 </subsection></section><section id="H5E9F356AD4C445F782A88F80E00C3402"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2101 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref>) is amended—</text> <paragraph id="H187092B0F4494E4FBF26A7DE64CB334A"><enum>(1)</enum><text>in paragraph (4)(E), by striking <quote>subject to regulation</quote> and inserting <quote>regulated</quote>;</text>
 </paragraph><paragraph id="HF9475D358D3B40FB97AE71F963889D25"><enum>(2)</enum><text>in paragraph (5)—</text> <subparagraph id="HE9CE3278498F46429B5CABA4536EFC2B"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>that is in effect on the day before the date of enactment of the Protecting and Securing Chemical Facilities from Terrorist Attacks Act of 2014;</quote> and inserting <quote>or this title</quote>; and</text>
 </subparagraph><subparagraph id="HA8720D079E804E93BB9868B3B1DC07B3"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>that is in effect on the day before the date of enactment of the Protecting and Securing Chemical Facilities from Terrorist Attacks Act of 2014;</quote> and inserting <quote>or this title</quote>;</text>
 </subparagraph></paragraph><paragraph id="HC2C4BFF742AD40298298667E7C6EEBB0"><enum>(3)</enum><text>by striking paragraphs (6), (7), and (8); and</text> </paragraph><paragraph id="H26DFBAC3734E41CBB294F7591416A9C9"><enum>(4)</enum><text>by redesignating paragraphs (9) through (14) as paragraphs (6) through (11), respectively.</text>
			</paragraph></section><section id="HFC5285767DB54662914EEA01258F6D4B"><enum>3.</enum><header>Chemical Facility Anti-Terrorism Standards Program</header>
 <subsection id="H9E4EAAD2B4414CBFBC931840D384B6D2"><enum>(a)</enum><header>Additional CFATS program requirement</header><text>Section 2102(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/622">6 U.S.C. 622</external-xref>) is amended—</text> <paragraph id="HCAC9B4C7A8C54EDD8B3F88C5DC5DC6C5"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="H6C70F54F7F3249B9B97E27D0BFD0D0C6"><enum>(2)</enum><text>in subparagraph (D), by striking the period and inserting a semicolon; and</text> </paragraph><paragraph id="H32BCE70D4D7449028F0CD748590221CF"><enum>(3)</enum><text>by adding at the end the following new subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H4E4E8217C04242739AA9BC8972C7C5FC" style="OLC">
 <subparagraph id="H815F37A2214041A086A10E0B96AB7DB2"><enum>(E)</enum><text display-inline="yes-display-inline">verify information submitted by a covered chemical facility prior to assigning such facility a lower risk tier or determining that such facility no longer presents a high level of security risk; and</text>
 </subparagraph><subparagraph id="H80BA50ECD420412C8A0228DFA4A3C96F"><enum>(F)</enum><text display-inline="yes-display-inline">develop a voluntary program for chemical facilities to address potential security risks at such facilities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HB72078BA6BC64273B568829270A1FDDA"><enum>(b)</enum><header>Employee input regarding security measures</header><text>Paragraph (2) of subsection (b) of section 2102 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/622">6 U.S.C. 622</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H568EB15C8E924C86B664976E768DBBD4" style="OLC">
					<paragraph id="H76356135DD6E4E8C9C59D44A4ED87086"><enum>(2)</enum><header>Employee consultation and awareness</header>
 <subparagraph id="H1A373E8BBAA84961A18B8FC4B100FF2C"><enum>(A)</enum><header>Employee consultation requirement</header><text display-inline="yes-display-inline">A facility’s security vulnerability assessment and site security plan shall be developed in consultation with—</text>
 <clause id="H8921C0F64BA34812A510C4D84B7AA89A"><enum>(i)</enum><text display-inline="yes-display-inline">at least one facility employee, in addition to the facility security officer or other individual who serves as a point of contact under section 27.230(a)(17) of title 6, Code of Federal Regulations, and the corresponding guidance issued under section 27.220(d) of such title, or any successor thereto, who possesses relevant knowledge, experience, training, or education pertaining to matters of site security; and</text>
 </clause><clause id="H938FBBEC10904EBD821B5615F3BC9D08"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a facility where facility employees are represented by a bargaining agent, at least one employee representative who—</text>
 <subclause id="H92617189F9A74192B1312DF5FEEE6A94"><enum>(I)</enum><text>is selected by the bargaining agent at that facility; and</text> </subclause><subclause id="HF136F99404644EEE9A2AF933A7343009"><enum>(II)</enum><text>has relevant knowledge, experience, training, or education pertaining to matters of site security.</text>
 </subclause></clause></subparagraph><subparagraph id="H8EC76360D3564447A000CE1A61644C4B"><enum>(B)</enum><header>Record of employee consultation</header><text display-inline="yes-display-inline">A covered chemical facility shall maintain a written record of the employee consultation required by subparagraph (A), including a record of—</text>
 <clause id="H4509138A3BCC452B9B6E09F879F8D461"><enum>(i)</enum><text>the name of the employee with whom the facility security officer or other similar official consulted;</text>
 </clause><clause id="HAA7BE1352125478AAC88B1887C6E6B9D"><enum>(ii)</enum><text>how often and when such consultation took place;</text> </clause><clause id="H2C209353A9704F7A9478B6C3E2D6033A"><enum>(iii)</enum><text>what mechanisms the facility used to capture feedback; and</text>
 </clause><clause id="HD34771B48DF7448CA57A55DA7E99751C"><enum>(iv)</enum><text>any recommendations that were offered, accepted, or rejected as part of the security vulnerability assessment or site security plan.</text>
 </clause></subparagraph><subparagraph id="HCA56F328B2A64542A282761B7CB33340"><enum>(C)</enum><header>Access to employees</header><text display-inline="yes-display-inline">Each owner or operator of a covered chemical facility shall, upon request, provide to an employee of the Department engaged in carrying out audits and inspections of such facility access to any employee who participated in the development of the facility’s security vulnerability assessment and site security plan.</text>
 </subparagraph><subparagraph id="H6869342643644A9084EEBBC1328B0060"><enum>(D)</enum><header>Employee awareness</header><text display-inline="yes-display-inline">The Secretary shall produce a poster for display in areas of covered chemical facilities and chemical facilities of interest shall be required to display that are accessible to facility employees to inform employees of the facility about program requirements under this title and the whistleblower protections provided under section 2105.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCC3DDBFB62914561827C39640EE749C2"><enum>(c)</enum><header>Site security plans</header>
 <paragraph id="HFE189E1F50F14532AADDCA3703BB1872"><enum>(1)</enum><header>Disapproval</header><text display-inline="yes-display-inline">Subsection (c)(1)(B) of section 2102 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/622">6 U.S.C. 622</external-xref>) is amended—</text> <subparagraph id="HF71A05D3BBAB4A9B825B7EF7B0B1A76D"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> at the end; and</text>
 </subparagraph><subparagraph id="H478FA49440B44E14BC78EB2DF3DB9EE8"><enum>(B)</enum><text>by amending clause (ii) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HE5716004BB48479ABDCA7307AD7A3B11" style="OLC"> <clause id="H2827051F6CA34DD790B82B8199E667E4"><enum>(ii)</enum><text display-inline="yes-display-inline">shall disapprove a site security plan if—</text>
 <subclause id="H49CF71F1611748E48763AFE698A493A8"><enum>(I)</enum><text display-inline="yes-display-inline">the plan fails to satisfy the risk-based performance standards established pursuant to subsection (a)(2)(C); or</text>
 </subclause><subclause id="HA2E33B54EA334B0F8BC6E79659D039E0"><enum>(II)</enum><text display-inline="yes-display-inline">the plan fails to include the name, organizational affiliation, and phone number of a local emergency manager or local emergency response provider and a documented policy to contact the local emergency manager or local emergency response provider at least annually regarding emergency response procedures at the facility.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H289212BD8794498D82198483AC30D4D7"><enum>(2)</enum><header>Assessments</header><text display-inline="yes-display-inline">Paragraph (3) of subsection (c) of such section is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H51FD81594D924A1EA40B6DE77C0D3A7A" style="OLC"> <paragraph id="HCF21D4C328004AD5A613F7AF73CEF3FD"><enum>(3)</enum><header>Site security plan assessments</header><text display-inline="yes-display-inline">In approving or disapproving a site security plan under this subsection, the Secretary shall—</text>
 <subparagraph id="HC7044159925A4F05870A80DA414FDE53"><enum>(A)</enum><text display-inline="yes-display-inline">employ the risk assessment policies and procedures developed under this title; and</text> </subparagraph><subparagraph id="HC4BFFF219E97439D9B3A32DAB152B211"><enum>(B)</enum><text display-inline="yes-display-inline">confirm that the covered chemical facility has complied with the employee consultation requirements in paragraph (2) of subsection (b), including by reviewing and recording compliance with the record-keeping requirements under subparagraph (B) of that paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HEC7A8B282EDE4549AB93BF07DED4E4C7"><enum>(d)</enum><header>Elimination of expedited approval program</header><text>Section 2102(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/622">6 U.S.C. 622</external-xref>) is amended by striking paragraph (4).</text> </subsection><subsection id="HC3CE99C2A88E4582A1D1E7675F1F5AF4"><enum>(e)</enum><header>Audits and inspections</header> <paragraph id="H2B689FDAB2174BCDA831A709D487BDA9"><enum>(1)</enum><header>Authority to conduct</header><text>Subparagraph (B) of paragraph (1) of subsection (d) of section 2102 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/622">6 U.S.C. 622</external-xref>) is amended by striking <quote>under this title using</quote> and inserting <quote>at chemical facilities of interest and covered chemical facilities and shall obtain information and records to ensure compliance with this title. Such audits and inspections shall be conducted using</quote>.</text>
 </paragraph><paragraph id="H0C69D060D411495DBFA7728AF11F2DA1"><enum>(2)</enum><header>Reporting structure</header><text>Subparagraph (D) of such paragraph is amended—</text> <subparagraph id="HF30C5B1AA992412B85FBF032F7F3CA40"><enum>(A)</enum><text>in clause (i), by inserting <quote>, or any successor organization that implements the requirements of subsection (a)(2),</quote> after <quote>Department</quote>; and</text>
 </subparagraph><subparagraph id="H7AA038A0D38F419B942F4957BA7E3F63"><enum>(B)</enum><text>in clause (ii), by inserting <quote>, or any successor organization that implements the requirements of subsection (a)(2),</quote> after <quote>Department</quote>.</text> </subparagraph></paragraph><paragraph id="H1C14E7DE5CA94A5DB05EC0C005D477FF"><enum>(3)</enum><header>Standards for auditors and inspectors</header><text display-inline="yes-display-inline">Subparagraph (E) of such paragraph is amended—</text>
 <subparagraph id="H4F0D127BC94144E8AADCE865F4156D64"><enum>(A)</enum><text>in the matter preceding clause (i)—</text> <clause id="HD54C4A81B1824C6EA60E362CE24C2AF7"><enum>(i)</enum><text>by striking <quote>The Secretary</quote> and inserting <quote>For each individual responsible for carrying out audits or inspections on behalf of the Secretary, the Secretary</quote>;</text>
 </clause><clause id="H5BCBCB75F4B64D7FABDF497D0E04CF8D"><enum>(ii)</enum><text>by inserting <quote>to ensure such individuals receive</quote> before <quote>the training</quote>; and</text> </clause><clause id="HF707218C421841908101109B051BC103"><enum>(iii)</enum><text>by striking <quote>and retraining of each individual used by the Department as an auditor or inspector, including each individual employed by the Department and all nondepartmental or nongovernmental personnel</quote> and inserting <quote>, continuing education, and other professional development tools necessary to carry out duties and responsibilities</quote>; and</text>
 </clause></subparagraph><subparagraph id="H341F635BBE264990AB13D0E36F9A3470"><enum>(B)</enum><text>in clause (i), by striking <quote>requirements</quote> and inserting <quote>necessary to audit and inspect compliance with all aspects of the risk-based performance standards, including standards related to cybersecurity,</quote>.</text>
 </subparagraph></paragraph><paragraph id="H1537D268694F425C9C50DDEAD6C5A9B1"><enum>(4)</enum><header>Emergency response plans</header><text>Such subsection is further amended by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H195D725237174A8D8A30C0FCA297B180" style="OLC"> <paragraph id="HF7C507D0CB6A47C8B50428A8DFD3FBA4"><enum>(4)</enum><header>Audit of emergency response plan</header><text display-inline="yes-display-inline">As part of the audit and inspection process under this subsection, the Secretary shall provide for an annual review of the compliance of a chemical facility with the requirements under subsection (c)(1)(B)(ii)(B) and the adherence of the facility to the emergency response requirements under such subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HD432E71FA9FF46A4A70825B48CCB2864"><enum>(f)</enum><header>Risk assessment</header><text>Section 2102(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/622">6 U.S.C. 622(e)</external-xref>) is amended—</text> <paragraph id="HBAD74C7720E34226B0E862267EEB1C99"><enum>(1)</enum><text>in paragraph (2)(B)—</text>
 <subparagraph id="HCF074D99059D4656B2793D59ED8F6FD6"><enum>(A)</enum><text>in the matter preceding clause (i), by inserting <quote>and other malicious acts</quote> after <quote>terrorism</quote>; and</text> </subparagraph><subparagraph id="HEEC093711D9943C989C223E6BB14C824"><enum>(B)</enum><text>in clause (ii), by striking <quote>severe economic consequences and the potential loss of human life in the event of the facility being subject to attack, compromise, infiltration, or exploitation by terrorists</quote> and inserting <quote>consequences in event of the facility being subject to attack, compromise, infiltration, or the exploitation of chemicals of interest by a terrorist or other malicious actor</quote>;</text>
 </subparagraph></paragraph><paragraph id="H519F5DE0FADF49D587A6553CB4A7DD9E"><enum>(2)</enum><text>in paragraph (3)—</text> <subparagraph id="HBA7FA07087764FF99E9BEFCF7993121B"><enum>(A)</enum><text>in subparagraph (A)—</text>
 <clause id="H7A4691A4E66F4858A3B4CEDA38C2AA05"><enum>(i)</enum><text>by redesignating clauses (i) and (ii) as clauses (ii) and (iii), respectively;</text> </clause><clause id="HDC0ED76503B54923BC3EF0EAB015A4DB"><enum>(ii)</enum><text>by inserting before clause (ii), as so redesignated, the following new clause (i):</text>
							<quoted-block display-inline="no-display-inline" id="H384CB395807C4EA5B85FA73E8BFE5AC1" style="OLC">
 <clause id="HD9C50777BB8F4B74817C2DF77E7CEE54"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary determines that a chemical facility of interest does not present a high level of security risk;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="H044B251D75464200947E0600780EC12C"><enum>(iii)</enum><text>in clause (iii), as so redesignated, by inserting <quote>or chemical facility of interest</quote> after <quote>covered chemical facility</quote>;</text> </clause></subparagraph><subparagraph id="H8539200CCEE74A3DAEE55FBEA3FA89B3"><enum>(B)</enum><text>in subparagraph (B)—</text>
 <clause id="H9BDBADD3711541BDA9A2581C9357982E"><enum>(i)</enum><text>by striking <quote>information on</quote> and all that follows and inserting <quote>information on—</quote>; and</text> </clause><clause id="H19886A74BCFC4C908A764602B69C6819"><enum>(ii)</enum><text>by adding at the end the following clauses:</text>
							<quoted-block display-inline="no-display-inline" id="H4A9C1C0B4AB146AC9CFC0F8C6D81D32A" style="OLC">
 <clause id="H5CC8877F444E44E99F97F106845564B3"><enum>(i)</enum><text display-inline="yes-display-inline">how the Secretary confirmed the information that was the basis for the change or determination described in subparagraph (A); and</text>
 </clause><clause id="H962E6FB3CEDC429F87895EAF9382CA7E"><enum>(ii)</enum><text display-inline="yes-display-inline">actions taken or practices employed by the facility to reduce or remove terrorism-related chemical security risks, where applicable.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="HBC30347ED90844018D2DCD62D06EE7E1"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H038A05A0E7D04A1DBC3D65053CB1B5E8" style="OLC"> <subparagraph id="H12C19A2664364906AD0C6A11924D1213"><enum>(C)</enum><header>Treatment of certain information</header><text display-inline="yes-display-inline">For the purposes of subsection (a) of section 2103—</text>
 <clause id="H12894D51B8264C12ABB70E39BC0A6801"><enum>(i)</enum><text display-inline="yes-display-inline">information described in subparagraph (B)(i) shall be given protections from public disclosure under such subsection; and</text>
 </clause><clause id="HD34EFD94B1214664AD20351407AE7C39"><enum>(ii)</enum><text display-inline="yes-display-inline">information described in subparagraph (B)(ii) shall not be given protections from public disclosure under such subsection.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H9B8DA52AB1AE4A0EA890E9DC1FA08055"><enum>(3)</enum><text>by redesignating paragraph (4) as paragraph (6);</text> </paragraph><paragraph id="H3BEF6C4F9F1340F28C9701ACB6B5AC55"><enum>(4)</enum><text>by inserting after paragraph (3) the following new paragraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H9CB1B2844DB74CE59CB7F45E5E7B6DA3" style="OLC">
						<paragraph id="HF5916D83AED5458DBAEED536690B4AC1"><enum>(4)</enum><header>Sharing information with emergency response providers</header>
 <subparagraph id="H5053EE77CE5A4CCEB6104D4E88B1F08C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make available to State, local, and regional fusion centers (as that term is defined in section 210A(j)(1) of this Act) and State and local government officials such information as the Secretary determines necessary to ensure that emergency response providers are prepared and provided with the situational awareness needed to respond to security incidents at covered chemical facilities.</text>
 </subparagraph><subparagraph id="HE32B1099D22A4F27980D5F4D4C104476"><enum>(B)</enum><header>Dissemination</header><text display-inline="yes-display-inline">The Secretary shall disseminate information under subparagraph (A) to individuals identified and entities described in such subparagraph in a secure and expeditious manner.</text>
							</subparagraph></paragraph><paragraph id="HCF24A67949F644DB9CCEF3C41AA0A51A"><enum>(5)</enum><header>Practices that may reduce chemical security risks</header>
 <subparagraph id="H5A1FA8C25ABC44F7B0F08DD3771D3F55"><enum>(A)</enum><header>In general</header><text>Based on the information maintained under paragraph (3)(B)(ii) regarding actions taken or practices employed by chemical facilities of interest to successfully reduce or remove terrorism-related chemical security risks, the Secretary shall develop voluntary, publicly available practices that could be used to guide other facility owners and operators in preventing, reducing, and mitigating chemical security risks.</text>
 </subparagraph><subparagraph id="H2AFE0BFF022C4ACD88ADA21442D5081B"><enum>(B)</enum><header>Treatment of sensitive information</header><text>In developing and disseminating practices under subparagraph (A), the Secretary shall protect from public disclosure all information described in section 2103(a).</text>
							</subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H478D54B9EC0D4405BF13B0E0E4456D63"><enum>(5)</enum><text>in paragraph (6), as redesignated by paragraph (3) of this subsection—</text> <subparagraph id="H637A0C44952148CD800F2013701BDC70"><enum>(A)</enum><text>in subparagraph (B)(i)—</text>
 <clause id="H6C59F55C3F3643E3967D45CDBCE0E501"><enum>(i)</enum><text>in subclause (aa), by striking <quote>or</quote> at the end;</text> </clause><clause id="H8487B04FF87F47D8B771A376CFC86E98"><enum>(ii)</enum><text>in subclause (bb), by striking <quote>and</quote> and inserting <quote>or</quote>; and</text>
 </clause><clause id="H3E7D2072932F445383722A3F663BC92B"><enum>(iii)</enum><text>by adding at the end the following new subclause:</text> <quoted-block display-inline="no-display-inline" id="H19FF5530578C4DBF9FB7E9330156210D" style="OLC"> <subclause id="H188A6C37606D4779880BB50370133405"><enum>(cc)</enum><text display-inline="yes-display-inline">determined that a chemical facility of interest did not present a high level of risk; and</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="HE01FED6586454295BA56A391E2E374F0"><enum>(B)</enum><text>by amending subparagraph (C) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H7E562DA21D8F4DA68EB9A2D9D8C7EE74" style="OLC"> <subparagraph id="H46627034879A4CD7866CE3F4D0B2F1CB"><enum>(C)</enum><text display-inline="yes-display-inline">for the period beginning on the date that is one year before the date of the enactment of the Protecting and Securing Chemical Facilities from Terrorist Attacks Act of 2019 and ending on the date of the enactment of such Act, the average length of time required to—</text>
 <clause id="HA4E22B00AFF8433EB0C04C3B88494324"><enum>(i)</enum><text display-inline="yes-display-inline">review and approve site security plans or alternative security programs for covered chemical facilities;</text>
 </clause><clause id="H855492154E5C4D7FAB38248FAE381153"><enum>(ii)</enum><text>ensure a facility has achieved full implementation of planned security measures; and</text> </clause><clause id="HCA0C94C6532E435EBFE3A3E2574E273F"><enum>(iii)</enum><text>conduct a compliance inspection, including the average length of time inspectors spend on an individual compliance inspection;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H2FC967A354604026AD8316B6B3D75002"><enum>(C)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="H80401693738D48B386B04CA3BDF2B5D9"><enum>(D)</enum><text>by redesignating subparagraph (F) as subparagraph (I); and</text>
 </subparagraph><subparagraph id="H8689AD97290042FA8005D194924C6F4B"><enum>(E)</enum><text>by inserting after subparagraph (E) the following new subparagraphs:</text> <quoted-block display-inline="no-display-inline" id="H3200EAEFDD6946CFB6FD52DAA1923DBC" style="OLC"> <subparagraph id="HCE515C0A61604E8295852991866A2428"><enum>(F)</enum><text display-inline="yes-display-inline">a detailed summary of reports and other information generated under paragraph (3) regarding facilities that receive a change in tier or that are determined not to present a high level of security risk;</text>
 </subparagraph><subparagraph id="H70BFFE04AD2D42D795C10DE301E69E7E"><enum>(G)</enum><text display-inline="yes-display-inline">a detailed summary of practices identified and disseminated under such paragraph;</text> </subparagraph><subparagraph id="H364AE7E8C5834731BAAF14C7E268E5AA"><enum>(H)</enum><text display-inline="yes-display-inline">actions taken and results produced in implementing the practices, to the extent feasible; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="H0E017ECDD15749BFBAA3AD1CFCF8D098"><enum>(g)</enum><header>Specific products and mixtures</header><text>Such section (<external-xref legal-doc="usc" parsable-cite="usc/6/622">6 U.S.C. 622</external-xref>) is further amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HD8DBEE9FC2874CD5AFF37B778E0FB7A8" style="OLC"> <subsection id="HBD2D420D82FC42A99C0F93A73F3CEBEE"><enum>(f)</enum><header>Specific products and mixtures containing chemicals of interest</header><text display-inline="yes-display-inline">The Secretary may exclude a specific product or mixture that contains a chemical of interest at or above the minimum concentration listed on Appendix A to part 27 of title 6, Code of Federal Regulations, or any successor thereto, from any reporting requirements under this section if the Secretary determines that the product or mixture does not present a risk for which the chemical of interest contained within the product or mixture was included on Appendix A.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H673D88533FA142A5BBD1826679956962"><enum>4.</enum><header>Protection and sharing of information</header>
 <subsection id="HCBCD03EF0C544ED98EE4F680335571B0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2103(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/623">6 U.S.C. 623(a)</external-xref>) is amended—</text> <paragraph id="HECCF90A9BC29481A9E97028BDB35DBD9"><enum>(1)</enum><text>by inserting <quote>with respect to information in the possession of the Department, the Secretary shall protect</quote> after <quote>any other provision of law,</quote>;</text>
 </paragraph><paragraph id="H30DB497EA3AD4D0C83458B62040C53FA"><enum>(2)</enum><text>by striking <quote>information,</quote>;</text> </paragraph><paragraph id="H65D4E44C3BF34F41A0405D3F928F070F"><enum>(3)</enum><text>by striking the comma after <quote>records</quote>; and</text>
 </paragraph><paragraph id="H04750B3CA1E3486EB8B14EA941779A5D"><enum>(4)</enum><text>by striking <quote>shall be given protections</quote>.</text> </paragraph></subsection><subsection id="H619520E1E1964672A263B1BCEA4C562F"><enum>(b)</enum><header>Authorized recipients</header><text>Such section is further amended—</text>

 </subparagraph><subparagraph id="H119255BAF34247A39C430F83386CE304"><enum>(B)</enum><text>Members of Congress.</text> </subparagraph><subparagraph id="H4A9B1885DBAD4FA8866D695AD24276F8"><enum>(C)</enum><text>Members of the Chemical Security Advisory Committee under section 2010 of this Act.</text>
 </subparagraph><subparagraph id="HB286B524973940FBAD8100539C0AE452"><enum>(D)</enum><text>The Comptroller General of the United States.</text> </subparagraph></paragraph><paragraph id="H84B2083022EB4C96B71D535F94BFA4A0"><enum>(2)</enum><header>Nondepartmental information</header><text>Information is not protected pursuant to subsection (a) if it is—</text>
 <subparagraph id="HD901071C2F8A4A89AE13FA1B5F7C7616"><enum>(A)</enum><text>not in the possession of the Department;</text> </subparagraph><subparagraph id="H337B31A734C34A46A8039E15316637FD"><enum>(B)</enum><text>developed under this title but has been previously produced or developed for other purposes; and</text>

 <subparagraph id="H05A702C978EA4C5DA65958862D5AA6AF"><enum>(A)</enum><text>in paragraph (1), by striking <quote>Not later than 180 days after the date of enactment of the Protecting and Securing Chemical Facilities from Terrorist Attacks Act of 2014, the Secretary</quote> and inserting <quote>The Secretary</quote>;</text>

 <clause id="H86ABB8965CC6445CBF7E72C3168613F3"><enum>(i)</enum><text>the Secretary shall keep confidential the identity of and any identifying information relating to that individual; and</text>
 </clause><clause id="H62E32C7614C745048484893C3ACC5C3C"><enum>(ii)</enum><text>any such report shall be subject to the protections on information under section 2103 of this Act to the extent that the report does not consist of publicly available information.</text>
 </clause></subparagraph><subparagraph id="H04C08D50870D4D748BF9DBBDAE7CC91A"><enum>(B)</enum><header>Notice</header><text display-inline="yes-display-inline">In a case in which it is necessary to disclose the identity of or any identifying information relating to an individual who submits a report under paragraph (1) because it is essential to investigate the information contained in the report or because of compulsory legal process, the Secretary shall provide timely advance notice to the individual of such disclosure.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HB1E5DCAEED6E4679BCE1290BFCBC8AFB"><enum>(C)</enum><text>by amending paragraph (3) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H1371413AF19349EF8F2E2CC82823F510" style="OLC"> <paragraph id="H994D2D20E8F94E18B7F8A7B9081E455A"><enum>(3)</enum><header>Response to reports</header><text display-inline="yes-display-inline">If a report submitted under paragraph (1) contains information identifying the individual making the report, the Secretary, or the designee of the Secretary shall, by not later than 15 days after the date on which the report is received, respond to the individual directly and acknowledge receipt of the report.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H6A59CF928C0D4800B415F1C22BAB1347"><enum>(D)</enum><text>in paragraph (5)—</text> <clause id="HC4560674AE804765A0E0806CC57AD389"><enum>(i)</enum><text display-inline="yes-display-inline">by amending subparagraph (C) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H3A1B2B87027D464695CCEBEF8BC50971" style="OLC">
 <subparagraph id="H8845EF053E074E1296F7BFC44DFB1B10"><enum>(C)</enum><header>Opportunity for review</header><text display-inline="yes-display-inline">In any action under paragraph (4) that is based on information received under the procedure established under paragraph (1), the Secretary shall provide for review of the action if a petition for review is filed within 20 calendar days of the date of issuance of the order for the action.</text>
							</subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="HBA87102B8C084BCCB81504EB3388A9EF"><enum>(ii)</enum><text>in subparagraph (D)—</text> <subclause id="H9A2CEF8D6A4A4547AD8D3743868329E6"><enum>(I)</enum><text>by striking <quote>unless the Secretary determines</quote> and inserting <quote>, except that the Secretary may provide for a 30-day extension if the Secretary determines</quote>;</text>
 </subclause><subclause id="HE84DC332108B4184A6656E130F46A8A4"><enum>(II)</enum><text>by striking <quote>that the violation providing a basis for the action continues to exist.</quote> and inserting <quote>that—</quote>; and</text> </subclause><subclause id="H3145FEB59369444A80E1AA119797A46A"><enum>(III)</enum><text>by adding at the end the following new clauses:</text>

 <subclause id="H80B4931611384D90AE039771D98AD35F"><enum>(I)</enum><text>by striking <quote>discharge an employee or otherwise discriminate against an employee with respect to the compensation provided to, or terms, conditions, or privileges of the employment of, the employee because the employee (or an individual acting pursuant to a request of the employee) submitted a report under paragraph (1).</quote> and inserting <quote>discharge an employee or otherwise discriminate against an employee or former employee with respect to the compensation provided to, or terms, conditions, or privileges associated with current or past employment of, the employee or former employee because the employee or former employee (or an individual acting pursuant to a request of the employee or former employee) submitted a report under paragraph (1).</quote>;</text>
 </subclause></clause><clause commented="no" id="H4DDCA60EB3264EE2A76CABFA812019D6"><enum>(ii)</enum><text>in subparagraph (B), in the matter preceding clause (i), by—</text> <subclause commented="no" id="HFD55A49A5CF041319B4670A71E257C4A"><enum>(I)</enum><text>inserting <quote>or former employee</quote> after <quote>An employee</quote>; and</text>
 </subclause><subclause commented="no" id="H44452C45798A4C899ECD843F66495D9C"><enum>(II)</enum><text>inserting <quote>or former employee (or an individual acting pursuant to a request of the employee or former employee)</quote> after <quote>the employee</quote>; and</text>
 </subclause></clause><clause id="H53F1255F8F2E4584A146AF99B89745B2"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H02040083056543B0A7BE3A49DDE883F1" style="OLC"> <subparagraph id="HD354627EDF014C9CA0EAEEF4247CF426"><enum>(C)</enum><header>Procedure and remedy</header> <clause id="H03295DF24B104D6CBAA7749ED1128482"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a procedure for the review and investigation of complaints of reprisals prohibited under subparagraph (A) and for remedies for violations of such subparagraph.</text>
 </clause><clause id="H967E29DAEC4D4E0BA761A8120E959B8A"><enum>(ii)</enum><header>Judicial remedies</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to deny an individual who submits a complaint for any reprisal prohibited under subparagraph (A) from seeking a judicial remedy against the owner or operator of the chemical facility of interest as long as the individual has exhausted administrative remedies.</text>
								</clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph></paragraph><paragraph id="H300E5037D5F04230B76888AEF33401A6"><enum>(2)</enum><text>by striking subsection (d).</text> </paragraph></section><section id="H7FD78715B2BC446BBCC435AE67B1389E"><enum>7.</enum><header>Chemical Security Advisory Committee</header> <subsection id="H397CB131A81E46699E63F28D7943C984"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title XXI of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref> et seq.) is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H588A6AD6EE634FCB80C502887F93B71A" style="OLC">
					<section id="H50AAE91321174C9F9FE15548E50AB1F3"><enum>2110.</enum><header>Chemical Security Advisory Committee</header>
 <subsection id="HA9C8DA31A35B49F28C3A5499931DCC0B"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a standing Chemical Security Advisory Committee to advise the Secretary on the implementation of this title.</text>
						</subsection><subsection id="H6C50D00083C9482E87BDB8150777BFBE"><enum>(b)</enum><header>Membership</header>
 <paragraph id="H7A63CC26A5D4477091CC57CB73578520"><enum>(1)</enum><header>In general</header><text>The Advisory Committee shall be comprised of 12 members selected by the Secretary, which shall include at least one individual who is a multi-disciplinary stakeholder with scientific or other expertise representing each of the following:</text>
 <subparagraph id="H9C792B61B6EE430B94EAF552EF1D604A"><enum>(A)</enum><text>Industry.</text> </subparagraph><subparagraph id="HCD10F388DFF1460B9163A78A498FA4FB"><enum>(B)</enum><text>Academia.</text>
 </subparagraph><subparagraph id="H433DE09911534FB98C51483FCD8B9B50"><enum>(C)</enum><text>Labor.</text> </subparagraph><subparagraph id="HD2D5FBDE87564595A155E757B387B1D4"><enum>(D)</enum><text>Emergency response providers.</text>
 </subparagraph><subparagraph id="H37232784EBAB4916A5598D2522AC51F2"><enum>(E)</enum><text>Local emergency planners.</text> </subparagraph><subparagraph id="H92053F6B93B24BA89D5FA08C2079581F"><enum>(F)</enum><text display-inline="yes-display-inline">Environmental, community, or public health advocates, particularly for communities with high concentrations of covered chemical facilities.</text>
 </subparagraph><subparagraph id="H23C07910BB354F189D5B47D7856383E0"><enum>(G)</enum><text>Cybersecurity and information policy.</text> </subparagraph></paragraph><paragraph id="H0CE6947270324AB3B6FF79024D08B69E"><enum>(2)</enum><header>Terms</header><text>Each member shall be appointed for an initial term of three years and may be reappointed for one additional three-year term.</text>
 </paragraph><paragraph id="H440C809D960444C7B859091F8449EF5D"><enum>(3)</enum><header>Chair</header><text>The Committee shall have a chair, who shall be selected by the members of the Committee.</text> </paragraph><paragraph id="HD2E253DBD2A14B979E94B62BDC75449E"><enum>(4)</enum><header>Pay</header><text>Members shall serve without pay.</text>
 </paragraph><paragraph id="HE553B095215B4F35B7951C666D2BE058"><enum>(5)</enum><header>Quorum</header><text>A majority of members of the Advisory Committee shall constitute a quorum but a lesser number may hold hearings.</text>
 </paragraph></subsection><subsection id="HA69664A8E7E8467A94BEE32E6BE4AD67"><enum>(c)</enum><header>Subcommittees</header><text display-inline="yes-display-inline">The Advisory Committee may establish subcommittees to assesses and recommend improvements to the risk tiering methodology for chemical facilities, the risk-based performance standards for chemical facilities, risk reduction strategies, and other aspects of the program under this title as the Secretary determines appropriate.</text>
 </subsection><subsection id="H872F4C9889444137B148CC372BC02126"><enum>(d)</enum><header>Information protection</header><text display-inline="yes-display-inline">Members of Advisory Committee shall maintain information protections pursuant to section 2103 of this Act. Any member who needs to access classified information to carry out assessments and recommendations for improving the risk tiering methodology for chemical facilities shall have an appropriate security clearance.</text>
 </subsection><subsection id="H290E77DED5D3493E905CDD479A73307E"><enum>(e)</enum><header>Annual report</header><text>Not later than January 30 each year, the chair shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and to the Committee on Homeland Security and the Committee on Energy and Commerce of the House of Representatives a report on the activities of the Committee during the year preceding the year during which the report is submitted.</text>
 </subsection><subsection commented="no" id="H756F59EF9CD543E0B8002D8751D32664"><enum>(f)</enum><header>Applicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Committee established under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H0239A8F4171E40AB8C8F01F29E89E8FD"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by inserting after the item relating to section 2109 the following new item:</text>

			</subsection></section><section id="H931EFAFC73494817A90F50E34DD24E19"><enum>8.</enum><header>Implementation plan and report to Congress</header>
 <subsection id="H173230F7CECC4085A59644EFB600ED98"><enum>(a)</enum><header>Implementation plan</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland Security shall develop, and submit to Congress, an implementation plan outlining how the Secretary plans to—</text>
 <paragraph id="H633E647156C94AEA84014B2EC9DB2553"><enum>(1)</enum><text>aggregate, anonymize, and analyze data collected from covered chemical facilities or chemical facilities of interest to identify practices that such facilities have employed to successfully reduce or remove terrorism-related chemical security risks;</text>
 </paragraph><paragraph id="H37E35F3A10AD48A3A1EB362FE84006F3"><enum>(2)</enum><text>develop voluntary, publicly available, practices based on such data, which may be updated as necessary, to guide facility owners and operators in preventing, reducing, and managing security risks; and</text>
 </paragraph><paragraph id="HC8442D4729D84D3EA9D4117FC5473C7F"><enum>(3)</enum><text>disseminate such practices to chemical facility owners and operators through an appropriate medium or system, including by making such practices available to the public to the greatest extent practicable.</text>
				</paragraph></subsection><subsection id="H58D241BD4F824E959233EACE78387F21"><enum>(b)</enum><header>Report</header>
 <paragraph id="HB603C3CD0D8F4B7286B46F7E350D026D"><enum>(1)</enum><header>Initial report</header><text>Not later than two years after the date of the enactment of this Act, the Secretary shall submit to Congress a report on the status of implementation plan required under subsection (a), a description of the voluntary, publicly available, practices identified, and the system or medium used to disseminate such practices to chemical facility owners and operators.</text>
 </paragraph><paragraph id="HF6FB1C808CD04E199559E9F797B992B4"><enum>(2)</enum><header>Annual updates</header><text display-inline="yes-display-inline">Not later than one year after the submission of the report required under paragraph (1), and annually thereafter, the Secretary shall submit to Congress information on changes to the voluntary practices information disseminated and bases for such changes, information on feedback collected from facility owners and operators regarding the extent to which voluntary practices were adopted, and information on what impact the dissemination of voluntary practices have had on the effectiveness of the program.</text>
				</paragraph></subsection></section><section id="H4C7C40658C9947CE98F619B8FF470F9F"><enum>9.</enum><header>Study on risks posed by excluded facilities</header>
 <subsection commented="no" id="H93D4156285194DAC858CBA5F6F17E760"><enum>(a)</enum><header>Study required</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall enter into an agreement with a non-Department of Homeland Security entity for the conduct of an independent assessment of—</text>
 <paragraph commented="no" id="HB2D365C0C2AF4F66B23178347C9891B6"><enum>(1)</enum><text>the implications for national security and homeland security of exempting from regulation under title XXI of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref> et seq.) excluded facilities, as such term is defined in section 2101(4) of such Act;</text>
 </paragraph><paragraph commented="no" id="H6FE1B3340FC144A4B41DA2848FEDDB08"><enum>(2)</enum><text>the implications for such excluded facilities of exempting such facilities from regulation; and</text> </paragraph><paragraph commented="no" id="H09F997FC998F44B4A63C3B0A76B018A8"><enum>(3)</enum><text>the implications of exempting such facilities from regulation for the communities located in the same geographic areas as such facilities.</text>
 </paragraph></subsection><subsection id="H16C0B2B8DF3C4D5D83AE5EA0785A0D00"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 16 months after entering into an agreement under subsection (a), the Secretary of Homeland Security shall submit to the appropriate congressional committees a report that includes the findings and recommendations of the independent assessment required by subsection (a).</text>
 </subsection><subsection id="HF102086A9BE94F738410379C1F3AE4F4"><enum>(c)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">In this section, the term <quote>appropriate congressional committees</quote> means—</text> <paragraph id="H6350FA7593D74425B2A9C43B7D9D6EA7"><enum>(1)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </paragraph><paragraph id="H5C7A005E50094936A4B9709A609AD22B"><enum>(2)</enum><text>the Committee on Homeland Security and the Committee on Energy and Commerce of the House of Representatives.</text>
				</paragraph></subsection></section><section id="H3B7FF66294E346CF9E19BC03C01D4810"><enum>10.</enum><header>Study on feasibility of waiver program</header>
 <subsection id="HFF6B70F60034484D8885F1161E3FA3F8"><enum>(a)</enum><header>Study required</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall conduct a study to assess the feasibility and desirability of establishing a process under which certain chemical facilities, as determined by the Secretary, may apply to for a waiver of certain regulatory requirements under title XXI of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref> et seq.) upon showing that—</text>
 <paragraph id="H024EB425A9354C4EA71710BA3AA91C17"><enum>(1)</enum><text>the requirements under such title are covered, to the same extent and in the same manner, under another Federal regulatory program;</text>
 </paragraph><paragraph id="H0953E5EDA17E45BC9842EA438C77B33E"><enum>(2)</enum><text>the facility is in full and complete compliance with such other Federal regulatory program, as shown through timely scheduled inspections, audits, and other supporting evidence; and</text>
 </paragraph><paragraph id="HDC3979629CED4512850647103C34A801"><enum>(3)</enum><text display-inline="yes-display-inline">the facility has not, during the five-year period preceding the date on which a waiver is requested, been subject to an enforcement action brought by the Federal regulator overseeing such regulatory program or been found to be noncompliant with any aspect of such regulatory program.</text>
 </paragraph></subsection><subsection id="H45B53C7B4C2D487EB79CF96FD56524FD"><enum>(b)</enum><header>Report to congress</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the appropriate congressional committees a report that includes detailed findings regarding the establishment of the process described in subsection (a) and, if appropriate, recommendations for implementation.</text>
 </subsection><subsection id="HD03E7F483CBE4FAA89DB944525935846"><enum>(c)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">In this section, the term <quote>appropriate congressional committees</quote> means—</text> <paragraph id="H406C1D67401D48548B9CC2BC53B071A5"><enum>(1)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </paragraph><paragraph id="H26F5E8D9C4864865B5EB770138F8003F"><enum>(2)</enum><text>the Committee on Homeland Security and the Committee on Energy and Commerce of the House of Representatives.</text>
				</paragraph></subsection></section><section id="H61AA1743DE5B446DAB7379C3014501E0"><enum>11.</enum><header>Review of potential effects of attacks on covered chemical facilities on other critical
			 infrastructure</header>
 <subsection id="H2F28D924BA7642038C926B73DF2D88E3"><enum>(a)</enum><header>Review required</header><text display-inline="yes-display-inline">The Director of the Cybersecurity and Infrastructure Security Agency shall—</text> <paragraph id="H4F73F2127FC541F99B0D8976FCD2DF1E"><enum>(1)</enum><text>conduct a review of the risk assessment approach and corresponding tiering methodology for covered chemical facilities required pursuant to section 2102(e)(2) of the Homeland Security Act of 2002, as amended by this Act, and assess the extent to which the approach and tiering methodology takes into account—</text>
 <subparagraph id="H7DF76B36D4764FA2B6938E2DC4C99D3C"><enum>(A)</enum><text>the nature of the area surrounding the chemical facility, the presence of nearby facilities or other critical infrastructure, and other features of the community that could contribute to the consequences of a terrorist attack or exploitation of chemicals of interest; and</text>
 </subparagraph><subparagraph id="HC149545C79B04014BAB161B589539095"><enum>(B)</enum><text>the potential effects on the health and economic conditions of communities disproportionately vulnerable to the consequences of a terrorist attack or exploitation of chemicals of interest; and</text>
 </subparagraph></paragraph><paragraph id="HDF58CE95ED684675AC699C9F350AE20A"><enum>(2)</enum><text>develop a plan to ensure that when the tiering methodology is next updated, the nature of the surrounding area, the presence of nearby facilities or other critical infrastructure, and other features of the community that could contribute to the consequences of a terrorist attack or exploitation of chemicals of interest and impacts on communities disproportionately vulnerable to the consequences of a terrorist attack or exploitation of chemicals of interest are better integrated.</text>
				</paragraph></subsection><subsection id="H640A13554B574A36BC338B5156EA60FB"><enum>(b)</enum><header>Report to Congress</header>
 <paragraph id="HF3D4A49A28424C3CA6DEF00E4915E4AB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Director shall submit to the appropriate congressional committees a report on the review and plan required under subsection (a).</text>
 </paragraph><paragraph id="H1374245A3F87450E9E4C47C5B7F3A313"><enum>(2)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">In this section, the term <quote>appropriate congressional committees</quote> means—</text> <subparagraph id="HFB66B03FEB4D48E6A871A31D9CA3B973"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </subparagraph><subparagraph id="H270C4BFEBD66430F870C45E36A475C48"><enum>(B)</enum><text>the Committee on Homeland Security and the Committee on Energy and Commerce of the House of Representatives.</text>
					</subparagraph></paragraph></subsection></section><section id="HF7683BCDA8BC42D2A1F9CD02FB1CD8E5"><enum>12.</enum><header>Comptroller General reports</header>
			<subsection id="H499E33C7A8194F7988F6D6A5BD5CD6FA"><enum>(a)</enum><header>Evaluation of effectiveness of risk-Based performance standards</header>
 <paragraph id="H7ED51781F9FB48DD82D8F0214636C806"><enum>(1)</enum><header>Study and report</header><text>Not later than 18 months after the date of the enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to the appropriate congressional committees a report on the effectiveness of the risk-based performance standards used by the Department of Homeland Security under title XXI of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref> et seq.) in protecting businesses, employees, the economy, the public, and national security against existing and evolving threats of concern.</text>
 </paragraph><paragraph id="H6C274C020D5F4F77824AFD1A81D1C0E9"><enum>(2)</enum><header>Contents of report</header><text>The report required by paragraph (1) shall address—</text> <subparagraph id="H1A40FFC7D23442A898410E25EDCF39D9"><enum>(A)</enum><text>the sufficiency of security risk determinations and countermeasures under title XXI of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="H3FAA23A96FB44258A2377BC270A0BE0E"><enum>(B)</enum><text>the need for revised or additional methods to address evolving security risks.</text> </subparagraph></paragraph></subsection><subsection id="HC6605DD8E28E4DBC8417E01F5E44F9B5"><enum>(b)</enum><header>Evaluation of information management</header><text>Not later than one year after the date of the enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to the appropriate congressional committees a report on—</text>
 <paragraph id="H0A16DCAEF57144AFA8A3A51E6E9CBD8C"><enum>(1)</enum><text>how the Secretary of Homeland Security documents, maintains, and uses information on tiering changes pursuant to section 2102(e)(3) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/622">6 U.S.C. 622(e)(3)</external-xref>); and</text>
 </paragraph><paragraph id="H6598872009114DEA87EB238B041B467A"><enum>(2)</enum><text>how management, maintenance, utility, and use of the information could be improved to better identify and disseminate practices to reduce chemical security risks.</text>
 </paragraph></subsection><subsection id="H71564102D97546E88DEA689D70B32164"><enum>(c)</enum><header>Evaluation of practices To reduce chemical security risks</header><text>Not later than 18 months after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the appropriate congressional committees a report on the effectiveness of the development and distribution by the Secretary of Homeland Security of practices to address chemical security risks and of any actions taken or results produced in response to such practices.</text>
 </subsection><subsection id="H298575B2CD824A10B67F1C0E7C0E6501"><enum>(d)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">In this section, the term <quote>appropriate congressional committees</quote> means—</text> <paragraph id="HBA19A24416E84839A2044E2CC2BFBB29"><enum>(1)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text>
 </paragraph><paragraph id="H41C9910A729D42CF8B7F844B8F750311"><enum>(2)</enum><text>the Committee on Homeland Security and the Committee on Energy and Commerce of the House of Representatives.</text>
				</paragraph></subsection></section><section id="H0B6265A5A2A84CF3A67BF6D6AB7AA296"><enum>13.</enum><header>Voluntary mechanism for reporting drones and other emerging threats</header>
 <subsection id="H3AEBE65D4A014959950767A2DF52500D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland Security, acting through the Director of the Cybersecurity and Infrastructure Security Agency, shall establish a secure communications and information technology infrastructure or platform that allows facility owners and operators to report, on a voluntary basis, information on emerging threats, including terrorism threats posed by unmanned aircraft systems (as defined in section 331(9) of the FAA Modernization and Reform Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/95">Public Law 112–95</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note)) to covered chemical facilities.</text>
 </subsection><subsection id="H9015583212E84BABA08ADF8DDDD2E2A8"><enum>(b)</enum><header>Platform capabilities</header><text display-inline="yes-display-inline">The Secretary shall ensure that the secure communications and information technology infrastructure or platform established pursuant to subsection (a) is designed to support data mining and other advanced analytic tools to access, receive, and analyze data and information to facilitate the reporting of the information described in subsection (a).</text>
 </subsection></section><section id="H5F5A740E8EC443648321F67A2C04F6E5"><enum>14.</enum><header>Regulations regarding specific products and mixtures containing chemicals of interest</header><text display-inline="no-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security shall prescribe regulations to enact a process through which the Secretary can be petitioned to exclude a product or mixture under subsection (f) of section 2102 of the Homeland Security Act, as added by section 3. In collecting information from petitioners under such subsection, the Secretary shall not be subject to subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, or section 553 of title 5, United States Code.</text>
 </section><section id="HE96FFD28265346558C744B614C7B3E18"><enum>15.</enum><header>Previously approved facilities</header><text display-inline="no-display-inline">In the case of a chemical facility that is a covered chemical facility under title XXI of the Homeland Security Act of 2002 for which the Secretary of Homeland Security approved a site security plan under such title before the date of enactment of this Act, the Secretary shall not require the facility to resubmit the site security plan solely by reason of the enactment of this Act or the amendments made by this Act.</text>
 </section><section id="H122738565CAB4BEF93C38E56199366CE"><enum>16.</enum><header>Termination</header><text display-inline="no-display-inline">Section 5 of the Protecting and Securing Chemical Facilities From Terrorist Attacks Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/254">Public Law 113–254</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref> note) is amended by striking <quote>the date that is 4 years after the effective date of this Act</quote> and inserting <quote>May 1, 2025</quote>.</text>
