 <section id="HF84A99EF95274205A0682A7BEA634120" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Warning Reporting System Improvement Act of 2018</short-title></quote>.</text> </section><section id="H7CBB90DD83864666891D45B1FE1E8FB8" section-type="subsequent-section"><enum>2.</enum><header>Additional early warning reporting requirements</header> <subsection id="H036CA3EEB5574D7C90E36E18B4B887AF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 30166(m) of title 49, United States Code, is amended—</text>
 <paragraph id="H2BF40512996A48BFAABA8D7128E99167"><enum>(1)</enum><text>in paragraph (3)—</text> <subparagraph id="H0191B3AF5993409C8DEA59DDF52994D0"><enum>(A)</enum><text>in subparagraph (C)—</text>
 <clause id="H1DADE4D098CF467C9B5ED11ED4496C62"><enum>(i)</enum><text>by striking <quote>The manufacturer</quote> and all that follows through <quote>shall report</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H97AABBC1523144F79D766E50B512099A" style="OLC"> <clause id="HE7AFD35143474E9E8DF095ACDA7F81FA"><enum>(i)</enum><header>In general</header><text>The manufacturer of a motor vehicle or motor vehicle equipment, including the manufacturer of an autonomous vehicle or an autonomous vehicle driving system, shall report</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="HAD58A5026E124737983862D78446F370"><enum>(ii)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H81A6054473894FED8296204DC3F6B24D" style="OLC"> <clause id="H1596E512563B4F359AA29F965CC40C4E"><enum>(ii)</enum><header>Incidents with injuries or fatalities</header><text>If an incident described in clause (i) involves a serious injury or fatality, the Secretary shall require the manufacturer to submit, as part of the incident report under clause (i)—</text>
 <subclause id="H3128AC17C591429F8B0378EDE39A4F97"><enum>(I)</enum><text>each initial claim or notice document that notified the manufacturer of the incident;</text> </subclause><subclause id="H212A1D6749E947F0A96CA6B4D2106CA5"><enum>(II)</enum><text>any police reports or other documents describing or reconstructing the incident;</text>
 </subclause><subclause id="H5B5CD2364CB14B6D92515E818721BAD5"><enum>(III)</enum><text>any amendments or supplements to the documents described in subclause (I), except—</text> <item id="H8871DAF7F3134581857FCE2BF83732D6"><enum>(aa)</enum><text>medical documents and bills; and</text>
 </item><item id="HB6716F2BD96C4AE48F4C3884252AA8EC"><enum>(bb)</enum><text>property damage invoices or estimates; and</text> </item></subclause><subclause id="HD8822731541442AF828A369461659CB8"><enum>(IV)</enum><text>the assessment of the manufacturer of the circumstances that led to the incident, including the analysis of the manufacturer with respect to the claims or notices with respect to allegations of a defect.</text>
 </subclause></clause><clause id="H5A93B37266D5442C9620905F58593A2F"><enum>(iii)</enum><header>Reporting requirements</header><text>Notwithstanding section 579.21 of title 49, Code of Federal Regulations (or a successor regulation), no report under this subsection shall be limited by model year.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="HDA5D3C951B464795911DED69E3323FC3"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H5D7E1E9F91564851AF39DEBD0D958D13" style="OLC"> <subparagraph commented="no" display-inline="no-display-inline" id="HA9A9B6A29EC44554BAEFA41D81C5808A"><enum>(D)</enum><header display-inline="yes-display-inline">Settlements</header><text display-inline="yes-display-inline">Notwithstanding any order entered in a civil action restricting the disclosure of information, a manufacturer of a motor vehicle or motor vehicle equipment shall comply with the requirements of this subsection and any regulation promulgated under this subsection.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H3FF2D37E1160481DB126A85D17166EE0"><enum>(2)</enum><text>in paragraph (4), by striking subparagraph (C) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HC9339084FF9A440880BE1EDA0368B394" style="OLC"> <subparagraph id="H0738B77F75854E889EDF76A0850631F0"><enum>(C)</enum><header>Disclosure</header> <clause id="H65E4BDA3D4D54FC7B96C9F2C82AD028D"><enum>(i)</enum><header>In general</header><text>The information provided to the Secretary pursuant to this subsection—</text>
 <subclause id="H663EDCE9B8234F17A8B4FEE0A5EBD177"><enum>(I)</enum><text>shall be disclosed publicly unless—</text> <item id="H7D3B9E226B634194A12BAA41AF01E4F2"><enum>(aa)</enum><text>exempt from disclosure under section 552(b) of title 5, subject to clause (ii); or</text>
 </item><item id="HAB6C9BAB368745FF8C69E66C2D4ED288"><enum>(bb)</enum><text>the information is subject to an order entered in a civil action restricting the disclosure of information; and</text>
 </item></subclause><subclause id="H0132136FBAF5430B985D7ADC799B62F2"><enum>(II)</enum><text>shall be entered into a public early warning reporting database established by the Secretary in a manner that is searchable by manufacturer name, vehicle or equipment make and model name, model year, and type of potential defect.</text>
 </subclause></clause><clause id="H8608D903EF584D2087B5D7B273ECEA34"><enum>(ii)</enum><header>Inapplicability of confidentiality provisions</header><text>In administering clause (i)(I), the Secretary shall not consider section 552(b)(4) of title 5 to prevent the public disclosure of—</text>
 <subclause id="H025D1F2F516F413F8DD7190E848162F7"><enum>(I)</enum><text>production information regarding passenger motor vehicles;</text> </subclause><subclause id="HFB9442FDDDFD4A14873322C52C09E548"><enum>(II)</enum><text>information on incidents involving death or serious injury;</text>
 </subclause><subclause id="H7F5666F4D0764A88839117A41C5E7A67"><enum>(III)</enum><text>numbers of property damage claims; or</text> </subclause><subclause id="H72C3CC526D0B4DA1A2AAFF330A0E49A2"><enum>(IV)</enum><text>aggregated numbers of consumer complaints.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H9B11A1FF901D4B62AB29544623A7A72C"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H2A828C4743F7447D9BC982E3E1B075DA" style="OLC"> <paragraph id="HDAFCE4D254BB4598B9FD00142CFE6E0C"><enum>(6)</enum><header>Use of early warning reports</header><text>The Secretary shall consider information gathered under this section in proceedings described in sections 30118 and 30162.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H85EB447BEBDA4CFBB2408B9F79EFDB84"><enum>(b)</enum><header>Regulations</header><text>To promote the public availability of information provided to the Secretary under subsection (m) of section 30166 of title 49, United States Code, and the utility of that information to inspection and investigation activities conducted by the Secretary under that section, not later than 2 years after the date of enactment of this Act, the Secretary of Transportation shall promulgate regulations to carry out this section and the amendments made by this section.</text>
 </subsection><subsection id="H0540FCBD04C54C5CBA0DDF5A95B50842"><enum>(c)</enum><header>Nullification of early warning reporting class determination regulations</header><text>On the effective date of the regulations promulgated under subsection (b), the regulations with respect to early warning reporting class determinations contained in appendix C of part 512 of title 49, Code of Federal Regulations (as in effect on that date), shall have no force or effect.</text>
			</subsection></section><section id="HD2F7230B2DA04BD4AAF6429C137697F0"><enum>3.</enum><header>Improved National Highway Traffic Safety Administration vehicle safety databases</header>
 <subsection id="HEEF2DEA725A644329890E7DAB2D29DE9"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and after consultation with frequent users of publicly available databases of the Secretary of Transportation (referred to in this section as the <quote>Secretary</quote>), the Secretary shall improve public accessibility to information on the publicly accessible vehicle safety databases of the National Highway Traffic Safety Administration by revising the publicly accessible vehicle safety databases—</text>
 <paragraph id="HC72CAAE7659048369C000FC169F5A776"><enum>(1)</enum><text>to improve organization and functionality, including design features such as drop-down menus;</text> </paragraph><paragraph id="H425F2FBA5CAA486383E6FDDDFC207420"><enum>(2)</enum><text>to allow for data from all of the publicly accessible vehicle safety databases to be searched, sorted, aggregated, and downloaded in a manner—</text>
 <subparagraph id="H5F5D055B1D2440FF882DC824A19822F8"><enum>(A)</enum><text>consistent with the public interest; and</text> </subparagraph><subparagraph id="HB7E6D6C6F038414781C10F39761DC70C"><enum>(B)</enum><text>that facilitates easy use by consumers;</text>
 </subparagraph></paragraph><paragraph id="HBBC1AF70153743B7A3587444D2717B83"><enum>(3)</enum><text>to provide greater consistency in presentation of vehicle safety issues;</text> </paragraph><paragraph id="H086C9177FFBD461485015A4090008DD7"><enum>(4)</enum><text>to improve searchability about specific vehicles and issues through standardization of commonly used search terms and the integration of databases to enable each of the databases to be simultaneously searched using the same keyword search function; and</text>
 </paragraph><paragraph id="H8710F346321F46429A1DFB3BF2165A60"><enum>(5)</enum><text>to ensure that each document, study, investigation, inspection, incident report, and other materials related to an incident that are created or obtained by the National Highway Traffic Safety Administration are made publicly available in a timely manner that is searchable in databases by—</text>
 <subparagraph id="H008343187C76403ABD5EE8F76A1935A1"><enum>(A)</enum><text>manufacturer name, vehicle or equipment make and model name, and model year;</text> </subparagraph><subparagraph id="HF6910784ACC54DAFBC6079FF4731B0BB"><enum>(B)</enum><text>type of potential defect;</text>
 </subparagraph><subparagraph id="H57D3411160EB4F5BA12CAEFD0929642C"><enum>(C)</enum><text>number of injuries or fatalities; and</text> </subparagraph><subparagraph id="HFB0B0E0EA90247C6BA4B33C7BAD5DE3D"><enum>(D)</enum><text>any other element that the Secretary determines to be in the public interest.</text>
 </subparagraph></paragraph></subsection><subsection id="HED89F286F32643B59E6ACB074EE6E520"><enum>(b)</enum><header>Inspection and investigation information</header><text>The Secretary shall—</text> <paragraph id="H96B920271A2F4340B7693A37E8698AE3"><enum>(1)</enum><text>provide public notice of each inspection or investigation activity conducted by the Secretary under section 30166 of title 49, United States Code; and</text>
 </paragraph><paragraph id="H9C132341364947EBB87D4C87042609F7"><enum>(2)</enum><text>make each notice described in paragraph (1), each written response by a manufacturer to such a notice, and each notice of any enforcement action or other action taken as a result of an inspection or investigation described in that paragraph—</text>
 <subparagraph id="HF73CC88ADFBC4BC1B497A105C4574F42"><enum>(A)</enum><text>available to consumers on the Internet not later than 5 days after the notice is issued; and</text> </subparagraph><subparagraph id="HD4EFD13B12FA4053B10C93CB10C9686C"><enum>(B)</enum><text>searchable by manufacturer name, vehicle or equipment make and model name, model year, system or component, and the type of inspection or investigation being conducted.</text>
					</subparagraph></paragraph></subsection></section></legis-body></bill>
