	<legis-body id="H0DD381EC03534968A21EB633446B077A" style="OLC">
 <section id="H8F3B6ADF5DAF45C7A684730DBAE2FE99" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telephone Robocall Abuse Criminal Enforcement and Deterrence Act</short-title></quote> or the <quote><short-title>TRACED Act</short-title></quote>.</text> </section><section id="H60F115B3470148EBB0A277EBA2AB0003"><enum>2.</enum><header>Forfeiture</header> <subsection id="H48C63B066FAC40EFAD73B5E8685F10C9"><enum>(a)</enum><header>In general</header><text>Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) is amended—</text>
 <paragraph id="H5E8813810A3547A1B85B0F2116610E2B"><enum>(1)</enum><text>in subsection (b), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H1E15B175D26344EB9E2B42F3137921B1" style="OLC"> <paragraph id="HFBD7F50AEE444553942AF260FC543116"><enum>(4)</enum><header>Civil forfeiture</header> <subparagraph id="HD3714D35D87D47FD86F24186C515DA2C"><enum>(A)</enum><header>In general</header><text>Any person that is determined by the Commission, in accordance with section 503(b)(3) or section 503(b)(4), to have violated this subsection with the intent to cause such violation shall be liable to the United States for a forfeiture penalty. A forfeiture penalty under this paragraph shall be in addition to any other penalty provided for by this Act. The amount of the forfeiture penalty determined under this paragraph shall not exceed $10,000 for each violation.</text>
 </subparagraph><subparagraph id="HBB88BE5CBA6647EF8CDDC0BB22B83F34"><enum>(B)</enum><header>Recovery</header><text>Any forfeiture penalty determined under subparagraph (A) shall be recoverable under section 504(a).</text> </subparagraph><subparagraph id="HA38910D0EC3F4CFAA16AAB6C3276744B"><enum>(C)</enum><header>Procedure</header><text>No forfeiture liability shall be determined under subparagraph (A) against any person unless such person receives the notice required by section 503(b)(3) or section 503(b)(4).</text>
 </subparagraph><subparagraph id="HA86348E3E898498F9897C1DF7A930F77"><enum>(D)</enum><header>Statute of limitations</header><text>No forfeiture penalty shall be determined or imposed against any person under subparagraph (A) if the violation charged occurred more than 3 years prior to the date of issuance of the required notice or notice or apparent liability.</text>
 </subparagraph><subparagraph id="H9DB80B3809E9435F9F0CEFF3D56F6E85"><enum>(E)</enum><header>Forfeiture under section 503</header><text>Notwithstanding section 503(b)(1), nothing in this paragraph may be construed to affect the authority of the Commission to impose a forfeiture penalty under section 503(b)(1)(B) against a person who is determined by the Commission, in accordance with that section, to have failed to comply with any provision of this subsection.</text>
 </subparagraph></paragraph><paragraph id="HCCCD3C34F294487289B075EB470A2CA9"><enum>(5)</enum><header>Criminal fine</header><text>Any person who violates this subsection with the intent to cause such violation shall upon conviction thereof be fined not more than $10,000 for each violation, or 3 times that amount for each day of a continuing violation, in lieu of the fine provided by section 501 of this title for such a violation. This subparagraph does not supercede the provisions of section 501 of this title relating to imprisonment or the imposition of a penalty of both fine and imprisonment.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HE3A4573188EA43C89453E27F3F5170EC"><enum>(2)</enum><text>in subsection (h)—</text> <subparagraph id="HD295AD8C62FD4C9B974CD01C78AA8A50"><enum>(A)</enum><text>by striking paragraph (2);</text>
 </subparagraph><subparagraph id="H8870A1DC392547A395C382E84ACD9538"><enum>(B)</enum><text>by redesignating paragraphs (3) through (7) as paragraphs (2) through (6), respectively;</text> </subparagraph><subparagraph id="HB68DC9B7CB2648EEA2163A0E0B7EE764"><enum>(C)</enum><text>in paragraph (3), as redesignated, by striking <quote>paragraph (3)</quote> and inserting <quote>paragraph (2)</quote>; and</text>
 </subparagraph><subparagraph id="HA563D734355E4C3D8E2D79BD19FC407C"><enum>(D)</enum><text>in paragraph (5), as redesignated, by striking <quote>paragraph (5)</quote> and inserting <quote>paragraph (4)</quote>.</text> </subparagraph></paragraph></subsection><subsection id="HF3FB7B0CA8A24191B114A56732C5A33A"><enum>(b)</enum><header>Applicability</header><text>The amendments made by this section shall not affect any action or proceeding commenced before and pending on the date of enactment of this Act.</text>
 </subsection><subsection id="H2ED56C9A17AB49FD88BD86BE4B17F285"><enum>(c)</enum><header>Deadline for regulations</header><text>The Federal Communications Commission shall prescribe regulations to implement the amendments made by this section not later than 270 days after the date of enactment of this Act.</text>
			</subsection></section><section id="H488F0CC258A0438DBFE8D13255D0139A"><enum>3.</enum><header>Call authentication</header>
			<subsection id="H597DB3096B4A479CA3E0C6AA8FCEBA84"><enum>(a)</enum><header>Authentication framework</header>
 <paragraph id="H079C14AB980542859CCC2F0C2251155D"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Federal Communications Commission shall require, not later than 18 months after the date of enactment of this Act, a provider of voice service to implement an appropriate and effective call authentication framework in the internet protocol networks of voice service providers.</text>
 </paragraph><paragraph id="H9B4E6FBFDE8C462F9C0BB1266296E89F"><enum>(2)</enum><header>Implementation</header><text>The Federal Communications Commission—</text> <subparagraph id="H12D48A5D62D541DA983C65E75DAA76E9"><enum>(A)</enum><text>shall not take the action described in subsection (a)(1) if the Federal Communications Commission determines, after public notice and an opportunity for comment, that each provider of voice services, not later than 12 months after the date of enactment of this Act—</text>
 <clause id="H20CC51ED7CBB4155BD021F4386A8B858"><enum>(i)</enum><text>has established voluntary rules for an appropriate and effective call authentication framework in the internet protocol networks of voice service providers;</text>
 </clause><clause id="HEEDA5760FF784750968AA2ECC6D5127D"><enum>(ii)</enum><text>has agreed voluntarily to participate in the authentication framework under clause (i);</text> </clause><clause id="H2A28640BF7184BF8BF41C1F19197E2F4"><enum>(iii)</enum><text>has begun to implement the authentication framework under clause (i); and</text>
 </clause><clause id="H8A5C29F66D3B493ABA0118F8FF700AB1"><enum>(iv)</enum><text>will fully implement the appropriate and effective call authentication framework under clause (i), not later than 18 months after the date of enactment of this Act, subject to subparagraph (B); and</text>
 </clause></subparagraph><subparagraph id="H6B33AB066FFB4542B9EC5E04D04FBC76"><enum>(B)</enum><text>may extend the deadline for implementation of the call authentication framework under paragraph (1) or subparagraph (A) of this paragraph, as applicable, for an additional 12 months, or such further time as the Federal Communications Commission determines to be necessary, for a provider that demonstrates substantial hardship in purchasing or upgrading equipment to support call authentication.</text>
					</subparagraph></paragraph></subsection><subsection id="HCAEF55B1B9B347F6A1485FDBE2DB866E"><enum>(b)</enum><header>Safe harbor and other regulations</header>
 <paragraph id="H4ED4C3B911B24B0BB04CB9C6A3FAB24A"><enum>(1)</enum><header>In general</header><text>The Federal Communications Commission shall promulgate rules—</text> <subparagraph id="H0C146FC6B2284CAD81C6EFFEE1D60A09"><enum>(A)</enum><text>affirming authority for a provider of voice service to block a voice call pursuant to the authentication framework under paragraph (1) or paragraph (2) of subsection (a), as applicable;</text>
 </subparagraph><subparagraph id="H871D680EC90F444394D3230BD7B15DFF"><enum>(B)</enum><text>establishing a safe harbor for a provider of voice service from liability for unintended or inadvertent blocking of calls or for the unintended or inadvertent misidentification of the level of trust for individual calls pursuant to the authentication framework under paragraph (1) or paragraph (2) of subsection (a), as applicable; and</text>
 </subparagraph><subparagraph id="H18FF39BD26A546E68477F340B54AB0C7"><enum>(C)</enum><text>establishing a process to permit a calling party adversely affected by the authentication framework under paragraph (1) or paragraph (2) of subsection (a), as applicable, to verify the authenticity of the calling party's calls.</text>
 </subparagraph></paragraph><paragraph id="HF3492671979F41279999D1C61DD096BC"><enum>(2)</enum><header>Considerations</header><text>In establishing the safe harbor under paragraph (1), the Federal Communications Commission shall consider limiting the liability of providers based on the extent to which they—</text>
 <subparagraph id="H5EBE1A9DEEB9466E8C923EE7A2742086"><enum>(A)</enum><text>block or identify calls based on the authentication framework under paragraph (1) or paragraph (2) of subsection (a), as applicable;</text>
 </subparagraph><subparagraph id="HB00852BA16D0403EA432AA39976A163D"><enum>(B)</enum><text>implemented procedures based on the framework; and</text> </subparagraph><subparagraph id="H60922EBBBD144B298E952B7DB303E3BE"><enum>(C)</enum><text>used reasonable care.</text>
 </subparagraph></paragraph></subsection><subsection id="H7BF5A66D99B54EF78FA88FEB4E3BE47C"><enum>(c)</enum><header>Definition of voice service</header><text>In this section, the term <term>voice service</term>—</text> <paragraph id="HCA2E99F9EE85417DA143B5EBC38431DC"><enum>(1)</enum><text>means any service that is interconnected with the public switched telephone network and that furnishes voice communications to an end user using resources from the North American Numbering Plan or any successor to the North American Numbering Plan adopted by the Commission under section 251(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251(e)(1)</external-xref>); and</text>
 </paragraph><paragraph id="H515E84A0295E44919B70402F68E7837C"><enum>(2)</enum><text>includes—</text> <subparagraph id="HD4D084CDC7334F209DC324E805834527"><enum>(A)</enum><text>transmissions from a telephone facsimile machine, computer, or other device to a telephone facsimile machine; and</text>
 </subparagraph><subparagraph id="HD414627759434052B44B8FEC234E2E0E"><enum>(B)</enum><text>without limitation, any service that enables real-time, two-way voice communications, including any service that requires Internet protocol-compatible customer premises equipment (CPE) and permits out-bound calling, whether or not the service is one-way or two-way voice over Internet protocol.</text>
 </subparagraph></paragraph></subsection><subsection id="HBFA701A7C12047EBB22A5F3A1EF92E2A"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall preclude the Federal Communications Commission from initiating a rulemaking pursuant to its existing statutory authority.</text>
			</subsection></section><section id="H60EB28563CB8400686F8EE4CF80FD03F"><enum>4.</enum><header>Protections from spoofed calls</header>
 <subsection id="HFFC3937FA09B46EBB0F6A7447C339F85"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and consistent with the authentication framework under paragraph (1) or paragraph (2) of section 3(a), as applicable, the Federal Communications Commission shall initiate a rulemaking to help protect a subscriber from receiving unwanted calls or text messages from a caller using an unauthenticated number.</text>
 </subsection><subsection id="HB4C27EB7E62049F994E366E0ABB0DAFF"><enum>(b)</enum><header>Considerations</header><text>In promulgating rules under subsection (a), the Federal Communications Commission shall consider—</text> <paragraph id="H17473D5218C24A1792640D8F3136DCA0"><enum>(1)</enum><text>the Government Accountability Office report on combating the fraudulent provision of misleading or inaccurate caller identification required by section 503(c) of division P of the Consolidated Appropriations Act 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>; 132 Stat. 348);</text>
 </paragraph><paragraph id="HE5B2C8E4E2C9474496E691480FAFF1B3"><enum>(2)</enum><text>the best means of ensuring that a subscriber or provider has the ability to block calls from a caller using an unauthenticated number;</text>
 </paragraph><paragraph id="H6052C8EC5D8549E887B9E07808B73256"><enum>(3)</enum><text>the impact on the privacy of a telephone subscriber from unauthenticated calls;</text> </paragraph><paragraph id="H38D944F692FF40C08A8F905865796B8C"><enum>(4)</enum><text>the effectiveness in verifying the accuracy of caller identification information; and</text>
 </paragraph><paragraph id="H2246ECDA78E8438A8963B4BCB005D325"><enum>(5)</enum><text>the availability and cost of providing protection from the unwanted calls or text messages described in subsection (a).</text>
				</paragraph></subsection></section><section id="H458ED89C3EBE4817B20FF0277138C3B8"><enum>5.</enum><header>Interagency working group</header>
 <subsection id="H5A444B8874B447438F276F9060194771"><enum>(a)</enum><header>In general</header><text>The Attorney General of the United States, in consultation with the Chairman of the Federal Communications Commission, shall convene an interagency working group to study Government prosecution of violations of section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>).</text>
 </subsection><subsection id="HADB662C60ECB48268ADC17C28382AEAE"><enum>(b)</enum><header>Duties</header><text>In carrying out the study under subsection (a), the interagency working group shall—</text> <paragraph id="HABD74E4DD31E4994ADEE8654B0198658"><enum>(1)</enum><text>determine whether, and if so how, any Federal law, including regulations, policies, and practices, or budgetary or jurisdictional constraints inhibit the prosecution of such violations;</text>
 </paragraph><paragraph id="HC29F073CBB7C4A80B28D4DB5F152742A"><enum>(2)</enum><text>identify existing and potential Federal policies and programs that encourage and improve coordination among Federal departments and agencies and States, and between States, in the prevention and prosecution of such violations;</text>
 </paragraph><paragraph id="HDE774DFD05684A678A4D13C7AE3BFA74"><enum>(3)</enum><text>identify existing and potential international policies and programs that encourage and improve coordination between nations in the prevention and prosecution of such violations; and</text>
 </paragraph><paragraph id="HC61E1572DB6C44D2A8BD0BF0340C294B"><enum>(4)</enum><text>consider—</text> <subparagraph id="HC7C32A4B3DDD480985512FB7F0B1CBCC"><enum>(A)</enum><text>the benefit and potential sources of additional resources for the Federal prevention and prosecution of criminal violations of that section;</text>
 </subparagraph><subparagraph id="HAA97666C5B544D158F981D7C9E0FC9F2"><enum>(B)</enum><text>whether to establish memoranda of understanding regarding the prevention and prosecution of such violations between—</text>
 <clause id="HC3585ED93FE641C591F99FC2E0482E15"><enum>(i)</enum><text>the States;</text> </clause><clause id="H5F697C8FB85D4DF9B0D8AE5E318112E0"><enum>(ii)</enum><text>the States and the Federal Government; and</text>
 </clause><clause id="H57C838E14A3E4737948558FB6286E70B"><enum>(iii)</enum><text>the Federal Government and a foreign government;</text> </clause></subparagraph><subparagraph id="HBEE487D0D4A34430A86D129AE6C16CCB"><enum>(C)</enum><text>whether to establish a process to allow States to request Federal subpoenas from the Federal Communications Commission;</text>
 </subparagraph><subparagraph id="H130FF1ADD5AC4DC2ABA712813275C72E"><enum>(D)</enum><text>whether extending civil enforcement to the States would assist in the successful prevention and prosecution of such violations;</text>
 </subparagraph><subparagraph id="H54CA2D43865F448696F747293628E5E2"><enum>(E)</enum><text>whether increased forfeiture and imprisonment penalties are appropriate, such as extending imprisonment for such a violation to a term longer than 2 years;</text>
 </subparagraph><subparagraph id="H7AEF9C710CF44F41AFDCB96C0A2949FE"><enum>(F)</enum><text>whether regulation of any entity that enters into a business arrangement with a carrier for the specific purpose of carrying, routing, or transmitting a call that constitutes such a violation would assist in the successful prevention and prosecution of such violations; and</text>
 </subparagraph><subparagraph id="HBE2FA2978C1C457B865DB2E6B463CD0E"><enum>(G)</enum><text>the extent to which, if any, Department of Justice policies to pursue the prosecution of violations causing economic harm, physical danger, or erosion of an inhabitant's peace of mind and sense of security inhibits the prevention or prosecution of such violations.</text>
 </subparagraph></paragraph></subsection><subsection id="HCB59CFBB95234A7497F963D035B2BE92"><enum>(c)</enum><header>Members</header><text>The interagency working group shall be composed of such representatives of Federal departments and agencies as the Attorney General considers appropriate, such as—</text>
 <paragraph id="H7493F5924C3F4CD3B5BB4964322E7AA1"><enum>(1)</enum><text>the Department of Commerce;</text> </paragraph><paragraph id="HE50AE4480CC447BFB6AEF3389AD0B70E"><enum>(2)</enum><text>the Department of State;</text>
 </paragraph><paragraph id="HAFFEEB3F7A54423B96481087AD253315"><enum>(3)</enum><text>the Department of Homeland Security;</text> </paragraph><paragraph id="H9C05127B5F3E4748B777A182B6912BDD"><enum>(4)</enum><text>the Federal Communications Commission;</text>
 </paragraph><paragraph id="HF27A49DD2CF244B9B141B090D4768F78"><enum>(5)</enum><text>the Federal Trade Commission; and</text> </paragraph><paragraph id="HF083B53083674C9EB879A5A81EA7E057"><enum>(6)</enum><text>the Consumer Financial Protection Bureau.</text>
 </paragraph></subsection><subsection id="HAF071D1114A146688A38CA0F655FE4E4"><enum>(d)</enum><header>Non-Federal stakeholders</header><text>In carrying out the study under subsection (a), the interagency working group shall consult with such non-Federal stakeholders as the Attorney General determines have the relevant expertise, including the National Association of Attorneys General.</text>
 </subsection><subsection id="HBEABD9EE3FB747A6B9126E9F4DF5F4C7"><enum>(e)</enum><header>Report to Congress</header><text>Not later than 9 months after the date of enactment of this Act, the interagency working group shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> a report on the findings of the study under subsection (a), including—</text>
 <paragraph id="H787A2C4C99A84B0D98D04D2FAD6C4C37"><enum>(1)</enum><text>any recommendations regarding the prevention and prosecution of such violations; and</text> </paragraph><paragraph id="H8CB5EC54E78345178B3B2C7A5E988FF9"><enum>(2)</enum><text>a description of what process, if any, relevant Federal departments and agencies have made in implementing the recommendations under paragraph (1).</text>
 </paragraph></subsection></section><section id="HD4A50469A597439F885A9AE2FF94E2EC"><enum>6.</enum><header>Access to number resources</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Federal Communications Commission shall commence a proceeding to determine whether Federal Communications Commission policies regarding access to number resources could be modified, including by establishing registration and compliance obligations, to help reduce access to numbers by potential perpetrators of violations of section 227(b) of the Communications Act of 1935 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>).</text>
