			 or obtained for political advantage from foreign nationals, to require
			 political committees under such Act to acknowledge in writing that they
			 are aware of the provisions of such Act which prohibit the solicitation,
			 acceptance, or receipt of money and other things of value from foreign
			 nationals in elections, and for other purposes.</official-title></form>
	<legis-body id="H22FE026243524909B9AE3BA1BED7B99B" style="OLC">
 <section id="H46A1959996634D3887B839AA2E70AA7A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Foreign Election Assistance Act of 2019</short-title></quote>.</text> </section><section id="HCAE20660F24C408C9F897EA8621FFC78"><enum>2.</enum><header>Treatment of information sought or obtained for political advantage from foreign nationals</header> <subsection id="H6552636C34654572A62A6C6F59AE79A2"><enum>(a)</enum><header>Clarification of treatment as thing of value for purposes of foreign money ban</header><text display-inline="yes-display-inline">Section 319(a)(1)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(a)(1)(A)</external-xref>) is amended by striking <quote>or other thing of value</quote> and inserting <quote>or other thing of value (including information sought or obtained for political advantage)</quote>.</text>
			</subsection><subsection id="H2C1C4B0BED2540FB82E27FA986DB3CD2"><enum>(b)</enum><header>Enhanced penalty for violation</header>
 <paragraph id="HAA1187F5FD274A509F6DAF57F62ACE72"><enum>(1)</enum><header>In general</header><text>Section 309(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30109">52 U.S.C. 30109(d)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HFDB85E632C43404FB8680D5E15CE572D" style="traditional">
 <subparagraph id="H89419F879AEC406C87E4531AC99E70EF" indent="up2"><enum>(E)</enum><text display-inline="yes-display-inline">Any person who knowingly and willfully commits a violation of section 319 which involves the making, solicitation, acceptance, or receipt of any contribution, donation, or expenditure involving information sought or obtained for political advantage, shall be fined under title 18, United States Code, or imprisoned for not more than 5 years, or both.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H0D4BDEF9C6814BF69E833E5E841FF98F"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply with respect to contributions, donations, and expenditures which are made, solicited, accepted, or received on or after the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="H24F29473A9BA412E86496C8DAC400FA6"><enum>3.</enum><header>Requiring acknowledgment of foreign money ban by political committees</header>
 <subsection id="HB1B25FD996A84BF39E7A34F5012C50ED"><enum>(a)</enum><header>Provision of information by Federal Election Commission</header><text display-inline="yes-display-inline">Section 303 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30103">52 U.S.C. 30103</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H34507574681D47FC89B9F8945231061A" style="OLC">
					<subsection id="HCE8B72D7AB884A11A35AC3B60AA7EB7F"><enum>(e)</enum><header>Acknowledgment of foreign money ban</header>
 <paragraph id="H56E715EFBEF74946A52738EA46517230"><enum>(1)</enum><header>Notification by Commission</header><text display-inline="yes-display-inline">Not later than 30 days after a political committee files its statement of organization under subsection (a), and biennially thereafter until the committee terminates, the Commission shall provide the committee with a written explanation of section 319.</text>
						</paragraph><paragraph id="H06F59BC9486C4D20B9F4F6D726960FD1"><enum>(2)</enum><header>Acknowledgment by committee</header>
 <subparagraph id="HC5DED064CCD34652B3B25E60492A8583"><enum>(A)</enum><header>In general</header><text>Not later than 30 days after receiving the written explanation of section 319 under paragraph (1), the committee shall transmit to the Commission a signed certification that the committee has received such written explanation and has provided a copy of the explanation to all members, employees, contractors, and volunteers of the committee.</text>
 </subparagraph><subparagraph id="H8EC4643255184D8793515BDB3D0082C3"><enum>(B)</enum><header>Person responsible for signature</header><text>The certification required under subparagraph (A) shall be signed—</text> <clause id="HFC79457BCC1C46359915F83E86466A8B"><enum>(i)</enum><text>in the case of an authorized committee of a candidate, by the candidate; or</text>
 </clause><clause id="HA01BBEB52BBF4D0F83BE334193D89ADD"><enum>(ii)</enum><text>in the case of any other political committee, by the treasurer of the committee.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H760ADB54673D424EBACC01518C4E1249"><enum>(b)</enum><header>Effective date; transition for existing committees</header> <paragraph id="H9B19E16BDD954B91BB1029DAEBF57EA1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to political committees which file statements of organization under section 303 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30103">52 U.S.C. 30103</external-xref>) on or after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="HFA022DB960914AF89C79F01D19915A79"><enum>(2)</enum><header>Transition for existing committees</header>
 <subparagraph id="H8A2D024755A842748ECB9FD1AC45C545"><enum>(A)</enum><header>Notification by Federal Election Commission</header><text>Not later than 90 days after the date of the enactment of this Act, the Federal Election Commission shall provide each political committee under such Act with the written explanation of section 319 of such Act, as required under section 303(e)(1) of such Act (as added by subsection (a)).</text>
 </subparagraph><subparagraph id="H9FA56CCA5DD64C11BA7EF2620500FA6C"><enum>(B)</enum><header>Acknowledgment by committee</header><text>Not later than 30 days after receiving the written explanation under subparagraph (A), each political committee under such Act shall transmit to the Federal Election Commission the signed certification, as required under section 303(e)(2) of such Act (as added by subsection (a)).</text>
