	<legis-body id="HD669BE9A501443B9BC3DB0EF3798ED4C" style="OLC">
 <section id="HE64E0F0693C0474585138B59E0E2A218" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevention of Sexual Assault in the Armed Forces Act</short-title></quote>.</text> </section><section id="H823BC7570E99478AA8DBC107AE6B8828"><enum>2.</enum><header>Defense Advisory Committee for the Prevention of Sexual Misconduct</header> <subsection id="H66CADF2A69E448728155BA40BE9DAF07"><enum>(a)</enum><header>Establishment required</header> <paragraph id="H1176874EAC834A108909CD9E917C7565"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense shall establish and maintain within the Department of Defense an advisory committee to be known as the <quote>Defense Advisory Committee for the Prevention of Sexual Misconduct</quote> (in this section referred to as the <quote>Advisory Committee</quote>).</text>
 </paragraph><paragraph id="H52A2813DBAC2475DB4A32F9562F51968"><enum>(2)</enum><header>Deadline for establishment</header><text>The Secretary shall establish the Advisory Committee not later than 180 days after the date of the enactment of this Act.</text>
				</paragraph></subsection><subsection id="H4EAE73E62AFC4D848332A2BB7196336F"><enum>(b)</enum><header>Membership</header>
 <paragraph id="H38D346E33F264E4CB737144BDB957594"><enum>(1)</enum><header>In general</header><text>The Advisory Committee shall consist of not more than 20 members, appointed by the Secretary from among individuals who have an expertise appropriate for the work of the Advisory Committee, including at least one individual with each expertise as follows:</text>
 <subparagraph id="HA164CF005C3B41499B04270A25CF4B14"><enum>(A)</enum><text>Expertise in the prevention of sexual assault and behaviors on the sexual assault continuum of harm.</text>
 </subparagraph><subparagraph id="H81167602E3F14509805F4A9B4A6424AC"><enum>(B)</enum><text>Expertise in the prevention of suicide.</text> </subparagraph><subparagraph display-inline="no-display-inline" id="HD29212EBB6084C88BC8BDA02E337B119"><enum>(C)</enum><text>Expertise in trauma and trauma symptoms.</text>
 </subparagraph><subparagraph id="H024FE0ADE9AA42118947958D84C5CC1C"><enum>(D)</enum><text>Expertise in the change of culture of large organizations.</text> </subparagraph><subparagraph id="H20C33CD627AB417BA4F3188CE4F11B99"><enum>(E)</enum><text>Expertise in implementation science.</text>
 </subparagraph></paragraph><paragraph id="HB35A2236103540DABA7D7A3C7C27074C"><enum>(2)</enum><header>Background of individuals</header><text>Individuals appointed to the Advisory Committee may include individuals with expertise in sexual assault prevention efforts of institutions of higher education, public health officials, and such other individuals as the Secretary considers appropriate.</text>
 </paragraph><paragraph id="H54F4DD5D9B524A288BF24131804811A4"><enum>(3)</enum><header>Prohibition on membership of members of Armed Forces on active duty</header><text>A member of the Armed Forces serving on active duty may not serve as a member of the Advisory Committee.</text>
				</paragraph></subsection><subsection id="HFDB1E64FB1CC470D9207ABB346B0CAFF"><enum>(c)</enum><header>Duties</header>
 <paragraph id="H5D99FAEFE2F74580B2C6E7C3F821CCEA"><enum>(1)</enum><header>In general</header><text>The Advisory Committee shall advise the Secretary on the following:</text> <subparagraph id="HBA5275F7E3FE4A1F8FD6CA5F4F759A23"><enum>(A)</enum><text>The prevention of sexual assault (including rape, forcible sodomy, other sexual assault, and other sexual misconduct (including behaviors on the sexual assault continuum of harm)) involving members of the Armed Forces.</text>
 </subparagraph><subparagraph id="HA655BFE7F3304109BB657981A162BB27"><enum>(B)</enum><text>The policies, programs, and practices of each military department, each Armed Force, and each military service academy for the prevention of sexual assault as described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="H8CC4960B6A514ABF9CAB34E380C2C5B7"><enum>(2)</enum><header>Basis for provision of advice</header><text>For purposes of providing advice to the Secretary pursuant to this subsection, the Advisory Committee shall review, on an ongoing basis, the following:</text>
 <subparagraph id="H04566B1076D34D7D8BEA0BD42AF22674"><enum>(A)</enum><text>Closed cases involving allegations of sexual assault described in paragraph (1).</text> </subparagraph><subparagraph id="H3FACEA2437BE4E10B10530CE45BE8E40"><enum>(B)</enum><text>Efforts of institutions of higher education to prevent sexual assault among students.</text>
 </subparagraph><subparagraph id="H03C4AE0F325B49738C478C82F6C8FCB3"><enum>(C)</enum><text>Any other information or matters that the Advisory Committee or the Secretary considers appropriate.</text>
 </subparagraph></paragraph><paragraph id="HB9C40FB9B1BC463CAD22D7765759762C"><enum>(3)</enum><header>Coordination of efforts</header><text>In addition to the reviews required by paragraph (2), for purposes of providing advice to the Secretary, the Advisory Committee shall also consult and coordinate with the Defense Advisory Committee on Investigation, Prosecution, and Defense of Sexual Assault in the Armed Forces (DAC–IPAD) on matters of joint interest to the two Advisory Committees.</text>
 </paragraph></subsection><subsection id="HD8FD64BAC65B43F8AD6B825A69883BFF"><enum>(d)</enum><header>Annual report</header><text>Not later than March 30 each year, the Advisory Committee shall submit to the Secretary and the Committees on Armed Services of the Senate and the House of Representatives a report on the activities of the Advisory Committee pursuant to this section during the preceding year.</text>
 </subsection><subsection id="HAC33AF4532FE4E7FAEB42A44235EA726"><enum>(e)</enum><header>Sexual assault continuum of harm</header><text>In this section, the term <term>sexual assault continuum of harm</term> includes—</text> <paragraph id="H093A6C2940B5478788FE65A46E701CB1"><enum>(1)</enum><text>inappropriate actions (such as sexist jokes), sexual harassment, gender discrimination, hazing, cyber bullying, or other behavior that contributes to a culture that is tolerant of, or increases risk for, sexual assault; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H399A65738852471DB507B529AAEB2A59"><enum>(2)</enum><text>maltreatment or ostracism of a victim for a report of sexual misconduct.</text> </paragraph></subsection><subsection id="HEAAD14628D6F4832B1A179A2926F5218"><enum>(f)</enum><header>Termination</header> <paragraph id="HFDF0C5DCA3F942FBA67747D14DDC7F36"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Advisory Committee shall terminate on the date that is five years after the date of the establishment of the Advisory Committee pursuant to subsection (a).</text>
 </paragraph><paragraph id="H16DA82EDB6EC4CCCB3C6C798DD78A9BC"><enum>(2)</enum><header>Continuation</header><text display-inline="yes-display-inline">The Secretary of Defense may continue the Advisory Committee after the termination date applicable under paragraph (1) if the Secretary determines that continuation of the Advisory Committee after that date is advisable and appropriate. If the Secretary determines to continue the Advisory Committee after that date, the Secretary shall notify the Committees on the Armed Services of the Senate and House of Representatives.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H5D0E8D6DB28548E0B4A0686BD4625BC0"><enum>3.</enum><header>Notice to victims of alleged sexual assault of pendency of further administrative action following
 a determination not to refer to trial by court-martial</header><text display-inline="no-display-inline">Under regulations prescribed by the Secretary of Defense, upon a determination not to refer a case of alleged sexual assault for trial by court-martial under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice), the commander making such determination shall periodically notify the victim of the status of a final determination on further action on such case, whether non-judicial punishment under section 815 of such title (article 15 of the Uniform Code of Military Justice), other administrative action, or no further action. Such notifications shall continue not less frequently than monthly until such final determination.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HB24273EBAA3A4A78A36519C869CCE647"><enum>4.</enum><header>Authority for detail of certain enlisted members of the Armed Forces as students at law schools</header>
 <subsection id="H0D948D1B0D9D495089C7DB495F638DB6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/101">Chapter 101</external-xref> of title 10, United States Code, is amended—</text> <paragraph id="H78B56A592477422187CE33D2315CA9B6"><enum>(1)</enum><text>by redesignating sections 2004a and 2004b as sections 2004b and 2004c, respectively; and</text>
 </paragraph><paragraph id="HDFBCEA7273594BDAAE3169910764E6A6"><enum>(2)</enum><text>by inserting after section 2004 the following new section:</text> <quoted-block display-inline="no-display-inline" id="H74E9C550AB604561953C7C00AE770396" style="USC"> <section id="HBFD17B038AA64773BFBFD3D35503AAB9"><enum>2004a.</enum><header>Detail as students at law schools: certain enlisted members</header> <subsection id="HEBE6090C8E3A4FD6BAA9FBC8D019D81C"><enum>(a)</enum><header>In general</header><text>The Secretary of each military department may, under regulations prescribed by the Secretary of Defense, detail enlisted members of the armed forces as students at accredited law schools, located in the United States, for a period of training leading to the degree of bachelor of laws or juris doctor. No more than twenty-five officers from each military department may commence such training in any single fiscal year.</text>
 </subsection><subsection id="HBB10BC2E9837438D8D5595C0F1C4F7D6"><enum>(b)</enum><header>Eligibility for detail</header><text>To be eligible for detail under subsection (a), a member must be a citizen of the United States and must—</text>
 <paragraph id="H4875EE42B52843F5A13E1DEA9794D911"><enum>(1)</enum><text>as of the time training is to begin—</text> <subparagraph id="H01F6C9F69C2D4C6181AA777C5B96A214"><enum>(A)</enum><text>have served on active duty for a period of not less than four years nor more than eight years;</text>
 </subparagraph><subparagraph id="H45A211FCC0BD491F9A2BCF4D09FAE08E"><enum>(B)</enum><text>be in pay grade E–5 or E–6; and</text> </subparagraph><subparagraph id="HEF713BC6FAE4478FA4EF28C31C872E5E"><enum>(C)</enum><text>meet all requirements for acceptance of a commission as a commissioned officer in the armed forces; and</text>
 </subparagraph></paragraph><paragraph id="H81F3D24395934660ADB7E967B6FEB4E9"><enum>(2)</enum><text>sign an agreement that, unless sooner separated, the member will—</text> <subparagraph id="H2C32EB2316E645DD8E6F066382C07C51"><enum>(A)</enum><text>complete the educational course of legal training;</text>
 </subparagraph><subparagraph id="H8E3BFA44A0C54B378A48CD32948049EC"><enum>(B)</enum><text>upon completion of the educational course of legal training—</text> <clause id="HFA181EA646FD441DADB9146506643D76"><enum>(i)</enum><text>accept a commission as a commissioned officer in the armed forces; and</text>
 </clause><clause id="H757BB4145BCB43749B505D0B7398BB9A"><enum>(ii)</enum><text>accept transfer or detail as a judge advocate or law specialist within the department concerned; and</text>
 </clause></subparagraph><subparagraph id="H528DBC7955274F2FB57CFC6E0BEEE82A"><enum>(C)</enum><text>agree to serve on active duty following completion or other termination of the educational course of legal training for a period of two years for each year or part thereof of such training.</text>
 </subparagraph></paragraph></subsection><subsection id="HC7B58B08FC9849A58BCD0C77300536A4"><enum>(c)</enum><header>Selection</header><text>Members detailed for legal training under subsection (a) shall be selected on a competitive basis by the Secretary of the military department concerned, under the regulations required by subsection (a).</text>
							</subsection><subsection id="HE9A033B338EA4FA9AA2E2B281149DD81"><enum>(d)</enum><header>Service and service obligations</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H498227AA43B2406A97C51F3C16B4B44B"><enum>(1)</enum><text>Except as provided in paragraph (2), any service obligation incurred by a member under an agreement entered into under subsection (b) shall be in addition to any service obligation incurred by the member under any other provision of law or agreement.</text>
								</paragraph><paragraph id="H991F996C428E43CF85050C4D93C7CF53" indent="up1"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H5299DDDD81884605AB1DB5E93BD18F80"><enum>(A)</enum><text>A member who does not successfully complete a course of legal training to which detailed pursuant to this section shall cease such detail and return to the armed force concerned as an enlisted member.</text>
 </subparagraph><subparagraph id="H732EDFB36D954B1FA7A3955CDD71E082" indent="up1"><enum>(B)</enum><text>Any time of a member described by subparagraph (A) in a course of legal training described in that subparagraph shall not count toward satisfaction of any period of service required under the current contract or agreement of the member for enlistment in the armed forces.</text>
 </subparagraph></paragraph></subsection><subsection id="H002EE3097FB045D49396DD23C0FDB746"><enum>(e)</enum><header>Limitation on number detailable</header><text>The aggregate number of enlisted members detailed under this section and commissioned officers detailed under section 2004 of this title in any fiscal year by a Secretary of a military department may not exceed 25.</text>
 </subsection><subsection id="HE3449421C1804456A9CD220AB9A1B1BB"><enum>(f)</enum><header>Other administrative matters</header><text>Subsections (d) and (f) of section 2004 of this title shall apply to the detail of members under this section, except that any reference in such section to an <quote>officer</quote> shall be deemed to be a reference to an <quote>enlisted member</quote> for such purposes.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBD821AA967D545F2B399FF5F1CA533B1"><enum>(b)</enum><header>Conforming amendments</header>
 <paragraph id="H766713F52AB04ED699205B429F64642F"><enum>(1)</enum><header>In general</header><text>Section 2004 of such title is amended—</text> <subparagraph id="H92D2E4569243473E848FEE7048F49804"><enum>(A)</enum><text>in subsection (a), by striking the second sentence; and</text>
 </subparagraph><subparagraph id="H5DBE999EDC4B405AA3F851886A232602"><enum>(B)</enum><text>in subsection (f)—</text> <clause id="H9F1A4E09A3234A029CA8C51D4AE9BA75"><enum>(i)</enum><text>by inserting <quote>(1)</quote> after <quote>(f)</quote>; and</text>
 </clause><clause id="HB0A1557D4D8E422C8559B106C4954B8B"><enum>(ii)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H92FE7DF121BF4021A1C77A8341CDF3E9" style="OLC"> <paragraph id="H4F79256034B6479F854FAFD7743611B8" indent="up1"><enum>(2)</enum><text>The aggregate number of commissioned officers detailed under this section and enlisted members detailed under section 2004a of this title in any fiscal year by a Secretary of a military department may not exceed 25.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </clause></subparagraph></paragraph><paragraph id="H807945F137214914929BCE88686FEA09"><enum>(2)</enum><header>Heading amendment</header><text>The heading of section 2004 of such title is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H528B16C9A12A464AB08946307E8E14B3" style="USC"> <section id="H7AE3203421324A20AE094E0142AFB06F"><enum>2004.</enum><header>Detail as students at law schools: commissioned officers</header></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H7680EFE6DCD54529A5AACC74F00A5201"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 101 of such title is amended by striking the item relating to section 2004 and inserting the following new items:</text>
