			 and the misuse of identification devices issued by the Department of
			 Education a criminal act.</official-title></form>
	<legis-body id="H199111C0A7CB462F9F0B373888F85522" style="OLC">
 <section id="H1D914A254C3D44DFBD6104F83C2E658D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Student Debt Relief Scams Act of 2019</short-title></quote>.</text> </section><section id="H085440DC78F64085A46BAAC6A45CD2A9"><enum>2.</enum><header>Criminal penalties</header> <subsection id="HFDCA6412AA9E40879387496F63B56659"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 490 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1097">20 U.S.C. 1097</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCAEFF1417774450A908ACD491234F604" style="OLC">
					<subsection id="HCA72AA0B7F744D77A464FFAD3B7F4831"><enum>(e)</enum><header>Access to Department of Education Information Technology Systems for fraud, commercial advantage,
 or private financial gain</header><text>Any person who knowingly uses an access device, as defined in section 1029(e)(1) of title 18, United States Code, issued to another person or obtained by fraud or false statement to access Department information technology systems for purposes of obtaining commercial advantage or private financial gain, or in furtherance of any criminal or tortious act in violation of the Constitution or laws of the United States or of any State, shall be fined not more than $20,000, imprisoned for not more than 5 years, or both.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H9F868D17A6E34973B9061296B70EAA3B"><enum>(b)</enum><header>Guidance</header><text>The Secretary shall issue guidance regarding the use of access devices in a manner that complies with this Act, and the amendments made by this Act.</text>
 </subsection><subsection id="H7220B02B2B4E4FE486ECBC8828A391A9"><enum>(c)</enum><header>Effective date of penalties</header><text>Notwithstanding section 6, the penalties described in section 490(e) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1097">20 U.S.C. 1097</external-xref>), as added by subsection (a), shall take effect the day after the date on which the Secretary issues guidance regarding the use of access devices, as described in subsection (b).</text>
 </subsection></section><section id="HA0EFC5F7CAB0497B808A94CD6C33ACFB"><enum>3.</enum><header>Loan counseling</header><text display-inline="no-display-inline">Section 485(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(b)</external-xref>) is amended—</text> <paragraph id="HC93CC995BDDF47A5A01DA93C0F602835"><enum>(1)</enum><text>in clause (viii), by striking <quote>and</quote> after the semicolon; and</text>
 </paragraph><paragraph id="H17EDB7A8AD5942A5BD77BFB0F0A565AA"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H5DB0608781E3492DBEE7238CEB86253E" style="OLC"> <clause id="HBE38201B5D784E33BF6CC96D5A527191"><enum>(x)</enum><text>an explanation that—</text>
 <subclause id="H6812540A7F4342FC98D151F3585C1ABF"><enum>(I)</enum><text>the borrower may be contacted during the repayment period by third-party student debt relief companies;</text>
 </subclause><subclause id="H0B8B5FE006D54D06B4618EA2C2F66253"><enum>(II)</enum><text>the borrower should use caution when dealing with those companies; and</text> </subclause><subclause id="H2E0D9CA32EC04A9A9FDCA5CF9482048D"><enum>(III)</enum><text>the services that those companies typically provide are already offered to borrowers free of charge through the Department or the borrower's servicer; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HB3C884A8BECB44A793B8AA8DC1043A16"><enum>4.</enum><header>Prevention of improper access</header><text display-inline="no-display-inline">Section 485B of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092b">20 U.S.C. 1092b</external-xref>) is amended—</text> <paragraph id="HA21E72EE881F447C8344E8FE4F5D9B01"><enum>(1)</enum><text>by redesignating subsections (e) through (h) as subsections (f) through (i), respectively;</text>
 </paragraph><paragraph id="H3C8AE3AFDDC24940AFE79FC8257367C8"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text> <subparagraph id="H814AB75D16A44E03AE1DF2EC55D91C50"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (5)(C), by striking <quote>and</quote> after the semicolon;</text>
 </subparagraph><subparagraph id="HB12394C38B654F01B3B76591944C0E04"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (6)(C), by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph><subparagraph id="H2CAB3F74A4A8409691F495556ADF473E"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2164778CC0254C668BEFA53B2BACE807" style="OLC">
 <paragraph id="HDFE61BA893F94896A1C29C16C4E7A453"><enum>(7)</enum><text>preventing access to the data system and any other system used to administer a program under this title by any person or entity for the purpose of assisting a student in managing loan repayment or applying for any repayment plan, consolidation loan, or other benefit authorized by this title, unless such access meets the requirements described in subsection (e).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HECF51105C33F475890EABB02771A55B4"><enum>(3)</enum><text>by inserting after subsection (d) the following:</text> <quoted-block display-inline="no-display-inline" id="HF625657A1B524F37A8DCBBB1A81A53BB" style="OLC"> <subsection id="H11A93635B9BD4279A1552175DC2B6268"><enum>(e)</enum><header>Requirements for third-Party data system access</header> <paragraph id="HBBB1D0E937B9496997BC2C600233A0C1"><enum>(1)</enum><header>In General</header><text>As provided in paragraph (7) of subsection (d), an authorized person or entity described in paragraph (2) may access the data system and any other system used to administer a program under this title if that access—</text>
 <subparagraph id="H24080F662B66476983C7A43E7B6850A4"><enum>(A)</enum><text>is in compliance with terms of service, information security standards, and a code of conduct which shall be established by the Secretary and published in the Federal Register;</text>
 </subparagraph><subparagraph id="H4CD469AB171C4F7FB5BE46E796D7217A"><enum>(B)</enum><text>is obtained using an access device (as defined in section 1029(e)(1) of title 18, United States Code) issued by the Secretary to the authorized person or entity; and</text>
 </subparagraph><subparagraph commented="no" id="HA250671E898A484F84ECAC7F301650D5"><enum>(C)</enum><text>is obtained without using any access device (as defined in section 1029(e)(1) of title 18, United States Code) issued by the Secretary to a student, borrower, or parent.</text>
 </subparagraph></paragraph><paragraph id="H96050148FD2C4D1E8F09FF170E26AAF0"><enum>(2)</enum><header>Authorized person or entity</header><text>An authorized person or entity described in this paragraph means—</text> <subparagraph id="H825FFE567C894046BD40AC8F0DF83F5C"><enum>(A)</enum><text>a guaranty agency, eligible lender, or eligible institution, or a third-party organization acting on behalf of a guaranty agency, eligible lender, or eligible institution, that is in compliance with applicable Federal law (including regulations and guidance); or</text>
 </subparagraph><subparagraph id="H385D4EF48EAF479C9E382A7CACD6B5BF"><enum>(B)</enum><text>a licensed attorney representing a student, borrower, or parent, or another individual who works for a Federal, State, local, or Tribal government or agency, or for a nonprofit organization, providing financial or student loan repayment counseling to a student, borrower, or parent, if—</text>
 <clause id="HB23610AB29114B198926B1A51D839FBF"><enum>(i)</enum><text>that attorney or other individual has never engaged in unfair, deceptive, or abusive practices, as determined by the Secretary;</text>
 </clause><clause id="HDDA42162AAF04C75854E8F385FEC97C5"><enum>(ii)</enum><text>that attorney or other individual does not work for an entity that has engaged in unfair, deceptive, or abusive practices (including an entity that is owned or operated by a person or entity that engaged in such practices), as determined by the Secretary;</text>
 </clause><clause id="HA864A4D564F84B71A8CFEFC47F4B91DB"><enum>(iii)</enum><text>system access is provided only through a separate point of entry; and</text> </clause><clause id="H025EABCC40E94791AEC33DA027B1870A"><enum>(iv)</enum><text>the attorney or other individual has consent from the relevant student, borrower, or parent to access the system.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HCFD62CCB2F5C4FC1986AEDCAA4F5E802"><enum>(4)</enum><text>in subsection (f)(1), as redesignated by paragraph (1)—</text> <subparagraph id="H90798B2A590842ED9DED1ABE7343BE7D"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>student and parent</quote> and inserting <quote>student, borrower, and parent</quote>;</text>
 </subparagraph><subparagraph id="H688476634E384D8C9DB9DE7FA69374BB"><enum>(B)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (D) and (E), respectively;</text> </subparagraph><subparagraph id="H1A4B5CDC324E4F5781FE743BDB8C70CB"><enum>(C)</enum><text>by inserting after subparagraph (B) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HFE9C7474B4C34D9C8A456E7B0DF59AD3" style="OLC">
 <subparagraph id="HE63C5B06591E482EAEAC948B628D94F4"><enum>(C)</enum><text>the reduction in improper data system access as described in subsection (d)(7);</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph><subparagraph id="HA554BB14F5AA48A5B73A0A6B74193433"><enum>(D)</enum><text>by striking subparagraph (E), as redesignated by subparagraph (B), and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HCEF3B5EBF4F5429099773845ED5C6ECC" style="OLC">
 <subparagraph id="H6852659B7BF04095BB01975D07C8D69E"><enum>(E)</enum><text>any protocols, codes of conduct, terms of service, or information security standards developed under paragraphs (6) or (7) of subsection (d) during the preceding fiscal year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></section><section commented="no" id="H3AE44FCEE3634A129D0B8EC0C4D8FED1"><enum>5.</enum><header>Agency prevention and detection</header><text display-inline="no-display-inline">Section 141(b)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1018">20 U.S.C. 1018(b)(2)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H431C682A56E44440852DBAEF7767FBB8" style="OLC">
 <subparagraph commented="no" id="HD9247ED4482D43FD9969EE754C3EE1CD"><enum>(C)</enum><text display-inline="yes-display-inline">Taking action to prevent and address the improper use of access devices, as described in section 485B(d)(7), including by—</text>
 <clause commented="no" id="H68E078145AEC4D4B90E3419FF9B81DD7"><enum>(i)</enum><text>detecting common patterns of improper use of any system that processes payments on Federal Direct Loans or other Department information technology systems;</text>
 </clause><clause commented="no" id="H704F75214F8441B5B85D98EA9DEF1728"><enum>(ii)</enum><text>maintaining a reporting system for contractors involved in the processing of payments on Federal Direct Loans in order to allow those contractors to alert the Secretary of potentially improper use of Department information technology systems;</text>
 </clause><clause commented="no" id="H9EA8C56538D94B0992662F6BAE42EA67"><enum>(iii)</enum><text>proactively contacting Federal student loan borrowers whose Federal student loan accounts demonstrate a likelihood of improper use in order to warn those borrowers of suspicious activity or potential fraud regarding their Federal student loan accounts; and</text>
 </clause><clause commented="no" id="H6E1BD861942344CD8AFA6FDDB0D31DBE"><enum>(iv)</enum><text>providing clear and simple disclosures in communications with borrowers who are applying for or requesting assistance with Federal Direct Loan programs (including assistance or applications regarding income-driven repayment, forbearance, deferment, consolidation, rehabilitation, cancellation, and forgiveness) to ensure that borrowers are aware that the Department will never require borrowers to pay for such assistance or applications.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" id="H49F7EFBC745F4D6C864F036D4FDEDFB3"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect on the date that is 180 days after the date of enactment of this Act.</text>
