			 and enable research into the medicinal properties of marijuana.</official-title></form>
	<legis-body id="HA073CED62850487FB30A6B6A79354862" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="H8E9CDF1266FB469BA044389565E32679" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Compassionate Access, Research Expansion, and Respect States Act of 2019</short-title></quote> or the <quote><short-title>CARERS Act of 2019</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="H91D039D8332D47B3984A61DBB328487E" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Federalism in drug policy</header><text display-inline="no-display-inline">Section 708 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/903">21 U.S.C. 903</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H08DBA572C7C94EFAB0F7E41532AC8E9E"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>No provision</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HB5461C05EE814956B244615AB4FA9027" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="H37987FB2B9924F3CA96B253724598495"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), no provision</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF6754BD368454ECDAB72CBF8CEFFF496"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H71D1843EF6574F12AA4EAEC680D50206" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="H42CA3225E4334888B96B75E21ACB4A98"><enum>(b)</enum><header display-inline="yes-display-inline">Compliance with State law</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the provisions of this title relating to marihuana shall not apply to any person acting in compliance with State law, as determined by the State, relating to the production, possession, distribution, dispensation, administration, laboratory testing, recommending use, or delivery of medical marihuana.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="H0D238AC8F8B4496194EBE4F39B24EFE4" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Exclusion of cannabidiol from definition of marihuana</header><text display-inline="no-display-inline">Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HBFBBA240B5674FF09247F6748057939F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (16)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HC62225E732444C759DA18D8D70F98646"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or cake, or the sterilized</quote> and inserting <quote>cake, the sterilized</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H66C5C88C8A9D42EE98368E488B616DB1"><enum>(B)</enum><text display-inline="yes-display-inline">by adding <quote>, or cannabidiol</quote> before the period at the end; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3992F2A394C8439F8A1D01F3A65F8C48"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H2F19829A0F1D406C94E2D4CA047802C6" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="H33264C8A718C4AD495A412668C254F4D"><enum>(57)</enum><text display-inline="yes-display-inline">The term <term>cannabidiol</term> means the substance cannabidiol, as derived from marihuana or the synthetic formulation, that contains not greater than 0.3 percent delta-9-tetrahydrocannabinol on a dry weight basis.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="H8E57E84B55C64BD787FB709812278DFA" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Cannabidiol determination by States</header><text display-inline="no-display-inline">Section 201 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/811">21 U.S.C. 811</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HD61E8D2804924520AF3C660E47FB40DA" style="OLC">
 <subsection commented="no" display-inline="no-display-inline" id="H4FAE548066FA44C5BA9608292FCC3336"><enum>(k)</enum><header display-inline="yes-display-inline">Cannabidiol determination</header><text display-inline="yes-display-inline">If a person grows or processes marihuana for purposes of making cannabidiol in accordance with State law, the marihuana shall be deemed to meet the concentration limitation under section 102(57), unless the Attorney General determines that the State law is not reasonably calculated to comply with section 102(57).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="H8434EF47F15C4555B5CDE7813A46D7B7" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Research</header>
 <subsection commented="no" display-inline="no-display-inline" id="H7930611A783440DEAD45D3CC000FE79D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Health and Human Services shall terminate the Public Health Service interdisciplinary review process described in the guidance entitled <quote>Guidance on Procedures for the Provision of Marijuana for Medical Research</quote> (issued on May 21, 1999).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H37987A2564D749F1949A2429AFF9AA6B"><enum>(b)</enum><header display-inline="yes-display-inline">Licenses for marijuana research</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Attorney General, acting through the Drug Enforcement Administration, shall issue not less than 3 licenses under section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>) to manufacture and distribute marijuana and marijuana-derivatives for research approved by the Food and Drug Administration.</text>
			</subsection><subsection id="HCD0BEEAF531547329DA0B5EC10FD53BC"><enum>(c)</enum><header>Marijuana research</header>
 <paragraph id="HF9DCF3F407114C5BA46F73D0DCDC8ADF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 303(f) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(f)</external-xref>) is amended—</text> <subparagraph id="HEE847735900B4BBF9B97549B494F6E6B"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (5) as subparagraphs (A) through (E), respectively;</text>
 </subparagraph><subparagraph id="H8D3330D0C9234838A51D65FC4C98DBCF"><enum>(B)</enum><text>by striking <quote>(f) The Attorney General</quote> and inserting <quote>(f)(1) The Attorney General</quote>;</text> </subparagraph><subparagraph id="H57A3678AAE8247CCACC63B9E73980B2F"><enum>(C)</enum><text>by striking <quote>Registration applications</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H55AA2395554347F9820E9340E902DFD2" style="OLC">
 <paragraph id="HA568BE8122424513813FDE3D0B8E0A9E" indent="up1"><enum>(2)</enum><text>Registration applications</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph><subparagraph id="H7B7342E402FF4F85BB27586516DBE5AC"><enum>(D)</enum><text>in paragraph (2), as so designated, by striking <quote>schedule I</quote> each place that term appears and inserting <quote>schedule I, except marijuana,</quote>;</text>
 </subparagraph><subparagraph id="H6651CA72454043E4884948A2C7F77168"><enum>(E)</enum><text>by striking <quote>Article 7</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H696B1B8249484B2FB3D12C7B58621C64" style="OLC"> <paragraph id="H0EF3A10B512D4A27ADF45C7AC63EB76B" indent="up1"><enum>(4)</enum><text>Article 7</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HCD41E08224E248ABBA647A416208D571"><enum>(F)</enum><text>by inserting before paragraph (4), as so designated, the following:</text> <quoted-block display-inline="no-display-inline" id="H275E6D0EFB244F1B82DF9399B684C94B" style="OLC"> <paragraph id="HCAECCC0E4FC34C77B5AAEE65B9FB8B11" indent="up1"><enum>(3)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H0B4E32B18C7E44FEA6F8E1F707A0CA86"><enum>(A)</enum><text>Not later than 180 days after the date of enactment of this paragraph, the Secretary shall promulgate regulations that require the Secretary to register a practitioner to conduct research on marihuana if—</text>
 <clause id="H0ED53E491E914FFE86E2D9EAE3A6B109" indent="up1"><enum>(i)</enum><text>the applicant is authorized to dispense, or conduct research with respect to, controlled substances in schedules II, III, IV, and V under the laws of the State in which the applicant practices; and</text>
 </clause><clause id="H78A2FB9EB2034DB6BEA584E83155E459" indent="up1"><enum>(ii)</enum><text>the applicant’s research protocol—</text> <subclause id="H3D03853537EC420A93BDAE9013F9A8DA"><enum>(I)</enum><text>has been reviewed and allowed by—</text>
 <item id="HBE7E297E587D414A9FCB69B50EF4F5EB"><enum>(aa)</enum><text>the Secretary under section 505(i) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(i)</external-xref>); or</text>
 </item><item id="H6F28749F8F3242468A8E4A1D61F6959E"><enum>(bb)</enum><text>the National Institutes of Health or another Federal agency that funds scientific research; or</text> </item></subclause><subclause id="H82F85EDAC4034879943724BB01C87992"><enum>(II)</enum><text>in the case of nonhuman research that is not federally funded, has been voluntarily submitted by the applicant to, and approved by, the National Institutes of Health.</text>
 </subclause></clause></subparagraph><subparagraph id="HE685A20622B9496C9288D9C29D5CA7DF" indent="up1"><enum>(B)</enum><text>The Secretary shall grant an application for registration under this paragraph unless the Secretary determines that the issuance of the registration would be inconsistent with the public interest. In determining the public interest, the Secretary shall consider the following factors:</text>
 <clause id="H062C6EE3FB98432A960FC2A50405DF3F"><enum>(i)</enum><text>The applicant's experience in dispensing, or conducting research with respect to, controlled substances.</text>
 </clause><clause id="H0EAC5735D74843B6881C8A516752F2BC"><enum>(ii)</enum><text>Compliance with applicable Federal or State laws relating to controlled substances.</text> </clause><clause id="H9AD6C9331DC540518AF2B2AAEB34A2A8"><enum>(iii)</enum><text>Conduct by the applicant that may threaten the public health and safety.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H002D57F7C6144F5E8F21B995DF7E6205"><enum>(2)</enum><header>Conforming amendment</header><text>Section 102(16) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(16)</external-xref>) is amended by inserting <quote>or <term>marijuana</term></quote> after <quote>The term <term>marihuana</term></quote>.</text> </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H4059CAC676F442DF940BB2E4EAEF4162" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Provision by Department of Veterans Affairs health care providers of recommendations and opinions regarding veteran participation in State marijuana programs</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Secretary of Veterans Affairs shall authorize physicians and other health care providers employed by the Department of Veterans Affairs to—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H28685D5FCBD343DAB030226BB4A0A5B3"><enum>(1)</enum><text display-inline="yes-display-inline">provide recommendations and opinions to veterans who are residents of States with State marijuana programs regarding the participation of veterans in such State marijuana programs; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA7B92F0B994645CFA0987110840BD3EE"><enum>(2)</enum><text display-inline="yes-display-inline">complete forms reflecting such recommendations and opinions.</text> </paragraph></section></legis-body></bill>
