		<section id="id1a3b240ac1ed4815bfd8c3bf70cf84f4" section-type="section-one"><enum>1.</enum><header>Improvements to home health payment reforms under Medicare</header>
 <subsection id="idbb1a9dfd60064130be7a37ecf4039f93"><enum>(a)</enum><header>Application of budget neutrality</header><text>Section 1895(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395fff">42 U.S.C. 1395fff(b)(3)</external-xref>), as amended by section 51001(a)(2) of the Bipartisan Budget Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/123">Public Law 115–123</external-xref>), is amended—</text>
 <paragraph id="id5e80656e27434f74b8248cf94a723c98"><enum>(1)</enum><text>in subparagraph (A)(iv), in the fourth sentence—</text> <subparagraph id="idef5e35f641ef4279b38065df9b67674e"><enum>(A)</enum><text>by striking <quote>shall make</quote> and inserting <quote>shall not make</quote>; and</text>
 </subparagraph><subparagraph id="id4f19d2ed4c0748b2aece77958a8166a2"><enum>(B)</enum><text>by striking <quote>and shall provide a description</quote> and all that follows through the period and inserting a period; and</text> </subparagraph></paragraph><paragraph id="id7443d11ea693416eab7f191f31e26450"><enum>(2)</enum><text>in subparagraph (D)—</text>
 <subparagraph id="id285afedcec4143eaa2b750344294b9d5"><enum>(A)</enum><text>in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">assumptions</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">observed evidence</header-in-text></quote>;</text> </subparagraph><subparagraph id="id898979db2f3c414b9ae0bfd21a8755cd"><enum>(B)</enum><text>in clause (i)—</text>
 <clause id="id838a20fd26754bfab1f363d6927316a1"><enum>(i)</enum><text>by striking <quote>differences between assumed</quote> and all that follows through <quote>and actual</quote>;</text> </clause><clause id="id5a4c4b071d5048efb90e114b628d7a79"><enum>(ii)</enum><text>by inserting <quote>attributable to the implementation of paragraphs (2)(B) and (4)(B)</quote> after <quote>behavior changes</quote>; and</text>
 </clause><clause id="id56d0f7ed3c334c1abbcecd9adc09af67"><enum>(iii)</enum><text>by adding at the end the following: <quote>The Secretary shall publish the determination under this clause with respect to an applicable year, including a description of the observed evidence used to make such determination, in the notice and comment rulemaking to update the prospective payment system under this subsection for such year. For purposes of the preceding sentence, the term <term>observed evidence</term> means statistically valid data from the most recent cost report and claims regarding changes in the nature of home health agency patients, patterns of care, service costs, and claims coding after January 1, 2020, reflecting behavioral changes relating to implementation of the provisions of and amendments made by section 51001 of the Bipartisan Budget Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/123">Public Law 115–123</external-xref>).</quote>;</text>
 </clause></subparagraph><subparagraph id="id1b46b6ad52124dff81649d11df5f1ab1"><enum>(C)</enum><text>in clause (ii), by inserting <quote>attributable to the implementation of paragraphs (2)(B) and (4)(B)</quote> after <quote>expenditures</quote>; and</text> </subparagraph><subparagraph id="idcce4b311387943d196184f92526dc7f5"><enum>(D)</enum><text>in clause (iii)—</text>
 <clause id="id6e8fbbd39cc0425393ecf394cd0b058c"><enum>(i)</enum><text>by adding <quote>attributable to the implementation of paragraphs (2)(B) and (4)(B)</quote> after <quote>expenditures</quote>; and</text> </clause><clause id="id479399bad4894657a7b75da9f5037515"><enum>(ii)</enum><text>by adding at the end the following: <quote>If such a temporary increase or decrease does not exceed 2.00 percent in any given year, the Secretary shall apply the entire increase or decrease in the next calendar year payment update; however, if such a temporary increase or decrease exceeds 2.00, to provide for minimal disruption to patients and providers, the Secretary shall phase in the temporary increase or decrease in equal amounts not to exceed 2.00 percent in any given year through the respective calendar year payment updates.</quote>.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id33d4f9eca1f94a479e02ec112733cdce"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the enactment of such section 51001(a)(2).</text>
