<subsection id="H5D6F522A937C4DD791596AE585FC2FE2"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>National Collegiate Athletics Act of 2019</short-title></quote> or the <quote><short-title>NCAA Act of 2019</short-title></quote>. </text></subsection> <subsection id="HE6AB6C758B53448397E45241BEE1ABD2"><enum>(b)</enum><header>Table of contents</header><text>The table of contents for this Act is as follows: </text>

<section id="H54FE4FECED934C018DB05165EA3981F7" commented="no"><enum>10.</enum><header>Enforcement</header><text display-inline="no-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following: </text> <quoted-block style="OLC" id="HD7C0C0CABB7A41A29084E754D6C4FB72" display-inline="no-display-inline"> <paragraph id="H0413745460C84255AD7C4157A57F685E"><enum>(30)</enum><text display-inline="yes-display-inline">The institution will comply with the requirements of title I of the NCAA Act of 2019. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8946C9A066F8448D98109A8C7235F59F"><enum>11.</enum><header>Amateurism</header> 
<subsection id="HEE18FF34B68D42F382390F3D47216D89"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), an institution of higher education may not restrict, or be a member of an intercollegiate athletic association that restricts amateur athletes from participating in amateur sports.</text></subsection> <subsection id="HF810DA71BE6E4FA0ABCF28561E9B9D5D"><enum>(b)</enum><header>Restrictions</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to restrictions with respect to—</text> 
<paragraph id="H952ED2E2CFF54B2E8098E1664AB570B4"><enum>(1)</enum><text display-inline="yes-display-inline">performance enhancement drugs;</text></paragraph> <paragraph id="H2AA74EFF997D4C898AC8C93D9D6D830C"><enum>(2)</enum><text>controlled substances which are illegal under the State laws in which the institution is located;</text></paragraph> 
<paragraph id="H05934BF7D8004506920B04256CE7D884"><enum>(3)</enum><text>educational requirements; or </text></paragraph> <paragraph id="H4A0330C4B70C4779AE523227111E9213"><enum>(4)</enum><text>student code violations.</text></paragraph> </subsection></section> 
<section id="H1FE672CB15DC45E6B69DD31470B3D34E"><enum>12.</enum><header>Scholarships</header> 
<subsection id="H48A406FDB0FB435D8768EFC3D3E9E7CF" commented="no"><enum>(a)</enum><header>Freshmen scholarship requirements</header> 
<paragraph id="H30CA7B22122940788CFDF306A84B232C" commented="no"><enum>(1)</enum><header>In general</header><text>In the case of a student described in paragraph (2), an institution of higher education may only provide a scholarship for at least 2 concurrent academic years.</text> </paragraph> <paragraph id="H8A470A3777554E83AAA04628AE8684A7" commented="no"><enum>(2)</enum><header>Student described</header><text>A student described under this paragraph is a student who—</text> 
<subparagraph id="HBB8653B8F5D341D9827CEED10ED9DE64" commented="no"><enum>(A)</enum><text>participates as an athlete in a collegiate revenue-generating sport;</text></subparagraph> <subparagraph id="HEF3709C709E5453788D27B42708DB67D" commented="no"><enum>(B)</enum><text>is an incoming freshman at such institution; and</text></subparagraph> 
<subparagraph id="H5B0B78540C6C417882E7F9F0736C90BE" commented="no"><enum>(C)</enum><text>does not transfer to such institution from another institution of higher education.</text></subparagraph></paragraph> </subsection> <subsection id="H9B9EC9E333A7429A9D3E02B001D7EA4F"><enum>(b)</enum><header>Other student athletes</header> <paragraph id="H6821037E5B5443E28960A4F51D2ED664"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a student described in paragraph (2), an institution of higher education may only provide a scholarship for at least 1 academic year. </text> </paragraph> 
<paragraph id="H349055B91DBB43EC9A314290D265B1CA"><enum>(2)</enum><header>Student described</header><text>A student described in this paragraph is a student who—</text> <subparagraph id="H74CEA2C41A0E451B98939F8EA2E59C66"><enum>(A)</enum><text>participates as an athlete in a collegiate revenue-generating sport; and</text></subparagraph> 
<subparagraph id="H9F94CC33656A4098BD2E29CE45A4FA17"><enum>(B)</enum><text>is not a recipient of a scholarship under subsection (a). </text></subparagraph></paragraph> </subsection> <subsection id="H3110D6D906AF45069879C5CDCA6DF81D" commented="no"><enum>(c)</enum><header>Amount of scholarship</header><text display-inline="yes-display-inline">The amount of a scholarship under subsection (a) or (b) shall be equal to the cost of attendance for the institution awarding such scholarship, as determined under section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>).</text></subsection> 
<subsection id="HBC8E3119BDA9400CB0733A769394B2DF"><enum>(d)</enum><header>Revocation</header><text>An institution of higher education may only revoke a scholarship under subsections (a) and (b) if the recipient of such scholarship—</text> <paragraph id="H9A4BBE03D3CA41ACAD1DD4AD4DBAC9E5"><enum>(1)</enum><text>elects to withdraw from participating in the collegiate revenue-generating sport; </text></paragraph> 
<paragraph id="HD2EE4132D73D49B7B3A6010C1FC3A390"><enum>(2)</enum><text display-inline="yes-display-inline">fails to complete mandatory time with respect to such sport;</text></paragraph> <paragraph id="H17BC3130417A41709F70508FAAA81B86"><enum>(3)</enum><text>is not an amateur athlete;</text></paragraph> 
<paragraph id="H99B812F5D014430F9C1373A32032B754"><enum>(4)</enum><text>violates the student code of conduct of the institution of higher education; or</text></paragraph> <paragraph id="HA9672C73509A4BBEB232E24BACE1D23B" commented="no"><enum>(5)</enum><text>has a GPA or academic performance below the standard for student athletes of the institution of higher education.</text></paragraph> </subsection></section> 
<section id="H34291B3A3EB046448397001DEA007A14" commented="no"><enum>13.</enum><header>Returning athlete scholarships</header> 
<subsection id="HCBE5CB9E8FA042AF888803AD3CF8AF93" commented="no"><enum>(a)</enum><header>Associates degree</header><text display-inline="yes-display-inline">In the case of a student that received a scholarship from an institution of higher education under subsection (a) or (b) of section 12 and attended such institution for a period of less than 2 academic years, such institution of higher education shall provide a needs-based scholarship to such student to complete the minimum coursework necessary to obtain an associate degree or equivalent, unless the athletes scholarship had been previously revoked under section 12(d).</text></subsection> <subsection id="H0D1B50B7F574444B95DC4DF2ABEF9AEA" commented="no"><enum>(b)</enum><header>Bachelors degree</header><text display-inline="yes-display-inline">In the case of a student that received a scholarship from an institution of higher education under subsection (a) or (b) of section 12 and attended such institution for a period of 2 or more academic years, such institution of higher education shall provide a needs-based scholarship to such student to complete the minimum coursework necessary to obtain a bachelors degree.</text></subsection> 
<subsection id="H228CB64A96BB4B07B1780DEFAE8A675E" commented="no"><enum>(c)</enum><header>Full-Time students</header><text>An institution of higher education may require a returning student described in subsection (a) or (b) to attend such institution full-time.</text></subsection> <subsection id="HDAF4FB5C556741D88877CCEAE0831A2B" commented="no"><enum>(d)</enum><header>Needs-Based scholarship</header><text display-inline="yes-display-inline">In this section, the term <term>needs-based scholarship</term> means the amount equal to—</text> 
<paragraph id="HFEE028AE451A46F0ABF2126983E37BB1" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the cost of attendance for a student (as defined in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>)); minus</text></paragraph> <paragraph id="H039403B4D8C74155845023CED71A1867" commented="no"><enum>(2)</enum><text>the lesser of the following:</text> 
<subparagraph id="H5E1A8A1B61014509A5156B233D8E026F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">The expected family contribution for such student if such contribution was determined under section 475 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087oo">20 U.S.C. 1087oo</external-xref>).</text></subparagraph> <subparagraph id="HA62E0E4A5FAE41469BFB9B6272BCEE9F" commented="no"><enum>(B)</enum><text>The expected family contribution for such student if such contribution was determined under section 476 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087pp">20 U.S.C. 1087pp</external-xref>).</text></subparagraph> 
<subparagraph id="H5D785ECDEAF34156BD382B76F7E7952D"><enum>(C)</enum><text>The expected family contribution for such student if such contribution was determined under section 477 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087qq">20 U.S.C. 1087qq</external-xref>).</text></subparagraph></paragraph></subsection></section> <section id="HBF3D9F80F5404DC684BC32AC0A23B5D7" commented="no"><enum>14.</enum><header>Student-athlete work opportunity</header> <subsection id="HBD89D39A6906425A9B99052176689D2D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An institution of higher education that provides a scholarship under subsection (a) or (b) of section 12 to a student shall require that such student report to such institution any potential paid work opportunity such student intends to accept, before accepting such work opportunity. </text></subsection> 
<subsection id="H5C5530E226524B28A380BB4A7D47732F"><enum>(b)</enum><header>Review of work opportunity</header><text display-inline="yes-display-inline">In the case of a work opportunity reported pursuant to subsection (a), an institution shall—</text> <paragraph id="HC55EEA852DB244D1B4F7CAC8FFC9B0D0"><enum>(1)</enum><text>approve or deny such opportunity in writing not later than 14 days after receiving such report; or</text></paragraph> 
<paragraph id="HB0A7E57BE6FD4927ADC7EF87611850FD"><enum>(2)</enum><text>deny such opportunity only if accepting such opportunity—</text> <subparagraph id="HE2B37F6F264E49B5AB4BCE2EE70C9F8D"><enum>(A)</enum><text>would nullify the amateur status of such student; or</text></subparagraph> 
<subparagraph id="H9AA7EDEC264C411296D4F450D60E4C7B"><enum>(B)</enum><text>would prohibit the student from fulfilling mandatory time commitments for the sport for which the student received a scholarship under subsection (a) or (b) of section 12.</text></subparagraph></paragraph></subsection> <subsection id="H0BA33B10DC434997964D9CEA7DCEF916"><enum>(c)</enum><header>Effect of denial</header><text display-inline="yes-display-inline">In the case of a denial of an opportunity reported to an institution of higher education pursuant to subsection (a), if a student accepts such opportunity, the institution may revoke the scholarship under subsection (a) or (b) of section 12 of such student. </text></subsection></section> 
<section id="H0F210E564BAF459A9D4D217C540E93A9"><enum>15.</enum><header>Student-athlete injury coverage</header> 
<subsection id="H4F52644F2C114C0AAF0BDBB9D67B5BAF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a student at an institution of higher education who participates as an athlete in a collegiate revenue-generating sport, such institution shall ensure that such student is provided, at no cost to such student, coverage for any medical costs incurred by such student with respect to any injury attributable to participation in such sport. Such institution shall serve as the primary payor with respect to 100 percent of such costs in lieu of any benefits such student may have under health insurance coverage or a group health plan (as such terms are defined in section 2791 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91</external-xref>)).</text></subsection> <subsection id="H66DC9DDDB784476492BCD93F6D77FB62" commented="no"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The requirement specified in subsection (a) shall apply with respect to students participating in a collegiate revenue-generating sport on or after the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></title> 
<title id="H0222C2EF05C04F29A2879AB56CC8AD3F"><enum>II</enum><header>Collective bargaining agreements</header> 
<section id="H52B1B7C54BF54DE58B60CA0CC6421BAF"><enum>21.</enum><header>Collective bargaining agreements in professional sports</header><text display-inline="no-display-inline">A collective bargaining agreement between a professional sports league and a professional players’ association entered into after the date of the enactment of this Act shall allow adults to enter the collective bargaining agreement at the same level as other adults with the same experience level in such professional sports league.</text></section></title> <title id="HC9A5B57DAF81467A848F9FB7E3C37BFF"><enum>III</enum><header>General provisions</header> <section id="H562DF4EFE51F45EEA641FF4A7462F279"><enum>31.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Education shall provide each institution of higher education with a collegiate revenue-generating sport a report of the responsibilities of such institutions with respect to players participating in the collegiate revenue-generating sport.</text></section> 
<section id="H388C981DE89044BB87E1ACCACEBAB1E1"><enum>32.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H4BB6CF41FB2245F19FF78A9A6DB83365"><enum>(1)</enum><header>Adult</header><text display-inline="yes-display-inline">The term <term>adult</term> means a person that is at least 18 years old.</text></paragraph> 
<paragraph id="HFCDE080A5FF64D7D9750BFBC63B0B1FB"><enum>(2)</enum><header>Amateur athlete</header><text>The term <term>amateur athlete</term> means an athlete that participates in a sport who has not—</text> <subparagraph id="H6A528430E8554C0E94019E906711071F"><enum>(A)</enum><text>entered into a contract with a professional team with respect to such sport;</text></subparagraph> 
<subparagraph id="H7A267AE55B9047A18A7F521B54CBAEE0"><enum>(B)</enum><text>received a salary with respect to such sport;</text></subparagraph> <subparagraph id="HDAE5AE6DDCDC42008494D0599C5AF419"><enum>(C)</enum><text>received earnings (not including scholarships) related to the participation in such sport; or</text></subparagraph> 
<subparagraph id="H0129868C37424D1B98A20E9B6D862F31"><enum>(D)</enum><text>received compensation from an agent representing or attempting to represent such athlete in such sport. </text></subparagraph></paragraph> <paragraph id="H6B25D60FD9214E78BD214E4FD83F6B81"><enum>(3)</enum><header>Collegiate revenue-generating sport</header><text>The term <term>collegiate revenue-generating sport</term> means men’s basketball or men’s football offered by an institution of higher education for which such institution participates in a qualified league.</text></paragraph> 
<paragraph id="H009BA0EFA9A64FE882C4BD1C9EBFB680"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> means an institution described in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>). </text></paragraph> <paragraph id="H4A59AB23EEA9457AAA3CB1B2CFD1DC40"><enum>(5)</enum><header>Qualified league</header><text display-inline="yes-display-inline">The term <term>qualified league</term> means—</text> 
<subparagraph id="HE48FC8A3CB1441A0AC728A059440FD93"><enum>(A)</enum><text>division 1, football bowl subdivision, autonomy schools; and</text></subparagraph> <subparagraph id="HFBE629D4D5474791B7EA2AFEF7F76B44"><enum>(B)</enum><text>any sports league comprised of at least 6 participating institutions of higher education in which at least 66 percent or greater of the revenues from a sport offered by such institutions exceed the expenses in that sport in each of the two most recently reported years.</text></subparagraph></paragraph> 
<paragraph id="HC8FC76818F2F402E89FFDC6FF5A29B81"><enum>(6)</enum><header>Professional sports league</header><text display-inline="yes-display-inline">The term <term>professional sports league</term> means—</text> <subparagraph id="H1285F80F28D14593838A2823B9006669"><enum>(A)</enum><text>the National Hockey League;</text></subparagraph> 
<subparagraph id="HFEE6FB91E33B46F5AFFC04EB978C0908"><enum>(B)</enum><text>the National Football League;</text></subparagraph> <subparagraph id="H1E61DC359CD64064BB448596D36A3040"><enum>(C)</enum><text>the National Basketball Association;</text></subparagraph> 
<subparagraph id="HD497A263FFD64D3BBD892DE7339BEA20"><enum>(D)</enum><text>Major League Baseball; and</text></subparagraph> <subparagraph id="HC96E8FA5A51C41BC9D8CEAA8812F7B9A"><enum>(E)</enum><text>Major League Soccer. </text></subparagraph></paragraph> 
<paragraph id="HC146A01F61D847588FAA00E2EA0B5629"><enum>(7)</enum><header>Professional players association</header><text display-inline="yes-display-inline">A group of professional sports league players that are represented by a collective bargaining agreement with a professional sports league.</text></paragraph></section></title> </legis-body> </bill>
