 <section id="HF5DB4515B9E54C5D9F3B016D92A360DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conservation Capital Gains Exclusion Act of 2018</short-title></quote>.</text> </section><section id="H547513EC26724C2882D564BDA2B87C1F"><enum>2.</enum><header>Exclusion of gain from sale of land or qualified real property interests for conservation purposes</header> <subsection id="H1E35EF4E7EDB4EC0BFB375852BE59960"><enum>(a)</enum><header>In general</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before section 140 the following new section:</text>

					<section id="HAB329278003B4ADC86A2DDE1D861F83B"><enum>139H.</enum><header>Gain from sale of land or qualified real property interests for conservation purposes</header>
 <subsection id="H5F66AB91137149EAA121DB5E3369B71E"><enum>(a)</enum><header>In general</header><text>Gross income shall not include any gain from the sale of land or a qualified real property interest to a qualified organization exclusively for conservation purposes.</text>
 </subsection><subsection id="HC6CBE3CFDC31466593C08BB180E3C015"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section—</text> <paragraph id="HDE5CF7CA09D8410E8808153AABF51551"><enum>(1)</enum><header>Qualified real property interest</header> <subparagraph id="H975A411D36FF49D29E542C2E279F40B5"><enum>(A)</enum><header>In general</header><text>The term <quote>qualified real property interest</quote> means any of the following interests in real property:</text>
 <clause id="H64846FC446BD4FD284404BC2970F2AA1"><enum>(i)</enum><text>The entire interest of the taxpayer.</text> </clause><clause id="H5386A17F7D0E4004B7D250FC8919C0FC"><enum>(ii)</enum><text>A remainder interest.</text>
 </clause><clause id="H90475C9DD5334A3EB7CDB31A0D5D2C62"><enum>(iii)</enum><text>A restriction (granted in perpetuity) on the use which may be made of the real property.</text> </clause></subparagraph><subparagraph id="H0B7B3988FFE14894869314156A3AF97A"><enum>(B)</enum><header>Special rule for mineral interests</header><text>An interest in real property shall not fail to be treated as a qualified real property interest solely by reason of a retention of a qualified mineral interest.</text>
 </subparagraph></paragraph><paragraph id="H9EC7E2D533364962912D9EC34A231A09"><enum>(2)</enum><header>Qualified organization; conservation purposes</header><text>The terms <quote>qualified organization</quote> and <quote>conservation purpose</quote> shall have the respective meanings given such terms by section 170(h).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HD0734F86937F4A7397F36DDEB5D34826"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for part III of subchapter B of chapter 1 of such Code is amended by inserting before the item relating to section 140 the following new item:</text>

 </subsection><subsection id="H3588F24DBFEE4C5B9F2838218652E07E"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text>
