 <section id="H2762E4E223D147E6B7EB07CE4135D584" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Loan Advocacy Act</short-title></quote>.</text> </section><section id="H146DCD73E4574A78A33C48E1E2C1F4D5"><enum>2.</enum><header>Performance-based organization for delivery of Federal student financial assistance</header> <subsection id="H19D0FB00EAE447FFB275503AC58E4D1B"><enum>(a)</enum><header>PBO</header><text>Section 141 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1018">20 U.S.C. 1018</external-xref>) is amended—</text>
 <paragraph id="HBF0EA0CF54AC4C46A2C6515270884D5C"><enum>(1)</enum><text>in subsection (a), by amending paragraph (2) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H337C0939951B4BAABBC0B7B9DB2B9020" style="OLC"> <paragraph id="H33F75BD7D3EC42098C3A5FB99CA9C035"><enum>(2)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the PBO are as follows:</text>
 <subparagraph id="H58F5B48D62274A72A78452577F36CD7E"><enum>(A)</enum><text display-inline="yes-display-inline">To prioritize students and borrowers in the decisionmaking process of the PBO.</text> </subparagraph><subparagraph id="HF17A691629154C47BAA8DBA81C103E73"><enum>(B)</enum><text display-inline="yes-display-inline">To improve service to students and other participants in the Federal student financial assistance programs authorized under title IV.</text>
 </subparagraph><subparagraph id="HD001DE3AA85D4E8897F62B8ADBF34185"><enum>(C)</enum><text>To make such programs more understandable to students and their parents.</text> </subparagraph><subparagraph id="H520FD6764846491A8DA4824D0AD18185"><enum>(D)</enum><text>To increase the efficiency and effectiveness of such programs for students and their parents.</text>
 </subparagraph><subparagraph id="H05F2293A938D4D2AA7F2F747432F1456"><enum>(E)</enum><text>To manage the costs of administering such programs.</text> </subparagraph><subparagraph id="H83A5C48101A74C96959E21F77FCDCB41"><enum>(F)</enum><text display-inline="yes-display-inline">To increase the accountability of the officials responsible for administering the operational aspects of such programs.</text>
 </subparagraph><subparagraph id="HBDC00785E0874D138A94A97158F69D23"><enum>(G)</enum><text display-inline="yes-display-inline">To increase oversight of institutions, contractors, and third party servicers that participate in the Federal student financial assistance programs authorized under title IV.</text>
 </subparagraph><subparagraph id="H0B08A6313EFD4302B345F9027D873F97"><enum>(H)</enum><text>To provide greater flexibility in the management and administration of such programs.</text> </subparagraph><subparagraph id="HF704EFCE6FD94B15AEA95B5DC8EB0DF2"><enum>(I)</enum><text>To implement open, common, integrated systems for the delivery of Federal student financial assistance programs authorized under title IV.</text>
 </subparagraph><subparagraph id="HD824D9336D9D403B9EBDD61C89DB0DC2"><enum>(J)</enum><text display-inline="yes-display-inline">To develop and maintain a student financial assistance system that contains complete, accurate, and timely data to ensure program integrity.</text>
 </subparagraph><subparagraph id="H29EB1E4C96994964B007783095083863"><enum>(K)</enum><text display-inline="yes-display-inline">To increase transparency in the operations and outcomes of Federal student financial assistance programs authorized under title IV.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H7B211032B9344C7E8590E813D7A61A09"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H0600B5782F17433BA54115E10EC5DB72"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="HABE9124FF4254AD8ABD2EF10746AC4F6"><enum>(i)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively; and</text> </clause><clause id="H35007A23FCF347209D4D62240EBB55B4"><enum>(ii)</enum><text>by inserting after subparagraph (A) the following:</text>
							<quoted-block display-inline="no-display-inline" id="H94E8712E6C774F8E9F20FAEBAD451CDE" style="OLC">
 <subparagraph commented="no" id="HD971FB99CA274539BA598338681BF054"><enum>(B)</enum><text display-inline="yes-display-inline">implement oversight and accountability measures to ensure that the PBO carries out its duties under this section efficiently, effectively, and in a manner that accomplishes the purposes specified in subsection (a)(2);</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="H732408D53BA740F5AD18B0BDD7907704"><enum>(B)</enum><text>in paragraph (2)(A)—</text> <clause id="HB50A84B603794E448D22EFB4F553F836"><enum>(i)</enum><text>by redesignating clauses (ii) through (vi) as clauses (iii) through (vii);</text>
 </clause><clause id="H3C68A4C75C024706AC6A49B480D0510E"><enum>(ii)</enum><text>by inserting after clause (i) the following:</text> <quoted-block display-inline="no-display-inline" id="HDE84956391F54BE29222490A7758EE6E" style="OLC"> <clause commented="no" id="HCEAB589DECD1463CB55A3FDDE74F447F"><enum>(ii)</enum><text display-inline="yes-display-inline">in accordance with paragraph (3), the collection, publication, and sharing of longitudinal data that may be used to evaluate Federal student financial assistance programs authorized under title IV, including the outcomes such programs achieve;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="H13561861703B4C38921D3663A6E9018D"><enum>(iii)</enum><text>in clause (vii), as so redesignated, by inserting <quote>, including oversight of institutions, contractors, and third party servicers that participate in such programs</quote> after <quote>title IV</quote> ;</text>
 </clause></subparagraph><subparagraph id="H020D7B6537DE4C50A6AEF4F56840F3F5"><enum>(C)</enum><text>by redesignating paragraphs (3) through (6) as paragraphs (4) through (7), respectively; and</text> </subparagraph><subparagraph id="H080E886D3D7244B898CA93421301356D"><enum>(D)</enum><text>by inserting after paragraph (2) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H409D46A37E9B43949BEE6F94DA94288B" style="OLC">
							<paragraph commented="no" id="H3DE1B3CFDE874A6E9C1E9B9012CBD3C9"><enum>(3)</enum><header>Collection, sharing, and publication of data</header>
 <subparagraph commented="no" id="HDBA0E80FBA3C42C59A67484F46178F21"><enum>(A)</enum><header>Collection</header><text display-inline="yes-display-inline">The PBO shall collect longitudinal data, including student-level data, that shall be used to evaluate Federal student financial assistance programs authorized under title IV.</text>
 </subparagraph><subparagraph commented="no" id="H21AB9B248B2C44A0AEACC6D4256949C2"><enum>(B)</enum><header>Sharing with NCES</header><text display-inline="yes-display-inline">The PBO shall make the data collected under subparagraph (A) available to the Commissioner of the National Center for Education Statistics for purposes of research and policy analysis.</text>
 </subparagraph><subparagraph commented="no" id="H7A6F592F5E6849D787C77CE031E52851"><enum>(C)</enum><header>Sharing with researchers</header><text display-inline="yes-display-inline">The Commissioner of the National Center for Education Statistics shall make the data shared under subparagraph (B) available to researchers for vetted research and evaluation purposes. Data made available to researchers under this subparagraph shall not include any data that would reveal personally identifiable information.</text>
								</subparagraph><subparagraph commented="no" id="HE25EC5BBA46F40919600DF554541D8D8"><enum>(D)</enum><header>Publication</header>
 <clause id="HFE22BEC69067447EAA0D296351CB1068"><enum>(i)</enum><header>In general</header><text>Not less frequently than once annually, and subject to clause (ii), the PBO shall make the data collected under subparagraph (A) available on a publicly accessible website of the Department of Education in a format that enables members of the public to easily retrieve, sort, and analyze the data.</text>
 </clause><clause id="H56E0916FDCB146CC80F34D6CB2D0B2F1"><enum>(ii)</enum><header>Privacy protections</header><text>The data made available under clause (i) shall not include—</text> <subclause id="HD97A6E54058443138A182E63D20DCA67"><enum>(I)</enum><text>student-level data; or</text>
 </subclause><subclause id="H15820C8DE48A4076B7A2F846B727BF8E"><enum>(II)</enum><text>any data that would reveal personally identifiable information about an individual student.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="H29ACD0451A3C4FCBA69CEA1F13537892"><enum>(3)</enum><text>by amending subsection (c) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H0E787C263EE049068F06B8C788B76BBE" style="OLC">
						<subsection id="HC24C00C88AFA4E1B82F9A1E21A1C70DA"><enum>(c)</enum><header>Performance plan, report, and briefing</header>
							<paragraph id="H2428585680EE4B0F9171C9EF0170EE4B"><enum>(1)</enum><header>Performance plan</header>
 <subparagraph id="HCA8571E5359345408D8B654CC2BC2402"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of the <short-title>Student Loan Advocacy Act</short-title>, and not less than once every five years thereafter, the Secretary and Chief Operating Officer shall agree on a performance plan for the PBO for the succeeding 5 years that—</text>
 <clause id="H38A8C620184644F5ACAFA7C8EFC002DD"><enum>(i)</enum><text>establishes measurable quantitative and qualitative goals and objectives for the organization; and</text> </clause><clause id="H307FBE90EFD143FF8AC5A721DE5C3E44"><enum>(ii)</enum><text>aligns such goals and objectives with the purposes specified in subsection (a)(2).</text>
 </clause></subparagraph><subparagraph id="HC23028AECB7C4136B5968DC8DF51EAC7"><enum>(B)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the five-year performance plan and any revision to the plan, the Secretary and the Chief Operating Officer shall consult with students, institutions, Congress, contractors, the Borrower Advocate, student aid experts, including consumer advocacy and research groups, the Director of the Bureau of Consumer Financial Protection, State attorneys general, and other relevant parties.</text>
 </subparagraph><subparagraph id="HD0AAC234D65D4A7DBD14A6CB13AE6CF4"><enum>(C)</enum><header>Revisions</header><text display-inline="yes-display-inline">The Secretary and Chief Operating Officer may annually update the plan under paragraph (1) to incorporate the recommendations made pursuant to the consultation required under subparagraph (B) that are accepted by the Secretary and the Chief Operating Officer.</text>
 </subparagraph><subparagraph id="HDCCF33B9AACB4FA7B0D8F0078E567B17"><enum>(D)</enum><header>Areas</header><text>The plan developed under subparagraph (A) shall address the responsibilities of the PBO in the following areas:</text>
 <clause id="HD06189E8C8574C0480DAEF4931245E0A"><enum>(i)</enum><text>Improving service to students and other participants in the Federal student financial assistance programs authorized under title IV, including making those programs more understandable and accessible to students and their parents.</text>
 </clause><clause id="HB60EDD8928AE486D987DFA946F30C3EA"><enum>(ii)</enum><text>Managing the costs and increasing the efficiency of such programs.</text> </clause><clause id="H17A045D865354F99BBD4743EE830B116"><enum>(iii)</enum><text>Improving, integrating, and investing in the systems that support such programs.</text>
 </clause><clause id="H150EEC3E58E545849BBF77F0C76E90A4"><enum>(iv)</enum><text display-inline="yes-display-inline">Developing open, common, and integrated systems for such programs.</text> </clause><clause display-inline="no-display-inline" id="H5CF5CAEEA38B4F3E935784B5105C36B3"><enum>(v)</enum><text display-inline="yes-display-inline">The collection, publication, and sharing of data on such programs as described in subsection (b)(3).</text>
 </clause><clause id="H84FA23EF2D9E4508A365B7DFE36C2442"><enum>(vi)</enum><text display-inline="yes-display-inline">Improving performance standards and outcomes with respect to institutions, contractors, and third party servicers that act as agents of the Department or as agents of institutions that participate in such programs.</text>
 </clause><clause id="H29EA172D5B9741BABFE633D46484C0DE"><enum>(vii)</enum><text>Any other areas identified by the Secretary.</text> </clause></subparagraph><subparagraph id="HAD6A2F32034F4E6CB874285CD099014A"><enum>(E)</enum><header>Public availability</header><text display-inline="yes-display-inline">Each plan developed under subparagraph (A) shall be made available on a publicly accessible website of the Department of Education.</text>
								</subparagraph></paragraph><paragraph id="H1C9859D4A89546DDB7A411E8C7643BC0"><enum>(2)</enum><header>Annual report</header>
 <subparagraph id="HDB3D06C9F3B047C29322FBF603A69D15"><enum>(A)</enum><header>Report required</header><text>Not later than one year after the date of the enactment of the <short-title>Student Loan Advocacy Act</short-title> and annually thereafter, the Secretary, acting through the Chief Operating Officer, shall submit to Congress an annual report on the performance of the PBO.</text>
 </subparagraph><subparagraph id="HCDBB6A97936B40E795F0C5A80B01123F"><enum>(B)</enum><header>Contents</header><text>The annual report shall include the following:</text> <clause id="H8178B670DC7142D3A50E4425AEAB6D3D"><enum>(i)</enum><text>An evaluation of the extent to which the PBO met the goals and objectives contained in the five-year performance plan described in paragraph (1) for the preceding year.</text>
 </clause><clause id="HFA5EF29717344A83826444DBF44C15ED"><enum>(ii)</enum><text>A summary of the consultation process under paragraph (1)(B) for the preceding year, including the recommendations that were accepted or denied by the Chief Operating Officer during such year, and the rationale for accepting or denying such recommendations.</text>
 </clause><clause commented="no" id="H4D1F4D98FB4749059AC9A4232716CF23"><enum>(iii)</enum><text display-inline="yes-display-inline">An independent financial audit of the expenditures of both the PBO and the programs administered by the PBO.</text>
 </clause><clause id="H2B3541FC010A4E4B87FABD4DF0690172"><enum>(iv)</enum><text>A summary of the actions taken by the PBO to address—</text> <subclause id="HEC14DE31A4074895930569A7242E7E06"><enum>(I)</enum><text>the findings of the audit described in clause (iii); and</text>
 </subclause><subclause id="HD6088493BC4B4BD59A32EBF687262965"><enum>(II)</enum><text>consumer feedback.</text> </subclause></clause><clause id="H305B375A69254D0EBDC3918899B20D9B"><enum>(v)</enum><text>Financial and performance requirements applicable to the PBO under—</text>
 <subclause id="H21869F97FBE74BCABBEB5C6D0B5BD3ED"><enum>(I)</enum><text display-inline="yes-display-inline">the Chief Financial Officers Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/576">Public Law 101–576</external-xref>); or</text> </subclause><subclause commented="no" id="H7475773094504B55B90875E2C4E39EAE"><enum>(II)</enum><text display-inline="yes-display-inline">the Government Performance and Results Act of 1993 (<external-xref legal-doc="public-law" parsable-cite="pl/103/62">Public Law 103–62</external-xref>).</text>
 </subclause></clause><clause id="HEDCE2A888D67445A8CD904689A22C39E"><enum>(vi)</enum><text>The results achieved by the PBO during the preceding year and whether such results met the goals specified in the performance plan under paragraph (1).</text>
 </clause><clause id="H8DE643A265DA49A0B1C70CC24E3931B9"><enum>(vii)</enum><text>With respect to the preceding year, the evaluation rating of the performance of the Chief Operating Officer and senior managers under subsections (d)(5) and (e)(2), including the amounts of bonus compensation awarded to the Chief Operating Officer and senior managers.</text>
 </clause><clause id="H2698437B107A4FDFB349D25FD239C803"><enum>(viii)</enum><text display-inline="yes-display-inline">Recommendations for legislative and regulatory changes to improve service to students and their families, and to improve the efficiency and integrity of Federal student financial assistance programs authorized under title IV.</text>
 </clause><clause id="HE7296AB0B989438EA025A8CF301B5168"><enum>(ix)</enum><text display-inline="yes-display-inline">Financial statements that provide a rationale for appropriately funding the activities of the PBO.</text> </clause><clause id="H73A7E7179BF14B779AE6129385DE6E56"><enum>(x)</enum><text>A summary of the management and compliance of contractors managed by the PBO in the preceding year, including corrective actions taken by the PBO with respect to such contractors.</text>
 </clause><clause id="H890AA70FC3F648F9B60B66DD31F7C28B"><enum>(xi)</enum><text>A description of how the PBO used the authority under paragraph (5) of subsection (b) for making personnel and procurement decisions in the preceding year, including the number of individuals hired through such authority and the bonuses provided to staff during such year.</text>
 </clause><clause id="H94D27ED6C3C9440F9C412F07C073787B"><enum>(xii)</enum><text display-inline="yes-display-inline">A summary of the oversight activities of institutions, contractors, and third party servicers that participate in the Federal student financial assistance programs authorized under title IV including—</text>
 <subclause id="HF5205312EB494817981308F22F728CBD"><enum>(I)</enum><text>fines levied on such institutions, contractors, and third party servicers, disaggregated by entity;</text> </subclause><subclause id="HB660B99E394D47B299C9E0411E09D8FD"><enum>(II)</enum><text>instances of fraud or misrepresentation by such institutions, contractors, or third party servicers; and</text>
 </subclause><subclause id="HA13B901D6BB341C98865110F9D807BD7"><enum>(III)</enum><text>violations of provisions in this Act by such institutions, contractors, or third party servicers disaggregated by entity and type of violation.</text>
 </subclause></clause><clause id="H4A7D8CC3C8EE463A85A69DED05E26AE1"><enum>(xiii)</enum><text>A summary of any improvements made with respect to transparency and any new types of data made available in the preceding year.</text>
 </clause><clause id="H87E17333F5774C418C42C9CC04318776"><enum>(xiv)</enum><text>A description of the progress made in the preceding year towards the specific measurable organization and individual goals specified in subsection (d)(5)(A).</text>
 </clause><clause commented="no" id="H6FDE2933664345E8B4DD0AC3CDC96008"><enum>(xv)</enum><text>The report submitted to the Secretary under subsection (f)(7).</text> </clause><clause id="H14B8CF98F3DC4B279CAD4307B2723729"><enum>(xvi)</enum><text>Other such information as the Director of the Office of Management and Budget shall prescribe for performance based organizations.</text>
 </clause></subparagraph></paragraph><paragraph id="H40E658D5719548699F374693FB8BEEB4"><enum>(3)</enum><header>Consultation with stakeholders</header><text>The Chief Operating Officer, in preparing the annual report described in paragraph (2), shall establish appropriate means to consult with students, borrowers, institutions, student aid experts, including consumer advocacy and research groups, the Director of the Bureau of Consumer Financial Protection, and others involved in the delivery and evaluation of student aid under title IV—</text>
 <subparagraph id="H7F476B09D0694AD48DDA8E73D65969F8"><enum>(A)</enum><text>regarding the degree of satisfaction with the delivery system; and</text> </subparagraph><subparagraph id="H6DDE452302E6426CB3B403E474E10279"><enum>(B)</enum><text>to seek suggestions on means to improve the performance of the delivery system.</text>
 </subparagraph></paragraph><paragraph id="H4B9FBE988EDF4518BDAF2CBD44962519"><enum>(4)</enum><header>Briefing on enforcement of program integrity</header><text display-inline="yes-display-inline">The Secretary shall, at the request of the authorizing committees, provide to the authorizing committees a briefing on the steps the Department of Education has taken to ensure—</text>
 <subparagraph id="H7517ED817AF941EEAE795628C6437461"><enum>(A)</enum><text display-inline="yes-display-inline">the experiences of students and borrowers are accounted for in decision making; and</text> </subparagraph><subparagraph id="H7FE6027210044B9D9E0902A4B5983995"><enum>(B)</enum><text>that contractors, lenders, and guaranty agencies and third party servicers are adhering to the requirements of title IV, the terms of any contract with the Secretary, consumer protection laws, Federal regulations and guidelines, and directives of the PBO.</text>
 </subparagraph></paragraph><paragraph id="H88B20A214D4B49B8A2BB276E1FB99B97"><enum>(5)</enum><header>Coordination with the Director of the Bureau of Consumer Financial Protection</header><text>Not later than 180 days after the date of the enactment of the <short-title>Student Loan Advocacy Act</short-title>, the Secretary shall enter into a memorandum of understanding with the Private Education Loan Ombudsman in accordance with section 1035(c)(2) of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5535">12 U.S.C. 5535(c)(2)</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HD842DE0346ED4B4DA92EB1D84BB9447C"><enum>(4)</enum><text>in subsection (d)—</text> <subparagraph id="HFBED460B5174451CA91C6796392E0C63"><enum>(A)</enum><text>in paragraph (1), by striking <quote>management ability</quote> and all that follows through the period at the end and inserting <quote>management ability, including contractor management, expertise in the Federal student financial assistance programs authorized under title IV, experience with financial systems, and knowledge of consumer financial protection laws, and without regard to political affiliation or activity.</quote>;</text>
 </subparagraph><subparagraph id="HC25083F484804BD8B77B737D575DFFF4"><enum>(B)</enum><text>by redesignating paragraphs (2) through (5) as paragraphs (3) through (6);</text> </subparagraph><subparagraph id="H284A1F45120C46ECBD50D355B1FB64AD"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text>

							<paragraph id="H0239A1A181E544DE8E3AD1A265EDE3C8"><enum>(2)</enum><header>Restrictions</header>
 <subparagraph id="H706096C0B6E6475298F8BE7255950D71"><enum>(A)</enum><header>Preservice and in-service restrictions</header><text>An individual may not serve as the Chief Operating Officer if such individual—</text> <clause id="H5061005599F84500A024D7218991BF6D"><enum>(i)</enum><text>is employed by, or has a financial interest in, an entity that contracts with the PBO; or</text>
 </clause><clause id="H72DC317A424748B0814234D0464A9D67"><enum>(ii)</enum><text>was employed by, or had a financial interest in, any such entity in any of the five years preceding the date of the individual’s appointment as the Chief Operating Officer.</text>
 </clause></subparagraph><subparagraph id="HB8AEEF3D2D414413A99F80913534020C"><enum>(B)</enum><header>Postservice restrictions</header><text>An individual who served as the Chief Operating Officer may not accept employment with an entity that contracts with the PBO until a period of five years has elapsed following the date on which such individual’s service as the Chief Operating Officer terminated.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H1CE52603FE2F4341810E1F0703A96709"><enum>(D)</enum><text>in paragraph (5), as so redesignated—</text> <clause id="H0BEAFD69222C458C8831DC51D034EE72"><enum>(i)</enum><text>in subparagraph (A)—</text>
 <subclause id="H94B6F6F8F7904018A67E5B0EFC1E25B9"><enum>(I)</enum><text>by inserting <quote>specific</quote> before <quote>measurable</quote>; and</text> </subclause><subclause id="HAEE04C7483C14100BCCD799AAF3A1CBD"><enum>(II)</enum><text>by inserting <quote>and metrics used to measure progress toward such goals</quote> before the period; and</text>
 </subclause></clause><clause commented="no" id="HBF093C5F7C7A4E68A1285AA4F44DEF26"><enum>(ii)</enum><text>in subparagraph (B), by inserting <quote>on the website of the Department</quote> before the period; and</text> </clause></subparagraph><subparagraph id="HA01F90C5EBA34CE28502CF0F86D849D7"><enum>(E)</enum><text>in paragraph (6), as so redesignated, by amending subparagraph (B) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H4D9F8BA7B779426C9A2B68A9777E30E5" style="OLC">
 <subparagraph id="H9B76398EA6F64B1F8D1BB0C84A54B142"><enum>(B)</enum><header>Bonus authorized</header><text>The Secretary may pay to the Chief Operating Officer a bonus in an amount that does not exceed 50 percent of such annual rate of basic pay. The decision to pay such a bonus, and the amount of the bonus, shall be based solely on the Secretary’s evaluation of the performance of the Chief Operating Officer with respect to the goals set forth in the performance agreement as described in paragraph (5)(A).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H3D219DD91135471FB50E90AE0AEFB359"><enum>(5)</enum><text>in subsection (e)(2), by striking <quote>organization and individual goals</quote> and inserting <quote>specific, measurable organization and individual goals and the metrics used to measure progress toward such goals. Performance agreements for senior management responsible for procurement shall include metrics that measure ability to oversee contractors.</quote>;</text>
 </paragraph><paragraph id="H8A11D628E15943A38E7D2A82C856C51F"><enum>(6)</enum><text>by amending subsection (f) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H23F53E9E1D604364932B09D0AF950168" style="OLC"> <subsection id="HE408269E5A6E4F559388D0AA04242E41"><enum>(f)</enum><header>Borrower Advocate</header> <paragraph id="HFFBCF37F080A45009E30BFB05D118458"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the PBO an <quote>Office of the Borrower Advocate</quote> (referred to in this subsection as the <quote>Office</quote>). The function of the Office shall be to provide timely assistance to borrowers of loans made, insured, or guaranteed under title IV by performing the duties described in paragraph (6).</text>
 </paragraph><paragraph id="H2F10EDA8A0B84E0D85D977262E12C762"><enum>(2)</enum><header>Head of Office</header><text display-inline="yes-display-inline">There shall be an official known as the <quote>Borrower Advocate</quote> who shall serve as the head of the Office. The Borrower Advocate shall be appointed by the Secretary from among individuals who have worked closely with the Federal student loan programs authorized under title IV.</text>
 </paragraph><paragraph id="H964B7832A77A4BB4B326A7FE23A26F78"><enum>(3)</enum><header>Removal</header><text display-inline="yes-display-inline">The Borrower Advocate may be removed only by the Secretary who shall communicate the reasons for any such removal to the authorizing committees.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HD3546BA27E7C4F3EAB5BD9FBE4B606E7"><enum>(4)</enum><header>Restrictions</header>
 <subparagraph id="H5D92A13FA88D4676ABD66598BFC35B9A"><enum>(A)</enum><header>Preservice and in-service restrictions</header><text>An individual may not serve as the Borrower Advocate if such individual—</text> <clause id="HE3FCB64FE1284AB9B6631CA8E7813A46"><enum>(i)</enum><text>is employed by, or has a financial interest in, an entity that contracts with the PBO; or</text>
 </clause><clause id="H31804776BF0D46D0B67A0E2210913C37"><enum>(ii)</enum><text>was employed by, or had a financial interest in, any such entity in any of the five years preceding the date of the individual’s appointment as the Borrower Advocate.</text>
 </clause></subparagraph><subparagraph id="H71F586F456874C89BDD29211DB662A87"><enum>(B)</enum><header>Postservice restrictions</header><text>An individual who served as the Borrower Advocate may not accept employment with an entity that contracts with the PBO until a period of five years has elapsed following the date on which such individual’s service as the Borrower Advocate terminated.</text>
 </subparagraph></paragraph><paragraph id="H78A80C2CB26F44C5AA5F976CDB5FE644"><enum>(5)</enum><header>Staff</header><text>The Office shall be staffed sufficiently to carry out the responsibilities of the Office under this subsection.</text>
 </paragraph><paragraph id="HAB1962F7059C436C81E4B5699042A841"><enum>(6)</enum><header>Duties of the Borrower Advocate</header><text display-inline="yes-display-inline">The Office of the Borrower Advocate shall—</text> <subparagraph id="HF5E95F2E789F4CDBAF3D3C05F78A77E3"><enum>(A)</enum><text display-inline="yes-display-inline">assist borrowers of loans made, insured, or guaranteed under title IV in resolving problems with the PBO and its contractors or other agents, including by—</text>
 <clause id="HA55E04134633430CB3D48FDE82150A4D"><enum>(i)</enum><text>receiving and reviewing complaints of such problems from borrowers;</text> </clause><clause id="H9F2E000BCB454BC88DC9680CC1882703"><enum>(ii)</enum><text>working to resolve such complaints in a manner that is in the best interests of borrowers; and</text>
 </clause><clause id="H5DC141862C804EC7B529E5A50D98D503"><enum>(iii)</enum><text>transmitting such complaints to States and recognized accrediting agencies or associations, as appropriate;</text>
 </clause></subparagraph><subparagraph id="HACD9BE8068E64E0CA0C5530EA20F340A"><enum>(B)</enum><text display-inline="yes-display-inline">attempt to resolve complaints within the Department of Education and with institutions of higher education, lenders, guaranty agencies, loan servicers, and other participants in the Federal student loan programs authorized under title IV in a manner that will improve the experience of the borrower;</text>
 </subparagraph><subparagraph id="H6AAFF98B2B1D4D9E9E2D0F0F5539D204"><enum>(C)</enum><text display-inline="yes-display-inline">compile and analyze data on borrower complaints and share such data with the Director of the Bureau of Consumer Financial Protection;</text>
 </subparagraph><subparagraph id="H42EE2222ECF94005910AE9206908A087"><enum>(D)</enum><text display-inline="yes-display-inline">publish, with any personally identifiable information redacted, such complaints and responses of the Secretary to such complaints on the website of the Department; and</text>
 </subparagraph><subparagraph id="H7EA994042C7B4362B3C6EF95E35D259F"><enum>(E)</enum><text display-inline="yes-display-inline">make appropriate recommendations to Congress, the Chief Operating Officer, and Secretary with respect to Federal student loan programs authorized under title IV and the experiences of borrowers in repayment of loans under such programs.</text>
 </subparagraph></paragraph><paragraph id="H64EC493E56264E86BF601C7B3BD716CC"><enum>(7)</enum><header>Public information</header><text display-inline="yes-display-inline">The Chief Operating Officer shall establish and maintain a public page on the website of the Department of Education exclusively to provide members of the public with information about the role of the PBO with respect to the oversight of institutions of higher education, lenders, guaranty agencies, contractors that contract with the PBO, subcontractors of such contractors, and third party servicers.</text>
 </paragraph><paragraph id="HD3C3CC179750462289F6BD622FE7DBB3"><enum>(8)</enum><header>Report</header><text>On an annual basis, the Borrower Advocate shall submit to the Chief Operating Officer a report on the activities of the Office during the preceding year that—</text>
 <subparagraph id="H386F527E698B4FA49E9A244ABA0FC59C"><enum>(A)</enum><text display-inline="yes-display-inline">identifies the activities carried out by the Borrower Advocate;</text> </subparagraph><subparagraph id="H5A8E1CD2F9B64D6FB84DBA0E1D6C4399"><enum>(B)</enum><text display-inline="yes-display-inline">summarizes the complaints received from borrowers, including the number of such complaints, and explains the activities undertaken by the PBO to address such complaints;</text>
 </subparagraph><subparagraph id="HFE0C886282C04E4D8E72E25E16AD9595"><enum>(C)</enum><text>proposes changes in the administrative practices of the PBO to mitigate problems experienced by borrowers; and</text>
 </subparagraph><subparagraph id="H796E951698EA425FACC8F611A2F750A9"><enum>(D)</enum><text>identifies potential legislative changes which may be appropriate to mitigate such problems.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="H85F2DA417A3447C8826FA0649DB5DBCC"><enum>(7)</enum><text display-inline="yes-display-inline">by redesignating subsection (i) as subsection (j); and</text>
 </paragraph><paragraph id="H57DF7C577D5D4348B411BDE23859891B"><enum>(8)</enum><text>by inserting after subsection (h) the following:</text> <quoted-block display-inline="no-display-inline" id="H7068C5FABE1E4D25B41323524F2C3799" style="OLC"> <subsection id="H62803A6554514557BED010C6874C328A"><enum>(i)</enum><header>Third party servicer defined</header><text display-inline="yes-display-inline">In this section, the term <term>third party servicer</term> has the meaning given that term in section 481(c).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H2B9F1D31E13F4450BA91DE2FE1758E02"><enum>(b)</enum><header>Definition of third-Party servicer</header><text display-inline="yes-display-inline">Section 481(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088(c)</external-xref>) is amended—</text> <paragraph id="H1ACF6F0C315B461490CEF54BEFBF5330"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>contract</quote> and inserting <quote>contract or other agreement, including a revenue sharing arrangement,</quote>; and</text>
 </paragraph><paragraph id="H3E2206DAF3BB4769AB4826926BAC6757"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>, through either manual or automated processing, any aspect of such institution's student assistance programs</quote> and inserting <quote>services on behalf of the institution receiving student assistance funds </quote>.</text>
				</paragraph></subsection><subsection id="H4F0400F8343C4B43B504F606923E3385"><enum>(c)</enum><header>Conforming amendments</header>
 <paragraph id="HC6CEAB7A572D45FE8F53A1A9800173CD"><enum>(1)</enum><text display-inline="yes-display-inline">Section 433(b)(13) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1083">20 U.S.C. 1083(b)(13)</external-xref>) is amended by striking <quote>Student Loan Ombudsman</quote> and inserting <quote>Borrower Advocate</quote>.</text>
 </paragraph><paragraph id="H5FA2D976AF6248C3A1C9CCB47E62897C"><enum>(2)</enum><text display-inline="yes-display-inline">Section 433(e)(3)(E) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1083">20 U.S.C. 1083(e)(3)(E)</external-xref>) is amended by striking <quote>Student Loan Ombudsman</quote> and inserting <quote>Borrower Advocate</quote>.</text>
