Russell National School Lunch Act and the Child Nutrition Act of 1966 to
			 improve nutrition in tribal areas, and for other purposes.</official-title></form>
	<legis-body id="HE2EC3FC1E0F54C39A8E02E6F4643B485" style="OLC">
 <section id="H9CA4AFFA16BA4918A88AD9BA7EC95CBA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Nutrition Improvement Act of 2019</short-title></quote>.</text> </section><section id="HB747CE74187146629A18A0C0591EFF08"><enum>2.</enum><header>Universal meal service in Native American areas</header><text display-inline="no-display-inline">Section 11 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a</external-xref>) is amended by inserting after subsection (e) the following:</text>
			<quoted-block display-inline="no-display-inline" id="H5B6CD8F4177F4CA198D696578D488A50" style="OLC">
				<subsection id="HC62331768A514C7AA434BE62A1060457"><enum>(f)</enum><header>Universal meal service in Native American areas</header>
 <paragraph id="HE810CBA4C2B34099B9AE91360898CD6E"><enum>(1)</enum><header>In general</header><text>The Secretary shall identify, for optional use in local educational agencies on or near Indian reservations, alternatives to—</text>
 <subparagraph id="HF07C873468A245E8ADA19B12D2EF719F"><enum>(A)</enum><text>the daily counting by category of meals provided by school lunch programs under this Act and the school breakfast program established by section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>);</text>
 </subparagraph><subparagraph id="HD90B387A736545EF84AFE6683263034C"><enum>(B)</enum><text>the use of annual applications as the basis for eligibility to receive free meals or reduced price meals under this Act; and</text>
 </subparagraph><subparagraph id="HF653A56BF4CF4B9C9477A770F037D7CF"><enum>(C)</enum><text>the use of universal meal service described in subsections (a)(1)(F) and (g).</text> </subparagraph></paragraph><paragraph id="HF61EA8016D97426D80442E3B0563BC3F"><enum>(2)</enum><header>Use of alternatives</header><text>Alternatives described in paragraph (1) may be—</text>
 <subparagraph id="HFBF687B9383F4324B943605E9EC303DF"><enum>(A)</enum><text>implemented for use in schools or by school food authorities that agree—</text> <clause id="H2794299220DD4B9DAE1B457048F98B25"><enum>(i)</enum><text>to serve all breakfasts and lunches to all students at no cost;</text>
 </clause><clause id="HE50328E3B7E44237AB22E606CA1B6578"><enum>(ii)</enum><text>to pay, from sources other than Federal funds, the costs of serving any lunches and breakfasts that are in excess of the value of assistance received under this Act or the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771</external-xref> et seq.), as determined by the Secretary, with respect to the number of lunches and breakfasts served during the applicable period; and</text>
 </clause><clause id="HBC7DE1A7F35C40CF8532A53E38FC5758"><enum>(iii)</enum><text>not to collect applications for free or reduced price meals; or</text> </clause></subparagraph><subparagraph id="HB8D3AE2763584D6C8D20C8BE58A2E4F4"><enum>(B)</enum><text>further tested through demonstration projects carried out by the Secretary in accordance with paragraph (3).</text>
 </subparagraph></paragraph><paragraph id="H5BA88F5DC2484C98B91731AF22F2055E"><enum>(3)</enum><header>Demonstration projects</header><text>For the purpose of carrying out demonstration projects described in paragraph (2)(B), the Secretary may waive any requirement of this Act relating to—</text>
 <subparagraph id="H439717CFDA67406D881AB7922D5B8122"><enum>(A)</enum><text>counting and claiming of meals provided by school lunch or breakfast programs; and</text> </subparagraph><subparagraph id="H4CD34A35718C428CA91F21C3D0D5A8BF"><enum>(B)</enum><text>determinations of eligibility for free or reduced priced meals.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HF6EB764B424F4121A7877B36DB3ADA0B"><enum>3.</enum><header>School lunch program and child and adult care food program</header><text display-inline="no-display-inline">Section 12(d) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(d)</external-xref>) is amended by striking paragraph (8) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="HA5CDC3D7130D40D9B462F75FAA2FD162" style="OLC">
 <paragraph id="H9D6D75F3C9EE4259A34E2AC405A636E1"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means—</text> <subparagraph id="H9D41A52F5C9F4073BBE8CD6350494983"><enum>(A)</enum><text>any of the 50 States;</text>
 </subparagraph><subparagraph id="HBCED9990AD8C4CCBA1FE9D12A62C23B3"><enum>(B)</enum><text>the District of Columbia;</text> </subparagraph><subparagraph id="H09A40E7DE8F04848AA375ABF96F113F4"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text>
 </subparagraph><subparagraph id="H6F5757F5A01A48B092CAB285221921A4"><enum>(D)</enum><text>the Virgin Islands;</text> </subparagraph><subparagraph id="HBB9F244EF6014842AA4BD81AA21BCCAB"><enum>(E)</enum><text>Guam;</text>
 </subparagraph><subparagraph id="H3ADE49ABD15249D99983EAAD5A633DF0"><enum>(F)</enum><text>American Samoa;</text> </subparagraph><subparagraph id="H3EC23A80E33C4813A158A7901F03242C"><enum>(G)</enum><text>the Commonwealth of the Northern Mariana Islands; or</text>
 </subparagraph><subparagraph id="H8D3EC0D14FA048FFA3182452C73B152D"><enum>(H)</enum><text>an Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H272625CD08EF40FEAFD10B156B9686ED"><enum>4.</enum><header>Summer food service program for children</header><text display-inline="no-display-inline">Section 13(a)(1)(E) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761(a)(1)(E)</external-xref>) is amended—</text>
 <paragraph id="H53AE0A27F865478D84C3F36197C8EEE4"><enum>(1)</enum><text>in clause (vi), by striking <quote>and</quote>;</text> </paragraph><paragraph id="H5E0624D0CB954EB8AA7D19182A3F3CF5"><enum>(2)</enum><text>in clause (vii), by striking the period and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="HE44567CF06844716A334B437CED95E12"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HD1A0642464A843C49753BB7BBD535082" style="OLC"> <clause id="H2C6BDB0E47874194B772BDDBAD63A320"><enum>(viii)</enum><text>an Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H4B88A72866734A508CB432E3C0033788"><enum>5.</enum><header>Administrative and start up funds</header><text display-inline="no-display-inline">Section 7(c) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776(c)</external-xref>) is amended—</text> <paragraph id="HE4FA503C1E324AC8ABB8B914EB2DE0B5"><enum>(1)</enum><text>by striking <quote>(c) If any State agency</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H94E1663557654DFB9DC35F8F697FC531" style="OLC">
					<subsection id="H631DE40AF12241DEBC1A683E28A48E49"><enum>(c)</enum><header>Adjustment in administrative funds</header>
 <paragraph id="HDAF120DBDF1847288055B016E0C9B310"><enum>(1)</enum><header>Administration by a State agency</header><text>If any State agency</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="H1927E329FC0C4741A72273F0B3E88044"><enum>(2)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7E9983E0FE094650BB031A7BD1862CFC" style="OLC">
					<paragraph id="H62EB5700744B436EB0ED8411A99509AF"><enum>(2)</enum><header>Administration by an Indian tribe</header>
 <subparagraph id="H64651B4849FB4C6C80451D671D59B81E"><enum>(A)</enum><header>In general</header><text>If an Indian tribe agrees to assume responsibility for the administration of the school breakfast program under section 4 or the school lunch program, summer food service program for children, or child and adult care food program established under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.), the Secretary shall make an appropriate adjustment in the administrative funds paid under this section to the Indian tribe not later than the preceding fiscal year.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4D84FF77F7D7412BADE109F49065B19D"><enum>(B)</enum><header>Start up funds</header><text>The adjustment in administrative funds described in subparagraph (A) shall consist of an amount for start up funds, negotiated with the Indian tribe, of not less than $10,000 nor more than $100,000 for each fiscal year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HEF0D44C0D63442BFB522470F97C16502"><enum>6.</enum><header>School breakfast program</header><text display-inline="no-display-inline">Section 15 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1784">42 U.S.C. 1784</external-xref>) is amended by striking paragraph (1) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="H6E883A51855441F3A9A14BC906061F8F" style="OLC">
 <paragraph id="H11E1E96AB6564755AF946C5FA8798643"><enum>(1)</enum><header>State</header><text>The term <term>State</term> means—</text> <subparagraph id="H01C5525554E145C7B2EF4E47E7CD3B3D"><enum>(A)</enum><text>any of the 50 States;</text>
 </subparagraph><subparagraph id="H92EA84C316414B5CAD226A1F08F3355A"><enum>(B)</enum><text>the District of Columbia;</text> </subparagraph><subparagraph id="H196AB9975A3447048152D683475D12BC"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text>
 </subparagraph><subparagraph id="HEC5389EE5C9145A4B45F4588EA7FC55F"><enum>(D)</enum><text>the Virgin Islands;</text> </subparagraph><subparagraph id="H1AF0F8B22895405CA35000D10F268465"><enum>(E)</enum><text>Guam;</text>
 </subparagraph><subparagraph id="H961D62F6A6FC41B28F87C85E5691E954"><enum>(F)</enum><text>American Samoa;</text> </subparagraph><subparagraph id="H0D985BC4F6F74B33BF20E20897F39E07"><enum>(G)</enum><text>the Commonwealth of the Northern Mariana Islands; or</text>
 </subparagraph><subparagraph id="H4857DFFBE4C94581BBFD285CD31286B1"><enum>(H)</enum><text>an Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
