			 answer a decennial census question shall apply only to the extent
			 necessary to allow the Government to obtain the information needed for its
			 enumeration of the population, as required by the Constitution of the
			 United States, as well as the enumeration of its citizen and noncitizen
			 populations, and for other purposes.</official-title></form>

 <section id="H109AA9FCA1374C18ABFF4E4ABDDBD1B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Authorizing Moderated Enumeration Responses Including Citizenship Acquisition Act</short-title></quote> or the <quote><short-title>AMERICA Act</short-title></quote>.</text> </section><section id="HCBC7749B58DC4790B36DA6E43CC87F06"><enum>2.</enum><header>Limited applicability of census penalty provision</header> <subsection id="H446CC285159F4512BF69B0B867336BB8"><enum>(a)</enum><header>In general</header><text>Section 221 of title 13, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H980239555BFD4E3A9707AA8EED4A694C" style="USC">
					<subsection id="H2E679162E8E449F6AFE7363919B0CE8B"><enum>(d)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="H7EAAA00CE3F14795AC8520B3A820E252"><enum>(1)</enum><text>The penalty under subsection (a) shall not apply to any individual who refuses or neglects to answer any question in a questionnaire, schedule, or the survey commonly referred to as the <quote>American Community Survey</quote> used in connection with any decennial census, except to the extent necessary to allow the Government to obtain the information needed for the enumeration of—</text>
 <subparagraph id="H43664E3AE8E249A38E62ECC93EB80EAF" indent="up1"><enum>(A)</enum><text>the population, as required by the Constitution of the United States; and</text> </subparagraph><subparagraph id="HBAB0D00D40754F2FA156C84F2D8FA9E7" indent="up1"><enum>(B)</enum><text>citizen and noncitizen populations.</text>
 </subparagraph></paragraph><paragraph id="H9A1D6A08197E4020B4DF74354E66FD72" indent="up1"><enum>(2)</enum><text>For purposes of this subsection, only questions included on a decennial census short form regarding enumeration of the household and citizenship status shall be considered necessary to permit such an enumeration.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HD0D9998FC2724E198EC5BFA55D64F404"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to all schedules used in connection with any decennial census of population, beginning with the 2020 decennial census, including those returned before the date of enactment of this Act.</text>
