and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H49083B045C8E49FCACC6EF7754795074"><enum>(2)</enum><text display-inline="yes-display-inline">an election of proceeding, as provided in this section, of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idCDF6D357098447419CD6466E4968F9C9"><enum>(A)</enum><text display-inline="yes-display-inline">a formal hearing as provided in section 405, subject to Board review as provided in section 406, and judicial review in the United States Court of Appeals for the Federal Circuit as provided in section 407;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA40F1BEA8E294489BA8E50CEC59C278D"><enum>(B)</enum><text display-inline="yes-display-inline">a civil action in a district court of the United States as provided in section 408; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB0ED488AC6E148AC84A77FB9F1C896D0"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a Library claimant (as defined in subsection (d)(1)), a proceeding described in subsection (d)(2) that relates to the violation at issue.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF7787BBF7E114157AD93F8E3294AF1EC"><enum>(b)</enum><header display-inline="yes-display-inline">Election of formal hearing or civil action</header><paragraph commented="no" display-inline="no-display-inline" id="idEB90D1FE0F964FF0975262225FB16224"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A covered employee who seeks to make—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4CBDD8C71CBC4643BC7667F0106048B9"><enum>(A)</enum><text display-inline="yes-display-inline">the election described in subsection (a)(2)(A) shall file the request for the formal hearing as provided in section 405(a)(1), by the deadline described in paragraph (2); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1D0BAEC205704DBDAF83D2CDE48C39A7"><enum>(B)</enum><text display-inline="yes-display-inline">the election described in subsection (a)(2)(B) shall file the civil action as provided in section 408, by the deadline described in paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC0E031B439B04A56A6B309A98C6BB161"><enum>(2)</enum><header display-inline="yes-display-inline">Deadline for election</header><text display-inline="yes-display-inline">The deadline described in this paragraph shall be 90 days after the later of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD16D0E80C261439AAA3B7EEA620605BB"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which either party opts out of mediation under section 402(c); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id49382844D51A4065BEA5BB72360A3D91"><enum>(B)</enum><text display-inline="yes-display-inline">the end of the period of mediation under section 403(c).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD441A86AEF7458B9E607D796C2ED578"><enum>(3)</enum><header display-inline="yes-display-inline">Effect of election</header><text display-inline="yes-display-inline">If the covered employee—</text><subparagraph commented="no" display-inline="no-display-inline" id="id86FB2C44E4DD44869590D2CC2FA5DD4C"><enum>(A)</enum><text display-inline="yes-display-inline">elects to file a request for a formal hearing as provided in section 405(a), the procedure for consideration of the claim shall not include a civil action or other proceeding described in subparagraph (B) or (C) of subsection (a)(2); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEEBCE6D059814B54B0CCB59C60944549"><enum>(B)</enum><text display-inline="yes-display-inline">elects to file a civil action as provided in section 408(a), the procedure for consideration of the claim shall not include any formal hearing, review, or other proceeding described in subparagraph (A) or (C) of subsection (a)(2).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0975CC508800497FAABC1C0AAB604EEF"><enum>(c)</enum><header display-inline="yes-display-inline">Special rule for Architect of the Capitol and Capitol Police</header><text display-inline="yes-display-inline">In the case of an employee of the Office of the Architect of the Capitol or of the Capitol Police, the Office, after receiving a claim filed under section 402, may recommend that the employee use, for a specific period of time, the grievance procedures of the Architect of the Capitol or the Capitol Police for resolution of the employee’s grievance. If the grievance procedures do not resolve the grievance, the employee may resume the procedure described in subsection (a), starting with section 403, except that the deadline for opting out of mediation under that section shall be 10 business days after the last day of the grievance procedures.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id31A7E0ADABC24178945E3AC61296DA83"><enum>(d)</enum><header display-inline="yes-display-inline">Election of remedies for Library of Congress</header><paragraph commented="no" display-inline="no-display-inline" id="id10B80CD371624901BDC3FDF69147A668"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id9BF275245D62423596A4AEB934181442"><enum>(A)</enum><header display-inline="yes-display-inline">Direct Act</header><text display-inline="yes-display-inline">The term <term>direct Act</term> means an Act (other than this Act), or provision of the Revised Statutes, that is specified in section 201, 202, or 203.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0065ADEB164840A586A4942830311D1D"><enum>(B)</enum><header display-inline="yes-display-inline">Direct provision</header><text display-inline="yes-display-inline">The term <term>direct provision</term> means a provision (including a definitional provision) of a direct Act that applies the rights or protections of a direct Act (including rights and protections relating to nonretaliation or noncoercion) to a Library claimant.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC1E33D42E4F041E79997DEF028CC4908"><enum>(C)</enum><header display-inline="yes-display-inline">Library claimant</header><text display-inline="yes-display-inline">The term <term>Library claimant</term> means, with respect to a direct provision, an employee of the Library of Congress who is covered by that direct provision.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H91454C19BF4C43C4BC421F50E3498190"><enum>(2)</enum><header display-inline="yes-display-inline">Election after proceedings initially brought under this Act</header><text display-inline="yes-display-inline">A Library claimant who initially files a claim for an alleged violation as provided in section 402 may, instead of proceeding with the claim in accordance with sections 403 (if applicable) and 405 or filing a civil action in accordance with section 408, during the period described in subsection (b)(2) but before the Office commences a formal hearing under section 405, elect to bring the claim for a proceeding before the corresponding Federal agency, under the corresponding direct provision.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30E90DBFCD084D0FA2AAAE5C4E097D3C"><enum>(3)</enum><header display-inline="yes-display-inline">Election after proceedings initially brought under other civil rights or labor law</header><text display-inline="yes-display-inline">A Library claimant who initially brings a claim, complaint, or charge under a direct provision for a proceeding before a Federal agency may, prior to requesting a hearing under the agency's procedures, elect to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idA74B1D0B534D4158985454338AD92290"><enum>(A)</enum><text display-inline="yes-display-inline">continue with the agency's procedures and preserve the option (if any) to bring any civil action relating to the claim, complaint, or charge, that is available to the Library claimant; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5C6E057E902E45CF8E87D0E4A2B2A154"><enum>(B)</enum><text display-inline="yes-display-inline">file a claim with the Office under section 402, make an election under subparagraph (A) or (B) of section 401(a)(2), and continue with the corresponding procedures of this subtitle.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id653D9AF12F2A438B9724B95A45EBBBAA"><enum>(4)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">This subsection shall take effect and shall apply as described in section 153(c) of the Legislative Branch Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) (except to the extent such section applies to any violation of section 210 or a provision of an Act specified in section 210).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3782e27446164c5f9ca748b632dd122b"><enum>(e)</enum><header display-inline="yes-display-inline">Rights of individuals To retain private counsel</header><text display-inline="yes-display-inline">Nothing in this Act may be construed to limit the authority of any particular individual, including a covered employee, the head of an employing office, or an individual who has a right to intervene under section 415(d)(6), to retain private counsel to protect the interests of the particular individual at any point during any of the procedures provided under this Act for the consideration of an alleged violation of part A of title II, including procedures described in section 415(d)(6).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idaae1523245824a5cb7ac15103da56119"><enum>(f)</enum><header display-inline="yes-display-inline">Standards for designated representatives or unrepresented parties</header><paragraph commented="no" display-inline="no-display-inline" id="idDA6D9CBF753D400D813030139AF3A3CB"><enum>(1)</enum><header display-inline="yes-display-inline">Standards</header><text display-inline="yes-display-inline">Each designated representative of a party, and unrepresented party, participating in any of the procedures (including proceedings) provided under this Act shall have an obligation to ensure that, to the best of that designated representative or unrepresented party's knowledge, information, and belief, as formed after an inquiry which is reasonable under the circumstances, each of the following is correct:</text><subparagraph commented="no" display-inline="no-display-inline" id="id7e13bb107acb4a6ca440754ebb0c2864"><enum>(A)</enum><text display-inline="yes-display-inline">No pleading, written motion, or other paper is presented for any improper purpose, such as to harass, cause unnecessary delay, or needlessly increase the cost of resolution of the matter.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id050056a72b3b4b5da69ec6e6cc594208"><enum>(B)</enum><text display-inline="yes-display-inline">The claims, defenses, and other legal contentions the designated representative or unrepresented party advocates are warranted by existing law or by a nonfrivolous argument for extending, modifying, or reversing existing law or for establishing new law.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf72b71898d5847eda66900846cf79141"><enum>(C)</enum><text display-inline="yes-display-inline">The factual contentions have evidentiary support or, if specifically so identified, will likely have evidentiary support after a reasonable opportunity for discovery.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id49a265caa92b49bf8af7fb4cede39f28"><enum>(D)</enum><text display-inline="yes-display-inline">The denials of factual contentions are warranted on the evidence or, if specifically so identified, are reasonably based on belief or a lack of information.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2122167C0F0D43E099F2A54509CDB82B"><enum>(2)</enum><header display-inline="yes-display-inline">Sanctions</header><subparagraph commented="no" display-inline="no-display-inline" id="idAC17F2C70CAD488FA766EEC311DBB13D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a decisionmaker described in subparagraph (B) determines that a designated representative of a party, or unrepresented party, has failed to comply with the standards specified in paragraph (1), then that decisionmaker may impose appropriate sanctions.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDFB7DC7D4BFC4393B15433174CBE8FB4"><enum>(B)</enum><header display-inline="yes-display-inline">Decisionmaker</header><text display-inline="yes-display-inline">A decisionmaker described in subparagraph (A) is—</text><clause commented="no" display-inline="no-display-inline" id="id3E5DE1E1555743C0B964150F41A5DD67"><enum>(i)</enum><text display-inline="yes-display-inline">a hearing officer or mediator chosen from the list specified in section 405(c)(2), who is not serving as a hearing officer or mediator to resolve any claim filed under section 402 that is associated with—</text><subclause commented="no" display-inline="no-display-inline" id="id7896A436412B453FAEEB7655E0590473"><enum>(I)</enum><text display-inline="yes-display-inline">the designated representative or unrepresented party; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idA5D9060413C547DDA31AB279389CB9C6"><enum>(II)</enum><text display-inline="yes-display-inline">an individual identified in claim.</text></subclause></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HC6121369BF3548E0B5C0CD0E4B55D0F4"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment relating to civil action</header><text display-inline="yes-display-inline">Section 408(a) (<external-xref legal-doc="usc" parsable-cite="usc/2/1408">2 U.S.C. 1408(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H06E5D1BCFE5641F999C431CDFE8185F1"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>section 404</quote> and inserting <quote>section 401</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H39BB9D4D8DDA484BAB3100778C86CE8F"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>who has completed counseling under section 402 and mediation under section 403</quote> and inserting <quote>who filed a timely claim under section 402, elected to file a civil action under section 401(a)(2)(B), and made a timely filing under this section as described in section 401(b)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0E62164F150429F919AB1A21A650995"><enum>(1)</enum><header display-inline="yes-display-inline">Notification of intent to file</header><text display-inline="yes-display-inline">To commence a proceeding under this title, a covered employee alleging a violation of law made applicable under part A of title II shall notify the Office of intent to file a claim with the Office.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id030DF8B3FEB342F4BC0D21A6F381B995"><enum>(2)</enum><header display-inline="yes-display-inline">Information</header><text display-inline="yes-display-inline">On receiving a notification under paragraph (1), the Office shall provide to the covered employee all relevant information with respect to the employee's and the employing office's rights under this Act, the process for filing the claim, and the option for the employee to elect, if the employee so chooses, to file a civil action regarding the alleged violation. The Office shall discuss the information and covered employee's claim with the covered employee. The Office shall initiate the procedures described in this paragraph on the date of the notification.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9a70e19c654b407aa7150f16a51c8a7c"><enum>(3)</enum><header display-inline="yes-display-inline">Filing</header><text display-inline="yes-display-inline">Upon providing the notification described in paragraph (1), and not later than the expiration of the 180-day period in subsection (e), the covered employee may file the claim. The claim shall be made in writing under oath or affirmation, shall describe the facts that form the basis of the claim and the violation that is being alleged, shall identify the employing office alleged to have committed the violation or in which the violation is alleged to have occurred, and shall be in such form as the Office requires.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H591603FFEC344EE1BE51ABA306D3FE09"><enum>(b)</enum><header display-inline="yes-display-inline">Initial processing of claim</header><text display-inline="yes-display-inline">Upon the filing of a claim by a covered employee under subsection (a), the Office shall take such steps as may be necessary for the initial intake and recording of the claim and shall transmit a copy of the claim to the head of the employing office not later than 3 business days after the date on which the claim is filed.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide24873137d584c3e90b5b999c5369793"><enum>(c)</enum><header display-inline="yes-display-inline">Mediation</header><paragraph commented="no" display-inline="no-display-inline" id="id53984d66bfb24449979dc0c91345eb6f"><enum>(1)</enum><header display-inline="yes-display-inline">Notification of right to opt out of mediation</header><subparagraph commented="no" display-inline="no-display-inline" id="idb4949d7c32b04982bfdc37ecd2ecd65d"><enum>(A)</enum><header display-inline="yes-display-inline">Covered employee</header><text display-inline="yes-display-inline">Upon receipt of a claim, the Office shall notify the covered employee about the process for mediation under section 403, the right to opt out of the mediation, and the deadline for opting out of the mediation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id73e7b8c5e12d4bf49559865bb1281403"><enum>(B)</enum><header display-inline="yes-display-inline">Employing office</header><text display-inline="yes-display-inline">Upon transmission to the employing office of the claim pursuant to subsection (b), the Office shall notify the employing office about the process for mediation under section 403, the right to opt out of the mediation, and the deadline for opting out of the mediation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67e31cdaf0e0459d99836b63745813df"><enum>(2)</enum><header display-inline="yes-display-inline">Deadline to opt out of mediation</header><text display-inline="yes-display-inline">Either party may opt out of the mediation. The deadline for opting out shall be 10 business days after the date on which the claim that would be the subject of the mediation is filed.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1769862D69CD49899F5792A3F714A079"><enum>(d)</enum><header display-inline="yes-display-inline">Use of electronic reporting and tracking system</header><paragraph commented="no" display-inline="no-display-inline" id="HA963A6C4C87B4A99BAB58A170C8DA1F4"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment and operation of system</header><text display-inline="yes-display-inline">The Office shall establish and operate an electronic reporting and tracking system through which a covered employee may initiate a proceeding under this title, and which will keep an electronic record of the date and time at which the proceeding is initiated and will track all subsequent actions or proceedings occurring with respect to the proceeding under this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E88CF30251B4F8D9E88E7971CB38BD3"><enum>(2)</enum><header display-inline="yes-display-inline">Accessibility to all parties</header><text display-inline="yes-display-inline">The system shall be accessible to all parties to such actions or proceedings, but only until the completion of such actions or proceedings.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF1B471221A624294A133420F8C82A480"><enum>(3)</enum><header display-inline="yes-display-inline">Assessment of effectiveness of procedures</header><text display-inline="yes-display-inline">The Office shall use the information contained in the system to make regular assessments of the effectiveness of the procedures under this title in providing for the timely resolution of claims, and shall submit semiannual reports on such assessments each year to the Committee on House Administration and the Committee on Appropriations of the House of Representatives and the Committee on Rules and Administration and the Committee on Appropriations of the Senate.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD7E0CBD7C2ED4B90B8F8CF6E7B0B53E7"><enum>(e)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">A covered employee may not file a claim under this section with respect to an allegation of a violation of law after the expiration of the 180-day period which begins on the date of the alleged violation. The Office shall not accept a claim that does not meet the requirements of this subsection.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H7AB9A8F7CF1C499BBAA0DE664A4EBEF0"><enum>(f)</enum><header display-inline="yes-display-inline">No effect on ability of covered employee To seek information from Office or pursue relief</header><text display-inline="yes-display-inline">Nothing in this section may be construed to limit the ability of a covered employee—</text><paragraph commented="no" display-inline="no-display-inline" id="H2829A1E7316A487389B16DC7F6688886"><enum>(1)</enum><text display-inline="yes-display-inline">to contact the Office or any other appropriate office prior to filing a claim under this title to seek information regarding the employee’s rights under this Act and the procedures available under this Act; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB8CFE54165714224B0BA4A5CADEEF7F1"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a covered employee of an employing office described in subparagraph (A), (B), or (C) of section 101(9), to refer information regarding an alleged violation of part A of title II to the Committee on Ethics of the House of Representatives or the Select Committee on Ethics of the Senate (as the case may be).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H6B62B35BD8004637823999FFB7135223"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents is amended by amending the item relating to section 402 to read as follows:</text><quoted-block display-inline="no-display-inline" id="H344CDF6C87844821ADC80239DFCEF787" style="OLC"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">Sec. 402. or</text></clause><clause commented="no" display-inline="no-display-inline" id="id7ad56708a92b4af195b258c469420546"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a violation of section 201(a) on the basis of sex, conduct by an individual described in subparagraph (A) that is an unwelcome sexual advance or request for sexual favors, when—</text><subclause commented="no" display-inline="no-display-inline" id="id0F6D020B67FF401A9A039DF9F9601347"><enum>(I)</enum><text display-inline="yes-display-inline">submission to such conduct is made either explicitly or implicitly a term or condition of the covered employee's employment; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0B2FE16614C349AFBFD2D5E31309E15B"><enum>(II)</enum><text display-inline="yes-display-inline">submission to or rejection of such conduct by the employee is used as the basis for an employment decision affecting such employee.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14B89CD898B44BFB9EB212E9FA8E3B8B"><enum>(2)</enum><header display-inline="yes-display-inline">Withholding amounts from compensation</header><subparagraph commented="no" display-inline="no-display-inline" id="HE84FB525A06A4CFFB9A3591C0E5813EE"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment of timetable and procedures by Committees</header><text display-inline="yes-display-inline">For purposes of carrying out subparagraph (B), the applicable Committee shall establish a timetable and procedures for the withholding of amounts from the compensation of an individual who is a Member of the House of Representatives or a Senator.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA272686966314123BEE3665357BA174D"><enum>(B)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">The payroll administrator shall withhold from an individual’s compensation and transfer to the account described in subsection (a) (after transferring to the account of the individual in the Thrift Savings Fund any amount that the individual had requested to be so transferred) such amounts as may be necessary to reimburse the account described in subsection (a) for the reimbursable portion of the award or settlement described in paragraph (1) if the individual has not reimbursed the account as required under paragraph (1) prior to the expiration of the 90-day period which begins on the date a payment is made from the account for such an award or settlement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1BE0C25E72E8454D906AAEC41990DA00"><enum>(C)</enum><header display-inline="yes-display-inline">Applicable committee defined</header><text display-inline="yes-display-inline">In this paragraph, the <quote>applicable Committee</quote> means—</text><clause commented="no" display-inline="no-display-inline" id="H93DF75FE5AA9419798C0FBEB25E65B59"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on House Administration of the House of Representatives, in the case of an individual who, at the time of the withholding, is a Member of the House; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HA4BC92CD964E4391AFCE7A118B5076EC"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Rules and Administration of the Senate, in the case of an individual who, at the time of the withholding, is a Senator.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6081ab364f92480792006fc23615cc35"><enum>(3)</enum><header display-inline="yes-display-inline">Administrative wage garnishment or other collection of wages from a subsequent position</header><subparagraph commented="no" display-inline="no-display-inline" id="id95033ba878094e62b4c046ad486fc859"><enum>(A)</enum><header display-inline="yes-display-inline">Individual subject to garnishment or other collection</header><text display-inline="yes-display-inline">Subparagraph (B) shall apply to an individual who is subject to the reimbursement requirement of this subsection if, by the expiration of the 180-day period that begins on the date a payment is made from the account described in subsection (a) relating to an award or settlement described in paragraph (1), the individual—</text><clause commented="no" display-inline="no-display-inline" id="id34a580d9b02241d299f882288e8f6452"><enum>(i)</enum><text display-inline="yes-display-inline">has not reimbursed the account for the entire reimbursable portion as required under paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1d9134e8a2984ef39648bcd17b35580d"><enum>(ii)</enum><text display-inline="yes-display-inline">is not employed as a Member of the House of Representatives or a Senator but is employed in a subsequent non-Federal position.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id404c01f6f8584e1b877013b00cc303fe"><enum>(B)</enum><header display-inline="yes-display-inline">Garnishment or other collection of wages</header><text display-inline="yes-display-inline">On the expiration of that 180-day period, the amount of the reimbursable portion of an award or settlement described in paragraph (1) (reduced by any amount the individual has reimbursed, taking into account any amounts withheld under paragraph (2)) shall be treated as a delinquent nontax debt and transferred to the Secretary of the Treasury for collection. Upon that transfer, the Secretary of the Treasury shall collect the debt, in accordance with section 3711 of title 31, United States Code, including by administrative wage garnishment of the wages of the individual described in subparagraph (A) from the position described in subparagraph (A)(ii). The Secretary of the Treasury shall transfer the collected amount to the account described in subsection (a).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22B5A56B91E94BCD87FF4C23C5C17511"><enum>(4)</enum><header display-inline="yes-display-inline">Notification to Office of Personnel Management and Secretary of the Treasury</header><text display-inline="yes-display-inline">If the individual does not obtain employment in a subsequent position referred to in paragraph (3)(A)(ii), not later than 90 days after the individual is first no longer receiving compensation as a Member or a Senator, the amounts withheld or collected under this subsection have not been sufficient to reimburse the account described in subsection (a) for the reimbursable portion of the award or settlement described in paragraph (1), the payroll administrator—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4F7F7FE60771478880214A6251857AD0"><enum>(A)</enum><text display-inline="yes-display-inline">shall notify the Director of the Office of Personnel Management, who shall take such actions as the Director considers appropriate to withhold from any annuity payable to the individual under chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, and transfer to the account described in subsection (a), such amounts as may be necessary to reimburse the account for the reimbursable portion of an award or settlement described in paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9E2C57D6911C43C59EA1A941D20FED32"><enum>(B)</enum><text display-inline="yes-display-inline">shall notify the Secretary of the Treasury, who (if necessary), notwithstanding section 207 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/407">42 U.S.C. 407</external-xref>), shall take such actions as the Secretary of the Treasury considers appropriate to withhold from any payment to the individual under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref> et seq.) and transfer to the account described in subsection (a), such amounts as may be necessary to reimburse the account for the reimbursable portion of an award or settlement described in paragraph (1).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7B262390F5C040309D5E961E86B1D1FA"><enum>(5)</enum><header display-inline="yes-display-inline">Coordination between OPM and Treasury</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management and the Secretary of the Treasury shall carry out paragraph (4) in a manner that ensures the coordination of the withholding and transferring of amounts under such paragraph, in accordance with regulations promulgated by the Director and the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7B0690890B0247A2A9E5ADAE54011D42"><enum>(6)</enum><header display-inline="yes-display-inline">Right to intervene</header><text display-inline="yes-display-inline">An individual who is subject to the reimbursement requirement of this subsection shall have the unconditional right to intervene in any mediation, hearing, or civil action under this title to protect the interests of the individual in the determination of whether an award or settlement described in paragraph (1) should be made, and the amount of any such award or settlement, except that nothing in this paragraph may be construed to require the covered employee who filed the claim to be deposed by counsel for the individual in a deposition that is separate from any other deposition taken from the employee in connection with the hearing or civil action.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC667977ABBA648F4910EFBAD3EF1531E"><enum>(7)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection, the term <term>payroll administrator</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3508FB0BBCDF4C7587FEE798C7DF7B0B"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of an individual who is a Member of the House of Representatives, the Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this subsection; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2CD0F5FD4708446D932F34FB60BFD243"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an individual who is a Senator, the Secretary of the Senate, or an employee of the Office of the Secretary of the Senate who is designated by the Secretary to carry out this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HD0FF3CCEE5354CCCBBFCA3E7E0674AC0"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to claims made on or after the date of the enactment of this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H00AD2F0CC7874DC68BC59A5B51D7C93D" section-type="subsequent-section"><enum>112.</enum><header display-inline="yes-display-inline">Automatic referral to congressional ethics committees of disposition of certain claims alleging
			 violations of Congressional Accountability Act of 1995 involving Members
 of Congress and senior staff</header><text display-inline="no-display-inline">Section 416(e) (<external-xref legal-doc="usc" parsable-cite="usc/2/1416">2 U.S.C. 1416(e)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H9C3DA9C65C7F43C8AA2B386943D591A1" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H14E1FCC00E564B81A81C3B5CD110A56D"><enum>(e)</enum><header display-inline="yes-display-inline">Automatic referrals to Congressional Ethics Committees of dispositions of claims involving Members of Congress and senior staff</header><paragraph commented="no" display-inline="no-display-inline" id="idbc185c5ba6ec4ff8b579ee6ad2b7d496"><enum>(1)</enum><header display-inline="yes-display-inline">Referral</header><text display-inline="yes-display-inline">Upon the final disposition under this title (as described in paragraph (6)) of a claim alleging a violation of section 201(a) or 206(a) that is perpetrated directly against a covered employee by a Member of the House of Representatives (including a Delegate or Resident Commissioner to the Congress) or a Senator, or by a senior staffer of an employing office described in subparagraph (A) or (B) of section 101(9), the Executive Director shall refer the claim to—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0C40301A780A4CED91A40621BD49B1A5"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Ethics of the House of Representatives, in the case of a Member or senior staffer of the House (including a Delegate or Resident Commissioner to the Congress); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDC271F461DA04FFC88FB2972B3945424"><enum>(B)</enum><text display-inline="yes-display-inline">the Select Committee on Ethics of the Senate, in the case of a Senator or senior staffer of the Senate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8838B6375A0541AB8102BB1762B94282"><enum>(2)</enum><header display-inline="yes-display-inline">Access to records and information</header><text display-inline="yes-display-inline">If the Executive Director refers a claim to a Committee under paragraph (1), the Executive Director shall provide the Committee with access to the settlement documents in the case of a settlement and findings by the hearing officer involved in the case of an award under this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9060F2B4DAC348C0BEDF2BB442EFF1E3"><enum>(3)</enum><header display-inline="yes-display-inline">Review by congressional ethics committees of settlements of certain claims</header><text display-inline="yes-display-inline">After the receipt of a settlement agreement for a claim that includes an allegation of a violation of section 201(a) or 206(a) that is perpetrated directly against a covered employee as described in section 415(d)(1)(D) by a Member of the House of Representatives (including a Delegate or a Resident Commissioner to the Congress) or a Senator, the corresponding committee described in paragraph (1) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idA69E00E0749A4EA0B80BC38BCC6A81B3"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 90 days after that receipt, review the settlement agreement;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5325F3E3E5E343C39B986D89389FCD48"><enum>(B)</enum><text display-inline="yes-display-inline">determine whether an investigation of the claim is warranted; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB32DD713993B4E6B9D81C4E8D26BA95F"><enum>(C)</enum><text display-inline="yes-display-inline">if the committee determines, after the investigation, that the claim that resulted in the settlement involved an actual violation of section 201(a) or 206(a) perpetrated directly against a covered employee as described in section 415(d)(1)(D) by the Member or Senator, then the committee shall notify the Executive Director to request the reimbursement described in section 415(d) and include the settlement in the report required by section 301(l).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8309D87E23B843D583CC8AE670EAD016"><enum>(4)</enum><header display-inline="yes-display-inline">Protection of personally identifiable information</header><text display-inline="yes-display-inline">If a Committee to which a claim is referred under paragraph (1) issues a report with respect to the claim, the Committee shall ensure that the report does not directly disclose the identity or position of the individual who filed the claim.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81c3862b3e614e6a84d1b339bde34c57"><enum>(5)</enum><header display-inline="yes-display-inline">Authority to protect identity of a claimant</header><subparagraph commented="no" display-inline="no-display-inline" id="id680C92721C60425094D91184DCE97FF5"><enum>(A)</enum><header display-inline="yes-display-inline">Redactions</header><text display-inline="yes-display-inline">If a Committee issues a report as described in paragraph (4), the Committee may, in accordance with subparagraph (B), make an appropriate redaction to the information or data included in the report if the Committee and the appropriate decisionmakers described in subparagraph (B) determine that including the information or data considered for redaction may lead to the unintentional disclosure of the identity or position of a claimant. The report including any such redaction shall note each redaction and include a statement that the redaction was made solely for the purpose of avoiding such an unintentional disclosure of the identity or position of a claimant.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0d55bf3c5164405383c90fa9651bc7ef"><enum>(B)</enum><header display-inline="yes-display-inline">Agreement on redactions</header><text display-inline="yes-display-inline">The Committee shall make a redaction under subparagraph (A) only if agreement is reached on the precise information or data to be redacted by—</text><clause commented="no" display-inline="no-display-inline" id="idd7e57063607845a6afabc4f432623408"><enum>(i)</enum><text display-inline="yes-display-inline">the Chairman and Ranking Member of the Committee on Ethics of the House of Representatives, in the case of a report concerning a Member of the House of Representatives (including a Delegate or Resident Commissioner to the Congress) or a senior staffer who is an employee of the House of Representatives; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id603d3f197ccd4ab9921883685b52d80a"><enum>(ii)</enum><text display-inline="yes-display-inline">the Chairman and Vice Chairman of the Select Committee on Ethics of the Senate, in the case of a report concerning a Senator or senior staffer who is an employee of the Senate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9F59FCEA839348ABBF465173F898F3F4"><enum>(C)</enum><header display-inline="yes-display-inline">Retention of unredacted reports</header><text display-inline="yes-display-inline">Each committee described in subparagraph (B) shall retain a copy of the report, without redactions.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEB6D646ADD5549249EFD8A8D5F193903"><enum>(6)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="idB8CDB9B917F3416C99FE85EA22314AF6"><enum>(A)</enum><header display-inline="yes-display-inline">Final disposition</header><text display-inline="yes-display-inline">The <quote>final disposition</quote> of a claim means the following:</text><clause commented="no" display-inline="no-display-inline" id="H588699501E9D4C10BCEEB654022F3F75"><enum>(i)</enum><text display-inline="yes-display-inline">An agreement to pay a settlement, including an agreement reached pursuant to mediation under section 403.</text></clause><clause commented="no" display-inline="no-display-inline" id="id6ebd2eb24d7941bdb271368121818a47"><enum>(ii)</enum><text display-inline="yes-display-inline">An order to pay an award that is final and not subject to appeal.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF463F50AC1494065BE9374C1BF258D37"><enum>(B)</enum><header display-inline="yes-display-inline">Senior staffer</header><text display-inline="yes-display-inline">The term <term>senior staffer</term> means any individual who, at the time a violation occurred, was required to file a report under title I of the Ethics in Government Act of 1978 (5 U.S.C. App.).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="H2D251DC39DA94FE7BE61F938445DFE56" section-type="subsequent-section"><enum>113.</enum><header display-inline="yes-display-inline">Availability of option to request remote work assignment or paid leave of absence during pendency
 of procedures</header><subsection commented="no" display-inline="no-display-inline" id="H4DEEC27DCEFB4B23B9480FB73034EC6B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title IV (<external-xref legal-doc="usc" parsable-cite="usc/2/1401">2 U.S.C. 1401</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HB124476765B9443B93CA75FFD7A6B9EB" style="OLC"><section commented="no" display-inline="no-display-inline" id="HBE085C5576674AA2B84C820D33C35A37" section-type="subsequent-section"><enum>417.</enum><header display-inline="yes-display-inline">Option to request remote work assignment or paid leave of absence during pendency of procedures</header><subsection commented="no" display-inline="no-display-inline" id="HF350746C5C0E42BCB9606E940359241A"><enum>(a)</enum><header display-inline="yes-display-inline">Options for employees</header><paragraph commented="no" display-inline="no-display-inline" id="idb19904d143da4f768d3f3a86a15c5b50"><enum>(1)</enum><header display-inline="yes-display-inline">Remote work assignment</header><text display-inline="yes-display-inline">At the request of a covered employee who files a claim alleging a violation of part A of title II by the covered employee’s employing office, during the pendency of any of the procedures available under this title for consideration of the claim, the employing office may permit the covered employee to carry out the employee’s responsibilities from a remote location (referred to in this section as <quote>permitting a remote work assignment</quote>) where such relocation would have the effect of materially reducing interactions between the covered employee and any person alleged to have committed the violation, instead of from a location of the employing office.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9014dbf72954022a9ff763164050fcb"><enum>(2)</enum><header display-inline="yes-display-inline">Exception for work assignments required to be carried out onsite</header><text display-inline="yes-display-inline">If, in the determination of the covered employee’s employing office, a covered employee who makes a request under this subsection cannot carry out the employee’s responsibilities from a remote location or such relocation would not have the effect described in paragraph (1), the employing office may during the pendency of the procedures described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id613036b17bc54e768543d443ee2d5769"><enum>(A)</enum><text display-inline="yes-display-inline">grant a paid leave of absence to the covered employee;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f002098a3054dedbbd42248cfc3e595"><enum>(B)</enum><text display-inline="yes-display-inline">permit a remote work assignment and grant a paid leave of absence to the covered employee; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc816cac8e3b84497b0c2f36bd8f3113c"><enum>(C)</enum><text display-inline="yes-display-inline">make another workplace adjustment, or permit a remote work assignment, that would have the effect of reducing interactions between the covered employee and any person alleged to have committed the violation described in paragraph (1).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5DE9C829745A4FAAA6B677562002C523"><enum>(3)</enum><header display-inline="yes-display-inline">Ensuring no retaliation</header><text display-inline="yes-display-inline">An employing office may not grant a covered employee’s request under this subsection in a manner which would constitute a violation of section 207.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79df9fe686954b0797e92e4666c3c426"><enum>(4)</enum><header display-inline="yes-display-inline">No impact on vacation or personal leave</header><text display-inline="yes-display-inline">In granting leave for a paid leave of absence under this section, an employing office shall not require the covered employee to substitute, for that leave, any of the accrued paid vacation or personal leave of the covered employee.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H046145CA884A4680A3C24E1291B56528"><enum>(b)</enum><header display-inline="yes-display-inline">Exception for arrangements subject to collective bargaining agreements</header><text display-inline="yes-display-inline">Subsection (a) does not apply to the extent that it is inconsistent with the terms and conditions of any collective bargaining agreement which is in effect with respect to an employing office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H81B654A7D6E342AABEF928572F574AD8"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents is amended by adding at the end of the items relating to tile IV the following new item:</text><quoted-block display-inline="no-display-inline" id="H394A9340B07847C88F332DB687DA477F" style="OLC"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">Sec. 417.  settlements</header><subsection commented="no" display-inline="no-display-inline" id="H572E3BA357E3409D98FFF33262D2E750"><enum>(a)</enum><header display-inline="yes-display-inline">Requiring reimbursement</header><text display-inline="yes-display-inline">Section 415 (<external-xref legal-doc="usc" parsable-cite="usc/2/1415">2 U.S.C. 1415</external-xref>), as amended by section 111, is further amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H3DBCF9FAD8984BEEBC63D5F93933E0D1" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H490146C0CD0740E78698268A0711D0D8"><enum>(e)</enum><header display-inline="yes-display-inline">Reimbursement by employing offices</header><paragraph commented="no" display-inline="no-display-inline" id="id16694527995f4d99b1e939f21baaafb9"><enum>(1)</enum><header display-inline="yes-display-inline">Notification of payments made from account</header><text display-inline="yes-display-inline">As soon as practicable after the Executive Director is made aware that a payment of an award or settlement under this Act has been made from the account described in subsection (a) in connection with a claim alleging a violation described in section 201(a) or 206(a) by an employing office (other than an employing office described in subparagraph (A), (B), or (C) of section 101(9)), the Executive Director shall notify the head of the employing office associated with the claim that the payment has been made, and shall include in the notification a statement of the amount of the payment.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4AC3A17FDC40400F8262815A6B4D8FD5"><enum>(2)</enum><header display-inline="yes-display-inline">Reimbursement by office</header><text display-inline="yes-display-inline">Not later than 180 days after receiving a notification from the Executive Director under paragraph (1), the head of the employing office involved shall transfer to the account described in subsection (a), out of any funds available for operating expenses of the office, a payment equal to the amount specified in the notification.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6BE5F548644F4AB3A3C47F96F04EC0B1"><enum>(3)</enum><header display-inline="yes-display-inline">Timetable and procedures for reimbursement</header><text display-inline="yes-display-inline">The head of an employing office shall transfer a payment under paragraph (2) in accordance with such timetable and procedures as may be established under regulations promulgated by the Office.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H7D9AEF78FC1943C08A7AA79EEE71406C"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to payments made under section 415 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1415">2 U.S.C. 1415</external-xref>) for an award or settlement for a claim that is filed on or after the date of the enactment of this Act.</text></subsection></section></subtitle></title><title commented="no" id="H86B69650346F4315903A66184B14BE6B" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Improving Operations of Office of Congressional Workplace Rights</header><section commented="no" display-inline="no-display-inline" id="HBD4A345697114DC69B3A2B872BA99AF1" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Reports on awards and settlements</header><subsection commented="no" display-inline="no-display-inline" id="H59F1C5EE80F2498B8A084A0B8A1DF36D"><enum>(a)</enum><header display-inline="yes-display-inline">Annual reports on awards and settlements</header><paragraph commented="no" display-inline="no-display-inline" id="H0EDD54F24092467E9B84FB07476F75EB"><enum>(1)</enum><header display-inline="yes-display-inline">Requiring submission and publication of reports</header><text display-inline="yes-display-inline">Section 301 (<external-xref legal-doc="usc" parsable-cite="usc/2/1381">2 U.S.C. 1381</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idC9F8CA5D8C5149329BDAEAC6CF1B443E"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (h)(3), by striking <quote>complaint</quote> each place it appears and inserting <quote>claim</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4C818012BE6B43539BE0556C537B0968"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HB537A304793E4C0F8CC9C1013275D118" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H1036CFE83EB14283B02CEFD710413802"><enum>(l)</enum><header display-inline="yes-display-inline">Annual reports on awards and settlements</header><paragraph commented="no" display-inline="no-display-inline" id="idc82b0f00e8264786b17a9a0e145c28a1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 45 days after the beginning of each calendar year, the Office shall submit to Congress and publish on the Office’s public website a report listing each award that is the result of a violation of part A of title II or settlement that is attributable to a finding described in section 415(d)(1)(B) and that was paid during the previous calendar year from the account described in section 415(a). The report shall include information on the employing office involved, the amount of the award or settlement, the provision that was the subject of the claim, and (in the case of an award or settlement resulting from a finding described in section 415(d)(1)(B)), whether the Member or former Member is in compliance with the requirement of section 415(d) to reimburse the account for the reimbursable portion of the award or settlement.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H685C28540E72423EA463ECCAF75EB929"><enum>(2)</enum><header display-inline="yes-display-inline">Protection of identity of individuals receiving awards and settlements</header><text display-inline="yes-display-inline">In preparing and submitting the reports required under paragraph (1), the Office shall ensure that the identity or position of any claimant is not disclosed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9C4CF540DAAC4539B0BCE396317475F7"><enum>(3)</enum><header display-inline="yes-display-inline">Authority to protect the identity of a claimant</header><subparagraph commented="no" display-inline="no-display-inline" id="idAC2D556E277A47D7BB1AC4229A1A39BD"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out paragraph (2), the Executive Director may make an appropriate redaction to the data included in the report described in paragraph (1) if the Executive Director determines that including the data considered for redaction may lead to the identity or position of a claimant unintentionally being disclosed. The report shall note each redaction and include a statement that the redaction was made solely for the purpose of avoiding such an unintentional disclosure of the identity or position of a claimant.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id498DE2FD92684C938235A2CE80462F09"><enum>(B)</enum><header display-inline="yes-display-inline">Recordkeeping</header><text display-inline="yes-display-inline">The Executive Director shall retain a copy of the report described in subparagraph (A), without redactions.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81E93A6B416D481C8660044F4AA32BE3"><enum>(4)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>claimant</term> means an individual who received an award or settlement, or who made an allegation of a violation against an employing office.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD199FCC7B804D00BAEA495CF6998C6C"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by paragraph (1) shall apply with respect to 2018 and each succeeding year.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9C4D88218547449195D434E28EC4BB9C"><enum>(b)</enum><header display-inline="yes-display-inline">Report on amounts previously paid</header><paragraph commented="no" display-inline="no-display-inline" id="HE4AA3BEE49ED4F44859A479063DF0A5E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Office of Congressional Workplace Rights shall submit to Congress and make available to the public on the Office’s public website a report on all payments made with public funds prior to the date of the enactment of this Act for awards and settlements in connection with violations of section 201(a) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311(a)</external-xref>), or section 207 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1317">2 U.S.C. 1317</external-xref>) and shall include in the report the following information:</text><subparagraph commented="no" display-inline="no-display-inline" id="H36A6E98514CF4808AE0768E39949F768"><enum>(A)</enum><text display-inline="yes-display-inline">The amount paid for each such award or settlement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEA35683A59FA40B08ABB035A3FC9696B"><enum>(B)</enum><text display-inline="yes-display-inline">The source of the public funds used for the award or settlement, without regard to whether the funds were paid from the account described in section 415(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1415">2 U.S.C. 1415(a)</external-xref>), an account of the House of Representatives or Senate, or any other account of the Federal Government.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6FCFCAAC9DFE446EB16B98C910FDEC79"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction regarding identification of House and Senate accounts</header><text display-inline="yes-display-inline">Nothing in paragraph (1)(B) may be construed to require or permit the Office of Congressional Workplace Rights to report the account of any specific office of the House of Representatives or Senate as the source of funds used for an award or settlement.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HBCF346F4596D475788AEC160064EB4EC" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Workplace climate surveys of employing offices</header><subsection commented="no" display-inline="no-display-inline" id="H3D58B8DF94F54BE2A5474A557C347DDA"><enum>(a)</enum><header display-inline="yes-display-inline">Requiring surveys</header><text display-inline="yes-display-inline">Title III (<external-xref legal-doc="usc" parsable-cite="usc/2/1381">2 U.S.C. 1381</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HC41E05BEF6B4488A939DCC673372E547" style="OLC"><section commented="no" display-inline="no-display-inline" id="H590F83CE95A941E7957859671D266208" section-type="subsequent-section"><enum>307.</enum><header display-inline="yes-display-inline">Workplace climate surveys of employing offices</header><subsection commented="no" display-inline="no-display-inline" id="idd94fdaa81bff4bf2be7a38c0ca2c26ea"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement To conduct surveys</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, and every 2 years thereafter, the Office shall conduct a survey of employees of employing offices described in subparagraphs (A), (B), (C), and (E) of section 101(9), regarding the workplace environment of such office. The Office shall make the survey available (which may include making the survey available electronically) to all such employees. Employee responses to the survey shall be voluntary.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H3796D94F2A7845FABE0898D198673C4A"><enum>(b)</enum><header display-inline="yes-display-inline">Special inclusion of information on sexual harassment and discrimination</header><text display-inline="yes-display-inline">In each survey conducted under this section, the Office shall survey respondents on attitudes regarding sexual harassment and discrimination.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H61186C0A9FCE4B40976BED3C75E2F621"><enum>(c)</enum><header display-inline="yes-display-inline">Methodology</header><paragraph commented="no" display-inline="no-display-inline" id="H5D6645B4A56042C392A688284C1D4BE6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Office shall conduct each survey under this section in accordance with methodologies established by the Office.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC30BA5C70EE24E5BBB6B74300EC58956"><enum>(2)</enum><header display-inline="yes-display-inline">Confidentiality</header><text display-inline="yes-display-inline">Under the methodologies established under paragraph (1), all responses to all portions of the survey shall be anonymous and confidential, and each respondent shall be told throughout the survey that all responses shall be anonymous and confidential.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE184C3201517461AAB04F40CAD77832A"><enum>(3)</enum><header display-inline="yes-display-inline">Survey form</header><text display-inline="yes-display-inline">The Office shall not include any code or information on the survey form that makes a respondent to the survey, or the respondent's employing office, individually identifiable.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3F709D1ECBFF45D388D89EF490FFF374"><enum>(d)</enum><header display-inline="yes-display-inline">Use of results of surveys</header><text display-inline="yes-display-inline">The Office shall furnish the information obtained from the surveys conducted under this section to the Committee on House Administration of the House of Representatives and the Committee on Homeland Security and Governmental Affairs, and the Committee on Rules and Administration, of the Senate.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H4F5CF47563764F5EBC0825E27E09EEF2"><enum>(e)</enum><header display-inline="yes-display-inline">Consultation with Committees</header><text display-inline="yes-display-inline">The Office shall carry out this section, including establishment of methodologies and procedures under subsection (c), in consultation with the Committee on House Administration of the House of Representatives and the Committee on Homeland Security and Governmental Affairs, and the Committee on Rules and Administration, of the Senate.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H92F6E97199FC41E88570AA2B6263166D"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents is amended by adding at the end of the items relating to title III the following new item:</text><quoted-block display-inline="no-display-inline" id="H02A9DF93FC594A208B4E981E5F3B04EA" style="OLC"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">Sec. 307. section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Confidential Advisor</header><text display-inline="no-display-inline">Section 302 (<external-xref legal-doc="usc" parsable-cite="usc/2/1382">2 U.S.C. 1382</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" compensation of, and may remove, a Confidential Advisor; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9eddfaa54df541e787f5e1a1347cc034"><enum>(B)</enum><text display-inline="yes-display-inline">designate an employee of the Office to serve as a Confidential Advisor.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b45a099c26c496f85fa9e14b226216d"><enum>(2)</enum><header display-inline="yes-display-inline">Duties</header><subparagraph commented="no" display-inline="no-display-inline" id="id67bf6751da1144a883e1c8a9636d5211"><enum>(A)</enum><header display-inline="yes-display-inline">Voluntary services</header><text display-inline="yes-display-inline">The Confidential Advisor shall offer to provide to covered employees described in paragraph (4) the services described in subparagraph (B), which a covered employee may accept or decline.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide15061f4d2094481aabb811a0dd3351a"><enum>(B)</enum><header display-inline="yes-display-inline">Services</header><text display-inline="yes-display-inline">The services referred to in subparagraph (A) are—</text><clause commented="no" display-inline="no-display-inline" id="id123d2a3f67f24490ace45e0f1d3d4574"><enum>(i)</enum><text display-inline="yes-display-inline">informing, on a privileged and confidential basis, a covered employee who has experienced a practice that may be a violation of part A of title II about the employee's rights under this Act;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4badb4fb43274cd89fa7c94a92e132ac"><enum>(ii)</enum><text display-inline="yes-display-inline">consulting, on a privileged and confidential basis, with a covered employee who has experienced a practice that may be a violation of part A of title II regarding—</text><subclause commented="no" display-inline="no-display-inline" id="id64332a02e9044c7ea0e69538fde5e129"><enum>(I)</enum><text display-inline="yes-display-inline">the roles, responsibilities, and authority of the Office; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0e853aa5642b4236a3da9d596c112e16"><enum>(II)</enum><text display-inline="yes-display-inline">the relative merits of securing private counsel, designating a non-attorney representative, or proceeding without representation during proceedings before the Office;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ide14b44ee2acb4b1584a68a4b42fe5fe3"><enum>(iii)</enum><text display-inline="yes-display-inline">assisting, on a privileged and confidential basis, a covered employee who seeks consideration under title IV of an allegation of a violation of part A of title II in understanding the procedures, and the significance of the procedures, described in that title IV; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4f21f25bea1a4ca491d8f4640e19a135"><enum>(iv)</enum><text display-inline="yes-display-inline">informing, on a privileged and confidential basis, a covered employee who has experienced a practice that may be a violation of part A of title II about the option of pursuing, in appropriate circumstances, a complaint with the Committee on Ethics of the House of Representatives or the Select Committee on Ethics of the Senate.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b1d60bb8841423aa158915d4befbd8b"><enum>(3)</enum><header display-inline="yes-display-inline">Qualifications</header><text display-inline="yes-display-inline">The Confidential Advisor shall be a lawyer who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6EBFBDB6CD3948BCA786810C2E4D9EF7"><enum>(A)</enum><text display-inline="yes-display-inline">is admitted to practice before, and is in good standing with, the bar of a State of the United States, the District of Columbia, or a territory of the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE16F3113C0554C1C82D7ED3543F80F48"><enum>(B)</enum><text display-inline="yes-display-inline">has experience representing clients in cases involving the workplace laws incorporated by part A of title II.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7D492F013D04490A9578921EEE25DBAA"><enum>(4)</enum><header display-inline="yes-display-inline">Individuals covered</header><text display-inline="yes-display-inline">The services described in paragraph (2) are available to any covered employee (which, for purposes of this subsection, shall include any staff member described in section 201(d) and any former covered employee (including any former staff member described in that section)), except that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1573A58B88BC436D88793D803E57E290"><enum>(A)</enum><text display-inline="yes-display-inline">a former covered employee may only request such services if the practice that may be a violation of part A of title II occurred during the employment or service of the employee; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9DDD9B92176F4B1599CE5FAE2A347775"><enum>(B)</enum><text display-inline="yes-display-inline">a covered employee described in this paragraph may only request such services before the expiration of the 180-day period described in section 402(e).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf5dc60d12f2248989a513d58189844b7"><enum>(5)</enum><header display-inline="yes-display-inline">Restrictions</header><text display-inline="yes-display-inline">The Confidential Advisor—</text><subparagraph commented="no" display-inline="no-display-inline" id="id563F93CACC354849931FF5168A8691A2"><enum>(A)</enum><text display-inline="yes-display-inline">shall not provide legal advice to, or act as the designated representative for, any covered employee in connection with the covered employee’s participation in any proceeding, including any proceeding under this Act, any judicial proceeding, or any proceeding before any committee of Congress; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7CF67264ACE46408A0DCF8420CD6D85"><enum>(B)</enum><text display-inline="yes-display-inline">shall not serve as a mediator in any mediation conducted pursuant to section 403.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="H0FA9A4DD260849B4BC5A5A46335604CE" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">GAO study of management practices</header><subsection commented="no" display-inline="no-display-inline" id="HE5800DBDB2EF4F3B8A67A570792D9F78"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study of the management practices of the Office of Congressional Workplace Rights.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HBF706198C0E84E4AAC65A837B9E7ECC4"><enum>(b)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the study conducted under subsection (a), and shall include in the report such recommendations as the Comptroller General considers appropriate for improvements to the management practices of the Office of Congressional Workplace Rights.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H886371E990C3474892E2605B32ED1A60" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">GAO audit of cybersecurity</header><subsection commented="no" display-inline="no-display-inline" id="H6160A248CC6D40B3AAEE5B102BD84C58"><enum>(a)</enum><header display-inline="yes-display-inline">Audit</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct an audit of the cybersecurity systems and practices of the Office of Congressional Workplace Rights.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HDC758C92B27E41209F1BF7ECA4473222"><enum>(b)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the audit conducted under subsection (a), and shall include in the report such display-inline="yes-display-inline">Miscellaneous Reforms</header><section commented="no" display-inline="no-display-inline" id="idFBDA77B88E71465DA12471F73ED6FB9B" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Application of Genetic Information Nondiscrimination Act of 2008</header><text display-inline="no-display-inline">Section 102 (<external-xref legal-doc="usc" parsable-cite="usc/2/1302">2 U.S.C. 1302</external-xref>) is amended by adding at the end the Nondiscrimination Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff</external-xref> et seq.), consistent with section 207(c) of that Act (<external-xref but who is not paid by the employing office for carrying out such duties, including an intern, an individual detailed to an employing office, and an individual participating in a fellowship program, in the same manner and to the same extent as such subsections and section apply with respect to a covered employee.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD3A1E64581A4FF3981672B7DF1C1625"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in paragraph (1) may be construed to extend liability for a violation of subsection (a) or section 207 to an employing office on the basis of an action taken by any person who is not under the supervision or control of the employing office.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idace4f9e19054493d849ff4f0521bc57c"><enum>(3)</enum><header display-inline="yes-display-inline">Intern defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>intern</term> means an individual who performs service for an employing office which is uncompensated by the United States, who obtains an educational benefit, such as by earning credit awarded by an educational institution or learning a trade or occupation, and who is appointed on a temporary basis.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H63B508E881644D1EB9BE431049251E06"><enum>(b)</enum><header display-inline="yes-display-inline">Technical correction relating to office responsible for change and initiate a proceeding under the other clause—</text><clause commented="no" display-inline="no-display-inline" id="id52ABD602E163460B8F604B3620A0508F"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a Library visitor who first filed a charge pursuant to subparagraph (A)(i), before the General Counsel files a complaint under subsection (d)(3); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id3F1D799CD3D049CDA3160983EABC8FCF"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a Library visitor who first initiated a proceeding under subparagraph (A)(ii), before the Library visitor requests a hearing under the procedures of the Library of Congress described in such subparagraph.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" violation described in this subsection is—</text><paragraph commented="no" display-inline="no-display-inline" id="id9B7A6AE180CD484A92A32205582D0812"><enum>(1)</enum><text display-inline="yes-display-inline">discrimination prohibited by section 201(a) (including, in accordance with section 102(c), discrimination prohibited by title II of the Genetic Information general</header><text display-inline="yes-display-inline">Not later than 45 days after the beginning of each Congress (beginning with the One Hundred Sixteenth Congress), each employing office shall submit a report to the Committee on House Administration of the House of Representatives and the Committee on Rules and Administration of the Senate on the implementation of the program required under Establishment of the Office of Congressional Workplace Rights.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD6FC9A89CD3E497490088C114956D504"><enum>(d)</enum><header display-inline="yes-display-inline">References in other laws, rules, and regulations</header><text display-inline="yes-display-inline">Any reference to the Office of Compliance in any law, rule, regulation, or other official paper in effect as of the effective date specified in section 401(a) shall be considered to refer and apply to the Office of Congressional Workplace Rights.</text></subsection></section></title><title commented="no" id="H7B571A0AF29B4C01B4C792C56D75A7B3" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">Effective Date</header><section commented="no" display-inline="no-display-inline" id="H1B67CF6E1516475B9DC5F8114E89CD5E" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Effective date</header><subsection commented="no" display-inline="no-display-inline" id="H2A0417F482D245E38C4118A53C953357"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act, this Act and the amendments made by this Act shall take effect upon the expiration of the 180-day period which begins on the date of the enactment of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H247FCE5EE7DD44539EEEA11569971067"><enum>(b)</enum><header display-inline="yes-display-inline">No effect on pending proceedings</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act may be construed to affect any proceeding or payment of an award or settlement relating to a claim under title IV of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1401">2 U.S.C. 1401</external-xref> et seq.) which is pending as of the date of the enactment of this Act. If, as of that date, an employee has begun any of the proceedings under that title that were available to the employee prior to that date, the employee may complete, or initiate and complete, all such proceedings, and such proceedings shall remain in effect with respect to, and provide the exclusive proceedings for, the claim involved until the completion of all such proceedings.</text></subsection></section></title></legis-body><attestation><attestation-group><attestation-date chamber="Senate" date="20180524">Passed the Senate May 24, 2018.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
