 <section id="H8654E127E0FA4AC4889888AD8F5CD4E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sustainable Chemistry Research and Development Act of 2019</short-title></quote>.</text> </section><section id="HAAEDE8855FBD4A36B65CAB0907C45935"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
 <paragraph id="HE0156E27EFE64732AB7A4ADBCA2F4EB4"><enum>(1)</enum><text>Congress recognized the importance and value of sustainable chemistry and the role of the Federal Government in section 114 of the American Innovation and Competitiveness Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/329">Public Law 114–329</external-xref>);</text>
 </paragraph><paragraph id="H0F1B11676A0D4032A50E3C44B8AF2D25"><enum>(2)</enum><text>sustainable chemistry and materials transformation is a key value contributor to business competitiveness across many industrial and consumer sectors;</text>
 </paragraph><paragraph id="H35821A2B8CAA4F11A82AA8ADFD5602C7"><enum>(3)</enum><text>companies across hundreds of supply chains critical to the American economy are seeking to reduce costs and open new markets through innovations in manufacturing and materials, and are in need of new innovations in chemistry, including sustainable chemistry;</text>
 </paragraph><paragraph id="H027FDE05E3054652BC1692215D119A12"><enum>(4)</enum><text>sustainable chemistry can improve the efficiency with which natural resources are used to meet human needs for chemical products while avoiding environmental harm, reduce or eliminate the emissions of and exposures to hazardous substances, minimize the use of resources, and benefit the economy, people, and the environment; and</text>
 </paragraph><paragraph id="HCDF4799D7207421A9E97AB0F0AE23C70"><enum>(5)</enum><text>a recent report by the Government Accountability Office (GAO–18–307) found that the Federal Government could play an important role in helping realize the full innovation and market potential of sustainable chemistry technologies, including through a coordinated national effort on sustainable chemistry and standardized tools and definitions to support sustainable chemistry research, development, demonstration, and commercialization.</text>
			</paragraph></section><section id="HE6DAB2390CC743FF8370711F662E956F"><enum>3.</enum><header>National coordinating entity for sustainable chemistry</header>
 <subsection id="H71E781DA163A4055915F859C5F91760A"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Director of the Office of Science and Technology Policy shall convene an interagency entity (referred to in this Act as the <quote>Entity</quote>) under the National Science and Technology Council with the responsibility to coordinate Federal programs and activities in support of sustainable chemistry, including those described in sections 5 and 6.</text>
 </subsection><subsection id="H78A7ABA42E9D40748A3ED166F95BBAA6"><enum>(b)</enum><header>Coordination with existing groups</header><text>In convening the Entity, the Director of the Office of Science and Technology Policy shall consider overlap and possible coordination with existing committees, subcommittees, or other groups of the National Science and Technology Council, such as—</text>
 <paragraph id="HC7FE81DCE57C4A6FA0180A329231CE9F"><enum>(1)</enum><text>the Committee on Environment;</text> </paragraph><paragraph id="H7BD70ED0DA724837A3F0A7D1AD14703B"><enum>(2)</enum><text>the Committee on Technology;</text>
 </paragraph><paragraph id="HE81023E0A3F747359A151BB35B79324A"><enum>(3)</enum><text>the Committee on Science; or</text> </paragraph><paragraph id="H8E20BD7E8C9D4FDA8B46985F8189490E"><enum>(4)</enum><text>related groups or subcommittees.</text>
 </paragraph></subsection><subsection id="H570E15646CED492CB37E628E95490F9D"><enum>(c)</enum><header>Co-Chairs</header><text display-inline="yes-display-inline">The Entity shall be co-chaired by the Office of Science and Technology Policy and a representative from the Environmental Protection Agency, the National Institute of Standards and Technology, the National Science Foundation, or the Department of Energy, as selected by the Director of the Office of Science and Technology Policy.</text>
 </subsection><subsection id="H608EF9A3542A443BB7395A234881E938"><enum>(d)</enum><header>Agency participation</header><text display-inline="yes-display-inline">The Entity shall include representatives, including subject matter experts, from the Environmental Protection Agency, the National Institute of Standards and Technology, the National Science Foundation, the Department of Energy, the Department of Agriculture, the Department of Defense, the National Institutes of Health, the Centers for Disease Control and Prevention, the Food and Drug Administration, the Office of Management and Budget, and other related Federal agencies, as appropriate.</text>
 </subsection><subsection id="H0F65AF44B9D34E6C9D9148390999C500"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The Entity shall terminate on the date that is 10 years after the date of enactment of this Act. <italic></italic></text> </subsection></section><section id="HBC44AFEEB1D848A9AAC6E3C5179775DE"><enum>4.</enum><header>Roadmap for sustainable chemistry</header> <subsection id="H75173E461AE94762A2675006673CC106"><enum>(a)</enum><header>Roadmap</header><text>Not later than 2 years after the date of enactment of this Act, the Entity shall—</text>
 <paragraph id="H0EEAC68327A74E6FAC73F216E95E6E93"><enum>(1)</enum><text>consult with relevant stakeholders including representatives from industry, academia, the Federal Government, and international entities to develop and update as needed a consensus definition of <quote>sustainable chemistry</quote> to guide the activities under this Act;</text>
 </paragraph><paragraph id="H77E12BE7A8754678B633C65A99C94A26"><enum>(2)</enum><text>develop a working framework of attributes characterizing and metrics for assessing sustainable chemistry, as described in subsection (b);</text>
 </paragraph><paragraph id="H8B08913DC1014DCC9AE52A0D9528B1A1"><enum>(3)</enum><text>assess the state of sustainable chemistry in the United States as a key benchmark from which progress under the activities described in this Act can be measured, including assessing key sectors of the United States economy, key technology platforms, commercial priorities, and barriers to innovation;</text>
 </paragraph><paragraph id="HF5E418DBF33D485F86AC50146D0D47A8"><enum>(4)</enum><text>coordinate and support Federal research, development, demonstration, technology transfer, commercialization, education, and training efforts in sustainable chemistry, including budget coordination and support for public-private partnerships, as appropriate;</text>
 </paragraph><paragraph id="H091F0381D62D430BB24D5C0BD45D9192"><enum>(5)</enum><text>identify methods by which the Federal agencies can facilitate the development of incentives for development, consideration and use of sustainable chemistry processes and products, including innovative financing mechanisms;</text>
 </paragraph><paragraph id="H33942E1CD0DA4C3DBFD028DB0F598A8B"><enum>(6)</enum><text>identify major scientific challenges, roadblocks, or hurdles to transformational progress in improving the sustainability of the chemical sciences; and</text>
 </paragraph><paragraph id="H7803C23F7C7A4F52A4CA3877DAABAC8A"><enum>(7)</enum><text>identify other opportunities for expanding Federal efforts in support of sustainable chemistry.</text> </paragraph></subsection><subsection id="H897D160A1D4343F68D979F546EF0B741"><enum>(b)</enum><header>Characterizing and assessing sustainable chemistry</header><text>The Entity shall develop a working framework of attributes characterizing and metrics for assessing sustainable chemistry for the purposes of carrying out the Act. In developing this framework, the Entity shall—</text>
 <paragraph id="HE1CE86628C9943A1A7E75E4EA621E959"><enum>(1)</enum><text>seek advice and input from stakeholders as described in subsection (c);</text> </paragraph><paragraph id="H202CCBFE912242B484BD4D3F383F2D47"><enum>(2)</enum><text>consider existing definitions of or frameworks characterizing and metrics for assessing sustainable chemistry already in use at Federal agencies;</text>
 </paragraph><paragraph id="H9A51FAA2A56A4C979B9036C348027934"><enum>(3)</enum><text>consider existing definitions of or frameworks characterizing and metrics for assessing sustainable chemistry already in use by international organizations of which the United States is a member, such as the Organisation for Economic Co-operation and Development; and</text>
 </paragraph><paragraph id="H58CDD27F4205479BA6AA03C52B4C3947"><enum>(4)</enum><text>consider any other appropriate existing definitions of or frameworks characterizing and metrics for assessing sustainable chemistry.</text>
 </paragraph></subsection><subsection id="HED7A02E294BC45EBB81BEB0111655F21"><enum>(c)</enum><header>Consultation</header><text>In carrying out the duties described in subsections (a) and (b), the Entity shall consult with stakeholders qualified to provide advice and information to guide Federal activities related to sustainable chemistry through workshops, requests for information, and other mechanisms as necessary. The stakeholders shall include representatives from—</text>
 <paragraph id="H505C7FB37D7D49F79952A4B6D24AEAB7"><enum>(1)</enum><text>business and industry (including trade associations and small- and medium-sized enterprises from across the value chain);</text>
 </paragraph><paragraph id="HDDED0576EF504617B166B32DEB1A0D7A"><enum>(2)</enum><text>the scientific community (including the National Academies of Sciences, Engineering, and Medicine, scientific professional societies, and academia);</text>
 </paragraph><paragraph id="H59696FBD7E894BD790358AB1C790E9C2"><enum>(3)</enum><text>the defense community;</text> </paragraph><paragraph id="H03060618DC344B12AE9E13EF571B633B"><enum>(4)</enum><text>State, tribal, and local governments, including nonregulatory State or regional sustainable chemistry programs, as appropriate;</text>
 </paragraph><paragraph id="HB81CC678A65D4B93867902ECECA77BC6"><enum>(5)</enum><text>nongovernmental organizations; and</text> </paragraph><paragraph id="H5055427B78FE44779D6032B9703ABAAF"><enum>(6)</enum><text>other appropriate organizations.</text>
				</paragraph></subsection><subsection id="HA1393309161847EEB7D3BA49BE0CE59F"><enum>(d)</enum><header>Report to congress</header>
 <paragraph id="H6C4716747C574A21899F5DAE0317F98A"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Entity shall submit a report to the Committee on Environment and Public Works, the Committee on Commerce, Science, and Transportation, and the Committee on Appropriations of the Senate, and the Committee on Science, Space, and Technology, the Committee on Energy and Commerce, and the Committee on Appropriations of the House of Representatives. In addition to the elements described in subsections (a) and (b), the report shall include—</text>
 <subparagraph id="H5271862BCF424D9F826346D6DE45119F"><enum>(A)</enum><text>a summary of federally funded, sustainable chemistry research, development, demonstration, technology transfer, commercialization, education, and training activities;</text>
 </subparagraph><subparagraph id="HACFCBAB575344224A1386859168E17F3"><enum>(B)</enum><text>a summary of the financial resources allocated to sustainable chemistry initiatives;</text> </subparagraph><subparagraph id="H9DC7701731CA4F09BA506881FA13FA58"><enum>(C)</enum><text>an assessment of the current state of sustainable chemistry in the United States, including the role that Federal agencies are playing in supporting it;</text>
 </subparagraph><subparagraph id="H9F6C412E532942A1AEB49808C7B7B329"><enum>(D)</enum><text>an analysis of the progress made toward achieving the goals and priorities of this Act, and recommendations for future program activities;</text>
 </subparagraph><subparagraph id="H6AD2632E7E094AA0B60455C90F8AB1E2"><enum>(E)</enum><text>an assessment of the benefits of expanding existing, federally supported, regional innovation and manufacturing hubs, centers, and institutes to include sustainable chemistry and the value of directing the creation of one or more dedicated sustainable chemistry centers of excellence, hubs, or institutes; and</text>
 </subparagraph><subparagraph id="H669B74B05A5F44058A0B0C496F5A98BF"><enum>(F)</enum><text>an evaluation of steps taken and future strategies to avoid duplication of efforts, streamline interagency coordination, facilitate information sharing, and spread best practices among participating agencies.</text>
 </subparagraph></paragraph><paragraph id="H9240E7DF6F57485F8163AD326718A1B0"><enum>(2)</enum><header>Submission to GAO</header><text>The Entity shall also submit the report described in paragraph (1) to the Comptroller General of the United States for consideration in future Congressional inquiries.</text>
				</paragraph></subsection></section><section id="HB69324E627CE4416B26C6148C8448B26"><enum>5.</enum><header>Agency activities in support of sustainable chemistry</header>
 <subsection id="H0621E50B450B4F82AE9136AF5BDADD00"><enum>(a)</enum><header>In general</header><text>The agencies participating in the Entity shall carry out activities in support of sustainable chemistry, as appropriate to the specific mission and programs of each agency.</text>
 </subsection><subsection id="H79BC9ED5A33240C1962D5E85666DCDD1"><enum>(b)</enum><header>Activities</header><text>The activities described in subsection (a) shall—</text> <paragraph id="HAE9CA3810EDA429087B6184E694ED24F"><enum>(1)</enum><text>incorporate sustainable chemistry into existing research, development, demonstration, technology transfer, commercialization, education, and training programs, that the agency determines to be relevant, including consideration of—</text>
 <subparagraph id="HC845B62B2C6B42BFA808BF87AD1E639E"><enum>(A)</enum><text>merit-based competitive grants to individual investigators and teams of investigators, including, to the extent practicable, early career investigators for research and development;</text>
 </subparagraph><subparagraph id="H615974059D7A46C2AE1E7EECBFFDAA43"><enum>(B)</enum><text>grants to fund collaborative research and development partnerships among universities, industry, and nonprofit organizations;</text>
 </subparagraph><subparagraph id="H082CF22151C6444B9C48B79AA7FB7D27"><enum>(C)</enum><text>coordination of sustainable chemistry research, development, demonstration, and technology transfer conducted at Federal laboratories and agencies;</text>
 </subparagraph><subparagraph id="HF96D6075859B435EA69D39811B67F952"><enum>(D)</enum><text>incentive prize competitions and challenges in coordination with such existing Federal agency programs; and</text>
 </subparagraph><subparagraph id="HF2DA08188CE24A9A9EBAA8ADD7ED94C6"><enum>(E)</enum><text>grants, loans, and loan guarantees to aid in the technology transfer and commercialization of sustainable chemicals, materials, processes, and products;</text>
 </subparagraph></paragraph><paragraph id="HF90BB1FA878345F0A349A3189FADB5CD"><enum>(2)</enum><text>collect and disseminate information on sustainable chemistry research, development, technology transfer, and commercialization, including information on accomplishments and best practices;</text>
 </paragraph><paragraph id="HB3263AA679044888B40CDB7B194FB44C"><enum>(3)</enum><text display-inline="yes-display-inline">raise awareness of sustainable chemistry concepts through public outreach activities;</text> </paragraph><paragraph id="HF25E96F8251C4839BA1ACAB8BBAE3536"><enum>(4)</enum><text>expand the education and training of students at all levels of education, professional scientists and engineers, and other professionals involved in all aspects of sustainable chemistry and engineering appropriate to that level of education and training, including through—</text>
 <subparagraph id="H548DAAB87ADE49D59C6C7459EB14998C"><enum>(A)</enum><text>partnerships with industry as described in section 6;</text> </subparagraph><subparagraph id="H2564C5A2BFDC4C50ABB96E07EDFAB62A"><enum>(B)</enum><text>support for the integration of sustainable chemistry principles into elementary, secondary, undergraduate, and graduate chemistry and chemical engineering curriculum and research training, as appropriate to that level of education and training; and</text>
 </subparagraph><subparagraph id="HF655EA136FA144C2B8760BDBFFB98205"><enum>(C)</enum><text>support for integration of sustainable chemistry principles into existing or new professional development opportunities for professionals including teachers, faculty, and individuals involved in laboratory research, (product development, materials specification and testing, life cycle analysis, and management);</text>
 </subparagraph></paragraph><paragraph id="H6A2ADB3179FD45E9B17F5352EBB808F3"><enum>(5)</enum><text>as relevant to an agency’s programs, examine methods by which the Federal agencies, in collaboration and consultation with the National Institute of Standards and Technology, may facilitate the development or recognition of validated, standardized tools for performing sustainability assessments of chemistry processes or products;</text>
 </paragraph><paragraph id="HDD44EFA1F0E5499E8AA57FE1A9C6D23D"><enum>(6)</enum><text>through programs identified by an agency, support (including through technical assistance, participation, financial support, communications tools, awards, or other forms of support) outreach and dissemination of sustainable chemistry advances such as non-Federal symposia, forums, conferences, and publications in collaboration with, as appropriate, industry, academia, scientific and professional societies, and other relevant groups;</text>
 </paragraph><paragraph id="H9FE018634B9E4D1E9797DBDF9F5AE94F"><enum>(7)</enum><text>provide for public input and outreach to be integrated into the activities described in this section by the convening of public discussions, through mechanisms such as public meetings, consensus conferences, and educational events, as appropriate;</text>
 </paragraph><paragraph id="HEB5ACAA12969496DAD2F75475193BEFE"><enum>(8)</enum><text>within each agency, develop metrics to track the outputs and outcomes of the programs supported by that agency; and</text>
 </paragraph><paragraph id="H776FA1896980432A987EE6C2BE65F7DA"><enum>(9)</enum><text>incentivize or recognize actions that advance sustainable chemistry products, processes, or initiatives, including through the establishment of a nationally recognized awards program through the Environmental Protection Agency to identify, publicize, and celebrate innovations in sustainable chemistry and chemical technologies.</text>
 </paragraph></subsection><subsection id="H7B3FC2FF739B4C84AEDC761309633EA9"><enum>(c)</enum><header>Limitations</header><text>Financial support provided under this section shall—</text> <paragraph id="HE2734D50251B4F8DA1C7F180FA8B9C49"><enum>(1)</enum><text>be available only for pre-competitive activities; and</text>
 </paragraph><paragraph id="H81FF264B444648FFAA33010CCD6B664F"><enum>(2)</enum><text>not be used to promote the sale of a specific product, process, or technology, or to disparage a specific product, process, or technology.</text>
 </paragraph></subsection><subsection id="H2DCD2155F8C54BFCB0DC673168F0DD0E"><enum>(d)</enum><header>Agency budget report</header><text display-inline="yes-display-inline">For each of fiscal years 2021 through 2030, not later than 90 days after submission of the President’s annual budget request, the Entity shall prepare and submit to the Committee on Environment and Public Works, the Committee on Commerce, Science, and Transportation, and the Committee on Appropriations of the Senate, and the Committee on Science, Space, and Technology, the Committee on Energy and Commerce, and the Committee on Appropriations of the House of Representatives a report that includes a summarized agency budget in support of the activities under this Act for the fiscal year to which such budget request applies, and for the then current fiscal year, including a breakout of spending for each agency participating in such activities.</text>
			</subsection></section><section id="H451D0AA082EF42F7B10BC9E68D6076B6"><enum>6.</enum><header>Partnerships in sustainable chemistry</header>
 <subsection id="HA336C8CD5AFC4CB9A0E06614A1111DFA"><enum>(a)</enum><header>In general</header><text>The agencies participating in the Entity may facilitate and support, through financial, technical, or other assistance, the creation of partnerships between institutions of higher education, nongovernmental organizations, consortia, or companies across the value chain in the chemical industry, including small- and medium-sized enterprises, to—</text>
 <paragraph id="HDB7BAF7E24EF4DC5A93283302BDB71E6"><enum>(1)</enum><text>create collaborative sustainable chemistry research, development, demonstration, technology transfer, and commercialization programs; and</text>
 </paragraph><paragraph id="H4E29B85C24394FE9998AA419BC4A8B3C"><enum>(2)</enum><text>train students and retrain professional scientists, engineers, and others involved in materials specification on the use of sustainable chemistry concepts and strategies by methods, including—</text>
 <subparagraph id="H84F13B46D04A4BFC9CE92353414EC2F4"><enum>(A)</enum><text>developing or recognizing curricular materials and courses for undergraduate and graduate levels and for the professional development of scientists, engineers, and others involved in materials specification; and</text>
 </subparagraph><subparagraph id="HAEA2B5EBA9334FAF8DCDBE360C965FB6"><enum>(B)</enum><text>publicizing the availability of professional development courses in sustainable chemistry and recruiting professionals to pursue such courses.</text>
 </subparagraph></paragraph></subsection><subsection id="H07C66F681A1B493287E6D5158B53D7F4"><enum>(b)</enum><header>Private sector participation</header><text>To be eligible for support under this section, a partnership in sustainable chemistry shall include at least one private sector organization.</text>
 </subsection><subsection id="HC41BADAD08914DCEAD542CB5A1FD746C"><enum>(c)</enum><header>Selection of partnerships</header><text>In selecting partnerships for support under this section, the agencies participating in the Entity shall also consider the extent to which the applicants are willing and able to demonstrate evidence of support for, and commitment to, the goals outlined in the roadmap and report described in section 4.</text>
 </subsection><subsection id="H91BE3AEE1B6F4B059A8241BBE3D10A4D"><enum>(d)</enum><header>Prohibited use of funds</header><text>Financial support provided under this section may not be used—</text> <paragraph id="H1FFF523A707346CC882423E044FF4628"><enum>(1)</enum><text>to support or expand a regulatory chemical management program at an implementing agency under a State law;</text>
 </paragraph><paragraph id="HB6281B58031449B0BBADA7FB00A354C7"><enum>(2)</enum><text>to construct or renovate a building or structure; or</text> </paragraph><paragraph id="H12BC9BC9792341D88EEB8C58B822215B"><enum>(3)</enum><text>to promote the sale of a specific product, process, or technology, or to disparage a specific product, process, or technology.</text>
 </paragraph></subsection></section><section id="HB2111B1F2D36452B89267617672BB9D6"><enum>7.</enum><header>Prioritization</header><text display-inline="no-display-inline">In carrying out this Act, the Entity shall focus its support for sustainable chemistry activities on those that achieve, to the highest extent practicable, the goals outlined in the Act.</text>
 </section><section id="H75514CEDADC74494B73C0C198DFE16BC"><enum>8.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to alter or amend any State law or action with regard to sustainable chemistry, as defined by the State.</text>
