Russell National School Lunch Act to prohibit the stigmatization of
			 children who are unable to pay for meals.</official-title></form>
	<legis-body id="H824CA3D8D0034989AECE473DBF530EFE" style="OLC">
 <section id="id8D30FD300E4F478B86B1EA9460742F65" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Blame, No Shame Act</short-title></quote>.</text></section><section id="H7BDB5131E0C94DD89C6CBEBB20C62E46" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="H7D51B16659D34FFEBF95F88D9A5B462F"><enum>(1)</enum><text display-inline="yes-display-inline">School nutrition programs help end childhood hunger and provide access to healthy, nutritious meals.</text>
 </paragraph><paragraph id="H781CD84743F7439F87F684D511B20DB9"><enum>(2)</enum><text>Access to school meals has been shown to improve educational outcomes.</text> </paragraph><paragraph id="H9D0903DDA1E242F6AB8E9490ADDE846A"><enum>(3)</enum><text display-inline="yes-display-inline">A Federal, publicly funded universal school meal and nutrition program will eliminate any stigma that accompanies free or reduced meals and students unable to purchase meals due to insufficient account funds.</text>
 </paragraph><paragraph id="H80970A4183AE446096BEF5E672B4AA5C"><enum>(4)</enum><text display-inline="yes-display-inline">A Federal, publicly funded universal school meal and nutrition program would further allow schools to shift resources from paperwork to providing high quality meals.</text>
 </paragraph><paragraph id="HFF0C3C8964A54AA1B4E258D2BC5C0053"><enum>(5)</enum><text>A Federal, publicly funded universal school meal and nutrition program should be established.</text> </paragraph></section><section id="H5EC6F7892992474D900CD6B486838205"><enum>3.</enum><header>Prohibition on stigmatization of children who are unable to pay for meals</header><text display-inline="no-display-inline">Section 9(b)(10) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(10)</external-xref>) is amended—</text>
 <paragraph id="HBA2CF476481649D597EFEB3B1C0F4F54"><enum>(1)</enum><text>by striking <quote>(10) No physical</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H4DD310E226954EFCAC078A6E8AFD3CA4" style="OLC"> <paragraph id="H2533536734C84EBB9EF0E48559577762"><enum>(10)</enum><header>Discriminatory or stigmatizing treatment of children by schools</header> <subparagraph id="HCB151CEF556B47E8B0BA76228C4996C8"><enum>(A)</enum><header>Discrimination based on eligibility</header><text>No physical</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H9986B9C97AB949DABF0119B9CDFE0CED"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H80C449CB8D404D3594900AB34AC56D5D" style="OLC"> <subparagraph id="HB87C6FD416C948F49B1DAC51C161DACB"><enum>(B)</enum><header>Stigmatization based on lack of funds or debt</header> <clause id="HF240251C01AD4188BBF5579B4043AEE4"><enum>(i)</enum><header>Definition of covered child</header><text>In this subparagraph, the term <term>covered child</term> means a child who—</text>
 <subclause id="HB3E79971F0884B4FB0C6BC23CF6B4BFB"><enum>(I)</enum><text>is a student at a school that participates in—</text> <item id="H2B41693087194E4684B5872BC3C5119E"><enum>(aa)</enum><text>the school lunch program established under this Act; or</text>
 </item><item id="H2AC5FCD6684A46519FE9FF24DF10FCAD"><enum>(bb)</enum><text>the school breakfast program established by section 4 of the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and</text> </item></subclause><subclause id="H3ABE87BC19884CE69BE0232574492396"><enum>(II)</enum> <item commented="no" display-inline="yes-display-inline" id="H6C7791ACE6EC4DE4938F69B21EF2CB99"><enum>(aa)</enum><text>does not have funds to pay for a lunch or breakfast at the school; or</text>
 </item><item commented="no" id="HE46AE9B15C984549932A463D382B1C55" indent="up1"><enum>(bb)</enum><text>has outstanding credit that was extended by a school food authority for a lunch or breakfast at the school.</text>
								</item></subclause></clause><clause id="H48D9D95A3AB3405AA6823FE01D293574"><enum>(ii)</enum><header>Requirements of local educational agencies</header>
 <subclause id="H0E398FAB656D490B948A962ED87DF1D1"><enum>(I)</enum><header>In general</header><text>A local educational agency shall not permit—</text> <item id="H3C43E12AF0CB442AB301B59F17671BBC"><enum>(aa)</enum><text>the public identification of a covered child, such as by requiring the covered child to wear a wristband or display a hand stamp to identify the covered child as a covered child;</text>
 </item><item id="HAD98AD829EC240889053AE47AFE83153"><enum>(bb)</enum><text>the stigmatization of a covered child, such as by preventing such student from participating in extracurricular activities, school functions, or other school events due to the status of the child as a covered child; or</text>
 </item><item id="HF1B4F670000A4E2DB290D12B2E50DA21"><enum>(cc)</enum><text>any requirement that a covered child, because of the status of the covered child as a covered child—</text>
 <subitem id="HF4F9134229E94B35BECE8C0CFA591BB3"><enum>(AA)</enum><text>perform chores or any other activity that is not required of students generally; or</text> </subitem><subitem id="HF0CE3CD247A4428483A1B8995066CECE"><enum>(BB)</enum><text>dispose of a lunch or breakfast after it has been served to the covered child.</text>
									</subitem></item></subclause><subclause id="HC966FFDCD6B24C1EA0A527868FBC02AE"><enum>(II)</enum><header>Communications</header>
 <item id="H52892409D06A4639B0356D30CA144F6A"><enum>(aa)</enum><header>In general</header><text>Subject to item (bb), a local educational agency shall require that any communication relating to an outstanding credit described in clause (i)(II)(bb) of a covered child shall be directed—</text>
 <subitem id="H70F61AFFCAE948B38D5920168C91CEFB"><enum>(AA)</enum><text>to a parent or guardian of the covered child; and</text> </subitem><subitem id="HB088D50C3C414214BF2CF62B66895AA5"><enum>(BB)</enum><text>not to the covered child.</text>
 </subitem></item><item id="HBD9A40D47DDB4762A4F35AEE33E715C7"><enum>(bb)</enum><header>Letters</header><text>A local educational agency may permit a requirement that a covered child deliver a letter addressed to a parent or guardian of the covered child that contains a communication described in item (aa), subject to the condition that the letter shall not be distributed to the covered child in a manner that stigmatizes the covered child.</text>
 </item><item id="H4FDC257305514B2DA05552D020FEA1AD"><enum>(cc)</enum><header>School meal collection policy distribution</header><text>A local educational agency shall annually publish and make publicly available, including to school administrators, meal vendors, and parents and guardians of children served by the local educational agency, the policy of local educational agency that includes—</text>
 <subitem id="H9800AE35DD2541E1AE807CD91414EE9A"><enum>(AA)</enum><text>the policies, procedures, and guidelines of the local educational agency with respect to owed debts and insufficient funds to purchase meals; and</text>
 </subitem><subitem id="HBC2A38A20F7E417DBA387F2C54F56608"><enum>(BB)</enum><text>available and relevant meals and food programs and resources.</text> </subitem></item></subclause></clause></subparagraph><subparagraph id="H7F504D0C0602441DAED087FC21973426"><enum>(C)</enum><header>Report on violations</header><text>Each State shall annually submit to the Secretary a report that includes—</text>
 <clause id="H7F7654B101904882A50D6C27349113BE"><enum>(i)</enum><text display-inline="yes-display-inline">each violation of this paragraph by a school located in such State during the previous year;</text> </clause><clause id="H9A70A85BE35B41D29D798D0A33D09E23"><enum>(ii)</enum><text>each violation of this paragraph by a local educational agency located in such State during the previous year;</text>
 </clause><clause id="H36ED5F87F17846CAB6CE25589E380AA0"><enum>(iii)</enum><text>the amount of student meal debt accrued in each school and each local educational agency located in the State during the previous year; or</text>
 </clause><clause id="HE778CFC153B646E2A30A16ADDA68247B"><enum>(iv)</enum><text>the policies with respect to school meals used by each school and local educational agency located in such State.</text>
 </clause></subparagraph><subparagraph id="H7684F74E5BEC4BD183B585651FECA414"><enum>(D)</enum><header>Publication</header><text>The Secretary shall establish and update a list of the violations of this paragraph on a public website of the Department.</text>
					</subparagraph><subparagraph commented="no" id="HF58C29E18B724C26B231D3DE509FF8D1"><enum>(E)</enum><header>Penalty</header>
 <clause commented="no" id="HAE984053426C44E381CF206285D14E40"><enum>(i)</enum><header>In general</header><text>Notwithstanding any other provision of law and subject to clause (ii), in the case of a local educational agency or a school served by such local educational agency that is reported under subparagraph (C) as having violated this paragraph, such local educational agency shall, not later than 3 years after the date on which such report was submitted—</text>
 <subclause commented="no" id="H8D17DF6A93B648EB922FF57AC15F8686"><enum>(I)</enum><text>use administrative funds reserved for school board or administrator activities to pay accrued school meal debt in the year prior to the date on which such report was submitted; and</text>
 </subclause><subclause commented="no" id="HD54BD2D04D214DB3A4EAD8F7761389A9"><enum>(II)</enum><text>forgive the outstanding debt of each covered child that accrued such debts.</text> </subclause></clause><clause commented="no" id="HC64376F4BDE74AA182E17EC386250B70"><enum>(ii)</enum><header>Certain funds excluded from redistribution</header><text display-inline="yes-display-inline">None of the funds that would otherwise be used by the local educational agency for salaries, bonuses, workforce training and development, instruction of students, student resources, day-to-day school operations, or the benefit of school employees, teachers, and school-based administrator may be used under clause (i).</text>
 </clause></subparagraph><subparagraph commented="no" id="HDB3B6160D2FF43CB8235E6C6B148383F"><enum>(F)</enum><header>Prohibition</header><text display-inline="yes-display-inline">In the case of covered child with outstanding debt with respect to school meals, a local educational agency may not seek collection through a collection agency if such collection agency charges such covered child or the family of such covered child fees that are in addition to the outstanding debt.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H7655E4BB9EB04B7CA6B89B1491AE107C"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Secretary of Agriculture should ensure that—</text> <paragraph id="H30079E8C3C104A7892FB1965A288F36A"><enum>(1)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HD897355286324C59B8D3D253216544F8"><enum>(A)</enum><text>to the maximum extent practicable, an application for a free or reduced price lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.) is distributed—</text>
 <clause id="HC32222A328F54AD088365A8AF94EC1F3" indent="up1"><enum>(i)</enum><text>in an understandable and uniform format; and</text> </clause><clause id="H9C039A8EEDB941E4AEE67E02783F3183" indent="up1"><enum>(ii)</enum><text>by not later than July 1 each year; and</text>
 </clause></subparagraph><subparagraph id="HD75C64BDE5D848669D84480A561400CB" indent="up1"><enum>(B)</enum><text>a local educational agency offers technical assistance to a parent or legal guardian to complete an application described in subparagraph (A);</text>
 </subparagraph></paragraph><paragraph id="H43CE19C4BDF84277BDBBEEEF4AB20273"><enum>(2)</enum><text>each local educational agency coordinates with—</text> <subparagraph id="HED8C80317A18400180CE50A3F7B24F74"><enum>(A)</enum><text>the local educational agency liaison designated under section 722(g)(1)(J)(ii) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11432">42 U.S.C. 11432(g)(1)(J)(ii)</external-xref>) to ensure that homeless children and youths eligible to receive free lunches and breakfasts under section 9(b)(12)(A)(iv) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(12)(A)(iv)</external-xref>) receive those free lunches and breakfasts; and</text>
 </subparagraph><subparagraph id="H4464C13A6B744BDA8EA02DFA7F3E4F04"><enum>(B)</enum><text>the State agency responsible for administering the State plans under parts B and E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621</external-xref> et seq.; <external-xref legal-doc="usc" parsable-cite="usc/42/470">42 U.S.C. 470</external-xref> et seq.) to ensure that foster children eligible to receive free lunches and breakfasts under section 9(b)(12)(A)(vii) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(12)(A)(vii)</external-xref>) receive those free lunches and breakfasts; and</text>
 </subparagraph></paragraph><paragraph id="H6186A8DAAF57429996CEDB8785100E44"><enum>(3)</enum><text>a local educational agency that participates in the school lunch program or the school breakfast program under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.) or section 4 of the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), respectively—</text>
 <subparagraph id="H77FF95E83E75428BBB0B722593711ECE"><enum>(A)</enum><text>shall provide to a child who requests a lunch or breakfast a lunch or breakfast, regardless of whether the child—</text>
 <clause id="HF06EC8A20404461ABE716EC81C191608"><enum>(i)</enum><text>has money to pay for the lunch or breakfast; or</text> </clause><clause id="H293ECB816EB1426A8019BE86FD990B6B"><enum>(ii)</enum><text>owes money for a lunch or breakfast;</text>
 </clause></subparagraph><subparagraph id="HFDC7ACF6D52A4899BC560A393E803CDB"><enum>(B)</enum><text>shall not provide to a child who qualifies for a free or reduced price lunch or breakfast an alternate meal that is not provided to students generally; and</text>
 </subparagraph><subparagraph id="H3CD1785B81E9461E93C9B4B89556CB0D"><enum>(C)</enum><text>should explore innovative ways to use technology to improve and coordinate communications with parents and guardians with respect to functions such as—</text>
 <clause id="HCCB21CC5CFC04D71A6D2B2576BFC8208"><enum>(i)</enum><text>prepayment for meals;</text> </clause><clause id="HD0EE9FCCB78B44A1AE1D89EF56618007"><enum>(ii)</enum><text>checking balances for school meals;</text>
 </clause><clause id="H1C285CADA30244AF8CF95D2CE3744CE7"><enum>(iii)</enum><text>adding funds to accounts for school meals;</text> </clause><clause id="H357691136B8E40FDAEB4DE8EE298D503"><enum>(iv)</enum><text>addressing outstanding debt for school meals; and</text>
 </clause><clause id="HD5832C6661D34A21B3AE83A1A240E311"><enum>(v)</enum><text>sending automatic emails when an account balance is low.</text> </clause></subparagraph></paragraph></section></legis-body></bill>
