		<official-title>To promote the provision of exercise or fitness equipment, and exercise or fitness classes and
			 instruction, that are accessible to individuals with
			 disabilities.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Exercise and Fitness for All Act</short-title></quote>.</text>
		</section><section id="id1c950f17c09340d9847b3ebee0995cba"><enum>2.</enum><header>Findings and purpose</header>
 <subsection id="id54825882d7ac4d27a2e231435812078e"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="ide3431aecd65347f2be584debdaab48ac"><enum>(1)</enum><text>Individuals with disabilities can maintain and improve their health through appropriate physical activity.</text>
 </paragraph><paragraph id="idaa6a51a14df54e4ca6977b1e6d3a7363"><enum>(2)</enum><text>In the 2018 Physical Activity Guidelines for Americans (referred to in this section as the <quote>Guidelines</quote>), the Department of Health and Human Services recommends that individuals with disabilities, who are able, participate in regular aerobic activity.</text>
 </paragraph><paragraph id="id0abc65bc4ec64dd481ce96e52c07cbc5"><enum>(3)</enum><text>The Guidelines also recommend that adults with disabilities, who are able, do muscle strengthening activities of moderate or high intensity on 2 or more days a week, as these activities provide additional health benefits.</text>
 </paragraph><paragraph id="id06cd300aa9654069bd3d74d10bee2fe7"><enum>(4)</enum><text>The Guidelines recommend that when adults with disabilities are not able to meet the Guidelines, they should engage in regular physical activity according to their abilities and avoid inactivity.</text>
 </paragraph><paragraph id="idc96175f58a3b4d928f13990418045c39"><enum>(5)</enum><text>Physical inactivity by adults with disabilities can lead to increased risk for functional limitations and secondary health conditions.</text>
 </paragraph><paragraph id="idad4c2f78bcde475f88444d76b893cb92"><enum>(6)</enum><text>Many individuals with disabilities are unable to engage in the exercises or fitness activities recommended in the Guidelines due to the failure of exercise or fitness service providers to provide accessible exercise or fitness equipment.</text>
 </paragraph><paragraph id="idb7d31a0e5a0e4b29b98a2868449d7a1e"><enum>(7)</enum><text>The failure to provide accessible exercise or fitness equipment constitutes discrimination in violation of the Americans with Disabilities Act of 1990 (referred to in this section as the <quote>ADA</quote>).</text>
 </paragraph></subsection><subsection id="idc3e57222e28f42de9da23c57d5a492f2"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is—</text> <paragraph id="id9B451747F79041898F3F2CAD6F7FC2B7"><enum>(1)</enum><text>to carry out the ADA’s objectives of providing <quote>a clear and comprehensive national mandate for the elimination of discrimination</quote> and <quote>clear, strong, consistent, enforceable standards addressing discrimination</quote>; and</text>
 </paragraph><paragraph id="idD117868DC23948E78BFA58636FF347F7"><enum>(2)</enum><text>specifically, to carry out those objectives by issuing guidelines and regulations for exercise or fitness service providers specifying the accessible exercise or fitness equipment, and the accessible exercise or fitness classes and instruction, necessary to ensure that individuals with disabilities can—</text>
 <subparagraph id="id808131A25C594FF78006C5AC9D87CEFC"><enum>(A)</enum><text>obtain the benefits of physical activity; and</text>
 </subparagraph><subparagraph id="id930F6BE30E6C4420AA523A38FC8075AB"><enum>(B)</enum><text>fully participate in the services offered by exercise or fitness service providers.</text>
 </subparagraph></paragraph></subsection></section><section id="id0d9fb98ceb014d528dcd7a3b330d12fa"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id3bf198ba8cf241b3834efdaade87cfd9"><enum>(1)</enum><header>Access board</header><text>The term <term>Access Board</term> means the Architectural and Transportation Barriers Compliance Board established under section 502 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/792">29 U.S.C. 792</external-xref>).</text>
 </paragraph><paragraph id="ide3a2382e1ff14b24a68f684bb5cc82dd"><enum>(2)</enum><header>Accessible exercise or fitness equipment</header><text>The term <term>accessible exercise or fitness equipment</term>—</text> <subparagraph id="id15EB4206F81E4BBF9A04CBB4B4DC2A59"><enum>(A)</enum><text>means exercise or fitness equipment that is accessible to, and can be independently used and operated by, individuals with disabilities; and</text>
 </subparagraph><subparagraph id="idB33810FA24F5434B829BA1A3CC67C96E"><enum>(B)</enum><text>includes equipment that complies with—</text>
 <clause id="id51B7E45297EC42A6AFBE84986366AB01"><enum>(i)</enum><text>the American Society for Testing and Materials (referred to in this section as <quote>ASTM</quote>) Standard Specification for Universal Design of Fitness Equipment for Inclusive Use by Persons with Functional Limitations and Impairments, ASTM F3021–17 (or any corresponding similar ASTM standard); and</text>
 </clause><clause id="idA629CD33BDA448ACBB367DF79C53F7F2"><enum>(ii)</enum><text>other ASTM standards with specifications for inclusive use of specific exercise or fitness equipment, such as bicycles or strength equipment.</text>
 </clause></subparagraph></paragraph><paragraph id="idd24a34a5b8a24683a14cbfd5fa2e7e26"><enum>(3)</enum><header>Exercise or fitness equipment</header><text>The term <term>exercise or fitness equipment</term> means devices such as motorized treadmills, stair climbers or step machines, stationary bicycles, rowing machines, weight machines, circuit training equipment, cardiovascular equipment, strength equipment, or other similar equipment.</text>
 </paragraph><paragraph id="idf7a53d36c3424ad7b7e819abf7256e8c"><enum>(4)</enum><header>Exercise or fitness service provider</header><text>The term <term>exercise or fitness service provider</term>—</text> <subparagraph id="id15D71990FAEC47F8A6F1C30F232ADD59"><enum>(A)</enum><text>means an entity that—</text>
 <clause id="id2830557F069E4052B5108B2F7EA46182"><enum>(i)</enum><text>provides exercise or fitness equipment, or exercise or fitness classes or instruction, for the use of patrons; and</text>
 </clause><clause id="id96BD55DCD95D4B22AAA582FC9A57006C"><enum>(ii)</enum><text>is considered a public accommodation under section 301 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181</external-xref>) or is considered a public entity under section 201 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131</external-xref>); and</text>
 </clause></subparagraph><subparagraph id="idA83C10149A394676B9581951A42013CA"><enum>(B)</enum><text>includes a stand-alone exercise or fitness center and an exercise or fitness center within an entity such as a hotel, retirement community, gymnasium, elementary or secondary school, or institution of higher education.</text>
 </subparagraph></paragraph><paragraph id="id3725a08e3d5a47e2b00b9f62b83440d9"><enum>(5)</enum><header>Individual with a disability</header><text>The term <term>individual with a disability</term> means any person with a disability as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text>
			</paragraph></section><section id="id24026b9f004b4f3aa100f6343237b8ee"><enum>4.</enum><header>Exercise and fitness accessibility guidelines and regulations</header>
 <subsection id="id5072de0f339b4ab5895974fb69f9d08a"><enum>(a)</enum><header>Establishment of guidelines</header><text>Not later than 18 months after the date of enactment of this Act, the Access Board shall develop and publish guidelines for exercise or fitness service providers regarding the provision of accessible exercise or fitness equipment.</text>
 </subsection><subsection id="id1f076c5f4e6f4fc7b489b2b42608cc92"><enum>(b)</enum><header>Contents of guidelines</header><text>The guidelines described in subsection (a) shall ensure that the appropriate number of items and types of accessible exercise or fitness equipment are provided by an exercise or fitness service provider.</text>
			</subsection><subsection id="idb18aaa8323c7489898b47aabcf2ac729"><enum>(c)</enum><header>Review and amendment</header>
 <paragraph id="id316773B398CA41FEBE7AE53FB2742B5A"><enum>(1)</enum><header>Revision</header><text>The Access Board shall periodically review and, as appropriate, amend the guidelines, and shall issue the resulting guidelines as revised guidelines.</text>
 </paragraph><paragraph id="id00EDD425C2D045D2B13CAE983C35AF34"><enum>(2)</enum><header>Inapplicability of regulatory elimination provision</header><text>Executive Order 13771 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to reducing regulation and controlling regulatory costs) shall not apply to this Act.</text>
				</paragraph></subsection><subsection id="idec26145e9f8645d2899cc003fa821a8d"><enum>(d)</enum><header>Regulations</header>
 <paragraph id="id8352490618C74AB6A439C60BB0EBEEF0"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the Access Board issues guidelines under this section, the Department of Justice shall issue regulations regarding the provision of accessible exercise or fitness equipment and accessibility of exercise or fitness classes and instruction.</text>
 </paragraph><paragraph id="id06140F962BFC4737BA7D15504FD1113C"><enum>(2)</enum><header>Equipment</header><text>With respect to the provision of exercise or fitness equipment, the regulations shall be consistent with the Access Board guidelines.</text>
 </paragraph><paragraph id="idBF0DEF1F71934197A815E72095470DB7"><enum>(3)</enum><header>Exercise or fitness classes and instruction</header><text>The regulations shall—</text>
 <subparagraph id="idfdd0f931077c499ebff3af3531279a14"><enum>(A)</enum><text>ensure that exercise or fitness classes and instruction offered by the service provider are accessible to individuals with disabilities; and</text>
 </subparagraph><subparagraph id="id421d01779352458890648d48508dc9d0"><enum>(B)</enum><text>ensure that the service provider makes available at least one employee who is able to assist individuals with disabilities in their use of accessible exercise or fitness equipment.</text>
 </subparagraph></paragraph><paragraph id="id3124AEA0FBFA4A49834D4E8E14C60A42"><enum>(4)</enum><header>Considerations</header><text>In issuing the regulations, the Department of Justice shall take into consideration each of the following:</text>
 <subparagraph id="ide58aead6b67a4965bf247de8cbb082af"><enum>(A)</enum><text>Whether the exercise or fitness service provider is providing equipment, classes, or instruction at a new or existing facility.</text>
 </subparagraph><subparagraph id="idbd3c1725e5bb430999c2e7f1f823784c"><enum>(B)</enum><text>The size of the exercise or fitness facility.</text> </subparagraph><subparagraph id="id394519e9a6a64bea853d24ac7e26e273"><enum>(C)</enum><text>The availability of closed captioning of video programming displayed on equipment or a television provided by the exercise or fitness service provider.</text>
					</subparagraph></paragraph></subsection></section><section id="id1DA0CC6363E840149483FFF75CE4D624"><enum>5.</enum><header>Tax credit for expenditures to provide accessible exercise or fitness equipment</header>
 <subsection id="id0807CE9757B84FB4A293F7D45C805142"><enum>(a)</enum><header>In general</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/44">section 44(c)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> <paragraph id="idCDCBD1794C604248836C540E894ABD97"><enum>(1)</enum><text>by striking <quote>means amounts paid or incurred by an eligible small business</quote> and inserting</text>
					<quoted-block display-inline="yes-display-inline" id="id2020F89D97DA448E8267D27CAAFFECF8" style="OLC">
 <text>means amounts paid or incurred—</text><subparagraph id="id78398A0642324184BDF96E0D0648893B"><enum>(A)</enum><text>amounts paid or incurred by an eligible small business</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="id370F36595D034590B1281E5FE3F00C42"><enum>(2)</enum><text>by striking <quote>section).</quote> and inserting <quote>section), and</quote>; and</text>
 </paragraph><paragraph id="idF7D7AAA7141A494DBD0D1BEAA7BE3DF2"><enum>(3)</enum><text>by inserting at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id93A81DFC31334537ACFE69C434E30B4E" style="OLC"> <subparagraph id="id85A83D3C886A4BA59C5F5C89DD7038D9"><enum>(B)</enum><text>amounts paid or incurred by an eligible small business which is an exercise or fitness service provider for the purpose of providing for use by individuals with disabilities accessible exercise or fitness equipment that meets the guidelines established by the Access Board under section 4 of the Exercise and Fitness for All Act.</text>
						</subparagraph><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Any term used in subparagraph (B) which is defined in section 3 of the Exercise and Fitness for All
			 Act shall have the meaning given such term in such section, as in effect
			 on the date of the enactment of such subparagraph.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idC150EC37873846029602C3A085F74ADC"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to expenses paid or incurred in taxable years beginning after the date of the enactment of this Act.</text>
