC44AA0E"><enum>3.</enum><header>Relationship to the Freedom of Information Act</header>
 <subsection id="HCB4B92EFABDD4B8F90E3FB24AEBEB326"><enum>(a)</enum><header>In general</header><text>Nothing in this Act shall be construed to—</text> <paragraph id="H0D03DF4BA2FF42C1A18F5B25821952E0"><enum>(1)</enum><text>require the disclosure of information, records, or reports that are exempt from public disclosure under section 552 of title 5, United States Code; or</text>
 </paragraph><paragraph id="H97A0FF2ED1A74BD6A85BDFAFECA73940"><enum>(2)</enum><text display-inline="yes-display-inline">impose any affirmative duty on the Secretary to review legislatively requested reports submitted for publication to the website for the purpose of identifying and redacting such information or records.</text>
 </paragraph></subsection><subsection id="HE643E8505A6C4C15B6538D170FAD6575"><enum>(b)</enum><header>Redaction of information</header><text>The Secretary may redact information required to be disclosed under this Act if the information would be properly withheld from disclosure under section 552 of title 5, United States Code, and shall—</text>
 <paragraph id="H550D18890F49428C9E4589FE3C5A7A50"><enum>(1)</enum><text>redact information required to be disclosed under this Act if disclosure of such information is prohibited by law;</text>
 </paragraph><paragraph id="HEF5BDA460FF64EECB3917767A61072A3"><enum>(2)</enum><text display-inline="yes-display-inline">redact only such information properly withheld under this subsection from the submission of information or from any legislatively requested report submitted under this Act;</text>
 </paragraph><paragraph id="HB24CAD0CC2F44353A6918D1D30ACFDF9"><enum>(3)</enum><text>identify where any such redaction is made in the submission or report; and</text> </paragraph><paragraph id="HD34A2400BE564EEAB337AC85A61177CC"><enum>(4)</enum><text>identify the exemption under which each such redaction is made.</text>
				</paragraph></subsection></section><section id="H8C58F62C00F64E80945DE04C9B18BEAB"><enum>4.</enum><header>Reports required</header>
 <subsection id="H3F9881B0F9824357B0C554280A13BBF4"><enum>(a)</enum><header>Recurring reports that the Secretary recommends discontinuing</header><text display-inline="yes-display-inline">The Secretary shall submit to Congress a report regarding recurring legislatively requested reports that the Secretary recommends discontinuing not later than—</text>
 <paragraph id="H7D6BE77CA4A2406B891CFB3E33A7A92C"><enum>(1)</enum><text display-inline="yes-display-inline">180 days after the date of the enactment of this Act; and</text> </paragraph><paragraph id="H38AC2480668A43708B69C50628E2178F"><enum>(2)</enum><text display-inline="yes-display-inline">two years after the date of the enactment of this Act.</text>
 </paragraph></subsection><subsection id="H48C54F06FE0546FA8FD5CDF7489059C3"><enum>(b)</enum><header>Compliance of VA website with Federal statutes, regulations, rules, and guidance</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to Congress a report regarding the compliance of the website of the Department with Federal statutes, regulations, rules, and guidance regarding transparency for and access by the public and Congress, including requirements for links and information subject to section 552 of title 5, United States Code, and the Inspector General Act of 1978 (<external-xref legal-doc="public-law" parsable-cite="pl/95/452">Public Law 95–452</external-xref>).</text>
 </subsection></section><section id="H59D1BE34D93949D0A2453C6A175AFDB5"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H93124A81A7604D59B9DD71F927C6D256"><enum>(1)</enum><header>Legislatively requested report</header><text display-inline="yes-display-inline">The term <quote>legislatively requested report</quote> means a report to be submitted by the Secretary to either house of Congress or any committee of Congress or subcommittee thereof pursuant to—</text>
 <subparagraph id="HAB14893A5055434BA81D9E14BAB5FAFC"><enum>(A)</enum><text>an Act of Congress enacted not more than eight years before the date of the enactment of this Act; or</text>
 </subparagraph><subparagraph id="H9562087C652F4D1FAF85E1B7F680101C"><enum>(B)</enum><text display-inline="yes-display-inline">a conference report adopted not more than eight years before the date of the enactment of this Act.</text> </subparagraph></paragraph><paragraph id="HCABA886640844EDC90F2B4C5EE5EDA72"><enum>(2)</enum><header>Open format</header><text>The term <quote>open format</quote> means a file format for storing digital data based on an underlying open standard that—</text>
 <subparagraph id="H50CADF7C2AB24456AC5871414D91291E"><enum>(A)</enum><text>is not encumbered by any restrictions that would impede reuse; and</text> </subparagraph><subparagraph id="HDD428A86631C4F1084902601CCDD1F9A"><enum>(B)</enum><text>is based on an underlying open data standard that is maintained by a standards organization.</text>
 </subparagraph></paragraph><paragraph id="H0B6B0B7379194EDEBC6D9C72909AC842"><enum>(3)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Veterans Affairs.</text> </paragraph><paragraph id="H39E0B151837749EC8A2C992056145C57"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Veterans Affairs.</text>
