		<official-title>To amend title XVIII of the Social Security Act to prohibit health plans and pharmacy benefit
			 managers from restricting pharmacies from informing individuals regarding
			 the prices for certain drugs and biologicals.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Know the Lowest Price Act of 2018</short-title></quote>.</text>
		</section><section id="idA62B2419D53C497FA8A5EDEE205B5604"><enum>2.</enum><header>Prohibition on limiting certain information on drug prices</header>
 <subsection id="idF56ABE50008D499EBB9BF1D811BC9E08"><enum>(a)</enum><header>In general</header><text>Section 1860D–4 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-104">42 U.S.C. 1395w–104</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id26B2244C613D46E09CB0F5B66C05D4B6" style="OLC">
 <subsection id="id5363CEB2EAB54ADEA6391D348A73D08F"><enum>(m)</enum><header>Prohibition on limiting certain information on drug prices</header><text>A PDP sponsor and a Medicare Advantage organization shall ensure that—</text> <paragraph id="id13916BE5236B4A5AB2B7CFDB2756F58B"><enum>(1)</enum><text>any health benefits plan offered by the sponsor or organization, including a prescription drug plan and an MA–PD plan, does not restrict a pharmacy that dispenses a prescription drug or biological from informing (or penalize such pharmacy for informing) an enrollee of any differential between the price of the drug or biological to the enrollee under the plan and the price the individual would pay for the drug or biological if the enrollee obtained the drug without using any health insurance coverage; and</text>
 </paragraph><paragraph id="idE91871927C794154B86A5C725B9D535A"><enum>(2)</enum><text>any entity that provides pharmacy benefits management services under a contract with any health benefits plan offered by the sponsor or organization does not, with respect to such plan or any health benefits plan that the entity contracts with to provide pharmacy benefits management services and that is offered by an entity other than such sponsor or organization, restrict a pharmacy that dispenses a prescription drug or biological from informing (or penalize such pharmacy for informing) an enrollee of any differential between the price of the drug or biological to the enrollee under the plan and the price the individual would pay for the drug or biological if the enrollee obtained the drug without using any health insurance coverage.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id95149E42AB654EE68A5636423BB17F79"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to plan years beginning on or after January 1, 2020.</text>
