			 of unaccompanied alien children from being used for any purpose other than
			 providing safe and secure placements, and for other purposes.</official-title></form>
	<legis-body id="H236AABCA84FD4BB0BA0AC7D8B3DF8462" style="OLC">
 <section id="HE9F44547E9594D089896A9B511E71612" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Cruel Handling of Information Leading to Deportation Harm Act of 2018</short-title></quote> or the <quote><short-title>Prevent CHILD Harm Act of 2018</short-title></quote>.</text> </section><section id="H0D965375DAE9493ABAF838F1F3FB7EEE"><enum>2.</enum><header>Use of sponsorship information</header> <subsection id="HFB5A3D0D44FF45009A9C56DA2B26B34D"><enum>(a)</enum><header>In general</header><text>Section 235(c)(3) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(c)(3)</external-xref>) is amended—</text>
 <paragraph display-inline="no-display-inline" id="HEAFF7303118441FCBB4CDF3194390533"><enum>(1)</enum><text>in subparagraph (A), by inserting after <quote>mental well-being.</quote> the following: <quote>In making such a determination, the Secretary may not consider the immigration status of the proposed custodian.</quote>; and</text>
 </paragraph><paragraph id="H2A42EA761AE646D69FDEF723349997FD"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HDD47DDAAE5A943D2B9260E44255443C2" style="OLC"> <subparagraph id="HAA27D2D769D745898B4C7CADB8F107E2"><enum>(D)</enum><header>Prohibiting use of certain information</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may not use information provided by an unaccompanied alien child or information initially obtained by the Secretary of Health and Human Services to make a suitability determination under subparagraph (A), a home study determination under subparagraph (B), or a secure facility determination under paragraph (2)(A) for the purpose of apprehending, detaining, or removing from the United States—</text>
 <clause id="H64E95DEAD4BE4EABADA214E4117948C8"><enum>(i)</enum><text>the unaccompanied alien child;</text> </clause><clause id="HC0A73FD4CA54453BA3FEEA164B292BD2"><enum>(ii)</enum><text>the proposed custodian or current custodian;</text>
 </clause><clause id="H4DEB9602E16745BFAEE8A7051E5B6BFD"><enum>(iii)</enum><text>a resident of the home in which the proposed custodian or current custodian resides;</text> </clause><clause id="H0F5245EDA96248F583F095540E951A00"><enum>(iv)</enum><text>the proposed sponsor or current sponsor; or</text>
 </clause><clause id="H17766C5BD38544B1A1E3165D7821E503"><enum>(v)</enum><text>a resident of the home in which the proposed sponsor or current sponsor resides.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="HDF840FE5067643429E335E08991E3D3D"><enum>(b)</enum><header>Rules of construction</header> <paragraph id="HD0736CE1F1FF48E2A3178C261EC25F1A"><enum>(1)</enum><header>Flores settlement agreement</header><text>The amendments made by this Act may not be construed to supersede the terms of the stipulated settlement agreement filed on January 17, 1997, in the United States District Court for the Central District of California in Flores v. Reno, CV 85–4544–RJK, (commonly known as the “Flores settlement agreement”).</text>
 </paragraph><paragraph id="H39032B379FDC4CA3B6CBBA7E60D62F2A"><enum>(2)</enum><header>Child welfare</header><text display-inline="yes-display-inline">The amendments made by this Act may not be construed to prevent the Secretary of Homeland Security from using information obtained by the Secretary of Health and Human Services to investigate or report to the appropriate law enforcement agency or child welfare agency instances of trafficking, abuse, or neglect.</text>
