Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.) apply to each major disaster and emergency declared by the President on or after August 1, 2017, under the Robert T. Stafford Disaster Relief and Emergency Assistance Act.</text>
 </section><section id="HE7FF7AF8CFF94CEDBB65A02F34A37C5C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id04601FE8E396452990F6040B8C65BC67"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text>
 </paragraph><paragraph id="id1720F365074F48E487B52FC0334A18E4"><enum>(2)</enum><header>Agency</header><text>The term <term>Agency</term> means the Federal Emergency Management Agency.</text> </paragraph><paragraph id="id1EC4258B222E4070A945D8C793C3A851"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given that term in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text>
			</paragraph></section><section id="H3796487C400E4D4DB7774C5E1CA4DA43"><enum>4.</enum><header>Wildfire prevention</header>
 <subsection id="HB876F40349B8447B8ACBEBE6A0D09075"><enum>(a)</enum><header>Mitigation assistance</header><text display-inline="yes-display-inline">Section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>) is amended—</text>
 <paragraph id="H4EC9BAEAE35F487E9A565B4AF66822CC"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as subsection (e); and</text> </paragraph><paragraph id="H55E7EBFB5B9C4D2091CB46BD387F2472"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H6D3447254284489699150A8553A0DA02" style="OLC">
 <subsection id="HAC2F126FF7B84BDBB6DA8E3918091F4B"><enum>(d)</enum><header>Hazard mitigation assistance</header><text display-inline="yes-display-inline">Whether or not a major disaster is declared, the President may provide hazard mitigation assistance in accordance with section 404 in any area affected by a fire for which assistance was provided under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H1DE344DDE2F44A62930FE56EC6DA6232"><enum>(b)</enum><header>Conforming amendments</header><text>The Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.) is amended—</text>
 <paragraph id="HEB342A131A4A46CBB336EF435BE4FED7"><enum>(1)</enum><text>in section 322(e)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/5165">42 U.S.C. 5165(e)(1)</external-xref>), by inserting <quote>or event under section 420</quote> after <quote>major disaster</quote> each place it appears; and</text> </paragraph><paragraph id="id7C0F2C1C1AD547389F8E20D8FFEF3DFC"><enum>(2)</enum><text>in section 404(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c(a)</external-xref>), as amended by section <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">32</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">33</added-phrase> of this Act—</text>
 <subparagraph id="HE26E17F37B624B0A9EEE35F4AE750FE2"><enum>(A)</enum><text>by inserting before the first period <quote>, or any area affected by a fire for which assistance was provided under section 420</quote>; and</text> </subparagraph><subparagraph id="H150D9081D79D4EE984F92621780A3BD7"><enum>(B)</enum><text>in the third sentence by inserting <quote>or event under section 420</quote> after <quote>major disaster</quote> each place it appears.</text>
 </subparagraph></paragraph></subsection><subsection id="HBEF675FD584A407B9B6DB8949D1B5CCA"><enum>(c)</enum><header>Reporting requirement</header><text>Not later than 1 year after the date of enactment of this Act and annually thereafter, the Administrator shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committees on Appropriations of the Senate and the House of Representatives a report containing a summary of any projects carried out, and any funding provided to those projects, under subsection (d) of section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>), as added by this section.</text>
 </subsection></section><section id="HE8E9537365A9489B81113B15706066A4"><enum>5.</enum><header>Additional activities</header><text display-inline="no-display-inline">Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block id="H06FA1D8A5D88435B8C4473C714D716D7" style="OLC">
 <subsection id="H63774784A5BA405FAA34F3406AE0C3AD"><enum>(f)</enum><header>Use of assistance</header><text>Recipients of hazard mitigation assistance provided under this section and section 203 may use the assistance to conduct activities to help reduce the risk of future damage, hardship, loss, or suffering in any area affected by a wildfire or windstorm, such as—</text>
 <paragraph id="HB58B9FFD31A44485962197FD918B6E6E"><enum>(1)</enum><text display-inline="yes-display-inline">reseeding ground cover with quick-growing or native species;</text> </paragraph><paragraph id="H6918025BC28C4F278AC301224573C394"><enum>(2)</enum><text>mulching with straw or chipped wood;</text>
 </paragraph><paragraph id="H2649F551E731448DBA456252E3015FEE"><enum>(3)</enum><text>constructing straw, rock, or log dams in small tributaries to prevent flooding;</text> </paragraph><paragraph id="H6AD1E09990964D5096D86990FF92D07C"><enum>(4)</enum><text>placing logs and other erosion barriers to catch sediment on hill slopes;</text>
 </paragraph><paragraph id="H6CF92BFA089B4714BB9B8738B41AF5F9"><enum>(5)</enum><text>installing debris traps to modify road and trail drainage mechanisms;</text> </paragraph><paragraph id="H273BB4C2E89E4F78981AD8436620EE44"><enum>(6)</enum><text>modifying or removing culverts to allow drainage to flow freely;</text>
 </paragraph><paragraph id="H17C2878F94FD44098B95A69F98244F32"><enum>(7)</enum><text>adding drainage dips and constructing emergency spillways to keep roads and bridges from washing out during floods;</text>
 </paragraph><paragraph id="HBBD459D5758B4785AA36F047379F0C2D"><enum>(8)</enum><text>planting grass to prevent the spread of noxious weeds;</text> </paragraph><paragraph id="H4B4067C7C3C94752B869BCFE4EEF5641"><enum>(9)</enum><text>installing warning signs;</text>
 </paragraph><paragraph id="HAEA749D146A74ECC8EAEC62AB1B864B6"><enum>(10)</enum><text>establishing defensible space measures;</text> </paragraph><paragraph id="H74560C40871B4BF193289DB40F6F8401"><enum>(11)</enum><text>reducing hazardous fuels;</text>
 </paragraph><paragraph id="HE678304F958542D1B51097C6A5BEF714"><enum>(12)</enum><text display-inline="yes-display-inline"><added-phrase committee-id="SSGA00" reported-display-style="italic">mitigating</added-phrase> windstorm damage, including replacing or installing electrical transmission or distribution utility pole structures with poles that are resilient to extreme wind and combined ice and wind loadings for the basic wind speeds and ice conditions associated with the relevant location;</text>
 </paragraph><paragraph id="H9801DEC028084403A473E1EF90E3E50E"><enum>(13)</enum><text display-inline="yes-display-inline">removing standing burned trees; and</text> </paragraph><paragraph id="HF0E13F9D29BE4C87AB9B1F0BAC7CB971"><enum>(14)</enum><text>replacing water systems that have been burned and have caused contamination.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H816BBDE4FEF341489A56DAE42F4C429F"><enum>6.</enum><header>Eligibility for code implementation and enforcement</header>
 <subsection id="idD6E271895E3748E599A8B0D041093893"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 402 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170a">42 U.S.C. 5170a</external-xref>) is amended—</text>
 <paragraph id="id27972996E9DA40EBA9D6084492649772"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="idD463363F93B449918292E2DA371AD9F3"><enum>(2)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text>
 </paragraph><paragraph id="idD6E4476D24CE4FD3B7CEE4F7B15C7C16"><enum>(3)</enum><text>by inserting after paragraph (4) the following:</text> <quoted-block display-inline="no-display-inline" id="idAA0C0D81E07949D0960C22C7C109C22C" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="id7073F54D49DA4D989CDF3ECE4A86CC80"><enum>(5)</enum><text display-inline="yes-display-inline">provide assistance to State and local governments for building code and floodplain management ordinance administration and enforcement, including inspections for substantial damage compliance<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">.</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">; and</added-phrase></text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id2244FBC727984BB48FB30EC8D7F42667"><enum>(b)</enum><header>Repair, restoration, and replacement of damaged facilities</header><text display-inline="yes-display-inline">Section 406(a)(2) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172(a)(2)</external-xref>) is amended—</text>
 <paragraph id="HDDBFAAD46A3943E79E4B97B01D9B970E"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="H6225EFFDBAE242AB94A043268B738CC8"><enum>(2)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="H330EDDCF1C274352AE4204CEDDE1C478"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H6BBD4F7D8BE44468B6A39A406CF3C129" style="OLC"> <subparagraph id="H3242712CBCCD42E7A8D5292CDF1F2193"><enum>(D)</enum><text display-inline="yes-display-inline">base and overtime wages for extra hires to facilitate the implementation and enforcement of adopted building codes for a period of not more than 180 days after the major disaster is declared.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H3B1F6B11F85647A9B223EED46499A838"><enum>7.</enum><header>Program improvements</header>
 <subsection id="H44FE9E32CDFE463A801CB88AE9AF94C0"><enum>(a)</enum><header>Hazard Mitigation</header><text display-inline="yes-display-inline">Section 406(c) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172(c)</external-xref>) is amended—</text>
 <paragraph commented="no" id="HCBD6A6672B934A23AABC8A03EE0B88E7"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(A), by striking <quote>90 percent of</quote>; and</text> </paragraph><paragraph commented="no" id="H5E581B7275C04079B13473DDCF79E99D"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking <quote>75 percent of</quote>.</text>
 </paragraph></subsection><subsection commented="no" id="HC97F547764D144F2A1855F2E28E358C3"><enum>(b)</enum><header>Participation</header><text display-inline="yes-display-inline">Section 428(d) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189f">42 U.S.C. 5189f(d)</external-xref>) is amended—</text>

 </paragraph><paragraph id="HD0AAFB085FAA48A49DB4302F90EF1C13"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HEED2D61671FF48A29279EBBD26A1EB20" style="OLC"> <paragraph commented="no" id="HB0046F220FBE421B98D6379A8F3AB6A6"><enum>(2)</enum><header>No conditions</header><text display-inline="yes-display-inline">The President may not condition the provision of Federal assistance under this Act on the election by a State, Tribal, or local government, or owner or operator of a private nonprofit facility to participate in the alternative procedures adopted under this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="H0D2EBF1CEAE34BAD8617A420E06BA682"><enum>(c)</enum><header>Certification</header><text display-inline="yes-display-inline">Section 428(e)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189f">42 U.S.C. 5189f(e)(1)</external-xref>) is amended—</text>
 <paragraph id="H5E3FB471656D4F36909F3091DA386E22"><enum>(1)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="HCADDA98B04F5440F93561A0E409921E5"><enum>(2)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="H880DA486C3D846328D48357D15CD1E15"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H5BB82D239866425FA3167BD09D0D2905" style="OLC"> <subparagraph commented="no" id="H78F320D147AE4FB9A017D37CE4F3FC52"><enum>(G)</enum><text>once certified by a professionally licensed engineer and accepted by the Administrator, the estimates on which grants made pursuant to this section are based shall be presumed to be reasonable and eligible costs, as long as there is no evidence of fraud.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HEB0C7A1807254429B9F1ADD7B66C0E07"><enum>8.</enum><header>Prioritization of facilities</header><text display-inline="no-display-inline"><deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">Not</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">Beginning not</added-phrase> later than 180 days after the date of enactment of this Act, the Administrator shall provide guidance and training on an annual basis to State, Tribal, and local governments, first responders, and utility companies on—</text>
 <paragraph id="H86EB7019C0744D2098769B4402065176"><enum>(1)</enum><text>the need to prioritize assistance to hospitals, nursing homes, and other long-term care facilities to ensure that such health care facilities remain functioning or return to functioning as soon as practicable during power outages caused by natural hazards, including severe weather events;</text>
 </paragraph><paragraph id="H6DC2DCD501B84110A5BACA191949D849"><enum>(2)</enum><text>how hospitals, nursing homes and other long-term care facilities should adequately prepare for power outages during a major disaster or emergency (as those terms are defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)); and</text>
 </paragraph><paragraph id="H86300F8DEAD94DA9AB5446E336C7A3E6"><enum>(3)</enum><text display-inline="yes-display-inline">how State, Tribal, and local governments, first responders, utility companies, hospitals, nursing homes, and other long-term care facilities should develop a strategy to coordinate emergency response plans, including the activation of emergency response plans, in anticipation of a major disaster, including severe weather events.</text>
			</paragraph></section><section id="H3278D84F4CA14B9CA61FE504FEB44C30"><enum>9.</enum><header>Guidance on evacuation routes</header>
			<subsection id="HEF3E701A6B4F43DF9413A62315A49BD2"><enum>(a)</enum><header>In general</header>
 <paragraph id="H2F9F544D817F4D9B801803D06B2A9851"><enum>(1)</enum><header>Identification</header><text display-inline="yes-display-inline">The Administrator, in coordination with the Administrator of the Federal Highway Administration, shall develop and issue guidance for State, local, and Tribal governments regarding the identification of evacuation routes.</text>
 </paragraph><paragraph id="H0F422ECAC72D4FA69A3F7E56D00A8C2B"><enum>(2)</enum><header>Guidance</header><text display-inline="yes-display-inline">The Administrator of the Federal Highway Administration, in coordination with the Administrator, shall revise existing guidance or issue new guidance as appropriate for State, local, and Tribal governments regarding the design, construction, maintenance, and repair of evacuation routes.</text>
				</paragraph></subsection><subsection id="HA6C602B58ED64920B3268E6CA9A897C9"><enum>(b)</enum><header>Considerations</header>
 <paragraph id="H32478E48E70640D696AED387F03D6384"><enum>(1)</enum><header>Identification</header><text display-inline="yes-display-inline">In developing the guidance under subsection (a)(1), the Administrator shall consider—</text> <subparagraph id="H86EB28D56631479F987DECA7E3E3A548"><enum>(A)</enum><text>whether evacuation routes have resisted impacts and recovered quickly from disasters, regardless of cause;</text>
 </subparagraph><subparagraph id="H025C1EDF98D643C7AA129F29B0F2FD3A"><enum>(B)</enum><text>the need to evacuate special needs populations, including—</text> <clause id="H92D9384093724FBE97222BE9F1B0DF77"><enum>(i)</enum><text display-inline="yes-display-inline">individuals with a physical or mental disability;</text>
 </clause><clause id="H604DB033609D45BA943DE1F86FF23149"><enum>(ii)</enum><text>individuals in schools, daycare centers, mobile home parks, prisons, nursing homes and other long-term care facilities, and detention centers;</text>
 </clause><clause id="H9681D14A012447CEB5C372F0C7F67573"><enum>(iii)</enum><text>individuals with limited-English proficiency;</text> </clause><clause id="H7E95ED2152DE4A91BE623AAF0A214634"><enum>(iv)</enum><text>the elderly; and</text>
 </clause><clause id="H04B0F88200F84DE384D6547F0C27FEA5"><enum>(v)</enum><text>individuals who are tourists, seasonal workers, or homeless;</text> </clause></subparagraph><subparagraph id="HBF450FD658CC434DA8486A626DD8EBEA"><enum>(C)</enum><text display-inline="yes-display-inline">the sharing of information and other public communications with evacuees during evacuations;</text>
 </subparagraph><subparagraph id="HF34A21498EDE423CBFE190C894DD8184"><enum>(D)</enum><text>the sheltering of evacuees, including the care, protection, and sheltering of animals;</text> </subparagraph><subparagraph id="H364D8A941B6641519E751169EB0628A5"><enum>(E)</enum><text>the return of evacuees to their homes; and</text>
 </subparagraph><subparagraph id="HAEAA3F31534F4F5199D518B6CD9FD567"><enum>(F)</enum><text>such other items the Administrator considers appropriate.</text> </subparagraph></paragraph><paragraph id="H5578F2BC981E4C58937DC765CB858468"><enum>(2)</enum><header>Design, construction, maintenance, and repair</header><text display-inline="yes-display-inline">In revising or issuing guidance under subsection (a)(2), the Administrator of the Federal Highway Administration shall consider—</text>
 <subparagraph id="HAB30AA25D3CF4901A3F8818F6C348CAB"><enum>(A)</enum><text display-inline="yes-display-inline">methods that assist evacuation routes to—</text> <clause id="H711F940BD0A643D49A6088D85E6D2462"><enum>(i)</enum><text display-inline="yes-display-inline">withstand likely risks to viability, including flammability and hydrostatic forces;</text>
 </clause><clause id="H2A6884197CE648C4A93CF7F222EB8DE7"><enum>(ii)</enum><text>improve durability, strength (including the ability to withstand tensile stresses and compressive stresses), and sustainability; and</text>
 </clause><clause id="H6A075D6EF19F4F80A826E100D5963D54"><enum>(iii)</enum><text>provide for long-term cost savings;</text> </clause></subparagraph><subparagraph id="H0B3743B14AA946A8AF34F56150567513"><enum>(B)</enum><text display-inline="yes-display-inline">the ability of evacuation routes to effectively manage contraflow operations;</text>
 </subparagraph><subparagraph id="HC6819EBC87B843D09EA5014C5722D8BB"><enum>(C)</enum><text>for evacuation routes on public lands, the viewpoints of the applicable Federal land management agency regarding emergency operations, sustainability, and resource protection; and</text>
 </subparagraph><subparagraph id="HC3BFE6A36EB041D28EB12C022076CF4B"><enum>(D)</enum><text display-inline="yes-display-inline">such other items the Administrator of the Federal Highway Administration considers appropriate.</text> </subparagraph></paragraph></subsection><subsection changed="added" committee-id="SSGA00" id="id2B04BE1230A54D418B2722B7FC7DD74B" reported-display-style="italic"><enum>(c)</enum><header>Study</header><text>The Administrator, in coordination with the Administrator of the Federal Highway Administration and State, local, territorial, and Tribal governments, may—</text>
 <paragraph id="id067B9CC132A943F0A0EDBF56B06F082D"><enum>(1)</enum><text>conduct a study of the adequacy of available evacuation routes to accommodate the flow of evacuees; and</text>
 </paragraph><paragraph id="id841093794FF24D169672FEFE4D3F6D8D"><enum>(2)</enum><text>submit recommendations on how to help with anticipated evacuation route flow, based on the study conducted under paragraph (1), to—</text>
 <subparagraph id="idBFECFDA78C3843E69A16D1243CC103B6"><enum>(A)</enum><text>the Federal Highway Administration;</text> </subparagraph><subparagraph id="id1C40C1DE2EF546689557560E366C7227"><enum>(B)</enum><text>the Agency;</text>
 </subparagraph><subparagraph id="idADC88F865D714DDFA4011588C8520A15"><enum>(C)</enum><text>State, local, territorial, and Tribal governments; and</text> </subparagraph><subparagraph id="idB79334D897454188B1F5BB4DA021946B"><enum>(D)</enum><text>Congress.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" id="H4889E53C0ACD4B6BBAAD8A481E853D00" section-type="subsequent-section"><enum>10.</enum><header>Duplication of benefits</header>
 <subsection commented="no" id="H686DF29C9961451CB002C9219D760066"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 312(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5155">42 U.S.C. 5155(b)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9E18A820B22D4F8FA377E8FBF17AF445" style="OLC">
					<paragraph commented="no" id="H7F5668EFB28343A99A779C689F650656"><enum>(4)</enum><header>Waiver of general prohibition</header>
 <subparagraph commented="no" id="H8BB37E0FA38E4799897C4298A0646D76"><enum>(A)</enum><header>In general</header><text>The President may waive the general prohibition provided in subsection (a) upon request of a Governor on behalf of the State or on behalf of a person, business concern, or any other entity suffering losses as a result of a major disaster or emergency, if the President finds such waiver is in the public interest and will not result in waste, fraud, or abuse. In making this decision, the President may consider the following:</text>
 <clause commented="no" id="HAE8E53B9E50441CE891CFB53F6AD0ED9"><enum>(i)</enum><text>The recommendations of the Administrator of the Federal Emergency Management Agency made in consultation with the Federal agency or agencies administering the duplicative program.</text>
 </clause><clause commented="no" id="H4A2E39DEAD94486390858DEA24F27032"><enum>(ii)</enum><text>If a waiver is granted, the assistance to be funded is cost effective.</text> </clause><clause commented="no" id="HEFA9B621984F49BA8C19D0ECD79DF8AB"><enum>(iii)</enum><text>Equity and good conscience.</text>
 </clause><clause commented="no" id="H19D29DEB931C45168A5C4CE6AFF36977"><enum>(iv)</enum><text>Other matters of public policy considered appropriate by the President.</text> </clause></subparagraph><subparagraph commented="no" id="H1268CEB425DD4535AD11873E6D6BD3C3"><enum>(B)</enum><header>Grant or denial of waiver</header><text>A request under subparagraph (A) shall be granted or denied not later than 45 days after submission of such request.<added-phrase committee-id="SSGA00" reported-display-style="italic">”.</added-phrase></text>
 </subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSGA00" id="H8223183E07924EC3AFF7813F29FCEA44" reported-display-style="strikethrough"><enum>(C)</enum><header>Prohibition on determination that loan is a duplication</header><text>Notwithstanding subsection (c), in carrying out subparagraph (A), the President may not determine that a loan is a duplication of assistance, provided that all Federal assistance is used toward a loss suffered as a result of the major disaster or emergency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection changed="added" commented="no" committee-id="SSGA00" display-inline="no-display-inline" id="id80e1f811316a473a970c7e881f5ee822" reported-display-style="italic"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to any major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) on or after the date of enactment of this Act.</text>
 </subsection></section><section id="H77335D3618854178AD685CABCA75B505"><enum>11.</enum><header>State administration of assistance for direct temporary housing and permanent housing construction</header><text display-inline="no-display-inline">Section 408(f) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(f)</external-xref>) is amended—</text>
 <paragraph id="H31C06F758B654139B1317E6DA7D67693"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="id85507AD5002345629016C27FE06AB539"><enum>(A)</enum><text>by striking the paragraph heading and inserting <quote><header-in-text level="paragraph" style="OLC">State- or Tribal-administered assistance and other needs assistance</header-in-text>.—</quote>;</text>
 </subparagraph><subparagraph id="H93F94460F78F42E3B1F4039CBEF948B9"><enum>(B)</enum><text>in subparagraph (A)—</text> <clause id="H189EE976D14247C082E08577E802AC78"><enum>(i)</enum><text>by striking <quote>financial</quote>; and</text>
 </clause><clause id="H286652675D3E438DB9BB785842081349"><enum>(ii)</enum><text>by striking <quote>subsection (e)</quote> and inserting <quote>subsections (c)(1)(B), (c)(4), and (e) if the President and the State or Tribal government comply, as determined by the Administrator, with paragraph (3)</quote>; and</text>
 </clause></subparagraph><subparagraph id="HB254BD4B57314F1FB568A869E17FA86D"><enum>(C)</enum><text>in subparagraph (B)—</text> <clause id="H3F37A2C5EB21463A8C1A460B7A0F1663"><enum>(i)</enum><text>by striking <quote>financial</quote>; and</text>
 </clause><clause id="H2BAA8EC7A2B84877BA5A49E23779922B"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>subsection (e)</quote> and inserting <quote>subsections (c)(1)(B), (c)(4), and (e)</quote>; and</text> </clause></subparagraph></paragraph><paragraph id="H163C8FF74DD4421A90B4FB4A7AD6B565"><enum>(2)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB08F805209AA4FD1BC431898DBBFD306" style="OLC">
					<paragraph id="HBCB0C4797F9D42F6BD5EFC39097A8C38"><enum>(3)</enum><header>Requirements</header>
 <subparagraph id="HC32126B2678843988AD34DEA507B909E"><enum>(A)</enum><header>Application</header><text display-inline="yes-display-inline">A State or Tribal government desiring to provide assistance under subsection (c)(1)(B), (c)(4), or (e) shall submit to the President an application for a grant to provide financial assistance under the program.</text>
 </subparagraph><subparagraph id="H0684218B3AA843CAB51BD14DB3828454"><enum>(B)</enum><header>Criteria</header><text display-inline="yes-display-inline">The President, in consultation and coordination with State<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">,</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">and</added-phrase> Tribal<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">, and local</deleted-phrase> governments, shall establish criteria for the approval of applications submitted under subparagraph (A). The criteria shall include, at a minimum—</text>
 <clause id="H7588D434321A40CFB70543DAF0AC2316"><enum>(i)</enum><text display-inline="yes-display-inline">a requirement that the State or Tribal government submit a housing strategy under subparagraph (C);</text> </clause><clause id="id9FAECB88C6894AA190AE95F0968F5459"><enum>(ii)</enum><text display-inline="yes-display-inline">the demonstrated ability of the State or Tribal government to manage the program under this section;</text>
 </clause><clause id="H4B78B1D1E89741B8A1197A519CBD7DA2"><enum>(iii)</enum><text>there being in effect a plan approved by the President as to how the State or Tribal government will comply with applicable Federal laws and regulations and how the State or Tribal government will provide assistance under its plan;</text>
 </clause><clause id="H6E8DE7E7B9254E658601A481EC4E3BA6"><enum>(iv)</enum><text>a requirement that the State<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">,</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">or</added-phrase> Tribal<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">, or local</deleted-phrase> government comply with rules and regulations established pursuant to subsection (j); and</text>
 </clause><clause id="HB93DC4B9623043CBB3FCB6F872DAFCB4"><enum>(v)</enum><text>a requirement that the President, or the designee of the President, comply with subsection (i).</text> </clause></subparagraph><subparagraph id="id76BA0B6686FD4F78B8661F665B8DD897"><enum>(C)</enum><header>Requirement of housing strategy</header> <clause id="id4E3B1FD717E24B30AA1D543E9C2EE556"><enum>(i)</enum><header>In general</header><text>A State or Tribal government submitting an application under this paragraph shall have an approved housing strategy, which shall be developed and submitted to the President for approval.</text>
 </clause><clause id="id1383E8C811FB4AB89C7E46119EADD1C9"><enum>(ii)</enum><header>Requirements</header><text>The housing strategy required under clause (i) shall—</text> <subclause id="id4F89565747D34DA6A13C149BCB6C3E3A"><enum>(I)</enum><text>outline the approach of the State in working with Federal partners, Tribal governments, local communities, nongovernmental organizations, and individual disaster survivors to meet disaster-related sheltering and housing needs; and</text>
 </subclause><subclause id="id8174f43cd68e45999452a81ff7a04da3"><enum>(II)</enum><text>include the establishment of an activation plan for a State Disaster Housing Task Force, as outlined in the National Disaster Housing Strategy, to bring together State, Tribal, local, Federal, nongovernmental, and private sector expertise to evaluate housing requirements, consider potential solutions, recognize special needs populations, and propose recommendations.</text>
 </subclause></clause></subparagraph><subparagraph id="HE149D289C962477293724D80D5773B50"><enum>(D)</enum><header>Quality assurance</header><text display-inline="yes-display-inline">Before approving an application submitted under this section, the President, or the designee of the President, shall institute adequate policies, procedures, and internal controls to prevent waste, fraud, abuse, and program mismanagement for this program and for programs under subsections (c)(1)(B), (c)(4), and (e). The President shall monitor and conduct quality assurance activities on a State or Tribal government’s implementation of programs under subsections (c)(1)(B), (c)(4), and (e). If, after approving an application of a State or Tribal government submitted under this paragraph, the President determines that the State or Tribal government is not administering the program established by this section in a manner satisfactory to the President, the President shall withdraw the approval.</text>
 </subparagraph><subparagraph id="H0B7A681454B54AE7AE139116A56E0E0F"><enum>(E)</enum><header>Audits</header><text display-inline="yes-display-inline">The Inspector General of the Department of Homeland Security shall provide for periodic audits of the programs administered by States and Tribal governments under this subsection.</text>
 </subparagraph><subparagraph id="HB154DEE6EB2F4336B3F6E2EAEB274BE9"><enum>(F)</enum><header>Applicable laws</header><text display-inline="yes-display-inline">All Federal laws applicable to the management, administration, or contracting of the programs by the Federal Emergency Management Agency under this section shall be applicable to the management, administration, or contracting by a non-Federal entity under this section.</text>
 </subparagraph><subparagraph id="HEBA1FEBC22E94C0AB10B26A76B2C1D12"><enum>(G)</enum><header>Report on effectiveness</header><text>Not later than 18 months after the date of enactment of this paragraph, the Inspector General of the Department of Homeland Security shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the State or Tribal government’s role to provide assistance under this section. The report shall contain an assessment of the effectiveness of the State or Tribal government’s role <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">to provide</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">in providing</added-phrase> assistance under this section, including—</text>
 <clause id="HE3D40B6ED40644C18933736C11AD2B12"><enum>(i)</enum><text display-inline="yes-display-inline">whether the State or Tribal government’s role helped to improve the general speed of disaster recovery;</text>
 </clause><clause id="H19A629D8C70B48489D25F64D3C726D76"><enum>(ii)</enum><text display-inline="yes-display-inline">whether the State or Tribal government providing assistance under this section had the capacity to administer this section; and</text>
 </clause><clause id="H2FE31422E98D4F62B08C2EDFF9DFC809"><enum>(iii)</enum><text display-inline="yes-display-inline">recommendations for changes to improve the program if the State or Tribal government’s role to administer the programs should be continued.</text>
 </clause></subparagraph><subparagraph id="idC315223DD7854E8CA7FE0A5E127C352A"><enum>(H)</enum><header>Report on incentives</header><text>Not later than 12 months after the date of enactment of this paragraph, the Administrator of the Federal Emergency Management Agency shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on a proposed incentive structure for awards made under this section to encourage participation by eligible States <added-phrase committee-id="SSGA00" reported-display-style="italic">and Tribal governments</added-phrase> and to potentially add cost-share requirements that are reasonable to support increased <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">State</deleted-phrase> management <added-phrase committee-id="SSGA00" reported-display-style="italic">by States and Tribal governments</added-phrase> according to this section.</text>
 </subparagraph><subparagraph id="HD147EBA54728417A863164BB1EF2BDD7"><enum>(I)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The President may not condition the provision of Federal assistance under this Act <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">by</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">on</added-phrase> a State or Tribal government requesting a grant under this section.</text>
						</subparagraph><subparagraph id="H830CB11253624284B11639DD5738A793"><enum>(J)</enum><header>Miscellaneous</header>
 <clause id="HCF0030D7066F47059C49DD4C2E5CB4EC"><enum>(i)</enum><header>Notice and comment</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency may waive notice and comment rulemaking <added-phrase committee-id="SSGA00" reported-display-style="italic">with respect to rules to carry out this section</added-phrase>, if the Administrator determines doing so is necessary to expeditiously implement this section, and may carry out this section as a pilot program until such regulations are promulgated.</text>
 </clause><clause id="H0ADF994C01EF4C1AA89C2271045206C0"><enum>(ii)</enum><header>Final Rule</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this paragraph, the Administrator of the Federal Emergency Management Agency shall issue final regulations to implement this subsection as amended by the <short-title>Disaster Recovery Reform Act of 2018</short-title>.</text>
 </clause><clause id="H1EDBBFEDBB15430189435DCD265B7834"><enum>(iii)</enum><header>Waiver and expiration</header><text>The authority under clause (i) and any pilot program implemented pursuant to such clause shall expire 2 years after the date of enactment of this paragraph or upon issuance of final regulations pursuant to clause (ii), whichever occurs sooner.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H446100A0FC2E42A7829300F054DA5025"><enum>12.</enum><header>Assistance to individuals and households</header>
 <subsection changed="not-changed" commented="no" id="idB8F891497665401084A90A4383846B39"><enum><added-phrase committee-id="SSGA00" reported-display-style="italic">(a)</added-phrase></enum><header><added-phrase committee-id="SSGA00" reported-display-style="italic">In general</added-phrase></header><text display-inline="yes-display-inline">Section 408(h) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(h)</external-xref>) is amended—</text>
 <paragraph id="H26763F654C804438BE995C5E50D19843"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>, excluding financial assistance to rent alternate housing accommodations under subsection (c)(1)(A)(i) and financial assistance to address other needs under subsection (e)</quote> after <quote>disaster</quote>;</text>
 </paragraph><paragraph id="HB106BD67C1FC49BFA6EAAB4F32AA8B4C"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3);</text> </paragraph><paragraph id="H909FFFBEA045497EA64D5AD1693CF82C"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text>

 </subparagraph><subparagraph id="H31D6AF2083864C49B66F12E91B3EBC8D"><enum>(B)</enum><header>Other needs assistance</header><text>The maximum amount of assistance established under paragraph (2) shall exclude expenses to repair or replace accessibility-related personal property under subsection (e)(2) for individuals with disabilities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection changed="added" committee-id="SSGA00" id="idEF8A18D3DC1B4D4590EA05D378F05F26" reported-display-style="italic"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply to any major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) on or after the date of enactment of this Act.</text>
			</subsection></section><section id="H7FC13216CB554379B92DB2D1F874FF4E"><enum>13.</enum><header>Multifamily lease and repair assistance</header>
 <subsection id="H2C8490BBC6134CBBB3210B666FD9FD31"><enum>(a)</enum><header>Lease and repair of rental units for temporary housing</header><text display-inline="yes-display-inline">Section 408(c)(1)(B)(ii)(II) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(c)(1)(B)(ii)(II)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H75AB1B84BB914B5482C59A57D8E65A96" style="OLC">
 <subclause id="H1CA78E064B574BA28548DE4631689BEB"><enum>(II)</enum><header>Improvements or repairs</header><text>Under the terms of any lease agreement for property entered into under this subsection, the value of the improvements or repairs shall be deducted from the value of the lease agreement.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H72224A7D5BDA44DABE7731A27E1407F9"><enum>(b)</enum><header>Rental properties impacted</header><text>Section 408(c)(1)(B)(ii)(I)(aa) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5174(c)(1)(B)(ii)(I)(aa)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HEAFAA4F1998C4725A675D749E8A3BD3A" style="OLC">
 <item id="H2FCF8A487A624BB3BFB17A61F8C89551"><enum>(aa)</enum><text>enter into lease agreements with owners of multifamily rental property impacted by a major disaster or located in areas covered by a major disaster declaration to house individuals and households eligible for assistance under this section; and</text></item><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H801A641BD48D4DAB8633384E180EA0DD"><enum>(c)</enum><header>Inspector general report</header><text>Not later than 2 years after the date of <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">the</deleted-phrase> enactment of this Act, the Inspector General of the Department of Homeland Security shall—</text>
 <paragraph id="idD5A91C6F6F4447C498548088397AA595"><enum>(1)</enum><text>assess the use of the authority provided under section 408(c)(1)(B) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(c)(1)(B)</external-xref>), as amended by this Act, including the adequacy of any benefit-cost analysis done to justify the use of this alternative; and</text>
 </paragraph><paragraph id="id489F5C252284446FA15C7B4E2C7D63DA"><enum>(2)</enum><text>submit a report on the results of the assessment conducted under paragraph (1) to the appropriate committees of Congress.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="HAF760C2C328E41CA853D8A533FEC0A32" section-type="subsequent-section"><enum>14.</enum><header>Private nonprofit facility</header>
 <subsection commented="no" display-inline="no-display-inline" id="idC06B27CED9F8498FBFCA70154742392B"><enum><added-phrase committee-id="SSGA00" reported-display-style="italic">(a)</added-phrase></enum><header><added-phrase committee-id="SSGA00" reported-display-style="italic">In general</added-phrase></header><text display-inline="yes-display-inline">Section 102(11)(B) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122(11)(B)</external-xref>) is amended by inserting <quote>food banks,</quote> after <quote>shelter workshops,</quote>.</text>
 </subsection><subsection changed="added" committee-id="SSGA00" id="id2D6F10E6B48A48E792E1EE9B959748EA" reported-display-style="italic"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to any major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) on or after February 9, 2018.</text>
 </subsection></section><section id="HB66B7AA5616E4A57846B3BC67501CC66"><enum>15.</enum><header>Management costs</header><text display-inline="no-display-inline">Section 324 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5165b">42 U.S.C. 5165b</external-xref>) is amended—</text>
 <paragraph id="H5D809C3D1CDA4C12901119B66DB29E6F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>any administrative expense, and any other expense not directly chargeable to</quote> and inserting <quote><added-phrase committee-id="SSGA00" reported-display-style="italic">any</added-phrase> direct administrative cost, and any other administrative expense associated with</quote>; and</text> </paragraph><paragraph id="H7A57B798A3C049AAB2BD446746B918C5"><enum>(2)</enum><text>in subsection (b)—</text>

 <paragraph id="H3BCFE8F251594348966E646F746ECEDA"><enum>(2)</enum><header>Specific Management Costs</header><text display-inline="yes-display-inline">The Administrator of Federal Emergency Management Agency shall provide the following percentage rates, in addition to the eligible project costs, to cover direct and indirect costs of administering the following programs:</text>
 <subparagraph id="H0E297D3CBE084ED393713FCF9BC076CE"><enum>(A)</enum><header>Hazard mitigation</header><text display-inline="yes-display-inline">A grantee under section 404 may be reimbursed not more than 15 percent of the total amount of the grant award under such section of which not more than 10 percent may be used by the grantee and 5 percent by the subgrantee for such costs.</text>
 </subparagraph><subparagraph id="H64222664A0F54F0F828457A67C8DB456"><enum>(B)</enum><header>Public Assistance</header><text display-inline="yes-display-inline">A grantee under sections 403, 406, 407, and 502 may be reimbursed not more than 12 percent of the total award amount under such sections, of which not more than 7 percent may be used by the grantee and 5 percent by the subgrantee for such costs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="H19FBCDD209DF41D5BD3D1CABF388396A"><enum>16.</enum><header>Flexibility</header>
			<subsection id="HAC96F72C83544FA09EA68EEA2BD7DD5B"><enum>(a)</enum><header>Waiver authority</header>
 <paragraph id="H0F34C11FC5E447D2A16A3A09C551F396"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>covered assistance</term> means assistance provided—</text> <subparagraph id="H73611FEFD8304D0795379E34086847E5"><enum>(A)</enum><text>under section 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3D6E20D103854EC0B1CDD035E26D3A52"><enum>(B)</enum><text>in relation to a major disaster or emergency declared by the President under section 401 or 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) on or after October 28, 2012.</text>
 </subparagraph></paragraph><paragraph id="id03CD5E57E1F448B99F547227D9C65B51"><enum>(2)</enum><header>Authority</header><text>Notwithstanding section 3716(e) of title 31, United States Code, the Administrator—</text> <subparagraph id="HDDDF4F26917245C98C194A05B8835CC5"><enum>(A)</enum><text>subject to subparagraph (B), may waive a debt owed to the United States related to covered assistance provided to an individual or household if—</text>
 <clause id="H527C5192E93C43048316F5752209C966"><enum>(i)</enum><text>the covered assistance was distributed based on an error by the Agency;</text> </clause><clause id="H859044BE87514C5E9B8B69977F48E284"><enum>(ii)</enum><text>there was no fault on behalf of the debtor; and</text>
 </clause><clause id="H8147A631CE9A4BE2875A8AF0C062CCD2"><enum>(iii)</enum><text>the collection of the debt would be against equity and good conscience; and</text> </clause></subparagraph><subparagraph id="HE5E93E40B1D44BAF86FE8391A436FA57"><enum>(B)</enum><text>may not waive a debt under subparagraph (A) if the debt involves fraud, the presentation of a false claim, or misrepresentation by the debtor or any party having an interest in the claim.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H2A54D426BA364B67924AB3AE8282E103"><enum>(3)</enum><header>Monitoring of covered assistance distributed based on error</header>
 <subparagraph id="HD404838BF07B4D3BA9EA71E07238A03F"><enum>(A)</enum><header>In general</header><text>The Inspector General of the Department of Homeland Security shall monitor the distribution of covered assistance to individuals and households to determine the percentage of such assistance distributed based on an error.</text>
 </subparagraph><subparagraph id="H2A1C83A4838042ADB6F41378E3B629EA"><enum>(B)</enum><header>Removal of waiver authority based on excessive error rate</header><text>If the Inspector General of the Department of Homeland Security determines, with respect to any 12-month period, that the amount of covered assistance distributed based on an error by the Agency exceeds 4 percent of the total amount of covered assistance distributed—</text>
 <clause id="HF08BEB1F2014416BACCFE9E80227A43C"><enum>(i)</enum><text>the Inspector General shall notify the Administrator and publish the determination in the Federal Register; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HDD8B9D3AE42F4B8A99A9D108C5EF8901"><enum>(ii)</enum><text>with respect to any major disaster or emergency declared by the President under section 401 or section 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>) after the date on which the determination is published under subparagraph (A), the authority of the Administrator to waive debt under paragraph (2) shall no longer be effective.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="id350CF39946844BEEA10F8F227FD64C8F"><enum>(b)</enum><header>Recoupment of certain assistance prohibited</header>
 <paragraph id="idA97B97CDA8A04E38AC1E76219B4004E7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 3716(e) of title 31, United States Code, and unless there is evidence of civil or criminal fraud, the Agency may not take any action to recoup covered assistance from the recipient of such assistance if the receipt of such assistance occurred on a date that is more than 3 years before the date on which the Agency first provides to the recipient written notification of an intent to recoup.</text>
 </paragraph><paragraph id="idB45F83E1FECD470B87CE3FF994DF8188"><enum>(2)</enum><header>Covered assistance defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered assistance</term> means assistance provided—</text> <subparagraph id="id13CBA45051C546CA81E78AB81261C374"><enum>(A)</enum><text>under section 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD2028C31A5FE4F7992553B53101F8031"><enum>(B)</enum><text>in relation to a major disaster or emergency declared by the President under section 401 or 501 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>) on or after January 1, 2012.</text>
					</subparagraph></paragraph></subsection><subsection id="HBEA8B3A2034647108C92E04505F1EAB5"><enum>(c)</enum><header> Statute of limitations</header>
 <paragraph id="H36EB08936D524DB58873666E47E98801"><enum>(1)</enum><header>In general</header><text>Section 705 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5205">42 U.S.C. 5205</external-xref>) is amended—</text>
 <subparagraph id="H1B14DE3EDD9845BA868E7FF9E3313119"><enum>(A)</enum><text>in subsection (a)(1)—</text> <clause id="HE39647CD7A4A40D6A497299640668D75"><enum>(i)</enum><text>by striking <quote>Except</quote> and inserting <quote>Notwithstanding section 3716(e) of title 31, United States Code, and except</quote>; and</text>
 </clause><clause id="H68BC29A428F740D7BC3F4BB4E1976B4C"><enum>(ii)</enum><text>by striking <quote>report for the disaster or emergency</quote> and inserting <quote>report for project completion as certified by the grantee</quote>; and</text> </clause></subparagraph><subparagraph id="H57EB2BDF7DA948329B6147C9A11F5CD8"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
 <clause id="H25F6C91A237A4E258CECFAA5DF2040B4"><enum>(i)</enum><text>in paragraph (1) by striking <quote>report for the disaster or emergency</quote> and inserting <quote>report for project completion as certified by the grantee</quote>; and</text> </clause><clause id="HDBA074B3752E4956BED0CF07B7F308D1"><enum>(ii)</enum><text>in paragraph (3) by inserting <quote>for project completion as certified by the grantee</quote> after <quote>final expenditure report</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="HC87806BA14744DC1A10ACD2F8648939B"><enum>(2)</enum><header>Applicability</header>
 <subparagraph id="HE245E25AC3AC4C2E9A47DAD05597049F"><enum>(A)</enum><header>In general</header><text>With respect to disaster or emergency assistance provided to a State or local government on or after January 1, 2004—</text>
 <clause id="HFF850651F5244538B4A92ADEAA8CC4EA"><enum>(i)</enum><text>no administrative action may be taken to recover a payment of such assistance after the date of enactment of this Act if the action is prohibited under section 705(a)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5205">42 U.S.C. 5205(a)(1)</external-xref>), as amended by paragraph (1); and</text>
 </clause><clause id="H3181E54AD90F4E94A411264D95A08356"><enum>(ii)</enum><text>any administrative action to recover a payment of such assistance that is pending on such date of enactment shall be terminated if the action is prohibited under section 705(a)(1) of that Act, as amended by paragraph (1).</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB8B31CDF78FB421EAF46A3E968874D6D"><enum>(B)</enum><header>Limitation</header><text>This section, including the amendments made by this section, may not be construed to invalidate or otherwise affect any administration action completed before the date of enactment of this Act.</text>
					</subparagraph></paragraph></subsection></section><section id="HE616368B6FD64848BB959EC5F03E8AC8"><enum>17.</enum><header>Additional disaster assistance</header>
 <subsection id="H5153F282FD1B40C4AD17D50180F44FBB"><enum>(a)</enum><header>Disaster mitigation</header><text display-inline="yes-display-inline">Section 209 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3149">42 U.S.C. 3149</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H898D084CAEA3481DB2F6982FA03D9391" style="OLC">
 <subsection id="HB82EB7D606AE4925BD1C17A36D8F48B4"><enum>(e)</enum><header>Disaster mitigation</header><text display-inline="yes-display-inline">In providing assistance pursuant to subsection (c)(2), if appropriate and as applicable, the Secretary may encourage hazard mitigation in assistance provided pursuant to such subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H0E1031C899684B7684F2006326786426"><enum>(b)</enum><header>Emergency management assistance compact grants</header><text>Section 661(d) of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/761">6 U.S.C. 761(d)</external-xref>) is amended by striking <quote>for fiscal year 2008</quote> and inserting <quote>for each of fiscal years 2018 through 2022</quote>.</text>
 </subsection><subsection commented="no" id="HD729BF0271F3441D975FBEC347FBEE15"><enum>(c)</enum><header>Emergency management performance grants program</header><text>Section 662(f) of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/762">6 U.S.C. 762(f)</external-xref>) is amended by striking <quote>the program</quote> and all that follows through <quote>2012</quote> and inserting <quote>the program, for each of fiscal years 2018 through 2022</quote>.</text>
 </subsection><subsection id="HFB62264738B4452CAF5C69854AC39805"><enum>(d)</enum><header>Technical amendment</header><text>Section 403(a)(3) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b(a)(3)</external-xref>) is amended by striking the second subparagraph (J).</text>
			</subsection></section><section id="H69A2C57D1002485AAB4969305F0AC23B"><enum>18.</enum><header>National veterinary emergency teams</header>
 <subsection id="H392992F42D3B4A28B39F49B37857FBCB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may establish one or more national veterinary emergency teams at accredited colleges of veterinary medicine.</text>
 </subsection><subsection id="HA226D235D48A4A2EB96046C26FA24EA7"><enum>(b)</enum><header>Responsibilities</header><text>A national veterinary emergency team shall—</text> <paragraph id="H8505794BDD5B45A59D49C724B411B9D5"><enum>(1)</enum><text>deploy with a team of the National Urban Search and Rescue Response System to assist with—</text>
 <subparagraph id="HF646C308C4144661AB85B26DD56F762F"><enum>(A)</enum><text>veterinary care of canine search teams;</text> </subparagraph><subparagraph id="HA089361F77564F3AAED6F213C3FD6926"><enum>(B)</enum><text>locating and treating companion animals, service animals, livestock, and other animals; and</text>
 </subparagraph><subparagraph id="H017B18072206420E8916F786621B14A3"><enum>(C)</enum><text>surveillance and treatment of zoonotic diseases;</text> </subparagraph></paragraph><paragraph id="H201772E9E1014627A6239AE008D45CD1"><enum>(2)</enum><text>recruit, train, and certify veterinary professionals, including veterinary students, in accordance with an established set of plans and standard operating guidelines to carry out the duties associated with planning for and responding to emergencies <added-phrase committee-id="SSGA00" reported-display-style="italic">and major disasters</added-phrase> as described in paragraph (1);</text>
 </paragraph><paragraph id="H19CED44F425149899CCAF52D7783980B"><enum>(3)</enum><text>assist State, Tribal, and local governments and nonprofit organizations in developing emergency management and evacuation plans that account for the care and rescue of animals and in improving local readiness for providing veterinary medical response during <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">a disaster</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">an emergency or major disaster</added-phrase>; and</text>
 </paragraph><paragraph id="H9AAC9A1D40B34C4B99172A2A4074757D"><enum>(4)</enum><text>coordinate with the Department of Homeland Security, the Department of Health and Human Services, the Department of Agriculture, State, Tribal, and local governments (including departments of animal and human health), veterinary and health care professionals, and volunteers.</text>
				</paragraph></subsection></section><section id="idb5890b8649494ee0a1fda70d2a8f0d39"><enum>19.</enum><header>Right of arbitration</header>
 <subsection commented="no" id="idBB5DA6D85C77405F907AE51EFE22136C"><enum><added-phrase committee-id="SSGA00" reported-display-style="italic">(a)</added-phrase></enum><header><added-phrase committee-id="SSGA00" reported-display-style="italic">In general</added-phrase></header><text display-inline="yes-display-inline">Section 423 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189a">42 U.S.C. 5189a</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id033d62080ebb4cd7b7cf495f95d6cc8f" style="OLC">
					<subsection id="idf039d8dcb65b4c1981abdd12e03363df"><enum>(d)</enum><header>Right of arbitration</header>
 <paragraph id="idac534884c810490190b6dc472c18bc8b"><enum>(1)</enum><header>In general</header><text>Notwithstanding <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">this section</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">subsections (a), (b), and (c)</added-phrase>, an applicant for assistance under this title may request arbitration to dispute the eligibility for assistance or repayment of assistance provided for a dispute of more than $500,000. Such arbitration shall be conducted <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">de novo</deleted-phrase> by the Civilian Board of Contract Appeals and the decision of such Board shall be binding.</text>
 </paragraph><paragraph changed="deleted" committee-id="SSGA00" id="id781e2ae9696c480bb6ff470d8744b1a7" reported-display-style="strikethrough"><enum>(2)</enum><header>Eligibility</header><text>To participate in arbitration under this subsection, an applicant—</text> <subparagraph id="id323c3b01ee814ba782ce9c0bdd8f9a6c"><enum>(A)</enum><text>shall submit the dispute to the arbitration process established under the authority granted under section 601 of division A of <external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref> (123 Stat. 115); and</text>
 </subparagraph><subparagraph id="id45e9a0ff118c4d80bb6080d97424164c"><enum>(B)</enum><text>may submit a request for arbitration after the completion of the first appeal under subsection (a) at any time before the Administrator of the Federal Emergency Management Agency has issued a final agency determination.</text>
 </subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="id8203ADF04615403EB304CDA67BF5FC3A" reported-display-style="italic"><enum>(2)</enum><header>Eligibility</header><text>To participate in arbitration under this subsection, an applicant may submit a request for arbitration after the completion of the first appeal under subsection (a) at any time before the Administrator of the Federal Emergency Management Agency has issued a final agency determination.</text>
 </paragraph><paragraph id="id4D8783B1E25E448DA08B2DC5EBE7B415"><enum>(3)</enum><header>Limitation of appeal</header><text>Upon the submission of a request for arbitration, an applicant shall forfeit all rights to further appeal.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection changed="added" committee-id="SSGA00" id="id680B590A2BD24414B210110433BCB2F5" reported-display-style="italic"><enum>(b)</enum><header>Regulations</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall issue regulations to implement the amendment made by this section.</text>
			</subsection></section><section id="HC23AEE09DBBC424FA13ED57A9D263284"><enum>20.</enum><header>Unified Federal environmental and historic preservation review</header>
 <subsection id="H1D9095E9AB6A4A008D9DC7A649F8CEB7"><enum>(a)</enum><header>Review and analysis</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall review the Unified Federal Environmental and Historic Preservation review process established pursuant to section 429 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189g">42 U.S.C. 5189g</external-xref>), and submit a report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate that includes the following:</text>
 <paragraph id="H8CF0607B10C04E418CA3180661161856"><enum>(1)</enum><text>An analysis of whether and how the unified process has expedited the interagency review process to ensure compliance with the environmental and historic requirements under Federal law relating to disaster recovery projects.</text>
 </paragraph><paragraph id="H37548B73A9F544B2B3609EABF848B5DE"><enum>(2)</enum><text display-inline="yes-display-inline">A survey and analysis of categorical exclusions used by other Federal agencies that may be applicable to any activity related to a major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191).</text>
 </paragraph><paragraph id="H7DBA4D5E2E184D47946C585896FB77E7"><enum>(3)</enum><text>Recommendations on any further actions, including any legislative proposals, needed to expedite and streamline the review process.</text>
 </paragraph></subsection><subsection id="H106EAA9440944C78A987A0AE5D039930"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">After completing the review, survey, and analyses under subsection (a), but not later than 2 years after the date of enactment of this Act, and after providing notice and opportunity for public comment, the Administrator shall issue regulations to implement any regulatory recommendations, including any categorical exclusions identified under subsection (a), to the extent that the categorical exclusions meet the criteria for a categorical exclusion under section 1508.4 of title 40, Code of Federal Regulations, and section II of DHS Instruction Manual 023–01–001–01.</text>
			</subsection></section><section id="HAA42425F7E69426BB1FEC0272C356855"><enum>21.</enum><header>Closeout incentives</header>
 <subsection id="H64912ED2599E4E2693CAFD9D96F2D685"><enum>(a)</enum><header>Facilitating closeout</header><text display-inline="yes-display-inline">Section 705 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5205">42 U.S.C. 5205</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block id="HDA51C1A8CC9A4A1A8A166C1D0118C4B3" style="OLC">
					<subsection id="HD11E52A0BFAB4BA58AE839559AABFD2C"><enum>(d)</enum><header>Facilitating closeout</header>
 <paragraph id="H0EE0D0945E2442EB9E71EA1339F6F75A"><enum>(1)</enum><header>Incentives</header><text>The Administrator of the Federal Emergency Management Agency may develop incentives and penalties that encourage State, Tribal, or local governments to close out expenditures and activities on a timely basis related to disaster or emergency assistance.</text>
 </paragraph><paragraph id="H206A03FACA744C119EE2F7AD4F05D17B"><enum>(2)</enum><header>Agency requirements</header><text display-inline="yes-display-inline">The Federal Emergency Management Agency shall, consistent with applicable regulations and required procedures, meet its responsibilities to improve closeout practices and reduce the time to close disaster program awards.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H3157CF7D5DA04D4092A0DAE78E832309"><enum>(b)</enum><header>Regulations</header><text>The Administrator shall issue regulations to implement the amendment<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">s</deleted-phrase> made by this section.</text> </subsection></section><section id="H19DBEF4006B9421EA3DEF086A6F81DEB"><enum>22.</enum><header>Performance of services</header><text display-inline="no-display-inline">Section 306 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5149">42 U.S.C. 5149</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H853E2F555B2347C69976268E776EB965" style="OLC">
 <subsection id="H40EF7247E9AF4082849C2FCB6A91A204"><enum>(c)</enum><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency is authorized to appoint temporary personnel, after serving continuously for 3 years, to positions in the Federal Emergency Management Agency in the same manner that competitive service employees with competitive status are considered for transfer, reassignment, or promotion to such positions. An individual appointed under this subsection shall become a career-conditional employee, unless the employee has already completed the service requirements for career tenure.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H34067453B19E472ABDF396E6BD27957A"><enum>23.</enum><header>Study to streamline and consolidate information collection</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall—</text> <paragraph id="H421AA9088B0A429CAA9CA29D705D767E"><enum>(1)</enum><text>in coordination with the Small Business Administration, the Department of Housing and Urban Development, the Disaster Assistance Working Group of the Council of the Inspectors General on Integrity and Efficiency, and other appropriate agencies, conduct a study and develop a plan, consistent with law, under which the collection of information from disaster assistance applicants and grantees will be modified, streamlined, expedited, efficient, flexible, consolidated, and simplified to be less burdensome, duplicative, and time consuming for applicants and grantees;</text>
 </paragraph><paragraph id="H0334868391564C748CAA5536FF04EA4B"><enum>(2)</enum><text display-inline="yes-display-inline">in coordination with the Small Business Administration, the Department of Housing and Urban Development, the Disaster Assistance Working Group of the Council of the Inspectors General on Integrity and Efficiency, and other appropriate agencies, develop a plan for the regular collection and reporting of information on Federal disaster assistance awarded, including the establishment and maintenance of a website for presenting the information to the public; and</text>
 </paragraph><paragraph id="H775F2A469499441FB0DD06AE81A64F8F"><enum>(3)</enum><text>submit the plans developed under paragraphs (1) and (2) to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text>
 </paragraph></section><section id="H70906ED5BE5D441FAD774B7666A6D817" section-type="subsequent-section"><enum>24.</enum><header>Agency accountability</header><text display-inline="no-display-inline">Title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref> et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H68AC0C72DF174BF1844C0A4FA4509B38" style="OLC">
				<section id="HEAC77732E7D446EABD5D0FFC22C28260"><enum>430.</enum><header>Agency accountability</header>
 <subsection id="H2A7C73B90008489F867D51227553C499"><enum>(a)</enum><header>Public Assistance</header><text display-inline="yes-display-inline">Not later than 5 days after an award of a public assistance grant is made under section 406 that is in excess of $1,000,000, the Administrator of the Federal Emergency Management Agency shall publish on the website of the Federal Emergency Management Agency the specifics of each such grant award, including—</text>
 <paragraph id="H59A26E275C7B424A9659DE1EA390A521"><enum>(1)</enum><text>identifying the Federal Emergency Management Agency Region;</text> </paragraph><paragraph id="H3D4451E57155444F80DCBF0C04B77E38"><enum>(2)</enum><text>the disaster or emergency declaration number;</text>
 </paragraph><paragraph id="H41A354D3C0154870983F0D4AD1F487C5"><enum>(3)</enum><text>the State, county, and applicant name;</text> </paragraph><paragraph id="HBAD7FEABDC9B46E296A66448C1C2C5EC"><enum>(4)</enum><text>if the applicant is a private nonprofit organization;</text>
 </paragraph><paragraph id="H4ECB3C82793747D596E722A0E1F1241C"><enum>(5)</enum><text>the damage category code;</text> </paragraph><paragraph id="HC3B1596AEF8D47708CE50353C440D064"><enum>(6)</enum><text>the amount of the Federal share obligated; and</text>
 </paragraph><paragraph id="HDF243541B43C45158EE31CD1979ACEAF"><enum>(7)</enum><text>the date of the award.</text> </paragraph></subsection><subsection id="HC4248DC45CF04622AB8EB02B756F11F6"><enum>(b)</enum><header>Mission Assignments</header> <paragraph id="H2BCD40B93E214528A5165CB100273B59"><enum>(1)</enum><header>In general</header><text>Not later than 5 days after the issuance of a mission assignment or mission assignment task order, the Administrator of the Federal Emergency Management Agency shall publish on the website of the Federal Emergency Management Agency any mission assignment or mission assignment task order to another Federal department or agency regarding a major disaster in excess of $1,000,000, including—</text>
 <subparagraph id="HB3C0E3AD2D8341C4ADCEB7732C325770"><enum>(A)</enum><text>the name of the impacted State or Indian Tribe;</text> </subparagraph><subparagraph id="HE6005EE40176479194C374B2C1EE0128"><enum>(B)</enum><text>the disaster declaration for such State or Indian Tribe;</text>
 </subparagraph><subparagraph id="H4CCD76C40C474E619A61A89B3CF4D220"><enum>(C)</enum><text>the assigned agency;</text> </subparagraph><subparagraph id="H4593DB8AB844455EA3170B5EC19E60B1"><enum>(D)</enum><text>the assistance requested;</text>
 </subparagraph><subparagraph id="H1EA945F8BB214176A40DA1D995DE039E"><enum>(E)</enum><text>a description of the disaster;</text> </subparagraph><subparagraph id="H1424E37D63F5416CA86C903EB7048F51"><enum>(F)</enum><text>the total cost estimate;</text>
 </subparagraph><subparagraph id="H95E1E372E303427CB755FBEBB63BFDCC"><enum>(G)</enum><text>the amount obligated;</text> </subparagraph><subparagraph id="H6FDD743D844F4BC1BCF8E8AAD6A80DFA"><enum>(H)</enum><text>the State or Tribal cost share, if applicable;</text>
 </subparagraph><subparagraph id="HA75A3C925E1044E4AE5130A554A1FFC8"><enum>(I)</enum><text>the authority under which the mission assignment or mission assignment task order was directed; and</text> </subparagraph><subparagraph id="H12D624E140144D3BA48A93E32EA9E84A"><enum>(J)</enum><text>if applicable, the date a State or Indian Tribe requested the mission assignment.</text>
 </subparagraph></paragraph><paragraph id="H4E2525B909444FBC960BD11CA676C033"><enum>(2)</enum><header>Recording changes</header><text>Not later than 10 days after the last day of each month until a mission assignment or mission assignment task order described in paragraph (1) is completed and closed out, the Administrator of the Federal Emergency Management Agency shall update any changes to the total cost estimate and the amount obligated.</text>
 </paragraph></subsection><subsection id="H0AF45781658A4867A452D1BC0579379F"><enum>(c)</enum><header>Disaster Relief Monthly Report</header><text>Not later than 10 days after the first day of each month, the Administrator of the Federal Emergency Management Agency shall publish on the website of the Federal Emergency Management Agency reports, including a specific description of the methodology and the source data used in developing such reports, including—</text>
 <paragraph id="H58874592674F4DC080DB4E01355E79BB"><enum>(1)</enum><text>an estimate of the amounts for the fiscal year covered by the President’s most recent budget pursuant to section 1105(a) of title 31, United States Code, including—</text>
 <subparagraph id="H7900284883804E89AA617B043897D4C9"><enum>(A)</enum><text>the unobligated balance of funds to be carried over from the prior fiscal year to the budget year;</text> </subparagraph><subparagraph id="HE55E11D6ECA24208AFF10D18A1CAF2C0"><enum>(B)</enum><text display-inline="yes-display-inline">the unobligated balance of funds to be carried over from the budget year to the budget year plus 1;</text>
 </subparagraph><subparagraph id="H937B0B2D451247B0B6A26AE056627F85"><enum>(C)</enum><text>the amount of obligations for noncatastrophic events for the budget year;</text> </subparagraph><subparagraph id="HDBB5767DA73F4779910A234CDEC92919"><enum>(D)</enum><text>the amount of obligations for the budget year for catastrophic events delineated by event and by State;</text>
 </subparagraph><subparagraph id="H31FE0AF6624746B6A576145C4EA2E143"><enum>(E)</enum><text>the total amount that has been previously obligated or will be required for catastrophic events delineated by event and by State for all prior years, the current fiscal year, the budget year, and each fiscal year thereafter;</text>
 </subparagraph><subparagraph id="H32C6C133DCDE446EABC9A3C4165CC162"><enum>(F)</enum><text>the amount of previously obligated funds that will be recovered for the budget year;</text> </subparagraph><subparagraph id="H37FDE9ECDA1741F1961B5420B548EEA1"><enum>(G)</enum><text>the amount that will be required for obligations for emergencies, as described in section 102(1), major disasters, as described in section 102(2), fire management assistance grants, as described in section 420, surge activities, and disaster readiness and support activities; and</text>
 </subparagraph><subparagraph id="HE2A5419F08464AB996665CE18DC8B4AC"><enum>(H)</enum><text>the amount required for activities not covered under section 251(b)(2)(D)(iii) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(b)(2)(D)(iii)</external-xref>); and</text>
 </subparagraph></paragraph><paragraph id="H50E5521609E84115AB69DB0C37824D9A"><enum>(2)</enum><text>an estimate or actual amounts, if available, of the following for the current fiscal year, which shall be submitted not later than the fifth day of each month, published by the Administrator of the Federal Emergency Management Agency on the website of the Federal Emergency Management Agency not later than the fifth day of each month:</text>
 <subparagraph id="HC643D175E4844B18BBBAC54A2224B537"><enum>(A)</enum><text>A summary of the amount of appropriations made available by source, the transfers executed, the previously allocated funds recovered, and the commitments, allocations, and obligations made.</text>
 </subparagraph><subparagraph id="H72303CF9D37046B7889446136653218C"><enum>(B)</enum><text>A table of disaster relief activity delineated by month, including—</text> <clause id="HEC44ADC4458842C5B667CBA5B9FD81CF"><enum>(i)</enum><text>the beginning and ending balances;</text>
 </clause><clause id="H05130675E80E4324AF1239FB698982AF"><enum>(ii)</enum><text>the total obligations to include amounts obligated for fire assistance, emergencies, surge, and disaster support activities;</text>
 </clause><clause id="H05804EA084AF4AEF92C76536D8B4AD5F"><enum>(iii)</enum><text>the obligations for catastrophic events delineated by event and by State; and</text> </clause><clause id="H000885E9738A4011BA2DE883DBFC2753"><enum>(iv)</enum><text>the amount of previously obligated funds that are recovered.</text>
 </clause></subparagraph><subparagraph id="HE29797D7D8E84404A2C5C7545B159E93"><enum>(C)</enum><text>A summary of allocations, obligations, and expenditures for catastrophic events delineated by event.</text>
 </subparagraph><subparagraph id="H5ED1C03CCB40432D895B5C467026A97C"><enum>(D)</enum><text>The cost of the following categories of spending:</text> <clause id="HE27BE06DC5504DC982550F3136B49A98"><enum>(i)</enum><text>Public assistance.</text>
 </clause><clause id="H88CFC29C5ED94BBEA18FA460BB17D097"><enum>(ii)</enum><text>Individual assistance.</text> </clause><clause id="H9ACFCA3BE5F3484BA14E1AF59BEEA969"><enum>(iii)</enum><text>Mitigation.</text>
 </clause><clause id="H6CFE3A65F4014614A10F6441424BF479"><enum>(iv)</enum><text>Administrative.</text> </clause><clause id="HFDAA5A7BEE6F4DB7A923813AD32E00D5"><enum>(v)</enum><text>Operations.</text>
 </clause><clause id="H2061566D28684019B8D093C506AC7273"><enum>(vi)</enum><text>Any other relevant category (including emergency measures and disaster resources) delineated by disaster.</text>
 </clause></subparagraph><subparagraph id="H0B6EF02331E84C698294B3468D9E0134"><enum>(E)</enum><text>The date on which funds appropriated will be exhausted.</text> </subparagraph></paragraph></subsection><subsection id="HF960A5CBC74B4617BC765ABFCC1BCBA3"><enum>(d)</enum><header>Contracts</header> <paragraph id="HAC732C61607D465EAB2679F3B1407A7B"><enum>(1)</enum><header>Information</header><text>Not later than 10 days after the first day of each month, the Administrator of the Federal Emergency Management Agency shall publish on the website of the Federal Emergency Management Agency the specifics of each contract in excess of $1,000,000 that the Federal Emergency Management Agency enters into, including—</text>
 <subparagraph id="H2D0AABFD8F104DD0889DD76DD9700CB8"><enum>(A)</enum><text>the name of the party;</text> </subparagraph><subparagraph id="HCBEFD8AE0E2147B497D9768F8E49CEE7"><enum>(B)</enum><text>the date the contract was awarded;</text>
 </subparagraph><subparagraph id="HD451CDA40CFB47AEB187510EA452A68D"><enum>(C)</enum><text>the amount and scope of the contract;</text> </subparagraph><subparagraph id="H87FC76F6ED5C4B3FA8A2FC4771814011"><enum>(D)</enum><text>if the contract was awarded through <added-phrase committee-id="SSGA00" reported-display-style="italic">a</added-phrase> competitive bidding process;</text>
 </subparagraph><subparagraph id="H556FA3F405DF40518AB797164817DA1F"><enum>(E)</enum><text>if no competitive bidding process was used, the reason why competitive bidding was not used; and</text> </subparagraph><subparagraph id="H934B9C79FCEB44F3800C860A355A0FE8"><enum>(F)</enum><text>the authority used to bypass the competitive bidding process.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">The information shall be delineated by disaster, if applicable, and specify the damage category

 </subparagraph><subparagraph id="H236F46DDFCA74547BEFB0C8C9E6FF57B"><enum>(C)</enum><text>The total amount of contracts awarded with no competitive bidding.</text> </subparagraph><subparagraph id="HE516A1C6D33F4DF3AC736FBE023B522F"><enum>(D)</enum><text>The damage category codes, if applicable, for contracts awarded without competitive bidding.</text>
 </subparagraph></paragraph></subsection><subsection changed="deleted" committee-id="SSGA00" id="id61BE76F3C9424EA79377075B01815BB4" reported-display-style="strikethrough"><enum>(e)</enum><header>Report on the collection of public assistance recipient and subrecipient contracts</header><text>Not later than 180 days after the date of enactment of this subsection, the Administrator of the Federal Emergency Management Agency shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the efforts of the Federal Emergency Management Agency to collect information on any contract prior to the project closeout phase for more than $500,000 that a public assistance recipient or subrecipient enters into using grant monies under section 324, 403, 406, 407, 428, or 502, to improve oversight efforts by the Inspector General of the Department and others, including—</text>

 </paragraph><paragraph id="id70166e4425364fbdbfe7abfb183b6ab2"><enum>(5)</enum><text>the period of performance for the contract; and</text> </paragraph><paragraph id="idb7689029c23b446892c8ecc1d65e6335"><enum>(6)</enum><text>whether the contract was awarded through a competitive bidding process.</text>
						</paragraph></subsection><subsection changed="added" committee-id="SSGA00" id="id78405BBA3C7A4620A580B5F69F82FD8E" reported-display-style="italic"><enum>(e)</enum><header>Collection of public assistance recipient and subrecipient contracts</header>
 <paragraph id="idCD62D8844BF34A7FB7961800FA8E84F1"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this subsection, the Administrator of the Federal Emergency Management Agency shall initiate efforts to begin collecting information prior to the project closeout phase on any contract for more than $500,000 that a public assistance recipient or subrecipient enters into using grant monies under section 324, 403, 406, 407, 428, or 502, to improve oversight efforts by the Inspector General of the Department and others, including—</text>
 <subparagraph id="idB8FE92F73CE9410CBA5533833B59CA75"><enum>(A)</enum><text>the name of each party;</text> </subparagraph><subparagraph id="id6B213AFE6F304E62BD5206DDCC157F41"><enum>(B)</enum><text>the date the contract was awarded;</text>
 </subparagraph><subparagraph id="id387F921885B04B198B16747F3B67ACB8"><enum>(C)</enum><text>the amount of the contract;</text> </subparagraph><subparagraph id="id7B2C361AAF96443B8EF8DF0A337ADB6F"><enum>(D)</enum><text>the scope of the contract;</text>
 </subparagraph><subparagraph id="id6338E3F774DC47548AD206EE2CB2A0C4"><enum>(E)</enum><text>the period of performance for the contract; and</text> </subparagraph><subparagraph id="idFFBD9247804A44EBA80431A51B1BD24D"><enum>(F)</enum><text>whether the contract was awarded through a competitive bidding process.</text>
 </subparagraph></paragraph><paragraph id="idBB35F27CFF5D4B0C8DE885582E3A44FC"><enum>(2)</enum><header>Report</header><text>Not later than 365 days after the date of enactment of this subsection, the Administrator of the Federal Emergency Management Agency shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the efforts of the Federal Emergency Management Agency to collect the information described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" id="H53B4504F7B264D0F8127FB9CA8FC4B2D"><enum>25.</enum><header>Audit of contracts</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Administrator shall not reimburse a State<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">, Tribe,</deleted-phrase> or local government, <added-phrase committee-id="SSGA00" reported-display-style="italic">an Indian tribal government <added-phrase committee-id="SSGA00" reported-display-style="italic">(as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)</added-phrase></added-phrase>, or the owner or operator of a private nonprofit facility <added-phrase committee-id="SSGA00" reported-display-style="italic">(as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)</added-phrase> for any activities made pursuant to a contract that prohibits the Administrator or the Comptroller General of the United States from auditing or otherwise reviewing all aspects relating to the contract.</text>
		</section><section id="H4D35F760222E4F63A6F0612408C6F8B0"><enum>26.</enum><header>Inspector general audit of FEMA contracts for tarps and plastic sheeting</header>
 <subsection id="H2775E88CD1C04EE2AFAE179B21284818"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Inspector General of the Department of Homeland Security shall initiate an audit of the contracts awarded by the Agency for tarps and plastic sheeting for the Commonwealth of Puerto Rico and the United States Virgin Islands in response to Hurricane Irma and Hurricane Maria.</text>
 </subsection><subsection id="H2BE6CF7781A6404294E5245020ED1634"><enum>(b)</enum><header>Considerations</header><text display-inline="yes-display-inline">In carrying out the audit under subsection (a), the Inspector General shall review—</text> <paragraph id="H1710998854D14AC5AB6F9397F9E08953"><enum>(1)</enum><text>the contracting process used by the Agency to evaluate offerors and award the relevant contracts to contractors;</text>
 </paragraph><paragraph id="HAB0D993893994A39AE1FF6AB96A2BD53"><enum>(2)</enum><text>the assessment conducted by the Agency of the past performance of the contractors, including any historical information showing that the contractors had supported large-scale delivery quantities in the past;</text>
 </paragraph><paragraph id="H288D6245AFB24BC68A01B53C45C28784"><enum>(3)</enum><text display-inline="yes-display-inline">the assessment conducted by the Agency of the capacity of the contractors to carry out the relevant contracts, including with respect to inventory, production, and financial capabilities;</text>
 </paragraph><paragraph id="H16C8F225E39649D2802BB1B3B11CD360"><enum>(4)</enum><text display-inline="yes-display-inline">how the Agency ensured that the contractors met the terms of the relevant contracts; and</text> </paragraph><paragraph id="H64DD7CEAC04449D5BD5244031A2067A1"><enum>(5)</enum><text display-inline="yes-display-inline">whether the failure of the contractors to meet the terms of the relevant contracts and the subsequent cancellation by the Agency of the relevant contracts affected the provision of tarps and plastic sheeting to the Commonwealth of Puerto Rico and the United States Virgin Islands.</text>
 </paragraph></subsection><subsection id="HF3EE254E826C4A21AC22379B1AE19159"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 270 days after the date of initiation of the audit under subsection (a), the Inspector General shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the results of the audit, including findings and recommendations.</text>
 </subsection></section><section id="H1EDB71257BEC460E877B85B4E8A36E9E"><enum>27.</enum><header>Relief organizations</header><text display-inline="no-display-inline">Section 309 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5152">42 U.S.C. 5152</external-xref>) is amended—</text>
 <paragraph id="H97E5F6D8A0D64ADF93A690D4AE24EE6A"><enum>(1)</enum><text>in subsection (a), by striking <quote>and other relief or</quote> and inserting <quote>long-term recovery groups, domestic hunger relief, and other relief, or</quote>; and</text> </paragraph><paragraph id="HCB41BCB806DB4594B6A633381A13324A"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>and other relief or</quote> and inserting <quote>long-term recovery groups, domestic hunger relief, and other relief, or</quote>.</text>
 </paragraph></section><section id="H61A1CD7962394B9A85D6EFCA11B6A244"><enum>28.</enum><header>Guidance on inundated and submerged roads</header><text display-inline="no-display-inline">The Administrator, in coordination with the Administrator of the Federal Highway Administration, shall develop and issue guidance for State<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">,</deleted-phrase> and local<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">, and Tribe </deleted-phrase>governments <added-phrase committee-id="SSGA00" reported-display-style="italic">and Indian tribal governments (as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)</added-phrase> regarding repair, restoration, and replacement of inundated and submerged roads damaged or destroyed by a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), and for associated expenses incurred by the Government, with respect to roads eligible for assistance under section 406 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172</external-xref>), as amended by this Act.</text>
		</section><section id="HA967C565B63241329360195490F9C375"><enum>29.</enum><header>Guidance and recommendations</header>
 <subsection id="HCCBE861C22194DCDAA99D49D2E83DB5F"><enum>(a)</enum><header>Guidance</header><text>The Administrator shall provide guidance to a common interest community that provides essential services of a governmental nature on actions that a common interest community may take in order to be eligible to receive reimbursement from a grantee that receives funds from the Agency for certain activities performed after an event that results in a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>).</text>
 </subsection><subsection id="H15C636695BBA4B93A190C6D0201999BA"><enum>(b)</enum><header>Recommendations</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator shall provide to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a legislative proposal on how to provide eligibility for disaster assistance with respect to common areas of condominiums and housing cooperatives.</text>
			</subsection></section><section id="HB4A83085762F46A69841EC76A29119B3" section-type="subsequent-section"><enum>30.</enum><header> Guidance on hazard mitigation assistance</header>
 <subsection id="H8D745C3C16B044B09B199ADD2FD49C6B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall issue guidance regarding the acquisition of property for open space as a mitigation measure under section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>) that includes—</text>
 <paragraph id="H537F159F294E405FA5AC9EF7A0F56359"><enum>(1)</enum><text display-inline="yes-display-inline">a process by which the State hazard mitigation officer appointed for such an acquisition shall, not later than 60 days after the applicant for assistance enters into an agreement with the Administrator regarding the acquisition, provide written notification to each affected unit of local government for such acquisition that includes—</text>
 <subparagraph id="H11FD48CA68F245C2BC12168E4F902B66"><enum>(A)</enum><text>the location of the acquisition;</text> </subparagraph><subparagraph id="H5CBAD34914DD4A9EB496F55A89D9BF38"><enum>(B)</enum><text>the State-local assistance agreement for the hazard mitigation grant program;</text>
 </subparagraph><subparagraph id="H6C298AECBEA2482983DABF6E5024CE31"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the acquisition; and</text> </subparagraph><subparagraph id="H8C4DE2BA90404726B549D3761549B28F"><enum>(D)</enum><text>a copy of the deed restriction; and</text>
 </subparagraph></paragraph><paragraph id="H140DED62A2B74315AF81233269CE1469"><enum>(2)</enum><text>recommendations for entering into and implementing a memorandum of understanding between units of local government and covered entities that includes provisions to allow an affected unit of local government notified under paragraph (1) to—</text>
 <subparagraph id="HB78E848EA061485AAF81BF3B2452E8D6"><enum>(A)</enum><text display-inline="yes-display-inline">use and maintain the open space created by such a project, consistent with section 404 (including related regulations, standards, and guidance) and consistent with all adjoining property, subject to the notification of the adjoining property, so long as the cost of the maintenance is borne by the local government; and</text>
 </subparagraph><subparagraph commented="no" id="H7614F701E32341718AF9AAE670333263"><enum>(B)</enum><text display-inline="yes-display-inline">maintain the open space pursuant to standards exceeding any local government standards defined in the agreement with the Administrator described under paragraph (1).</text>
 </subparagraph></paragraph></subsection><subsection id="H19CBB22809444077B5EED81CB4E5F3BE"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HAD417C76190E4EB8AFDB074B02E02055"><enum>(1)</enum><header>Affected unit of local government</header><text display-inline="yes-display-inline">The term <term>affected unit of local government</term> means any entity covered by the definition of local government in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">,</deleted-phrase> that has jurisdiction over the property subject to the acquisition described in subsection (a).</text>
 </paragraph><paragraph id="HA231BC29BCA147B8A5088E53E5079F2C"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text> <subparagraph id="HB045A3319E584002ABFC22D1A14455A3"><enum>(A)</enum><text display-inline="yes-display-inline">the grantee or subgrantee receiving assistance for an open space project described in subsection (a);</text>
 </subparagraph><subparagraph id="H8B6166203962409BA7905489D89B1456"><enum>(B)</enum><text>the State in which such project is located; and</text> </subparagraph><subparagraph id="H0CA153E4E8404C47954DF7B30C33968B"><enum>(C)</enum><text display-inline="yes-display-inline">the applicable Regional Administrator of the Agency.</text>
 </subparagraph></paragraph></subsection></section><section id="H8DBBB98DC30841EE9D486B19B644AACF" section-type="subsequent-section"><enum>31.</enum><header>Additional hazard mitigation activities</header><text display-inline="no-display-inline">Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>), as amended by section 5, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HA835F8A92D9046A4AF90F8CF7060DEAE" style="OLC">
 <subsection id="H88AC628ACB6546F8B8CEE4A1E4128059"><enum>(g)</enum><header>Use of assistance</header><text display-inline="yes-display-inline">Recipients of hazard mitigation assistance provided under this section and section 203 may use the assistance to conduct activities to help reduce the risk of future damage, hardship, loss, or suffering in any area affected by earthquake hazards, including—</text>
 <paragraph id="HC01FEAA9E3224FBABD1F0BE546EE31EC"><enum>(1)</enum><text display-inline="yes-display-inline">improvements to regional seismic networks in support of building a capability for earthquake early warning;</text>
 </paragraph><paragraph id="HB9FCA4007D29449BA8E4DCEEB64FF1CD"><enum>(2)</enum><text display-inline="yes-display-inline">improvements to geodetic networks in support of building a capability for earthquake early warning; and</text>
 </paragraph><paragraph id="H4C9EE726877645E6A4CC26BBB7B754FE"><enum>(3)</enum><text display-inline="yes-display-inline">improvements to seismometers, Global Positioning System receivers, and associated infrastructure in support of building a capability for earthquake early warning.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H370660D3E6424C16B19806A83F4B0CCD" section-type="subsequent-section"><enum>32.</enum><header>National public infrastructure predisaster hazard mitigation</header>
 <subsection id="H3075E05F8E944236820E20DAA38EECA3"><enum>(a)</enum><header>Predisaster hazard mitigation</header><text display-inline="yes-display-inline">Section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) is amended—</text>
 <paragraph id="HC7B06F88353E4184A58DDED544E4A877"><enum>(1)</enum><text>in subsection (c)<added-phrase committee-id="SSGA00" reported-display-style="italic">,</added-phrase> by inserting <quote>Public Infrastructure</quote> after <quote>the National</quote>;</text> </paragraph><paragraph id="H4C2BBB3E4251432387E539FDAB6D06BF"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(1)(B)—</text>
 <subparagraph id="H7E3B7A2F6DD843D194A11F3355931E62"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>or</quote> at the end;</text> </subparagraph><subparagraph id="H0EFC840911D247AC860D3579E17A5510"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (iii), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </subparagraph><subparagraph id="H6A83A1E729C34D1AB7109E7975454F62"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block id="H710B31E12D204859ABCDC08B593B5D32" style="OLC"> <clause id="H4E4EDE7F3E944C8AAFCD638B410C0F64"><enum>(iv)</enum><text display-inline="yes-display-inline">to establish, adopt, and carry out enforcement activities to implement the latest published editions of relevant consensus-based codes, specifications, and standards that incorporate the latest hazard-resistant designs and establish minimum acceptable criteria for the design, construction, and maintenance of residential structures and facilities that may be eligible for assistance under this Act for the purpose of protecting the health, safety, and general welfare of the buildings’ users against disasters.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H27844660AEE74A08A924816365CD7F52"><enum>(3)</enum><text>in subsection (f)—</text> <subparagraph id="HA4D7FBB04E564CEBB8F81D810B6A3E1E"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>for mitigation activities that are cost effective</quote> after <quote>competitive basis</quote>; and</text>
 </subparagraph><subparagraph id="HE4EA7CB0484A4226B75116CA91DCD600"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block id="H4D660A8B1C17416B967153EE4F127CF2" style="OLC"> <paragraph commented="no" id="H8E7B3790016849949D2DC03687DBF5D0"><enum>(3)</enum><header>Redistribution of unobligated amounts</header><text>The President may—</text>
 <subparagraph commented="no" id="H5715FE8E7F344F4CBCB410B0B85E03A2"><enum>(A)</enum><text>withdraw amounts of financial assistance made available to a State (including amounts made available to local governments of a State) under this subsection that remain unobligated by the end of the third fiscal year after the fiscal year for which the amounts were allocated; and</text>
 </subparagraph><subparagraph commented="no" id="H53C66BD1D84748E6B8210B8F508D826A"><enum>(B)</enum><text>in the fiscal year following a fiscal year in which amounts were withdrawn under subparagraph (A), add the amounts to any other amounts available to be awarded on a competitive basis pursuant to paragraph (1).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H9D05E07FB443475696DA938C605F4E1E"><enum>(4)</enum><text>in subsection (g)—</text> <subparagraph id="HD352C281AE12417BA1E8DB649A208E78"><enum>(A)</enum><text>in paragraph (9), by striking <quote>and</quote> at the end;</text>
 </subparagraph><subparagraph id="H88FE66209A3B418D8066E1C36A33825E"><enum>(B)</enum><text>by redesignating paragraph (10) as paragraph (12); and</text> </subparagraph><subparagraph id="H320AD8F91973452CAE8F21827B0D89D4"><enum>(C)</enum><text>by inserting after paragraph (9) the following:</text>

 <paragraph id="H8F5BF46096714AE7A041DEBCBE570174"><enum>(10)</enum><text display-inline="yes-display-inline">the extent to which the State or local government has facilitated the adoption and enforcement of the latest published editions of relevant consensus-based codes, specifications, and standards that incorporate the latest hazard-resistant designs and establish criteria for the design, construction, and maintenance of residential structures and facilities that may be eligible for assistance under this Act for the purpose of protecting the health, safety, and general welfare of the buildings’ users against disasters;</text>
 </paragraph><paragraph id="H3F09F5AAFA7E4551AECDB86505E9297C"><enum>(11)</enum><text>the extent to which the assistance will fund activities that increase the level of resiliency; and</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="H195B4DB82CCC406380F2CBBC68C09C3C"><enum>(5)</enum><text>by striking subsection (i) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H954DA0CC664E48A990F057AB5D0415B7" style="OLC">
						<subsection id="H03E9743810A64DF59BFF7A67277A4F5A"><enum>(i)</enum><header>National public infrastructure predisaster mitigation assistance</header>
 <paragraph commented="no" id="H449E309971DC4853974D76652718A36E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may set aside from the Disaster Relief Fund, with respect to each major disaster, an amount equal to 6 percent of the estimated aggregate amount of the grants to be made pursuant to sections 403, 406, 407, 408, 410, 416, and 428 for the major disaster in order to provide technical and financial assistance under this section.</text>
 </paragraph><paragraph id="H17C24F46FD3249FC99BB12E266271484"><enum>(2)</enum><header>Estimated aggregate amount</header><text>Not later than 180 days after each major disaster declaration pursuant to this Act, the estimated aggregate amount of grants for purposes of paragraph (1) shall be determined by the President and such estimated amount need not be reduced, increased, or changed due to variations in estimates.</text>
 </paragraph><paragraph id="H84E3B578BC4949F48DE3F88B99E03538"><enum>(3)</enum><header>No reduction in amounts</header><text display-inline="yes-display-inline">The amount set aside pursuant to paragraph (1) shall not reduce the amounts otherwise made available for sections 403, 404, 406, 407, 408, 410, 416, and 428 under this Act.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H70E5418E17264A4989D9F2D968B474E5"><enum>(6)</enum><text>by striking subsections (j) and (m); and</text> </paragraph><paragraph id="id9A3927020DEB480696507181496394B9"><enum>(7)</enum><text>by redesignating subsections (k), (l), and (n) as subsections (j), (k), and (l), respectively.</text>
 </paragraph></subsection><subsection id="H2AA37F568F8C4EF182B9E2756591E083"><enum>(b)</enum><header>Applicability</header><text>The amendments made to section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) by paragraphs (3) and (5) of subsection (a) shall apply to funds appropriated after the date of enactment of this Act.</text>
			</subsection></section><section id="H529A05784B04407495497A8CD16AF56D" section-type="subsequent-section"><enum>33.</enum><header>Additional mitigation activities</header>
 <subsection id="H370BAAD4A2224308B17DFD9871E62E3C"><enum>(a)</enum><header>Hazard mitigation clarification</header><text>Section 404(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c(a)</external-xref>) is amended by striking the first sentence and inserting the following: <quote>The President may contribute up to 75 percent of the cost of hazard mitigation measures which the President has determined are cost effective and which substantially reduce the risk of, or increase resilience to, future damage, hardship, loss, or suffering in any area affected by a major disaster.</quote>.</text>
 </subsection><subsection id="H9F695B92E3E148B0AE90D4167FAA0806"><enum>(b)</enum><header>Eligible cost</header><text display-inline="yes-display-inline">Section 406(e)(1)(A) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172(e)(1)(A)</external-xref>) is amended—</text>
 <paragraph id="H4B4BFD19834B4F21A06D1DE2726D5F0A"><enum>(1)</enum><text>in the matter preceding clause (i), by inserting after <quote>section,</quote> the following: <quote>for disasters declared on or after August 1, 2017, or a disaster in which a cost estimate has not yet been finalized for a project,</quote>;</text>
 </paragraph><paragraph id="HF0206442CDEF442C8DD25214AB638EB4"><enum>(2)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="HA33E464744A340988BF6452C0BC45227"><enum>(3)</enum><text>in clause (ii)—</text>
 <subparagraph id="HC25D6B670C764410A7D6F686985585A4"><enum>(A)</enum><text>by striking <quote>codes, specifications, and standards</quote> and inserting <quote>the latest published editions of relevant consensus-based codes, specifications, and standards that incorporate the latest hazard-resistant designs and establish minimum acceptable criteria for the design, construction, and maintenance of residential structures and facilities that may be eligible for assistance under this Act for the purposes of protecting the health, safety, and general welfare of a facility’s users against disasters</quote>;</text>
 </subparagraph><subparagraph id="H6CE80E64BF5D4AF6801F30590F49792C"><enum>(B)</enum><text>by striking <quote>applicable at the time at which the disaster occurred</quote>; and</text> </subparagraph><subparagraph id="HC07E1E27A35949D592B0F8290C1264B6"><enum>(C)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </subparagraph></paragraph><paragraph id="HFC338908D56240E183F80C5EB72F14C9"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block id="H749DD38DE5414EE1B643AF913989D542" style="OLC"> <clause id="HB04CB1A5B07C4DF99949B6E161F5B183"><enum>(iii)</enum><text>in a manner that allows the facility to meet the definition of resilient developed pursuant to this subsection.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="H3490F20844C34FDFB4C8F5E730FDE4C0"><enum>(c)</enum><header>Other eligible cost</header><text display-inline="yes-display-inline">Section 406(e)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172(e)(1)</external-xref>) is amended by adding at the end the following:</text>

 <subparagraph commented="no" id="HAF9F7280BC4F4605B19E50496ED256B7"><enum>(C)</enum><header>Contributions</header><text display-inline="yes-display-inline">Contributions for the eligible cost made under this section may be provided on an actual cost basis or on cost-estimation procedures.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H66A709124B6C437AAEC70B2BA82C81A6"><enum>(d)</enum><header>New rules</header><text display-inline="yes-display-inline">Section 406(e) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172(e)</external-xref>) is further amended by adding at the end the following:</text>
				<quoted-block id="H2CBBE275F79846748E8AB69400CCD8EC" style="OLC">
					<paragraph id="H96D23AB257784FD091197A7EFC298C81"><enum>(5)</enum><header>New rules</header>
 <subparagraph id="H6A035886AD5240E39BD86DB86B1E52DA"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this paragraph, the President, acting through the Administrator of the Federal Emergency Management Agency, and in consultation with the heads of relevant Federal departments and agencies, shall issue a final rulemaking that defines the terms <term>resilient</term> and <term>resiliency</term> for purposes of this subsection.</text>
 </subparagraph><subparagraph id="H855AE5F5946C42F69C39B889E2E8EEC2"><enum>(B)</enum><header>Interim guidance</header><text>Not later than 60 days after the date of enactment of this paragraph, the Administrator shall issue interim guidance to implement this subsection. Such interim guidance shall expire 18 months after the date of enactment of this paragraph or upon issuance of final regulations pursuant to subparagraph (A), whichever occurs first.</text>
 </subparagraph><subparagraph id="H556A459D7C39495D849E005ED1BB442B"><enum>(C)</enum><header>Guidance</header><text>Not later than 90 days after the date on which the Administrator issues the final rulemaking under this paragraph, the Administrator shall issue any necessary guidance related to the rulemaking.</text>
 </subparagraph><subparagraph id="H626E60247D7A46DA8F7FCB574786226C"><enum>(D)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this paragraph, the Administrator shall submit to Congress a report summarizing the regulations and guidance issued pursuant to this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H0EF365A285904B9CB3CE57E3CA0999E4"><enum>(e)</enum><header>Conforming amendment</header><text>Section 205(d)(2) of the Disaster Mitigation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172</external-xref> note) is amended by inserting <quote>(B)</quote> after <quote>except that paragraph (1)</quote>.</text>
 </subsection><subsection changed="added" committee-id="SSGA00" id="id55F1179435554AAD9FE2C6419071DBE6" reported-display-style="italic"><enum>(f)</enum><header>Applicability</header><text>The amendments made by subsections (b) and (c) shall apply to any major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) on or after the date of enactment of this Act.</text>
 </subsection></section><section changed="deleted" committee-id="SSGA00" id="H88E7CE3C8FC1442D8F0F0B4A817F8641" reported-display-style="strikethrough"><enum>34.</enum><header>Reimbursement</header><text display-inline="no-display-inline">The Agency shall retroactively reimburse State and units of local government (for a period of 3 years after the declaration of a major disaster under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>)) upon determination that a locally implemented housing solution, implemented by State or units of local government, costs 50 percent of the comparable Agency solution or whatever the locally implemented solution costs, whichever is lower.</text>
 </section><section id="H04D627AC3E76425998EAF7E54C104C32"><enum><deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">35</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">34</added-phrase>.</enum><header>Flood insurance</header><text display-inline="no-display-inline">Section 406(d)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172(d)(1)</external-xref>) is amended by adding at the end the following: <quote>This section shall not apply to more than 1 building of a multi-structure educational, law enforcement, correctional, fire, or medical campus, effective January 1, 2016.</quote>.</text>
		</section><section id="H36B848E3148C471DBD4A99F60537AAF7"><enum><deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">36</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">35</added-phrase>.</enum><header>Certain recoupment prohibited</header>
 <subsection id="H0C1A82D0F5344BB09552D03A763DFFFF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Agency shall deem any covered disaster assistance to have been properly procured, provided, and utilized, and shall restore any funding of covered disaster assistance previously provided but subsequently withdrawn or deobligated.</text>
 </subsection><subsection id="H88569F23A11645A6B3931D7184E159B2"><enum>(b)</enum><header>Covered disaster assistance defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered disaster assistance</term> means assistance—</text> <paragraph id="H9BE9B60EB9734C7599210A3A94801EC0"><enum>(1)</enum><text>provided to a local government pursuant to section 403, 406, or 407 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b</external-xref>, 5172, <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">or</deleted-phrase> 5173); and</text>
 </paragraph><paragraph id="H5062E0CE2FED47C68F4FF9B79D1EFB82"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to which<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">,</deleted-phrase> the Inspector General of the Department of Homeland Security has determined, after an audit, that—</text>
 <subparagraph id="HA363DFD8032E431584F57ADFB4C2200D"><enum>(A)</enum><text>the Agency deployed to the local government a Technical Assistance Contractor to review field operations, provide eligibility advice, and assist with day-to-day decisions;</text>
 </subparagraph><subparagraph id="H92F65948FE054354AD9E597F8A716477"><enum>(B)</enum><text>the Technical Assistance Contractor provided inaccurate information to the local government; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE7555BCAE8D472482FA6C990DFAF439"><enum>(C)</enum><text>the local government relied on the inaccurate information to determine that relevant contracts were eligible, reasonable, and reimbursable.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id734B3831B78B4A588F2E3507B0D7A60C"><enum><deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">37</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">36</added-phrase>.</enum><header>Federal assistance to individuals and households and nonprofit facilities</header>
 <subsection id="idB5AD1212DE7D49339B3E6B4049CC4118"><enum>(a)</enum><header>Critical document fee waiver</header><text display-inline="yes-display-inline">Section 408(e) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(e)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD93CEDDD3DEA428A921F185E04DFFE91" style="OLC">
					<paragraph id="idB6294BFD05E847CAA9A1CDDC7FE3D4B6"><enum>(3)</enum><header>Critical document fee waiver</header>
 <subparagraph id="idBF4D157CF74B48608B919BE42833DEE7"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 1 of the Passport Act of June 4, 1920 (<external-xref legal-doc="usc" parsable-cite="usc/22/214">22 U.S.C. 214</external-xref>) or any other provision of law, the President, in consultation with the Governor of a State, may provide a waiver under this section to an individual or household described in paragraph (1) of the following document replacement fees:</text>
 <clause id="idE7DE3C3062C6426AADC9BC19E9BC633D"><enum>(i)</enum><text>The passport application fee for individuals who lost their United States passport.</text> </clause><clause id="id72887D026D1F4158893ECB188CE13728"><enum>(ii)</enum><text>The file search fee for a United States passport.</text>
 </clause><clause id="id7C3ACD11A0234AEB8CBB7E313863E9F0"><enum>(iii)</enum><text>The Application for Waiver of Passport and/or Visa form (Form I–193) fee.</text> </clause><clause id="id73ED650D8C364D76B2977435A7C71658"><enum>(iv)</enum><text>The Permanent Resident Card replacement form (Form I–90) filing fee.</text>
 </clause><clause id="idE66A3CAB17B2422391F09DD82249E840"><enum>(v)</enum><text>The Declaration of Intention form (Form N–300) filing fee.</text> </clause><clause id="idDFBC62DE4EC441D09972A6B2010D796D"><enum>(vi)</enum><text>The Naturalization/Citizenship Document replacement form (Form N–565) filing fee.</text>
 </clause><clause id="idCA091E05932B42239980E11C58317B17"><enum>(vii)</enum><text>The Employment Authorization form (Form I–765) filing fee.</text> </clause><clause id="id3BCAE1465E6D4237BDBFC8FD6FEE0469"><enum>(viii)</enum><text>The biometric service fee.</text>
 </clause></subparagraph><subparagraph id="id81343914EE7F421FB9F310771C8418E8"><enum>(B)</enum><header>Exemption from form requirement</header><text>The authority of the President to waive fees under clauses (iii) through (viii) of subparagraph (A) applies regardless of whether the individual or household qualifies for a Form I–912 Request for Fee Waiver, or any successor thereto.</text>
 </subparagraph><subparagraph id="id9BAD5B9CFD9B4B318F3011C814AB1841"><enum>(C)</enum><header>Exemption from assistance maximum</header><text>The assistance limit in subsection (h) shall not apply to any fee waived under this paragraph.</text> </subparagraph><subparagraph changed="added" commented="no" committee-id="SSGA00" display-inline="no-display-inline" id="id30626B565BAE48C2936E01294E7D3226" reported-display-style="italic"><enum>(D)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 365 days after the date of enactment of this paragraph, the Administrator of the Federal Emergency Management Agency and the head of any other agency given critical document fee waiver authority under this paragraph shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the costs associated with providing critical document fee waivers as described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id9EECBAD2C19446E283D427EA04BAD3FE"><enum>(b)</enum><header>Federal assistance to private nonprofit childcare facilities</header><text display-inline="yes-display-inline">Section 406(a)(3)(B) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172(a)(3)(B)</external-xref>) is amended by inserting <quote>(including private nonprofit center-based childcare)</quote> after <quote>education</quote>.</text>
 </subsection><subsection changed="added" committee-id="SSGA00" id="id651601DA5F6141B8ABEEB7528768FB91" reported-display-style="italic"><enum>(c)</enum><header>Applicability</header><text>The amendment made by subsection (b) shall apply to any major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) on or after the date of enactment of this Act.</text>
			</subsection></section><section id="idF0194C5C050F4C1EA3850F1D114ED27B"><enum><deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">38</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">37</added-phrase>.</enum><header>Cost of assistance estimates</header>
 <subsection id="idc969b86a3c1a42ffbb0eb84efd07e1e9"><enum>(a)</enum><header>In general</header><text>Not later than <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">180</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">270 </added-phrase>days after the date of enactment of this Act, the Administrator shall review the factors considered when evaluating a request for a major disaster declaration under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.), specifically the estimated cost of the assistance<added-phrase committee-id="SSGA00" reported-display-style="italic">, and provide a report and briefing to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives</added-phrase>.</text>
 </subsection><subsection id="idE5B685D0276042A0A112781EF8AB3F8B"><enum>(b)</enum><header>Rulemaking</header><text>Not later than <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">180 days</deleted-phrase> <added-phrase committee-id="SSGA00" reported-display-style="italic">2 years</added-phrase> after the date of enactment of this Act, the Administrator shall review and initiate a rulemaking to update <added-phrase committee-id="SSGA00" reported-display-style="italic">the factors considered when evaluating a Governor's request for a major disaster declaration, including reviewing</added-phrase> how the Agency estimates the cost of major disaster assistance<deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">, including adjusting the per capita impact indicator for annual inflation for all years since 1986</deleted-phrase>, and consider other impacts on the capacity of a jurisdiction to respond to disasters.</text>
 </subsection><subsection changed="deleted" committee-id="SSGA00" id="idCDB43957C1F549E0B3C8D2E7BCE62F05" reported-display-style="strikethrough"><enum>(c)</enum><header>Implementation</header><text>The Administrator—</text> <paragraph id="idB68F197C46EB46AF8EB5151DE58D0522"><enum>(1)</enum><text>shall ensure that any new methodology developed under this section shall be phased in over a period of not less than 5 years; and</text>
 </paragraph><paragraph id="id7A3E20793D7F4455958A2812429D0041"><enum>(2)</enum><text>may subject adjustments to an increase of not more than 10 percent annually for jurisdictions, if the Administrator determines the increase is necessary to allow additional time to appropriately budget for future disasters.</text>
 </paragraph></subsection><subsection changed="deleted" committee-id="SSGA00" id="id60EC917F7D3F4B7484015DAE08462AA7" reported-display-style="strikethrough"><enum>(d)</enum><header>Report</header><text>Not later than 365 days after the date of enactment of this Act, the Administrator shall—</text> <paragraph id="idf8ed17eb40c645398338c1a92d7f9a7e"><enum>(1)</enum><text>submit a report to the committees of jurisdiction of Congress on the initiative to modernize the per capita impact indicator; and</text>
 </paragraph><paragraph id="idd7b4cf6bb0354cfbab691ce0391aba07"><enum>(2)</enum><text>present recommendations for new measures to assess the capacities of States to respond to and recover from disasters.</text>
 </paragraph></subsection></section><section id="id7DF29C4820194138A97F15A95DCD451C"><enum><deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">39</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">38</added-phrase>.</enum><header>Report on insurance shortfalls</header><text display-inline="no-display-inline">Section 311 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5154">42 U.S.C. 5154</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id763BBCC5126643DF8A99C5CE375E02E5" style="OLC">
 <subsection id="id921E1BD29AAC4CDAA2CC9CFEE7052C14"><enum>(d)</enum><header>Report on insurance shortfalls</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this subsection, and each year thereafter, the Administrator of the Federal Emergency Management Agency shall submit a report to Congress on the number of instances and the estimated amounts involved, by State, for cases in which self-insurance amounts have been insufficient to address flood damages.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" committee-id="SSGA00" id="idbeecfe3baca54695a20f3816848802a7" reported-display-style="italic"><enum>39.</enum><header>Post disaster building safety assessment</header>
			<subsection id="idab8106646a97458e9ce9e07f219e068a"><enum>(a)</enum><header>Building safety assessment team</header>
 <paragraph id="id740CBB47BACB4DE08FF6916E6AC93FB0"><enum>(1)</enum><header>In general</header><text>The Administrator shall coordinate with State and local governments and organizations representing architects and engineers to develop guidance, including best practices, for post disaster assessment of buildings by licensed architects and engineers to ensure the architects and engineers properly analyze the structural integrity and livability of buildings and structures.</text>
 </paragraph><paragraph id="id043E85C637184A168C3768E4E73876F9"><enum>(2)</enum><header>Publication</header><text>The Administrator shall publish the guidance required to be developed under paragraph (1) not later than 1 year after the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="id91e15d110408469881791aaf30c56aa5"><enum>(b)</enum><header>National incident management system</header><text>The Administrator shall revise or issue guidance as required to the National Incident Management System to ensure the functions of an architect are accurately incorporated, to include assisting communities in mitigating, preparing for, responding to, and recovering from a disaster, including participating on, managing, and supervising building safety assessment teams.</text>
			</subsection></section><section changed="added" committee-id="SSGA00" id="id01053AFD286941299B8BAC0E0F49BB0F" reported-display-style="italic"><enum>40.</enum><header>FEMA updates on national preparedness assessment</header>
 <text display-inline="no-display-inline">Not later than 6 months after the date of enactment of this Act, and every 6 months thereafter until completion, the Administrator shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives an update on the progress of the Agency in completing action 6 with respect to the report published by the Government Accountability Office entitled <quote>2012 Annual Report: Opportunities to Reduce Duplication, Overlap and Fragmentation, Achieve Savings, and Enhance Revenue</quote> (February 2, 2012), which requires the Agency to—</text>
 <paragraph id="id1ff173ca9ed94be89cc46fbc32c78f4f"><enum>(1)</enum><text>complete a national preparedness assessment of capability gaps at each level based on tiered, capability-specific performance objectives to enable prioritization of grant funding; and</text>
 </paragraph><paragraph id="idDCED782F2F7C454B929E81DDE2E17DC5"><enum>(2)</enum><text>identify the potential costs for establishing and maintaining those capabilities at each level and determine what capabilities Federal agencies should provide.</text>
			</paragraph></section><section changed="added" committee-id="SSGA00" id="id24AB1AB8DD64481584823F052EF358DA" reported-display-style="italic"><enum>41.</enum><header>FEMA report on duplication in non-natural disaster preparedness grant programs</header>
 <text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a report on the results of the efforts of the Agency to identify and prevent unnecessary duplication within and across the non-natural disaster preparedness grant programs of the Agency, as required in the report published by the Government Accountability Office entitled <quote>2012 Annual Report: Opportunities to Reduce Duplication, Overlap and Fragmentation, Achieve Savings, and Enhance Revenue</quote> (February 2, 2012), including with respect to—</text>
 <paragraph id="id392BBD4A4A1A4D588E32E9E7976AA296"><enum>(1)</enum><text display-inline="yes-display-inline">the Urban Area Security Initiative established under section 2003 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/604">6 U.S.C. 604</external-xref>);</text>
 </paragraph><paragraph id="idB43B83A229A2489A9F199778601661D4"><enum>(2)</enum><text display-inline="yes-display-inline">the Port Security Grant Program authorized under section 70107 of title 46, United States Code;</text> </paragraph><paragraph id="idF351E5F3EA52442A95321C4072EB8BDE"><enum>(3)</enum><text display-inline="yes-display-inline">the State Homeland Security Grant Program established under section 2004 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/605">6 U.S.C. 605</external-xref>); and</text>
 </paragraph><paragraph id="id4A4970586374497F851A47E773BFE126"><enum>(4)</enum><text display-inline="yes-display-inline">the Transit Security Grant Program authorized under titles XIV and XV of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1131">6 U.S.C. 1131</external-xref> et seq.).</text>
			</paragraph></section><section changed="added" committee-id="SSGA00" id="idA5E283928C9E4728B3BAD833484408CA" reported-display-style="italic"><enum>42.</enum><header>Extension of unemployment assistance for the Commonwealth of Puerto Rico and the United States
			 Virgin Islands</header>
 <subsection id="idC98471828E4C40EB80A295ED7FF89931"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, in the case of an individual eligible to receive unemployment assistance under section 410(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5177">42 U.S.C. 5177(a)</external-xref>) as a result of a disaster declaration made for Hurricane Irma and Hurricane Maria in the Commonwealth of Puerto Rico and the United States Virgin Islands, the President shall make such assistance available for 52 weeks after the date of the disaster declaration effective as if enacted at the time of the disaster declaration.</text>
 </subsection><subsection id="id883BFECFC3C34FE4B5245D39B031492A"><enum>(b)</enum><header>No additional funds authorized</header><text>No additional funds are authorized to carry out the requirements of this section.</text> </subsection></section><section changed="added" committee-id="SSGA00" id="id7FFB155CC0D3461BA4BA6ED2824E371F" reported-display-style="italic"><enum>43.</enum><header>Study and report</header> <subsection id="idBECA0A5CDF044E25996FBB8112C299C3"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator shall enter into a contract with the National Academy of Medicine to conduct a study and prepare a report as described in subsection (b).</text>
			</subsection><subsection id="id3B6A9B86BD834C068FEE9CD22FB08944"><enum>(b)</enum><header>Study and report</header>
				<paragraph id="id33770A78A6D24A3696408A79D8B870E9"><enum>(1)</enum><header>Study</header>
 <subparagraph id="id09F31926B1014CF9BAE5B8C275E0118E"><enum>(A)</enum><header>In general</header><text>The study described in this subsection shall be a study of matters concerning best practices in mortality counts as a result of a major disaster (as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)).</text>
 </subparagraph><subparagraph id="idd05ac50990a2480aa33853a7174a4f72"><enum>(B)</enum><header>Contents</header><text>The study described in this subsection shall address approaches to quantifying mortality and significant morbidity among populations affected by major disasters, which shall include best practices and policy recommendations for—</text>
 <clause id="id2a5e56aa85be4600baec87b8ed89e5e8"><enum>(i)</enum><text>equitable and timely attribution, in order to facilitate access to available benefits, among other things;</text>
 </clause><clause id="id25834e8247714672ba05dff3319bc5dc"><enum>(ii)</enum><text>timely prospective tracking of population levels of mortality and significant morbidity, and their causes, in order to continuously inform response efforts; and</text>
 </clause><clause id="id353196f53b00489789621be715c16b06"><enum>(iii)</enum><text>a retrospective study of disaster-related mortality and significant morbidity to inform after-action analysis and improve subsequent preparedness efforts.</text>
 </clause></subparagraph></paragraph><paragraph id="id55034af3c2f54624898a0e4d220bcc77"><enum>(2)</enum><header>Report</header><text>Not later than 2 years after the date on which the contract described in subsection (a) is entered into, the National Academy of Medicine shall complete and transmit to the Administrator a report on the study described in paragraph (1).</text>
 </paragraph></subsection><subsection id="idEEA8F9B57F8741F8B120BB152660FE4A"><enum>(c)</enum><header>No additional funds authorized</header><text>No additional funds are authorized to carry out the requirements of this section.</text> </subsection></section><section changed="added" committee-id="SSGA00" id="id1D17B6B1CAD6412BB950FDB8313B5F8D" reported-display-style="italic"><enum>44.</enum><header>Review of assistance for damaged underground water infrastructure</header> <subsection id="id69DF0B860D764A7C8B5DBD610F4927D1"><enum>(a)</enum><header>Definition of public assistance grant program</header><text>The term <term>public assistance grant program</term> means the public assistance grant program authorized under sections 403, 406, 407, and 502(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b</external-xref>, 5172, 5173, 5192(a)).</text>
 </subsection><subsection id="id1F41C205EB0D4CB19FE63106C23EC279"><enum>(b)</enum><header>Review and briefing</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator shall—</text> <paragraph id="id1E995A6C1517495CBC6614F2BB06DE30"><enum>(1)</enum><text>conduct a review of the assessment and eligibility process under the public assistance grant program and the public notice and comment requirements under section 325(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5165c">42 U.S.C. 5165c(a)</external-xref>) with respect to assistance provided for damaged underground water infrastructure as a result of a major disaster declared under section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), including wildfires; and</text>
 </paragraph><paragraph id="id5D959FB0B4CD45AD826D4967DC7095B6"><enum>(2)</enum><text>provide to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a briefing on the review conducted under paragraph (1).</text>
 </paragraph></subsection><subsection id="idBB1BAACF52D24C52992DAE70679EE824"><enum>(c)</enum><header>Report and recommendations</header><text>The Administrator shall—</text> <paragraph id="idDEE10E5DB36045D0ACBA7BDD31F48388"><enum>(1)</enum><text>not later than 180 days after the date of enactment of this Act, issue a report on the review conducted under subsection (b)(1); and</text>
 </paragraph><paragraph id="id7210A2404D8A45BF9C72CF45D034E3C9"><enum>(2)</enum><text>not later than 180 days after the date on which the Administrator issues the report required under paragraph (1), implement any recommendations contained in the report.</text>
