			 infringement, and for other purposes.</official-title></form>
	<legis-body id="HC90B60121C614D73924BBC28F7F50963" style="OLC">
 <section id="H9C547018774146D5B7B1431E5FC4EA94" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family Movie Act Clarification Act of 2018</short-title></quote>.</text> </section><section id="H087108168286410580163DE31C3364E6" section-type="subsequent-section"><enum>2.</enum><header>Amendments to the exemption of certain performances</header> <subsection id="H4C4029F522D04CA090E7D33754520D19"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 110 of title 17, United States Code, is amended—</text>
 <paragraph id="H8FAD1203B9984865962EE114FE03C6A3"><enum>(1)</enum><text>in paragraph (10), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph id="H4E8576D276C6423DB4FF4303BCA4FFDA"><enum>(2)</enum><text>in paragraph (11), by striking the period at the end and inserting <quote>; and</quote>;</text>
 </paragraph><paragraph id="H87423732B33C4FB19573B942C036E045"><enum>(3)</enum><text>by inserting after paragraph (11) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="HB5A1D34DF43446CCA3529A2F1430EAF6" style="OLC"> <paragraph id="HACBDF252F9CC4CABBC736CFB6E095EFA"><enum>(12)</enum><text display-inline="yes-display-inline">the making imperceptible by or at the direction of an individual, acting in a personal capacity, of limited portions of audio or video content of a motion picture, during a performance transmitted to that individual for private viewing, directly or indirectly from an authorized copy or digital transmission of the motion picture, or the provision of a service that enables such making imperceptible, if no fixed copy of the altered version of the motion picture is created.</text>
						</paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="H6DE69A4523C64B62B9D31E2182F9853E"><enum>(4)</enum><text>by striking <quote>For purposes of paragraph (11)</quote> and inserting <quote>For purposes of paragraph (11) and (12)</quote>; and</text> </paragraph><paragraph id="HE39812573C1E491E8B006534A6A0D3BB"><enum>(5)</enum><text>by adding at the end, the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE045565FC0F34264B9D1876A863C3CF3" style="OLC">
 <paragraph id="id9F5A382D05874689BDF20516042D5D03"><enum></enum><text>For purposes of paragraph (12)—</text><subparagraph id="id6E95488CC93D41AA9610B0D611959C10"><enum>(A)</enum><text>no person asserting the rights of a motion picture copyright owner may prevent or impede by contract the provision of a service as described in such paragraph;</text></subparagraph><subparagraph id="idF2AA20DE6F1E4825801A404C56781003"><enum>(B)</enum><text>no person providing an authorized digital transmission of a motion picture to any individual may modify technical aspects of its transmission service for the purpose of preventing such individual from receiving a transmission as authorized by such paragraph; and</text></subparagraph><subparagraph id="id1188D28BB6E645F19476CD4BB5F218A0"><enum>(C)</enum><text>neither the circumvention of access controls for the purpose of providing a service described in such paragraph nor the use of technology that allows such service to be provided at a cost and quality comparable to that of the authorized stream under such paragraph violates any provision of this title if there is no demonstrated and avoidable economic injury to the copyright owner or the authorized digital transmission provider.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H648E41B573974A10A10C78A35402D5B4"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 32(3) of the Act entitled <quote>An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes</quote>, approved July 5, 1946 (<external-xref legal-doc="usc" parsable-cite="usc/15/1114">15 U.S.C. 1114(3)</external-xref>), commonly referred to as the <quote>Trademark Act of 1946</quote> or the <quote>Lanham Act</quote>, is amended by inserting <quote>or (12)</quote> after <quote>paragraph (11)</quote> each place it appears.</text>
			</subsection></section></legis-body></bill>
