			 and assist in the reentry of ex-offenders into the workforce.</official-title></form>
	<legis-body id="HB64E97001D344FBB9D38767FAEBCD4F5" style="OLC">
 <section id="H28591CD8909B448EBFD9E02FC57DF75A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workforce Reentry Act</short-title></quote>.</text> </section><section id="H14B4148907304D74BF8BA6B44B5CD4E3"><enum>2.</enum><header>Ex-Offender Reentry Program Start-up Grants</header><text display-inline="no-display-inline">Subtitle D of title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221</external-xref> et seq.) is amended—</text>
 <paragraph id="HCBC65901E0A14C96952E48A21FF6A21A"><enum>(1)</enum><text>by redesignating section 172 as section 173; and</text> </paragraph><paragraph id="H0D051C6D09D448B1AB14D3483E8B1EE8"><enum>(2)</enum><text>by inserting after section 171 the following new section:</text>

					<section id="HDE4098715CC24FED8E2B1040852D1AFE"><enum>172.</enum><header>Ex-Offender Reentry Program Start-up Grants</header>
 <subsection id="H6D47954D606442EBB4FD798AADD8CED5"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to—</text> <paragraph id="H59A6D74591C84655914C9A532B717253"><enum>(1)</enum><text>prompt innovation and improvement in the reentry of ex-offenders into the workforce so that successful initiatives can be continued and replicated; and</text>
 </paragraph><paragraph id="H3529770DBF144721AB7C656608AFB071"><enum>(2)</enum><text>allow for the dissemination of information regarding best practices in preparing ex-offenders for sustained participation in the workforce.</text>
 </paragraph></subsection><subsection id="H64275032164A46929131A17409305152"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H6812D5ED070C48ACA47C73ECD4FDA60C"><enum>(1)</enum><header>Apprenticeship opportunities</header><text>The term <term>apprenticeship opportunities</term> includes registered apprenticeship, industry-recognized apprenticeship, and preapprenticeship programs.</text>
 </paragraph><paragraph id="H80C6DD28A6D34BB081CBD66FFFB2D2BA"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="H6B3937510DF84997A49997F1A12D0830"><enum>(A)</enum><text>a private non-profit organization under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986;</text>
 </subparagraph><subparagraph id="H4628A605507442759324937D881F64B8"><enum>(B)</enum><text>a local workforce development board;</text> </subparagraph><subparagraph id="H94378780249147E4B09B9471ADF77666"><enum>(C)</enum><text display-inline="yes-display-inline">a State or local government; or</text>
 </subparagraph><subparagraph id="H9555C26B80674C6A89603576DE2C0573"><enum>(D)</enum><text>an Indian or Native American entity eligible for grants under section 166.</text> </subparagraph></paragraph><paragraph id="HB1EB913BB7AF473A9714756CAFD5FC04"><enum>(3)</enum><header>Eligible participant</header> <subparagraph id="HF048FCAE96184105B27A9DBAD0255B2F"><enum>(A)</enum><header>In general</header><text>The term <term>eligible participant</term> means an individual—</text>
 <clause id="HB970D0BAE5E04582ADDEC625E49F172C"><enum>(i)</enum><text>who is not less than age 18;</text> </clause><clause id="HBED7C26172D54A7C9FE705EDE3E11B0A"><enum>(ii)</enum><text>who has been convicted as an adult and imprisoned under Federal or State law;</text>
 </clause><clause id="H19A5AB5FB7C34A49A81E2266FE0C3D4A"><enum>(iii)</enum><text>whose most recent offense has not been a violent or sex-based offense; or</text> </clause><clause id="H248FD1E9433F4D2AB143E24CDAAE4F63"><enum>(iv)</enum><text>who has not been released from prison or jail for more than 180 days before the date on which the individual begins participation.</text>
 </clause></subparagraph><subparagraph id="H753B3EB43F9C462987BF4433D98D323B"><enum>(B)</enum><header>Exception</header><text>Up to 10 percent of all participants may be individuals who do not meet the requirements of clause (iv) of subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="H16D6CFA14B364446ADEEF585876C7014"><enum>(4)</enum><header>Evidence-based</header><text>The term <term>evidence-based</term> means a program or practice that—</text> <subparagraph id="HF9A45CE5A7F44BB3A9E246750039CCBB"><enum>(A)</enum><text display-inline="yes-display-inline">is demonstrated effective when implemented with fidelity;</text>
 </subparagraph><subparagraph id="HD20256D4F1EF41FD88BD1D7CFB4FC8F3"><enum>(B)</enum><text>is based on a clearly articulated and empirically supported theory;</text> </subparagraph><subparagraph id="H2BE6EF4087344C31A4144DC945999B8F"><enum>(C)</enum><text>has measurable outcomes relevant to workforce outcomes for reentering offenders; and</text>
 </subparagraph><subparagraph id="H91BC76E8A16F4BCE98969315F46AF109"><enum>(D)</enum><text>has been scientifically tested and proven effective through randomized control studies or comparison group studies.</text>
 </subparagraph></paragraph><paragraph id="H62B9EDDFA54746B081884C4F684A7E9D"><enum>(5)</enum><header>Promising</header><text display-inline="yes-display-inline">The term <term>promising</term> refers to a program or practice that—</text> <subparagraph id="H320477351F8242C58FF53D6273395111"><enum>(A)</enum><text>is demonstrated to be effective based on positive outcomes relevant to workforce engagement for reentering offenders from 1 or more objective, independent, and scientifically valid evaluation; and</text>
 </subparagraph><subparagraph id="H1FE5504DE2BB4530B03F7AC5E8510582"><enum>(B)</enum><text>includes ongoing efforts to examine the effects of such program or practice.</text> </subparagraph></paragraph></subsection><subsection id="H962821E476354DCC923FF88B0D686446"><enum>(c)</enum><header>Program authorized</header> <paragraph id="H6950246162E545DF999C2B2E4A7176A6"><enum>(1)</enum><header>In general</header><text>In carrying out the activities under this section, the Secretary shall, on a competitive basis, award grants for a period of not more than 5 years to eligible entities to enable such entities to provide job training, job placement services, and mentoring.</text>
 </paragraph><paragraph id="H75DB461281134A269D0F456E77274342"><enum>(2)</enum><header>Priority</header><text>In awarding grants, the Secretary shall give priority to eligible entities that—</text> <subparagraph id="HC76F14C58276439D955D5836E2B14D03"><enum>(A)</enum><text>establish partnerships with business or educational institutions to provide a program of study leading to postsecondary credentials in in-demand occupations; or</text>
 </subparagraph><subparagraph id="HC55D262BE2894926BC3CCBB4821D6729"><enum>(B)</enum><text display-inline="yes-display-inline">provide customized training that is designed to meet the specific requirements of an employer (including a group of employers) and is conducted with a commitment by the employer to employ an individual upon successful completion of the training.</text>
 </subparagraph></paragraph><paragraph id="H60AF80F07A0446F79879B02F7893C119"><enum>(3)</enum><header>Renewal</header><text display-inline="yes-display-inline">The Secretary may renew a grant to an eligible entity under this section for a period no longer than 5 additional years if the eligible entity—</text>
 <subparagraph id="HF93A2E46836E444882634A5FDDB70214"><enum>(A)</enum><text>demonstrates success in helping eligible participants reenter the workforce according to the performance indicators under (g)(1); and</text>
 </subparagraph><subparagraph id="H18BADBD7C0F0483AB0725BBBCA61843F"><enum>(B)</enum><text>provides an assurance that the entity will provide a non-Federal contribution, including cash and in-kind donations, in an amount not less than 100 percent of the total funds awarded in the renewal grant.</text>
 </subparagraph></paragraph></subsection><subsection id="H73CE066DC67F415F9386DE55BC77FB79"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, an eligible entity shall submit an application to the Secretary, which shall include the following:</text>
 <paragraph id="H0C140340252945C1B54EDD1436D0BC24"><enum>(1)</enum><text>A detailed description of the program including the core services they will provide, how the eligible entity will recruit and select eligible participants for the program, how many participants they plan on serving each year, and the length of participation in the program.</text>
 </paragraph><paragraph id="H10E40227D6264C608378A9C77CEBB30B"><enum>(2)</enum><text>A description of evidence-based or promising practices the eligible entity will use in the administration of the program.</text>
 </paragraph><paragraph id="HE973E1F254964E8FA5C132971BD8F3C5"><enum>(3)</enum><text>A description of partnerships with local businesses to provide apprenticeship opportunities, work-based learning, and job placement and recruitment (if applicable).</text>
 </paragraph><paragraph id="H2A56E2E2063944A98E759C3E62D7B6F7"><enum>(4)</enum><text>An assurance that the eligible entity will coordinate activities with workforce development programs and other services provided under this title, including utilizing the one-stop delivery system of the local workforce development areas to provide appropriate services and recruit eligible individuals to ensure the maximum number of eligible individuals will have the opportunity to participate in the program.</text>
 </paragraph><paragraph id="H5998BF829ED140CB8F52D928686C8265"><enum>(5)</enum><text display-inline="yes-display-inline">An assurance that the eligible entity will provide a 50-percent match, as described in subsection (e).</text>
 </paragraph><paragraph id="HD04152A6407C441E9AC6E477F6A34F3E"><enum>(6)</enum><text display-inline="yes-display-inline">A plan to coordinate with other programs and entities, including those that may be provided by such other programs and entities, to provide substance abuse treatment services, mental health treatment services, housing services, and transportation services.</text>
 </paragraph><paragraph id="HC0E0AF08C0DE43D4BFF7E8EC79036DEB"><enum>(7)</enum><text display-inline="yes-display-inline">An assurance that the eligible entity will provide the data necessary for the indicators of performance in subsection (g).</text>
 </paragraph><paragraph id="H33B8065121904900AAA98E79E1339FFC"><enum>(8)</enum><text>A plan to continue the program with non-Federal funds after grant period.</text> </paragraph></subsection><subsection id="H20C80016F86E4230AB8F8FA543CDDB03"><enum>(e)</enum><header>Matching requirement</header><text display-inline="yes-display-inline">In order to receive a grant from the Secretary under this section, each eligible entity shall provide a non-Federal contribution, including cash and in-kind donations, in an amount not less than 50 percent of the total funds awarded.</text>
						</subsection><subsection id="H1DA3FF973F8743C9854D442C4F686BC9"><enum>(f)</enum><header>Use of funds</header>
 <paragraph id="H5B8100ACF9D449F1B3A8FEA3BC13018F"><enum>(1)</enum><header>In general</header><text>A grant awarded under this section may be used to—</text> <subparagraph id="H7281CD49B115483D88DB23B38071B0B7"><enum>(A)</enum><text>provide workforce development and job placement services to eligible participants, including occupational skills education, on-the-job training, apprenticeship opportunities, work experience, job referrals, basic skills remediation, educational services, work readiness activities, and post-placement support, in coordination with the one-stop partners and one-stop operators that provide services at any center operated under a one-stop deliver system established under section 121;</text>
 </subparagraph><subparagraph id="H36738AE7300A4C0AB68879DBDC7E2E1C"><enum>(B)</enum><text>mentor eligible participants, including the provision of support, guidance, and assistance in the community and the workplace to address the challenges faced by ex-offenders;</text>
 </subparagraph><subparagraph id="H9A649A94DA9041CB9304ABD5BC091A82"><enum>(C)</enum><text>provide outreach to State or Federal correctional facilities to increase awareness, identify and recruit eligible participants, provide screening and assessment of eligible participants and align educational offerings with existing services available to individuals who are presently incarcerated; or</text>
 </subparagraph><subparagraph id="H2070F0ED3C9F4EFA86A284C72C03BBD2"><enum>(D)</enum><text display-inline="yes-display-inline">coordinate with employers to develop customized training programs and agreements around the hiring of eligible participants.</text>
								</subparagraph></paragraph><paragraph id="H543666C4FD80418BACB8FC24B026933B"><enum>(2)</enum><header>Limitations</header>
 <subparagraph id="HD7EC4205189F4D08A1C80421409AC1B6"><enum>(A)</enum><header>Certain services excluded</header><text>Funds provided under this section may not be used to provide substance abuse treatment services, mental health treatment services, or housing services, except that such a grant may be used to coordinate with other programs and entities to provide substance abuse treatment services, mental health treatment services, or housing services to eligible participants.</text>
 </subparagraph><subparagraph id="H3BA8224CEC9D49FB88D907FBEB8178D5"><enum>(B)</enum><header>Administrative cost limit</header><text>A grantee may not use more than 10 percent of the funds received under a grant for administrative costs.</text>
 </subparagraph><subparagraph id="H4228AF2A020948AE979192DCB62D9179"><enum>(C)</enum><header>Limit on amount paid as stipends to participants</header><text>A grantee may not use more than 15 percent of the funds received under such grant to provide stipends to program participants while completing an educational or skill development program.</text>
								</subparagraph></paragraph></subsection><subsection id="H6B609C8DED724E999F91961119DAA47A"><enum>(g)</enum><header>Performance outcomes and accountability</header>
 <paragraph id="H78B179D5846A409684B89CE9E05F7FC9"><enum>(1)</enum><header>Indicators of performance</header><text>Each eligible entity receiving a grant under this section shall report each year to the Secretary of Labor on the following indicators of performance:</text>
 <subparagraph id="H8FEF2A163BB64AC3AB02EBDF08ACE282"><enum>(A)</enum><text display-inline="yes-display-inline">The percentage of program participants who are in unsubsidized employment during the second quarter after exit from the program.</text>
 </subparagraph><subparagraph id="H8E04827F058346BE8BBEF7EF7E49CF10"><enum>(B)</enum><text>The percentage of program participants who are in unsubsidized employment during the fourth quarter after exit from the program.</text>
 </subparagraph><subparagraph id="HA86F6AB737084222A2EE503A04280946"><enum>(C)</enum><text>The median earnings of program participants who are in unsubsidized employment during the second quarter after exit from the program.</text>
 </subparagraph><subparagraph id="HD451D08BADF1402CAF6130B66936DB64"><enum>(D)</enum><text>The percentage of program participants who obtain a recognized postsecondary credential, or a secondary school diploma or its recognized equivalent, during participation in or within one year after exit from the program.</text>
 </subparagraph></paragraph><paragraph id="H127450F62A2E48B1B2CB36854BAF06D9"><enum>(2)</enum><header>Independent evaluation</header><text>Not later than five years after the date of enactment of this section and from amounts made available under section 173(d), the Secretary shall provide for and report to Congress on an independent evaluation of the grant program established under this section that includes an assessment of the effectiveness of the grant program and the effectiveness of individual grantees included in the evaluation in reducing recidivism and assisting individuals in—</text>
 <subparagraph id="H9A885651A44F4C589239901722B37EEE"><enum>(A)</enum><text>earning credentials;</text> </subparagraph><subparagraph id="H4F2A20016DDC4E50BE7974FB71A2174F"><enum>(B)</enum><text>finding and maintaining employment; and</text>
 </subparagraph><subparagraph id="H4B0E365ED7754E92930FBBF808698BC6"><enum>(C)</enum><text>increasing their earnings.</text> </subparagraph></paragraph><paragraph id="HB6DF584B9249465C8924C943BA4D581D"><enum>(3)</enum><header>Report</header><text>The Secretary shall release an annual report on—</text>
 <subparagraph id="H9AD125313B4C4E458A144F607CA036C5"><enum>(A)</enum><text>the number of individuals who participated in programs assisted under this section;</text> </subparagraph><subparagraph id="HAB82CC3D5821447D8BD987E57A4CCD13"><enum>(B)</enum><text>the percentage of individuals participating in a program assisted under this section that successfully completed the program; and</text>
 </subparagraph><subparagraph id="H387C3751ECBD45A0B28E075F52A5CE5D"><enum>(C)</enum><text>the performance of grantees as measured by the performance indicators set forth in paragraph (1).</text> </subparagraph></paragraph><paragraph id="H9C336E32D83B468B9048E635EDD85362"><enum>(4)</enum><header>Disseminating best practices</header><text>Using the findings of the independent evaluation under paragraph (2) the Secretary shall disseminate information to State and local government, local workforce development boards, and relevant stakeholders regarding best practices in providing workforce development opportunities for ex-offenders and reducing recidivism.</text>
 </paragraph></subsection><subsection id="HCDCED26D34AB4ECEBAD8E936D470621F"><enum>(h)</enum><header>Administrative activities</header><text display-inline="yes-display-inline">The Secretary may use up to 2 percent of the funds annually appropriated to carry out the activities of this section including disseminating best practices and providing technical assistance to grantees and partnering businesses regarding the availability of applicable tax credits including the Work Opportunity Tax Credit.</text>
 </subsection><subsection id="HC486D0D5CB57454DBB61E81C384F05FD"><enum>(i)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to authorize any new appropriations to carry out the purpose of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H9E9567472F1841A79E2A0F8D45FC09AE"><enum>3.</enum><header>Authorized funds</header><text display-inline="no-display-inline">Section 173(d) of the Workforce Innovation and Opportunity Act (as redesignated by section 2(1)) is amended by striking <quote>section 169</quote> and inserting <quote>sections 169 and 172</quote>.</text>
