			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to minimize costs and burdens under the Medicare
			 program by providing for consideration of the removal of certain measures
			 applicable to inpatient hospitals and post-acute care inpatient providers
			 and providing for meaningful measures.</official-title></form>

 <section id="HA93D9D915D844F5EB6C0A1BBEEE591F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Remove Extraneous Measures that Obstruct Value and Efficiency Act</short-title></quote> or the <quote><short-title>REMOVE Act</short-title></quote>.</text> </section><section id="HCC4C679FFB3345348364E51CF0B9175F"><enum>2.</enum><header>Removal of certain quality measures applicable to inpatient hospitals and post-acute care providers inpatient providers; providing for meaningful measures</header> <subsection id="HC5C42D90F09B42C7B3D1C858D1C9AAF7"><enum>(a)</enum><header>Removal for inpatient hospitals</header> <paragraph id="H50DF4E7EFC024BA4AD6FA03221A9140A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1886(b)(3)(B)(viii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(b)(3)(B)(viii)</external-xref>) is amended by adding at the end the following new subclause:</text>
					<quoted-block display-inline="no-display-inline" id="H40D6FD3A396846AABAA4FE950F3F5F4F" style="OLC">
 <subclause id="HFBED8FC10D6E40E7AEA8BB4BBABF2710" indent="up2"><enum>(XII)</enum><text display-inline="yes-display-inline">For purposes of this clause, in considering the removal of a quality measure, the Secretary shall base such consideration on factors such as the following:</text>
 <item id="HEFC589EF1C474BAEA5A22FD55811B55D"><enum>(aa)</enum><text display-inline="yes-display-inline">Measure performance is so high and unvarying that meaningful distinctions in improvements in performance can no longer be made.</text>
 </item><item id="H3CCE5CC55228461E965BD3436B180C2B"><enum>(bb)</enum><text display-inline="yes-display-inline">Performance or improvement on such measure does not result in better patient outcomes.</text> </item><item id="H5D211AB157234162A7DDDCD52DD03FA7"><enum>(cc)</enum><text display-inline="yes-display-inline">Such measure does not align with clinical guidelines or practice.</text>
 </item><item id="HF253BBC37C1F4C9D990A1F53C6CAC416"><enum>(dd)</enum><text display-inline="yes-display-inline">Another measure is available that, with respect to a particular topic, is more broadly applicable (across settings, populations, or conditions) than the measure that is being considered for removal for the particular topic.</text>
 </item><item id="HC480E62357F349359F62AC875B190D38"><enum>(ee)</enum><text display-inline="yes-display-inline">Another measure is available that, with respect to a particular topic, is more proximal in time to desired patient outcomes than the measure that is being considered for removal for the particular topic.</text>
 </item><item id="H264C7E5304104182879E168BE5594C1C"><enum>(ff)</enum><text display-inline="yes-display-inline">Another measure is available that, with respect to a particular topic, is more strongly associated with desired patient outcomes than the measure that is being considered for removal for the particular topic.</text>
 </item><item commented="no" id="H3A9CD17D06A64D7597F741E8DE99A3E4"><enum>(gg)</enum><text display-inline="yes-display-inline">Collection or public reporting of the measure leads to negative unintended consequences.</text> </item><item id="H6CFB3ACB000748509DF29C9E711384E3"><enum>(hh)</enum><text display-inline="yes-display-inline">The costs (including costs associated with administrative burden to providers of services and suppliers) associated with the measure outweigh the benefit of the continued use of the measure.</text>
 </item><item id="H679BE28BB2004AAEBC9AF99CCD832E5A"><enum>(ii)</enum><text>Such other factors determined appropriate by the Secretary.</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph><paragraph id="H8009287A21384959848ACD04E58A77C2"><enum>(2)</enum><header>Value-based purchasing program</header><text display-inline="yes-display-inline">Section 1886(o)(2)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(o)(2)(D)</external-xref>) is amended—</text>
 <subparagraph id="H259DA0FC99EA4640AD9DBD9F389AD6A6"><enum>(A)</enum><text>in the heading, by inserting <quote><header-in-text level="subparagraph" style="OLC">and removal of</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">Replacing</header-in-text></quote>;</text> </subparagraph><subparagraph id="H0BDD5387AEAC4FDCAA73C0910E667501"><enum>(B)</enum><text>by striking <quote>Subclause (VI)</quote> and inserting <quote>Subclauses (VI) and (XII)</quote>; and</text>
 </subparagraph><subparagraph id="H89A9B8DBEC5F46BAB3BFAF4BA1D2D020"><enum>(C)</enum><text>by striking <quote>such subclause applies</quote> and inserting <quote>such subclauses apply</quote>.</text> </subparagraph></paragraph></subsection><subsection id="HF3BCB1ECAF8341CBBB86843F5518D118"><enum>(b)</enum><header>Removal for post-Acute care providers</header><text display-inline="yes-display-inline">Section 1899B(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395lll">42 U.S.C. 1395lll(h)</external-xref>) is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HD6FF0C76310243359CAFD9EE4F5C8CD0" style="OLC">
					<paragraph id="H6701F830DEC5478B813B2735FBD1D10C"><enum>(3)</enum><header>Measure removal factors</header>
 <subparagraph id="HA54651FB0F0D486B9DDEA116557012BE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out paragraph (1) and the provisions specified in subparagraph (B), for purposes of evaluating quality measures described in such paragraph or such subparagraph, respectively, the Secretary shall consider removal of such a measure based on factors such as those described in section 1886(b)(3)(B)(viii)(XII).</text>
 </subparagraph><subparagraph id="H679B5F83EBB743D38398169F9FCA6E7E"><enum>(B)</enum><header>Reporting provisions and measures described</header><text>For purposes of subparagraph (A), the provisions and measures described in this subparagraph are the following:</text>
 <clause id="HF527C6AD3FC7430CA7AF48026F74E188"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of inpatient rehabilitation facilities, section 1886(j)(7) and the measures described in such section.</text>
 </clause><clause id="H102973503A6F4731BAB671711FF519D0"><enum>(ii)</enum><text display-inline="yes-display-inline">In the case of long-term care hospitals, section 1886(m)(5) and the measures described in such section.</text>
 </clause><clause id="HE5195880DE0148429BA736044D8DFABC"><enum>(iii)</enum><text display-inline="yes-display-inline">In the case of skilled nursing facilities, section 1888(e)(6) and the measures described in such section.</text>
 </clause><clause id="H4B5A7BD50A474CE9B33F3EB980A13AC4"><enum>(iv)</enum><text display-inline="yes-display-inline">In the case of home health agencies, section 1895(b)(3)(B)(v) and the measures described in such section.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H246C25D6E70B43248CD981FC066BFAB4"><enum>(c)</enum><header>Providing for meaningful measures</header><text display-inline="yes-display-inline">Section 1890A(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395aaa-1">42 U.S.C. 1395aaa–1(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H7399A2DA070544BD8B5FAE52813321D9" style="OLC">
 <paragraph id="HC0247C8539B14773BF2BE99DA3574830"><enum>(7)</enum><header>Meaningful measures</header><text display-inline="yes-display-inline">In selecting and updating quality measures for use under this title, the Secretary shall, as practicable, consider the extent to which such measures satisfy the following factors:</text>
 <subparagraph id="H823794F97072402A85693EC7D221AF39"><enum>(A)</enum><text>The measures are patient-centered and meaningful to patients, clinicians, and providers.</text> </subparagraph><subparagraph id="HCA542129276E449B9DBE72EA0E268503"><enum>(B)</enum><text display-inline="yes-display-inline">The measures address high-impact measure areas that safeguard public health.</text>
 </subparagraph><subparagraph id="HD34B66B9D6144A67ACAD84E1C1BCB956"><enum>(C)</enum><text display-inline="yes-display-inline">The measures are outcome-based where possible.</text> </subparagraph><subparagraph id="H129C09978FD146B5934FE01973DB0383"><enum>(D)</enum><text display-inline="yes-display-inline">The measures minimize the level of burden for providers.</text>
 </subparagraph><subparagraph id="H90583674931B463CA3F9D120E938F725"><enum>(E)</enum><text display-inline="yes-display-inline">The measures create significant opportunity for improvement;</text> </subparagraph><subparagraph id="HFB04632DA1F54EF2B75C0F3C814D3C9D"><enum>(F)</enum><text display-inline="yes-display-inline">The measures align across programs and with other payors.</text>
 </subparagraph><subparagraph id="H145F916A0EE44991AAFEF5FC81EC3FE4"><enum>(G)</enum><text display-inline="yes-display-inline">The measures satisfy any other factor specified by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section></legis-body></bill>
