			 laws and providing
			 for the public's safety, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Comprehensive Addiction Reform, Education, and Safety Act of 2018</short-title></quote> or the <quote><short-title>CARES Act</short-title></quote>.</text>
		</section><section id="id7DC49A3B054C4E1C96ABEEB6B52A39F0"><enum>2.</enum><header>Opioid advertising and consumer safety</header>
 <subsection id="id87C8A1DA1BAF4395A4E829DD1A53137F"><enum>(a)</enum><header>Requiring FDA review of television advertisements for controlled substances</header><text>Section 503C of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/353c">21 U.S.C. 353c</external-xref>) is amended—</text> <paragraph id="idCEA5595DD4D8496CABE373B3121790CF"><enum>(1)</enum><text>in subsection (a), by striking <quote>The Secretary</quote> and inserting <quote>Subject to subsection (f), the Secretary</quote>;</text>
 </paragraph><paragraph id="id61E7FD17AC3441798B22EAE8EA8DA8C4"><enum>(2)</enum><text>in subsection (c), by inserting <quote>or (f)</quote> after <quote>subsection (e)</quote>;</text> </paragraph><paragraph id="id8288F949A5AD4E25A08CEBADC559630F"><enum>(3)</enum><text>by redesignating subsection (f) as subsection (g); and</text>
 </paragraph><paragraph id="id6D669B3862C3477D8D355C1F87CA4716"><enum>(4)</enum><text>by inserting after subsection (e) the following:</text> <quoted-block display-inline="no-display-inline" id="id9834692788054600BFDC8F7ACB27D9D2" style="OLC"> <subsection id="id2784C9B8B3F14704A3A686F197427C4B"><enum>(f)</enum><header>Advertisements for controlled substances</header> <paragraph id="idFBC64335A2924F00A36A53C4CDB651D3"><enum>(1)</enum><header>In general</header><text>In the case of a television advertisement for a controlled substance (as defined in section 102 of the Controlled Substances Act)—</text>
 <subparagraph id="id1CCDFB3F2E004087B5177CB05BDEB9C4"><enum>(A)</enum><text>the Secretary shall require the submission of such advertisement under subsection (a); and</text> </subparagraph><subparagraph id="idFC8A45C95A0849819948A5A9FFB810CA"><enum>(B)</enum><text>the sponsor of such advertisement may not disseminate the advertisement until the Secretary has conducted the review under this section.</text>
 </subparagraph></paragraph><paragraph id="idEACDCEC3A21047D3951616E4D39E957F"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $5,000,000 for the period of fiscal years 2019 through 2023 to increase the proficiency and speed of the Secretary in conducting and reviewing television advertisements for controlled substances (as so defined) under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id91CE6F315A6C423CB43F670D1B03856F"><enum>(b)</enum><header>Enforcement</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5BC136632C014BAFB5C8960A970878BF" style="OLC">
 <subsection id="id391C601C2FC1407EA96C3D709224804D"><enum>(eee)</enum><text>The failure to comply with the requirements under section 503C(f).</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block> </subsection><subsection id="id13732DE1FB164E61B27B976D11118796"><enum>(c)</enum><header>Rule of construction</header><text>No amendment made by this section shall preclude the enforcement, under any relevant civil or other enforcement authority, of a State consumer protection statute.</text>
 </subsection></section><section id="idF795C7C07E6E48B2B7EB2EABC7EB03A3"><enum>3.</enum><header>Increasing civil and criminal penalties</header><text display-inline="no-display-inline">Section 402(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/842">21 U.S.C. 842(c)</external-xref>) is amended—</text> <paragraph id="idE517615099F84A89990BAEC0429309C9"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>shall not exceed $10,000.</quote> and inserting the following:</text>
				<quoted-block display-inline="yes-display-inline" id="id4B4D9DF19D374DDCB298F9B27905C818" style="OLC">
 <text>shall not exceed—</text><clause id="id12F5EB5CC22944BE833F2BEC11B967B7"><enum>(i)</enum><text>except as provided in clause (ii), $10,000; and</text> </clause><clause id="id87410F2F545F4A7892343F82607657B4"><enum>(ii)</enum><text>if the violation is committed by a manufacturer of opioids and relates to the reporting of suspicious orders for opioids or failing to maintain effective controls against diversion of opioids, $100,000.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id89D3E5C33E63441DA428A2933B8096B6"><enum>(2)</enum><text>in paragraph (2)—</text> <subparagraph id="idC45F7A89912F4896A6B2799D58AEDBD4"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>or (D)</quote> after <quote>subparagraph (B)</quote>; and</text>
 </subparagraph><subparagraph id="idAC186358D945472C8F30FE20DCAECE27"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idB2580D1A321A4D7DB6C740C0567AB3A3" style="OLC"> <subparagraph id="idDA57C3957DB64D1F8802C273E5592200" indent="up2"><enum>(D)</enum><text>In the case of a violation referred to in subparagraph (A) that was a violation of paragraph (5) or (10) of subsection (a) committed by a manufacturer of opioids that relates to the reporting of suspicious orders for opioids or failing to maintain effective controls against diversion of opioids, the criminal fine under title 18, United States Code, shall not exceed $500,000.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="idcafdbe375fa944f0bbc414064f31fedd"><enum>4.</enum><header>Opioid manufacturer accountability and combatting diversion</header>
 <subsection id="id0AC059B420A84ED687488B9CA9A36760"><enum>(a)</enum><header>Publication of certain records</header><text>Not later than 1 year after the date of enactment of this Act, and every year thereafter, the Administrator of the Drug Enforcement Administration shall publish in the Federal Register and on the Internet website of the Drug Enforcement Administration the prior conviction records under Federal and State law of manufacturers of opioids, as described in section 303(a)(4) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(a)(4)</external-xref>).</text>
 </subsection><subsection id="id71071522B01B47B3A90B5F2077DB2238"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator of the Drug Enforcement Administration for diversion investigators and tactical diversion squads of the Drug Enforcement Administration such sums as may be necessary for each of fiscal years 2019 through 2023, which shall be in addition to any amounts otherwise made available to the Administrator.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HE714DDC9A7E8495DAF42FFA644D316EE"><enum>5.</enum><header>Heroin enforcement groups</header>
 <subsection commented="no" display-inline="no-display-inline" id="HA5E2A72B40B64E5D8334412C372C39EB"><enum>(a)</enum><header>In general</header><text>The Attorney General shall establish heroin enforcement groups within the Drug Enforcement Administration to target and dismantle illicit heroin trafficking organizations.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H233A5DA43B3145B3B32559C6123370A3"><enum>(b)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $50,000,000 for fiscal year 2019.</text> </subsection></section></legis-body> </bill>
