		<official-title>To amend the Food Security Act of 1985 to encourage soil health, and for other
			 purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conservation for Very Erodible Row Cropland Act of 2018</short-title></quote> or the <quote><short-title>COVER Act</short-title></quote>.</text>
 </section><section id="id6D56EF2EEE704C3A8BFDEFCE9CE10F7B"><enum>2.</enum><header>Soil health initiative</header><text display-inline="no-display-inline">Section 1240B of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idCCCA67A416684B9A86BF6F5A135DA7E5" style="OLC">
				<subsection id="id4FC7394C85774CB3953F9A69E3B8D381"><enum>(j)</enum><header>Soil health initiative</header>
 <paragraph commented="no" id="id7a74105bd4a24454947d07624f925f51"><enum>(1)</enum><header>Definition of cover crop</header><text>In this subsection, the term <quote>cover crop</quote> means a grass, legume, or forb that is planted for seasonal vegetative cover.</text> </paragraph><paragraph id="id28C7FBC6880946F895C3A3B5BBBEDF9C"><enum>(2)</enum><header>Soil health initiative</header> <subparagraph id="id5B042D8245744055BAEB7BD9824F13C1"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide payments under the program for practices that—</text>
 <clause id="id2D1886626DF1439E89F0047FB4F34CAE"><enum>(i)</enum><text>improve soil health;</text> </clause><clause id="id9937CD5066AE49CE866C30E6BEF8AEAD"><enum>(ii)</enum><text>enhance the ability of a farmer to absorb and recover from shocks and stresses to production;</text>
 </clause><clause id="id387C1A2150724764AE29614B4AF5F88F"><enum>(iii)</enum><text>increase the storage of carbon on agricultural land; and</text> </clause><clause id="id8DC4827BCB9D42539462BE7883BCA349"><enum>(iv)</enum><text>achieve other conservation outcomes, as determined by the Secretary.</text>
 </clause></subparagraph><subparagraph id="ided9979870da84846b7e74781db0c212f"><enum>(B)</enum><header>Diversity</header><text>The Secretary shall ensure that producers receiving payments for practices described in clauses (i) through (iv) of subparagraph (A) are located in areas that reflect diverse conditions with respect to region, water quantity, and agricultural practice.</text>
						</subparagraph></paragraph><paragraph id="id158D08A80F6B4953932364D8A6014C65"><enum>(3)</enum><header>Soil health practices</header>
 <subparagraph id="idD8E6BC0C4509420AB180B44FF2BDE300"><enum>(A)</enum><header>In general</header><text>Practices that improve soil health under paragraph (2)(A)(i) shall—</text> <clause id="id12A654B41F814ACDB705434AD495401C"><enum>(i)</enum><text>reflect regional soil and climate conditions; and</text>
 </clause><clause id="idF37C3038140743AF8D55B83E965E13C1"><enum>(ii)</enum><text>include—</text> <subclause id="idB4148B7E491E4002B29528AC58703AD5"><enum>(I)</enum><text>any practice that improves soil health, as determined by the Secretary; and</text>
 </subclause><subclause id="id0051F2AA832944B29DAD5EAFE6E361EB"><enum>(II)</enum><text>not fewer than two of the practices described in subparagraph (B).</text> </subclause></clause></subparagraph><subparagraph id="id9EC830C8F56B4CCA91AC123CA66FE8A1"><enum>(B)</enum><header>Practices described</header><text>The practices referred to in subparagraph (A)(ii)(II) are the following:</text>
 <clause id="id29D2E2E43EC346649A74D581825F97CD"><enum>(i)</enum><text>The planting of a regionally appropriate cover crop.</text> </clause><clause id="id3109DBAC0CB4417C8E50E62E0103A6D5"><enum>(ii)</enum><text>No-till or reduced-till agriculture.</text>
 </clause><clause id="id6580ADAB614B485AA41B5AC49F071A1B"><enum>(iii)</enum><text>Resource-conserving crop rotation.</text> </clause><clause id="idA1CDCF9C6DA346BAB64C33717F43EE31"><enum>(iv)</enum><text>The use of organic soil amendments, including compost, biochar, and digestate.</text>
 </clause><clause id="idA4D29E191C594E2E83F4CFF5DBC24C3C"><enum>(v)</enum><text>The integration of livestock grazing.</text> </clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="idECF2F6D07921436ABDCF7E7167E51C8B"><enum>3.</enum><header>Cover crop pilot program</header><text display-inline="no-display-inline">Section 1240H of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-8">16 U.S.C. 3839aa–8</external-xref>) is amended—</text>
 <paragraph id="idF240BFF9E2EE45B6B69A8C1188A79858"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text> </paragraph><paragraph id="idD616486B16764DED9B40DE13206AFFB9"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC1EDF78F3C504546A01EC551774F34E6" style="OLC">
					<subsection id="idD6F3FF623EE040B8ABC192F747E26AD1"><enum>(c)</enum><header>Cover crop pilot program</header>
 <paragraph id="idD60450D06FF644608B726141291BD81D"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a pilot program to provide payments under this subsection to producers to encourage—</text>
 <subparagraph id="idE78576C7B5CB4AB4A28AA4D8A0848AB7"><enum>(A)</enum><text>the measurement of outcomes relating to the planting of a regionally appropriate cover crop; and</text> </subparagraph><subparagraph id="idA190ECCC364B40F4BAF570443AD4A900"><enum>(B)</enum><text>opportunities to increase farm income.</text>
 </subparagraph></paragraph><paragraph id="id350E0550FDBA462486A9B84D2DCA8F77"><enum>(2)</enum><header>Third-party partners</header><text>In carrying out the pilot program under paragraph (1), the Secretary shall give priority to producers that partner with—</text>
 <subparagraph id="id872152E1F8674E9EBC4B7F9A365BA80E"><enum>(A)</enum><text>academic entities to study the impact of soil carbon sequestration on soil health and farm productivity;</text>
 </subparagraph><subparagraph id="id27C683678A4441B58A3806C825E3ED8A"><enum>(B)</enum><text>carbon offset protocol developers to develop quantification methodologies for carbon offset protocols;</text>
 </subparagraph><subparagraph id="idF64950CB182F48CFB3D04F578FA64FB4"><enum>(C)</enum><text>livestock producers to integrate grazing where regionally appropriate; or</text> </subparagraph><subparagraph id="id602C3533B471452698C911B8B2503AFB"><enum>(D)</enum><text>food manufacturers—</text>
 <clause id="ide2ea7b7775a24b30b207ce99e7108c46"><enum>(i)</enum><text>to enter into supply agreements for food produced under the pilot program; and</text> </clause><clause id="id7fa57d2a8a9947b2b5d8ebd9f9a6a1cf"><enum>(ii)</enum><text>to develop marketing products relating to the soil health benefits of that food.</text>
 </clause></subparagraph></paragraph><paragraph id="idE6B0D9E4674A4798A4C2F13700CEF692"><enum>(3)</enum><header>Diversity</header><text>The Secretary shall ensure that producers receiving payments under paragraph (1)—</text> <subparagraph id="idA6292CDB075E43B8B93CE59FE7F91BB1"><enum>(A)</enum><text>are located in areas that reflect diverse conditions with respect to region, water quantity, and agricultural practice; and</text>
 </subparagraph><subparagraph id="id759DABBBD9474E9B9391DC58C04296F2"><enum>(B)</enum><text>plant regionally appropriate cover crops that enhance nutrient cycling and the capacity of soil to hold water.</text>
 </subparagraph></paragraph><paragraph id="id1EF9F84DC77448ABA625F75D45964668"><enum>(4)</enum><header>Funding</header><text>Of the funds made available to carry out this chapter, the Secretary shall use to carry out this subsection $20,000,000 for each of fiscal years 2019 through 2023.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
