 <section id="HF3E4683BDA3A4385BAC294F48EFC601B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Transparency of Information and Safeguarding Toxics Act of 2018</short-title></quote> or the <quote><short-title>ETO is Toxic Act</short-title></quote>.</text> </section><section id="H5B326DE586BC4E519C013B757A9E8F2B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H387FD339F6774661878806E33148E1C7"><enum>(1)</enum><header>Air Assessment</header><text>The term <term>Air Assessment</term> means the National Air Toxics Assessment published by the EPA Administrator.</text> </paragraph><paragraph id="H87DE9528C9BD4D5F930B7FA3C2FB2B4A"><enum>(2)</enum><header>ATSDR Administrator</header><text>The term <term>ATSDR Administrator</term> means the Administrator of the Agency for Toxic Substances and Disease Registry of the Department of Health and Human Services.</text>
 </paragraph><paragraph id="H5667706AF1F7434FBCEE87B80E235819"><enum>(3)</enum><header>EPA Administrator</header><text>The term <term>EPA Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </paragraph><paragraph id="H6B92F7BF872D4204A3E1B559DB3EAA95"><enum>(4)</enum><header>Information System</header><text>The term <term>Information System</term> means the Integrated Risk Information System of the EPA Administrator.</text>
			</paragraph></section><section id="HD6503F752B744D6293CAC13E316D15C0"><enum>3.</enum><header>Strengthening and improving Air Assessment</header>
 <subsection id="HD5BBA7C655294C44AF8A3C6145F0328C"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="HD684006D7625471F9D617303CA5431B6"><enum>(1)</enum><text>since 1996, the Air Assessment has helped Federal, State, and local air quality specialists determine which air toxics and emission source types may raise health risks in certain communities;</text>
 </paragraph><paragraph id="HF7605156791542AC9B09C21547E7DF95"><enum>(2)</enum><text>the Air Assessment is released every 3 years, and the data in the National Air Toxics Assessment is used—</text>
 <subparagraph id="H8A0056AFBCFA424CA8E7987DEEEE362A"><enum>(A)</enum><text>to identify locations of interest for further study;</text> </subparagraph><subparagraph id="H907581A2C5DD4723B42431554F5A3A5B"><enum>(B)</enum><text>to prioritize pollutants and emission sources; and</text>
 </subparagraph><subparagraph id="H49832F90EAD04EDCAE862B91D91CBAF8"><enum>(C)</enum><text>to inform monitoring programs; and</text> </subparagraph></paragraph><paragraph id="HA60882954AC24B17B7FC1D07AF6BF674"><enum>(3)</enum><text>the Air Assessment is a key public health tool that helps reduce cancer risks and other serious health effects.</text>
 </paragraph></subsection><subsection id="H80D56361BB584CBBAF4D5C33173B9B5E"><enum>(b)</enum><header>Publication requirements</header><text>The EPA Administrator shall publish—</text> <paragraph id="H6EBB9A33EB2A467A9CB616DD72EF937F"><enum>(1)</enum><text>an updated Air Assessment not less frequently than once every 2 years;</text>
 </paragraph><paragraph id="H19F02500D3DA47C1B486EFFBC23DDDDE"><enum>(2)</enum><text>each updated Air Assessment described in paragraph (1) not later than 180 days after the date on which the data for the Air Assessment have been finalized by the EPA Administrator; and</text>
 </paragraph><paragraph id="HF84024B711CF4B30A1BC1E10431F0994"><enum>(3)</enum><text>a report describing the results of each updated Air Assessment in the Federal Register.</text> </paragraph></subsection><subsection id="H4F11BC4F44A143D4AC0AF2ECB7C09C18"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $20,000,000 to the EPA Administrator to carry out the Air Assessment for fiscal year 2019 and each fiscal year thereafter.</text>
			</subsection></section><section id="HAFA1AED23C56418D8412D9BB97611F91"><enum>4.</enum><header>Ensuring timely review of public health risks through Information System</header>
 <subsection id="HE8D7672C7845415DA57F83CCABE69E36"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="HFA6494960EEC4554B906BAA3FFDF7A5A"><enum>(1)</enum><text>the Information System is a critical tool to help protect public health by identifying and characterizing the health hazards of chemicals found in the environment; and</text>
 </paragraph><paragraph id="H9134D1E49D794F56991D1AE18F88C60F"><enum>(2)</enum><text>assessments conducted under the Information System are—</text> <subparagraph id="HD5D09D33B14745DCB6BD21AABBFB82D7"><enum>(A)</enum><text>an important source of toxicity information used by—</text>
 <clause id="H592AECFA99224CF18387313F26E0CA78"><enum>(i)</enum><text>State and local health agencies;</text> </clause><clause id="HDDCB9CA14D9C4D859FB743D232F9511C"><enum>(ii)</enum><text>other Federal agencies; and</text>
 </clause><clause id="H6A957308517E4273A231475EB4BAC805"><enum>(iii)</enum><text>international health organizations; and</text> </clause></subparagraph><subparagraph id="HC81DECF2ED554225B859D785ACC3CE54"><enum>(B)</enum><text>used—</text>
 <clause id="H4DF2196729354E46A8A5CE6721CF2929"><enum>(i)</enum><text>to inform clean-up decisions at—</text> <subclause id="H5442CE564513412CB0592053507505EF"><enum>(I)</enum><text>sites on the National Priorities List developed by the President in accordance with section 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(a)(8)(B)</external-xref>); and</text>
 </subclause><subclause id="HEEF676594F3B41B1871C44FBE17E49DD"><enum>(II)</enum><text>other contaminated sites;</text> </subclause></clause><clause id="HB61F0457AEEF403CA36446E6931469FD"><enum>(ii)</enum><text>to set standards to ensure clean drinking water;</text>
 </clause><clause id="H6874EFB439C14B94828A6FB8158682BC"><enum>(iii)</enum><text>to assess health risks from toxic air emissions; and</text> </clause><clause id="HB5C681EC3F6F432F93ACE6282BDE69C5"><enum>(iv)</enum><text>to evaluate health risks of chemicals in commerce.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H39A801AD381D41FDA58B57D901CF9059"><enum>(b)</enum><header>Requirements</header>
				<paragraph id="H5FA7C599037C489489811D22D43F9D51"><enum>(1)</enum><header>Assessments</header>
 <subparagraph id="H082E21A45E794F09AC80E865729E8F3D"><enum>(A)</enum><header>Consideration</header><text>If an assessment of a chemical has been conducted under the Information System, the EPA Administrator shall take into consideration the data obtained by that assessment when conducting a rulemaking with respect to that chemical.</text>
 </subparagraph><subparagraph id="H1EA5DAE0EBE6418AB7329FD5740FC618"><enum>(B)</enum><header>Release</header><text>Not later than 180 days after the date on which an assessment of a chemical is completed under the Information System, the EPA Administrator shall publish the assessment in the Federal Register.</text>
					</subparagraph><subparagraph id="HEC00184504044EE6B0DA594EA025F311"><enum>(C)</enum><header>Additional review</header>
						<clause id="H773BA447809D439483F2ED7D6754B03B"><enum>(i)</enum><header>Identification</header>
 <subclause id="H5A6D53C37A3F4CB3AC2E07B0989109C0"><enum>(I)</enum><header>In general</header><text>Not later than 60 days after the date on which an assessment of a chemical is completed under the Information System that determines that the chemical poses an adverse public health risk, the EPA Administrator shall—</text>
 <item id="H0861FF575E8042FDA1CF13FA90A0D225"><enum>(aa)</enum><text>consult with the directors of the regional offices of the Environmental Protection Agency regarding the determination; and</text>
 </item><item id="H46159DDD5BAE4FAB8FE5FFA4B71C1E90"><enum>(bb)</enum><text>identify each facility that is a significant source of the chemical to determine whether the facility poses an adverse public health risk.</text>
 </item></subclause><subclause id="H0F9A4DF920184B8AB80E574176AF7E09"><enum>(II)</enum><header>Publication</header><text>After completing the identification of facilities under subclause (I)(bb), the EPA Administrator shall immediately—</text>
 <item id="HF357D8E07D1A454EA1F3E2707CBFC7AB"><enum>(aa)</enum><text>notify Congress of the identification; and</text> </item><item id="H40B55B7E5EDF458AB1C2BE56B673FC54"><enum>(bb)</enum><text>make publicly available a list describing each facility identified.</text>
 </item></subclause><subclause id="HA39CBEF42D414663B19A35A4CF63E4B3"><enum>(III)</enum><header>Continuous monitoring</header><text>The EPA Administrator shall require the continuous monitoring of each facility identified under subclause (I)(bb) for the chemical determined to have an adverse public health risk as a result of an assessment referred to in subclause (I).</text>
							</subclause></clause><clause id="HA31D4DD1353B41CA897E201616CD2EE1"><enum>(ii)</enum><header>Additional review</header>
 <subclause id="HF63BB207B49D49F8BB849E0BF39040D0"><enum>(I)</enum><header>In general</header><text>The EPA Administrator shall examine each facility identified under clause (i)(I)(bb) to determine whether the facility poses an adverse public health risk.</text>
 </subclause><subclause id="H407D58812479488AA7D1E455D09E9708"><enum>(II)</enum><header>Notification</header><text>Not later than 7 days after the EPA Administrator completes the additional review under subclause (I)—</text>
 <item id="H1BB2306BAFEF40A1B195607B7DA7A567"><enum>(aa)</enum><text>the EPA Administrator shall—</text> <subitem id="H7A0B7077BDA24E73BA8D87E3FBDE4010"><enum>(AA)</enum><text>publish the results of the additional review; and</text>
 </subitem><subitem id="HFB75B745A5754E30B988F5817614C5FF"><enum>(BB)</enum><text>notify Congress of the results described in subitem (AA); and</text> </subitem></item><item id="H39B67B2006AF4D72992409376C080C7E"><enum>(bb)</enum><text>on a determination that the applicable facility poses an adverse public health risk, the director of the applicable regional office of the Environmental Protection Agency shall notify each affected State and local public health official and the public of the adverse public health risk.</text>
 </item></subclause></clause></subparagraph><subparagraph id="HA90A0ABA1D524210A28B3F4DBBA55BB2"><enum>(D)</enum><header>Approval of maximum achievable control technology</header><text>If a maximum achievable control technology (within the meaning of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.)) is available for a facility identified under subparagraph (C)(i)(I)(bb), the EPA Administrator shall expedite the permitting of that maximum achievable control technology at the facility.</text>
 </subparagraph></paragraph><paragraph id="H42D2BDCC8D2C4F90BCB730AE94299026"><enum>(2)</enum><header>Toxics release inventory</header><text>Section 313(c) of the Emergency Planning and Community Right-To-Know Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11023">42 U.S.C. 11023(c)</external-xref>) is amended—</text>
 <subparagraph id="HAC599CB5F80843E48D9CA51E07DD4761"><enum>(A)</enum><text>by striking the period at the end and inserting <quote>; and</quote>;</text> </subparagraph><subparagraph id="H35FE2CCE50164629A1A49CF310D1B02B"><enum>(B)</enum><text>by striking <quote>are those chemicals</quote> and inserting the following:</text>
						<quoted-block act-name="" display-inline="yes-display-inline" id="H6C24EC66F1FB45F8BF8F0787BE0ADC8F" style="OLC">
 <text>are—</text><paragraph id="H2E0B32CB41F6457184ED7F94D7B9B3D5"><enum>(1)</enum><text>those chemicals</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph><subparagraph id="H48CADC1C3C064ED6BCEE6A2B11374B2A"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block act-name="" id="H6CCA681849C845A3A313D383E5624BA8" style="OLC">
 <paragraph id="HE062001472694B7B954748BA012F34AA"><enum>(2)</enum><text>chemicals identified as carcinogenic by an assessment under the Integrated Risk Information System of the Administrator.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="H72BC05634C3E48B0A426AA502F4780C8"><enum>(c)</enum><header>Prohibition</header><text>The EPA Administrator may not transfer the Information System outside of the Office of Research and Development of the Environmental Protection Agency.</text>
 </subsection><subsection id="H74377B8BD25D49B4B3BFE07BFCCF27CE"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $20,000,000 to the EPA Administrator to carry out the duties of the Information System for fiscal year 2019 and each fiscal year thereafter.</text>
			</subsection></section><section id="H3628C746643F4035954021EE5D5E83F5"><enum>5.</enum><header>Improving coordination between Environmental Protection Agency and Agency for Toxic Substances and
 Disease Registry; community outreach division</header><text display-inline="no-display-inline">Section 104(i) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(i)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block act-name="" id="H7B1E2F4EB17F43028D3D995458F2BFBB" style="OLC">
 <paragraph id="H98367EFDC55D4A7BB9B2E30231B3E04A"><enum>(19)</enum><header>Consultations required</header><text>Not less frequently than once every 90 days, the Administrator of ATSDR shall consult with the Assistant Administrators for the Office of Research and Development, the Office of Land and Emergency Management, the Office of Air and Radiation, and the Office of Chemical Safety and Pollution Prevention of the Environmental Protection Agency, and the director of any other office of the Environmental Protection Agency determined to be appropriate by the Administrator of ATSDR, regarding—</text>
 <subparagraph id="H6E0487D21CFC4E9AA3C413B6DD4E16A1"><enum>(A)</enum><text>the future schedule of assessments of chemicals to be conducted under the Integrated Risk Information System of the Administrator of EPA;</text>
 </subparagraph><subparagraph id="HDD30833B6C86482DB97832E1DBC263EE"><enum>(B)</enum><text>the results of existing assessments conducted under the Integrated Risk Information System of the Administrator of EPA; and</text>
 </subparagraph><subparagraph id="H6D50BCB5A98A491D8B74C13BA2D6A15B"><enum>(C)</enum><text>the concerns of the Administrator of ATSDR that merit additional review, if any.</text> </subparagraph></paragraph><paragraph id="H2C9DDB8EA1FB4AB096DA44E29E005576"><enum>(20)</enum><header>Reassessments</header> <subparagraph id="HC1A8CAA3FD774070ACB29785CF6B0608"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text>
 <clause id="H53632600EED345D8ABA32F38E616FC32"><enum>(i)</enum><header>Health assessment</header><text>The term <term>health assessment</term> means a health assessment completed by the Administrator of ATSDR under paragraph (6).</text> </clause><clause commented="no" display-inline="no-display-inline" id="HA9715E6EAAFD49BB865B7FC26E684054"><enum>(ii)</enum><header>Health consultation</header><text>The term <term>health consultation</term> means a written response from the Administrator of ATSDR to a specific request for information about health risks related to a specific site, a specific chemical release, or the presence of hazardous materials in a specific area.</text>
 </clause></subparagraph><subparagraph id="H7B01201DB53F40B8AD160224522439A7"><enum>(B)</enum><header>Determination</header><text>On receiving information from a consultation under paragraph (19) that the Integrated Risk Information System of the Administrator of EPA will be conducting an assessment of a chemical, the Administrator of ATSDR shall determine which health assessments or health consultations, as applicable, need to be reevaluated if the assessment results in a determination that the chemical poses a new adverse public health risk.</text>
					</subparagraph><subparagraph id="HDA17F887C63E47658A5DB2E954E2199C"><enum>(C)</enum><header>Reevaluation</header>
 <clause id="H33372D1B79114FC9941FB63A331AC8AC"><enum>(i)</enum><header>In general</header><text>Not later than 30 days after the date on which an assessment conducted by the Integrated Risk Information System of the Administrator of EPA results in a determination that a chemical has a new adverse public health risk, the Administrator of ATSDR shall reevaluate each health assessment and health consultation, as applicable, identified under subparagraph (B).</text>
 </clause><clause id="H5378FC22577242959789DE3814C6B29E"><enum>(ii)</enum><header>Notification to Congress</header><text>Not later than 14 days after the date on which the Administrator of ATSDR begins a reevaluation under clause (i), the Administrator of ATSDR shall notify Congress that the reevaluation is being conducted.</text>
 </clause><clause id="HBCB3278F1902460895520F9FF22B88F3"><enum>(iii)</enum><header>Publication</header><text>Not later than 30 days after the date of completion of a reevaluation under clause (i), the Administrator of ATSDR shall—</text>
 <subclause id="H1FB07C4C6833477B90D200FC14553A42"><enum>(I)</enum><text>publish in the Federal Register any revisions to a health assessment or a health consultation, as applicable, as a result of the reevaluation; and</text>
 </subclause><subclause id="H1C1A2F9A83964A4AB463D524EA9DC1B3"><enum>(II)</enum><text>notify Congress of the revisions described in subclause (I).</text> </subclause></clause></subparagraph></paragraph><paragraph id="HA005898C377C416B920D35234915C317"><enum>(21)</enum><header>Personal exposure testing</header><text>The Administrator of ATSDR, in coordination with the Administrator, shall administer personal exposure tests for a chemical that has a new adverse public health risk as described in paragraph (20)(B)(i), as available, to vulnerable populations, including children and the elderly.</text>
				</paragraph><paragraph id="HC9C31648F1E14075B0955B75C66F746F"><enum>(22)</enum><header>Community Outreach Division</header>
 <subparagraph id="HB4F201FB9D2C47ABA67BA8CF87B90CB4"><enum>(A)</enum><header>Establishment</header><text>The Administrator of ATSDR shall establish within the Office of Communication of ATSDR a division, to be known as the <quote>Community Outreach Division</quote>.</text>
 </subparagraph><subparagraph id="HDB3C703C1DFA433596C15FD796434267"><enum>(B)</enum><header>Purpose</header><text>The purpose of the of the Community Outreach Division shall be—</text> <clause id="H7B4A6F585597435FAEE55870367D0174"><enum>(i)</enum><text>to include communities when determining the priority of chemicals to undergo review by ATSDR; and</text>
 </clause><clause id="HB8955E4B2B444BB3BD568226F2C8A2B6"><enum>(ii)</enum><text>to communicate risk assessments to affected communities.</text> </clause></subparagraph></paragraph><paragraph id="H3BF0023AE24E4DFC9FA85DEBC11CFB1D"><enum>(23)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $70,000,000 to carry out the duties of the ATSDR for fiscal year 2019 and each fiscal year thereafter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H75C92E69AF234510B1EFC251DD06EB05"><enum>6.</enum><header>Data sampling</header><text display-inline="no-display-inline">If the ATSDR Administrator requests the EPA Administrator to conduct a sample for a chemical that poses an adverse public health risk and the EPA Administrator rejects that request, the EPA Administrator shall submit to Congress a notice describing—</text>
 <paragraph id="HFF3DC19017C1498DA317943F2A8D2D1F"><enum>(1)</enum><text>the request; and</text> </paragraph><paragraph id="HC0BFAA5895E846E1AEDC02AE918B55CB"><enum>(2)</enum><text>the reasons for rejecting the request.</text>
