<section id="H720BF25302E04181B36AB81B5CE5AFA9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mapping Accuracy Promotes Services Act</short-title></quote> or the <quote><short-title>MAPS Act</short-title></quote>.</text></section> <section id="HBCF3FEDD3AD24FFAA311679B12FCE815" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H86309664006649C7B68CCE083FBA0067"><enum>(1)</enum><header>Broadband internet access service</header><text>The term <quote>broadband internet access service</quote> has the meaning given the term in section 8.1(b) of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph> <paragraph id="HBEBD2DE2F26C489D9E28F3116AF8D8AE"><enum>(2)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission.</text></paragraph> 
<paragraph id="H5F4AC9D6B7ED42DAB22523D6B9A3E796"><enum>(3)</enum><header>Provider</header><text>The term <quote>provider</quote> means a provider of fixed or mobile broadband internet access service.</text></paragraph> <paragraph id="HE68CB6EC449A4BDCACCB2B4263A66822"><enum>(4)</enum><header>Quality of service</header><text display-inline="yes-display-inline">The term <quote>quality of service</quote> means information regarding offered download and upload speeds and latency of a provider’s broadband internet access service as determined by and to the extent otherwise collected by the Commission.</text> </paragraph></section> 
<section id="H693EAEBBBBEF4153B2C4361EC4B4F882"><enum>3.</enum><header>Enforcement</header> 
<subsection id="H34845E7D975C4A09844E3F0179FD5765"><enum>(a)</enum><header>In general</header><text>It shall be unlawful for a person to willfully, knowingly, or recklessly submit broadband internet access service coverage information or data to the Commission for the purposes of compiling a broadband coverage map that is inaccurate with respect to the availability or quality of service of broadband internet access service.</text></subsection> <subsection id="HD1E9F8EC9AD54138A470AB6B7450F96B"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be subject to an appropriate penalty, as determined by the Commission, under—</text> 
<paragraph id="H9E89E90FE34D4771B7804C20B95A799F"><enum>(1)</enum><text>the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.), including section 501 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/47/501">47 U.S.C. 501</external-xref>); and</text></paragraph> <paragraph id="HBB7176281BBA428DB22236461616BB7A"><enum>(2)</enum><text>the rules of the Commission.</text></paragraph></subsection> 
<subsection id="HCD1FCE2EC8BE4FBCB35BEA5759350167"><enum>(c)</enum><header>Effective date</header> 
<paragraph id="H1D2C47E2AE5948FD857890E3456467E6"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), subsection (a) shall apply with respect to broadband internet access service coverage information or data that is submitted to the Commission on or after the date of the enactment of this Act.</text></paragraph> <paragraph id="HFECC742F7CE54B7CA27C8D1AE6D969BB"><enum>(2)</enum><header>Quality of service information or data</header><text display-inline="yes-display-inline">To the extent broadband internet access service coverage information or data relates to quality of service, subsection (a) shall apply with respect to information or data that is submitted on or after the date that is 180 days after the date of the enactment of this Act.</text></paragraph></subsection></section>
