			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant to provide mental health services and behavioral health services to at-risk
			 youth, and for other purposes.</official-title></form>
	<legis-body id="H6DCC48FCBC3F4C31A6919D6D4620F5F5" style="OLC">
 <section id="H43A5556984B041D989827F857504726B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminating Debtor’s Prison for Kids Act of 2019</short-title></quote>.</text> </section><section id="H5EF66174AC2845B59D15B74D67BCF545"><enum>2.</enum><header>Youth mental health grant</header> <subsection id="H6BBE229CDB0E4C51843EB5FF538D3F1B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning not later than 180 days after the date of the enactment of this Act, the Attorney General shall carry out a program under which the Attorney General makes grants to eligible States for the purpose of providing evidence-based and trauma-informed mental and behavioral health services to at-risk youth in any school, secure detention facility, or secure correctional facility in the State.</text>
 </subsection><subsection id="H6BEFA51C4DF24A1EB177DBB603D64AE1"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, a State shall—</text> <paragraph id="HEBDA4B62EF1A45BD842AE29A1B77E821"><enum>(1)</enum><text display-inline="yes-display-inline">certify to the Attorney General that the laws of the State prohibit a juvenile offender or a parent or guardian of such an offender from being ordered to pay probation supervision fees or court administrative fees, including the cost of court-appointed attorneys or public defenders, the cost of prosecution, and other administrative costs of the court;</text>
 </paragraph><paragraph id="HC46FF682B77D47C2B794BCA8923CA0C8"><enum>(2)</enum><text display-inline="yes-display-inline">certify to the Attorney General that the laws of the State prohibit a parent or guardian of a juvenile offender from paying child support or other costs for detention or post-adjudication placement to the State; and</text>
 </paragraph><paragraph id="HE06B8F36CD594802A5EE4B7252684FB5"><enum>(3)</enum><text>submit to the Attorney General an application at such time, in such manner, and containing such information as the Attorney General may require.</text>
 </paragraph></subsection><subsection id="HC684854BADA04A8B98FEC28BF36FB76B"><enum>(c)</enum><header>Use of funds</header><text>A State that receives a grant under this section shall use the grant to provide evidence-based and trauma-informed mental and behavioral health services to at-risk youth in any school, secure detention facility, or secure correctional facility in the State.</text>
			</subsection><subsection display-inline="no-display-inline" id="HCCD69ABB632441FBAB3CC0C6EFE82E14">
				<enum>(d)</enum>
				<header>Contracts and Subawards</header>
 <paragraph id="HA65C45C4C18C42CF86660B9A1DC93DBB"><enum>(1)</enum><header>In general</header><text>A State may, in using a grant under this section for purposes authorized by subsection (c), use all or a portion of that grant to contract with or make one or more subawards to one or more units of local government.</text>
				</paragraph><paragraph id="H3DEE3F40CF85423DA67FC2703325D6B7">
 <enum>(2)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An entity that receives a contract or a subaward under this subsection may use such funds to provide services or benefits described under subsection (c).</text>
 </paragraph></subsection><subsection id="H900C8140ABCA4A4488B02C347814E52B"><enum>(e)</enum><header>Information for report</header><text display-inline="yes-display-inline">A State that receives a grant under this section shall provide to an independent criminal justice organization, selected by the Attorney General, such information as is necessary to complete the report described in section 3.</text>
 </subsection><subsection id="HDAB9137A3D4D41DBAA6BE59AA88C7320"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $500,000,000 for each of fiscal years 2020 through 2024.</text>
			</subsection></section><section display-inline="no-display-inline" id="H9B532BD31CA44A11B35DC8936212A976" section-type="subsequent-section"><enum>3.</enum><header>National report</header>
 <subsection id="H4FC71A30ACF74712BC0E7A2F6D4E3E02"><enum>(a)</enum><header>Independent report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, an independent criminal justice organization, selected by the Attorney General, shall submit to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate a national report on fines and fees imposed on adults and juveniles in the criminal justice system, including—</text>
 <paragraph id="HB589219A17914F3D81986B7D92F2E610"><enum>(1)</enum><text display-inline="yes-display-inline">information with respect to the monetary amount of fines and fees imposed, including the race, ethnicity, tribal affiliation, and other demographic data of the individuals upon whom such fines and fees are imposed and the rate at which individuals are reincarcerated within 1 year of release from a secure detention facility or a secure correctional facility;</text>
 </paragraph><paragraph id="H7CBC8EEC84854967A59ACC0AC0A1A126"><enum>(2)</enum><text>a description of each type of service for which a fee is imposed;</text> </paragraph><paragraph id="H896A1E6343BA4AB89D74B360367D1225"><enum>(3)</enum><text display-inline="yes-display-inline">a description of each type of charge for which a fine is imposed;</text>
 </paragraph><paragraph id="H85D01705C28143CAA2D25CE170DB1BD3"><enum>(4)</enum><text>a comparison of the average length of imprisonment or detention for individuals who are unable to pay a fine and the average length of imprisonment or detention for individuals who are able to pay a fine; and</text>
 </paragraph><paragraph id="H17412F0717A84CAE9C6D5AD959646C58"><enum>(5)</enum><text>a disclosure of the sum total of fines and fees collected minus the cost for efforts to collect such sum.</text>
 </paragraph></subsection><subsection id="H2130B4FBDC0940649A98C08C2C569B6D"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $2,000,000 for fiscal year 2020, which shall remain available until expended.</text>
 </subsection></section><section id="HBB76C3F848E34862A5F7E868CF9D3235"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H6418619A670D4DDB922A50E6C075C8C6"><enum>(1)</enum><header>At-risk youth</header><text display-inline="yes-display-inline">The term <quote>at-risk youth</quote> means an individual who—</text>
 <subparagraph id="H84D4F4BEB4C04C38A65246FE311FE203"><enum>(A)</enum><text>has not attained the age of 21; and</text> </subparagraph><subparagraph id="H38C2EB01F60C4456AE55805BC35CE18E"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="HDAEB53E7C4B447089E63E61F04DC2181"><enum>(i)</enum><text display-inline="yes-display-inline">is likely to fail academically without intervention, including an individual who—</text>
 <subclause id="H7C0A0F6BC7504EF492D1AC4CB4237E6F" indent="up1"><enum>(I)</enum><text>has a high truancy rate;</text> </subclause><subclause id="HE80EFB87F91B41348A9C811986A7DF4E" indent="up1"><enum>(II)</enum><text>has withdrawn from school previously;</text>
 </subclause><subclause id="HEA21C2A9F4A04A25987CCBC0392E2152" indent="up1"><enum>(III)</enum><text>is not less than 1 year behind the appropriate grade level for such individual; or</text> </subclause><subclause id="HB4A1D80B07C0468386E70EF3CE855761" indent="up1"><enum>(IV)</enum><text>has limited English language proficiency;</text>
 </subclause></clause><clause id="H37D8FA02E759449BB21FB8D6CA1290FE" indent="up1"><enum>(ii)</enum><text>uses drugs or alcohol;</text> </clause><clause id="HA805B2CFB29F419AAC6F3249799EFC85" indent="up1"><enum>(iii)</enum><text>is pregnant or a parent;</text>
 </clause><clause id="H6AEA6B563CEE46C4BE02E33018C0FBF4" indent="up1"><enum>(iv)</enum><text>is a gang member;</text> </clause><clause id="H556C9E76B39940B8917C4CEB7FDC9EFC" indent="up1"><enum>(v)</enum><text display-inline="yes-display-inline">is in contact with the juvenile justice system; or</text>
 </clause><clause id="H652F328BB2244BBDA5625BD8BD04AF7D" indent="up1"><enum>(vi)</enum><text display-inline="yes-display-inline">is homeless, has run away from home, or is in foster care.</text> </clause></subparagraph></paragraph><paragraph id="H32F417E453F944AC9865A62DE32C51F5"><enum>(2)</enum><header>Evidence-based</header><text display-inline="yes-display-inline">The term <quote>evidence-based</quote> has the meaning given such term in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11103">34 U.S.C. 11103</external-xref>).</text>
 </paragraph><paragraph id="HD86211BD2A0C4422B9DD7444BADF136A"><enum>(3)</enum><header>Juvenile offender</header><text>The term <quote>juvenile offender</quote> means an individual—</text> <subparagraph id="H8734CA1E84EB4F4C9DA26A53176B116E"><enum>(A)</enum><text>who has not attained the age of 21; and</text>
				</subparagraph><subparagraph id="HDD3DCE33485C4846B01738B898DF9924"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HADA959783EFD4569BA543C4CAF9C8FF1"><enum>(i)</enum><text>against whom a petition is filed for the adjudication of a delinquency offense under the laws of a State or the United States; or</text>
 </clause><clause id="HDBD036A39B074F44A84827B31C5C4A8D" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">who has been adjudicated delinquent for a delinquency offense under the laws of a State or the United States.</text>
 </clause></subparagraph></paragraph><paragraph id="H5F39791567374552BDB25B8A96C9D3E5"><enum>(4)</enum><header>Secure correctional facility</header><text display-inline="yes-display-inline">The term <quote>secure correctional facility</quote> has the meaning given such term in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11103">34 U.S.C. 11103</external-xref>).</text>
 </paragraph><paragraph commented="no" id="H354D392C496647CEA90BC0DF17963264"><enum>(5)</enum><header>Secure detention facility</header><text>The term <quote>secure detention facility</quote> has the meaning given such term in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11103">34 U.S.C. 11103</external-xref>).</text>
 </paragraph><paragraph id="H6EEB964FF14E4ADDA6DFE085C3F6F262"><enum>(6)</enum><header>School</header><text display-inline="yes-display-inline">The term <quote>school</quote> means—</text> <subparagraph id="HA0EA1EC0F66945059518C4CEDFC699E6"><enum>(A)</enum><text display-inline="yes-display-inline">an early childhood education program (as such term is defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>));</text>
 </subparagraph><subparagraph id="H0B296C8EC6004A7291627E4FCA634A97"><enum>(B)</enum><text display-inline="yes-display-inline">an elementary school (as such term is defined in section 8101 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)); or</text> </subparagraph><subparagraph id="H10665803CEC94BA58A41187426593FB6"><enum>(C)</enum><text display-inline="yes-display-inline">a secondary school (as such term is defined in section 8101 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)).</text>
 </subparagraph></paragraph><paragraph id="HE37DA8BB0ABE4F71A043EB2A5976B24D"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any possession of the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD2ADDDE9839348C5B5321536B16D0087"><enum>(8)</enum><header>Trauma-informed</header><text display-inline="yes-display-inline">The term <quote>trauma-informed</quote> has the meaning given such term in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11103">34 U.S.C. 11103</external-xref>).</text>
