	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Apprenticeships through Regional Training Networks for Employers' Required Skills Act of 2018</short-title></quote> or the <quote><short-title>PARTNERS Act</short-title></quote>.</text>
 </section><section id="idB8902543735E48598002A190E18B7F19"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to promote registered apprenticeships and other work-based learning opportunities for small and medium-sized businesses within in-demand industry sectors, through the establishment and support of eligible partnerships.</text>
 </section><section id="idB8AEB72CA3EC44B0B500B263FC9339BB"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id2b74dc4a35a74f1b805f09d272ef73fd"><enum>(1)</enum><header>Eligible partnership</header><text>The term <term>eligible partnership</term> means an industry or sector partnership that submits and obtains approval of an application consistent with section 6(b).</text>
 </paragraph><paragraph id="id9BEC0A95152D4CC48DBE372031311F88"><enum>(2)</enum><header>In-demand industry sector</header><text>The term <term>in-demand industry sector</term> means a sector described in subparagraphs (A)(i) and (B) of section 3(23) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102(23)</external-xref>).</text>
 </paragraph><paragraph id="id0907D70B907D410DB2AC306D0772A29D"><enum>(3)</enum><header>Local or regional</header><text>The term <term>local or regional</term>, used with respect to an entity, means that the entity provides services in, respectively, a local area or region.</text>
 </paragraph><paragraph id="idFD5026EDB37F404294C0A1D45B82C442"><enum>(4)</enum><header>Registered apprenticeship</header><text>The term <term>registered apprenticeship</term> means an apprenticeship registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.).</text> </paragraph><paragraph id="id2A796BCE78F0434088D19F729942A9C7"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9C9DCD4281724E358601D2A97D0DAAB8"><enum>(6)</enum><header>Work-based learning opportunity</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8DBC7CFA7BF3429D9C54CEBB425FCA8C"><enum>(A)</enum><header>In general</header><text>The term <term>work-based learning opportunity</term> means a program that provides workers with paid work experience and corresponding classroom instruction, delivered in an employment relationship that both the business and worker intend to lead to continuing employment after the program ends.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB7B98D5797B54DFAB3B81C50B5E72A03"><enum>(B)</enum><header>Work experience</header><text>In subparagraph (A), the term <term>paid work experience</term> includes training by a business that is provided to a paid participant while engaged in productive work in a job that provides knowledge or skills essential to the full and adequate performance of the job.</text>
 </subparagraph></paragraph><paragraph id="idA20A8481D67443BEBC53111B8549DE17"><enum>(7)</enum><header>Workforce terms</header><text>The terms <term>Governor</term>, <term>individual with a barrier to employment</term>, <term>industry or sector partnership</term>, <term>local area</term>, <term>local board</term>, <term>outlying area</term>, <term>recognized postsecondary credential</term>, <term>region</term>, <term>State</term>, and <term>supportive services</term>, used with respect to activities supported under this Act, have the meanings given the terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text>
 </paragraph></section><section id="id59df00b14a54432ab8419a98cf01b1da"><enum>4.</enum><header>Availability of funds</header><text display-inline="no-display-inline">From funds paid into the general fund of the Treasury and available under section 286(s)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(s)(2)</external-xref>), the Secretary shall carry out this Act.</text>
		</section><section id="id237B676AC1EA4533A1164ACA0E536EB0"><enum>5.</enum><header>Allotments to States</header>
 <subsection id="id0B7EB0751B26449A9B399ED6E2CDCAA3"><enum>(a)</enum><header>Reservation</header><text display-inline="yes-display-inline">Of the amounts available for this Act under section 4, the Secretary may reserve—</text> <paragraph id="id5FCD3DADA850404D9B04AC7F7963FC6E"><enum>(1)</enum><text display-inline="yes-display-inline">not more than 5 percent of those amounts for the costs of technical assistance and Federal administration of this Act;</text>
 </paragraph><paragraph id="idFD89F885509242169AD587808B73D49C"><enum>(2)</enum><text display-inline="yes-display-inline">not more than 2 percent of those amounts for the costs of evaluations conducted under section 8(b); and</text>
 </paragraph><paragraph id="idB904160C00E14261827BA6808E6CFA2F"><enum>(3)</enum><text display-inline="yes-display-inline">not more than <fraction>1/4</fraction> of 1 percent of such amounts to provide assistance to the outlying areas.</text> </paragraph></subsection><subsection id="id2C1BCE5F0A4042A6B5A3B5BB5615A9EC"><enum>(b)</enum><header>Allotments</header> <paragraph id="id8D3D16D506B9411485261D36602123A9"><enum>(1)</enum><header>In general</header><text>Of the amounts available for this Act under section 4 that remain after the Secretary makes the reservations under subsection (a), the Secretary shall, for the purpose of assisting (which may include assistance in establishing expanded) local or regional eligible partnerships to support work-based learning opportunities under this Act, make allotments to eligible States in accordance with clauses (ii) through (v) of section 132(b)(1)(B) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3162">29 U.S.C. 3162(b)(1)(B)</external-xref>), subject to paragraph (2).</text>
 </paragraph><paragraph id="id2224339A8D7749979F1B5F8B252F3977"><enum>(2)</enum><header>Application</header><text>For purposes of applying the clauses described in paragraph (1), under paragraph (1), the Secretary—</text>
 <subparagraph id="id4EE1C3533B814726B572469A69F8EB6D"><enum>(A)</enum><text>shall not apply subclauses (I) and (III) of clause (iv) with respect to the first fiscal year after the date of enactment of this Act;</text>
 </subparagraph><subparagraph id="idD32D285D405842459573CFECDBAB8A37"><enum>(B)</enum><text>shall apply clause (iv)(II) by substituting <quote>0.5 percent of the remaining amounts described in paragraph (1)</quote> for the total described in that clause;</text> </subparagraph><subparagraph id="idEAE0EB37ECEB48E98574479BFFCFCB82"><enum>(C)</enum><text>shall not apply clause (iv)(IV);</text>
 </subparagraph><subparagraph id="idB31001A968D94966877C56EE31932768"><enum>(D)</enum><text>shall apply clause (v)(II) by substituting <quote>The term <term>allotment percentage</term>, used with respect to the second full fiscal year after the date of enactment of this Act, or a subsequent fiscal year, means a percentage of the remaining amounts described in paragraph (1) that is received through an allotment made under this subsection for the fiscal year.</quote> for the two sentences in that clause; and</text>
 </subparagraph><subparagraph id="idFE0001E18A294833A754E16423BC5E1B"><enum>(E)</enum><text>shall apply clause (v)(III) by substituting <quote>a work-based learning opportunity carried out under this Act</quote> for <quote>a program of workforce investment activities carried out under this subtitle</quote>.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5BC812EFDA9B48CDACBEF55E1742FC98"><enum>(3)</enum><header>Use of unallotted funds</header><text display-inline="yes-display-inline">If a State fails to meet the requirements for an allotment under this subsection, the Secretary may allot funds that are not allotted under paragraphs (1) and (2) to eligible States under a formula based on the formula specified in section 132(c) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3173">29 U.S.C. 3173(c)</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9A7B2F65CFA4722AD22FC3E6DAEA4CE"><enum>(4)</enum><header>Definition</header><text>In this subsection, the term <quote>eligible State</quote> means a State that meets the requirements of section 102 or 103 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3112">29 U.S.C. 3112</external-xref>, 3113) and subsection (c).</text>
 </paragraph></subsection><subsection id="id17ba0dcc21d946d5a622169aecf4cabd"><enum>(c)</enum><header>State eligibility</header><text>To be eligible to receive an allotment under subsection (b), a State shall submit an application to the Secretary, at such time, in such manner, and containing a description of the activities to be carried out with the grant funds. At a minimum, the application shall include information on—</text>
 <paragraph id="idf8759eac5a5b474daee729941ca0ecf9"><enum>(1)</enum><text>the industry or sector of the local or regional industry or sector partnerships that will be supported, the lead partners for the partnerships, and how the partnerships will work to engage small and medium-sized businesses, as applicable, in the activities of the partnerships;</text>
 </paragraph><paragraph id="id8d55656bce304a86985c911624184c2f"><enum>(2)</enum><text>the in-demand industry sectors that will be served, including how such industry sectors were identified, and how the activities of the partnerships will align with State, regional, and local plans as required under title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref> et seq.);</text>
 </paragraph><paragraph id="id43d8a9ad3b964bcb8f4fd9e0a9d2cda3"><enum>(3)</enum><text>the registered apprenticeship programs or other work-based learning opportunities to be supported though the partnerships;</text>
 </paragraph><paragraph id="idde990ea450514036b12cb7a915b815b9"><enum>(4)</enum><text>the populations that will receive services, including individuals with barriers to employment and populations that were historically underrepresented in the industry sectors to be served through the partnerships;</text>
 </paragraph><paragraph id="id5e0b48c5f0184e5c9da76481fd724380"><enum>(5)</enum><text>the services, including business engagement, classroom instruction, and supportive services (including at least 6 months of post-employment supportive services), that will be supported through the grant funds;</text>
 </paragraph><paragraph id="id48aae5bdfc6c441da79609f218f22e9d"><enum>(6)</enum><text>the recognized postsecondary credentials that workers will obtain through participation in the work-based learning opportunity and the quality of the learning opportunity that leads to the credentials;</text>
 </paragraph><paragraph id="id977cddbdad454f38b04813270514a363"><enum>(7)</enum><text>levels of performance to be achieved on the performance indicators described in section 8, to measure progress towards expanding work-based learning opportunities; and</text>
 </paragraph><paragraph id="id4dd4b6cee7cf46c89111e3c8dfc2218b"><enum>(8)</enum><text>how the partnerships will leverage additional resources, including funding provided under title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref> et seq.) and non-Federal resources, to support the activities carried out under this Act.</text>
 </paragraph></subsection><subsection id="id1699463216F6412389EA64FEF12607D6"><enum>(d)</enum><header>Review of applications</header><text>The Secretary shall review applications submitted under subsection (c) in consultation with the Secretary of Education and the Secretary of Health and Human Services.</text>
			</subsection></section><section id="id537c1a358ec849ad89dadb2b7898e3ee"><enum>6.</enum><header>Grants to partnerships</header>
			<subsection id="id579ec94585864ec1b71dfdd25b76ef3b"><enum>(a)</enum><header>Grants</header>
 <paragraph id="id57596AF897624A1E8E59C2C1ABEEC5A5"><enum>(1)</enum><header>In general</header><text>The Governor of a State that receives an allotment under section 5 shall use the funds made available through the allotment and not reserved under subsection (d) to award grants to industry or sector partnerships that seek to become eligible partnerships. The Governor shall award the grants for the purpose of assisting (which may include establishing expanded) local or regional industry or sector partnerships that are identified in the application submitted under section 5(c), to carry out activities described in section 7.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6269ECCB87F349AFA5E3F6F72C0FC8DF"><enum>(2)</enum><header display-inline="yes-display-inline">Period and amount of grant</header><text display-inline="yes-display-inline">A State may make a grant under this section for a period of 3 years, and in an amount of not more than $500,000.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC47F1459111C4C53B78F85934B90263F"><enum>(3)</enum><header>Availability of funds</header><text>The Governor of a State that receives an allotment under section 5 for a fiscal year may use the funds made available through the allotment during that year or the 2 subsequent fiscal years.</text>
 </paragraph></subsection><subsection id="ide13ff2239ce24fc4b5f27b7599eb487e"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, an industry or sector partnership described in subsection (a)(1) shall—</text>
 <paragraph id="idABE6674EE3254B9790B1A27925BB5442"><enum>(1)</enum><text>submit an application to the State at such time, in such manner, and containing such information as the State may require; and</text>
 </paragraph><paragraph id="idE25A1343D9884971A99C6891D71BC5F5"><enum>(2)</enum><text>designate a partner in the industry or sector partnership, to serve as the fiscal agent for purposes of the grant.</text>
				</paragraph></subsection><subsection id="idC3A0831CADCF4666A510F4EE948F789A"><enum>(c)</enum><header>Awards of grants</header>
 <paragraph id="id64c44960e6184c49ad05767c9de8d139"><enum>(1)</enum><header>Participation in multiple eligible partnerships</header><text>Subject to paragraph (2), a State may award grants under this section in a way that results in an entity being represented in more than one partnership that receives such a grant.</text>
 </paragraph><paragraph id="idf085d01fe9d74da1b27efb5d8f0cad0a"><enum>(2)</enum><header>Geographic diversity</header><text>In making the grants, a State shall ensure that there is geographic diversity in the areas in which activities will be carried out under the grants.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida9eda9f953954b5392a49518b10f15fc"><enum>(d)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The State may reserve not more than 5 percent of the amount of an allotment under section 5 for the administration of the grants awarded under this section.</text>
			</subsection></section><section id="idB74285EA640F4ECA97516CA4FCC1CC22"><enum>7.</enum><header>Use of funds</header>
 <subsection id="id680789F54D384FB8BCF2E5FED54B841A"><enum>(a)</enum><header>In general</header><text>An eligible partnership that receives a grant under section 6 shall use the grant funds to support a registered apprenticeship or other work-based learning opportunity. The eligible partnership shall use the grant funds to support the activities described in subsections (b) and (c) and such other strategies as may be necessary to support the development and implementation of work-based learning opportunities, and participant retention in and completion of those opportunities. The partnership may use the grant funds to establish an expanded eligible partnership.</text>
 </subsection><subsection id="id6CD839C5F2454F6088A33B8E697EB97D"><enum>(b)</enum><header>Business engagement</header><text>The eligible partnership shall use grant funds to provide services to engage businesses in work-based learning opportunities, which may include assisting a small or medium-sized business with—</text>
 <paragraph id="id413801aa43ac4cd89d05f11c1bfe5bfd"><enum>(1)</enum><text>the navigation of the registration process for a sponsor of a registered apprenticeship program;</text> </paragraph><paragraph id="id8c2b09cf77744f9d893142701e7dc305"><enum>(2)</enum><text>the connection of the business with an education provider to develop classroom instruction to complement on-the-job learning;</text>
 </paragraph><paragraph id="ideff03fe1a3b84e979de3fb137a32f97f"><enum>(3)</enum><text>the development of a curriculum for a work-based learning opportunity;</text> </paragraph><paragraph id="idba80231090244ad0ab51541cbe53189a"><enum>(4)</enum><text>the employment of workers in a work-based learning opportunity for a transitional period before the business hires an individual for continuing employment;</text>
 </paragraph><paragraph id="id30d7a986b00a4d87a553781d5a638271"><enum>(5)</enum><text>the provision of training to managers and front-line workers to serve as trainers or mentors to workers in the work-based learning opportunity;</text>
 </paragraph><paragraph id="id492c31854654423aac437326c2f1ff1a"><enum>(6)</enum><text>the provision of career awareness activities; and</text> </paragraph><paragraph id="id2764dd38d7ce4bbaa869d738b7948dc7"><enum>(7)</enum><text>the recruitment of individuals to participate in a work-based learning opportunity from individuals receiving additional workforce and human services, including—</text>
 <subparagraph id="id6681B1C0169B464B8D298A2B53407A70"><enum>(A)</enum><text>workers in programs under the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="id22074BB6462146CA9BCC0FA9B22DEC9E"><enum>(B)</enum><text>recipients of assistance through the supplemental nutrition assistance program established under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="id71B14D493E4040DF92D9F20652562C00"><enum>(C)</enum><text>recipients of assistance through the program of block grants to States for temporary assistance for needy families established under part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.).</text>
					</subparagraph></paragraph></subsection><subsection id="id40BAB6076FAA4449977E5586D2683B2C"><enum>(c)</enum><header>Supportive services for workers</header>
 <paragraph id="idf8dc4e88f7af4743a3c1579b5f327354"><enum>(1)</enum><header>In general</header><text>The eligible partnership shall use grant funds to provide supportive services for workers to assure their success in work-based learning opportunities, which may include—</text>
 <subparagraph id="idc73c0c703e724789928f03ccf0317849"><enum>(A)</enum><text>connection of individuals with adult basic education;</text> </subparagraph><subparagraph id="idc3488782d0ac4cf0b156a7c9281fa355"><enum>(B)</enum><text>connection of individuals with pre-work-based learning or training, including through a pre-apprenticeship program;</text>
 </subparagraph><subparagraph id="id362515048AFE4E4184AFA8B330721644"><enum>(C)</enum><text>provision of additional mentorship and retention supports for individuals during pre-work-based learning or training for the learning opportunities, and during periods of employment for the learning opportunities;</text>
 </subparagraph><subparagraph id="id90C82050FEBE453B8EB093AF88057222"><enum>(D)</enum><text>provision of tools, work attire, and other required items necessary to start employment; and</text> </subparagraph><subparagraph id="id1368402bc4c242a3bd50382e6cdf9367"><enum>(E)</enum><text>provision of transportation, child care services, or other supportive services.</text>
 </subparagraph></paragraph><paragraph id="id93a1b20119d24e9d86b8ec4ce789383c"><enum>(2)</enum><header>Length of services</header><text>Each eligible partnership shall provide supportive services for workers for not less than 12 months after the date of placement of an individual in a work-based learning opportunity. That 12-month period shall include a period of pre-work-based learning or training, a transitional period of employment as described in subsection (b)(4), and a period of continuing employment.</text>
				</paragraph></subsection></section><section id="idCEC0195363604D5E9DC5547DBE7E1CED"><enum>8.</enum><header>Performance and accountability</header>
 <subsection id="idB8B79E3137FC4BC7A6BC0FB4DF515DD7"><enum>(a)</enum><header>Local reports</header><text>Not later than 1 year after receiving a grant under section 6, and annually thereafter, each eligible partnership in a State shall conduct an evaluation and submit to the State a local report containing information on—</text>
 <paragraph id="idde269850dde8465b817d3c795f56f6bd"><enum>(1)</enum><text>levels of performance achieved by the eligible partnership with respect to the performance indicators under section 116(b)(2)(A) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(b)(2)(A)</external-xref>)—</text>
 <subparagraph id="idA7D58F0EA5454D148BA60A4E97150056"><enum>(A)</enum><text>for all workers in the work-based learning opportunity involved; and</text>
 </subparagraph><subparagraph id="idF56C5A1E12EF421B987AF2AD4E97F273"><enum>(B)</enum><text>for all such workers, disaggregated by each population specified in section 3(24) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102(24)</external-xref>) and by race, ethnicity, sex, and age; and</text>
 </subparagraph></paragraph><paragraph id="idcac16a7f423a4d8a934b9367176e2daa"><enum>(2)</enum><text>levels of performance achieved by the eligible partnership with respect to the performance indicators under that section 116(b)(2)(A)—</text>
 <subparagraph id="idAEF63A74A32645C58F7612A0AE0077B1"><enum>(A)</enum><text>for individuals with barriers to employment in the work-based learning opportunity involved; and</text>
 </subparagraph><subparagraph id="idA9A430662F094B5483D13B619BD4EAFF"><enum>(B)</enum><text>for all such individuals, disaggregated by each population specified in section 3(24) of the Workforce Innovation and Opportunity Act and by race, ethnicity, sex, and age.</text>
 </subparagraph></paragraph></subsection><subsection id="id5e073fc21e8e46cd835e460d8fd4b5a4"><enum>(b)</enum><header>State reports</header><text>Not later than 24 months after receiving initial local reports under subsection (a) (but in no case less than 18 months after the corresponding grants are awarded) and annually thereafter, the State shall conduct an evaluation and submit a report to the Secretary containing—</text>
 <paragraph id="id978C0105BBA14F7D9D6E0EEA38311543"><enum>(1)</enum><text>the information provided by the eligible partnerships through the local reports; and</text>

 <subsection id="idE368124D16504E1596450D0918251951"><enum>(a)</enum><header>American Competitiveness and Workforce Improvement Act of 1998</header><text>Section 414(c) of the American Competitiveness and Workforce Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2916a">29 U.S.C. 2916a</external-xref>) is repealed.</text>
 </subsection><subsection id="id1D3F438A8B4B4268A703A7CC70904DA4"><enum>(b)</enum><header>Immigration and Nationality Act</header><text>Section 286(s)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(s)(2)</external-xref>) is amended to read as follows:</text>
