			 deny applications to export natural gas, and for other purposes. </official-title>

 <section id="id09ADF82F964E44B3AF242D1ADB25D743" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>LNG Permitting Certainty and Transparency Act</short-title></quote>.</text> </section><section id="id744C7E8FDA5848C0BCB0B2C1505B29A6" section-type="subsequent-section"><enum>2.</enum><header>Action on applications to export liquefied natural gas</header> <subsection commented="no" display-inline="no-display-inline" id="idd2206fa1fac34942ab4afd9f5c4c944b"><enum>(a)</enum><header display-inline="yes-display-inline">Decision deadline</header><text display-inline="yes-display-inline">For proposals that must also obtain authorization from the Federal Energy Regulatory Commission or the Maritime Administration to site, construct, expand, or operate liquefied natural gas export facilities, the Secretary of Energy (referred to in this Act as the <term>Secretary</term>) shall issue a final decision on any application for the authorization to export natural gas under section 3(a) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b(a)</external-xref>) not later than 45 days after the later of—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id3924e33671c04844b11ffac312af68ec"><enum>(1)</enum><text display-inline="yes-display-inline">the conclusion of the review to site, construct, expand, or operate the liquefied natural gas export facilities required by the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57fdeb6c3c9641f3840e0a9ff4126427"><enum>(2)</enum><text display-inline="yes-display-inline">the date of enactment of this Act.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9329476f3809470294598e1b8510952b"><enum>(b)</enum><header display-inline="yes-display-inline">Conclusion of review</header><text display-inline="yes-display-inline">For purposes of subsection (a), review required by the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) shall be considered concluded when the lead agency—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="ida8b31bf410be4dd0a903f0fa43ff2864"><enum>(1)</enum><text display-inline="yes-display-inline">for a project requiring an Environmental Impact Statement, publishes a Final Environmental Impact Statement;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71761c26e71c4e009bec85e5b05ae128"><enum>(2)</enum><text display-inline="yes-display-inline">for a project for which an Environmental Assessment has been prepared, publishes a Finding of No Significant Impact; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddce23e738a364bd188fd6d90a0211d94"><enum>(3)</enum><text display-inline="yes-display-inline">determines that an application is eligible for a categorical exclusion pursuant to National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) implementing regulations.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8eafd3e555ed405a8752bc9a7b3f0db0"><enum>(c)</enum><header display-inline="yes-display-inline">Judicial review</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id0f58b5510ddd40919a2f3020a89dfd81"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except for review in the Supreme Court, the United States Court of Appeals for the District of Columbia Circuit or the circuit in which the liquefied natural gas export facility will be located pursuant to an application described in subsection (a) shall have original and exclusive jurisdiction over any civil action for the review of—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id649f0f52c7934252aaabbef65933c6b1"><enum>(A)</enum><text display-inline="yes-display-inline">an order issued by the Secretary with respect to such application; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id666249c411bf4d2b8e6db889d8f73dcb"><enum>(B)</enum><text display-inline="yes-display-inline">the failure of the Secretary to issue a final decision on such application.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id78ce4258a64d46c1816c86a981048092"><enum>(2)</enum><header display-inline="yes-display-inline">Order</header><text display-inline="yes-display-inline">If the Court in a civil action described in paragraph (1) finds that the Secretary has failed to issue a final decision on the application as required under subsection (a), the Court shall order the Secretary to issue the final decision not later than 30 days after the order of the Court.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87589bd169354c03b791bd2402118244"><enum>(3)</enum><header display-inline="yes-display-inline">Expedited consideration</header><text display-inline="yes-display-inline">The Court shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id1b61cc8026524b139c41c33601598ade"><enum>(A)</enum><text display-inline="yes-display-inline">set any civil action brought under this subsection for expedited consideration; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51a5f5cd539e431d899799684c29616f"><enum>(B)</enum><text display-inline="yes-display-inline">set the matter on the docket as soon as practicable after the filing date of the initial pleading.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf1e63efc7526424fadb28d0b25996567"><enum>(4)</enum><header display-inline="yes-display-inline">Transfers</header><text display-inline="yes-display-inline">In the case of an application described in subsection (a) for which a petition for review has been filed—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idc7b8d19bf2684873b903d46fc549eb26"><enum>(A)</enum><text display-inline="yes-display-inline">upon motion by an applicant, the matter shall be transferred to the United States Court of Appeals for the District of Columbia Circuit or the circuit in which a liquefied natural gas export facility will be located pursuant to an application described in section 3(a) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b(a)</external-xref>); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f6590bb73ef46679a81f784bcf2060b"><enum>(B)</enum><text display-inline="yes-display-inline">the provisions of this section shall apply.</text> </subparagraph></paragraph></subsection></section></legis-body> </bill>
