 </subsection></section><section id="H774B97E9D8DD43AFB2A180C460FA4B86"><enum>2.</enum><header>Secretary defined</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of the Army.</text> </section><title id="HE8393BC1803B4D2C9A8C93C30845F58B"><enum>I</enum><header>General Provisions</header> <section commented="no" id="HC9951FBB5EEA4855BC9AA9A3E5E69DB8"><enum>101.</enum><header>Sense of Congress regarding water resources development bills</header><text display-inline="no-display-inline">It is the sense of Congress that, because the missions of the Corps of Engineers for navigation, flood control, beach erosion control and shoreline protection, hydroelectric power, recreation, water supply, environmental protection, restoration, and enhancement, and fish and wildlife mitigation benefit all Americans, and because water resources development projects are critical to maintaining the country’s economic prosperity, national security, and environmental protection, Congress should consider a water resources development bill not less often than once every Congress.</text>
			</section><section id="HDF3B095811164C43B427BEFE15060C01"><enum>102.</enum><header>Use of Harbor Maintenance Trust Fund to support navigation</header>
 <subsection id="H638BA75673274B73AF3ECAA9AFDB61AD"><enum>(a)</enum><header>Availability of amounts</header><text>Section 210 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2238">33 U.S.C. 2238</external-xref>) is amended—</text> <paragraph id="H69BA870C5B3E466DA0FB65BDF8407902"><enum>(1)</enum><text>in the section heading by striking <quote><header-in-text level="section" style="OLC">Authorization of appropriations</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Funding for harbor navigation</header-in-text></quote>;</text>
 </paragraph><paragraph id="HCB26979DACF94AB9AB768673BB257E9F"><enum>(2)</enum><text>by redesignating subsections (c), (d), (e), and (f) as subsections (d), (e), (f), and (g), respectively; and</text>
 </paragraph><paragraph id="HA89EF7F7C25C458B893666D17416360E"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text> <quoted-block id="HE6B49520EE854D559BA051F05CA8EA02" style="OLC"> <subsection id="HF33114508BB64A76B9AF3B11FCDA90FA"><enum>(c)</enum><header>Use of collected funds in fiscal year 2029 and thereafter</header> <paragraph id="HCE734B39CC42424BBEE93B298DC8CBFA"><enum>(1)</enum><header>Use of funds</header><text>In addition to amounts appropriated under subsections (a) and (b), there shall be available to the Secretary, out of the Harbor Maintenance Trust Fund, without further appropriation, for fiscal year 2029 and each fiscal year thereafter, such sums as may be necessary to carry out the purposes of subsection (a)(2).</text>
 </paragraph><paragraph id="H3B8B191D80CC4ACAAE6E203997E518D3"><enum>(2)</enum><header>Availability of amounts</header><text>Amounts made available under this subsection shall remain available until expended.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H4917EB38F9FD4F73A89F062FD6D34B76"><enum>(b)</enum><header>Conforming amendments</header><text>Section 210 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2238">33 U.S.C. 2238</external-xref>) is further amended—</text>
 <paragraph id="H18E2B056C29749F7A4D9E286DA63863C"><enum>(1)</enum><text>in subsection (d)(2)(A)(i) (as redesignated by subsection (a)(2) of this section) by striking <quote>subsection (e)</quote> and inserting <quote>subsection (f)</quote>;</text> </paragraph><paragraph id="HF0421F4DDC564093AC6F3DEED0EC8CDE"><enum>(2)</enum><text>in subsection (e)(3)(B)(i) (as redesignated by subsection (a)(2) of this section) by striking <quote>subsection (c)(2)(A)</quote> and inserting <quote>subsection (d)(2)(A)</quote>; and</text>
 </paragraph><paragraph id="HD85DDFEF8B7049D3BE7C6EDCC4C24912"><enum>(3)</enum><text>in subsection (f)(2)(A)(ii) (as redesignated by subsection (a)(2) of this section) by striking <quote>subsection (d)(2)</quote> and inserting <quote>subsection (e)(2)</quote>.</text> </paragraph></subsection></section><section id="HC72694E2485442EDBFFB14606FBBC88B"><enum>103.</enum><header>Assessment of harbors and inland harbors</header><text display-inline="no-display-inline">Section 210(e) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2238">33 U.S.C. 2238(e)</external-xref>) is amended—</text>
 <paragraph id="HC034DA1331AE420AADC0DF23953C808D"><enum>(1)</enum><text>in paragraph (1), by striking <quote>shall assess the</quote> and inserting <quote>shall assess, and issue a report to Congress on, the</quote>; and</text> </paragraph><paragraph id="HAE0489F2AD3A407091EAB762DF21042B"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following:</text>

 <subparagraph id="H4F0A30E56D30447CA41D228720523478"><enum>(C)</enum><header>Opportunities for beneficial use of dredged materials</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary shall identify potential opportunities for the beneficial use of dredged materials obtained from harbors and inland harbors referred to in subsection (a)(2), including projects eligible under section 1122 of the Water Resources Development Act of 2016 (130 Stat. 1645; <external-xref legal-doc="usc" parsable-cite="usc/33/2326">33 U.S.C. 2326</external-xref> note).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H70FDF2682DA34D7B93E55EF6640B4BAB"><enum>104.</enum><header>Levee safety initiative reauthorization</header><text display-inline="no-display-inline">Title IX of the Water Resources Development Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/33/3301">33 U.S.C. 3301</external-xref> et seq.) is amended—</text> <paragraph id="H841D845E01D64B1792970FE1AF5E642B"><enum>(1)</enum><text display-inline="yes-display-inline">in section 9005(g)(2)(E)(i), by striking <quote>2015 through 2019</quote> and inserting <quote>2019 through 2023</quote>; and</text>
 </paragraph><paragraph id="HF5EC407E7BB847DE9BF75526D3677818"><enum>(2)</enum><text>in section 9008, by striking <quote>2015 through 2019</quote> each place it appears and inserting <quote>2019 through 2023</quote>.</text> </paragraph></section><section id="H20272BF278294D14B3A0E1A5C97177F5"><enum>105.</enum><header>Dam safety</header><text display-inline="no-display-inline">Section 14 of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467j">33 U.S.C. 467j</external-xref>) is amended by striking <quote>2015 through 2019</quote> each place it appears and inserting <quote>2019 through 2023</quote>.</text>
 </section><section id="H80DC97F39F2548A79354646695F462FB"><enum>106.</enum><header>Rehabilitation of Corps of Engineers constructed dams</header><text display-inline="no-display-inline">Section 1177(e) of the Water Resources Development Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/33/467f-2">33 U.S.C. 467f–2</external-xref> note) is amended by striking <quote>$10,000,000</quote> and inserting <quote>$40,000,000</quote>.</text>
			</section><section id="H4DA12342101C4389BE965DF16274A948"><enum>107.</enum><header>Forecast-informed reservoir operations</header>
 <subsection id="HA0C28BA149384D2DA7AD06CEE3037CD4"><enum>(a)</enum><header>Report on forecast-Informed reservoir operations</header><text>Not later than one year after the date of completion of the forecast-informed reservoir operations research study pilot program at Coyote Valley Dam, Russian River Basin, California (authorized by the River and Harbor Act of 1950 (64 Stat. 177)), the Secretary shall issue a report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate on the results of the study pilot program.</text>
 </subsection><subsection id="H0388DA95E23D4FC2902FA7DDBF799CDB"><enum>(b)</enum><header>Contents of report</header><text>The Secretary shall include in the report issued under subsection (a)—</text> <paragraph id="H1E816557068C4AA08E62DA2447FA80D3"><enum>(1)</enum><text display-inline="yes-display-inline">an analysis of the use of forecast-informed reservoir operations at Coyote Valley Dam, California;</text>
 </paragraph><paragraph id="HA4D9B64C1D1B43248D783D469BFB1E63"><enum>(2)</enum><text>an assessment of the viability of using forecast-informed reservoir operations at other dams owned or operated by the Secretary;</text>
 </paragraph><paragraph id="H6D01A06B4A96468BA8F7D2838370BB4A"><enum>(3)</enum><text>an identification of other dams owned or operated by the Secretary where forecast-informed reservoir operations may assist the Secretary in the optimization of future reservoir operations; and</text>
 </paragraph><paragraph id="H5F3F5354A38A40B5B15212217DEFEF29"><enum>(4)</enum><text>any additional areas for future study of forecast-informed reservoir operations.</text> </paragraph></subsection></section><section id="H7D68342EF1304B6B81235540EE88D518"><enum>108.</enum><header>Emergency response to natural disasters</header> <subsection id="H5611E049C4BE4968B50D9AA5B3A4BEC3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5(a)(1) of the Act of August 18, 1941 (<external-xref legal-doc="usc" parsable-cite="usc/33/701n">33 U.S.C. 701n(a)(1)</external-xref>) is amended in the first sentence—</text>
 <paragraph id="H2DD54CF02FA34BCFAE51ADD7E09A1413"><enum>(1)</enum><text>by striking <quote>strengthening, raising, extending, or other modification thereof</quote> and inserting <quote>strengthening, raising, extending, realigning, or other modification thereof</quote>; and</text> </paragraph><paragraph id="HC7B5A6875C9543D79531A0D64BF904C9"><enum>(2)</enum><text>by striking <quote>structure or project damaged or destroyed by wind, wave, or water action of other than an ordinary nature to the design level of protection when, in the discretion of the Chief of Engineers,</quote> and inserting <quote>structure or project damaged or destroyed by wind, wave, or water action of other than an ordinary nature to either the pre-storm level or the design level of protection, whichever provides greater protection, when, in the discretion of the Chief of Engineers,</quote>.</text>
 </paragraph></subsection><subsection id="H3DFD39B761B747478E0A4BB8A9AFF33C"><enum>(b)</enum><header>Duration</header><text display-inline="yes-display-inline">Section 156(e) of the Water Resources Development Act of 1976 (42 U.S.C. 1962d–5f(e)) is amended by striking <quote>6 years</quote> and inserting <quote>9 years</quote>.</text>
 </subsection></section><section id="H908633B082794A1DAA07116D97B7689A"><enum>109.</enum><header>Integrated water resources planning</header><text display-inline="no-display-inline">In carrying out a water resources development feasibility study, the Secretary shall consult with local governments in the watershed covered by such study to determine if local water management plans exist, or are under development, for the purposes of stormwater management, water quality improvement, aquifer recharge, or water reuse.</text>
			</section><section id="HAE6567EFC984404B9AF01A54C037C11E"><enum>110.</enum><header>Mitigation banks</header>
 <subsection commented="no" id="HA3C78B5F44D24CF193A0170F5835AA58"><enum>(a)</enum><header>Definition of mitigation bank</header><text>In this section, the term <term>mitigation bank</term> has the meaning given that term in section 332.2 of title 33, Code of Federal Regulations.</text> </subsection><subsection id="HA51A5F414451448994EB9D9B816AC329"><enum>(b)</enum><header>Guidance</header><text>The Secretary shall issue guidance on the use of mitigation banks to meet requirements for water resources development projects in order to update mitigation bank credit release schedules to—</text>
 <paragraph id="H6959AF21103449468833291A24F7F3CD"><enum>(1)</enum><text>support the goal of achieving efficient permitting and maintaining appropriate environmental protections; and</text>
 </paragraph><paragraph id="H160BF5CCB80349D8B026D14E3EFAB051"><enum>(2)</enum><text>promote increased transparency in the use of mitigation banks.</text> </paragraph></subsection><subsection id="H366202149BA547548763B4B28EF40391"><enum>(c)</enum><header>Requirements</header><text>The guidance issued under subsection (b) shall—</text>
 <paragraph commented="no" id="H92CC9D7C36B7475581B3EF0BADA7DBE2"><enum>(1)</enum><text>be consistent with—</text> <subparagraph commented="no" id="HDB8840B55F054ED68B516A7F789DCE8C"><enum>(A)</enum><text>part 230 of title 40, Code of Federal Regulations;</text>
 </subparagraph><subparagraph commented="no" id="HB5A23DB3438D42B5B2EB9B0AA83816BC"><enum>(B)</enum><text>section 906 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2283">33 U.S.C. 2283</external-xref>);</text> </subparagraph><subparagraph commented="no" id="HE8A7156D2D1B4B508A951AD8C247D46B"><enum>(C)</enum><text>part 332 of title 33, Code of Federal Regulations; and</text>
 </subparagraph><subparagraph commented="no" id="H7E269DFA1D374F74A452C9BFD9B6DCEE"><enum>(D)</enum><text>section 314(b) of the National Defense Authorization Act for Fiscal Year 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/136">Public Law 108–136</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref> note); and</text>
 </subparagraph></paragraph><paragraph id="H4B3D9E6B9E5D4A769A0B8325C5649343"><enum>(2)</enum><text>provide for—</text> <subparagraph commented="no" id="HBBC9AEE09A604D678493E5464C008B5B"><enum>(A)</enum><text>the mitigation bank sponsor to provide sufficient financial assurances to ensure a high level of confidence that the compensatory mitigation project will be successfully completed, in accordance with applicable performance standards, under section 332.3(n) of title 33, Code of Federal Regulations;</text>
 </subparagraph><subparagraph commented="no" id="H825459EDEE7D442D94CF042FB5CDEF23"><enum>(B)</enum><text>the mitigation bank sponsor to reserve the share of mitigation bank credits required to ensure ecological performance of the mitigation bank, in accordance with section 332.8(o) of title 33, Code of Federal Regulations; and</text>

				</subsection><subsection commented="no" id="H9C6B828DE30A4AD8A57133EDF01671CE"><enum>(b)</enum><header>John Day Dam, Washington and Oregon</header>
 <paragraph commented="no" id="H717CEAED402B4EACBE23CF4C3A6D8BF1"><enum>(1)</enum><header>In general</header><text>The Secretary shall, not later than 180 days after the date of enactment of this Act, and in consultation with the Secretary of the Interior, conduct a study to determine the extent to which Indian Tribes have been displaced as a result of the construction of the John Day Dam, Columbia River, Washington and Oregon, as authorized by section 204 of the Flood Control Act of 1950 (64 Stat. 179), including an assessment of effects related to housing and related improvements.</text>
 </paragraph><paragraph commented="no" id="HF45859EE757944D2A020C472597715D8"><enum>(2)</enum><header>Additional actions</header><text display-inline="yes-display-inline">If the Secretary determines, based on the study under paragraph (1), that assistance is required, the Secretary may use all existing authorities of the Secretary to provide assistance, which may include housing and related improvements, to Indian Tribes displaced as a result of the construction of the John Day Dam, Columbia River, Washington and Oregon.</text>
 </paragraph><paragraph commented="no" id="H54AE036AA16F4D2491646B58FB673DA9"><enum>(3)</enum><header>Repeal</header><text>Section 1178(c)(2) of the Water Resources Development Act of 2016 (130 Stat. 1675) is repealed.</text> </paragraph></subsection><subsection commented="no" id="HBA24804756DA4BB5B5406C303A96FEB6"><enum>(c)</enum><header>The Dalles Dam, Washington and Oregon</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of the Interior, shall complete a village development plan for any Indian Tribe displaced as a result of the construction of the Dalles Dam, Columbia River, Washington and Oregon, as authorized by section 204 of the Flood Control Act of 1950 (64 Stat. 179).</text>
				</subsection></section><section id="HDD278530247B4FBEB6A8D9F30B91055A"><enum>113.</enum><header>Dissemination of information</header>
 <subsection commented="no" id="H23769BF174AD44DE8091338AD8E79D8D"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph commented="no" id="H69467DB716254E1EA14B09086BC86D82"><enum>(1)</enum><text>Congress plays a central role in identifying, prioritizing, and authorizing vital water resources infrastructure activities throughout the United States.</text>
 </paragraph><paragraph commented="no" id="H3577EAA9F04A4DCF9368877A4E8C6C1A"><enum>(2)</enum><text>The Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/121">Public Law 113–121</external-xref>) established a new and transparent process to review and prioritize the water resources development activities of the Corps of Engineers with strong congressional oversight.</text>
 </paragraph><paragraph commented="no" id="H43543B694EE04106AE4EDEF786EBDF20"><enum>(3)</enum><text>Section 7001 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2282d">33 U.S.C. 2282d</external-xref>) requires the Secretary to develop and submit to Congress each year a Report to Congress on Future Water Resources Development and, as part of the annual report process, to—</text>
 <subparagraph commented="no" id="HEB2E61E468DC45D19C98168275CABF49"><enum>(A)</enum><text>publish a notice in the Federal Register that requests from non-Federal interests proposed feasibility studies and proposed modifications to authorized water resources development projects and feasibility studies for inclusion in the report; and</text>
 </subparagraph><subparagraph commented="no" id="HBC74DDE7E77140E888E79B68DD1677B6"><enum>(B)</enum><text>review the proposals submitted and include in the report those proposed feasibility studies and proposed modifications that meet the criteria for inclusion established under such section 7001.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H3C58700F533F485385ECDD0D0AE0C07C"><enum>(4)</enum><text>Congress will use the information provided in the annual Report to Congress on Future Water Resources Development to determine authorization needs and priorities for purposes of water resources development legislation.</text>
 </paragraph><paragraph commented="no" id="H7B49AFA4D7134DB1B4FE02F69B8169FB"><enum>(5)</enum><text>To ensure that Congress can gain a thorough understanding of the water resources development needs and priorities of the United States, it is important that the Secretary take sufficient steps to ensure that non-Federal interests are made aware of the new annual report process, including the need for non-Federal interests to submit proposals during the Secretary’s annual request for proposals in order for such proposals to be eligible for consideration by Congress.</text>
 </paragraph></subsection><subsection id="HAE9B133BD726402B9EC2DBF4AC6B36A0"><enum>(b)</enum><header>Dissemination of process information</header><text>The Secretary shall develop, support, and implement education and awareness efforts for non-Federal interests with respect to the annual Report to Congress on Future Water Resources Development required under section 7001 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2282d">33 U.S.C. 2282d</external-xref>), including efforts to—</text>
 <paragraph id="H24185C4C68F4420C9A8202B91292E9C3"><enum>(1)</enum><text>develop and disseminate technical assistance materials, seminars, and guidance on the annual process as it relates to non-Federal interests;</text>
 </paragraph><paragraph id="H452546B59339480FAB2DF0A4A7E0B1CD"><enum>(2)</enum><text>provide written notice to local elected officials and previous and potential non-Federal interests on the annual process and on opportunities to address local water resources challenges through the missions and authorities of the Corps of Engineers;</text>
 </paragraph><paragraph id="H6C4DB09B4F2B44EAAEC123FB6C94417B"><enum>(3)</enum><text>issue guidance for non-Federal interests to assist such interests in developing proposals for water resources development projects that satisfy the requirements of such section 7001; and</text>
 </paragraph><paragraph id="HDD1C98AC7F2944FD8F90EA3C15E90ECC"><enum>(4)</enum><text>provide, at the request of a non-Federal interest, assistance with researching and identifying existing project authorizations and Corps of Engineers decision documents.</text>
					</paragraph></subsection></section><section id="H96C71949A40C45AB8D856DB5DA005311"><enum>114.</enum><header>Non-Federal engagement and review</header>
				<subsection id="HF6131FDF3FEE4D0D9FEE8DD9016FBF0C"><enum>(a)</enum><header>Public notice</header>
 <paragraph id="H7DE309339B0441759CFF357A132A99C1"><enum>(1)</enum><header>In general</header><text>Prior to developing and issuing any new or revised implementation guidance for a covered water resources development law, the Secretary shall issue a public notice that—</text>
 <subparagraph id="HD743B660FE58460F9080ADD801C79B7B"><enum>(A)</enum><text>informs potentially interested non-Federal stakeholders of the Secretary’s intent to develop and issue such guidance; and</text>
 </subparagraph><subparagraph id="HDC08EAB167BF440285C1008EBC49D16A"><enum>(B)</enum><text>provides an opportunity for interested non-Federal stakeholders to engage with, and provide input and recommendations to, the Secretary on the development and issuance of such guidance.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H6A0380EF201546DE889C8628DB5FCCD9"><enum>(2)</enum><header>Issuance of notice</header><text display-inline="yes-display-inline">The Secretary shall issue the notice under paragraph (1) through a posting on a publicly accessible website dedicated to providing notice on the development and issuance of implementation guidance for a covered water resources development law.</text>
					</paragraph></subsection><subsection id="H075EA94E318F420AA97F088A64CF361E"><enum>(b)</enum><header>Stakeholder engagement</header>
 <paragraph id="HF3DE60C7C1E74915AB9AB66EB5575BD9"><enum>(1)</enum><header>Input</header><text display-inline="yes-display-inline">The Secretary shall allow a minimum of 60 days after issuance of the public notice under subsection (a) for non-Federal stakeholders to provide input and recommendations to the Secretary, prior to finalizing implementation guidance for a covered water resources development law.</text>
 </paragraph><paragraph id="HE258BFFAF4B84108BA8E45F2E67C7FDF"><enum>(2)</enum><header>Outreach</header><text display-inline="yes-display-inline">The Secretary may, as appropriate (as determined by the Secretary), reach out to non-Federal stakeholders and circulate drafts of implementation guidance for a covered water resources development law for informal feedback and recommendations.</text>
 </paragraph></subsection><subsection id="H4F6B8E9C26C54544AC287C6CA884DBEB"><enum>(c)</enum><header>Development of guidance</header><text display-inline="yes-display-inline">When developing implementation guidance for a covered water resources development law, the Secretary shall take into consideration the input and recommendations received from non-Federal stakeholders, and make the final guidance available to the public on-line on a publicly accessible website.</text>
 </subsection><subsection id="H7D3361D09C1B4048B5C9CCDFA8AE9F45"><enum>(d)</enum><header>Covered water resources development law</header><text>In this section, the term <term>covered water resources development law</term> means—</text> <paragraph id="HB6B0A58ADB454071B8CEA9719BCDAF37"><enum>(1)</enum><text display-inline="yes-display-inline">the Water Resources Reform and Development Act of 2014;</text>
 </paragraph><paragraph id="HA3E76C3BBB264A73B798BE2DCA97CA68"><enum>(2)</enum><text display-inline="yes-display-inline">the Water Resources Development Act of 2016;</text> </paragraph><paragraph id="H925DD660D6F54A608619594F6CEDBBF7"><enum>(3)</enum><text>this Act; and</text>
 </paragraph><paragraph id="H7C07C91DD8EF4416916B66B4348D6293"><enum>(4)</enum><text>any Federal water resources development law enacted after the date of enactment of this Act.</text> </paragraph></subsection></section><section id="H7656DE41519E44E2AD4A1C89E0E1EC0A"><enum>115.</enum><header>Comprehensive backlog report</header><text display-inline="no-display-inline">Section 1001(b)(4) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/579a">33 U.S.C. 579a(b)(4)</external-xref>) is amended—</text>
 <paragraph id="H63D464A534654DC4ABE6F27DEC6B0C25"><enum>(1)</enum><text>in the header, by inserting <quote><header-in-text level="paragraph" style="OLC">and operation and maintenance</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">backlog</header-in-text></quote>;</text> </paragraph><paragraph id="HC351736E15344A4BA8985CDFC1989328"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subparagraph (A) to read as follows:</text>

 </clause><clause id="HDAD0CD1FC61045D4AEEF77D76627AEBE"><enum>(ii)</enum><text>a list of major Federal operation and maintenance needs of projects and properties under the control of the Corps of Engineers.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="H80A5BCE9534447B98593722105D677B1"><enum>(3)</enum><text>in subparagraph (B)—</text> <subparagraph commented="no" id="H2D995A0A26534D70817ACC3C2EE4EB42"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, by inserting <quote><header-in-text level="subparagraph" style="OLC">backlog</header-in-text></quote> before <quote><header-in-text level="subparagraph" style="OLC">information</header-in-text></quote>; and</text>

 </clause><clause id="HAD62998679544614B5619D0197AC9A19"><enum>(ii)</enum><text>a brief description of the project or property;</text> </clause><clause id="H0B6C0292351A4DA4BD314D15AC32A08B"><enum>(iii)</enum><text>an estimate of the Federal costs to meet the major operation and maintenance needs at the project or property; and</text>
 </clause><clause id="H68D6E05B234E40638A428303F93EB944"><enum>(iv)</enum><text>an estimate of unmet or deferred operation and maintenance needs at the project or property.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="H187F11363D6E468EA0A29D208F294895"><enum>(5)</enum><text>in subparagraph (D), as so redesignated—</text>
 <subparagraph id="H67793A563FEA41E4B44E416023EAE4D7"><enum>(A)</enum><text>in clause (i), in the matter preceding subclause (I), by striking <quote>Not later than 1 year after the date of enactment of this paragraph, the Secretary shall submit a copy of the list</quote> and inserting <quote>For fiscal year 2019, and biennially thereafter, in conjunction with the President’s annual budget submission to Congress under section 1105(a) of title 31, United States Code, the Secretary shall submit a copy of the lists</quote>; and</text>

 </section><section id="H4555B2BFF3A2428C9CFA2A66F2FF9EB1"><enum>117.</enum><header>Transparency in administrative expenses</header><text display-inline="no-display-inline">Section 1012(b)(1) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2315a">33 U.S.C. 2315a(b)(1)</external-xref>) is amended by striking <quote>The Secretary</quote> and inserting <quote>Not later than 1 year after the date of enactment of the <short-title>Water Resources Development Act of 2018</short-title>, the Secretary</quote>.</text>
			</section><section id="H9402D7D04BE54E1381857AE8569F63B4"><enum>118.</enum><header>Study of the future of the United States Army Corps of Engineers</header>
 <subsection id="HC29F62A1D97F46CDA245B57BEF7ED1EA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall enter into an agreement with the National Academy of Sciences to convene a committee of experts to carry out a comprehensive study on—</text>
 <paragraph id="HFB3BCD9C17E54A97A64EECBE4D5DA6C3"><enum>(1)</enum><text>the ability of the Corps of Engineers to carry out its statutory missions and responsibilities, and the potential effects of transferring the functions (including regulatory obligations), personnel, assets, and civilian staff responsibilities of the Secretary relating to civil works from the Department of Defense to a new or existing agency or sub-agency of the Federal Government, including how such a transfer might affect the Federal Government’s ability to meet the current statutory missions and responsibilities of the Corps of Engineers; and</text>
 </paragraph><paragraph id="H3C7A55EF41C24F94ADE370C7C41C1C74"><enum>(2)</enum><text display-inline="yes-display-inline">improving the Corps of Engineers’ project delivery processes, including recommendations for such improvements, taking into account factors including—</text>
 <subparagraph id="HB02452F9B77344D2A1D84007E12B93C0"><enum>(A)</enum><text>the effect of the annual appropriations process on the ability of the Corps of Engineers to efficiently secure and carry out contracts for water resources projects and perform regulatory obligations; and</text>
 </subparagraph><subparagraph id="H4635F2E10B7B457AA6CAA6726B43D787"><enum>(B)</enum><text display-inline="yes-display-inline">the effect that the current Corps of Engineers leadership and geographic structure at the division and district levels has on its ability to carry out its missions in a cost-effective manner.</text>
 </subparagraph></paragraph></subsection><subsection id="H87C8D9318855441C8B4CB33C8443D17B"><enum>(b)</enum><header>Considerations</header><text>The study carried out under subsection (a) shall include consideration of—</text> <paragraph id="H22056C2234BF47C482A3F1860E2CBD9F"><enum>(1)</enum><text>effects on the national security of the United States;</text>
 </paragraph><paragraph id="H625B1E5ED31443C18674BBFF115D095A"><enum>(2)</enum><text>the ability of the Corps of Engineers to maintain sufficient engineering capability and capacity to assist ongoing and future operations of the United States Armed Services; and</text>
 </paragraph><paragraph id="H86F1FDD854D84494B2CB0741C3E65B1E"><enum>(3)</enum><text>emergency and natural disaster response obligations of the Federal Government that are carried out by the Corps of Engineers.</text>
 </paragraph></subsection><subsection id="H20A4366A5E6A47EE9AF03628A8654F8D"><enum>(c)</enum><header>Consultation</header><text>The agreement entered into under subsection (a) shall require the National Academy to, in carrying out the study, consult with—</text>
 <paragraph id="H1CBD8E1A2EBD47F6B562CBF43E76A7B0"><enum>(1)</enum><text>the Department of Defense, including the Secretary of the Army and the Assistant Secretary of the Army for Civil Works;</text>
 </paragraph><paragraph id="H443654DD8FF843E993C63D2F2746256B"><enum>(2)</enum><text>the Department of Transportation;</text> </paragraph><paragraph id="HAAEA88F15D3344A98D91EA2309D33EFE"><enum>(3)</enum><text>the Environmental Protection Agency;</text>
 </paragraph><paragraph id="H03A88F1CA00447B49443A0D518726457"><enum>(4)</enum><text>the Department of Homeland Security;</text> </paragraph><paragraph id="H722E685851DE40C29FE65339C5D6CDC6"><enum>(5)</enum><text>the Office of Management and Budget;</text>
 </paragraph><paragraph id="HE47D1198FD664356B7E636D0151F38FD"><enum>(6)</enum><text>other appropriate Federal agencies;</text> </paragraph><paragraph id="H5A2D7E4860504CB283E6E48C3DF1EEFA"><enum>(7)</enum><text>professional and non-governmental organizations; and</text>
 </paragraph><paragraph id="HEC9B9755D9AB441BBDE0BF64EF6D6CAB"><enum>(8)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate.</text>
 </paragraph></subsection><subsection id="H492DE6346B7D478A995E74EDA03C0C1D"><enum>(d)</enum><header>Submission to Congress</header><text>The Secretary shall submit the final report of the National Academy containing the findings of the study carried out under subsection (a) to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate not later than 2 years after the date of enactment of this Act.</text>
 </subsection></section><section commented="no" id="HEC85272A358C440095DB98E393284980"><enum>119.</enum><header>Acknowledgment of credit</header><text display-inline="no-display-inline">Section 7007(a) of the Water Resources Development Act of 2007 (121 Stat. 1277; 128 Stat. 1226) is amended by adding at the end the following: <quote>Notwithstanding section 221(a)(4)(C)(i) of the Flood Control Act of 1970 (42 U.S.C. 1962d–5b(a)(4)(C)(i)), the Secretary may provide credit for work carried out during the period beginning on November 8, 2007, and ending on the date of enactment of the <short-title>Water Resources Development Act of 2018</short-title> by the non-Federal interest for a project under this title if the Secretary determines that the work is integral to the project and was carried out in accordance with the laws specified in section 5014(i)(2)(A) of the Water Resources Reform and Development Act of 2014 (128 Stat. 1331) and all other applicable Federal laws.</quote>.</text>
 </section><section id="H799C6CD28B1640D191A7C5BA40C6BDBE"><enum>120.</enum><header>Non-Federal implementation pilot program</header><text display-inline="no-display-inline">Section 1043(b)(8) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2201">33 U.S.C. 2201</external-xref> note(b)(8)) is amended by striking <quote>2015 through 2019</quote> and inserting <quote>2019 through 2023</quote>.</text>
 </section><section id="H65D3904B7EAB4B92AFF68E981A204ACD"><enum>121.</enum><header>Study of water resources development projects by non-Federal interests</header><text display-inline="no-display-inline">Section 203 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2231">33 U.S.C. 2231</external-xref>) is amended—</text> <paragraph id="H0A99D36049CA45C29FB80FFB644452E3"><enum>(1)</enum><text>in subsection (a)(1), by inserting <quote>federally authorized</quote> before <quote>feasibility study</quote>;</text>
 </paragraph><paragraph id="HC4A816F110DB475198676E7BA73AEC97"><enum>(2)</enum><text>by amending subsection (c) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HBAA229B6CFE7417D9313AF6F6168AA6F" style="OLC"> <subsection id="H3AA18D96278B4B17ADB9879D02D8204F"><enum>(c)</enum><header>Submission to Congress</header> <paragraph id="H0C2B3F23F91E420BA4356BDF766B9641"><enum>(1)</enum><header>Review and submission of studies to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of receipt of a feasibility study of a project under subsection (a)(1), the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that describes—</text>
 <subparagraph id="H2A52FEA77D1A409E87312DA5A052B74C"><enum>(A)</enum><text>the results of the Secretary’s review of the study under subsection (b), including a determination of whether the project is feasible;</text>
 </subparagraph><subparagraph id="H88861F858D584FA58796263A9C8F4905"><enum>(B)</enum><text>any recommendations the Secretary may have concerning the plan or design of the project; and</text> </subparagraph><subparagraph id="H3E99E87C8DCE46D1BB53F66003DBD154"><enum>(C)</enum><text>any conditions the Secretary may require for construction of the project.</text>
 </subparagraph></paragraph><paragraph id="H0A6E6B0FDAEF4D1A8426CA50D2DC05D1"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The completion of the review by the Secretary of a feasibility study that has been submitted under subsection (a)(1) may not be delayed as a result of consideration being given to changes in policy or priority with respect to project consideration.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H3FECE90890104F91A876CD6F120D8793"><enum>(3)</enum><text>by amending subsection (e) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HE0AF4B11F1994C1EB8F7A944B33566A9" style="OLC"> <subsection id="HAD129DB7B40246AA87191963E8E6A8F3"><enum>(e)</enum><header>Review and technical assistance</header> <paragraph commented="no" id="HB517224CF9AF4DDC96D4BCFEF9590F9A"><enum>(1)</enum><header>Review</header><text>The Secretary may accept and expend funds provided by non-Federal interests to undertake reviews, inspections, certifications, and other activities that are the responsibility of the Secretary in carrying out this section.</text>
 </paragraph><paragraph id="H31A3CC63C5CE41AAA191AFCBC2B0DE28"><enum>(2)</enum><header>Technical assistance</header><text>At the request of a non-Federal interest, the Secretary may provide to the non-Federal interest technical assistance relating to any aspect of a feasibility study if the non-Federal interest contracts with the Secretary to pay all costs of providing such technical assistance.</text>
 </paragraph><paragraph id="H22B46228B501428B9942477B9C1D81A7"><enum>(3)</enum><header>Limitation</header><text>Funds provided by non-Federal interests under this subsection shall not be eligible for credit under subsection (d) or reimbursement.</text>
 </paragraph><paragraph id="H0B852CA625224FFBA7A253A124C353D4"><enum>(4)</enum><header>Impartial decisionmaking</header><text>In carrying out this section, the Secretary shall ensure that the use of funds accepted from a non-Federal interest will not affect the impartial decisionmaking of the Secretary, either substantively or procedurally.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section commented="no" id="H46E2DB45B629443F869D504039F4A9BD"><enum>122.</enum><header>Construction of water resources development projects by non-Federal interests</header><text display-inline="no-display-inline">Section 204 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2232">33 U.S.C. 2232</external-xref>) is amended—</text> <paragraph commented="no" id="H5761299F93984C27AF786C6349F633A1"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="H3E9B1B89C6624EDBA9F7C82606175412"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>federally authorized</quote> before <quote>water resources development project</quote>;</text> </subparagraph><subparagraph id="H6B055B50E8374F3F95A6E690C6A133B2"><enum>(B)</enum><text>in paragraph (2)(A), by inserting <quote>, except as provided in paragraph (3)</quote> before the semicolon; and</text>
 </subparagraph><subparagraph id="HD06C147E32014EC488CC58694D945103"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="HD1C557D739FC4E81B5FA16094365473F" style="OLC"> <paragraph id="H0BF2C6CE87E3440B99AAA89C232DFAB4"><enum>(3)</enum><header>Permit exception</header> <subparagraph id="H8715486444944D219C0AEEAF1B1085AE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a project described in subsection (a)(1) or subsection (a)(3), or a separable element thereof, and subject to the execution of a written agreement described in subparagraph (B), a non-Federal interest that carries out a project under this section shall not be required to obtain any Federal permits or approvals that would not be required if the Secretary carried out the project or separable element unless there are significant new circumstances or information relevant to environmental concerns or compliance since development of the project recommendation</text>
 </subparagraph><subparagraph id="H8DD3340104144A31BD75DF80A385EA4D"><enum>(B)</enum><header>Written agreement</header><text display-inline="yes-display-inline">For purposes of this paragraph, a written agreement shall provide that the non-Federal interest shall comply with the same legal and technical requirements that would apply if the project or separable element were carried out by the Secretary, including all mitigation required to offset environmental impacts of the project or separable element as determined by the Secretary</text>
								</subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" id="HF9CB8B7334394A06B5695F0C6B8CB4D1"><enum>(2)</enum><text>in subsection (d)(5)—</text> <subparagraph commented="no" id="HAC2F44F089CD4D1D972A4B34339A833C"><enum>(A)</enum><text>by striking <quote>flood damage reduction</quote> each place it appears and inserting <quote>water resources development</quote>;</text>

					</subparagraph></paragraph></section><section id="HF9B01BB68CF4450D86A74D9378831A1F"><enum>123.</enum><header>Advanced funds for water resources development studies and projects</header>
				<subsection id="H30A6C78479A841B6B9C68934D34C57A2"><enum>(a)</enum><header>Contributions by States and political subdivisions for immediate use on authorized flood-Control
 work; repayment</header><text display-inline="yes-display-inline">The Act of October 14, 1940 (54 Stat. 1176; <external-xref legal-doc="usc" parsable-cite="usc/33/701h-1">33 U.S.C. 701h–1</external-xref>) is amended—</text> <paragraph id="H726622B9294E40978834B4DAB306CC62"><enum>(1)</enum><text>by striking <quote>a flood-control project duly adopted and authorized by law</quote> and inserting <quote>a federally authorized water resources development project,</quote>;</text>
 </paragraph><paragraph id="H22862355CF4349549D8C621070F0B395"><enum>(2)</enum><text>by striking <quote>such work</quote> and inserting <quote>such project</quote>;</text> </paragraph><paragraph id="H6973D029B0064355BD73A60E3AC95F7F"><enum>(3)</enum><text>by striking <quote>flood-control work</quote> and inserting <quote>such project</quote>; and</text>
 </paragraph><paragraph id="H6AD45CBBA67047C38E39720217A2D691"><enum>(4)</enum><text>by adding at the end the following: <quote>For purposes of this Act, the term <term>State</term> means the several States, the District of Columbia, the commonwealths, territories, and possessions of the United States, and Indian tribes (as defined in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>)).</quote>.</text>
 </paragraph></subsection><subsection id="H2DF129F941E8476F992E80D520808687"><enum>(b)</enum><header>No adverse effect on processes</header><text display-inline="yes-display-inline">In implementing any provision of law that authorizes a non-Federal interest to provide, advance, or contribute funds to the Secretary for the development or implementation of a water resources development project (including sections 203 and 204 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2231">33 U.S.C. 2231</external-xref>, 2232), section 5 of the Act of June 22, 1936 (<external-xref legal-doc="usc" parsable-cite="usc/33/701h">33 U.S.C. 701h</external-xref>), and the Act of October 15, 1940 (<external-xref legal-doc="usc" parsable-cite="usc/33/701h-1">33 U.S.C. 701h–1</external-xref>)), the Secretary shall ensure, to the maximum extent practicable, that the use by a non-Federal interest of such authorities does not adversely affect—</text>
 <paragraph id="HD95EF210C459467197F7B6BCB4B023D2"><enum>(1)</enum><text display-inline="yes-display-inline">the process or timeline for development and implementation of other water resources development projects by other non-Federal entities that do not use such authorities; or</text>
 </paragraph><paragraph id="HBFB3FD43D9F14BEEB981176A6B18DEE9"><enum>(2)</enum><text>the process for including such projects in the President’s annual budget submission to Congress under section 1105(a) of title 31, United States Code.</text>
 </paragraph></subsection><subsection id="H2B587FE80F9E41DB81A04E995C543F03"><enum>(c)</enum><header>Advances by private parties; repayment</header><text display-inline="yes-display-inline">Section 11 of the Act of March 3, 1925 (<external-xref legal-doc="usc" parsable-cite="usc/33/561">33 U.S.C. 561</external-xref>) is repealed.</text> </subsection></section><section id="H68157AAB1F7142088ABD47F116005CC1"><enum>124.</enum><header>Funding to process permits</header><text display-inline="no-display-inline">Section 214(a) of the Water Resources Development Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/33/2352">33 U.S.C. 2352(a)</external-xref>) is amended—</text>
 <paragraph id="H5C92FCB16C534800B28E0736113E5853"><enum>(1)</enum><text>in paragraph (3), by striking <quote>10 years</quote> and inserting <quote>12 years</quote>; and</text> </paragraph><paragraph id="H5237B223678044B5AFFE6A58812B01EA"><enum>(2)</enum><text>in paragraph (5)—</text>
 <subparagraph id="H3ABD40FB90FC4C828B86CDEB0146764B"><enum>(A)</enum><text>by striking <quote>4 years after the date of enactment of this paragraph</quote> and inserting <quote>December 31, 2022</quote>; and</text> </subparagraph><subparagraph id="HF83D773134DA41409D6F3C73CCDBAFA1"><enum>(B)</enum><text>by striking <quote>carry out a study</quote> and inserting <quote>carry out a follow-up study</quote>.</text>
					</subparagraph></paragraph></section><section commented="no" id="HC929E701AB544AEE90E890389C8825F5"><enum>125.</enum><header>Study on economic and budgetary analyses</header>
 <subsection commented="no" id="H4713281630D449E291197D3BA434861B"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall enter into an agreement with the National Academy of Sciences to—</text>
 <paragraph commented="no" id="H819C1F99CA8448C29573B866410D288D"><enum>(1)</enum><text>carry out a study on the economic principles and analytical methodologies currently used by or applied to the Corps of Engineers to formulate, evaluate, and budget for water resources development projects; and</text>
 </paragraph><paragraph commented="no" id="HB5E8DBD6A3CF4DFAA5C6E9BBEFCE3ED7"><enum>(2)</enum><text>make recommendations to Congress on potential changes to such principles and methodologies to improve transparency, return on Federal investment, cost savings, and prioritization, in the formulation, evaluation, and budgeting of such projects.</text>
 </paragraph></subsection><subsection commented="no" id="H7AE7365A70B34239A9B7C7D6CCE8C822"><enum>(b)</enum><header>Considerations</header><text>The study under subsection (a) shall include—</text> <paragraph commented="no" id="HC42CF61D071F42A2A452C05FAB032FE3"><enum>(1)</enum><text>an analysis of the current economic principles and analytical methodologies used by or applied to the Corps of Engineers in determining the total benefits and total costs during the formulation of, and plan selection for, a water resources development project;</text>
 </paragraph><paragraph commented="no" id="H823E194F705F44C29509EF2FBA354B8B"><enum>(2)</enum><text display-inline="yes-display-inline">an analysis of improvements or alternatives to how the Corps of Engineers utilizes the National Economic Development, Regional Economic Development, Environmental Quality, and Other Social Effects accounts developed by the Institute for Water Resources of the Corps of Engineers in the formulation of, and plan selection for, such projects;</text>
 </paragraph><paragraph commented="no" id="H56BAF53821664BF990164D6DB5DAC99F"><enum>(3)</enum><text>an analysis of whether such principles and methodologies fully account for all of the potential benefits of project alternatives, including any reasonably associated benefits of such alternatives that are not contrary to law, Federal policy, or sound water resources management;</text>
 </paragraph><paragraph commented="no" id="H438E0C17133A49CE9D05742F8464C0DD"><enum>(4)</enum><text display-inline="yes-display-inline">an analysis of whether such principles and methodologies fully account for all of the costs of project alternatives, including potential societal costs, such as lost ecosystem services, and full life-cycle costs for such alternatives; and</text>
 </paragraph><paragraph commented="no" id="HADA70098516E4B4B8008766487DFABF7"><enum>(5)</enum><text>an analysis of the methodologies utilized by the Federal Government in setting and applying discount rates for benefit-cost analyses used in the formulation, evaluation, and budgeting of Corps of Engineers water resources development projects.</text>
 </paragraph></subsection><subsection commented="no" id="H3F90CAE55A4E4517BB172EEF2D6ED9D7"><enum>(c)</enum><header>Publication</header><text>The agreement entered into under subsection (a) shall require the National Academy of Sciences to, not later than 30 days after the completion of the study—</text>
 <paragraph commented="no" id="HD6ADA45FFE13487C87A1EDA1928AF34F"><enum>(1)</enum><text>submit a report containing the results of the study and the recommendations to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives; and</text>
 </paragraph><paragraph commented="no" id="HC5AF3C474BEB47328DF42C10855BC4E8"><enum>(2)</enum><text>make a copy of such report available on a publicly accessible website.</text> </paragraph></subsection><subsection commented="no" id="H4812AC1535A44F9B80D6EF544635031E"><enum>(d)</enum><header>Sense of Congress on budgetary evaluation metrics and transparency</header><text>It is the sense of Congress that the President, in the formulation of the annual budget request for the U.S. Army Corps of Engineers (Civil Works), should submit to Congress a budget that—</text>
 <paragraph commented="no" id="H61F20156AAED4344BE3CA43A94CB1A10"><enum>(1)</enum><text>aligns the assessment of the potential benefit-cost ratio for budgeting water resources development projects with that used by the Corps of Engineers during project plan formulation and evaluation pursuant to section 80 of the Water Resources Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/1962d-17">42 U.S.C. 1962d–17</external-xref>); and</text>
 </paragraph><paragraph commented="no" id="HB69CC370D15443C8B5EDE76CE2AAFC34"><enum>(2)</enum><text>demonstrates the transparent criteria and metrics utilized by the President in the evaluation and selection of water resources development projects included in the budget request.</text>
					</paragraph></subsection></section></title><title id="H96254B98746B4513B566DD2B2D77D992"><enum>II</enum><header>Studies</header>

 <paragraph id="HBA6567A140774AEBB9FC265B35981AF9"><enum>(1)</enum><header>In general</header><text>The Secretary is authorized to carry out studies to determine the feasibility of a project for ecosystem restoration and flood risk management in Madison, St. Clair, and Monroe counties, Illinois, St. Louis City, and St. Louis, Jefferson, Franklin, Gasconade, Maries, Phelps, Crawford, Dent, Washington, Iron, St. Francois, St. Genevieve, Osage, Reynolds, and Texas counties, Missouri.</text>
 </paragraph><paragraph id="H53836F35B12B4B1CBD44320956B39D49"><enum>(2)</enum><header>Continuation of existing study</header><text>Any study carried out under paragraph (1) shall be considered a continuation of the study being carried out under Committee Resolution 2642 of the Committee on Transportation and Infrastructure of the House of Representatives, adopted June 21, 2000.</text>

 </paragraph><paragraph id="H0A55896F9E4F4A0CA138FB9391103D10"><enum>(3)</enum><text>Everglades Agricultural Area Reservoir, Central Everglades Planning Project, Florida.</text> </paragraph></subsection></section></title><title id="HD45C48477643496FA4532E2D8F47C7DA"><enum>III</enum><header>Deauthorizations, Modifications, and Related Provisions</header> <section commented="no" id="H98098293BA324C4F9157B840CE227C99"><enum>301.</enum><header><italic></italic>Deauthorization of inactive projects</header> <subsection commented="no" id="H0BFDD8057D9844B0B6E01535678D1C65"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this section are—</text>
 <paragraph commented="no" id="H1AE03B4C37C44F47AF203A5B72079726"><enum>(1)</enum><text>to identify $3,000,000,000 in water resources development projects authorized by Congress that are no longer viable for construction due to—</text>
 <subparagraph commented="no" id="H6A96C34F273E45FD8B28FAADCBDB06A0"><enum>(A)</enum><text>a lack of local support;</text> </subparagraph><subparagraph commented="no" id="H97100E7D63504CD38D8BCA33AA7573EA"><enum>(B)</enum><text>a lack of available Federal or non-Federal resources; or</text>
 </subparagraph><subparagraph commented="no" id="HB897EE9EA51A43A1A48AB1868F577C23"><enum>(C)</enum><text>an authorizing purpose that is no longer relevant or feasible;</text> </subparagraph></paragraph><paragraph commented="no" id="HAA217059399D441399A6D253B8A2B329"><enum>(2)</enum><text>to create an expedited and definitive process for Congress to deauthorize water resources development projects that are no longer viable for construction; and</text>
 </paragraph><paragraph commented="no" id="H2E943DE8C1C442EFB35D7ECC1EB82B2C"><enum>(3)</enum><text>to allow the continued authorization of water resources development projects that are viable for construction.</text>
					</paragraph></subsection><subsection commented="no" id="HD4AE31B813CD45E7903D1BA78E34B463"><enum>(b)</enum><header>Interim deauthorization list</header>
 <paragraph commented="no" id="H3A019BCA33B9412D9E56DCC76B5437DD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop an interim deauthorization list that identifies—</text> <subparagraph commented="no" id="HFAF03CDAD17B4151B2B7D9C6A05BB853"><enum>(A)</enum><text>each water resources development project, or separable element of a project, authorized for construction before November 8, 2007, for which—</text>
 <clause commented="no" id="H20CAF47F9691421697EE941D2E6CF2EC"><enum>(i)</enum><text>planning, design, or construction was not initiated before the date of enactment of this Act; or</text> </clause><clause commented="no" id="HA0B02E9140334D5F838CC2935352509A"><enum>(ii)</enum><text>planning, design, or construction was initiated before the date of enactment of this Act, but for which no funds, Federal or non-Federal, were obligated for planning, design, or construction of the project or separable element of the project during the current fiscal year or any of the 6 preceding fiscal years; and</text>
 </clause></subparagraph><subparagraph commented="no" id="H2A854CDFC19542B4A29B8A92A3C90131"><enum>(B)</enum><text>each project or separable element identified and included on a list to Congress for deauthorization pursuant to section 1001(b)(2) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/579a">33 U.S.C. 579a(b)(2)</external-xref>).</text>
						</subparagraph></paragraph><paragraph commented="no" id="HCAF616ACA0B34B25BC8C712BB0DE09B7"><enum>(2)</enum><header>Public comment and consultation</header>
 <subparagraph commented="no" id="HC99C9BDB8E3C443CBB9F7DDB95020251"><enum>(A)</enum><header>In general</header><text>The Secretary shall solicit comments from the public and the Governors of each applicable State on the interim deauthorization list developed under paragraph (1).</text>
 </subparagraph><subparagraph commented="no" id="H068BF99BCDEF4175AA8F93EC8865D8B0"><enum>(B)</enum><header>Comment period</header><text>The public comment period shall be 90 days.</text> </subparagraph></paragraph><paragraph commented="no" id="H6D5C6DBFB3AD4D36B4BBBB374B8139CA"><enum>(3)</enum><header>Submission to Congress; publication</header><text>Not later than 90 days after the date of the close of the comment period under paragraph (2), the Secretary shall—</text>
 <subparagraph commented="no" id="H5B4D2A6198B94567956E48C8E99A43F8"><enum>(A)</enum><text>submit a revised interim deauthorization list to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives; and</text>
 </subparagraph><subparagraph commented="no" id="H088652D1F9924D799D614B30FB43D8BA"><enum>(B)</enum><text>publish the revised interim deauthorization list in the Federal Register.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="H14A1169552604EC0961F0A3673665243"><enum>(c)</enum><header>Final deauthorization list</header> <paragraph commented="no" id="H6146CDB2D95942CFBE1E1811891E9AA1"><enum>(1)</enum><header>In general</header><text>The Secretary shall develop a final deauthorization list of water resources development projects, or separable elements of projects, from the revised interim deauthorization list described in subsection (b)(3).</text>
					</paragraph><paragraph commented="no" id="HF343B13FBE924D5B8478A1711A8EDE61"><enum>(2)</enum><header>Deauthorization amount</header>
 <subparagraph commented="no" id="H7AC46C003E0E43EC9720A3F4A41B0126"><enum>(A)</enum><header>Proposed final list</header><text>The Secretary shall prepare a proposed final deauthorization list of projects and separable elements of projects that have, in the aggregate, an estimated Federal cost to complete that is at least $3,000,000,000.</text>
 </subparagraph><subparagraph commented="no" id="H2C4E3C1D3109473F99CC9C7592C2ABAB"><enum>(B)</enum><header>Determination of Federal cost to complete</header><text>For purposes of subparagraph (A), the Federal cost to complete shall take into account any allowances authorized by section 902 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2280">33 U.S.C. 2280</external-xref>), as applied to the most recent project schedule and cost estimate.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H55B8CBA9E93C4958809CFC2D9958657B"><enum>(3)</enum><header>Identification of projects</header>
						<subparagraph commented="no" id="H83C7942E0A234E81ABCADF447ED821F8"><enum>(A)</enum><header>Sequencing of projects</header>
 <clause commented="no" id="H81B034525A604C8FBF89957AE0823C5D"><enum>(i)</enum><header>In general</header><text>The Secretary shall identify projects and separable elements of projects for inclusion on the proposed final deauthorization list according to the order in which the projects and separable elements of the projects were authorized, beginning with the earliest authorized projects and separable elements of projects and ending with the latest project or separable element of a project necessary to meet the aggregate amount under paragraph (2)(A).</text>
 </clause><clause commented="no" id="H979A1680D35C4664819C08A50535E05A"><enum>(ii)</enum><header>Factors to consider</header><text>The Secretary may identify projects and separable elements of projects in an order other than that established by clause (i) if the Secretary determines, on a case-by-case basis, that a project or separable element of a project is critical for interests of the United States, based on the possible impact of the project or separable element of the project on public health and safety, the national economy, or the environment.</text>
 </clause><clause commented="no" id="H2058F311D2E64DE28C905743675AB2BD"><enum>(iii)</enum><header>Consideration of public comments</header><text>In making determinations under clause (ii), the Secretary shall consider any comments received under subsection (b)(2).</text>
 </clause></subparagraph><subparagraph commented="no" id="HF56FF8889C6246C3BE585EEF8A8BC449"><enum>(B)</enum><header>Appendix</header><text>The Secretary shall include as part of the proposed final deauthorization list an appendix that—</text> <clause commented="no" id="H4829A46163C64A65AC611204E11B0F58"><enum>(i)</enum><text>identifies each project or separable element of a project on the interim deauthorization list developed under subsection (b) that is not included on the proposed final deauthorization list; and</text>
 </clause><clause commented="no" id="HB704B43AF6324AB4B6CBEC0FBB52AAF5"><enum>(ii)</enum><text>describes the reasons why the project or separable element is not included on the proposed final list.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" id="H2F03E13799A84732A00F6DC3764C800C"><enum>(4)</enum><header>Public comment and consultation</header>
 <subparagraph commented="no" id="HCF583911FF2C4CF9A1D1CE2583798D7D"><enum>(A)</enum><header>In general</header><text>The Secretary shall solicit comments from the public and the Governor of each applicable State on the proposed final deauthorization list and appendix developed under paragraphs (2) and (3).</text>
 </subparagraph><subparagraph commented="no" id="H087CECA3A5A94EC9B3AC52949EA8D293"><enum>(B)</enum><header>Comment period</header><text>The public comment period shall be 90 days.</text> </subparagraph></paragraph><paragraph commented="no" id="H6503AA343726468A9D14546A8283158D"><enum>(5)</enum><header>Submission of final list to Congress; publication</header><text>Not later than 120 days after the date of the close of the comment period under paragraph (4), the Secretary shall—</text>
 <subparagraph commented="no" id="H62407F50FA9649428177F7952EA6F091"><enum>(A)</enum><text>submit a final deauthorization list and an appendix to the final deauthorization list in a report to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives; and</text>
 </subparagraph><subparagraph commented="no" id="H8571CD7D24FE44558655E95B2661E428"><enum>(B)</enum><text>publish the final deauthorization list and the appendix to the final deauthorization list in the Federal Register.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="HBA2F88D0069D4FFFA57AB47E1322700D"><enum>(d)</enum><header>Deauthorization; Congressional review</header>
 <paragraph commented="no" id="H5D0A00B3924F4354803313AE0F4E429D"><enum>(1)</enum><header>In general</header><text>After the expiration of the 180-day period beginning on the date of submission of the final deauthorization list and appendix under subsection (c), a project or separable element of a project identified in the final deauthorization list is hereby deauthorized, unless Congress passes a joint resolution disapproving the final deauthorization list prior to the end of such period.</text>
					</paragraph><paragraph commented="no" id="H706F05E22DCD4A90B9F1133B9F2BAC29"><enum>(2)</enum><header>Non-Federal contributions</header>
 <subparagraph commented="no" id="HFFA871BC6223464B8057030D2492B024"><enum>(A)</enum><header>In general</header><text>A project or separable element of a project identified in the final deauthorization list under subsection (c) shall not be deauthorized under this subsection if, before the expiration of the 180-day period referred to in paragraph (1), the non-Federal interest for the project or separable element of the project provides sufficient funds to complete the project or separable element of the project.</text>
 </subparagraph><subparagraph commented="no" id="HE17F4AE30AC24BC88ADD9539A2928D01"><enum>(B)</enum><header>Treatment of projects</header><text>Notwithstanding subparagraph (A), each project and separable element of a project identified in the final deauthorization list shall be treated as deauthorized for purposes of the aggregate deauthorization amount specified in subsection (c)(2)(A).</text>
 </subparagraph></paragraph><paragraph commented="no" id="H2B93C01EFA634F59811F9424B7590649"><enum>(3)</enum><header>Projects identified in appendix</header><text>A project or separable element of a project identified in the appendix to the final deauthorization list shall remain subject to future deauthorization by Congress.</text>
 </paragraph></subsection><subsection commented="no" id="H296CC2CB6F764A979D0CA755A63BC5B6"><enum>(e)</enum><header>Special rule for projects receiving funds for post-Authorization study</header><text display-inline="yes-display-inline">A project or separable element of a project may not be identified on the interim deauthorization list developed under subsection (b), or the final deauthorization list developed under subsection (c), if the project or separable element received funding for a post-authorization study during the current fiscal year or any of the 6 preceding fiscal years.</text>
				</subsection><subsection commented="no" id="HDBB59301C8EB4C79B45FDCFB409D2582"><enum>(f)</enum><header>General provisions</header>
 <paragraph commented="no" id="H7A3AB98A1B3B4E3EB88580CAB819C356"><enum>(1)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> <subparagraph commented="no" id="H572F97625FBA4703B2A98BA405A7A968"><enum>(A)</enum><header>Post-authorization study</header><text>The term <term>post-authorization study</term> means—</text>
 <clause commented="no" id="H5657A747D29A4E22A2E72C805B676A07"><enum>(i)</enum><text>a feasibility report developed under section 905 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2282">33 U.S.C. 2282</external-xref>);</text>
 </clause><clause commented="no" id="H25167DC709884A3DAC140782D82AEB12"><enum>(ii)</enum><text>a feasibility study, as defined in section 105(d) of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2215">33 U.S.C. 2215(d)</external-xref>); or</text>
 </clause><clause commented="no" id="H48716FE9A99D42988196BA125CB88501"><enum>(iii)</enum><text>a review conducted under section 216 of the Flood Control Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/33/549a">33 U.S.C. 549a</external-xref>), including an initial appraisal that—</text>
 <subclause commented="no" id="H9D2EEA950B554E8E8480D406139A0071"><enum>(I)</enum><text>demonstrates a Federal interest; and</text> </subclause><subclause commented="no" id="H939E46902D124F7FBD920C65BA5D875F"><enum>(II)</enum><text>requires additional analysis for the project or separable element.</text>
 </subclause></clause></subparagraph><subparagraph commented="no" id="HC41D79860C62487CA2ED77D4A01ED84E"><enum>(B)</enum><header>Water resources development project</header><text>The term <term>water resources development project</term> includes an environmental infrastructure assistance project or program of the Corps of Engineers.</text> </subparagraph></paragraph><paragraph commented="no" id="H17F79EC344B94FB495C5D621BE60ED45"><enum>(2)</enum><header>Treatment of project modifications</header><text>For purposes of this section, if an authorized water resources development project or separable element of the project has been modified by an Act of Congress, the date of the authorization of the project or separable element shall be deemed to be the date of the most recent modification.</text>
					</paragraph></subsection></section><section id="HE37CDC831C34412FA8DC230E008965C2"><enum>302.</enum><header>Backlog prevention</header>
				<subsection id="HB061BE80E535407495D223D2998658ED"><enum>(a)</enum><header>Project deauthorization</header>
 <paragraph id="H71233F789E154AD1B50FA502C5DEAF6B"><enum>(1)</enum><header>In general</header><text>A water resources development project, or separable element of such a project, authorized for construction by this Act shall not be authorized after the last day of the 10-year period beginning on the date of enactment of this Act unless—</text>
 <subparagraph id="HD2D4E327B29040C1B19522D0AF721128"><enum>(A)</enum><text>funds have been obligated for construction of, or a post-authorization study for, such project or separable element during that period; or</text>
 </subparagraph><subparagraph commented="no" id="HCEAC3EA25E2A41CC8249DF6C23F11F52"><enum>(B)</enum><text>the authorization contained in this Act has been modified by a subsequent Act of Congress.</text> </subparagraph></paragraph><paragraph id="H02EECAE3D217422585FD36CAC49A21A6"><enum>(2)</enum><header>Identification of projects</header><text>Not later than 60 days after the expiration of the 10-year period referred to in paragraph (1), the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that identifies the projects deauthorized under paragraph (1).</text>
 </paragraph></subsection><subsection id="HA4FDE0DA7F6B4E5DB231CFBE36809754"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 60 days after the expiration of the 12-year period beginning on the date of enactment of this Act, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives, and make available to the public, a report that contains—</text>
 <paragraph id="HFEE62FF6E9444AD3AD67A1DED4CA7821"><enum>(1)</enum><text>a list of any water resources development projects authorized by this Act for which construction has not been completed during that period;</text>
 </paragraph><paragraph id="HAD77D9691A044C49B090EC7236DE5B86"><enum>(2)</enum><text>a description of the reasons the projects were not completed;</text> </paragraph><paragraph id="H3553CA311BD94304A1E5E3BC8A0DF3D7"><enum>(3)</enum><text>a schedule for the completion of the projects based on expected levels of appropriations; and</text>
 </paragraph><paragraph id="H3B7E067518E74F71899378DE97957CDB"><enum>(4)</enum><text>a 5-year and 10-year projection of construction backlog and any recommendations to Congress regarding how to mitigate current problems and the backlog.</text>
 </paragraph></subsection><subsection id="HF4C54530116C428C811A8AB649CEA56B"><enum>(c)</enum><header>Clarification</header><text>Section 6003(a) of the Water Resources Reform Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/579c">33 U.S.C. 579c(a)</external-xref>) is amended by striking <quote>7</quote> each place it appears and inserting <quote>10</quote>.</text>
				</subsection></section><section id="HECE331FB02C044938259B7ED96A37AAB"><enum>303.</enum><header>Project modifications</header>
 <subsection commented="no" id="H9BAD79B94C8847DEA988CB3C425C7F91"><enum>(a)</enum><header>Consistency with reports</header><text display-inline="yes-display-inline">Congress finds that the project modifications described in this section are in accordance with the reports submitted to Congress by the Secretary under section 7001 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/2282d">33 U.S.C. 2282d</external-xref>), titled <quote>Report to Congress on Future Water Resources Development</quote>, or have otherwise been reviewed by Congress.</text>
				</subsection><subsection id="H8791A65C45BD4FAE9EC19CF7077EAB64"><enum>(b)</enum><header>Modifications</header>
 <paragraph id="HD3190B3A0A1E48F4AB724576FF5C14D0"><enum>(1)</enum><header>Harbor/South Bay, California</header><text display-inline="yes-display-inline">Section 219(f)(43) of the Water Resources Development Act of 1992 (113 Stat. 337; 114 Stat. 2763A–220) is amended by striking <quote>$35,000,000</quote> and inserting <quote>$70,000,000</quote>.</text>

 <paragraph commented="no" id="H7A8D7FF2503B41189D45888B4D7AE12F"><enum>(1)</enum><header>Conveyance authorized</header><text display-inline="yes-display-inline">The Secretary of the Army may convey to Cheatham County, Tennessee (in this subsection referred to as the <quote>Grantee</quote>), all right, title, and interest of the United States in and to the real property in Cheatham County, Tennessee, consisting of approximately 9.19 acres, identified as portions of tracts E–514–1, E–514–2, E–518–1, E–518–2, E–519–1, E–537–1, and E–538, all being part of the Cheatham Lock and Dam project at CRM 158.5, including any improvements thereon.</text>
 </paragraph><paragraph commented="no" id="HE6E132E143C4453AA03662B59DD685DD"><enum>(2)</enum><header>Deed</header><text>The conveyance of property under this subsection shall be accomplished using a quitclaim deed and upon such terms and conditions as the Secretary determines appropriate to protect the interests of the United States, to include retaining the right to inundate with water any land transferred under this subsection.</text>
 </paragraph><paragraph commented="no" id="H58974703516048BC87119924F8F863EB"><enum>(3)</enum><header>Consideration</header><text>The Grantee shall pay to the Secretary an amount that is not less than the fair market value of the land conveyed under this subsection, as determined by the Secretary.</text>
 </paragraph><paragraph commented="no" id="H46582AA07FAF4F0BB12FB8BB13F1F00F"><enum>(4)</enum><header>Subject to existing easements and other interests</header><text>The conveyance of property under this section shall be subject to all existing easements, rights-of-way, and leases that are in effect as of the date of the conveyance.</text>
					</paragraph></subsection><subsection id="H8C7CA2146CE24952AF80CDC81E2978B8"><enum>(b)</enum><header>Nashville, Tennessee</header>
 <paragraph id="HEF4FBBD49DAC42ECBF3AC75D34C415C0"><enum>(1)</enum><header>Conveyance authorized</header><text>The Secretary of the Army may convey, without consideration, to the City of Nashville, Tennessee (in this subsection referred to as <quote>City</quote>), all right, title, and interest of the United States in and to the real property covered by Lease No. DACW62–1–84–149, including any improvements thereon, at the Riverfront Park Recreational Development, consisting of approximately 5 acres, subject to the right of the Secretary to retain any required easements in the property.</text>
 </paragraph><paragraph id="H61DBA8080EF64DB8B7257D562B4495C0"><enum>(2)</enum><header>Conveyance agreement</header><text>A quit claim deed shall be used to convey real property under this subsection upon the terms and conditions mutually satisfactory to the Secretary and the City. The deed shall provide that in the event the City, its successors, or assigns cease to maintain improvements for recreation included in the conveyance or otherwise utilize the real property conveyed for purposes other than recreation and compatible flood risk management, the City, its successor, or assign shall repay to the United States the Federal share of the cost of constructing the improvements for recreation under the agreement between the United States and the City dated December 8, 1981, increased as necessary to account for inflation.</text>
					</paragraph></subsection><subsection id="HC8B4B14B77AD44358A55718CFF6EFD37"><enum>(c)</enum><header>Generally applicable provisions</header>
 <paragraph id="HE27D5DCB4B5741E6AC27FA21222FF3F1"><enum>(1)</enum><header>Survey to obtain legal description</header><text>The exact acreage and the legal description of any real property to be conveyed under this section shall be determined by a survey that is satisfactory to the Secretary.</text>
 </paragraph><paragraph id="H94E641490B4343FFB087CBA7DF2209E3"><enum>(2)</enum><header>Applicability of property screening provisions</header><text>Section 2696 of title 10, United States Code, shall not apply to any conveyance under this section.</text> </paragraph><paragraph commented="no" id="HEB4D97D541714F39BF62AF49A1BE037F"><enum>(3)</enum><header>Additional terms and conditions</header><text display-inline="yes-display-inline">The Secretary may require that any conveyance under this section be subject to such additional terms and conditions as the Secretary considers necessary and appropriate to protect the interests of the United States.</text>
 </paragraph><paragraph id="HAF37879FE19046E99941A5DCED0E5019"><enum>(4)</enum><header>Costs of conveyance</header><text display-inline="yes-display-inline">An entity to which a conveyance is made under this section shall be responsible for all reasonable and necessary costs, including real estate transaction and environmental documentation costs, associated with the conveyance.</text>
 </paragraph><paragraph id="H831A43C8729E44958E9BC9AA0A8A3879"><enum>(5)</enum><header>Liability</header><text display-inline="yes-display-inline">An entity to which a conveyance is made under this section shall hold the United States harmless from any liability with respect to activities carried out, on or after the date of the conveyance, on real property conveyed. The United States shall remain responsible for any liability with respect to activities carried out, before such date, on the real property conveyed.</text>
 </paragraph></subsection></section><section commented="no" id="HCF8A5E9CD5EB470BBC71A57F2C6DD453" section-type="subsequent-section"><enum>307.</enum><header>Clatsop County, Oregon</header><text display-inline="no-display-inline">The portions of the project for raising and improving existing levees of Clatsop County Diking District No. 13, in Clatsop County, Oregon, authorized by section 5 of the Act of June 22, 1936 (49 Stat. 1590), that are referred to as Christensen No. 1 Dike No. 42 and Christensen No. 2 Levee No. 43 are no longer authorized beginning on the date of enactment of this Act.</text>
 </section><section commented="no" id="H04DFF7515A0B435EBAF3F744E502D2E2"><enum>308.</enum><header>Kissimmee River Restoration, Central and Southern Florida</header><text display-inline="no-display-inline">Subject to a determination by the Secretary that the costs are reasonable and allowable and that the work for which credit is requested was carried out in accordance with the laws specified in section 5014(i)(2)(A) of the Water Resources Reform and Development Act of 2014 (128 Stat. 1331) and all other applicable Federal laws, the Secretary may credit toward the non-Federal share of the cost of the Kissimmee River project, authorized in section 101(8) of the Water Resources Development Act of 1992 (106 Stat. 4802), the value of in-kind contributions made by the non-Federal interest with respect to the six following actions, as described in the final report of the Director of Civil Works on the Central and Southern Florida Project, Kissimmee River Restoration Project, dated April 27, 2018:</text>

 </paragraph></section><section id="H6D23C068602040F6BFBC4D7FCB6CAC25" section-type="subsequent-section"><enum>309.</enum><header>Lytle and Cajon Creeks, California</header><text display-inline="no-display-inline">That portion of the channel improvement project, Lytle and Cajon Creeks, California, authorized to be carried out as a part of the project for the Santa Ana River Basin, California, by the Act of December 22, 1944 (Chapter 665; 58 Stat. 900), that consists of five earth-filled groins commonly referred to as <quote>the Riverside Avenue groins</quote> is no longer authorized as a Federal project beginning on the date of enactment of this Act.</text>
