Russell National School Lunch Act to prohibit the stigmatization of
			 children who are unable to pay for meals.</official-title></form>
	<legis-body id="H8A9D73CF73EB4774AE0FD21AFF861681" style="OLC">
 <section id="H7C757CBF04D34A54B8D5AA515C387E9A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Anti-Lunch Shaming Act of 2019</short-title></quote>.</text> </section><section id="H6832D586ECBF485792B1021FBD8666E3"><enum>2.</enum><header>Prohibition on stigmatization of children who are unable to pay for meals</header><text display-inline="no-display-inline">Section 9(b)(10) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(10)</external-xref>) is amended—</text>
 <paragraph id="H51E95A70A3FF4BD8830BE642F76DE5FF"><enum>(1)</enum><text>by striking <quote>(10) No physical</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H9D25907730EE44DE8B5041624977B2E8" style="OLC"> <paragraph id="H3978D5AD2B494140BA326D927142BAF3"><enum>(10)</enum><header>Discriminatory or stigmatizing treatment of children by schools</header> <subparagraph id="H4FD1CB9C691F427ABA1DB858E2E61FAB"><enum>(A)</enum><header>Discrimination based on eligibility</header><text>No physical</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HC6C533E90D354A67A4F45F60CFD8421D"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H5154548695924E219A52D6C27DEF849B" style="OLC"> <subparagraph id="H83A4AFFCC8FD4A89AA72C7DF7544FFF3"><enum>(B)</enum><header>Stigmatization based on lack of funds or debt</header> <clause id="HA46AECB764EB4B07BF3D46BB3F1520AF"><enum>(i)</enum><header>Definition of covered child</header><text>In this subparagraph, the term <term>covered child</term> means a child who—</text>
 <subclause id="H0200DB32DDB845B1908D5148CE47FB27"><enum>(I)</enum><text>is a student at a school that participates in—</text> <item id="H6D29416ED69D4E23A64A2F99778647E5"><enum>(aa)</enum><text>the school lunch program established under this Act; or</text>
 </item><item id="HF3BD2AB3CE3646FDA7AFC01857C33C66"><enum>(bb)</enum><text>the school breakfast program established by section 4 of the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and</text> </item></subclause><subclause id="HABD52C7626564E12A6ECD4FD7E54F0F1"><enum>(II)</enum> <item commented="no" display-inline="yes-display-inline" id="H56C81088C62E406D9B9ADF795C86C664"><enum>(aa)</enum><text>does not have funds to pay for a lunch or breakfast at the school; or</text>
 </item><item id="HF4D5E9F1A8044AE3A631C4737D21CE68" indent="up1"><enum>(bb)</enum><text>has outstanding credit that was extended by a school food authority for a lunch or breakfast at the school.</text>
								</item></subclause></clause><clause id="H37B66626C3134F93ABF5D017195FB2F9"><enum>(ii)</enum><header>Requirements of school food authorities</header>
 <subclause id="H1BCFF8AA0D9D427FA88EA4BD31FA7FB7"><enum>(I)</enum><header>In general</header><text>A school food authority shall not permit—</text> <item id="H56772ED95EE54F7487A4931B0FFB66BA"><enum>(aa)</enum><text>the public identification or stigmatization of a covered child, such as by requiring the covered child to wear a wristband or display a hand stamp to identify the covered child as a covered child; or</text>
 </item><item id="HD609D0734E034A7CBF99FF52A0EDB290"><enum>(bb)</enum><text>any requirement that a covered child, because of the status of the covered child as a covered child—</text>
 <subitem id="H39EE71BE32C14D2DB7B42495B38CCFB2"><enum>(AA)</enum><text>perform chores or any other activity that is not required of students generally; or</text> </subitem><subitem id="HC38B9B1DBFD54C8581E22DD575ACA054"><enum>(BB)</enum><text>dispose of a lunch or breakfast after it has been served to the covered child.</text>
									</subitem></item></subclause><subclause id="HCF7C9D11E42E4FF389606472671CF53A"><enum>(II)</enum><header>Communications</header>
 <item id="H02AA5EFECF0441F4AC0D1EAC9CBCC419"><enum>(aa)</enum><header>In general</header><text>Subject to item (bb), a school food authority shall require that any communication relating to an outstanding credit described in clause (i)(II)(bb) of a covered child shall be directed—</text>
 <subitem id="H41BFCC8D79B745C08AA449B1E4572845"><enum>(AA)</enum><text>to a parent or guardian of the covered child; and</text> </subitem><subitem id="H6916F8418BF547CF81117096CDD17253"><enum>(BB)</enum><text>not to the covered child.</text>
 </subitem></item><item id="H1B2E8CC4DB4543A680FBC089A40F40D4"><enum>(bb)</enum><header>Letters</header><text>A school food authority may permit a requirement that a covered child deliver a letter addressed to a parent or guardian of the covered child that contains a communication described in item (aa), subject to the condition that the letter shall not be distributed to the covered child in a manner that stigmatizes the covered child.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HA5ED522BFE1147C689DB35B688809DC2"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Secretary of Agriculture should ensure that—</text> <paragraph id="H50532536D1C44DEB9792D58263F96A74"><enum>(1)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H8B57A6B54A274285B8FEBC9E79C3A64D"><enum>(A)</enum><text>to the maximum extent practicable, an application for a free or reduced price lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.) is distributed—</text>
 <clause id="H0BC2435FA2A14670A48F4C17F585C683" indent="up1"><enum>(i)</enum><text>in an understandable and uniform format; and</text> </clause><clause id="H87D7DB6450034DB290D7E746965C65B9" indent="up1"><enum>(ii)</enum><text>by not later than July 1 each year; and</text>
 </clause></subparagraph><subparagraph id="H19B6F8445F12408D9E10A8EF98E62208" indent="up1"><enum>(B)</enum><text>a school food authority offers technical assistance to a parent or legal guardian to complete an application described in subparagraph (A);</text>
 </subparagraph></paragraph><paragraph id="H7D3B9120AB2049F28937DF60C747A1D1"><enum>(2)</enum><text>each school food authority coordinates with—</text> <subparagraph id="H2CB1EB3D5BD14A98A6D887D17F73DB6B"><enum>(A)</enum><text>the local educational agency liaison designated under section 722(g)(1)(J)(ii) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11432">42 U.S.C. 11432(g)(1)(J)(ii)</external-xref>) to ensure that homeless children and youths eligible to receive free lunches and breakfasts under section 9(b)(12)(A)(iv) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(12)(A)(iv)</external-xref>) receive those free lunches and breakfasts; and</text>
 </subparagraph><subparagraph id="H252A88163FD44923992D8BAB2400931F"><enum>(B)</enum><text>the State agency responsible for administering the State plans under parts B and E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621</external-xref> et seq.; <external-xref legal-doc="usc" parsable-cite="usc/42/470">42 U.S.C. 470</external-xref> et seq.) to ensure that foster children eligible to receive free lunches and breakfasts under section 9(b)(12)(A)(vii) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(12)(A)(vii)</external-xref>) receive those free lunches and breakfasts; and</text>
 </subparagraph></paragraph><paragraph id="H5410CDA7FEAE4BC2A6B0CB7D3BE2D4CC"><enum>(3)</enum><text>a school food authority that participates in the school lunch program or the school breakfast program under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.) or section 4 of the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), respectively—</text>
 <subparagraph id="H02695B2BA31E4652808E53D812D2AF22"><enum>(A)</enum><text>shall provide to a child who requests a lunch or breakfast a lunch or breakfast, regardless of whether the child—</text>
 <clause id="H1CF5CACE54344AF0B3F544340FCB62FB"><enum>(i)</enum><text>has money to pay for the lunch or breakfast; or</text> </clause><clause id="HDCD9D41E34284D10A007273E419FCF97"><enum>(ii)</enum><text>owes money for a lunch or breakfast;</text>
 </clause></subparagraph><subparagraph id="HD7D712DE95544C07B0FED5504C84D611"><enum>(B)</enum><text>shall not provide to a child who qualifies for a free or reduced price lunch or breakfast an alternate meal that is not provided to students generally; and</text>
 </subparagraph><subparagraph id="H369D022883B0457DA9F670DDA28686B5"><enum>(C)</enum><text>should explore innovative ways to use technology to improve and coordinate communications with parents and guardians with respect to functions such as—</text>
 <clause id="H4647BC2FFB75444EADEE59BD98ABEDB5"><enum>(i)</enum><text>prepayment for meals;</text> </clause><clause id="H4245E972BA5346469779FF344F237F44"><enum>(ii)</enum><text>checking balances for school meals;</text>
 </clause><clause id="HE656A710C73C4256BF703F082FF58E2F"><enum>(iii)</enum><text>adding funds to accounts for school meals;</text> </clause><clause id="H9E0BD260584747A399F77F0761CE1DED"><enum>(iv)</enum><text>addressing outstanding debt for school meals; and</text>
 </clause><clause id="H5B56F68FC4F54F0E9768EF616B9A98DB"><enum>(v)</enum><text>sending automatic emails when an account balance is low.</text> </clause></subparagraph></paragraph></section></legis-body></bill>
