			 Nissitissit Rivers as components of the Wild and Scenic Rivers System, and
			 for other purposes.</official-title></form>
	<legis-body id="H53FF7AA99AA6408E8F868EEDD02FDB9A" style="OLC">
 <section id="HE2C19F57F6024DDB9289045A292E72F6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nashua River Wild and Scenic River Act of 2018</short-title></quote>.</text> </section><section id="HC10C0E12931647EFBE7B20E73F004ADC" section-type="subsequent-section"><enum>2.</enum><header>Nashua wild and scenic rivers, Massachusetts and New Hampshire</header> <subsection id="H258C084FAF1E4B718546AB71C8FAA278"><enum>(a)</enum><header>Designation of wild and scenic river segments</header><text display-inline="yes-display-inline">Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by inserting after paragraph (212) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H05A5EAA351A44B0898EE4F3069E97D02" style="OLC">
					<paragraph id="HF644A837B2144707AFFB95C0E4491D39"><enum>(213)</enum><header>Nashua, Squannacook, and Nis­si­tis­sit wild and scenic rivers, Massachusetts and New Hampshire</header>
 <subparagraph id="H985626ED73EB4E119177F98B2B838F5F"><enum>(A)</enum><text>The following segments in the Commonwealth of Massachusetts and State of New Hampshire, to be administered by the Secretary of the Interior as a scenic river:</text>
 <clause id="HF15BF799B643400783A479E9846EAE3E"><enum>(i)</enum><text display-inline="yes-display-inline">The approximately 27-mile segment of the mainstem of the Nashua River from the confluence of the North and South Nashua Rivers in Lancaster, Massachusetts, and extending north to the Massachusetts-New Hampshire border, except as provided in subparagraph (B).</text>
 </clause><clause id="H7C308F576A264C27B6D0B3F22A5F9BA5"><enum>(ii)</enum><text display-inline="yes-display-inline">The approximately 16.3-mile segment of the Squannacook River from its headwaters in Ash Swamp, Townsend, Massachusetts, extending downstream to the confluence of the river with the Nashua River in Shirley/Ayer, Massachusetts, except as provided in subparagraph (B).</text>
 </clause><clause id="H50FC4CDD75D1416D877A77262B287F6D"><enum>(iii)</enum><text display-inline="yes-display-inline">The approximately 9.5-mile segment of the Nissitissit River from its headwaters in Brookline, New Hampshire, to the confluence of the river with the Nashua River in Pepperell, Massachusetts.</text>
 </clause></subparagraph><subparagraph id="H86E0CFFA109348FCA402938735F3186B"><enum>(B)</enum><header>Exclusion areas</header><text>The designation of the river segments in subparagraph (A) shall exclude—</text> <clause id="H0AF08C4052184FACA67C4B8558EFAC25"><enum>(i)</enum><text>with respect to the Ice House hydroelectric project (FERC P–12769), from 700 feet upstream from the crest of the dam to 500 feet downstream from the crest of the dam;</text>
 </clause><clause id="HE614A091A17D4B8BAEBB7200204C7E3B"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to the Pepperell hydroelectric project (FERC P12721), from 9,240 feet upstream from the crest of the dam to 1,000 feet downstream from the crest of the dam; and</text>
 </clause><clause id="H95605C356E434F96AC492F7790CFF2DA"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to the Hollingsworth and Vose dam (non-FERC), from 1,200 feet upstream from the crest of the dam to 2,665 feet downstream from the crest of the dam.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4341ECBBF5794798BFCA6D36467384A8"><enum>(b)</enum><header>Management</header>
				<paragraph id="H3BF6D2807BFD49C1AB3BC21F5F992069"><enum>(1)</enum><header>Process</header>
 <subparagraph id="HD8A249F7A5DA4E85AF9B25FE8713AE54"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The river segments designated by section 3(a)(213) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) shall be managed in accordance with—</text>
 <clause id="HBD6842F47ED64142A783C893F2A25D38"><enum>(i)</enum><text display-inline="yes-display-inline">the Nashua, Squannacook, and Nissitissit Rivers Stewardship Plan developed pursuant to the study described in section 5(b)(21) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1276">16 U.S.C. 1276(b)(21)</external-xref>) (referred to in this subsection as the <quote>management plan</quote>), dated February 15, 2018; and</text>
 </clause><clause id="HFCE8B31522504E02AE64172FF186EB43"><enum>(ii)</enum><text display-inline="yes-display-inline">such amendments to the management plan as the Secretary of the Interior determines are consistent with this section and as are approved by the Nashua, Squannacook, and Nissitissit Rivers Stewardship Council (referred to in this subsection as the <quote>Stewardship Council</quote>).</text>
 </clause></subparagraph><subparagraph display-inline="no-display-inline" id="H7FB6DFE124CE42D3A7361D444D357F92"><enum>(B)</enum><header>Comprehensive Management Plan</header><text display-inline="yes-display-inline">The management plan shall be considered to satisfy the requirements for a comprehensive management plan under section 3(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(d)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="H1F81D31074D544578DAB6A1B4D3AD119"><enum>(2)</enum><header>Committee</header><text display-inline="yes-display-inline">The Secretary of the Interior shall coordinate the management responsibilities of the Secretary of the Interior under this Act with the Stewardship Council, as specified in the management plan.</text>
				</paragraph><paragraph id="HDAB9AFE416234482AD47DC993BA0188E"><enum>(3)</enum><header>Cooperative agreements</header>
 <subparagraph id="H9F420034144E496AB22471B08DDD3E38"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In order to provide for the long-term protection, preservation, and enhancement of the river segments designated by section 3(a)(213) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>), the Secretary of the Interior may enter into cooperative agreements pursuant to sections 10(e) and 11(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/16/1281">16 U.S.C. 1281(e)</external-xref>, 1282(b)(1)) of such Act with—</text>
 <clause id="H9F963C54BA734EF79D45AAE1CADEE7B4"><enum>(i)</enum><text display-inline="yes-display-inline">the Commonwealth of Massachusetts and the State of New Hampshire;</text> </clause><clause id="H06D39E6FC0FC431ABCDAF82694C3722F"><enum>(ii)</enum><text>the municipalities of—</text>
 <subclause id="H823D0214672F45A7A75A5044DAF60604"><enum>(I)</enum><text>Ayer, Bolton, Dunstable, Groton, Harvard, Lancaster, Pep­per­ell, Shirley, and Townsend in Massachusetts; and</text>
 </subclause><subclause id="HBE8F2B582509416CB872D395B68DEE2C"><enum>(II)</enum><text>Brookline and Hollis in New Hampshire; and</text> </subclause></clause><clause id="H4BA1ADD390DC4B7981442E40F12DE081"><enum>(iii)</enum><text>appropriate local, regional, State, or multistate, planning, environmental, or recreational organizations.</text>
 </clause></subparagraph><subparagraph id="HFF1A01FFE634461EB3C2D0BB746C78B5"><enum>(B)</enum><header>Consistency</header><text display-inline="yes-display-inline">Each cooperative agreement entered into under this paragraph shall be consistent with the management plan and may include provisions for financial or other assistance from the United States.</text>
					</subparagraph></paragraph><paragraph id="H1C0DE737CDD943CAAE29EDE36416AF5D"><enum>(4)</enum><header>Effect on working dams</header>
 <subparagraph id="HB600E5D2DB3B43D4AB628977AD1E7A1B"><enum>(A)</enum><header>In general</header><text>The designation of the river segments by section 3(a)(213) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>), does not—</text>
 <clause id="HE2F01CA6A4C74763A91D03A887425873"><enum>(i)</enum><text display-inline="yes-display-inline">impact or alter the existing terms of permitting, licensing, or operation of—</text> <subclause id="HFEA78AD1918D46F991F4EFA2E3675CC5"><enum>(I)</enum><text>the Pepperell hydroelectric project (FERC Project P–12721, Nashua River, Pepperell, MA);</text>
 </subclause><subclause id="HF5405539699A41ADBEFC412567E43690"><enum>(II)</enum><text>the Ice House hydroelectric project (FERC Project P–12769, Nashua River, Ayer, MA); or</text> </subclause><subclause id="H4731923464FF4B3D80B7F2B8E332B3E3"><enum>(III)</enum><text>the Hollingsworth and Vose Dam (non-FERC industrial facility, Squannacook River, West Groton, MA) as further described in the management plan (Appendix A, <term>Working Dams</term>); or</text>
 </subclause></clause><clause id="HD89875C3796947C7A0A5825FFDED84A3"><enum>(ii)</enum><text>preclude the Federal Energy Regulatory Commission from licensing, relicensing, or otherwise authorizing the operation or continued operation of the Pepperell and Ice House hydroelectric projects under the terms of licenses or exemptions in effect on the date of enactment of this Act; or</text>
 </clause><clause id="HF47E12CF3571480B9D1865884CE8F600"><enum>(iii)</enum><text display-inline="yes-display-inline">limit actions taken to modernize, upgrade, or carry out other changes to such projects authorized pursuant to clause (i), subject to written determination by the Secretary of the Interior that the changes are consistent with the purposes of the designation.</text>
						</clause></subparagraph></paragraph><paragraph id="H3ACFD3AC988442058D3A69609686BE27"><enum>(5)</enum><header>Land management</header>
 <subparagraph id="H4BED69A25F5441F09915818124A1CB10"><enum>(A)</enum><header>Zoning ordinances</header><text display-inline="yes-display-inline">For the purpose of the segments designated by section 3(a)(213) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>), the zoning ordinances adopted by the municipalities named in subsection 3(A)(ii), including provisions for conservation of floodplains, wetlands, and watercourses associated with the segments, shall be deemed to satisfy the standards and requirements of section 6(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1277">16 U.S.C. 1277(c)</external-xref>).</text>
 </subparagraph><subparagraph id="HC0EF42FEB10A4E238620F102D7F3F116"><enum>(B)</enum><header>Acquisitions of lands</header><text display-inline="yes-display-inline">The authority of the Secretary to acquire land for the purposes of the segments designated by section 3(a)(213) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) shall be—</text>
 <clause id="H3C277E38C2BE4B698CCE9D631BCA28A6"><enum>(i)</enum><text>limited to acquisition by donation or acquisition with the consent of the owner of the land; and</text> </clause><clause id="HAB72277450F54B838DE1BCD0B2D817F6"><enum>(ii)</enum><text>subject to the additional criteria set forth in the management plan.</text>
 </clause></subparagraph><subparagraph id="H88821DDF60114E6D87AE43539CB39EC5"><enum>(C)</enum><header>No condemnation</header><text display-inline="yes-display-inline">No land or interest in land within the boundary of the river segments designated by section 3(a)(213) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) may be acquired by condemnation.</text>
 </subparagraph></paragraph><paragraph id="H2E7269E42DA64726A034093A648A3E70"><enum>(6)</enum><header>Relation to the National Park System</header><text display-inline="yes-display-inline">Notwithstanding section 10(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1281">16 U.S.C. 1281(c)</external-xref>), each segment of the Nashua, Squannacook, and Nissitissit Rivers designated as a component of the Wild and Scenic Rivers System under this Act shall not—</text>
 <subparagraph id="H2447BC4B00BA4351AB05636C5C24BA31"><enum>(A)</enum><text>be administered as a unit of the National Park System; or</text> </subparagraph><subparagraph id="HE0A9F993684446248BFC28952F372814"><enum>(B)</enum><text>be subject to regulations that govern the National Park System.</text>
					</subparagraph></paragraph></subsection></section></legis-body></bill>
