 <section id="HCB23091043C743AFA86599237947F551" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modern Worker Empowerment Act</short-title></quote>.</text> </section><section id="H5F0E1EA980F54019A55173145EFF61F1"><enum>2.</enum><header>Amendments to the Fair Labor Standards Act of 1938 to harmonize the definition of employee</header> <subsection id="H3EA095D8E7CC459E9CC34D47922A0991"><enum>(a)</enum><header>Definition of employee</header><text display-inline="yes-display-inline">Section 3(e)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)(1)</external-xref>) is amended by inserting before the period the following: <quote>, as determined under the usual common law rules (as applied for purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/3121">section 3121(d)</external-xref> of the Internal Revenue Code of 1986)</quote>.</text>
 </subsection><subsection id="HD6BEEF4AD62B408EA935998D35F0E6D7"><enum>(b)</enum><header>Definition of employ</header><text display-inline="yes-display-inline">Section 3(g) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(g)</external-xref>) is amended by inserting <quote>an employee</quote> after <quote>permit</quote>.</text> </subsection></section></legis-body></bill>
