 <section id="H656BA34E114C4F4796117215A32C9378" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Contracting Opportunities for Small Businesses Act of 2019</short-title></quote>.</text> </section><section id="HF55FA507FC6E4128809226E2B59EDAF2"><enum>2.</enum><header>Amendments to contracting authority for certain small business concerns</header> <subsection id="H69F3AEA4A46540708909477222B3680C"><enum>(a)</enum><header>Qualified HUBZone small business concerns</header><text display-inline="yes-display-inline">Subparagraph (A) of section 31(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657a">15 U.S.C. 657a(b)(2)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H99DA253F35A5470CBB3F651C71DF5339" style="OLC">
 <subparagraph id="H159E0F5868904D19A4DDE44EAA13C6BD"><enum>(A)</enum><header>Sole source contracts</header><text display-inline="yes-display-inline">A contracting officer may award sole source contracts under this section to any qualified HUBZone small business concern, if—</text>
 <clause id="HB38B012E71E844A199573A041E0BA792"><enum>(i)</enum><text>the qualified HUBZone small business concern is determined to be a responsible contractor with respect to performance of such contract opportunity;</text>
 </clause><clause id="H38AE217FB9DE4369BCCDE565AEF9D691"><enum>(ii)</enum><text>the contracting officer does not have a reasonable expectation that two or more qualified HUBZone small business concerns will submit offers for the contracting opportunity;</text>
 </clause><clause id="H9B414AAE76C340DC8F4950E3EB09E8C1"><enum>(iii)</enum><text>the anticipated award price of the contract will not exceed—</text> <subclause id="H6BBE19B07E6C4B7A90FB1231B395D081"><enum>(I)</enum><text>$7,000,000, in the case of a contract opportunity assigned a standard industrial classification code for manufacturing; or</text>
 </subclause><subclause id="H109A15AD0B8046F6B0B4B9C810A313CB"><enum>(II)</enum><text>$4,000,000, in the case of all other contract opportunities; and</text> </subclause></clause><clause id="HBED2FD3B29F84AF483A6D0BB7F68AB66"><enum>(iv)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H45EA9434E3AD4766ABC701EB6B36D015"><enum>(b)</enum><header>Small business concern owned and controlled by service-Disabled veterans</header><text>Subsection (a) of section 36 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657f">15 U.S.C. 657f</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HB021EB6A27BD4C998AADEDCB150A0BAE" style="OLC">
 <subsection id="HD1C7414822D9401399C208321C3327EC"><enum>(a)</enum><header>Sole Source Contracts</header><text>In accordance with this section, a contracting officer may award a sole source contract to any small business concern owned and controlled by service-disabled veterans if—</text>
 <paragraph id="H791C79CAB881469791E342B4883AA97D"><enum>(1)</enum><text>such concern is determined to be a responsible contractor with respect to performance of such contract opportunity;</text>
 </paragraph><paragraph id="HA9797A755CDC4CE6B68A79BC89163BBD"><enum>(2)</enum><text>the contracting officer does not have a reasonable expectation that two or more small business concerns owned and controlled by service-disabled veterans will submit offers for the contracting opportunity;</text>
 </paragraph><paragraph id="HEE67C09BD290457E9FED5B190EB1EABF"><enum>(3)</enum><text>the anticipated award price of the contract will not exceed—</text> <subparagraph id="H6570582249034907AE626CCE803C4349"><enum>(A)</enum><text>$7,000,000, in the case of a contract opportunity assigned a standard industrial classification code for manufacturing; or</text>
 </subparagraph><subparagraph id="H5B267558AA6747028721AD0D100B5F15"><enum>(B)</enum><text>$4,000,000, in the case of any other contract opportunity;</text> </subparagraph></paragraph><paragraph id="HDE33F867E6D048458A5EBA8E5C60AC12"><enum>(4)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price;</text>
 </paragraph><paragraph id="H7FFC41E71F774179A45971CB17753803"><enum>(5)</enum><text display-inline="yes-display-inline">the contracting officer has notified the Administration of the intent to make such award and requested that the Administration determine the concern’s eligibility for award; and</text>
 </paragraph><paragraph id="H853D370CE34C482BB48BB31CA9B0629D"><enum>(6)</enum><text>the Administration has determined that such concern is eligible for award.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HECECDA4A036A45B78E8CBEEAC7F86CE5"><enum>(c)</enum><header>Certain small business concerns owned and controlled by women</header><text display-inline="yes-display-inline">Section 8(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(m)</external-xref>) is amended—</text>
 <paragraph id="HA0BDE5FB27C14FDFA2D93D04E063BAD3"><enum>(1)</enum><text>by amending paragraph (7) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HCBF8B364549C4D46A038A57DAA2B9F78" style="OLC"> <paragraph id="HAECACB8C7D5A4A758D49CAC8092DCA24"><enum>(7)</enum><header>Authority for sole source contracts for economically disadvantaged small business concerns owned and controlled by women</header><text>A contracting officer may award a sole source contract under this subsection to any small business concern owned and controlled by women described in paragraph (2)(A) and certified under paragraph (2)(E) if—</text>
 <subparagraph id="H8580D530B981494787716CAAC5F58518"><enum>(A)</enum><text>such concern is determined to be a responsible contractor with respect to performance of the contract opportunity;</text>
 </subparagraph><subparagraph id="H1DBF81058BD64CB0ACA08F431E60E61A"><enum>(B)</enum><text>the contracting officer does not have a reasonable expectation that two or more businesses described in paragraph (2)(A) will submit offers;</text>
 </subparagraph><subparagraph id="HF4BDD8AB8581419396DD332770CB2BDE"><enum>(C)</enum><text>the anticipated award price of the contract will not exceed—</text> <clause id="HEE814ED0865549BBA95519CCD150DA24"><enum>(i)</enum><text>$7,000,000, in the case of a contract opportunity assigned a standard industrial classification code for manufacturing; or</text>
 </clause><clause id="H35A6B365FB10451A8B3F2ADF6ACE9B3D"><enum>(ii)</enum><text>$4,000,000, in the case of any other contract opportunity;</text> </clause></subparagraph><subparagraph id="HC430713C620C4D6FA0C69564079ABB0E"><enum>(D)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price;</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H37A8230E41F846E3A92EF3DB290E8F0B"><enum>(E)</enum><text display-inline="yes-display-inline">the contracting officer has notified the Administration of the intent to make such award and requested that the Administration determine the concern’s eligibility for award; and</text>
 </subparagraph><subparagraph id="H6A6DD66E85CE47F18114C4CD2D6AF42F"><enum>(F)</enum><text>the Administration has determined that such concern is eligible for award.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="HF4EF6DE144934251896D0EEEB828E653"><enum>(2)</enum><text>by amending paragraph (8) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H2D260321A0884C4884AE5C297A101D60" style="OLC">
						<paragraph id="H73A8D1E86F0E4D78862995C03793B47D"><enum>(8)</enum><header>Authority for sole source contracts for small business concerns owned and controlled by women in
 substantially underrepresented industries</header><text>A contracting officer may award a sole source contract under this subsection to any small business concern owned and controlled by women certified under paragraph (2)(E) that is in an industry in which small business concerns owned and controlled by women are substantially underrepresented (as determined by the Administrator under paragraph (3)) if—</text>
 <subparagraph id="HF7F1A228304F42E7B8798FE7FD8C4F16"><enum>(A)</enum><text>such concern is determined to be a responsible contractor with respect to performance of the contract opportunity;</text>
 </subparagraph><subparagraph id="H666BD5D7BFDC47909FEE9A53E399A8FD"><enum>(B)</enum><text>the contracting officer does not have a reasonable expectation that two or more businesses in an industry that has received a waiver under paragraph (3) will submit offers;</text>
 </subparagraph><subparagraph id="HC52A222E9A22466AB9A08D69EE55A854"><enum>(C)</enum><text>the anticipated award price of the contract will not exceed—</text> <clause id="H75C956ED2E454690882A0CA72F15562B"><enum>(i)</enum><text>$7,000,000, in the case of a contract opportunity assigned a standard industrial classification code for manufacturing; or</text>
 </clause><clause id="HC4C4BABF61B945EB8F0DF4962381FD1B"><enum>(ii)</enum><text>$4,000,000, in the case of any other contract opportunity;</text> </clause></subparagraph><subparagraph id="HE922AFD24A9F4DF889F8A544E19C899F"><enum>(D)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price;</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="HC518960E51734AB3B130154F0E420408"><enum>(E)</enum><text display-inline="yes-display-inline">the contracting officer has notified the Administration of the intent to make such award and requested that the Administration determine the concern’s eligibility for award; and</text>
 </subparagraph><subparagraph id="H76FAE12B6C6348C0B02D55F1DC60AB4F"><enum>(F)</enum><text>the Administration has determined that such concern is eligible for award.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H72756F590F5B4501B6D7A8988A4B9BE0"><enum>(d)</enum><header>Elimination of the inclusion of option years in the award price for contracts</header><text display-inline="yes-display-inline">Section 8 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637</external-xref>) is amended by striking <quote>(including options)</quote> each place such term appears.</text>
			</subsection></section><section id="HB1FAECD8ED3844F4954114568C806E4C"><enum>3.</enum><header>SBA certification program notification</header>
 <subsection id="H14F2E2FF677548AA8FE6516C264B8368"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall notify the Committee on Small Business of the House of Representatives and the Committee on Small Business and Entrepreneurship of the Senate when the Administrator has implemented each of the following:</text>
 <paragraph id="H17F9C8EDCE7E40179C6594103A08DF68"><enum>(1)</enum><text display-inline="yes-display-inline">A program to certify small business concerns owned and controlled by women (as defined in section 8(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(m)</external-xref>)).</text>
 </paragraph><paragraph id="H189DA74C0767408B9407B4BAE056D6C3"><enum>(2)</enum><text display-inline="yes-display-inline">A program to certify small business concerns owned and controlled by service-disabled veterans (as defined in section 3(q)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(q)</external-xref>)).</text>
 </paragraph></subsection><subsection id="H70AC94D763E94277AE2F8C97138D7846"><enum>(b)</enum><header>Additional notice</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall submit a copy of a notification required under subsection (a) to the Law Revision Counsel of the House of Representatives so that the Law Revision Counsel may execute the amendments required under section 4.</text>
 </subsection></section><section id="H88D41337E156439AA90FFB334E7D6C0F"><enum>4.</enum><header>Removal of eligibility determination upon implementation of certification programs</header><text display-inline="no-display-inline">Effective upon the notification described under section 3, the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> et seq.) is amended—</text>
 <paragraph id="HEAC1F9FE279F4C05B294B647B03CEE81"><enum>(1)</enum><text>in section 8(m)—</text> <subparagraph id="H2E24F1CE86AA4385A0B2377E7B92B38A"><enum>(A)</enum><text>in paragraph (7)—</text>
 <clause display-inline="no-display-inline" id="HE9B44493C2764FFDB884A01EBF077359"><enum>(i)</enum><text>in subparagraph (C), by adding <quote>and</quote> at the end;</text> </clause><clause id="H4065FA46A29F40E1B493F88596F23C5A"><enum>(ii)</enum><text>in subparagraph (D), by striking the semicolon at the end and inserting a period; and</text>
 </clause><clause id="H159679B6D33849F68E93F57AFBE8C025"><enum>(iii)</enum><text>by striking subparagraphs (E) and (F); and</text> </clause></subparagraph><subparagraph id="H2D31ACAD6FB84EC0A06A7FF9D0BCDC4B"><enum>(B)</enum><text>in paragraph (8)—</text>
 <clause display-inline="no-display-inline" id="HC9B08FB9786F43B8986AB7204496F720"><enum>(i)</enum><text>in subparagraph (C), by adding <quote>and</quote> at the end;</text> </clause><clause id="H8FDE853932E34A059C4EB612C694A03C"><enum>(ii)</enum><text>in subparagraph (D), by striking the semicolon at the end and inserting a period; and</text>
 </clause><clause id="H66552563A3D74756A63A1CE7514E8A98"><enum>(iii)</enum><text>by striking subparagraphs (E) and (F); and</text> </clause></subparagraph></paragraph><paragraph id="HB30672EC04CB4DF08DE8340B1F22245E"><enum>(2)</enum><text>in section 36(a)—</text>
 <subparagraph id="HC3A96FDB04634E45AD39936E678ABE79"><enum>(A)</enum><text>in paragraph (3), by adding <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="HF9BDC78852564C89860EDD0E7B735860"><enum>(B)</enum><text>in paragraph (4), by striking the semicolon at the end and inserting a period; and</text>
 </subparagraph><subparagraph id="HEAA21348BC6E4B55BDEB74ABA3200107"><enum>(C)</enum><text>by striking paragraphs (5) and (6).</text> </subparagraph></paragraph></section><section id="H576B6F2F92C04A9386A1F3383BBA9A89"><enum>5.</enum><header>GAO Report</header> <subsection id="H6E306A2B33C6443FAA86F959EB0C0C5A"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">With respect to the procurement programs of the Small Business Administration for small business concerns owned and controlled by women (as defined in section 8(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(m)</external-xref>)) and for small business concerns owned and controlled by service-disabled veterans (as defined in section 3(q)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(q)</external-xref>)), the Comptroller General of the United States shall conduct an evaluation of the policies and practices used by the Administration and other Federal agencies to provide assurances that contracting officers are properly clas­si­fy­ing sole source awards under those programs in the Federal Procurement Data System and that sole source contracts awarded under those programs are being awarded to eligible concerns.</text>
 </subsection><subsection id="H76215BFF721342A1BE71A437167E328E"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the Small Business Administration implements the certification programs described under section 3, the Comptroller General shall issue a report to the Committee on Small Business of the House of Representatives and the Committee on Small Business and Entrepreneurship of the Senate containing the findings made in carrying out the study required under subsection (a).</text>
			</subsection><subsection id="HE1BDEADF05414E61890AF91CE9C172F8"><enum>(c)</enum><header>SBA consideration of GAO report</header>
 <paragraph id="H099AFE767F6040F1AD96AE8F8E405940"><enum>(1)</enum><header>In general</header><text>The Administrator of the Small Business Administration shall review the report issued under subsection (b) and take such actions as the Administrator may determine appropriate to address any concerns raised in such report and any recommendations contained in such report.</text>
 </paragraph><paragraph id="HCA211FFCF40C4385B4078832785E0A38"><enum>(2)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">After the review described under paragraph (1), the Administrator shall issue a report to Congress—</text> <subparagraph id="H303DC4870C794925941E1BDCF9B7D9B6"><enum>(A)</enum><text>stating that no additional actions were necessary to address any concerns or recommendations contained in the report; or</text>
 </subparagraph><subparagraph id="H68408813D45E49C78D63525396B6B599"><enum>(B)</enum><text>describing the actions taken by the Administrator to resolve such concerns or implement such recommendations.</text>
