		<section id="id68004A141D204E8F934757FF1A40B2C5" section-type="section-one"><enum>1.</enum><header>Assumption by States of certain ESA responsibilities</header>
 <subsection id="idB70781F27C944FB9BDF2BEE2ABB6A5DB"><enum>(a)</enum><header>In general</header><text>The Endangered Species Act of 1973 is amended by inserting after section 6 (<external-xref legal-doc="usc" parsable-cite="usc/16/1535">16 U.S.C. 1535</external-xref>) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF947BD62652E49C7A44E44EB8A39DEB6" style="OLC">
					<section id="id26D36F56259A448A806FCE1EA78573A4"><enum>6A.</enum><header>Assumption by States of certain responsibilities relating to highway projects</header>
						<subsection id="id177c7d4744494294a8afb67701bd0f22"><enum>(a)</enum><header>Establishment</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id729ec0ea4cab493f8a90c2276fcc0834"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out an assignment program (referred to in this section as the <term>program</term>) to allow States to assume certain responsibilities of the Secretary with respect to agency actions applicable to highway projects within the State.</text>
							</paragraph><paragraph id="idc201cd6fe9b841f3af84bcffe297fba8"><enum>(2)</enum><header>Assumption of responsibility</header>
 <subparagraph id="id130e881b3b9a40a494edd7b08a72edfb"><enum>(A)</enum><header>In general</header><text>Subject to the other requirements of this section, on written agreement of the Secretary and a State (which may be in the form of a memorandum of understanding), the Secretary may assign, and the State may assume, the responsibilities of the Secretary under subsections (a) and (b) of section 7 with respect to agency actions (as defined in subsection (a)(2) of that section) that are applicable to one or more highway projects in the State.</text>
								</subparagraph><subparagraph id="idbc261be5218f4a9eb3f52a5060b1183d"><enum>(B)</enum><header>Additional responsibility</header>
 <clause id="id95096B47857A4DDBAFA8B9D42FA54B99"><enum>(i)</enum><header>In general</header><text>If a State assumes responsibility under subparagraph (A)—</text> <subclause id="id4c895ad8fafa4037afb5c5c9822026bc"><enum>(I)</enum><text>the Secretary may assign to the State, and the State may assume, all or part of the responsibilities of the Secretary described in that subparagraph for environmental review, consultation, or other action required under any Federal environmental law pertaining to the review or approval of highway projects described in the agreement referred to in that subparagraph; and</text>
 </subclause><subclause id="id1ebbdffe476b4ce8834731a42d3cb41d"><enum>(II)</enum><text>subject to clause (ii), on the request of the State, the Secretary may also assign to the State, and the State may assume, the responsibilities of the Secretary described in that subparagraph for one or more railroad, public transportation, or multimodal projects within the State.</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd62fd8116672469db132f3f03a6e1235"><enum>(ii)</enum><header>Exclusion of projects</header><text>In any State that assumes a responsibility of the Secretary under clause (i)(II), a recipient of assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, may submit to the Secretary a request that the Secretary shall maintain the responsibility of the Secretary with respect to one or more public transportation projects carried out by the recipient in the State.</text>
 </clause></subparagraph><subparagraph id="id119d2efed5ef4becbf4e2b09a2856ea0"><enum>(C)</enum><header>Procedural and substantive requirements</header><text>A State shall assume responsibility under this section subject to the same procedural and substantive requirements as would apply if the responsibility were carried out by the Secretary.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91613169714b473d92c80c14cc15114a"><enum>(D)</enum><header>Federal responsibility</header><text>Any responsibility of the Secretary that is not explicitly assumed by a State by written agreement under this section shall remain the responsibility of the Secretary.</text>
 </subparagraph><subparagraph id="idae4f9141a3d9446793bdee6051446219"><enum>(E)</enum><header>No effect on authority</header><text>Nothing in this section preempts or interferes with any power, jurisdiction, responsibility, or authority of a Federal agency (other than the United States Fish and Wildlife Service), except with respect to an authority delegated by the Secretary pursuant to subparagraph (A) under applicable law regarding a project or agency action described in subparagraph (A) or (B).</text>
 </subparagraph><subparagraph id="id5a1354ff7791492f8f0e16eb28257bd1"><enum>(F)</enum><header>Preservation of flexibility</header><text>The Secretary may not require a State, as a condition of participation in the program, to forgo a project delivery method that is otherwise permissible for a project described in subparagraph (A) or (B).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id392a12a4329449dc9fdf39aa903b400e"><enum>(G)</enum><header>Legal fees</header><text>A State that assumes a responsibility of the Secretary under this section for a project described in subparagraph (A) or (B) may use funds apportioned to the State under section 104(b)(2) of title 23, United States Code, as necessary, for attorneys' fees directly attributable to eligible activities associated with the project.</text>
								</subparagraph></paragraph></subsection><subsection id="id2de52118e73047dc97ce6bff47ed6368"><enum>(b)</enum><header>State participation</header>
 <paragraph id="id6d7516a957194989ad350de8ef91d6f5"><enum>(1)</enum><header>Participating States</header><text>To be eligible to participate in the program, a State shall—</text> <subparagraph id="idD1FA41A3734D4B3CA973DEDC06D963EA"><enum>(A)</enum><text>be participating in the surface transportation project delivery program under section 327 of title 23, United States Code; and</text>
 </subparagraph><subparagraph id="idB65596B71B594797A74F1D2AC5A273DA"><enum>(B)</enum><text>assume the responsibilities of the Secretary of Transportation under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) pursuant to that section.</text>
 </subparagraph></paragraph><paragraph id="id7a0684491e664f35bcaafb27adc0bc15"><enum>(2)</enum><header>Application</header><text>Not later than 270 days after the date of enactment of this section, the Secretary shall amend, as appropriate, regulations that establish requirements relating to information required in any application of a State to participate in the program, including, at a minimum—</text>
 <subparagraph id="id734d4bfb74184d6b94bc31c72ad54385"><enum>(A)</enum><text>the projects or classes of projects for which the State anticipates exercising the authority that may be granted under the program;</text>
 </subparagraph><subparagraph id="id0c668ed0765c4587854b1ca0f40ddcce"><enum>(B)</enum><text>verification of the financial resources necessary to carry out the authority that may be granted under the program; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id473a45062d6f4713bc5de98fe305fdbc"><enum>(C)</enum><text>evidence of the notice and solicitation of public comment by the State relating to participation of the State in the program, including copies of comments received from that solicitation.</text>
								</subparagraph></paragraph><paragraph id="idd810d240b98b463b8f367de2bcc5ca57"><enum>(3)</enum><header>Public notice</header>
 <subparagraph id="id640aca4c24b04850863290303bc6bb30"><enum>(A)</enum><header>In general</header><text>Each State that submits an application in accordance with the regulations described in paragraph (2) shall give notice of the intent of the State to participate in the program by not later than 30 days before the date of submission of the application.</text>
 </subparagraph><subparagraph id="id32b5aebb0e1c4b2f906aeba36e1b2187"><enum>(B)</enum><header>Method of notice and solicitation</header><text>The State shall provide notice and solicit public comment under this paragraph by publishing the complete application of the State in accordance with the appropriate public notice requirements of the State.</text>
 </subparagraph></paragraph><paragraph id="id14ade089597c47dfbe03a1254976b8be"><enum>(4)</enum><header>Selection criteria</header><text>The Secretary may approve the application of a State under this subsection only if—</text> <subparagraph id="idb70b61939e964a0ea4ac9fc28652ecf0"><enum>(A)</enum><text>any necessary changes to regulations pursuant to paragraph (2) have been carried out;</text>
 </subparagraph><subparagraph id="id755c7c7f7b6d438cbe9e03e5b182ce8e"><enum>(B)</enum><text>the Secretary determines that the State has the capability, including financial and personnel, to assume the responsibility; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf52ee635dfc441c4accf67b21f991610"><enum>(C)</enum><text>the head of the State agency with primary jurisdiction over highway matters enters into a written agreement with the Secretary, as described in subsection (c).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda50c41ce6ea4ac198e59ca10d304308"><enum>(5)</enum><header display-inline="yes-display-inline">Other Federal agency views</header><text display-inline="yes-display-inline">If a State applies to assume a responsibility of the Secretary that would have required the Secretary to consult with another Federal agency, the Secretary shall solicit the views of the Federal agency before approving the application of the State under this subsection.</text>
 </paragraph></subsection><subsection id="id6f2c57b31ca24340ab292d9ed09efeee"><enum>(c)</enum><header>Written agreement</header><text>A written agreement under this section shall—</text> <paragraph id="idacf111f2355d4ba6bd0c5ac353e97ef6"><enum>(1)</enum><text>be executed by—</text>
 <subparagraph id="idA42B265508F647349DD2EE440723BDC7"><enum>(A)</enum><text>the Governor of the applicable State; or</text> </subparagraph><subparagraph id="id472A54593B2A4FE688F04F961DB8FA11"><enum>(B)</enum><text>the top-ranking transportation official in the State who is charged with responsibility for highway construction;</text>
 </subparagraph></paragraph><paragraph id="id0c0331595940444aa40a9c92ab247c23"><enum>(2)</enum><text>be in such form as the Secretary may require;</text> </paragraph><paragraph id="ida61f05b2b17f4d2e866e6373a0d77a80"><enum>(3)</enum><text>provide that the State—</text>
 <subparagraph id="id8395e5caa9b94eb49c686866951c3987"><enum>(A)</enum><text>agrees to assume all or part of the responsibilities of the Secretary referred to in subsection (a);</text>
 </subparagraph><subparagraph id="idd24b2db290f848c8bc332f193d76d0c8"><enum>(B)</enum><text>expressly consents, on behalf of the State, to accept the jurisdiction of the Federal courts for the compliance, discharge, and enforcement of any responsibility of the Secretary assumed by the State;</text>
 </subparagraph><subparagraph id="id17a36e4e31574e8585d42eabf9e17cae"><enum>(C)</enum><text>certifies that State laws (including regulations) are in effect that—</text> <clause id="id68bdca44308a4f9389f0a8c2a5a4f812"><enum>(i)</enum><text>authorize the State to take the actions necessary to carry out the responsibilities being assumed; and</text>
 </clause><clause id="id0395f692aa69420187b92ede14c9778d"><enum>(ii)</enum><text>are comparable to section 552 of title 5, United States Code, including providing that any decision regarding the public availability of a document under those State laws is reviewable by a court of competent jurisdiction; and</text>
 </clause></subparagraph><subparagraph id="id7334c2ce65d245c0a615d661241a6abe"><enum>(D)</enum><text>agrees to maintain the financial resources necessary to carry out the responsibilities being assumed;</text>
 </subparagraph></paragraph><paragraph id="id00fba125bcbe4dc5a86e6e09b6cf0312"><enum>(4)</enum><text>require the State to provide to the Secretary any information the Secretary reasonably considers necessary to ensure that the State is adequately carrying out the responsibilities assigned to the State;</text>
 </paragraph><paragraph id="idc529e2c4921a4307b0c67986fedf77db"><enum>(5)</enum><text>have a term of not more than 5 years; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0bebcccf055f4ecba0360e7c0d1ac30b"><enum>(6)</enum><text>be renewable.</text>
							</paragraph></subsection><subsection id="id334696d3cd104e6195aca6999ae026a1"><enum>(d)</enum><header>Jurisdiction</header>
 <paragraph id="ida101523cb0854c9ba257cbcd7eb81f64"><enum>(1)</enum><header>In general</header><text>The United States district courts shall have exclusive jurisdiction over any civil action against a State for failure to carry out any responsibility assumed by the State pursuant to this section.</text>
 </paragraph><paragraph id="idabaaa1dddddf4f419e1b9cd82984842c"><enum>(2)</enum><header>Legal standards and requirements</header><text>A civil action under paragraph (1) shall be governed by the legal standards and requirements that would apply in such a civil action against the Secretary had the Secretary taken the actions in question.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22babe9f0e774e19b5f0712fd242330a"><enum>(3)</enum><header>Intervention</header><text>The Secretary shall have the right to intervene in any action described in paragraph (1).</text> </paragraph></subsection><subsection id="id44082520d3c744c9b963d02b0836fe79"><enum>(e)</enum><header>Effect of assumption of responsibility</header><text>A State that assumes responsibility under subsection (a)(2) shall be solely responsible and solely liable for carrying out, in lieu of, and without further approval of, the Secretary, those responsibilities, until the date on which the program is terminated in accordance with subsection (j).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idbe3260f88fbc4ab397d294c188971e9c"><enum>(f)</enum><header>Limitations on agreements</header><text>Nothing in this section permits a State to assume any rulemaking authority of the Secretary under any Federal law.</text>
						</subsection><subsection id="idedd4e50064a8403f95e29fda67d45943"><enum>(g)</enum><header>Audits</header>
 <paragraph id="id8a3b9bbaae194efa8daad2593e63d627"><enum>(1)</enum><header>In general</header><text>To ensure compliance by a State with an agreement of the State under subsection (c) (including compliance by the State with all Federal laws for which responsibility is assumed under subsection (a)(2)), for each State participating in the program, the Secretary shall—</text>
 <subparagraph id="id179a54139a1c4781ab5a8123d46a5054"><enum>(A)</enum><text>not later than 180 days after the date of execution of the applicable agreement, meet with the State—</text>
 <clause id="idE671F868EF1F43ED8C49DF7419861C2F"><enum>(i)</enum><text>to review the implementation of the agreement; and</text>
 </clause><clause id="id83C8DC5864A34B99B4359E9EBE483A91"><enum>(ii)</enum><text>to discuss plans for the first annual audit;</text>
 </clause></subparagraph><subparagraph id="id02f9a1894bf74e16a750299fb4c4cb48"><enum>(B)</enum><text>conduct annual audits during each of the first 4 years of State participation in the program; and</text> </subparagraph><subparagraph id="ideae5c043e0a24ee7bbddbe78cd0ba1d7"><enum>(C)</enum><text>ensure that the time period for completing an annual audit, from initiation to completion (including public comment and responses to those comments), does not exceed 180 days.</text>
								</subparagraph></paragraph><paragraph id="id6c7572bcf2ff465898744e269261e56a"><enum>(2)</enum><header>Public availability and comment</header>
 <subparagraph id="id462eedd90b614bf3842cd519cc81769c"><enum>(A)</enum><header>In general</header><text>An audit conducted under paragraph (1) shall be provided to the public for comment.</text> </subparagraph><subparagraph id="id153e9fc6365948f9b5c6e00eec82f138"><enum>(B)</enum><header>Response</header><text>Not later than 60 days after the date on which the period for public comment ends, the Secretary shall respond to public comments received under subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="idaac9bcfd17274afb9f506936050bc95e"><enum>(3)</enum><header>Audit team</header>
 <subparagraph id="id7a4768c8a55d41a3b556a0f3757460be"><enum>(A)</enum><header>In general</header><text>An audit conducted under paragraph (1) shall be carried out by an audit team determined by the Secretary, in consultation with the State, in accordance with subparagraph (B).</text>
 </subparagraph><subparagraph id="idf1c8a9f97d714ad4ba6edc0ebbfd07b7"><enum>(B)</enum><header>Consultation</header><text>Consultation with the State under subparagraph (A) shall include a reasonable opportunity for the State to review, and provide comments regarding, the proposed members of the audit team.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4528c731149a452ca38795a5eba1892e"><enum>(h)</enum><header>Monitoring</header><text>After the end of the fourth year of the participation by a State in the program, the Secretary shall monitor compliance by the State with the written agreement under subsection (c), including the provision by the State of financial resources to carry out the written agreement.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id9d84b21d68f74060b83b9621021973ab"><enum>(i)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">The Secretary shall submit to Congress an annual report that describes the administration of the program during the preceding calendar year.</text>
						</subsection><subsection id="idd1fc57c8bd2a48c691c57668186262f5"><enum>(j)</enum><header>Termination</header>
 <paragraph id="id879c3b3e8f7c40f09eb04a7b92cdd705"><enum>(1)</enum><header>Termination by Secretary</header><text>The Secretary may terminate the participation of a State in the program if—</text> <subparagraph id="idd05ecc1c5a7947e587473ca3406cd10c"><enum>(A)</enum><text>the Secretary determines that the State is not adequately carrying out the responsibilities assigned to the State pursuant to this section;</text>
 </subparagraph><subparagraph id="ide852073492064806b8288251fb6fbd8f"><enum>(B)</enum><text>the Secretary provides to the State—</text> <clause id="idbb36af564c684214b0e28a16b081cf2f"><enum>(i)</enum><text>a notification of the determination of noncompliance;</text>
 </clause><clause id="id567dc86114c4407c99a9898e86eb65af"><enum>(ii)</enum><text>a period of not less than 120 days to take such corrective action as the Secretary determines to be necessary to comply with the applicable agreement; and</text>
 </clause><clause id="idd4299f02aaa24398b67d5375ca6ab8e8"><enum>(iii)</enum><text>on request of the Governor of the State, a detailed description of each responsibility in need of corrective action regarding an inadequacy identified under subparagraph (A); and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf4e02ca0986c4820a5363ccc5646401e"><enum>(C)</enum><text>the State, after the notification and period for corrective action provided under subparagraph (B), fails to take satisfactory corrective action, as determined by the Secretary.</text>
 </subparagraph></paragraph><paragraph id="id7876d065e7aa4a43bb3bea4b5c319a84"><enum>(2)</enum><header>Termination by State</header><text>The State may terminate the participation of the State in the program at any time by providing to the Secretary a notice, by not later than the date that is 90 days before the date of termination, subject to such terms and conditions as the Secretary may provide.</text>
 </paragraph></subsection><subsection id="idb81f9f4f57044438b8ee4206853ceff2"><enum>(k)</enum><header>Capacity building</header><text>The Secretary, in cooperation with representatives of State officials, may carry out education, training, peer-exchange, and other initiatives as appropriate—</text>
 <paragraph id="id85ae82a9df55468cb4a96b5a2a3e57cb"><enum>(1)</enum><text>to assist States in developing the capacity to participate in the program; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1ab9204189a4038847527d3707eca71"><enum>(2)</enum><text>to promote information sharing and collaboration among States that are participating in the program.</text>
 </paragraph></subsection><subsection id="idc184e034b75c4bbd909a5a82f1a38300"><enum>(l)</enum><header>Relationship to locally administered projects</header><text>A State granted authority under this section may, as appropriate and on the request of a local government—</text>
 <paragraph id="id50fb51bfbeeb46558fd0156fd2786cfd"><enum>(1)</enum><text>exercise that authority on behalf of the local government for a locally administered project; or</text> </paragraph><paragraph id="iddb0017603dca49f99bd5c1f95c0b1b4f"><enum>(2)</enum><text>provide guidance and training regarding consolidating and minimizing the documentation and environmental analyses necessary for sponsors of a locally administered project to comply with—</text>
 <subparagraph id="id736EB1213F654E6E985ECA7315EC31B0"><enum>(A)</enum><text>section 7; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3D725DC497E3460A88C993CF310AA0EB"><enum>(B)</enum><text>any comparable requirements under State law.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id88D977ECDF204C429C06834235D4FE72"><enum>(b)</enum><header>Conforming amendments</header><text>Section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>) is amended—</text> <paragraph id="id25E72593D9334F4BB9167A0A84FCDD05"><enum>(1)</enum><text>in subsection (a)—</text>
 <subparagraph id="id8DAF1CAF4152476192C77C5857D7CFC0"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id6E09A628AFE54D33AC6B2291F543FE6F" style="OLC"> <paragraph id="id3A6D28F911E747FE8343C26D8B951163"><enum>(1)</enum><header>Federal agency actions</header> <subparagraph id="id4935FAC1087B425C990224077C08ADA1"><enum>(A)</enum><header>In general</header><text>The Secretary shall—</text>
 <clause id="id8F55B97F5209417E95AF9A6FE33BC2CB"><enum>(i)</enum><text>review other programs administered by the Secretary; and</text> </clause><clause id="id2A73ADD541EE42BA865AF0B5450A9089"><enum>(ii)</enum><text>use those programs in furtherance of the purposes of this Act.</text>
 </clause></subparagraph><subparagraph id="id0636F3088DCB41799047380511FC324E"><enum>(B)</enum><header>Other agencies</header><text>The head of each other Federal department or agency, in consultation with, and with the assistance of, the Secretary or a State that has assumed a responsibility of the Secretary pursuant to section 6A, as applicable, shall use the authorities of the department or agency in furtherance of the purposes of this Act by carrying out programs for the conservation of endangered species and threatened species listed under section 4.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
