			 agencies that fund, conduct, or oversee scientific research, and for other
			 purposes.</official-title></form>
	<legis-body id="H24E63EDFBB7E46E3AA0D0F2CD067E672" style="OLC">
 <section id="H53A2EE81A7B848BFA976226765B13CAA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Scientific Integrity Act</short-title></quote>.</text> </section><section id="H48FC58A3A1694D0DB29681E77F405138"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
 <paragraph id="H8F07C3A470364BEF952DDA27BBB435D9"><enum>(1)</enum><text>science and the scientific process should inform and guide public policy decisions on a wide range of issues, including improvement of public health, protection of the environment, and protection of national security;</text>
 </paragraph><paragraph id="H5453C14237BD4663B382F0283CFAB86B"><enum>(2)</enum><text>the public must be able to trust the science and scientific process informing public policy decisions;</text>
 </paragraph><paragraph id="H42AD8FA5E0E8486E8E1EA3DF122FF340"><enum>(3)</enum><text>science, the scientific process, and the communication of science should be free from politics, ideology, and financial conflicts of interest;</text>
 </paragraph><paragraph id="H545C0AC7378E4AF08A17C7A6B0051CF1"><enum>(4)</enum><text>policies and procedures that ensure the integrity of the conduct and communication of publicly funded science are critical to ensuring public trust;</text>
 </paragraph><paragraph id="HE9E27500D6CA40D5B62BC6E18E417479"><enum>(5)</enum><text>Federal agencies that fund, conduct, or oversee research should promote and maximize the communication and open exchange of data and findings to other agencies, policymakers, and the public of research conducted by a scientist or engineer employed or contracted by a Federal agency that funds, conducts, or oversees scientific research; and</text>
 </paragraph><paragraph id="HD93EB4AEEB2B412FB7CEFFD0BAC182A1"><enum>(6)</enum><text>Federal agencies that fund, conduct, or oversee research should work to prevent the suppression or distortion of the data and findings.</text>
 </paragraph></section><section id="H4805A85C329646C9B9FCADDEBA688F47"><enum>3.</enum><header>Amendment to America COMPETES Act</header><text display-inline="no-display-inline">Section 1009 of the America COMPETES Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6620">42 U.S.C. 6620</external-xref>) is amended to read as follows:</text> <quoted-block id="H8CCE541C5FCC4A4AB33740C7EFD5393E" style="OLC"> <subsection id="HE1D4A2B5209746E0A3878C256AE14BA9"><enum>(a)</enum><header>Prohibited conduct</header><text>No covered individual shall—</text>
 <paragraph id="H7B55D96E983847B0AEF82F037D8AA4F9"><enum>(1)</enum><text>engage in dishonesty, fraud, deceit, misrepresentation, coercive manipulation, or other scientific or research misconduct;</text>
 </paragraph><paragraph id="H1A21D065765744B4B13DD03FF56752A0"><enum>(2)</enum><text>suppress, alter, interfere with, or otherwise impede the timely release and communication of, scientific or technical findings;</text>
 </paragraph><paragraph id="H409E1D95CDC9458FAD76D0A73C48A315"><enum>(3)</enum><text>intimidate or coerce an individual to alter or censor, or retaliate against an individual for failure to alter or censor, scientific or technical findings; or</text>
 </paragraph><paragraph id="H632011C572454B1290F3969A145AE353"><enum>(4)</enum><text>implement institutional barriers to cooperation and the timely communication of scientific or technical findings.</text>
					</paragraph></subsection><subsection id="HB6CA0A4034A6496796A652B7537A3636"><enum>(b)</enum><header>Scientific publications and conferences</header>
 <paragraph id="HE20681BA5F1144F68534D492F03D1C1C"><enum>(1)</enum><header>Dissemination of findings</header><text>Subject to existing law, a covered individual may disseminate scientific or technical findings—</text> <subparagraph id="HFCC62803F22C47B098D6B0217870A3E0"><enum>(A)</enum><text>by participating in scientific conferences; and</text>
 </subparagraph><subparagraph id="H577A468DA57A48A2AC68288B9022B969"><enum>(B)</enum><text>seeking publication in online and print publications through peer-reviewed, professional, or scholarly journals.</text>
						</subparagraph></paragraph><paragraph id="H917E7F6FA68547DC9CC16C21244813F3"><enum>(2)</enum><header>Review by agencies</header>
 <subparagraph id="H596CEEF963E14C51BC757D3C09A31143"><enum>(A)</enum><header>In general</header><text>A covered agency may require a covered individual to, before disseminating scientific or technical findings under paragraph (1), submit the findings to the covered agency so that the agency may conduct a review of the data and findings for technical accuracy and compliance with subsection (a).</text>
 </subparagraph><subparagraph id="H9C903EA4B9BC4FA782DC62CFB337E277"><enum>(B)</enum><header>Approval</header><text>If a covered agency does not complete the review under subparagraph (A) of data and findings submitted by a covered individual within 30 days of the submission—</text>
 <clause id="H53B9435B86364E4C8694644A8A5CA96A"><enum>(i)</enum><text>the submission shall be deemed approved by the covered agency; and</text> </clause><clause id="H95DBCA7EB319403795752861C361FC10"><enum>(ii)</enum><text>the covered individual may proceed with plans to disseminate the scientific or technical findings.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="HEED6FC66DE4F406C8A9465875E08F793"><enum>(c)</enum><header>Leadership in the scientific community</header><text>Subject to applicable law governing ethics and conflicts of interest, a covered individual may—</text> <paragraph id="H7DC4CB218C1549EBB2895B8B27296318"><enum>(1)</enum><text>sit on scientific advisory or governing boards;</text>
 </paragraph><paragraph id="H71462CA41C1948EFA002CFE31AB890FD"><enum>(2)</enum><text>join or hold leadership positions on scientific councils, societies, unions, and other professional organizations;</text>
 </paragraph><paragraph id="H7E78DF4BBC674C649678270826A467AB"><enum>(3)</enum><text>contribute to the academic peer-review process as reviewers or editors; and</text> </paragraph><paragraph id="H6893F28024FB41EFB2C9BFCCF1C959DD"><enum>(4)</enum><text>participate and engage with the scientific community.</text>
 </paragraph></subsection><subsection id="H960B869C45414417A8E7B1EB4ABC25E3"><enum>(d)</enum><header>Public statements on basic or applied research</header><text>Whenever a covered agency seeks to make a public statement about the conclusions of basic or applied research in science or engineering conducted by a covered individual—</text>
 <paragraph id="H056FFAD7829F4EBCAEFB60FDC838973F"><enum>(1)</enum><text>the covered individual shall have the opportunity to review the public statement for technical accuracy; and</text>
 </paragraph><paragraph id="HA515201F89D94AC48BBC0EB244E8B48D"><enum>(2)</enum><text>if an inaccuracy is discovered as a result of the review under paragraph (1), the covered agency and the covered individual shall jointly revise the public statement.</text>
					</paragraph></subsection><subsection id="HFB91BEEECCD64E67AE9CDDA406790B8E"><enum>(e)</enum><header>Interview requests on research; personal statements</header>
 <paragraph id="H33865E3B0BBA4D37BF2EE9876BDF1DF4"><enum>(1)</enum><header>Interview requests to covered individuals</header><text>A covered individual may respond to media interview requests regarding their scientific or technical findings from research conducted by the individual without prior approval from the covered agency supporting the research of the covered individual, but the covered agency may require the covered individual to report the subject of any such interview.</text>
 </paragraph><paragraph id="H6A6D54F28F534AA5A254C4C1D22BA0C0"><enum>(2)</enum><header>Interview requests to agencies</header><text>In the event a covered agency supporting the research of a covered individual receives a media interview request regarding that research, the covered agency shall—</text>
 <subparagraph id="H2C23D5ED3A0C4BD69FEFE02819C3374F"><enum>(A)</enum><text>offer the covered individual the choice of responding to the interview directly; or</text> </subparagraph><subparagraph id="H2CFCC9F028754D209F7D6BE479BF0C2A"><enum>(B)</enum><text>provide a knowledgeable spokesperson who can, in an objective, nonpartisan, and articulate manner, describe and explain the scientific and technical findings to the media and the people of the United States.</text>
 </subparagraph></paragraph><paragraph id="H3AD7AB8944754DCDB4DC262ACC47B110"><enum>(3)</enum><header>Personal statements</header><text>A covered individual may present viewpoints in an interview under paragraphs (1) and (2) that extend beyond the scientific or technical findings of the covered individual, and incorporate the expert or personal opinions of the covered individual, including on matters of policy only if the covered individual indicates that they are presenting their individual opinions.</text>
 </paragraph><paragraph id="H561730E53C034AF4B4B1F63ACBC166CD"><enum>(4)</enum><header>Conflicts of interest</header><text>Any covered individual presenting viewpoints under paragraph (3) shall disclose any apparent, potential, or actual financial conflicts of interest or non-financial conflicts of interest.</text>
 </paragraph><paragraph id="HF60745D2004E4420A76DDFD866D03B34"><enum>(5)</enum><header>Biographical information</header><text>Any covered individual presenting viewpoints under paragraph (3) may note their affiliation with a covered agency as part of their biographical information, provided that the affiliation is noted as 1 of several biographical details of the covered individual.</text>
 </paragraph></subsection><subsection display-inline="no-display-inline" id="H477C3D475EBC43C7B29F98BEC54FC10B"><enum>(f)</enum><header>Scientific integrity policies</header><text>Not later than 90 days after the date of enactment of the Scientific Integrity Act, the head of each covered agency shall—</text>
 <paragraph id="H53D68F01DC414EBEA7C869106B2AD1F3"><enum>(1)</enum><text>develop, adopt, and enforce a scientific integrity policy; and</text> </paragraph><paragraph id="H9A98F9CE93814C55A50D40E95C5FC45D"><enum>(2)</enum><text>submit the scientific integrity policy to the Director of the Office of Science and Technology Policy and Congress.</text>
 </paragraph></subsection><subsection id="H760B1571B88747F4840F45EF87FABAF7"><enum>(g)</enum><header>Requirements</header><text>A scientific integrity policy under subsection (b) shall—</text> <paragraph id="H38F9BCFF4EB84E15A00D4B5C5C2F1D19"><enum>(1)</enum><text>be consistent with the principles established under subsections (a) through (d);</text>
 </paragraph><paragraph id="H6E1431D65F5B46ACBA1FC3B59A1E6748"><enum>(2)</enum><text>specifically address what is and what is not permitted or recommended under that policy, including procedures;</text>
 </paragraph><paragraph id="HB6B9FA2B6B6442E99BEF5E31742AB6E3"><enum>(3)</enum><text>be specifically designed for the covered agency;</text> </paragraph><paragraph id="H2D723654F63C46B69E7B70E35CD0D411"><enum>(4)</enum><text>be applied uniformly throughout the covered agency; and</text>
 </paragraph><paragraph id="HF6264D021A2D45CFB57DDB0439DE237F"><enum>(5)</enum><text>be publicly accessible and widely communicated to all employees, private contractors, and grantees of the covered agency.</text>
 </paragraph></subsection><subsection id="HCA9B23AF422C4080A44BF3C11EFCB427"><enum>(h)</enum><header>Contents</header><text>In addition to the requirements in subsection (g), each scientific integrity policy under subsection (g) shall, at a minimum, ensure that—</text>
 <paragraph id="HB940141A6404437C848E8F65C46514C3"><enum>(1)</enum><text>scientific conclusions are not made based on political considerations;</text> </paragraph><paragraph id="HD16046E69C4B4933AF9983CCC4750A1D"><enum>(2)</enum><text>the selection and retention of candidates for science and technology positions in the covered agency are based primarily on the candidate’s expertise, scientific credentials, experience, and integrity;</text>
 </paragraph><paragraph id="H69774EBE0F484AF58A6FFF812E08B1DE"><enum>(3)</enum><text>no covered individual shall suppress, alter, interfere, or otherwise impede the timely release and communication of scientific or technical findings;</text>
 </paragraph><paragraph id="H1E67573DAF964D568157051E2C79721E"><enum>(4)</enum><text display-inline="yes-display-inline">personnel actions regarding covered individuals, except for political appointees, are not made based on political consideration or ideology;</text>
 </paragraph><paragraph id="HBA3574F3BE3A4F0C8B5589DFBA625126"><enum>(5)</enum><text>covered individuals cannot intimidate or coerce others to alter or censor scientific findings;</text> </paragraph><paragraph id="HDC3EA6E442BA475299B3893AB942D081"><enum>(6)</enum><text>covered individuals adhere to the highest ethical and professional standards in conducting their research and disseminating their findings;</text>
 </paragraph><paragraph id="H1F82B073BFE24141B603159EFCD7A032"><enum>(7)</enum><text>the appropriate rules, procedures, and safeguards are in place to ensure the integrity of the scientific process within the covered agency;</text>
 </paragraph><paragraph id="H502F54F3CF6C4D98A335E44CB08F56D2"><enum>(8)</enum><text>scientific or technological information considered in policy decisions is subject to well-established scientific processes, including peer review where appropriate;</text>
 </paragraph><paragraph id="HCD56EFE109484346A3A213F5DF82214E"><enum>(9)</enum><text>procedures, including any applicable whistleblower protections, are in place as are necessary to ensure the integrity of scientific and technological information and processes on which the covered agency relies in its decision making or otherwise uses; and</text>
 </paragraph><paragraph id="HC32D6443DC164D749E21C5A128543AE5"><enum>(10)</enum><text>include enforcement processes consistent for an administrative hearing and an administrative appeal.</text>
 </paragraph></subsection><subsection id="H8B013575E35048B4A05D6D9CD9DF8680"><enum>(i)</enum><header>Application</header><text>Each scientific integrity policy adopted under subsection (f) shall apply to covered individuals.</text> </subsection><subsection id="H06ECEE02BDDB482BBE0A8DD06F177AD4"><enum>(j)</enum><header>Scientific integrity officer</header><text>Not later than 30 days after the date of enactment of this Act, each covered agency shall appoint a Scientific Integrity Officer, who shall—</text>
 <paragraph id="HE277180AADE24E66A1B24FAAD832025C"><enum>(1)</enum><text display-inline="yes-display-inline">be a career employee at the covered agency in an science and professional positions;</text> </paragraph><paragraph id="H15476DCA3BC642B8BF81831B5A0E8DBF"><enum>(2)</enum><text>have substantial technical knowledge and expertise in conducting and overseeing scientific research; and</text>
 </paragraph><paragraph id="HFEF2B90F2A18459E99226FFBB0699947"><enum>(3)</enum><text>direct the activities and duties described in subsections (k), (l), and (m).</text> </paragraph></subsection><subsection id="H38AEA4105E684261A0AB2545206F4F1D"><enum>(k)</enum><header>Policies, process, and training</header><text>Not later than 180 days after the date of enactment of this Act, each covered agency shall adopt and implement—</text>
 <paragraph id="HF5FAC5CFD02543219B894F933A116CFF"><enum>(1)</enum><text>an administrative process and administrative appeal for dispute resolution consistent with the covered agency’s scientific integrity policy adopted under subsection (f); and</text>
 </paragraph><paragraph id="H9813ADCE00724B989F9B9CE053DD428D"><enum>(2)</enum><text>a training program to—</text> <subparagraph id="H1EEA9C0B38A34D6BA9639CE0BA070283"><enum>(A)</enum><text>provide regular scientific integrity and ethics training to employees and contractors of the covered agency;</text>
 </subparagraph><subparagraph id="H87D0B3921642408891199317A2BC5F09"><enum>(B)</enum><text>provide new covered employees with training within one month of commencing employment;</text> </subparagraph><subparagraph id="H118F13A568BD4CFD90D38AF4C5E09433"><enum>(C)</enum><text>provide information to ensure that covered individuals are fully aware of their rights and responsibilities regarding the conduct of scientific research, publication of scientific research, communication with the media and the public regarding scientific research; and</text>
 </subparagraph><subparagraph id="H772CFB6421894979AA8AF3C9DDB2C4BC"><enum>(D)</enum><text>provide information to ensure that covered individuals are fully aware of their rights and responsibilities for administrative hearings and appeals established in the covered agency’s scientific integrity policy.</text>
 </subparagraph></paragraph></subsection><subsection id="H0C7F80C44C454107980BADFF13D933C9"><enum>(l)</enum><header>Reporting</header><text>Each Scientific Integrity Officer appointed by a covered agency under subsection (j) shall post an annual report on the public website of the covered agency that includes—</text>
 <paragraph id="H83962967775A4D498880685611D46210"><enum>(1)</enum><text>the number of misconduct cases filed for administrative redress for the year covered by the report;</text> </paragraph><paragraph id="H314CEA6C8C1A41688872604718EA4D76"><enum>(2)</enum><text>the number of misconduct cases petitioned for administrative appeal for the year covered by the report; and</text>
 </paragraph><paragraph id="H629212E8349D41039FB813416AACE944"><enum>(3)</enum><text>the number of cases still pending from years prior to the year covered by the report, if any.</text> </paragraph></subsection><subsection id="HC9E3FA7C100C47A48FA27E6021B95209"><enum>(m)</enum><header>Record</header><text>Each scientific integrity policy, process, and report produced by a covered agency under this section shall be—</text>
 <paragraph id="HB72B3F9D1928485397AC53E99EF9C1C8"><enum>(1)</enum><text>submitted to—</text> <subparagraph id="H5C21F17E3CA34F23BDC9391A4E0D94C1"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text>
 </subparagraph><subparagraph id="H372830C697D94446806DCD38B1E21E3D"><enum>(B)</enum><text>the Committee on Science, Space, and Technology of the House of Representatives; and</text> </subparagraph><subparagraph id="H5BA316200EE44D9596CD6A9342801D42"><enum>(C)</enum><text>the Office of Science and Technology Policy; and</text>
 </subparagraph></paragraph><paragraph id="H8D2DCCE245B84B7AB78E5074FBE28282"><enum>(2)</enum><text>made available to the public on the website of the covered agency.</text> </paragraph></subsection><subsection id="HF021D91B659042D38B7B7A0EC9EEDE34"><enum>(n)</enum><header>Coordination by the Office of Science and Technology Policy</header><text>The Office of Science and Technology Policy shall collate, organize, and publicly share all information it receives under subsection (m) in one place on its own website. In addition, the Director of the Office of Science and Technology Policy shall, on annual basis, convene the Scientific Integrity Officer of each covered agency appointed under subsection (j) to discuss best practices for implementing the requirements of this section.</text>
 </subsection><subsection id="H4A250720B9E64ADFA5B6DBE6B6A34AE3"><enum>(o)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H56D496EB4C8D4342B8BA3972069242F9"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text>
 </paragraph><paragraph id="H7658B7A851D6418CAB77AE2CBD755160"><enum>(2)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means an agency that funds, conducts, or oversees scientific research.</text> </paragraph><paragraph id="H879E487A15844331A6B3E74783B0D95A"><enum>(3)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means a Federal employee or contractor who—</text>
 <subparagraph id="H19773BD0598D46ED847485940D4EFD3A"><enum>(A)</enum><text>is engaged in, supervises, or manages scientific activities;</text> </subparagraph><subparagraph id="H06381367F5C540BD822EC6901FCA219A"><enum>(B)</enum><text>analyzes or publicly communicates information resulting from scientific activities; or</text>
 </subparagraph><subparagraph id="HE644AE1A2EF1469295220C4C8B580957"><enum>(C)</enum><text>uses scientific information or analyses in making bureau, office, or agency policy, management, or regulatory decisions.</text>
 </subparagraph></paragraph><paragraph id="H83542168FCD343F58395D8096EE2A3A7"><enum>(4)</enum><header>Public statement</header><text>The term <term>public statement</term> means any communication that is intended for, or should reasonably be expected to have, broad distribution outside the Federal Government, including—</text>
 <subparagraph id="H5D48C0A174584D4195F2B67A6DFC527C"><enum>(A)</enum><text>public speeches, news releases and advisories, news conferences, broadcast appearances, and interviews or discussions with journalists;</text>
 </subparagraph><subparagraph id="HAA6DEF2643FC4335877CD6C1872ED355"><enum>(B)</enum><text>public writings, such as articles or papers in publications or other writings distributed through mass-mailing, e-mail, or posting on a website or social media platform;</text>
 </subparagraph><subparagraph id="HD617A870F27440D099FC503B284EE221"><enum>(C)</enum><text>materials and presentations for public educational instruction, lectures, conferences, seminars, and similar venues; and</text>
 </subparagraph><subparagraph id="HA9585CD745C04B698BDC224318A2F5E9"><enum>(D)</enum><text>public distribution of audiovisual works, such as slide sets, PowerPoint presentations, podcasts, online video, and exhibits.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HBD3267A7910B44D2B4F08D74E34837BF"><enum>4.</enum><header>Existing policies; clarification</header>
 <subsection id="HDC1FEB19A7854096AAA9A8A1968752F9"><enum>(a)</enum><header>Existing scientific integrity policies</header><text>Notwithstanding the amendments made by this Act, a covered agency’s scientific integrity policy that was in effect on the day before the date of enactment of this Act may satisfy the requirements of this Act if the head of the covered agency—</text>
 <paragraph id="HA2876ED94E1A4C13948EBCFF0473F305"><enum>(1)</enum><text>makes a written determination that the policy satisfies the requirements of that section; and</text> </paragraph><paragraph id="HB61EF42862FC456AA350083852C62C83"><enum>(2)</enum><text>submits the written determination and the policy to the Director of the Office of Science and Technology Policy for review.</text>
 </paragraph></subsection><subsection id="HC8BC6C33EE444F87BCB11A758DF8FFC2"><enum>(b)</enum><header>Clarification</header><text>Nothing in this Act shall affect the application of United States copyright law.</text> </subsection><subsection id="HF300D256AB084DB38DDD91413A8601AC"><enum>(c)</enum><header>Covered agency defined</header><text>The term <quote>covered agency</quote> has the meaning given the term in section 1009 of the America COMPETES Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6620">42 U.S.C. 6620</external-xref>).</text>
			</subsection></section></legis-body></bill>
