		<official-title>To improve consumer protections for customers of air ambulance operators, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Air Ambulance Consumer Protection Act</short-title></quote>.</text>
		</section><section id="H81BC952F3C644E118BCE54A6F7C6C98B"><enum>2.</enum><header>Advisory committee for transparency in air ambulance industry</header>
 <subsection id="H856D969448CF4745B5D7C2F80E1ECB07"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Transportation shall establish an advisory committee to make recommendations for a rulemaking—</text>
 <paragraph id="H237403C596EA48F99B8FA4E5F7D8C94D"><enum>(1)</enum><text>to require air ambulance operators to clearly disclose charges for air transportation services separately from charges for non-air transportation services within any invoice or bill; and</text>
 </paragraph><paragraph id="H159ECA84973846CD96DFEED04A91473C"><enum>(2)</enum><text>to provide other consumer protections for customers of air ambulance operators.</text> </paragraph></subsection><subsection id="HA5C1850C61CE4CA7AF4E63FB0B36A780"><enum>(b)</enum><header>Composition of the advisory committee</header><text>The advisory committee shall be composed of the following members:</text>
 <paragraph id="H87A1BFF12C4B4F73B4DD10A7355A00DD"><enum>(1)</enum><text>The Secretary of Transportation.</text> </paragraph><paragraph id="HAECDB75AEB2D4AA18CC132BCB8AA04A4"><enum>(2)</enum><text>One representative, to be appointed by the Secretary, of each of the following:</text>
 <subparagraph id="H494A27CFD5804724B5B3314523BC466A"><enum>(A)</enum><text>Each relevant Federal agency, as determined by the Secretary.</text> </subparagraph><subparagraph id="H7E4D32C613D945DEA797697F07026BB8"><enum>(B)</enum><text>State insurance regulators.</text>
 </subparagraph><subparagraph id="H59B629594EA4498284C5B1A971A82B73"><enum>(C)</enum><text>Health insurance providers.</text> </subparagraph><subparagraph id="H2A853D8A5E1F4AAFA9EBBC6CED0FAFA7"><enum>(D)</enum><text>Consumer groups.</text>
 </subparagraph></paragraph><paragraph id="HAB5EF5613477483C8EE83E2D5563866F"><enum>(3)</enum><text display-inline="yes-display-inline">Three representatives, to be appointed by the Secretary, to represent the various segments of the air ambulance industry.</text>
 </paragraph></subsection><subsection id="H43AFBFC9ED964782A968145B36867E96"><enum>(c)</enum><header>Recommendations</header><text>The advisory committee shall make recommendations with respect to each of the following:</text> <paragraph id="HF47983D70F0E455F96C565CEEEAAB1CE"><enum>(1)</enum><text>Cost-allocation methodologies needed to ensure that charges for air transportation services are separated from charges for non-air transportation services.</text>
 </paragraph><paragraph id="H2E5EC56F831844818ED1DFEA6567B7C4"><enum>(2)</enum><text>Cost- or price-allocation methodologies to prevent commingling of charges for air transportation services and charges for non-air transportation services in bills and invoices.</text>
 </paragraph><paragraph id="HBF84422FDC3C403EA54E4313F804170B"><enum>(3)</enum><text>Formats for bills and invoices to ensure that customers and State insurance regulators can clearly distinguish between charges for air transportation services and charges for non-air transportation services.</text>
 </paragraph><paragraph id="HA461750B080A4E038FF5F2222614CB4A"><enum>(4)</enum><text>Data or industry references related to aircraft operating costs to be used in determining the proper allocation of charges for air transportation services and charges for non-air transportation services.</text>
 </paragraph><paragraph id="H3256B5D259AB4B1899152B4C447AA5D0"><enum>(5)</enum><text>Guidance materials to instruct States, political subdivisions of States, and political authorities of 2 or more States on referring to the Secretary allegations of unfair or deceptive practices or unfair methods of competition by air ambulance operators.</text>
 </paragraph><paragraph id="HF86306AACCEE4D3088261DE168F47DE6"><enum>(6)</enum><text>Protections for customers of air ambulance operators, after consideration of the circumstances in which the services of air ambulance operators are used.</text>
 </paragraph><paragraph id="HB8E5B905BC6C4CAB920DFA9A1D3AFF6D"><enum>(7)</enum><text>Protections of proprietary cost data from inappropriate public disclosure.</text> </paragraph><paragraph id="H03DF94B5BACF4C378865DF4C48B96EA5"><enum>(8)</enum><text>Such other matters as the Secretary determines necessary or appropriate.</text>
 </paragraph></subsection><subsection id="HB238FF23ACC941A58AF891BB31E866ED"><enum>(d)</enum><header>Report</header><text>Not later than 180 days after the date of the first meeting of the advisory committee, the advisory committee shall submit to the Secretary, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Commerce, Science, and Transportation of the Senate a report containing the recommendations made under subsection (c).</text>
 </subsection><subsection id="H9FBE631F9FAA4ECE9A55EA914B988FA9"><enum>(e)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of receipt of the report under subsection (d), the Secretary shall consider the recommendations of the advisory committee and issue a final rule—</text>
 <paragraph id="H8AA1E3A5CDEC4E5AB2EC8CC1B48E2689"><enum>(1)</enum><text>to require air ambulance operators to clearly disclose charges for air transportation services separately from charges for non-air transportation services within any invoice or bill; and</text>
 </paragraph><paragraph id="HACD631D4C7F14734883620DE391D1A43"><enum>(2)</enum><text>to provide other consumer protections for customers of air ambulance operators.</text> </paragraph></subsection><subsection id="HD944412C28784BACB28EA3405CA01D7A"><enum>(f)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text>
 <paragraph id="HF89E791BF9D44061B8138E63865F480E"><enum>(1)</enum><header>Air ambulance operator</header><text>The term <quote>air ambulance operator</quote> means an air carrier operating pursuant to part 135 of title 14, Code of Federal Regulations, that provides medical, ambulance, or related services.</text>
 </paragraph><paragraph id="HA0216C33625A47FB8E0D35FB9A964CA7"><enum>(2)</enum><header>Non-air transportation services</header><text>The term <quote>non-air transportation services</quote> means those services provided by air ambulance operators but not other air carriers operating pursuant to part 135 of title 14, Code of Federal Regulations.</text>
 </paragraph></subsection><subsection id="H3975943090E9454EBFD308C6A981FB6F"><enum>(g)</enum><header>Termination</header><text>The advisory committee shall terminate on the date of submission of the report under subsection (d).</text>
 </subsection><subsection id="H3FA8A54EB3F64E7585CFAE00DEA7F1B8"><enum>(h)</enum><header>Nature of air ambulance services</header><text>The non-air transportation services of air ambulance operators and prices thereof are neither services nor prices of an air carrier for purposes of section 41713 of title 49, United States Code.</text>
			</subsection></section><section id="H8C04BC334B0D4E1DB261FDE6891E4183"><enum>3.</enum><header>Air ambulance complaints</header>
 <subsection id="H85BC2E61D5C146D89D17F1DD7CE342F8"><enum>(a)</enum><header>Consumer complaints</header><text display-inline="yes-display-inline">Section 42302 of title 49, United States Code, is amended—</text> <paragraph id="H6DFEB6BB58C74F47A5ED862C1926D431"><enum>(1)</enum><text>in subsection (a) by inserting <quote>(including transportation by air ambulance)</quote> after <quote>air transportation</quote>;</text>
 </paragraph><paragraph id="H07ADDA3ADD7D4C6D81C3F5EB1B1A4EC5"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H713910A33E824F4CB9E4C46999C62763"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text>
 <clause id="H8978E4D685B944B6850312C37B700D05"><enum>(i)</enum><text>by inserting <quote>, and an air ambulance operator,</quote> after <quote>passenger seats</quote>; and</text> </clause><clause id="H4427F80587B948F4B79E925AA4DEF1BE"><enum>(ii)</enum><text>by inserting <quote>or operator</quote> after <quote>Internet Web site of the carrier</quote>; and</text>
 </clause></subparagraph><subparagraph id="HE6CCBD252A234F6693387DFFD0CEE3E1"><enum>(B)</enum><text>in paragraph (2) by inserting <quote>or operator</quote> after <quote>mailing address of the air carrier</quote>; and</text> </subparagraph></paragraph><paragraph id="HB325194D907E40E0B00EA2C6CF8F7EFA"><enum>(3)</enum><text>by striking subsection (c) and inserting the following:</text>

						<subsection id="HCCC829C6110D4474ABF5A8D865BEB282"><enum>(c)</enum><header>Notice to passengers on boarding or billing documentation</header>
 <paragraph id="H147CD8F2089F44D59C7563B81AC62AE7"><enum>(1)</enum><header>Air carriers and foreign air carriers</header><text>An air carrier or foreign air carrier providing scheduled air transportation using any aircraft that as originally designed has a passenger capacity of 30 or more passenger seats shall include the hotline telephone number established under subsection (a) on—</text>
 <subparagraph id="H928860B6C8EE4405B9C61AF57F5E7F24"><enum>(A)</enum><text>prominently displayed signs of the carrier at the airport ticket counters in the United States where the air carrier operates; and</text>
 </subparagraph><subparagraph id="H4A6879FF385949C9B04F4A8829B2672D"><enum>(B)</enum><text>any electronic confirmation of the purchase of a passenger ticket for air transportation issued by the air carrier.</text>
 </subparagraph></paragraph><paragraph id="H2E2612888EF447B8857C3BB6E3E38EDD"><enum>(2)</enum><header>Air ambulance operators</header><text>An air ambulance operator shall include the hotline telephone number established under subsection (a) on any invoice, bill, or other communication provided to a passenger or customer of the operator.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H4A2AC24DEC0A420796C2A5CF07A82B71"><enum>(b)</enum><header>Unfair and deceptive practices and unfair methods of competition</header><text display-inline="yes-display-inline">Section 41712(a) of title 49, United States Code, is amended—</text> <paragraph id="H822384666DA6489AA4715DB0D28186AC"><enum>(1)</enum><text>by inserting <quote>air ambulance customer,</quote> after <quote>foreign air carrier,</quote> the first place it appears; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14037E6EBBA549328EA399171EE081EE"><enum>(2)</enum><text>by adding at the end the following: <quote>In this subsection, the term <quote>air carrier</quote> includes an air ambulance operator and the term <quote>air transportation</quote> includes any transportation provided by an air ambulance.</quote>.</text> </paragraph></subsection></section></legis-body> </bill>
