			 Federal Housing Finance Agency to develop a program to provide assistance
			 to creditworthy borrowers with Federal student debt in purchasing certain
			 foreclosed homes owned by the Federal Government, the Federal National
			 Mortgage Association, the Federal Home Loan Mortgage Corporation, and
			 local land banks, and for other purposes.</official-title></form>
	<legis-body id="H422B7DBC4D9D46BF8BFBBC65FA147B0B" style="OLC">
 <section id="H1441F38ED9CC4CE1854670FB1B395F8B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transforming Student Debt to Home Equity Act of 2019</short-title></quote>.</text> </section><section id="HC3F05823728E4521B6A91D9AD0CC4687"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
 <paragraph id="H1B48A26F007E43D7A437CCE5F73E4FD8"><enum>(1)</enum><text>In the first quarter of 2019, over 16,800,000 homes remain vacant in the United States.</text> </paragraph><paragraph id="H509185CD96D048A29BFA68F78D8AD315"><enum>(2)</enum><text>These extended vacancies depress neighborhood property values and create a downward spiral in neighborhood stability in already troubled communities.</text>
 </paragraph><paragraph id="HB4F8BAC7A7B3439A962ED19B9D782872"><enum>(3)</enum><text>Meanwhile, due to climbing expenses of higher education, the total Federal student debt owed equals $1,560,000,000,000.</text>
 </paragraph><paragraph id="H552B59A90696455FABBD3A7DB75A9FA2"><enum>(4)</enum><text>More than 44,700,000 Americans have at least one outstanding student loan, up dramatically from 37,000,000 Americans just 7 years ago.</text>
 </paragraph><paragraph id="H269EE65C182F4E6FAF55BDB39C411CC8"><enum>(5)</enum><text>Student loan repayments are forcing millions of young families out of purchasing their first home, as they cannot afford to save for a down payment or qualify for a mortgage.</text>
 </paragraph><paragraph id="H42A0AEDE58404D688814E48EB2342359"><enum>(6)</enum><text display-inline="yes-display-inline">Data from the United States Census Bureau shows that non-Hispanic White households have an average net worth of $130,800, while Black households have an average net worth of $9,590 and Hispanic households have $17,530; providing innovative financial products will allow the United States to close the racial wealth gap and to ensure equitable access to housing and economic mobility.</text>
 </paragraph><paragraph id="H3A834BAFDF3B46C9957729245C15371F"><enum>(7)</enum><text display-inline="yes-display-inline">According to a report from Pew Research Center, the median income of African-American households decreased by 53 percent between 2008 and 2013. In the same time period, the income gap between White households and African-American households widened; increasing from 13 times greater to 17 times greater.</text>
 </paragraph><paragraph id="H50D7674033D44231A9AC802B491321CD"><enum>(8)</enum><text display-inline="yes-display-inline">It is imperative to create a demonstration program to design financial pathways to, where possible, to systematically convert some student debt streams into equity streams through negotiation of mortgages; otherwise housing purchases will continue to be sluggish among first time home-buyers and thousands more Americans will enter their midyears saddled with student loan debt never having had the opportunity to accumulate equity.</text>
 </paragraph><paragraph id="HD31C0AD968A2435D933CC115F5C25163"><enum>(9)</enum><text>It is in the interest of the Federal Government to use the resources at its disposal, including both housing properties held in trust and student debt obligations, to put reverse pressure on these downward trends.</text>
 </paragraph><paragraph id="HE12C3B969FCF4821A743C46A8B0EBA15"><enum>(10)</enum><text>By arranging financing that recalculates terms, debt-to-income ratios, mortgage interest rates, and other factors, short-term student debt could transition into longer term home ownership.</text>
 </paragraph><paragraph id="H8E857E0C604848329F16357FC399EA3C"><enum>(11)</enum><text display-inline="yes-display-inline">The goal is to connect creditworthy Federal student debt holders with housing properties for sale and held by the Federal Government and local land banks.</text>
 </paragraph><paragraph id="H2E636CD580524CD5BF4BC6A6EED7C7B7"><enum>(12)</enum><text display-inline="yes-display-inline">Over time, participants can help restore neighborhoods, transform their debt to equity, and stabilize secured property values locally and on the Federal ledger by maintaining and investing in a home mortgage.</text>
			</paragraph></section><section id="H1DFBFF3379EA4C53901DAA52A3A55F88"><enum>3.</enum><header>Program to expand access to mortgages to eligible creditworthy homebuyers with federal student loan
			 debt</header>
 <subsection id="H83FC3893B40948DB89FC5A46ED73D314"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">From amounts appropriated pursuant to subsection (g), the Secretary of the Department of Housing and Urban Development and the Director of the Federal Housing Finance Agency shall establish and carry out a pilot demonstration program to—</text>
 <paragraph id="H2DA58ADC76C145B4A96B0B74F0193526"><enum>(1)</enum><text>provide assistance to eligible applicants in purchasing eligible properties; and</text> </paragraph><paragraph id="H42D9929B5C124F7780796745A8BC4F10"><enum>(2)</enum><text display-inline="yes-display-inline">subsequently analyze the results of the provision of such assistance.</text>
 </paragraph></subsection><subsection id="H11B4E7C771A34F8EBF64E9B8E566629A"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In establishing and carrying out the program pursuant to subsection (a), the Secretary of the Department of Housing and Urban Development and the Director of the Federal Housing Finance Agency shall consult with—</text>
 <paragraph id="H76F5EBD5B35F4BEB8C94CE8D6FF05F9A"><enum>(1)</enum><text display-inline="yes-display-inline">the Director of the Consumer Financial Protection Bureau;</text> </paragraph><paragraph id="H2DF0167A71684871AD8A258935B59870"><enum>(2)</enum><text>the Secretary of Agriculture;</text>
 </paragraph><paragraph id="HF83B7C543D894FD5AAD41790CC81801F"><enum>(3)</enum><text>the Secretary of Veteran Affairs;</text> </paragraph><paragraph id="HD7360A6529184CBBB2A111F5A0E542B7"><enum>(4)</enum><text>the Secretary of Education; and</text>
 </paragraph><paragraph id="H8A90A240932F4701AD127B0BD00DFC82"><enum>(5)</enum><text>the Secretary of the Treasury.</text> </paragraph></subsection><subsection id="H864B1DF4BDB5429CB08A3CFAD8781E43"><enum>(c)</enum><header>Eligible applicants</header><text>To be eligible for the program established pursuant to subsection (a), an applicant—</text>
 <paragraph id="HEAC599CBC63A463AB4D9BDC349AA5C88"><enum>(1)</enum><text>shall have an outstanding balance of principal or interest owing on a Federal loan made, insured, or guaranteed under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> et seq.);</text>
 </paragraph><paragraph id="HC84283F01C6B4386B6561532522A90BF"><enum>(2)</enum><text>may not be subject to a judgment secured through litigation with respect to such a loan under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> et seq.), may not be subject to an order for wage garnishment under section 488A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1095a">20 U.S.C. 1095a</external-xref>), and at the time of application for participation in the program under this section—</text>
 <subparagraph id="HC361B1C9CF6C410E921084E7998CACB1"><enum>(A)</enum><text>such a loan shall be in repayment status as determined under section 428(b)(7)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1078">20 U.S.C. 1078(b)(7)(A)</external-xref>); or</text>
 </subparagraph><subparagraph id="HA659F5D7C93F4966BB89F647C1EDC453"><enum>(B)</enum><text>such a loan shall be in a grace period preceding repayment;</text> </subparagraph></paragraph><paragraph id="H6B31A821CEA2411DBD11153F91F06187"><enum>(3)</enum><text>may not have owned a home during the 3-year period immediately before the applicant purchases an eligible property with assistance provided under this section;</text>
 </paragraph><paragraph id="HD41FE56074B04DE1996577C9C1C60E92"><enum>(4)</enum><text>shall complete a program of counseling with respect to the responsibilities and financial management involved in homeownership that is approved by the Secretary;</text>
 </paragraph><paragraph id="HFBA894904C7C4ED99D34C2C224139750"><enum>(5)</enum><text>shall be creditworthy, as determined by the Secretary and the Director;</text> </paragraph><paragraph id="H5481D352C5454B80A3A6DCC46A863984"><enum>(6)</enum><text>shall agree to use an eligible property purchased with assistance provided under this section as the applicant’s primary residence for not less than the 3-year period beginning on the date of such purchase; and</text>
 </paragraph><paragraph id="H3D8DCFE84C1846A0A20E873C2BA20D8F"><enum>(7)</enum><text>shall be employed and earning sufficient income to repay a mortgage loan, as determined by the Secretary and the Director for the purposes of this program.</text>
				</paragraph></subsection><subsection id="H8708070A5DCA4D34B401F3B91BB098DB"><enum>(d)</enum><header>Types of assistance</header>
 <paragraph id="H4B369F24B5F945E6AF3F0F0ADE3EA0CC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A program established under this section may provide for any one or more of the following options:</text> <subparagraph id="H1CB78B654B6B433C8982AE0292ED2431"><enum>(A)</enum><text>A discount on the appraised value of an eligible property.</text>
 </subparagraph><subparagraph id="H216E15AF88774C37B980B1417D270B6F"><enum>(B)</enum><text>Flexibility in underwriting standards related to the purchase of eligible properties for mortgages insured under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707</external-xref> et seq.) or owned or guaranteed by the Federal National Mortgage Association or the Federal Home Loan Mortgage Corporation.</text>
 </subparagraph><subparagraph id="HF99A64C8E5B74D6EA897E341A0A83005"><enum>(C)</enum><text>The development of new mortgage products specifically targeted to eligible applicants.</text> </subparagraph><subparagraph id="HA44FC03A18AD4B3D9C884BF35EA737C5"><enum>(D)</enum><text>Any other assistance that the Secretary and Director jointly deem appropriate.</text>
 </subparagraph></paragraph><paragraph id="H94673C485E904395867751940939379C"><enum>(2)</enum><header>Repayment integration</header><text display-inline="yes-display-inline">A program established under this section shall provide for the development of a program that will use actuarial information to determine how the repayment of loans described in subsection (c)(1) may be integrated into a mortgage repayment schedule to allow an eligible applicant to accumulate equity in the eligible property, including by reason of meeting the eligible applicant’s obligations under such student loan.</text>
 </paragraph><paragraph id="HC719DF7B2F194D5EB7D7DFDA13A1F87E"><enum>(3)</enum><header>Collaboration</header><text>In providing assistance described under paragraph (1), the Secretary and the Director may collaborate with—</text>
 <subparagraph id="H473CDC8862ED4AF8A36EDFDE85A90CFE"><enum>(A)</enum><text>community banks having less than $10,000,000,000 in total assets;</text> </subparagraph><subparagraph id="H21ACD82ECAF742F7A5D8B1A4C1B5C1E9"><enum>(B)</enum><text>credit unions (as defined in section 101 of the Federal Credit Union Act);</text>
 </subparagraph><subparagraph id="HD1061C9779984B9FB1886B96356B1180"><enum>(C)</enum><text>and local fair housing organizations; and</text> </subparagraph><subparagraph id="HA9BA6DCA0BCD4D62B53F64E8666DAEBB"><enum>(D)</enum><text>local land banks.</text>
 </subparagraph></paragraph></subsection><subsection id="H5A37F506434343F49CF7E7E78954BAB9"><enum>(e)</enum><header>Geographical diversity</header><text>In selecting eligible applicants to receive assistance under this section, the Secretary and the Director shall, to the extent practicable, consider the location of the eligible property to be purchased by the eligible applicant, including whether the eligible property is located in a rural or urban area, to ensure geographic diversity of such eligible properties.</text>
			</subsection><subsection id="H478FA28F334248CCBD6C5C5BEFC658FE"><enum>(f)</enum><header>Reports</header>
 <paragraph id="H491CCB760D2945A586AE40B23CE128F2"><enum>(1)</enum><header>Interim report</header><text>Not later than 90 days after the date of the enactment of this section, the Secretary and the Director shall submit to Congress an interim report describing the type of assistance the Secretary and the Director shall provide under the program established under this section.</text>
 </paragraph><paragraph id="H9D66F70358804C4A89392A5C8CA5067C"><enum>(2)</enum><header>Final report</header><text>Not later than 3 years after the date of the enactment of this section, the Secretary and the Director shall submit to Congress a final report that—</text>
 <subparagraph id="H618E5F160A744FCF8583C1EB5ED1530C"><enum>(A)</enum><text>evaluates the impact of the program carried out under this section and describes any findings;</text> </subparagraph><subparagraph id="HD632CF113F6A4F7CA9FB271041EF94C2"><enum>(B)</enum><text>identifies other types of assistance the Secretary and the Director may offer; and</text>
 </subparagraph><subparagraph id="H3F5585CB586E46538AD9C13A2D8A9EFC"><enum>(C)</enum><text>includes any recommendations the Secretary and Director may have for improving the program.</text> </subparagraph></paragraph></subsection><subsection id="H37AF91B9B43F49BA82B4637CA19E2E0D"><enum>(g)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="H3EC2052851F040149250700DB422F3DC"><enum>(1)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Federal Housing Finance Agency.</text> </paragraph><paragraph id="HAAFEAE39E6AB4FD88F70E1661741D867"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Department of Housing and Urban Development.</text>
 </paragraph><paragraph id="HCC187E571F6C4085A7ACFECD1EE4999D"><enum>(3)</enum><header>Eligible property</header><text>The term <quote>eligible property</quote> means a property that is designed as a dwelling for occupancy by 1 to 4 families—</text> <subparagraph id="HCD6E6EF9930341079421056A2AE35F8F"><enum>(A)</enum><text>that is safe and habitable, as defined by the Secretary and the Director;</text>
 </subparagraph><subparagraph id="H0E4349E9613D49E5A06F3025A7D70A55"><enum>(B)</enum><text>for which, as determined by the Secretary and the Director, the occupancy of which will promote community revitalization; and</text>
 </subparagraph><subparagraph id="H780456AFAC77427C87018AC474FFACC5"><enum>(C)</enum><text>that—</text> <clause id="HCF8F2123ED104402805E4357AB07A2B2"><enum>(i)</enum><text>was previously subject to a mortgage loan insured by the Federal Housing Administration under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707</external-xref> et seq.) and is owned by the Secretary pursuant to the payment of insurance benefits under such Act;</text>
 </clause><clause id="H7F1F756F02914FC288988CF4954869CD"><enum>(ii)</enum><text>is a real estate owned property of the Federal National Mortgage Association or the Federal Home Loan Mortgage Corporation; or</text>
 </clause><clause id="HF7CCE5EC86474C099EC2F9266AA2540B"><enum>(iii)</enum><text>is owned by a local land bank.</text> </clause></subparagraph></paragraph><paragraph id="HEFA25C1A9F9F4B8C93ACEAC6F7CBEA5E"><enum>(4)</enum><header>Local land bank</header><text display-inline="yes-display-inline">The term <quote>local land bank</quote> means—</text>
 <subparagraph id="H9C29E2C14BFC44DFA9EF7F2078459236"><enum>(A)</enum><text>a governmental or nongovernmental nonprofit entity established, at least in part, to assemble, temporarily manage, and dispose of vacant land for the purpose of stabilizing neighborhoods and encouraging re-use or redevelopment of urban property; or</text>
 </subparagraph><subparagraph id="H702FE5EBAFD14C4BBB3D550A8F907370"><enum>(B)</enum><text display-inline="yes-display-inline">such other governmental or nongovernmental entity as the Secretary and the Director may determine appropriate.</text>
 </subparagraph></paragraph></subsection><subsection id="H8E7F3B16692345EA97B962DD16CCBE0F"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as necessary to carry out this section for fiscal years 2021, 2022, and 2023.</text>
