<section id="HAAD9DBCF5F764468BF4EB259B92765A6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Our Obligation to Recognize American Heroes (OORAH) Act of 2019 </short-title></quote>.</text></section> <section id="H65EB7ADB48F94E8581E47E6E07068FBF" section-type="subsequent-section"><enum>2.</enum><header>Expansion of availability of financial assets of Iran to victims of terrorism</header> <subsection id="H1AAEBE12FF3347D4829761FAEDEE9D55"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text>
<paragraph id="H80D15200306D4447B0770F3C67B76F2C"><enum>(1)</enum><text>On October 23, 1983, terrorists sponsored by the Government of Iran bombed the United States Marine barracks in Beirut, Lebanon. The terrorists killed 241 servicemen and injured scores more.</text></paragraph> <paragraph id="HB90112F9D1BC4A7AA926C67A7E893C86"><enum>(2)</enum><text>Those servicemen were killed or injured while on a peacekeeping mission.</text></paragraph>
<paragraph id="H64948EE810DC4461BBE56FBD981475E1"><enum>(3)</enum><text>Terrorism sponsored by the Government of Iran threatens the national security of the United States.</text></paragraph> <paragraph id="H259087F94BA4474B84E9FFC4C2085934"><enum>(4)</enum><text>The United States has a vital interest in ensuring that members of the Armed Forces killed or injured by such terrorism, and the family members of such members, are able to seek justice.</text></paragraph></subsection>
<subsection id="H70E78F8595D44A1C92F58EBF813B3854"><enum>(b)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 502 of the Iran Threat Reduction and Syria Human Rights Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/8772">22 U.S.C. 8772</external-xref>) is amended—</text> <paragraph id="H669C0C73A8974C4EBA48D8D84C08BBE2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text>
<subparagraph id="HF42FE388D15542B0B8A513CC99EB9939"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>in the United States</quote> and inserting <quote>by or</quote>;</text></subparagraph> <subparagraph id="H5AFDF3FF25244A1DBC49E0A2E132FD1C"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>, or an asset that would be blocked if the asset were located in the United States,</quote> after <quote>unblocked)</quote>; and</text></subparagraph>
<subparagraph id="H0D4EBFA946B74AAE9038AB9F7AF8B35A"><enum>(C)</enum><text>in the flush text at the end—</text> <clause id="HCD905F4236E8422EA27EEDFCE7132D84"><enum>(i)</enum><text>by inserting after <quote>in aid of execution</quote> the following: <quote>, or to an order directing that the asset be brought to the State in which the court is located and subsequently to execution or attachment in aid of execution,</quote>; and</text></clause>
<clause id="HC280983E350B490AA994526AE68E84E0"><enum>(ii)</enum><text>by inserting <quote>, without regard to concerns relating to international comity</quote> after <quote>resources for such an act</quote>;</text></clause></subparagraph></paragraph> <paragraph id="H83204015B95E4E1AB0C2D1A0E4817BC4"><enum>(2)</enum><text>in subsection (b)—</text>
<subparagraph id="HCC004A79AAE54CDABE724E89DDD7318F"><enum>(A)</enum><text>by striking <quote>that are identified</quote> and inserting the following: “that are—</text> <quoted-block display-inline="no-display-inline" id="H08F72286489A4474A4BCD2ED0846B8B1" style="OLC"> <paragraph id="HD26C9892334D4849B32A9D028CA749AA"><enum>(1)</enum><text>identified</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="H414E443EC834450EA2A4873EC16E3B98"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="HF57EBF13EDB84B7AA1259CDCD2AF6113"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="H50181EAD68464CA48621733F8A6A785A"><enum>(2)</enum><text>identified in and the subject of proceedings in the United States District Court for the Southern District of New York in Peterson et al. v. Islamic Republic of Iran et al., Case No. 13 Civ. 9195 (LAP).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H7E74128222AC4491B87C15E8DD245C67"><enum>(3)</enum><text>by striking subsection (e);</text></paragraph>
<paragraph id="HA2721296A1F54D119490903D25DB056E"><enum>(4)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph> <paragraph id="HDA02EFFDFBD6405B8E4A191012CD52A9"><enum>(5)</enum><text>by inserting after subsection (b) the following:</text>

<subsection id="HA85D515B3C01449D95F1D59545722B8E"><enum>(c)</enum><header>Personal jurisdiction</header><text>For purposes of this section, the United States District Court for the Southern District of New York shall have personal jurisdiction over any foreign securities intermediary that credited financial assets described in subsection (b) to an account the intermediary holds outside the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body></bill>
