		<official-title>To amend the Presidential Transition Act of 1963 to improve the orderly transfer of the executive
			 power during Presidential transitions.  </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Presidential Transition Enhancement Act of 2018</short-title></quote>.</text>
		</section><section id="idABFE74AE150C4C6DB08B3033E6E2B6C5"><enum>2.</enum><header>Presidential transition enhancements</header>
 <subsection id="iddfce927fc17c4324ac8e2162e683e26f"><enum>(a)</enum><header>In general</header><text>Section 3 of the Presidential Transition Act of 1963 (<external-xref legal-doc="usc" parsable-cite="usc/3/102">3 U.S.C. 102</external-xref> note) is amended—</text> <paragraph id="id36b8b8ee4e244b8aae20ce82bf3c3918"><enum>(1)</enum><text>in subsection (a)(2), by inserting <quote>, or in the case of an employee in a position in the legislative branch, with the consent of the supervising Member of Congress</quote> after <quote>with the consent of the head of the agency</quote>;</text>
 </paragraph><paragraph id="id046ba0ab1b6b4aa8a8ac77f1de30f41f"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idc29fc89c3b6c44509c8c9b19e1597c97" style="OLC"> <subsection id="id6863440c87474fa7bb695e485ad5a864"><enum>(b)</enum><text>The Administrator shall expend funds for the provision of services and facilities under this section—</text>
 <paragraph id="idD628FAFF54E84C278AAAE2A0A0544EB7"><enum>(1)</enum><text>in connection with any obligation incurred during the period—</text> <subparagraph id="id2134d1d19b4848ec81d77d2044a4c09d"><enum>(A)</enum><text>beginning on the day after the date of the general elections held to determine the electors of the President and Vice President under section 1 or 2 of title 3, United States Code; and</text>
 </subparagraph><subparagraph id="id03b93cf4bd194fabbc3d03a7f2887c4c"><enum>(B)</enum><text>ending on the date that is 60 days after the date of the inauguration of the President-elect as President and the inauguration of the Vice-President-elect as Vice President; and</text>
 </subparagraph></paragraph><paragraph id="id2A145FBD8AA04BC6B1D7A1E42DA976AA"><enum>(2)</enum><text>without regard to whether the transition team submits to the Administrator a request for payment regarding services or facilities before the end of such period.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="idd8070148e2914246b4469ee15268f446"><enum>(3)</enum><text>in subsection (h)(2)(B)(ii), by striking <quote>computers</quote> and inserting <quote>information technology</quote>; and</text> </paragraph><paragraph id="id9c11d0aeb80a49c28497658db368a9e7"><enum>(4)</enum><text>By adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id807d8a66ffce4dd1b233f3af734f80d7" style="OLC">
						<subsection id="id1224d966cd7245b59727a93ee5e711da"><enum>(i)</enum><header>Memorandums of understanding</header>
 <paragraph id="id627ed014384f48c59f2b0fd3a0a6ee58"><enum>(1)</enum><header>In general</header><text>Not later than August 1 of a year during which a Presidential election occurs, the Administrator shall, to the maximum extent practicable, enter into a memorandum of understanding with the transition representative of each eligible candidate, which shall include, at a minimum, the conditions of access to employees, facilities, and documents of agencies by transition staff.</text>
 </paragraph><paragraph id="id0a193f6bf74c4e16a37b3ca41e4ed597"><enum>(2)</enum><header>Existing resources</header><text>To the maximum extent practicable, a memorandum of understanding entered into under paragraph (1) shall be based on memorandums of understanding relating to previous Presidential transitions.</text>
							</paragraph><paragraph id="id928292563e1a4f428d9209db3ddc339d"><enum>(3)</enum><header>Transition representative</header>
 <subparagraph id="idDF5A70462673477AA4E5F99D112C3BF5"><enum>(A)</enum><header>Designation of representative for inquiries</header><text>Each memorandum of understanding entered into under this subsection shall designate a representative of the eligible candidate to whom the Administrator shall direct any inquiries or legal instruments regarding the records of the eligible candidate that are in the custody of the Administrator.</text>
 </subparagraph><subparagraph id="id37C055ECEC7A4719A14DFD9EE85374CC"><enum>(B)</enum><header>Change in transition representative</header><text>The designation of a new individual as the transition representative of an eligible candidate shall not require the execution of a new memorandum of understanding under this subsection.</text>
 </subparagraph></paragraph><paragraph id="id5b588d54969b41ca89ec36747ded82c8"><enum>(4)</enum><header>Amendments</header><text>Any amendment to a memorandum of understanding entered into under this subsection shall be agreed to in writing.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5D41F38710524B94A82F13114447C42D"><enum>(5)</enum><header display-inline="yes-display-inline">Prior notification of deviation</header><text display-inline="yes-display-inline">Each party to a memorandum of understanding entered into under this subsection shall provide written notice not later than 3 days before taking any action that deviates from the terms and conditions agreed to in the memorandum of understanding.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB19E42E341A04B83B2E3258988613F88"><enum>(6)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible candidate</term> has the meaning given that term in subsection (h)(4).</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id46f7cb44a9494bafbc9a085c18fc5f82"><enum>(b)</enum><header>Agency transitions</header><text>Section 4 of the Presidential Transition Act of 1963 (<external-xref legal-doc="usc" parsable-cite="usc/3/102">3 U.S.C. 102</external-xref> note) is amended—</text>
 <paragraph id="idd2b8c77f398c4f83bae3e3c5003e4e8e"><enum>(1)</enum><text>in subparagraphs (C) and (D) of subsection (e)(3), by inserting <quote>serving in a career position</quote> after <quote>senior representative</quote>; and</text> </paragraph><paragraph id="idd8fdf00b93fa41379c36e839137a0080"><enum>(2)</enum><text>by striking subsection (f)(2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1dfc954d6d744b29b40e07ff802ec405" style="OLC">
 <paragraph id="id48db2f55a8f943dd802f80ef2b53e5a2"><enum>(2)</enum><header>Acting officers</header><text>Not later than September 15 of a year during which a Presidential election occurs, and in accordance with subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, the head of each agency shall ensure that a succession plan is in place for each senior noncareer position in the agency.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
