		<official-title>To prohibit covenants not to compete and require employers to notify employees of such prohibition,
			 and for other purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workforce Mobility Act of 2018</short-title></quote>.</text>
		</section><section id="id6721ad09bd9d462bb36ae653242ee20b"><enum>2.</enum><header>Prohibiting covenants not to compete</header>
 <subsection id="idF521A4B822744780BE29759F233CE679"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No employer shall enter into, enforce, or threaten to enforce a covenant not to compete with any employee of such employer, who in any workweek is engaged in commerce or in the production of goods for commerce (or is employed in an enterprise engaged in commerce or in the production of goods for commerce).</text>
 </subsection><subsection id="id23DA805B5307414B93AD34D5E5F66F65"><enum>(b)</enum><header>Notice</header><text display-inline="yes-display-inline">An employer who employs any employee, who in any workweek is engaged in commerce or in the production of goods for commerce (or is employed in an enterprise engaged in commerce or in the production of goods for commerce), shall post notice of the provisions of this Act in a conspicuous place on the premises of such employer.</text>
			</subsection></section><section id="id6e005dabdcee4c739e56815f2d1a33fd"><enum>3.</enum><header>Department of Labor enforcement</header>
 <subsection id="idfa0f1289f1d648c6b3557763fd090c1f"><enum>(a)</enum><header>In general</header><text>The Secretary shall receive, investigate, attempt to resolve, and enforce a complaint of a violation of section 2 in the same manner that the Secretary receives, investigates, and attempts to resolve a complaint of a violation of section 6 or 7 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref> and 207), subject to subsection (b).</text>
 </subsection><subsection id="id77ed9353563e425aa9af8fddddcbd644"><enum>(b)</enum><header>Civil fine</header><text>The Secretary shall impose a civil fine—</text> <paragraph id="id755ba7ceee204f13ae2bed7159f94c7d"><enum>(1)</enum><text>with respect to any employer who violates section 2(a), in an amount not to exceed $5,000 for—</text>
 <subparagraph id="id9D54F37013D14294928D6DE0600EB038"><enum>(A)</enum><text>each employee aggrieved by such violation; and</text>
 </subparagraph><subparagraph id="id53F8C009C623463D8BA93381611CA121"><enum>(B)</enum><text>for each week the employer is in violation of such section; and</text> </subparagraph></paragraph><paragraph id="id0bf80b3e01014b4f8b8c3676b5fc4e21"><enum>(2)</enum><text>with respect to any employer who violates section 2(b), in an amount not to exceed $5,000 for each week the employer is in violation of such section.</text>
				</paragraph></subsection></section><section id="id92ec8ec06c0f4079852fc49e9f3f98c1"><enum>4.</enum><header>Private right of action</header>
 <subsection id="id273bc86d27b849ee83173b43c56132ce"><enum>(a)</enum><header>In general</header><text>An employee who is aggrieved by a violation of section 2 may bring a civil action in an appropriate district court of the United States.</text>
 </subsection><subsection id="idAB35A3334DCF450DBE9DEB16E7290E3B"><enum>(b)</enum><header>Relief</header><text>In a civil action under subsection (a), a court may award—</text> <paragraph id="idf536614afbfb40f4abaa3a4c089058c7"><enum>(1)</enum><text>any actual damages sustained by the employee as a result of the violation;</text>
 </paragraph><paragraph id="id11be1c24862246e4a809779ae932a42c"><enum>(2)</enum><text>such amount of punitive damages as the court may allow; and</text> </paragraph><paragraph id="idcc2dd3d8e2b1419ebe7c4f5d6a2f9578"><enum>(3)</enum><text>for an employee that is a prevailing party, the costs of the action and reasonable attorney’s fees, as determined by the court.</text>
 </paragraph></subsection></section><section id="id859968a4e0b3473788222b42697a292b"><enum>5.</enum><header>Trade secrets</header><text display-inline="no-display-inline">Nothing in this Act shall preclude an employer from entering into an agreement with an employee to not share any information (including after the employee is no longer employed by the employer) regarding the employer or the employment that is a trade secret, as defined in section 1839 of title 18, United States Code.</text>
 </section><section id="idf1490257226c40df9070e741f9da9500"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text> <paragraph id="idD09B19EA377D477E9A128811861B0ECF"><enum>(1)</enum><header>Commerce</header><text display-inline="yes-display-inline">The term <term>commerce</term> has the meaning given such term in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text>
 </paragraph><paragraph id="idbffa1153c3a44747b04bcaa4031d2e67"><enum>(2)</enum><header>Covenant not to compete</header><text>The term <term>covenant not to compete</term> means an agreement, entered into after the date of enactment of this Act between an employer and an employee, that restricts such employee from performing, after the employment relationship between the employer and the employee terminates, any of the following:</text>
 <subparagraph id="id076bcdae0bdd4f049f60ec0be3579fef"><enum>(A)</enum><text>Any work for another employer for a specified period of time.</text> </subparagraph><subparagraph id="id2c1004e3ecb245d5be140033034c0d54"><enum>(B)</enum><text>Any work in a specified geographical area.</text>
 </subparagraph><subparagraph id="id956a781de3364696be0de12cc9f9b192"><enum>(C)</enum><text>Any work for another employer that is similar to such employee’s work for the employer that is a party to such agreement.</text>
 </subparagraph></paragraph><paragraph id="id26e641ff41ef4f899bb9b967233803fa"><enum>(3)</enum><header>Employee; employer</header><text>The terms <term>employee</term> and <term>employer</term> have the meanings given such terms in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text>
 </paragraph><paragraph id="id61028cc08559408b902828d361335322"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text> </paragraph><paragraph id="idfb5a637ebcee4ae19ab13705794b03a4"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means any of the several States or the District of Columbia.</text>
