 <section id="HCCB34230D3EF44A384B9D02860D0F108" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mancos Water Conservancy District Conveyance Act</short-title></quote>.</text> </section><section id="HFFA69E54548345A69A74FEF4E8A09832"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H332A37286CEC4A31A2CB995D810E8ECD"><enum>(1)</enum><header>Contract</header>
 <subparagraph id="HE7C87BC3440A4B568DD84A36AFD3A503"><enum>(A)</enum><header>In general</header><text>The term <term>Contract</term> means the contract providing for the repayment of construction and operation and maintenance costs of the Mancos Project entered into by the United States and the District numbered I1r–1384 and dated July 20, 1942.</text>
 </subparagraph><subparagraph id="H37E1A01BC6624E75B81B4D5A0310A2B2"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Contract</term> includes any amendment or supplement to the contract described in subparagraph (A).</text> </subparagraph></paragraph><paragraph id="HFCC59221EF1B4E319CD34FDB548D2AF1"><enum>(2)</enum><header>District</header><text>The term <term>District</term> means the Mancos Water Conservancy District, established on January 6, 1941, under the Water Conservancy Act (Colo. Rev. Stat. 37–45–101 et seq.).</text>
 </paragraph><paragraph id="HE03F520F68FE4F7DB82E02F6CC8B6C44"><enum>(3)</enum><header>Mancos Project</header><text>The term <term>Mancos Project</term> means the project of the Bureau of Reclamation—</text> <subparagraph id="H5B8F4DA3155E4B3391F34A9C84BB2F44"><enum>(A)</enum><text>located in the State; and</text>
 </subparagraph><subparagraph id="HBAD800A405F84A318BCACCB717C76DA5"><enum>(B)</enum><text>authorized by the Act of August 11, 1939 (commonly known as the <quote>Water Conservation and Utilization Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/590y">16 U.S.C. 590y</external-xref> et seq.).</text> </subparagraph></paragraph><paragraph id="H027926415AC34A40BE083006E6601392"><enum>(4)</enum><header>Mancos Project feature</header> <subparagraph id="HA61346034BCC44AC904696151B3A34F7"><enum>(A)</enum><header>In general</header><text>The term <term>Mancos Project feature</term> means the inlet canal, outlet canal, structures, facilities, land, easements, rights-of-way, buildings, and water rights associated with the Mancos Project.</text>
 </subparagraph><subparagraph id="HCFC19C6440DF48648C565AD13F9F92FB"><enum>(B)</enum><header>Inclusion</header><text>The term <term>Mancos Project feature</term> includes the Jackson Gulch Reservoir.</text> </subparagraph><subparagraph id="HAF1E960F7052416CB130E57411AAE130"><enum>(C)</enum><header>Exclusions</header><text>The term <term>Mancos Project feature</term> does not include—</text>
 <clause id="H7C833F728E0C44B995ABA253DDF6159B"><enum>(i)</enum><text>the Jackson Gulch Dam; or</text> </clause><clause id="H7DECECE7F31D4405B776B71A06E98F02"><enum>(ii)</enum><text>any structure, facility, or other improvement associated with the Mancos Project paid for by the State.</text>
 </clause></subparagraph></paragraph><paragraph id="H9E76998A595041D58CE76A2C70227F42"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text> </paragraph><paragraph id="H1F9461AF452249A2BA2644D60BD02F38"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means the State of Colorado.</text>
 </paragraph><paragraph id="HBAF002ECCB104BB0A86BD9D6939F2A91"><enum>(7)</enum><header>Transfer Agreement</header><text>The term <term>Transfer Agreement</term> means the agreement between the United States and the District establishing the terms and conditions of the conveyance of the Mancos Project features from the United States to the District.</text>
			</paragraph></section><section id="H9A0E16A7F3694BBA8BDE07479BA1C958"><enum>3.</enum><header>Mancos Project features conveyance, Colorado</header>
			<subsection id="H825989C243FF447E8C6511853C71FC67"><enum>(a)</enum><header>Conveyance of Mancos Project features and easement</header>
 <paragraph id="H971D0101DC9E42E0848C188B3CE5E5CA"><enum>(1)</enum><header>Finding relating to contract repayment</header><text>Congress finds that the District has completed the obligation of the District under the Contract to repay the capital costs of the Mancos Project.</text>
				</paragraph><paragraph id="H3F0AEA85B2D644D48E8043E1CB959DEA"><enum>(2)</enum><header>Conveyances</header>
					<subparagraph id="H403D9D49B85F4B489081B7B4C4A4952F"><enum>(A)</enum><header>Mancos project features</header>
 <clause id="H22FC55BF21FB4E299316636D266290A1"><enum>(i)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, in accordance with applicable law (including regulations), the Secretary shall convey to the District all right, title, and interest of the United States in and to the Mancos Project features, in accordance with the terms and conditions established in the Transfer Agreement.</text>
 </clause><clause id="HD4BC1CE24C3D47A8BF8A0E3D4D5DF0FA"><enum>(ii)</enum><header>No additional consideration required</header><text>The District shall not be required to provide to the Secretary additional consideration for the conveyance of the Mancos Project features under clause (i).</text>
						</clause></subparagraph><subparagraph id="H31751BF65B43463783438128990DD893"><enum>(B)</enum><header>Easement</header>
 <clause id="HC454D37148784CC5A4C645BDFF193387"><enum>(i)</enum><header>In general</header><text>The Secretary shall convey to the State an easement for access to the Mancos Project features that make up Mancos State Park for the benefit of the public for recreation and related management uses.</text>
 </clause><clause id="H20B7AC17E2564C51A902326AC3DF2AA3"><enum>(ii)</enum><header>No consideration required</header><text>The State shall not be required to provide consideration to the Secretary for the conveyance of the easement under clause (i).</text>
 </clause><clause id="H434DFC8ECEFB4D1392974B0045E79476"><enum>(iii)</enum><header>Effect</header><text>Nothing in this subparagraph—</text> <subclause id="HBEA1282DB4F94DB6AF17502479FB0F7C"><enum>(I)</enum><text>affects the jurisdiction of the State with respect to the management and maintenance of Mancos State Park; or</text>
 </subclause><subclause id="HE8DDB279BAB74836BD9D2CA85955F24F"><enum>(II)</enum><text>authorizes the District to manage or maintain Mancos State Park.</text> </subclause></clause><clause id="H4AF9FBF33FC949BE8D32C7E6604860E6"><enum>(iv)</enum><header>Termination</header> <subclause id="H9149A81489C542C5B91B9C702715A7B7"><enum>(I)</enum><header>Notice</header><text>If the State permanently closes Mancos State Park, the State shall terminate the easement conveyed under clause (i) by written notice to the Secretary and the District.</text>
 </subclause><subclause id="H2EDEF33581924B1FBEC057D33DC08C24"><enum>(II)</enum><header>Effect</header><text>On the termination of the easement under subclause (I), all affixed structures, facilities, or other improvements paid for by the State within Mancos State Park shall become the property of the District at no cost to the District.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H1C92C9196FA746C1AD2F8327E51D1875"><enum>(3)</enum><header>Compliance with environmental laws</header>
 <subparagraph id="HECE8B7DFD99441CA84EF2F672DD75A4F"><enum>(A)</enum><header>In general</header><text>Before completing any conveyance under paragraph (2)(A)(i), the Secretary shall carry out all actions required under—</text>
 <clause id="HA99238CF4B1640AFB084B20E690B0814"><enum>(i)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.);</text> </clause><clause id="H42EA2D2913424F0186B2A57CDDD22B6A"><enum>(ii)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.); or</text>
 </clause><clause id="HBF60B63B89B041C0A2B3CB7D1AB2C0E7"><enum>(iii)</enum><text>any other law applicable to the property conveyed.</text> </clause></subparagraph><subparagraph id="HFF33EF9E053545619FEB49D27AAFB0C1"><enum>(B)</enum><header>Effect</header><text>Nothing in this Act modifies or alters any obligation of the United States under—</text>
 <clause id="HD136D1EF2FFA4AA68B6B4A90E112B607"><enum>(i)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); or</text> </clause><clause id="H2B3E0B95BD88462EA3B31E12B7D6D2E1"><enum>(ii)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text>
						</clause></subparagraph></paragraph><paragraph id="HB9673E43EBF44B59BAD6B891BEED8288"><enum>(4)</enum><header>Jackson Gulch Dam</header>
 <subparagraph id="HD4C82F43525542C58B7A5E5AC7558EFD"><enum>(A)</enum><header>Possession</header><text>The United States shall retain possession of the Jackson Gulch Dam.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7AAB2743F59C4B2C93AEF37C06F086E6"><enum>(B)</enum><header>No effect on transferred works agreement</header><text>The District shall continue in effect the operations and maintenance of the Jackson Gulch Dam and associated outlet works in accordance with—</text>
 <clause commented="no" display-inline="no-display-inline" id="H2119C2DE6E944DB0A2424BE7950C0F71"><enum>(i)</enum><text>article 11 of the Contract; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="H49E0A178E9C043E2AC24D0133C737731"><enum>(ii)</enum><text>the transferred works agreement dated December 12, 1962.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD73E61C07FCD485DAA6310AADFB0490C"><enum>(b)</enum><header>Limitation</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H88812B0B1EF64549BF16D3C1864A1780"><enum>(1)</enum><header>In general</header><text>Notwithstanding any provision of the Contract or any other provision of law (including any law described in paragraph (2)), effective beginning on the date of the conveyance under subsection (a)(2)(A)(i), the Secretary may not assess any additional fee or charge or incur any additional costs relating to any outlet works that is a Mancos Project feature (based on the historical use of the applicable outlet works).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD5989EFB3E7649CEBB72CDDD4A1141E9"><enum>(2)</enum><header>Description of laws</header><text>The laws referred to in paragraph (1) are—</text> <subparagraph id="H6B293CAD52834E9889A2CC764977638E"><enum>(A)</enum><text>section 9 of the Act of August 11, 1939 (commonly known as the <quote>Water Conservation and Utilization Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/590z-7">16 U.S.C. 590z–7</external-xref>);</text>
 </subparagraph><subparagraph id="HA41233624B8D461B9E1D95CC9D62CEB3"><enum>(B)</enum><text>the Mancos Project Private Power Development Authorization Act of 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/434">Public Law 103–434</external-xref>; 108 Stat. 4549);</text>
 </subparagraph><subparagraph id="HBA1B4D8F43034BE09280A3CA71161330"><enum>(C)</enum><text>Public Law 106–549 (114 Stat. 2743); and</text> </subparagraph><subparagraph id="HF3F5647CDA744C22AAAC38E28C629659"><enum>(D)</enum><text>section 9105 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1303).</text>
 </subparagraph></paragraph><paragraph id="H5FF033AE442D4FF4BD4CA20581657CEA"><enum>(3)</enum><header>Valid existing rights</header><text>The conveyance under subsection (a)(2)(A)(i) shall be subject to all valid existing leases, permits, rights-of-way, easements, and other rights appurtenant to the Mancos Project features.</text>
 </paragraph></subsection><subsection id="HB5386A60534944B7BDE42A1E0678353B"><enum>(c)</enum><header>No liability</header><text display-inline="yes-display-inline">Except as otherwise provided by law, effective on the date of conveyance to the District of the Mancos Project features under subsection (a)(2)(A)(i), the United States shall not be liable for any damages arising out of any act, omission, or occurrence based on any prior ownership or operation by the United States of any Mancos Project feature.</text>
			</subsection><subsection id="H6B9107175D7B4873BD779894587F334D"><enum>(d)</enum><header>Reports</header>
 <paragraph id="HEB4D15D932C84A6D810A5409F3485DE1"><enum>(1)</enum><header>Initial report on conveyance delay</header><text display-inline="yes-display-inline">If the Secretary is unable to convey to the District the Mancos Project features under subsection (a)(2)(A)(i) by the date that is 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives, by not later than 30 days after that date, a report that describes—</text>
 <subparagraph id="HEA9C4ECD6F16450EA83E836BEC82D54B"><enum>(A)</enum><text>the reasons for the delay; and</text> </subparagraph><subparagraph id="H51D213EC362F46EEA0BDD9BB686F3D55"><enum>(B)</enum><text>a schedule for completing the conveyance as soon as practicable.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A7442CD5502458B997ED0C12960427D"><enum>(2)</enum><header>Subsequent annual reports</header><text>Not less frequently than once each year during the period beginning on the date of submission of the report under paragraph (1), if applicable, and ending on the date on which the Mancos Project features are conveyed in accordance with this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives reports that provides the information described in subparagraphs (A) and (B) of paragraph (1).</text>
 </paragraph></subsection><subsection id="HAB25BF9D9DB74719A844AED51ADC8672"><enum>(e)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this Act, or any action carried out by the Secretary pursuant to this Act affects, impacts, or establishes any additional burden or obligation on the District in the exercise of any right of the District relating to—</text>
 <paragraph id="HE737F27EA21145D98ED00B8932F2FF08"><enum>(1)</enum><text display-inline="yes-display-inline">water;</text> </paragraph><paragraph id="HEA112E7C7EA9477A9C170403BD29284A"><enum>(2)</enum><text display-inline="yes-display-inline">real property; or</text>
 </paragraph><paragraph id="HCAC9F7D38490470D80AD5F04E9FCB99D"><enum>(3)</enum><text display-inline="yes-display-inline">the use of any Mancos Project feature.</text> </paragraph></subsection></section></legis-body></bill>
