 <section id="H1438BA44621843398E10500DF9935C29" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Carrier Electronic Logging Device Exemption Act of 2019</short-title></quote>.</text> </section><section id="HB835F399A3674B50B6FDF59F828564D0"><enum>2.</enum><header>Exception to the electronic logging device requirements for motor carriers that own or operate 10 or fewer commercial vehicles</header><text display-inline="no-display-inline">Section 31137(b)(3) of title 49, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H11514A07759F4DBD97AC27C43E58FC2B" style="OLC">
				<paragraph id="HB00E01E024EE4598B5430C7F52CA8F03"><enum>(3)</enum><header>Exception</header>
 <subparagraph id="HD3C252F5365F41A995E78B80F88541FB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An excepted motor carrier may comply with the hours of service requirements by requiring each driver to use—</text>
 <clause id="HE098CE82D7974EB7AE28FA8669B94643"><enum>(i)</enum><text>a paper record of duty status form; or</text> </clause><clause id="HAF0E1B77DCCC4CD5A36A45A26789DB3F"><enum>(ii)</enum><text>an electronic logging device.</text>
 </clause></subparagraph><subparagraph id="HA74D2738AA6946B894F0001B4D2743E4"><enum>(B)</enum><header>Excepted motor carrier defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>excepted motor carrier</quote> means—</text> <clause id="HDAF0D7E3A07F4E1B82E0C1DD4B2A9B16"><enum>(i)</enum><text display-inline="yes-display-inline">a motor carrier when transporting a motor home or recreation vehicle trailer within the definition of the term <quote>driveaway-towaway operation</quote> (as defined in section 390.5 of title 49, Code of Federal Regulations); and</text>
 </clause><clause id="H2863E6C1A3C945D78FBE6E1BD05D60E8"><enum>(ii)</enum><text display-inline="yes-display-inline">a motor carrier that owns or operates 10 or fewer commercial motor vehicles, including commercial motor vehicles owned or operated by all motor carriers affiliated with that motor carrier by common ownership, common management, common control, or common familiar relationship.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H78DE0CA45876494FA2ECCC5C5ABE2A8F"><enum>3.</enum><header>Requirement to prescribe regulations</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Transportation shall promulgate such regulations as are necessary to carry out the amendment made by section 2 of this Act.</text>
