			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require congressional approval of certain trade remedies, and for other purposes.</official-title></form>
	<legis-body id="H3E8D431FB52E4363B6B50563D7316FA6" style="OLC">
 <section id="H2D3D1AE168CB4F2E81DE34D91DBFEB0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Responsible and Free Trade Act</short-title></quote>.</text> </section><section id="HDE407411400D4EDBA579CB291A1A86FC"><enum>2.</enum><header>Approval for remedy actions by the United States Trade Representative</header><text display-inline="no-display-inline">Section 301 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref>) is amended as follows:</text>
 <paragraph id="HB3789D4420324FCAB48B6488C390C020"><enum>(1)</enum><header>Mandatory action</header><text>In the matter following subsection (a)(1)(B)(ii), by striking <quote>shall take action authorized in subsection (c)</quote> and inserting <quote>shall propose, in accordance with subsection (d), action authorized under subsection (c)</quote>.</text> </paragraph><paragraph id="H2DC063F680074496BBC29184A1DD62F7"><enum>(2)</enum><header>Discretionary action</header><text>In subsection (b)(2), by striking <quote>shall take all appropriate and feasible action authorized under subsection (c)</quote> and inserting <quote>shall propose, in accordance with subsection (d), appropriate and feasible action authorized under subsection (c)</quote>.</text>
 </paragraph><paragraph id="H6CBFD5C17D57455FB1E5899EADFF4BF6"><enum>(3)</enum><header>Congressional disapproval procedures</header><text>By redesignating subsection (d) as subsection (e) and inserting after subsection (c) the following:</text> <quoted-block display-inline="no-display-inline" id="HC8BFA4067740468A8ACEC8EB0B7A5FB7" style="OLC"> <subsection id="H30CA4A6BAA014546BF882BB9B990D24C"><enum>(d)</enum><header>Congressional disapproval procedures</header> <paragraph id="H078C1B1B1FBE4983B26B6007D06D6D7C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Trade Representative shall submit to the Committee on Ways and Means of the House of Representatives and to the Committee on Finance of the Senate a report describing and justifying a determination pursuant to subsection (a) or (b) of this section and specifying the proposed action authorized under subsection (c). The Trade Representative shall also include in such report, as appropriate, any specific direction of the President relating to such proposed action and any other action within the power of the President that the President, as provided for in subsection (a), may have directed the Trade Representative to take with respect to such determination.</text>
						</paragraph><paragraph id="H9F70E21C2A814F908A5A2AAD51672BC5"><enum>(2)</enum><header>Entry into force</header>
 <subparagraph id="HF839C8BD4FF342A997396BED45CBCDE9"><enum>(A)</enum><header>Joint resolution of disapproval</header><text>An action proposed in accordance with paragraph (1) shall take effect on the date that is 60 days after the date of the submission of the report required by paragraph (1) unless, within such 60 day window, Congress enacts a joint resolution, the matter after the resolving clause of which is as follows: <quote>That the Congress does not approve the action proposed by the Trade Representative under section 301 of the Trade Act of 1974 submitted to the Congress on _____.</quote>, the blank space being filled with the appropriate date.</text>
 </subparagraph><subparagraph id="H8CFD74339A9C4BE1BF142EE6E8178406"><enum>(B)</enum><header>Procedures applied</header><text display-inline="yes-display-inline">The provisions of section 152 shall apply to resolutions described in subsection (a).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="H5B44077343E94B978C9C701B9B8B7C64"><enum>3.</enum><header>Approval for remedy action relating to positive adjustments to import competition</header><text display-inline="no-display-inline">Section 202 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2252">19 U.S.C. 2252</external-xref>) is amended as follows:</text>
 <paragraph id="H4F52F55232B846E985AE2B2F1EDDBC04"><enum>(1)</enum><header>Initial submission to Congress</header><text>In subsection (f)—</text> <subparagraph id="H699C40698B7048519F292097AF8420D5"><enum>(A)</enum><text>in paragraph (1), by striking <quote>shall submit to the President</quote> and inserting <quote>shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate</quote>; and</text>
 </subparagraph><subparagraph id="HEB6FABE26A0D4048A78C53A0C8526FA2"><enum>(B)</enum><text>in paragraph (3), by striking <quote>submitting a report to the President</quote> and inserting <quote>submitting a report to the Committees</quote>.</text> </subparagraph></paragraph><paragraph id="H3D3956BF46A5406C84E67206E6344133"><enum>(2)</enum><header>Conforming amendments</header><text>In the matter following subsection (c)(2)(B), by striking <quote>to the President under subsection (e)</quote> and inserting <quote>under subsection (f)</quote>.</text>
 </paragraph><paragraph id="H231F50ECECA445E5B2D65ED862EF4A0A"><enum>(3)</enum><header>Congressional disapproval procedures</header><text>By adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H2D6DE2E43AD64C95BB8963343419191A" style="OLC"> <subsection id="HFBB84FCF4370426195273CF1A3878ACB"><enum>(j)</enum><header>Entry into force</header> <paragraph id="H52B29E9E358A4F66A603080824548536"><enum>(1)</enum><header>Joint resolution of disapproval</header><text>On the date that is 60 days after the date of the submission of a report under subsection (f), the Commission shall submit such report to the President unless, within such 60 day window, Congress enacts a joint resolution, the matter after the resolving clause of which is as follows: <quote>That the Congress does not approve the report by the Commission under section 202(f) of the Trade Act of 1974 submitted to the Congress on _____.</quote>, the blank space being filled with the appropriate date.</text>
 </paragraph><paragraph id="H962FB6B6FEA3444AB1CEDA1B7902F129"><enum>(2)</enum><header>Procedures applied</header><text>The provisions of section 152 shall apply to resolutions described in subsection (a).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="H249262757CA5440693B11DBC67024BDC"><enum>4.</enum><header>Approval for action safeguarding national security</header> <subsection id="H32D50A04A0304D2FAFE16A12233071C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>) is amended—</text>
 <paragraph id="HB84256CD13FE4A52A694909D52D36450"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="H708E1B00F7B04B1780D83666F2CBD441"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="H69B03A6677DA43E1930DB6AAF2482111"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>Secretary of Commerce</quote> and all that follows through <quote>) shall</quote> and inserting <quote>the Secretary of Defense shall</quote>; and</text> </clause><clause id="H4AA9F6E407714CE98BFACD3155431C72"><enum>(ii)</enum><text>in subparagraph (B)—</text>
 <subclause id="H8BA4A8C531A24F848B466CAB01E17639"><enum>(I)</enum><text>by striking <quote>Secretary shall</quote> and inserting <quote>Secretary of Defense shall</quote>; and</text> </subclause><subclause id="H502DF3C5203440939F3243DEAC2740A6"><enum>(II)</enum><text>by striking <quote>Secretary of Defense of</quote> and inserting <quote>Secretary of Commerce of</quote>;</text>
 </subclause></clause></subparagraph><subparagraph id="H8A070533250F45F39E546349D2DE8BD1"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="HF15F8E59ADE64F9AA1BD5C6273EFD46B"><enum>(i)</enum><text>by striking subparagraph (B);</text>
 </clause><clause id="H384A7B526CB746CEB26DE809C01B46E9"><enum>(ii)</enum><text>in subparagraph (A)—</text> <subclause id="HB2339F3CA8874C13B6F6BD70FD8D35FD"><enum>(I)</enum><text>in the matter preceding clause (i)—</text>
 <item id="HE0C3E15A17014BC096D48978D384EAB1"><enum>(aa)</enum><text>by striking <quote>(A) In</quote> and inserting <quote>In</quote>; and</text> </item><item id="HC61B971BE15A41549F8DA58064E22548"><enum>(bb)</enum><text>by striking <quote>Secretary</quote> and inserting <quote>Secretary of Defense</quote>; and</text>
 </item></subclause><subclause id="H00E0E6D0AAD749058981E55A42D3A217"><enum>(II)</enum><text>by striking clauses (i) through (iii) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HC8817D21379C4734928D1E31CD0E0548" style="traditional"> <subparagraph id="HF223DE83F35A4F38829C9FEC1FF91144" indent="up1"><enum>(A)</enum><text>consult with the Secretary of Commerce regarding the methodological and policy questions raised in any investigation initiated under paragraph (1);</text>
 </subparagraph><subparagraph id="HEFA4C5C5219C44D6A83CF0D344B43D51" indent="up1"><enum>(B)</enum><text>prepare an assessment of the defense requirements and national security impact of any article that is the subject of an investigation, which shall focus on—</text>
 <clause id="HC2C11C7EFA474359BE830A78189C977A"><enum>(i)</enum><text>the impact of the importation of the article on military readiness and critical infrastructure; and</text> </clause><clause id="H36DD0563074242E59D77FA9F3D344EE9"><enum>(ii)</enum><text>the need for a reliable supply of the article to protect national security;</text>
 </clause></subparagraph><subparagraph id="H96091DC0807945BEB62F049B2A7921F1" indent="up1"><enum>(C)</enum><text>seek information and advice from the Secretary of Commerce;</text> </subparagraph><subparagraph id="HA56EFF2C7D9E433CB7E3F252548D4959" indent="up1"><enum>(D)</enum><text>consult with appropriate officers of the United States;</text>
 </subparagraph><subparagraph id="H36AF50DC6AC54253836B0E9B772E5E56" indent="up1"><enum>(E)</enum><text>consult with members of the Committee on Finance of the Senate and members of the Committee on Ways and Means of the House of Representatives; and</text>
 </subparagraph><subparagraph id="HDBA4F0BD0AEF41B09BC2A4E73233A681" indent="up1"><enum>(F)</enum><text>hold public hearings, co-chaired with the Department of Commerce, or otherwise afford interested parties an opportunity to present information and advice relevant to such investigation.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subclause></clause></subparagraph><subparagraph id="H06F546FFF1A840DB831508C64F474DFB"><enum>(C)</enum><text>in paragraph (3)—</text> <clause id="H07AA5454E2B244418B864C604330D0FC"><enum>(i)</enum><text>by redesignating subparagraph (B) as subparagraph (D);</text>
 </clause><clause id="HE9F26002705043139A5C144E1511FB0C"><enum>(ii)</enum><text>by striking subparagraph (A) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H27F3D517544E4558B664E6661BCB9C30" style="traditional"> <subparagraph id="H229CD01C9B8746B184453C1C97DBAE89" indent="up2"><enum>(A)</enum><text>Not later than 200 days after the date on which the Secretary of Defense initiates an investigation under paragraph (1) with respect to an article, the Secretary of Defense shall submit to the President a report on the findings of such investigation with respect to the effect of the importation of such article in such quantities or under such circumstances on the national security of the United States.</text>
 </subparagraph><subparagraph id="H11F299DF83FF4778AB31A86BE72158A3" indent="up2"><enum>(B)</enum><text>If the report described in subparagraph (A) includes an affirmative finding that the importation of an article in such quantities or under such circumstances threatens to impair the national security, the President may direct the Secretary of Commerce to devise recommendations to address such threat.</text>
 </subparagraph><subparagraph id="H1F9C122D30954E1DBF8DBEFCEF72CEAF" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">Not later than 100 days after receiving from the President under subparagraph (B) a direction to devise recommendations with respect to an article, the Secretary of Commerce shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a report that includes—</text>
 <clause id="HE87C4D2F064C4593B2502EC1BC18A6C1"><enum>(i)</enum><text>recommendations for action or inaction under this section with respect to the article; and</text> </clause><clause id="H72137CDAA69549558B5506F78DC46182"><enum>(ii)</enum><text>the findings of the Secretary of Commerce with respect to the investigation by the Secretary of Defense under paragraph (1).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="H7D9F54FD6717447FB91A7FE5201A6476"><enum>(iii)</enum><text>in subparagraph (D), as so redesignated by subparagraph (C)—</text> <subclause id="HD40992581A8546EAB8E027B5977DEF2B"><enum>(I)</enum><text>by striking <quote>Secretary</quote> and inserting <quote>Secretary of Defense</quote>; and</text>
 </subclause><subclause id="H457F2158F6C04A31A2662FECA3DF03C4"><enum>(II)</enum><text>by inserting <quote>or the report submitted by the Secretary of Commerce under subparagraph (C)</quote> after <quote>subparagraph (A)</quote>;</text> </subclause></clause></subparagraph><subparagraph id="HB4F5A15753484903A3871651EA077FF9"><enum>(D)</enum><text>in paragraph (4), by inserting <quote>of Defense, in consultation with the Secretary of Commerce,</quote> after <quote>The Secretary</quote>; and</text>
 </subparagraph><subparagraph id="H87A0EE31B41C484997E28B18B9006473"><enum>(E)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HB54F165A818240148EA431F3F9C638A1" style="traditional"> <paragraph id="H17E572CEB0354173929AC964745FE3CB"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary shall submit the report described in paragraph (3)(C) to the President if Congress enacts a joint resolution, the matter after the resolving clause of which is as follows: <quote>That the Congress approves the report by the Commission under section 232 of the Trade Act of 1962 submitted to the Congress on _____.</quote>, the blank space being filled with the appropriate date. The provisions of section 152 of the Trade Act of 1974 shall apply with respect to the consideration of such joint resolution.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HE1E2D1016C12436CAA0B03D784EFEBBC"><enum>(2)</enum><text>in subsection (c)(1), by striking subparagraph (A) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H9AB9A46891CC46E286625238FEA0751D" style="traditional"> <subparagraph id="HD91A307EFEA34DA1970CBBF0BF18BBE2" indent="up2"><enum>(A)</enum><text>Not later than 60 days after receiving recommendations submitted under subsection (b)(5) with respect to an article, the President shall—</text>
 <clause id="H1D2B331A82294B1D9895F05A8A6F2EC5"><enum>(i)</enum><text>decide whether to take action based on such recommendations; and</text> </clause><clause id="H9471B413288E43F78AEA691EB3803527"><enum>(ii)</enum><text>if the President decides to take action under clause (i), determine the nature and duration of the action to be taken to adjust the imports of the article and its derivatives so that such imports will not threaten to impair the national security.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="HA8EBA5B7FF1742128DE277A8A3B104D0"><enum>(3)</enum><text>in subsection (d)—</text> <subparagraph id="HAD944C50287D4CB29E868501F5A75EAF"><enum>(A)</enum><text>by striking <quote>the Secretary and the President</quote> each place it appears and inserting <quote>the Secretary of Defense, the Secretary of Commerce, and the President</quote>; and</text>
 </subparagraph><subparagraph id="HF6F885A7407541A087B7FD3DFE28AD41"><enum>(B)</enum><text>by inserting <quote>, the production of which is needed for national defense requirements and critical infrastructure in the United States</quote> after <quote>welfare of individual domestic industries</quote>;</text>
 </subparagraph></paragraph><paragraph id="HDDBA9BC17C90426BBFFDEAD1F75AB4D0"><enum>(4)</enum><text>by redesignating the second subsection (d) as subsection (e); and</text> </paragraph><paragraph id="H4DF770E8C1B34A4E943C86520679F2D5"><enum>(5)</enum><text>in subsection (e)(1), as so redesignated by paragraph (3), by striking <quote>Secretary</quote> and inserting <quote>Secretary of Defense</quote>.</text>
				</paragraph></subsection><subsection id="HD28FE2B09E55418899E456205FBCCD89"><enum>(b)</enum><header>Effective date</header>
 <paragraph id="H12BD1B7EA8594BB98E7167240DA4E2A4"><enum>(1)</enum><header>Suspension of enforcement of prior ongoing actions</header><text>No action taken pursuant to such section 232 (as in effect before the date of the enactment of this Act) during the 2-year period ending on the day before the date of the enactment of this Act may be enforced until the date of the enactment of a joint resolution of approval described in paragraph (2).</text>
 </paragraph><paragraph id="H96931458625D482BA1B8AF39EB1CA9D0"><enum>(2)</enum><header>Procedures to enforce prior ongoing actions</header><text display-inline="yes-display-inline">A joint resolution described in this paragraph is a resolution the matter after the resolving clause of which is as follows: <quote>That the Congress approves the action relating to ____ under section 232 of the Trade Act of 1962 as in effect on _____.</quote>, the blank spaces being filled with, respectively, a description of the action to be approved and the appropriate date. The provisions of section 152 of the Trade Act of 1974 shall apply with respect to the consideration of such joint resolution.</text>
				</paragraph></subsection></section></legis-body></bill>
