Miscellaneous.</toc-entry></toc> </subsection></section><section changed="deleted" committee-id="SSCM00" id="id8bf009f7989b45d0a06b995ce3d6a05a" reported-display-style="strikethrough"><enum>2.</enum><header>Authorization of the maritime administration</header> <subsection id="idAE3A52AA83C447BDB4E2819EDBB0CBA3"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Department of Transportation for fiscal year 2019, to be available without fiscal year limitation if so provided in appropriations Acts, the following amounts for programs associated with maintaining the United States merchant marine:</text>
 <paragraph id="idc0decce3e7e3439d8cf5400e73d2b875"><enum>(1)</enum><text>For expenses necessary for operations of the United States Merchant Marine Academy, $69,000,000 for Academy operations.</text>
 </paragraph><paragraph id="idbdce44eef5324b0bbb71a28a7ea24763"><enum>(2)</enum><text>For expenses necessary to support the State maritime academies, $32,200,000, of which—</text> <subparagraph id="id90673424c4c94bffbf0652156d6525c2"><enum>(A)</enum><text>$2,400,000 shall remain available until September 30, 2019, for the Student Incentive Program;</text>
 </subparagraph><subparagraph id="idf0452c779bee4c4b95f99d767ce2a8a2"><enum>(B)</enum><text>$6,000,000 shall remain available until expended for direct payments to such academies;</text> </subparagraph><subparagraph id="id97ac1be7b4e14cfd92ea193e26b067d5"><enum>(C)</enum><text>$22,000,000 shall remain available until expended for maintenance and repair of State maritime academy training vessels; and</text>
 </subparagraph><subparagraph id="id820b8ef0ec6544f596dbe9ad0bc5c370"><enum>(D)</enum><text>$1,800,000 shall remain available until expended for training ship fuel assistance.</text> </subparagraph></paragraph><paragraph id="idf8ab30e0364f41c38d62f8c7159a5934"><enum>(3)</enum><text>For expenses necessary to support the National Security Multi-Mission Vessel Program, $300,000,000, which shall remain available until expended.</text>
 </paragraph><paragraph id="id8796e9e7344c4ad48cd6c7890a2cf744"><enum>(4)</enum><text>For expenses necessary to support Maritime Administration operations and programs, $60,442,000.</text> </paragraph><paragraph id="id5f2563582fce44cfbb1a0f8227bbc8e1"><enum>(5)</enum><text>For expenses necessary to dispose of vessels in the National Defense Reserve Fleet, $6,000,000, which shall remain available until expended.</text>
 </paragraph><paragraph id="id74c672f75e4d4731811e902ea7d545a7"><enum>(6)</enum><text>For expenses necessary to maintain and preserve a United States flag merchant marine to serve the national security needs of the United States under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/531">chapter 531</external-xref> of title 46, United States Code, $300,000,000.</text>
 </paragraph><paragraph id="id10fe61b7a1c0426d90bfc55b151d166f"><enum>(7)</enum><text>For expenses necessary for the loan guarantee program authorized under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/537">chapter 537</external-xref> of title 46, United States Code, $33,000,000, of which—</text>
 <subparagraph id="idef8f256eb8074398b43aaba16a208f74"><enum>(A)</enum><text>$30,000,000 may be used for the cost (as defined in section 502(5) of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a(5)</external-xref>)) of loan guarantees under the program; and</text>
 </subparagraph><subparagraph id="ided8c4271f8364e8e878abe2d6c1d2cee"><enum>(B)</enum><text>$3,000,000 may be used for administrative expenses relating to loan guarantee commitments under the program.</text>
 </subparagraph></paragraph></subsection><subsection id="idE52860C4BF524827ADC62867105D9A6B"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Maritime Administrator shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the status of unexpended appropriations for capital asset management at the United States Merchant Marine Academy, and the plan for expending such appropriations.</text>
 </subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" id="id86b8e807d554483f8189a8c151515b7d" reported-display-style="strikethrough"><enum>3.</enum><header>Concurrent jurisdiction</header><text display-inline="no-display-inline">Notwithstanding any other law, the Secretary of Transportation may relinquish, at the Secretary’s discretion, to the State of New York, such measure of legislative jurisdiction over the lands constituting the United States Merchant Marine Academy in King’s Point, New York, as is necessary to establish concurrent jurisdiction between the Federal Government and the State of New York. Such partial relinquishment of legislative jurisdiction shall be accomplished—</text>
 <paragraph commented="no" id="idf0231b509e3d40dea212a96cac74da0f"><enum>(1)</enum><text>by filing with the Governor of New York a notice of relinquishment to take effect upon acceptance thereof; or</text>
 </paragraph><paragraph commented="no" id="id088e7397199447aba57e07068bf670e1"><enum>(2)</enum><text>as the laws of that State may provide.</text> </paragraph></section><section changed="deleted" committee-id="SSCM00" id="id61c7d40e0ff144908d2c7d57cdac7395" reported-display-style="strikethrough"><enum>4.</enum><header>United States Merchant Marine Academy policy on sexual harassment, dating violence, domestic violence, sexual assault, and stalking</header> <subsection id="idFC6C93DEF5C54171AC009244210BAD43"><enum>(a)</enum><header>Policy on sexual harassment, dating violence, domestic violence, sexual assault, and stalking</header><text display-inline="yes-display-inline">Section 51318 of title 46, United States Code, is amended—</text>
 <paragraph id="id9d82ffcd4e7a4dda9619e1369f9eae1d"><enum>(1)</enum><text>in subsection (a)(2)—</text> <subparagraph id="id225b5a925e3643818494ff7b60523afd"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>and prevention</quote> after <quote>awareness</quote>;</text>
 </subparagraph><subparagraph id="id6aff9a15c8f444d68437a381800d5ce2"><enum>(B)</enum><text>by redesignating subparagraph (B) as subparagraph (C), and subparagraphs (C) through (F) as subparagraphs (E) through (H), respectively;</text>
 </subparagraph><subparagraph id="idcdf6b73309a54e5c93ac4fe65c0e2455"><enum>(C)</enum><text>by inserting after subparagraph (A) the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id1483b5d0cd2c46cab34a6ae83cf5084c" reported-display-style="strikethrough" style="OLC"> <subparagraph id="idcf290e06273f4e8c8100157db2a491d0"><enum>(B)</enum><text>procedures for documenting, tracking, and maintaining the data required to conduct the annual assessments to determine the effectiveness of the policies, procedures, and training program of the Academy with respect to sexual harassment, dating violence, domestic violence, sexual assault, and stalking involving cadets or other Academy personnel, as required by subsection (c);</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="id0cf20bf3eb054580b4085be734265541"><enum>(D)</enum><text>by inserting after subparagraph (C), as redesignated by subparagraph (B), the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id0F6B4D9451DD4608B0A325735C1FC9CC" reported-display-style="strikethrough" style="OLC"> <subparagraph id="ida96c4e2fe78c4a558fc31dd5af94420d"><enum>(D)</enum><text>procedures for investigating sexual harassment, dating violence, domestic violence, sexual assault, or stalking involving a cadet or other Academy personnel to determine whether disciplinary action is necessary;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id8CD74A96E6DE4420B435939BEE84CDEE"><enum>(2)</enum><text>in subsection (b)(2)(A), by inserting <quote>and other Academy personnel</quote> after <quote>cadets at the Academy</quote>; and</text> </paragraph><paragraph id="id2ABB3EAE367E44728A81069EF1192702"><enum>(3)</enum><text>in subsection (d)—</text>
 <subparagraph id="id3f60048f23144fcda4cf0711fc183ae3"><enum>(A)</enum><text>in paragraph (2)(A) by inserting <quote>, including sexual harassment,</quote> after <quote>sexual assaults, rapes, and other sexual offenses</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2918F09906B946A287F313A0DE3CE8E7"><enum>(B)</enum><text>in paragraph (4)(B), by striking <quote>The Secretary</quote> and inserting <quote>Not later than January 15 of each year, the Secretary</quote>.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="id6258ed5f950142f09bc9176e3dcb29f6"><enum>(b)</enum><header>Implementation</header><text>The Superintendent of the United States Merchant Marine Academy may implement the amendment to subsection (b)(2)(A) of section 51318 of title 46, United States Code, made by subsection (a)(2), by updating an existing plan issued pursuant to the National Defense Authorization Act for Fiscal Year 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/91">Public Law 115–91</external-xref>).</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="id40e5febdb0c24ceca2170ae6e1745f6f" reported-display-style="strikethrough"><enum>5.</enum><header>Report on implementation of recommendations for the United States Merchant Marine Academy Sexual
 Assault Prevention and Response Program</header><text display-inline="no-display-inline">Not later than December 31, 2018, the Maritime Administrator shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report describing the progress of the Maritime Administration in implementing and closing each of the recommendations made in the Office of Inspector General’s Report issued March 28, 2018 (ST–2018–039) identifying gaps in the United States Merchant Marine Academy’s Sexual Assault Prevention and Response Program.</text>
 </section><section changed="deleted" committee-id="SSCM00" id="ide7e51896424243fba795e45743927d22" reported-display-style="strikethrough"><enum>6.</enum><header>Electronic records on mariner availability to meet national security needs</header><text display-inline="no-display-inline">Section 7502 of title 46, United States Code, is amended—</text> <paragraph id="ide2ef2c0c71bf43c893ef7c2c6efa73af"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text>
 </paragraph><paragraph id="id09f1f0e88fee439c82f92a208a0cab79"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id91d6fc7656c2481fb97431dad342b671" reported-display-style="strikethrough" style="OLC"> <subsection id="id485cc94d4df149a98b2a048ba3a52749"><enum>(c)</enum><text>The Secretary shall coordinate with the Secretary of Transportation to ensure that, to the extent feasible, electronic records provide information on mariner availability to meet national security needs for mariner credentialing and strategic sealift.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section changed="deleted" committee-id="SSCM00" id="id7226afa3a9654dcb99865c0b49b95861" reported-display-style="strikethrough"><enum>7.</enum><header>Small shipyard grants</header><text display-inline="no-display-inline">Section 54101(b) of title 46, United States Code, is amended—</text> <paragraph id="idac5946e7e78648b1bb74f4cea63e6956"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text>
 </paragraph><paragraph id="idca101cf77dca41b195c25029a6eab6b1"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id803520f816b54428ba27febe64f4725a" reported-display-style="strikethrough" style="OLC"> <paragraph id="idf5e16e24a8b74f3789c7dfcd87ff8fd5"><enum>(2)</enum><header>Timing of grant notice</header><text>The Administrator shall post a Notice of Funding Opportunity regarding grants awarded under this section not more than 15 days after the date of enactment of the appropriations Act for the fiscal year concerned.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id456b721580184629b23b4006c54717cf"><enum>(3)</enum><text>in paragraph (4), as redesignated by paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (3)</quote>.</text> </paragraph></section><section changed="deleted" committee-id="SSCM00" id="id5a7f081749b74d1a9b3a54f38c678d00" reported-display-style="strikethrough"><enum>8.</enum><header>Domestic ship recycling facilities</header><text display-inline="no-display-inline">Section 3502 of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/398">Public Law 106–398</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/54/308704">54 U.S.C. 308704</external-xref> note) is amended—</text>
 <paragraph id="id6dcead114a8e498d8379324a8c88532f"><enum>(1)</enum><text>by redesignating subsections (c) through (f) as subsections (d) through (g), respectively; and</text> </paragraph><paragraph id="id7a47450237b04c91bf8d8e32798a6736"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text>

					<subsection id="id4407fed001d24a3baa942cb774ff6b18"><enum>(c)</enum><header>Scrapping of imported vessels</header>
 <paragraph id="ida296787890fe4455b023bf18a685b0a6"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, domestic ship scrapping facilities selected by the Secretary of Transportation in accordance with subsection (b) may import into the United States, for the purpose of dismantling, marine vessels that contain regulated levels of polychlorinated biphenyls that are integral to a vessel’s structure, equipment, or systems necessary for its operation.</text>
 </paragraph><paragraph id="id31fe72c929d248dca6302e1db5c95dc3"><enum>(2)</enum><header>No TSCA prior authorization required</header><text>In lieu of the rulemaking by the Administrator of the Environmental Protection Agency under section 6(e) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(e)</external-xref>), imports of vessels containing regulated levels of polychlorinated biphenyls shall be subject to prior notification and consent in accordance with this subsection.</text>
						</paragraph><paragraph id="id04828cdc76554db083bfbabff41700d0"><enum>(3)</enum><header>Notification</header>
 <subparagraph id="idD1440E3D929E4484B18CBDBEE69520B9"><enum>(A)</enum><header>Contents</header><text>An importer of 1 or more vessels containing regulated levels of polychlorinated biphenyls shall submit a notification to the Environmental Protection Agency not less than 75 days before a vessel is imported into the United States under this subsection. The import notification may cover up to one year of shipments of vessels containing regulated levels of polychlorinated biphenyls being sent to the same ship scrapping facility, and shall contain, at a minimum, the following items:</text>
 <clause id="id0e58152da0a5468f9b6148df3dd9f700"><enum>(i)</enum><text>The name, contact name, address, telephone number, email address, and EPA Identification Number (if applicable) of the ship scrapping facility and the recognized trader, if the ship scrapping facility is not the importer.</text>
 </clause><clause id="id901e4f9a0a4d4dc6bbdb18c5190bde14"><enum>(ii)</enum><text>The name, contact name, address, telephone number, email address, and EPA Identification Number (if applicable) of each facility where polychlorinated biphenyls or hazardous materials contained on a vessel will be stored and disposed of, including any polychlorinated biphenyls storage or disposal facility approved under the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601</external-xref> et seq.).</text>
 </clause><clause id="id70dc52732908489fbdcf4c4ef1c6beac"><enum>(iii)</enum><text>The types of polychlorinated biphenyls or polychlorinated biphenyls items expected to be removed from the vessels.</text>
 </clause><clause id="id9b54b83e2668425085d92bc4e851ec9c"><enum>(iv)</enum><text>The number of vessels proposed for import and maximum tonnage.</text> </clause><clause id="id0c3b281df42048afbfb5677e44aee89b"><enum>(v)</enum><text>The period of time covered by the import notice (not to exceed one year) and the start and end dates of shipment.</text>
 </clause></subparagraph><subparagraph id="id4F63ECFC5F4745EFB331806F0FDA3102"><enum>(B)</enum><header>Form</header><text>Each notice under this paragraph shall be clearly marked <quote>PCB Waste Import Notice</quote> and shall be submitted to the Environmental Protection Agency in such form and manner as the Environmental Protection Agency may require.</text>
 </subparagraph><subparagraph id="idA26080DFAB2145EEAB74CB2A37EB5021"><enum>(C)</enum><header>Revised notification</header><text>If an importer wishes to change any of the information specified on the original notification, the importer must submit a revised notification, containing notification of the changes, to the Environmental Protection Agency.</text>
							</subparagraph></paragraph><paragraph id="id9ba92a470e7249cfb1f8af2e178a36d4"><enum>(4)</enum><header>Consent</header>
 <subparagraph id="id89110CC695004DCA9A8A3F1CC2DC22E4"><enum>(A)</enum><header>In General</header><text>An importer shall not import vessels containing regulated levels of polychlorinated biphenyls until the importer has received consent from the Administrator of the Environmental Protection Agency.</text>
 </subparagraph><subparagraph id="id594204ec3e294ff9b03df124ecab166f"><enum>(B)</enum><header>Terms</header><text>Importers shall only import vessels under the terms of the consent issued by the Administrator of the Environmental Protection Agency under this paragraph and subject to the condition that the facility shall establish a valid written contract, chain of contracts, or equivalent arrangements with other United States facilities, where applicable, to manage the polychlorinated biphenyls and hazardous waste expected to be removed from the vessel or vessels.</text>
 </subparagraph></paragraph><paragraph id="id3416fdef3e38439da9d18a8156a432ec"><enum>(5)</enum><header>Report to the environmental protection agency</header><text>Any ship scrapping facility authorized by this subsection to import vessels containing regulated levels of polychlorinated biphenyls shall file with the Administrator of the Environmental Protection Agency, not later than April 1 of each year, a report providing, for each vessel imported in accordance with this subsection, the following information:</text>

 <paragraph id="id140ff9f817b4438791094594cde96e9d"><enum>(1)</enum><text>the key challenges, if any, to ensuring that the United States marine transportation system and merchant marine are sufficient to support United States economic and defense needs, as articulated by the Maritime Administration, the Committee on the Marine Transportation System, and other stakeholders;</text>
 </paragraph><paragraph id="idf57a77cf05414cef86a10f604507feb4"><enum>(2)</enum><text>the extent to which a national maritime strategy incorporates desirable characteristics of successful national strategies as identified by the Comptroller General, and any key obstacles (as identified by stakeholders) to successfully implementing such strategies; and</text>
 </paragraph><paragraph id="idbfcee86783c34234b97edfecc26dcf67"><enum>(3)</enum><text>the extent to which Federal efforts to establish national maritime strategy are duplicative or fragmented, and if so, the impact on United States maritime policy for the future.</text>
 </paragraph></section><section changed="deleted" commented="no" committee-id="SSCM00" id="id53f88ef1fc4b456794554d37b6c25351" reported-display-style="strikethrough"><enum>11.</enum><header>Department of Transportation Inspector General report on title XI program</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Department of Transportation Office of Inspector General shall—</text>
 <paragraph commented="no" id="id98AF52EE4E8E4A92B66B622C03506E5A"><enum>(1)</enum><text display-inline="yes-display-inline">initiate an audit of the financial controls and protections included in the policies and procedures of the Department of Transportation for approving loan applications for the loan guarantee program authorized under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/537">chapter 537</external-xref> of title 46, United States Code; and</text>
 </paragraph><paragraph commented="no" id="id7B4354F199B441A79081374DA0A2B865"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing the results of that audit once the audit is completed.</text>
 </paragraph></section><section changed="deleted" commented="no" committee-id="SSCM00" id="idd4b6bfb9fe2143108f855ce3a4df8d63" reported-display-style="strikethrough"><enum>12.</enum><header>Multi-year contracts</header><text display-inline="no-display-inline">Nothing in section 3505 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>) may be construed to prohibit the Maritime Administration from entering into a multi-year contract for the procurement of up to 5 new vessels within the National Security Multi-Mission Vessel Program and associated government–furnished equipment, subject to the availability of appropriations.</text>
 </section><section changed="deleted" committee-id="SSCM00" id="id3e761c0ac4cc4875a36f4982ecb8b046" reported-display-style="strikethrough"><enum>13.</enum><header>Use of State academy training vessels</header><text display-inline="no-display-inline">Section 51504(g) of title 46, United States Code, is amended to read as follows:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id05E1278F28A94208A90C7D3DEF6D46C4" reported-display-style="strikethrough" style="OLC"> <subsection id="idd5c4e3d2201847c69ef0da1f81dcc4cb"><enum>(g)</enum><header>Vessel sharing</header> <paragraph id="idC563565341734CA199A1A1E5AA8986E2"><enum>(1)</enum><header>In General</header><text>Not later than 90 days after the date of enactment of the <short-title>Maritime Authorization and Enhancement Act for Fiscal Year 2019</short-title>, the Secretary, acting through the Maritime Administrator, shall upon consultation with the maritime academies, and to the extent feasible with the consent of the maritime academies, implement a program of vessel sharing, requiring maritime academies to share training vessels provided by the Secretary among maritime academies, as necessary to ensure that training needs of each academy are met.</text>
 </paragraph><paragraph id="ida47cf66493084eaa87c30ddc7478fb11"><enum>(2)</enum><header>Program of vessel sharing</header><text>For purposes of this subsection, a program of vessel sharing shall include—</text> <subparagraph id="iddd9213edf35d4db1ad54b492f282b2dc"><enum>(A)</enum><text>ways to maximize the available underway training capacity available in the fleet of training vessels;</text>
 </subparagraph><subparagraph id="id54dcb0a3e84c4794bac211fe88ec7506"><enum>(B)</enum><text>coordinating the dates and duration of training cruises with the academic calendars of maritime academies;</text>
 </subparagraph><subparagraph id="idf3e33753d0be42888b6a4d9099a4b1ae"><enum>(C)</enum><text>coordinating academic programs designed to be implemented aboard training vessels among maritime academies; and</text>
 </subparagraph><subparagraph id="id8c5ada17c4444419a3f73ae3a58998ca"><enum>(D)</enum><text>identifying ways to minimize costs.</text> </subparagraph></paragraph><paragraph id="id1482B695E37C4AB7BDC9952DB82A4152"><enum>(3)</enum><header>Evaluation</header><text>Not later than 30 days after the beginning of each fiscal year, the Secretary, acting through the Maritime Administrator, shall evaluate the vessel sharing program under this subsection to determine the optimal utilization of State maritime training vessels, and modify the program as necessary to improve utilization.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			<subsection id="id1ba7c383a44d47cc90597d95b2870a68"><enum>(a)</enum><header>Study of the Great Lakes System</header>
 <paragraph id="idC1180622CAD9496F8DA0BFEE495DAEE7"><enum>(1)</enum><header>In General</header><text>The Maritime Administrator shall conduct a comprehensive study of the Great Lakes—Saint Lawrence Seaway navigation system (referred to in this section as the <quote>Great Lakes System</quote>) that examines the current state of the system and makes recommendations for improvements.</text>
 </paragraph><paragraph id="id9d48535e81bb42818a14e480375d1bb6"><enum>(2)</enum><header>Contents</header><text>The study—</text> <subparagraph id="ide6b8aae4a6a64ae9aecb7147a887a1a4"><enum>(A)</enum><text>shall examine, with respect to the Great Lakes System—</text>
 <clause id="ida73d23aab10a456bb55f799184cb3e9a"><enum>(i)</enum><text>typical cargo routing options;</text> </clause><clause id="id6edc290ef9bb412a97d2dc151a253a22"><enum>(ii)</enum><text>the cost profile of each route and alternative routes;</text>
 </clause><clause id="id7a03a58381b44dc3a137947158656f37"><enum>(iii)</enum><text>port infrastructure quality;</text> </clause><clause id="id04be1adcc5cd4f01ade013806aa9415d"><enum>(iv)</enum><text>intermodal connections;</text>
 </clause><clause id="id64e9d212772b4c1881795b10f3506188"><enum>(v)</enum><text>competing transportation options, including air, rail, and ground transportation and their relative market position;</text>
 </clause><clause id="id3918a7ae5ba04a398977ead33e310219"><enum>(vi)</enum><text>taxes and fees imposed on vessels;</text> </clause><clause id="idccb6ab69e2c64b5bb6ec0ac467992298"><enum>(vii)</enum><text>marketing efforts to increase shipments;</text>
 </clause><clause id="iddd2e411190224421a32dcc6f86d1d99c"><enum>(viii)</enum><text>subsidies provided to the Great Lakes System and to competing cargo transportation systems;</text> </clause><clause id="idc385a1aa643247dca76cf4737d1d98d2"><enum>(ix)</enum><text>the condition of the docks at each port;</text>
 </clause><clause id="id936ccaff59384f3d9b0d53d644f18e0a"><enum>(x)</enum><text>United States and Canadian Government icebreaking capabilities to facilitate commercial shipping; and</text>
 </clause><clause id="iddca5e1f8559e49b98896cc3686ba5a12"><enum>(xi)</enum><text>the condition of vessel navigation infrastructure (such as channels, locks, letties, and breakwaters) and efforts to maintain, upgrade, or replace that infrastructure; and</text>
 </clause></subparagraph><subparagraph id="id0a65314656384787b2483e6ad17e6091"><enum>(B)</enum><text>shall make recommendations on—</text> <clause id="ida1d3c95b807a4f7aba2bfac89a24e6cb"><enum>(i)</enum><text>the level of additional investment needed to improve the Great Lakes System;</text>
 </clause><clause id="id6056bf1000d84bc39895b4a57ff462cc"><enum>(ii)</enum><text>any benefits of increased Federal or State investment in the Great Lakes System; and</text> </clause><clause id="id8666253a1dde4e21946975a7c36b0ac3"><enum>(iii)</enum><text>any regulatory or competitive burdens impeding growth of the Great Lakes System.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id1968cafa08b648a1895f7fd358baf618"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Maritime Administrator shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Transportation and Infrastructure of the House of Representatives, and the Co-Chairs of the Great Lakes Task Force of the Senate and of the House of Representatives containing the results of the study conducted under this section.</text>

Miscellaneous.</toc-entry> </toc> </subsection></section><section changed="added" committee-id="SSCM00" id="idb092ab13-e28f-4889-b604-e16d4bb599aa" reported-display-style="italic"><enum>2.</enum><header>Authorization of the Maritime Administration</header> <subsection id="id38a601ab-6308-460b-a0ff-3d8fbd6e0f7e"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Department of Transportation for fiscal year 2019, to be available without fiscal year limitation if so provided in appropriations Acts, the following amounts for programs associated with maintaining the United States merchant marine:</text>
 <paragraph id="id2190b1c0-9c39-4385-8826-ee0d2cadc675"><enum>(1)</enum><text>For expenses necessary for operations of the United States Merchant Marine Academy, $69,000,000 for Academy operations.</text>
 </paragraph><paragraph id="id632cdc6c-886e-42ee-ba2d-f174c058c503"><enum>(2)</enum><text>For expenses necessary to support the State maritime academies, $32,200,000, of which—</text> <subparagraph id="id13d76206-0d17-42b8-9476-5d61a064201f"><enum>(A)</enum><text>$2,400,000 shall remain available until September 30, 2020, for the Student Incentive Program;</text>
 </subparagraph><subparagraph id="id4d529815-e29c-40d5-815d-b3eea2c927a8"><enum>(B)</enum><text>$6,000,000 shall remain available until expended for direct payments to such academies;</text> </subparagraph><subparagraph id="idfe360206-bf67-44c1-af3b-c7215e77c1a5"><enum>(C)</enum><text>$22,000,000 shall remain available until expended for maintenance and repair of State maritime academy training vessels; and</text>
 </subparagraph><subparagraph id="ida510afe2-c877-4bde-b13b-f2f38a400a23"><enum>(D)</enum><text>$1,800,000 shall remain available until expended for training ship fuel assistance.</text> </subparagraph></paragraph><paragraph id="id42585586-6261-4245-bb2f-00edea32e1bc"><enum>(3)</enum><text>For expenses necessary to support the National Security Multi-Mission Vessel Program, $300,000,000, which shall remain available until expended.</text>
 </paragraph><paragraph id="id0e4f259a-f84d-45f0-930a-18b95ad0944c"><enum>(4)</enum><text>For expenses necessary to support Maritime Administration operations and programs, $60,442,000, of which $5,000,000 shall remain available until expended for port infrastructure development under section 50302 of title 46, United States Code.</text>
 </paragraph><paragraph id="idbe6de81b-f60d-43b2-ac67-0b73accf9cc3"><enum>(5)</enum><text>For expenses necessary to dispose of vessels in the National Defense Reserve Fleet, $6,000,000, which shall remain available until expended.</text>
 </paragraph><paragraph id="iddb4c0413-78d3-4533-8b5b-6a783639cfcc"><enum>(6)</enum><text>For expenses necessary to maintain and preserve a United States flag merchant marine to serve the national security needs of the United States under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/531">chapter 531</external-xref> of title 46, United States Code, $300,000,000.</text>
 </paragraph><paragraph id="id990e7662-5a29-42f8-8ede-1cc8dd76c8de"><enum>(7)</enum><text>For expenses necessary for the loan guarantee program authorized under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/537">chapter 537</external-xref> of title 46, United States Code, $33,000,000, of which—</text>
 <subparagraph id="id18a82531-a12b-4cb8-9fdd-743f67106d1b"><enum>(A)</enum><text>$30,000,000 may be used for the cost (as defined in section 502(5) of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a(5)</external-xref>)) of loan guarantees under the program; and</text>
 </subparagraph><subparagraph id="idad3ecf87-c91f-4a7d-b51f-96fdc9c44e64"><enum>(B)</enum><text>$3,000,000 may be used for administrative expenses relating to loan guarantee commitments under the program.</text>
 </subparagraph></paragraph></subsection><subsection id="id2583629a-b1b7-40c3-89e5-5d083c632952"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Maritime Administrator shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Armed Services and the Committee on Transportation and Infrastructure of the House of Representatives on the status of unexpended appropriations for capital asset management at the United States Merchant Marine Academy, and the plan for expending such appropriations.</text>
 </subsection></section><section changed="added" commented="no" committee-id="SSCM00" id="id382ab60d-677e-4198-8185-50d496b9c03e" reported-display-style="italic"><enum>3.</enum><header>Concurrent jurisdiction</header><text display-inline="no-display-inline">Notwithstanding any other law, the Secretary of Transportation may relinquish, at the Secretary’s discretion, to the State of New York, such measure of legislative jurisdiction over the lands constituting the United States Merchant Marine Academy in King’s Point, New York, as is necessary to establish concurrent jurisdiction between the Federal Government and the State of New York. Such partial relinquishment of legislative jurisdiction shall be accomplished—</text>
 <paragraph commented="no" id="idbbfa3b7d-256e-45cd-babb-cd958c044af6"><enum>(1)</enum><text>by filing with the Governor of New York a notice of relinquishment to take effect upon acceptance thereof; or</text>
 </paragraph><paragraph commented="no" id="idff733895-7df9-4c97-b8e0-34e40700eba1"><enum>(2)</enum><text>as the laws of that State may provide.</text> </paragraph></section><section changed="added" committee-id="SSCM00" id="id38fa850c-6a6a-4c75-bfb3-ecfb9dcbaba1" reported-display-style="italic"><enum>4.</enum><header>United States Merchant Marine Academy policy on sexual harassment, dating violence, domestic violence, sexual assault, and stalking</header> <subsection id="id1968991b-fbe1-4e4c-8c53-8df53973a8fb"><enum>(a)</enum><header>Policy on sexual harassment, dating violence, domestic violence, sexual assault, and stalking</header><text display-inline="yes-display-inline">Section 51318 of title 46, United States Code, is amended—</text>
 <paragraph id="id745800a4-2b55-404a-beaf-09fbc79d9636"><enum>(1)</enum><text>in subsection (a)(2)—</text> <subparagraph id="id738bb69f-abdf-4ccf-975d-9cf260d3929a"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>and prevention</quote> after <quote>awareness</quote>;</text>
 </subparagraph><subparagraph id="id1cf6e56b-705d-40d7-81ef-6c13d2a79257"><enum>(B)</enum><text>by redesignating subparagraph (B) as subparagraph (C), and subparagraphs (C) through (F) as subparagraphs (E) through (H), respectively;</text>
 </subparagraph><subparagraph id="id12236a68-6904-4dfe-81f1-25c47948ed30"><enum>(C)</enum><text>by inserting after subparagraph (A) the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id7306146f-a7b2-4f6c-a886-ef94551a3b24" reported-display-style="italic" style="OLC"> <subparagraph id="id4961bf21-4014-4293-b5d5-ab83c454c863"><enum>(B)</enum><text>procedures for documenting, tracking, and maintaining the data required to conduct the annual assessments to determine the effectiveness of the policies, procedures, and training program of the Academy with respect to sexual harassment, dating violence, domestic violence, sexual assault, and stalking involving cadets or other Academy personnel, as required by subsection (c);</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="idf9fbe361-7d1d-4666-8034-928121cea5d1"><enum>(D)</enum><text>by inserting after subparagraph (C), as redesignated by subparagraph (B), the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id1ff91356-29a6-4eb9-82d3-7f99ccec7374" reported-display-style="italic" style="OLC"> <subparagraph id="idfee9bcbd-dd6e-472c-b5aa-8482b1f20c42"><enum>(D)</enum><text>procedures for investigating sexual harassment, dating violence, domestic violence, sexual assault, or stalking involving a cadet or other Academy personnel to determine whether disciplinary action is necessary;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id700be124-146d-436a-b8fe-5afc1fa4a35d"><enum>(2)</enum><text>in subsection (b)(2)(A), by inserting <quote>and other Academy personnel</quote> after <quote>cadets at the Academy</quote>; and</text> </paragraph><paragraph id="idd3c726d8-bc6b-4fc3-ab72-6ed727ca42c3"><enum>(3)</enum><text>in subsection (d)—</text>
 <subparagraph id="id3d59c883-7df8-41f0-b79c-408669251b64"><enum>(A)</enum><text>in paragraph (2)(A) by inserting <quote>, including sexual harassment,</quote> after <quote>sexual assaults, rapes, and other sexual offenses</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id649ecc9d-bef6-4d66-b51c-940a0469bf5b"><enum>(B)</enum><text>in paragraph (4)(B), by striking <quote>The Secretary</quote> and inserting <quote>Not later than January 15 of each year, the Secretary</quote>.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="id2ec1d2e8-b0d5-4a53-aba0-19e37650940e"><enum>(b)</enum><header>Implementation</header><text>The Superintendent of the United States Merchant Marine Academy may implement the amendment to subsection (b)(2)(A) of section 51318 of title 46, United States Code, made by subsection (a)(2), by updating an existing plan issued pursuant to the National Defense Authorization Act for Fiscal Year 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/91">Public Law 115–91</external-xref>).</text>
			</subsection></section><section changed="added" committee-id="SSCM00" id="id4f6d6f6f-a845-4d0e-8d75-756217884b34" reported-display-style="italic"><enum>5.</enum><header>Report on implementation of recommendations for the United States Merchant Marine Academy Sexual
 Assault Prevention and Response Program</header><text display-inline="no-display-inline">Not later than April 1, 2019, the Maritime Administrator shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Armed Services and the Committee on Transportation and Infrastructure of the House of Representatives a report describing the progress of the Maritime Administration in implementing and closing each of the recommendations made in the Office of Inspector General’s Report issued March 28, 2018 (ST-2018-039) identifying gaps in the United States Merchant Marine Academy’s Sexual Assault Prevention and Response Program.</text>
		</section><section changed="added" committee-id="SSCM00" id="idb9d592c95d4c4b9296729bee3fec88de" reported-display-style="italic"><enum>6.</enum><header>Report on the application of the Uniform Code of Military Justice to the United States Merchant
 Marine Academy</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Maritime Administrator shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Armed Services and the Committee on Transportation and Infrastructure of the House of Representatives on the impediments to the application of the Uniform Code of Military Justice at the United States Merchant Marine Academy.</text>
 </section><section changed="added" committee-id="SSCM00" id="idfa60dbd5-81f4-4d8c-ace6-407d28d118cb" reported-display-style="italic"><enum>7.</enum><header>Electronic records on mariner availability to meet national security needs</header><text display-inline="no-display-inline">Section 7502 of title 46, United States Code, is amended—</text> <paragraph id="id8e950c45-8cf6-4efc-9c78-e0f2e51e84ea"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text>
 </paragraph><paragraph id="id9d6b3e93-755a-40a1-824b-4083123d2f02"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id6b54c7c9-466a-42f8-9f45-8c7cd38b6727" reported-display-style="italic" style="OLC"> <subsection id="id2e1d25e1-5bb4-42df-b37f-ecddf26a9c8d"><enum>(c)</enum><text>The Secretary shall coordinate with the Secretary of Transportation to ensure that, to the extent feasible, electronic records provide information on mariner availability and respective credentials to meet national security needs for credentialed mariners crewing strategic sealift vessels.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section changed="added" committee-id="SSCM00" id="id1d2df2f5-39fa-431d-9467-f44f31f2e3b5" reported-display-style="italic"><enum>8.</enum><header>Small shipyard grants</header><text display-inline="no-display-inline">Section 54101(b) of title 46, United States Code, is amended—</text> <paragraph id="id9baf0197-83bd-4fe8-836e-30120f2ed9a6"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text>
 </paragraph><paragraph id="id3e0ba98d-73fd-4a58-9814-1029401db6fe"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id3f96b57b-e9a0-4c0c-9aff-8aace7690024" reported-display-style="italic" style="OLC"> <paragraph id="id37f7a3f6-33a1-4f71-85d6-764c90cc5608"><enum>(2)</enum><header>Timing of grant notice</header><text>The Administrator shall post a Notice of Funding Opportunity regarding grants awarded under this section not more than 15 days after the date of enactment of the appropriations Act for the fiscal year concerned.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idffcbd4f5-f641-4b6c-bd3b-e34b64215519"><enum>(3)</enum><text>in paragraph (4), as redesignated by paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (3)</quote>.</text> </paragraph></section><section changed="added" committee-id="SSCM00" id="id6e532dad-508e-45f0-80ff-1705c72f357c" reported-display-style="italic"><enum>9.</enum><header>Domestic ship recycling facilities</header><text display-inline="no-display-inline">Section 3502 of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/398">Public Law 106–398</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/54/308704">54 U.S.C. 308704</external-xref> note) is amended—</text>
 <paragraph id="id93dbe400-2358-47c3-bb9d-47a4e3da713d"><enum>(1)</enum><text>by redesignating subsections (c) through (f) as subsections (d) through (g), respectively; and</text> </paragraph><paragraph id="idd942b096-ec94-4a70-9eaa-ab71a043d323"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text>

					<subsection id="idbd2829d4-e6f9-4bc7-b5f3-db0fa54e6f48"><enum>(c)</enum><header>Scrapping of imported vessels</header>
 <paragraph id="id34bf90b9-8b37-456c-8990-6fcf4477d158"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, domestic ship scrapping facilities selected by the Secretary of Transportation in accordance with subsection (b) may import into the United States, for the purpose of dismantling, marine vessels that contain regulated levels of polychlorinated biphenyls that are integral to a vessel’s structure, equipment, or systems necessary for its operation.</text>
 </paragraph><paragraph id="idee686561-ec22-4723-9fd5-d0f7dfefa029"><enum>(2)</enum><header>No TSCA prior authorization required</header><text>In lieu of rulemaking by the Administrator of the Environmental Protection Agency under section 6(e) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(e)</external-xref>), imports of vessels containing regulated levels of polychlorinated biphenyls shall be subject to prior notification and consent in accordance with this subsection.</text>
						</paragraph><paragraph id="id1f9da6cb-37e5-435f-a342-31ef3c68179f"><enum>(3)</enum><header>Notification</header>
 <subparagraph id="id2e55c3dc-91b3-4f54-8d46-05e4fde16e32"><enum>(A)</enum><header>Contents</header><text>An importer of 1 or more vessels containing regulated levels of polychlorinated biphenyls shall submit a notification to the Environmental Protection Agency not less than 75 days before a vessel is imported into the United States under this subsection. The import notification may cover up to one year of shipments of vessels containing regulated levels of polychlorinated biphenyls being sent to the same ship scrapping facility, and shall contain, at a minimum, the following items:</text>
 <clause id="iddb25ecd2-697e-4e9c-a7ba-c00425109ea1"><enum>(i)</enum><text>The name, contact name, address, telephone number, email address, and EPA Identification Number (if applicable) of the ship scrapping facility and the recognized trader, if the ship scrapping facility is not the importer.</text>
 </clause><clause id="id7b74dab3-c4fe-4c2a-b964-69567e980b91"><enum>(ii)</enum><text>The name, contact name, address, telephone number, email address, and EPA Identification Number (if applicable) of each facility where polychlorinated biphenyls or hazardous materials contained on a vessel will be stored and disposed of, including any polychlorinated biphenyls storage or disposal facility approved under the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601</external-xref> et seq.).</text>
 </clause><clause id="idd13789de-959d-4c44-b72e-5e2be8dc6963"><enum>(iii)</enum><text>The types of polychlorinated biphenyls or polychlorinated biphenyls items expected to be removed from the vessels.</text>
 </clause><clause id="id2d1df0d2-5f85-4e97-972c-574fefc84f2d"><enum>(iv)</enum><text>The number of vessels proposed for import and maximum tonnage.</text> </clause><clause id="id73afd6c4-29d4-484b-854c-7841b89b17c5"><enum>(v)</enum><text>The period of time covered by the import notice (not to exceed one year) and the start and end dates of shipment.</text>
 </clause></subparagraph><subparagraph id="idd7d8de09-0a5c-47dc-8fc5-378c861dead8"><enum>(B)</enum><header>Form</header><text>Each notice under this paragraph shall be clearly marked <quote>PCB Waste Import Notice</quote> and shall be submitted to the Environmental Protection Agency in such form and manner as the Environmental Protection Agency may require.</text>
 </subparagraph><subparagraph id="id076b0fff-fb7a-4a0c-adb9-2aec3b01a61e"><enum>(C)</enum><header>Revised notification</header><text>If an importer wishes to change any of the information specified on the original notification, the importer must submit a revised notification, containing notification of the changes, to the Environmental Protection Agency.</text>
							</subparagraph></paragraph><paragraph id="ide934920f-a86b-4613-a275-d27fb4e1e9f0"><enum>(4)</enum><header>Consent</header>
 <subparagraph id="id8ea4faa2-581c-4de8-8fc0-80d1892da7e4"><enum>(A)</enum><header>In General</header><text>An importer shall not import vessels containing regulated levels of polychlorinated biphenyls until the importer has received consent from the Administrator of the Environmental Protection Agency.</text>
 </subparagraph><subparagraph id="id6de71fc0-3a21-4584-8ecc-96137f9b729a"><enum>(B)</enum><header>Terms</header><text>Importers shall only import vessels under the terms of the consent issued by the Administrator of the Environmental Protection Agency under this paragraph and subject to the condition that the facility shall establish a valid written contract, chain of contracts, or equivalent arrangements with other United States facilities, where applicable, to manage the polychlorinated biphenyls and hazardous waste expected to be removed from the vessel or vessels.</text>
 </subparagraph></paragraph><paragraph id="id8ba04c32-4a18-4179-83e2-ff13a3b29b7b"><enum>(5)</enum><header>Report to the environmental protection agency</header><text>Any ship scrapping facility authorized by this subsection to import vessels containing regulated levels of polychlorinated biphenyls shall file with the Administrator of the Environmental Protection Agency, not later than April 1 of each year, a report providing, for each vessel imported in accordance with this subsection, the following information:</text>
 <subparagraph id="id7f64757c-60f1-44fd-a3a2-957fc3f38ebe"><enum>(A)</enum><text>The vessel name and approximated tonnage.</text> </subparagraph><subparagraph id="id13cf9a93-48e3-458f-8ddc-7ca460ec7ba2"><enum>(B)</enum><text>Registration number and flag of the vessel.</text>
 </subparagraph><subparagraph id="idc2c2f8dd-bfe6-4277-a14a-3709394ffa3e"><enum>(C)</enum><text>The date of import.</text> </subparagraph><subparagraph id="id75779f8b-283b-4251-8292-533e9d482391"><enum>(D)</enum><text>The types, quantities, and final destination of all polychlorinated biphenyls and hazardous waste removed.</text>
 </subparagraph><subparagraph id="ida5cd6d35-17b1-47f6-adaa-d1e6c69e7ad5"><enum>(E)</enum><text>The EPA-issued consent number under which the vessel was imported.</text> </subparagraph></paragraph><paragraph id="id4f727a62-4cc5-4ebc-9736-2d4cb9e6ae52"><enum>(6)</enum><header>Applicable laws</header><text>Once a vessel has been imported pursuant to this subsection, the manufacturing, processing, distribution in commerce, use, and disposal of any polychlorinated biphenyls and hazardous waste contained on the vessel shall be carried out in accordance with applicable Federal, State, and local laws and regulations.</text>
 </paragraph><paragraph id="id5d9fb3f0b9ff420fa6fba6021cd4cbc4"><enum>(7)</enum><header>Authority</header><text>The Administrator of the Environmental Protection Agency may promulgate additional standards or procedures for the import of ships that contain regulated levels of polychlorinated biphenyls and hazardous waste, for the purpose of recycling, under this subsection, if—</text>
 <subparagraph id="idb2c2ad45fb80421badd0c75f1ea42706"><enum>(A)</enum><text>the benefits of such additional standards or procedures exceed the costs of those standards or procedures;</text>
 </subparagraph><subparagraph id="iddacdc131ca514325a0d05378cf73068c"><enum>(B)</enum><text>not later than 180 days prior to promulgating such additional standards or procedures, the Administrator of the Environmental Protection Agency submits a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives demonstrating compliance with subparagraph (A) and the reasons such standards or procedures are necessary; and</text>
 </subparagraph><subparagraph id="idc76594a594904f9ebd68c277420758d9"><enum>(C)</enum><text>the Administrator of the Environmental Protection Agency receives the concurrence of the Maritime Administrator on any such additional standards or procedures.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section changed="added" commented="no" committee-id="SSCM00" id="id5d6ac498-3a40-4369-a352-c601369f7ade" reported-display-style="italic"><enum>10.</enum><header>Sea year on contracted vessels</header><text display-inline="no-display-inline">Section 51307 of title 46, United States Code, is amended—</text> <paragraph commented="no" id="idC123851958134E41A1358F21E9D8C2E6"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary</quote> and inserting the following:</text>

 <subsection commented="no" id="id396D28EAABAE4B90B71EBF26628973EF"><enum>(a)</enum><header>In general</header><text>The Secretary</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph commented="no" id="id1494CBED14914719852E197C838C1092"><enum>(2)</enum><text>in paragraph (1) of subsection (a)—</text>
 <subparagraph commented="no" id="id8D837182EB7E41EEA6AB207720BE461F"><enum>(A)</enum><text>by striking <quote>owned or subsidized by</quote> and inserting <quote>owned, subsidized by, or contracted with</quote>; and</text> </subparagraph><subparagraph commented="no" id="id3EE3344C399E463B94099658B2A4E58F"><enum>(B)</enum><text>by inserting <quote>, including in accordance with subsections (b), (c), and (d)</quote> after <quote>Government</quote>; and</text>
 </subparagraph></paragraph><paragraph commented="no" id="id6F655DE9A26D4764BFB1338B7D66C27B"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id912BF7D718664E1A92270F198B7E00D4" reported-display-style="italic" style="OLC"> <subsection id="id77f252fc3c0d431ca12a462ad9d7aed7"><enum>(b)</enum><header>Maritime Security Program vessels</header><text>Subject to subsection (d), the Secretary shall require an operator of a vessel participating in the Maritime Security Program under chapter 531 of this title to carry on each Maritime Security Program vessel 2 United States Merchant Marine Academy cadets, if available, on each voyage.</text>
 </subsection><subsection id="idd225fd3cc8c14f4fbe1fa76a1ccf1c18"><enum>(c)</enum><header>Military Sealift Command vessels</header><text>Subject to subsection (d), the Secretary and Commander of the Military Sealift Command shall require an operator of a vessel contracted for service for the United States Navy’s Military Sealift Command to carry on each such vessel 2 United States Merchant Marine Academy cadets, if available, on each voyage, if the vessel—</text>
 <paragraph id="id39382bf4ee384d3fa85f4e742604b4dc"><enum>(1)</enum><text>is flagged in the United States; and</text> </paragraph><paragraph id="id82b09ab1da4542bfb45c55393a02e61d"><enum>(2)</enum><text>is rated at 10,000 gross tons or higher.</text>
 </paragraph></subsection><subsection id="idbac1e1393cec46888eea0cb70a6a8b3f"><enum>(d)</enum><header>Waiver</header><text>If it is determined at any time by the Secretary or the Commander of the Military Sealift Command that cadets from the United States Merchant Marine Academy would place an undue burden on a vessel or vessel operator, the Secretary or Commander may waive the requirements described in subsection (b) or (c).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section changed="added" committee-id="SSCM00" id="idc2eedb65-da4d-440f-8275-63015c42133b" reported-display-style="italic"><enum>11.</enum><header>GAO report on national maritime strategy</header><text display-inline="no-display-inline">The Comptroller General of the United States shall complete a study and submit to the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Armed Services of the House of Representatives, and the Committee on Transportation and Infrastructure of the House of Representatives, a report on—</text>
 <paragraph id="ide1a2a284-afb9-4342-91bd-b9ae90ac5a0b"><enum>(1)</enum><text>the key challenges, if any, to ensuring that the United States marine transportation system and merchant marine are sufficient to support United States economic and defense needs, as articulated by the Maritime Administration, the Committee on the Marine Transportation System, and other stakeholders;</text>
 </paragraph><paragraph id="id654dea42-91e8-4268-9152-1ceb5934c77a"><enum>(2)</enum><text>the extent to which a national maritime strategy incorporates desirable characteristics of successful national strategies as identified by the Comptroller General, and any key obstacles (as identified by stakeholders) to successfully implementing such strategies; and</text>
 </paragraph><paragraph id="idb814237a-4a83-4002-b790-02afa13da551"><enum>(3)</enum><text>the extent to which Federal efforts to establish national maritime strategy are duplicative or fragmented, and if so, the impact on United States maritime policy for the future.</text>
 </paragraph></section><section changed="added" commented="no" committee-id="SSCM00" id="id1c8f7a08-6db4-47fb-863b-166a46ce1f98" reported-display-style="italic"><enum>12.</enum><header>Department of Transportation Inspector General report on Title XI program</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Department of Transportation Office of Inspector General shall—</text>
 <paragraph commented="no" id="id54431cb4-f369-4bb5-8d73-23221e29bfa5"><enum>(1)</enum><text display-inline="yes-display-inline">initiate an audit of the financial controls and protections included in the policies and procedures of the Department of Transportation for approving loan applications for the loan guarantee program authorized under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/537">chapter 537</external-xref> of title 46, United States Code; and</text>
 </paragraph><paragraph commented="no" id="idef83ac98-b9d7-437f-a112-7f8f02b1a1e6"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Armed Services and the Committee on Transportation and Infrastructure of the House of Representatives a report containing the results of that audit once the audit is completed.</text>
 </paragraph></section><section changed="added" commented="no" committee-id="SSCM00" id="id447a7a43-468d-4b5c-ad16-921d1147ade6" reported-display-style="italic"><enum>13.</enum><header>Multi-year contracts</header><text display-inline="no-display-inline">Nothing in section 3505 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>) may be construed to prohibit the Maritime Administration from entering into a multi-year contract for the procurement of up to 5 new vessels within the National Security Multi-Mission Vessel Program and associated government–furnished equipment, subject to the availability of appropriations.</text>
 </section><section changed="added" committee-id="SSCM00" id="ide3d07813-31fd-42fe-ad44-1bd5d4059957" reported-display-style="italic"><enum>14.</enum><header>Use of State Maritime Academy training vessels</header><text display-inline="no-display-inline">Section 51504(g) of title 46, United States Code, is amended to read as follows:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id55963b41-480b-44d2-88f3-8e5cd03d379a" reported-display-style="italic" style="OLC"> <subsection id="idb1dab0cd-399b-4208-a193-1105490fa705"><enum>(g)</enum><header>Vessel capacity sharing</header> <paragraph id="idbb7426e0-48cd-4579-91e4-42aa612b86fb"><enum>(1)</enum><header>In General</header><text>Not later than 90 days after the date of enactment of the <short-title>Maritime Authorization and Enhancement Act for Fiscal Year 2019</short-title>, the Secretary, acting through the Maritime Administrator, shall upon consultation with the maritime academies, and to the extent feasible with the consent of the maritime academies, implement a program of vessel sharing, requiring maritime academies to share training capacity vessels provided by the Secretary among maritime academies, as necessary to ensure that training needs of each academy are met.</text>
 </paragraph><paragraph id="id2acc07db-843c-4646-b73f-33b7620b4986"><enum>(2)</enum><header>Program of vessel capacity sharing</header><text>For purposes of this subsection, a program of vessel capacity sharing shall include—</text> <subparagraph id="idfbb4e7e7-c004-474e-a305-98f65ce35295"><enum>(A)</enum><text>ways to maximize the available underway training capacity available in the fleet of training vessels;</text>
 </subparagraph><subparagraph id="id06582d22-d492-47c1-b017-2dfc946602e1"><enum>(B)</enum><text>coordinating the dates and duration of training cruises with the academic calendars of maritime academies;</text>
 </subparagraph><subparagraph id="idCF3913A8730F4FFF9D51BFBD66BD95AC"><enum>(C)</enum><text>coordinating academic programs designed to be implemented aboard training vessels among maritime academies; and</text>
 </subparagraph><subparagraph id="idc0949e69-465d-4550-a715-b828b36667f1"><enum>(D)</enum><text>identifying ways to minimize costs.</text> </subparagraph></paragraph><paragraph id="id03a8629e-1e6d-4ec1-8dd4-96b1643d308b"><enum>(3)</enum><header>Evaluation</header><text>Not later than 30 days after the beginning of each fiscal year, the Secretary, acting through the Maritime Administrator, shall evaluate the vessel capacity sharing program under this subsection to determine the optimal utilization of State maritime training vessels, and modify the program as necessary to improve utilization.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" committee-id="SSCM00" id="id817cda00-87ae-42f7-80f4-18fbe693b025" reported-display-style="italic"><enum>15.</enum><header>Permanent authority of Secretary of Transportation to issue vessel war risk insurance</header>
 <subsection id="id64a75e50-9efb-437e-9486-c8e9bedd242b"><enum>(a)</enum><header>In general</header><text>Section 53912 of title 46, United States Code, is repealed.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="id5b8b2df6-548f-4daf-b3e7-27a4647e3ec3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/539">chapter 539</external-xref> of title 46, United States Code, is amended by striking the item relating to section 53912.</text>
 </subsection></section><section changed="added" committee-id="SSCM00" id="idD612F2243F8D48D284E22EFA136215C2" reported-display-style="italic"><enum>16.</enum><header>Buy America</header><text display-inline="no-display-inline">Subsection (c) of section 54101 of title 46, United States Code, is amended by adding at the end the following:</text>

				<paragraph id="id556971673B7E4D15866283AE49E1A86E"><enum>(3)</enum><header>Buy America</header>
 <subparagraph id="id2F99E0EE05F84767AA60CD1147864857"><enum>(A)</enum><header>In General</header><text>Notwithstanding any other provision of law, the Secretary of Transportation shall not obligate any funds authorized to be appropriated to carry out this chapter unless any steel, iron, and manufactured products used in the project authorized under this chapter are produced in the United States.</text>
 </subparagraph><subparagraph id="id38635AC06442430C810C32022BC04712"><enum>(B)</enum><header>Exception</header><text>The provisions of subparagraph (A) shall not apply where the Secretary finds—</text> <clause id="id63B2AFAB67514000985F27FFD1C8F28E"><enum>(i)</enum><text>that their application would be inconsistent with the public interest;</text>
 </clause><clause id="idE404115EEB3242D3A0C2B3C627352EB2"><enum>(ii)</enum><text>that such materials and products are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality; or</text>
 </clause><clause id="id6368223EF7C44C508D1BCE88F82844D9"><enum>(iii)</enum><text>that inclusion of domestic material will increase the cost of the overall project by more than 25 percent.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" committee-id="SSCM00" id="id27675fee-0969-4008-bb6a-7acad4de8c0f" reported-display-style="italic"><enum>17.</enum><header>Navigation system study and report</header>
			<subsection id="id1ea08768-0042-4126-8897-6ce5935717e6"><enum>(a)</enum><header>Study of the Great Lakes System</header>
 <paragraph id="id0e4a0eaa-b220-4c86-a604-585e39d72321"><enum>(1)</enum><header>In General</header><text>The Maritime Administrator shall conduct a comprehensive study of the Great Lakes - Saint Lawrence Seaway navigation system (referred to in this section as the <quote>Great Lakes System</quote>) that examines the current state of the system and makes recommendations for improvements.</text>
 </paragraph><paragraph id="id5612f152-662b-44a9-a414-e52b38ab2186"><enum>(2)</enum><header>Contents</header><text>The study—</text> <subparagraph id="idf610c51a-e05f-48ad-b54e-70f33e3de2fc"><enum>(A)</enum><text>shall examine, with respect to the Great Lakes System—</text>
 <clause id="idfe6e396d-9d08-41d6-ab17-8321029dfd12"><enum>(i)</enum><text>typical cargo routing options;</text> </clause><clause id="idd7c5b806-e6a9-4c14-9d39-fcf4c1fbba5b"><enum>(ii)</enum><text>the cost profile of each route and alternative routes;</text>
 </clause><clause id="id031d70d1-10d0-4b01-8ec2-bac1de275776"><enum>(iii)</enum><text>port infrastructure quality;</text> </clause><clause id="idf370126c-f97f-4667-854a-7e1868161891"><enum>(iv)</enum><text>intermodal connections;</text>
 </clause><clause id="id48d3a5b9-6af1-42a6-8ff6-c5725c4ea4cc"><enum>(v)</enum><text>competing transportation options, including air, rail, and ground transportation and their relative market position;</text>
 </clause><clause id="idfb952baf-deec-4fbb-afed-47267aeebd7d"><enum>(vi)</enum><text>taxes and fees imposed on vessels;</text> </clause><clause id="ida4131114-c0bf-44db-8879-11296d620e46"><enum>(vii)</enum><text>marketing efforts to increase shipments;</text>
 </clause><clause id="idcae94c7c-6957-44d5-bd21-a901ab596ff2"><enum>(viii)</enum><text>subsidies provided to the Great Lakes System and to competing cargo transportation systems;</text> </clause><clause id="idb302b8eb-6eef-444f-a806-aa955029179a"><enum>(ix)</enum><text>the condition of the docks at each port;</text>
 </clause><clause id="id10a93ae8-95db-4ffb-8d6d-07d59fa31967"><enum>(x)</enum><text>United States and Canadian Government icebreaking capabilities to facilitate commercial shipping; and</text>
 </clause><clause id="id2dd8c5ff-7b2a-4177-8261-d341bbc4c28f"><enum>(xi)</enum><text>the condition of vessel navigation infrastructure (such as channels, locks, jetties, and breakwaters) and efforts to maintain, upgrade, or replace that infrastructure; and</text>
 </clause></subparagraph><subparagraph id="id30736762-844f-4dba-96a2-5529c16b0ae2"><enum>(B)</enum><text>shall make recommendations on—</text> <clause id="id3199656f-22e1-4f08-9b5a-64ef3c026361"><enum>(i)</enum><text>the level of additional investment needed to improve the Great Lakes System;</text>
 </clause><clause id="idb551abe8-bbfb-404c-811f-a7c4f22aa468"><enum>(ii)</enum><text>any benefits of increased Federal or State investment in the Great Lakes System; and</text> </clause><clause id="id0e6bb1e1-f3de-41db-ab6d-ea90d3da6a70"><enum>(iii)</enum><text>any regulatory or competitive burdens impeding growth of the Great Lakes System.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="idd7e055b7-b7f2-4ea7-b640-de8bfa9d7d7a"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Maritime Administrator shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Transportation and Infrastructure of the House of Representatives, and the Co-Chairs of the Great Lakes Task Force of the Senate and of the House of Representatives containing the results of the study conducted under this section.</text>
 </subsection><subsection commented="no" id="ida2ec12ce-9115-4334-81c5-a954ea10d1cf"><enum>(c)</enum><header>Contract</header><text>The Maritime Administrator may enter into a contract with an independent entity to carry out the study.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSCM00" id="idd8c5f1d1-9381-45aa-95ec-5bffe4260415" reported-display-style="italic"><enum>18.</enum><header>Miscellaneous</header>
 <subsection commented="no" id="id362da0e7-114b-4088-a5d0-c9da4c4defa1"><enum>(a)</enum><header>Noncommercial vessels</header><text display-inline="yes-display-inline">Section 3514(a) of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/46/51318">46 U.S.C. 51318</external-xref> note) is amended—</text>
 <paragraph commented="no" id="id4568e4d7-87a6-41f3-ae78-ec30068551a7"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Not later than</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id241a336d-76a4-4c86-8c77-9b3c13e39b8f" reported-display-style="italic" style="OLC"> <paragraph commented="no" id="idbfcb12c5-3574-4572-9d1b-40d08e3f21d3"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>

 <subparagraph commented="no" id="id339c815a-1cff-4052-9b0d-4e081843ad44"><enum>(A)</enum><text display-inline="yes-display-inline">Any entity or agency of the United States.</text> </subparagraph><subparagraph commented="no" id="id10aef7da-af00-4fed-94d3-e9ae547bf72f"><enum>(B)</enum><text display-inline="yes-display-inline">The government of a State or territory.</text>
 </subparagraph><subparagraph commented="no" id="idc19f4038-6a74-47da-9f4a-9db1ff3c7ba6"><enum>(C)</enum><text display-inline="yes-display-inline">Any political subdivision of a State or territory.</text> </subparagraph><subparagraph commented="no" id="idcd57a445-286f-4a0f-9a67-b43d8dc2c064"><enum>(D)</enum><text display-inline="yes-display-inline">Any other municipal organization.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfa6d004d-3153-474c-aa8e-fcfb0277ac7c"><enum>(b)</enum><header>Passenger records</header><text>Section 51322(c) of title 46, United States Code, is amended to read as follows:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="ida5f31f62-3d13-47ba-af28-0eff3123f25f" reported-display-style="italic" style="OLC"> <subsection id="id75ff0dab-f4c3-4723-a344-2074f5783fe4"><enum>(c)</enum><header>Maintenance of sexual assault training records</header><text>The Maritime Administrator shall require the owner or operator of a commercial vessel, or the seafarer union for a commercial vessel, to maintain records of sexual assault training for any person required to have such training.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id3b80ee66-a0ac-453a-9fa4-24de35fb9ff5"><enum>(c)</enum><header>National Oceanic and Atmospheric Administration</header><text>Section 3134 of title 40, United States Code, is amended by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id5630d2d9-c06e-4fda-9441-c6849baebb17" reported-display-style="italic" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="idb77966c5-2da3-4df1-b9b7-434e50adbd57"><enum>(c)</enum><header>National Oceanic and Atmospheric Administration</header><text>The Secretary of Commerce may waive this subchapter with respect to contracts for the construction, alteration, or repair of vessels, regardless of the terms of the contracts as to payment or title, when the contract is made under the Act entitled ‘An Act to define the functions and duties of the Coast and Geodetic Survey, and for other purposes’, approved August 6, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/33/883a">33 U.S.C. 883a</external-xref> et seq.).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
