			 qualified broadband property to expand the level of broadband service in a
			 qualified rural census tract.</official-title></form>
	<legis-body id="H8A9C251209AC41159A3223E47AE3C0C0" style="OLC">
 <section id="H8E7F20A393664EE69C1D52B3757A9D86" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Broadband Connectivity Act of 2018</short-title></quote>.</text> </section><section id="H071A6203C14D47F3BE591436419F1647"><enum>2.</enum><header>Rural Broadband Tax Credit</header> <subsection id="H3C187EDCB8444A2FB3C9C3745F2F93D9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Internal Revenue Code of 1986 is amended by inserting after subsection 48D the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H6AA84C0FB64448DFAEDB998A5279C15F" style="OLC">
					<section id="H88A7DC6851C94AB694196F5039C98920"><enum>48E</enum><header>Rural Broadband Credit</header>
 <subsection display-inline="no-display-inline" id="H8D276EFDCFAD4A508A87F4A3C43F5870"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For the purposes of section 38, the rural broadband credit for any taxable year is an amount equal to 30 percent of the basis of qualified broadband property placed in service by the taxpayer during such taxable year.</text>
						</subsection><subsection display-inline="no-display-inline" id="H99E8E0F0DD884D188C1DDEBEFCB84ACC"><enum>(b)</enum><header>Cap on credit amount</header>
 <paragraph id="H09E6B3897AFE40A988994D2B010B5461"><enum>(1)</enum><header>In general</header><text>The amount of the credit allowable to a taxpayer under subsection (a) for any property for a taxable year shall not exceed an amount equal to the product of—</text>
 <subparagraph id="HF4E6CE536AEB424EB45004F3424EA8E8"><enum>(A)</enum><text>the value of the number of qualified potential customers served by the qualifying broadband project for which such property is necessary, multiplied by</text>
 </subparagraph><subparagraph id="HAE4456947D9C4B588A0F3EF1C9C9825E"><enum>(B)</enum><text>$170.</text> </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H09A12C03A65649CEB82664E92C461823"><enum>(2)</enum><header>Qualified potential customer</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>qualified potential customer</quote> means, with respect to a taxpayer, an individual—</text>
 <subparagraph id="H7F695B5345C44D6F946B94C484BA2931"><enum>(A)</enum><text display-inline="yes-display-inline">who resides in a qualified rural census tract, and</text> </subparagraph><subparagraph id="HCFE9B8D61DCA4FAD94E14E4C3A1A8D1F"><enum>(B)</enum><text display-inline="yes-display-inline">whom such taxpayer demonstrates to the satisfaction of the Secretary would upon request be provided broadband service by the taxpayer for a customary charge for commencing broadband service of no more than $1,000.</text>
 </subparagraph></paragraph></subsection><subsection id="HB08154D9500543A7B0299D71B98C86C8"><enum>(c)</enum><header>Qualified broadband property</header><text display-inline="yes-display-inline">For the purposes of this section—</text> <paragraph id="HC84B5153B2A24B85B52680C7E673934E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>qualified broadband property</quote> means property necessary for a qualifying broadband project.</text>
 </paragraph><paragraph id="HE35C996AFDA445A7B948D692C3518E08"><enum>(2)</enum><header>Qualifying broadband project</header><text>The term <quote>qualifying broadband project</quote> means any project designed to expand the number of individuals with broadband service in a qualified rural census tract.</text>
 </paragraph><paragraph id="H202C7C47433C4928B78A079FEE875888"><enum>(3)</enum><header>Broadband service</header><text display-inline="yes-display-inline">The term <quote>broadband service</quote> means broadband service (as defined in section 601(b) of the Rural Electrification Act of 1936) that meets the minimum acceptable level for such service (as established by the Secretary of Agriculture pursuant to section 601(e) of the Rural Electrification Act of 1936).</text>
 </paragraph><paragraph id="HF9BA991CCA5A4B4B984DD01746685640"><enum>(4)</enum><header>Qualified rural census tract</header><text display-inline="yes-display-inline">The term <quote>qualified rural census tract</quote> means a census tract designated not later than December 31, 2018, by the Secretary (in consultation with the Chairman of the Federal Communications Commission, the Assistant Secretary of Commerce for Communications and Information who is head of the National Telecommunications and Information Administration, and the Secretary of Agriculture) as—</text>
 <subparagraph id="H55186F828BE74176B2468185BE6AE70A"><enum>(A)</enum><text>being rural, and</text> </subparagraph><subparagraph commented="no" id="H2C6C7B430E56490F9CEF61299A20EFC7"><enum>(B)</enum><text>having less than 50 percent of residents with access to broadband service.</text>
 </subparagraph></paragraph></subsection><subsection id="H80BFBFA204F3430795F04BEC6D4A4589"><enum>(d)</enum><header>Carryover of certain amounts</header><text display-inline="yes-display-inline">If, for the taxable year, the amount which (but for subsection (b)) would have been taken into account under subsection (a) exceeds the limitation of subsection (b), then the amount of such excess shall be taken into account under subsection (a) for the succeeding taxable year.</text>
 </subsection><subsection id="H1CE15D1D859746FA86C5CB816A9D42C3"><enum>(e)</enum><header>Termination</header><text>This section shall not apply to property placed in service after December 31, 2028.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H0FBEE2CB112A4FDABF7B2682AA5EFB7C"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 46 is amended by striking <quote>and</quote> at the end of paragraph (5), by striking the period at the end of paragraph (6) and inserting <quote>, and</quote>, and by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H8EA80CA88F2F473BB49F1A9F94C49F13" style="OLC">
 <paragraph id="H8AA0996BC1674F3ABF76D99E8A992C6E"><enum>(7)</enum><text display-inline="yes-display-inline">the rural broadband credit.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HA9A4D38896FB43EE8705FC9E84BC7928"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subpart E of part IV of subchapter A of chapter 1 is amended by adding at the end the following new item:</text>

 </subsection><subsection id="H66964913A56B4895934E1507C9A2E09E"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property placed in service after December 31, 2018.</text>
