 <subsection id="HD6855B9690EE4EE99AA6252B6158D2FA"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Coal Royalty Fairness and Communities Investment Act of 2018</short-title></quote>.</text> </subsection><subsection id="H0F4386A3E2B34AC595FB1F65C59E9C60"><enum>(b)</enum><header>Table of contents</header><text>The table of contents of this Act is as follows:</text>

			</subsection></section><title id="H36CF6F033FA6422FAFB6A1FED0C003EB" style="OLC"><enum>I</enum><header>Valuation of Federal Coal for Purposes of Royalties</header>
 <section id="HB50C9A2DB170461681CA93D76A114395" section-type="subsequent-section"><enum>101.</enum><header>Valuation of coal royalties</header><text display-inline="no-display-inline">Section 7 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/207">30 U.S.C. 207</external-xref>) is amended—</text> <paragraph id="HD03F524280A944A19D05B43DBBBAAE87"><enum>(1)</enum><text>in subsection (a), by striking the fourth sentence; and</text>
 </paragraph><paragraph id="HC4B0F7B90BC4441EA3A722350CD86A54"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H7677962276804FC987E747438EB47661" style="OLC"> <subsection id="HA078858B565340B0ADC89518CEE3ED31"><enum>(d)</enum><header>Royalties</header> <paragraph id="HAC7B8F0A5E124311807073704BC87FEE"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
								<subparagraph id="H9693246E131249238F22830AF763CE42"><enum>(A)</enum><header>Assessment value</header>
 <clause id="H69D583B516E44E5798FDB122E20334DE"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>assessment value</term>, with respect to Federal coal, means the gross proceeds accruing to the lessee or the affiliate of the lessee’s first arm’s length contract for the sale of Federal coal.</text>
 </clause><clause commented="no" id="HF92B4BA1331742EEB91337D382A73BA1"><enum>(ii)</enum><header>Exception</header><text display-inline="yes-display-inline">If the Secretary cannot identify any arm’s length contract for the sale of Federal coal, then the assessment value means a price imputed by the Secretary based on the coal price index.</text>
 </clause></subparagraph><subparagraph id="HB0E8BDB407E84411A10795765AE60B1D"><enum>(B)</enum><header>Arm’s length contract</header><text display-inline="yes-display-inline">The term <term>arm’s length contract</term> means a contract, agreement, or transaction for the sale of Federal coal that is between parties that are independent of each other and that are not affiliates.</text>
 </subparagraph><subparagraph id="HE35C7D543489473CAA3829016EAE7D08"><enum>(C)</enum><header>Affiliate</header><text>The term <term>affiliate</term>, with respect to a lessee, means a party that controls, is controlled by, or is under common control with the lessee, and includes a parent or subsidiary company.</text>
 </subparagraph><subparagraph id="HC20DA4B94EDB437EBCDA8548E78FDF12"><enum>(D)</enum><header>Coal price index</header><text display-inline="yes-display-inline">The term <term>coal price index</term> means the schedule of average market prices of Federal coal (in United States dollars) at final sale, based on the quality and type of the Federal coal, as determined by the Secretary, in consultation with the Administrator of the Energy Information Administration.</text>
 </subparagraph><subparagraph id="HC04CB07BE81448E9A9A0B0A72901E22B"><enum>(E)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </subparagraph></paragraph><paragraph id="H532BC564C90344CA80DB80A13DC2E1CC"><enum>(2)</enum><header>Payment rate</header> <subparagraph id="H97FD03C2607540DE8069A9F422E99DDB"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a lease shall require payment of a royalty in such amount as the Secretary shall determine, which shall not be less than 12.5 percent of the assessment value of Federal coal.</text>
 </subparagraph><subparagraph id="H3A24A0EE8D74403A8DB1860E1785B762"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">In the case of Federal coal recovered by an underground mining operation, the Secretary may establish such lower royalty payment rate as the Secretary determines to be appropriate in lieu of the royalty payment rate described in subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="H49C7634D8AF04FB9A1EC87E24E9A90EC"><enum>(3)</enum><header>Administration</header>
 <subparagraph id="HD31867A3B2E04DD49CF98008FB153966"><enum>(A)</enum><header>Reporting</header><text display-inline="yes-display-inline">The Secretary shall ensure that any purchaser of Federal coal shall annually submit to the Secretary a report containing such information as the Secretary determines to be necessary to carry out this subsection.</text>
 </subparagraph><subparagraph id="H6AD1B8E92F7B458BA61DA3B9B08342A0"><enum>(B)</enum><header>Audits</header><text>To carry out this subsection, the Secretary may examine the records of any person engaged in the purchase, sale, transportation, or marketing of Federal coal.</text>
								</subparagraph></paragraph><paragraph id="HFC62670412F04143B2119EFA14DF4721"><enum>(4)</enum><header>Coal price index</header>
 <subparagraph id="HEA029E7B9AB74BA08CCEB232F1030F03"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall compile in a coal price index the assessment values of coal by type and quality of coal.</text>
 </subparagraph><subparagraph id="H36F15A22E0954D4F9483E9019E7EFF05"><enum>(B)</enum><header>Publication</header><text>Not less frequently than quarterly, the Secretary shall publish in the Federal Register and on a public website the coal price index, along with a methodological description, including—</text>
 <clause id="H9BA3013D7E3547428D7EAB2D66FCB7DF"><enum>(i)</enum><text>the method of calculation;</text> </clause><clause id="HCA8F5D0B8956462199F771D951E7F33D"><enum>(ii)</enum><text>the data used to calculate the coal price index in an aggregate manner that does not reveal proprietary information; and</text>
 </clause><clause id="H5D79EDC7B5714D079B496558D88C1542"><enum>(iii)</enum><text>any other information the Secretary considers appropriate to ensure transparency.</text> </clause></subparagraph><subparagraph id="H9B961CB50AB943A783168A6A7EEB9BB6"><enum>(C)</enum><header>Other information</header><text display-inline="yes-display-inline">If a person believes that the coal price index does not accurately reflect the assessment value of the coal produced by the person, the person may petition the Secretary to use information supplied by the person in lieu of the coal price index for the purpose of determining the assessment value of the coal produced by such person, including all information the Secretary requires to accurately determine the assessment value and audit the records of the person.</text>
								</subparagraph></paragraph><paragraph id="H16A78B74BDA34741B00B58552FEE7904"><enum>(5)</enum><header>Reviews</header>
 <subparagraph id="HF05CE4CB48AE457AB8D9993E32E75C53"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To ensure a transparent, fair, and efficient administration of the Federal coal program, and to ensure that citizens of the United States receive a fair return on Federal coal, not later than 3 years after the date of the enactment of this subsection and every 3 years thereafter during the 15-year period beginning on such date, the Comptroller General of the United States shall submit to Congress a report containing the results of a review conducted by the Comptroller General of the Federal coal program, including the administration of this subsection.</text>
 </subparagraph><subparagraph id="H8D6DE0698E444664996C728FE69DE421"><enum>(B)</enum><header>Consultation</header><text>In conducting a review under this paragraph, the Comptroller General shall consult with—</text> <clause id="H73A8F8040EDE48898547158771CE452A"><enum>(i)</enum><text>the Secretary;</text>
 </clause><clause id="H260F8BEECC164F519018CDA86F0139C8"><enum>(ii)</enum><text>the Director of the Bureau of Land Management;</text> </clause><clause id="H529F5B2D3F4D487AB7B1EB0194F406F4"><enum>(iii)</enum><text>the Secretary of Transportation; and</text>
 </clause><clause id="H55016CA0FF994CADB57FFA1FF02E6613"><enum>(iv)</enum><text>the Secretary of Energy.</text> </clause></subparagraph><subparagraph id="HDE7A84E8A3D140EFB143CD00B9214CD3"><enum>(C)</enum><header>Inclusions</header><text>In conducting a review under this paragraph, the Comptroller General shall review—</text>
 <clause id="HAE0310B739A74E0D831B54BB90C4AF65"><enum>(i)</enum><text>the total volume of coal production from Federal land;</text> </clause><clause id="H84058A75ED0849CBBCE9B6B11A9BD767"><enum>(ii)</enum><text>the total volume of remaining coal reserves on Federal land;</text>
 </clause><clause id="H0C058FD00A2C46438AE8E6530FA801B7"><enum>(iii)</enum><text>the total amount of revenues generated from the Federal coal program, itemized by type of revenue, including lease bonus payments and royalties;</text>
 </clause><clause id="H45ADDCE4D1C14C738211994453CD94F0"><enum>(iv)</enum><text>market prices for coal;</text> </clause><clause id="HD95FF2A58C1442688874068B7F76F455"><enum>(v)</enum><text>market prices for transportation costs and any other deductible costs; and</text>
 </clause><clause id="HE49A95BA128C4936850CF30833860C03"><enum>(vi)</enum><text>the appropriateness of royalty rates.</text> </clause></subparagraph><subparagraph id="H40F324F1B3A0469E9B2932CA95645AD7"><enum>(D)</enum><header>Format</header><text>The Comptroller General shall report information in a review under this paragraph—</text>
 <clause id="H5CD12D85A32C46BDA05B7514685975A0"><enum>(i)</enum><text>in the aggregate for the United States; and</text> </clause><clause id="H4C29F990434B4DBAB878333A3A36694D"><enum>(ii)</enum><text>categorized by State for at least the top 10 Federal coal-producing States, as determined by the Comptroller General.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="H1ABAEC4D45FE4FA7A579BE8F1B346D7B"><enum>(6)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary shall seek to enter into an agreement with the National Academy of Sciences to conduct a study to determine the most equitable method for valuation of coal produced on Federal lands for purposes of Federal coal leases. Not later than 18 months after the date of the enactment of this subsection, and every five years thereafter, the Secretary shall submit to Congress a report containing the findings, of such study.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H892E3E7E210E40E8A3DCADAE5DF2675B"><enum>II</enum><header>Programs To Reinvest in Coal-Impacted Com­mu­nities</header>
			<section id="HE932C821C03A474795719BA815B4C06E"><enum>201.</enum><header>Establishment of Fund</header>
 <subsection id="H70FE755731234107B1609250637D5E91"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a separate account, to be administered by the Secretary (acting through the Economic Development Administration), to be known as the <quote>Coal Area Economic Revitalization Fund</quote>.</text>
 </subsection><subsection id="H03FDDAD7648A4D9483D2DBE2F1F58A7B"><enum>(b)</enum><header>Deposits</header><text display-inline="yes-display-inline">Of the amount of royalty revenues collected by the United States for each fiscal year from coal leases under section 7 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/207">30 U.S.C. 207</external-xref>) (as amended by section 101(2)), to the extent the revenues are available, there shall be deposited in the Coal Area Economic Revitalization Fund $75,000,000.</text>
				</subsection><subsection id="HB77CCB9FDF1D46549757EFD4C3EFA0E1"><enum>(c)</enum><header>Availability of amounts</header>
 <paragraph id="H3B7E815AE370485FA1DD2DCD9BBABF00"><enum>(1)</enum><header>In general</header><text>Subject to subsection (d) and notwithstanding any other provision of law, for each fiscal year, of the amounts deposited in the Coal Area Economic Revitalization Fund under subsection (b), there shall be made available, without further appropriation, the following amounts:</text>
 <subparagraph id="H3707572769C840C6AE7622C496699830"><enum>(A)</enum><text>$70,000,000 to the Secretary to provide grant assistance under covered programs for eligible projects, in accordance with section 202.</text>
 </subparagraph><subparagraph id="H25A46D6A35EC4672A325B2E14FD5DF1A"><enum>(B)</enum><text>$5,000,000 to the Secretary of Energy to provide funding for large-scale projects to capture and store carbon dioxide emissions from industrial sources, in accordance with section 203.</text>
 </subparagraph></paragraph><paragraph id="H6FC1BF2F29D34879B20398F04B7F477E"><enum>(2)</enum><header>Special rule</header><text display-inline="yes-display-inline">If, with respect to a fiscal year, the amounts in the Coal Area Economic Revitalization Fund are insufficient to carry out paragraph (1), there shall be made available, without further appropriation, the following:</text>
 <subparagraph id="H5A7200E9651842B888E017D6A01060CD"><enum>(A)</enum><text display-inline="yes-display-inline">To the Secretary for the purposes described in paragraph (1)(A), 93.333 percent of the amounts available in the Fund.</text>
 </subparagraph><subparagraph id="H23A24FF6EAD0405DAABB7917F7E9F0F5"><enum>(B)</enum><text display-inline="yes-display-inline">To the Secretary of Energy for the purposes described in paragraph (1)(B), 6.666 percent of the amounts available in the fund.</text>
 </subparagraph></paragraph></subsection><subsection id="H87E7642DA9F343898617D84C412A397C"><enum>(d)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">A participating agency that receives funds under subsection (c) may not use not more than 2 percent of the amount the agency receives for each fiscal year to cover the administrative expenses of the participating agency in carrying out the covered program.</text>
 </subsection><subsection id="HEADAFD22502044F7A11339FDBDA0EEE2"><enum>(e)</enum><header>Period of availability</header><text display-inline="yes-display-inline">The amounts deposited in the Coal Area Economic Revitalization Fund shall remain available without fiscal year limitation until expended.</text>
				</subsection></section><section id="H7ABEE130F3B44E6B8077BCB5D10DD98D"><enum>202.</enum><header>Federal economic and workforce development assistance programs</header>
 <subsection id="H891E8DEDDB1F443C8A6962C02F865FBD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Economic Development Administration, shall use the amounts made available under section 201(c)(1) to provide grant assistance under covered programs described in subsection (c) for eligible projects described in subsection (d).</text>
				</subsection><subsection id="H9D35DFA036884E5F9C4E57FC70409486"><enum>(b)</enum><header>Allocation of funds for covered programs</header>
 <paragraph id="HC1A894C725B44792A1A5BC8D5CBE3471"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text> <subparagraph id="HAB9FD9E838DC4FDCB851843CBF2819A5"><enum>(A)</enum><text>allocate amounts made available to carry out this section among the covered programs in accordance with the criteria described in paragraph (2); and</text>
 </subparagraph><subparagraph id="H8B3AC47F18DB4A758BB859F212D643B4"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 30 days after allocations are determined under subparagraph (A), provide public notice of the availability of grant assistance under this section through a Federal Funding Opportunity announcement.</text>
 </subparagraph></paragraph><paragraph id="HBDED1A25762747CBB962EFC208617924"><enum>(2)</enum><header>Allocation criteria</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary shall establish and publish criteria for the allocation of amounts made available to carry out this section among the covered programs.</text>
					</paragraph></subsection><subsection id="HAFE037EE31534B758974406827F64A12"><enum>(c)</enum><header>Covered programs</header>
 <paragraph id="H36056ED4627D4DF1A71EAEEC02205F41"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On allocation by the Secretary of amounts from the Coal Area Economic Revitalization Fund for a covered program under this section, the head of the applicable participating agency shall manage grant selection (including eligibility requirements in addition to the eligibility requirements listed in subsection (d)), awards, and execution of projects with respect to such amounts.</text>
 </paragraph><paragraph id="HCDB27600447049D098377D5B69DC4F2A"><enum>(2)</enum><header>Terms and conditions</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, projects that receive grant assistance under this section shall be subject to the eligibility rules, permitted activities, and reporting requirements of the covered program under which the grant is made.</text>
					</paragraph></subsection><subsection id="HC64B9F0D500F482091FDF88504E7E8E0"><enum>(d)</enum><header>Eligible projects</header>
 <paragraph id="H32CC7A79D36040EEBDB6F3454A78654D"><enum>(1)</enum><header>Project purposes</header><text display-inline="yes-display-inline">A project shall be eligible for assistance under this section if the purpose of the project is to assist impacted communities—</text>
 <subparagraph id="HA14A8776D8E94D71ACDA6BE5E3E697FA"><enum>(A)</enum><text display-inline="yes-display-inline">to organize community stakeholders, analyze and inventory community assets, evaluate needs and resources, or develop comprehensive economic development strategic plans;</text>
 </subparagraph><subparagraph id="H87BC7F174F6B41B18178E0A11B0796F4"><enum>(B)</enum><text>to undergo in-depth labor market analysis and workforce development and dislocated worker planning associated with the provision of training and employment services;</text>
 </subparagraph><subparagraph id="H9970CB2B55DD4D94A1062FF2377A9748"><enum>(C)</enum><text>to implement linked economic and workforce development strategies to promote local and regional economic growth;</text>
 </subparagraph><subparagraph id="H8E6F33918FCA430AB89A397A9229DF71"><enum>(D)</enum><text>to accelerate job creation by leveraging local assets;</text> </subparagraph><subparagraph id="H8CC3099D85F541348DEBABF2739DA08A"><enum>(E)</enum><text>to train and place workers in family-supporting, high-demand jobs (including registered apprenticeship and other on-the-job training models);</text>
 </subparagraph><subparagraph id="H2B47C1DF18EF44978F9AA981EAEAE011"><enum>(F)</enum><text display-inline="yes-display-inline">to create linkages between community stakeholders, economic development organization, public and private entities, and the labor force that drive local and regional economic growth; or</text>
 </subparagraph><subparagraph id="HF45F476505224A12A822E6FBA5A05767"><enum>(G)</enum><text>to carry out other purposes approved by the Secretary.</text> </subparagraph></paragraph><paragraph id="H7C1EC0B5A67E42B8A1BFDF87658C8C3B"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting projects to receive assistance under this section, the head of a participating agency shall—</text>
 <subparagraph commented="no" id="HE89CC29B92D442A3BBAC6E9983AC51E4"><enum>(A)</enum><text display-inline="yes-display-inline">give priority to project applications that establish a clear linkage between the proposed project and the means by which the project will result in local and regional economic growth and diversification, job creation, or job training and reemployment for dislocated workers, without regard to any formula used by a participating agency to disburse other funds; and</text>
 </subparagraph><subparagraph id="H417A759D388C43C887847E889AFF5808"><enum>(B)</enum><text>consult directly with impacted communities to determine the greatest needs of the impacted communities and give priority to projects that address those needs.</text>
 </subparagraph></paragraph><paragraph id="H4A8387E9F69D42C4A16CA5678085198C"><enum>(3)</enum><header>Specific activities and costs to be considered</header><text display-inline="yes-display-inline">In providing assistance under this section for projects for economic diversification, the head of a participating agency shall give consideration for priority, at a minimum, to the following activities and costs:</text>
 <subparagraph id="H6D63275F29DB4531B12E564CAD719010"><enum>(A)</enum><text display-inline="yes-display-inline">Analysis activities that build from strategic economic development plans, including—</text> <clause id="HB9BF088267134619A714B94D398E3588"><enum>(i)</enum><text display-inline="yes-display-inline">economic and workforce data collection; and</text>
 </clause><clause id="H4B026EB9FD004A3A9E5182CE6A80494A"><enum>(ii)</enum><text display-inline="yes-display-inline">supply chain and industry cluster analysis.</text> </clause></subparagraph><subparagraph id="H0C9DD8E865A540FC8013C185419ACC35"><enum>(B)</enum><text>Outreach and targeted assistance to economic development organizations, unions, workers, and other stakeholders.</text>
 </subparagraph><subparagraph id="H045B6373613847AD9FA40A2412082426"><enum>(C)</enum><text>Remediation and redevelopment of coal economy sites, as appropriate.</text> </subparagraph><subparagraph id="H7A3EF56FE31E44CD99812C9FCC7ACAA4"><enum>(D)</enum><text>Provision of business planning and market exploration services.</text>
 </subparagraph><subparagraph id="H68998D5C44094E0D8CDAE0AC5DAA0906"><enum>(E)</enum><text>Development of business incubator programs.</text> </subparagraph><subparagraph id="HA0A05205231A4396809CC6BF4E28B8FF"><enum>(F)</enum><text>Facilitation of access to private capital investment and capacity building to effectively use capital investment.</text>
 </subparagraph><subparagraph id="HE8DCFA55EDCF44A2A06CDB7CED7EF73B"><enum>(G)</enum><text>Promotion of exports from entities in the impacted area.</text> </subparagraph><subparagraph id="H0BC31FBD47554420BC26F2484BCC2C2A"><enum>(H)</enum><text>Workforce training and dislocated worker services and supports for impacted workers.</text>
 </subparagraph><subparagraph id="HCB37D4FBB0114701B310E01BA467EE14"><enum>(I)</enum><text>Costs associated with registered apprenticeship and on-the-job training models.</text> </subparagraph><subparagraph id="H37D1BDD666D643F1978DC6E98B1BA8D9"><enum>(J)</enum><text>Temporary or short-term relocation or commuting costs for available jobs in other parts of the applicable State or region.</text>
 </subparagraph><subparagraph id="HEA81912937C34555B32E401D0C6DB926"><enum>(K)</enum><text>Staffing, operating, and administrative costs for the recipient organization.</text> </subparagraph><subparagraph id="H9A423BC681A947378159B2D7EB934741"><enum>(L)</enum><text>Comprehensive strategies that—</text>
 <clause id="H19698B3C09224060AD6EA9453CB2A4B5"><enum>(i)</enum><text>integrate all of the activities and costs described in subparagraphs (A) through (K); and</text> </clause><clause id="HD2D3C90CE8C949EA91FF953E6819370D"><enum>(ii)</enum><text>leverage other investments from the applicable participating agency and other Federal departments and agencies.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="H9D114853117343F5BA5735EB6E73BFC2"><enum>(e)</enum><header>Coordination of activities</header><text>The Secretary shall—</text> <paragraph id="HC13C624BA7C444A89951C09F778E3497"><enum>(1)</enum><text display-inline="yes-display-inline">provide a single staff point of Federal contact (with staffing assistance from other participating agencies, as needed) for grants awarded under this section; and</text>
 </paragraph><paragraph id="H35D96CD1FED54B968A06412E9E0AB52A"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate cross-agency activities at the regional level that direct additional Federal resources to impacted communities.</text>
 </paragraph></subsection></section><section id="H56E195A47C6E462EA5BB143A9AC0C2C7"><enum>203.</enum><header>Carbon capture and sequestration</header><text display-inline="no-display-inline">The Secretary of Energy shall use the amounts made available under section 201(c)(2) to provide financial assistance for the design, construction, and operation of large-scale projects to capture and store carbon dioxide emissions from industrial sources.</text>
			</section><section id="H165C7335AB2D40D894015ACDF2840491"><enum>204.</enum><header>Additional Federal agency participation</header>
 <subsection id="HA9EF0B78C17045F8888D54C6D8FD839D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal departments and agencies described in subsection (b) shall provide to impacted communities technical assistance and educational outreach to fund partnerships, in coordination with available resources.</text>
 </subsection><subsection id="HDCA9B4C57DFB463FB6330FCE5F6E457C"><enum>(b)</enum><header>Description of departments and agencies</header><text>The Federal departments and agencies referred to in subsection (a) are—</text> <paragraph id="HF25C71FC57E1442BA6094B236D143194"><enum>(1)</enum><text>the Rural Business-Cooperative Service of the Department of Agriculture;</text>
 </paragraph><paragraph id="H6048B28F7BC44E2F8BFFFC4373330649"><enum>(2)</enum><text>the Office of Solid Waste and Emergency Response of the Environmental Protection Agency;</text> </paragraph><paragraph id="H513F530793A043B0BED95B50C058E0A4"><enum>(3)</enum><text>the Department of Energy;</text>
 </paragraph><paragraph id="HB528178F33BE46FEA981A1C40D83B23C"><enum>(4)</enum><text>the Community Development Financial Institutions Fund of the Department of the Treasury;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAB6C24F3C6414D40B72C9E842385423E"><enum>(5)</enum><text>SelectUSA and the National Institute of Standards and Technology—Manufacturing Extension Partnerships of the Department of Commerce;</text>
 </paragraph><paragraph id="H0BD0CA2215724EF69B6DC92346A66D0A"><enum>(6)</enum><text>the Corporation for National and Community Service; and</text> </paragraph><paragraph id="H39544DB5D6EE40A79F19BC46B1BA4A50"><enum>(7)</enum><text>the Office of Surface Mining Reclamation and Enforcement of the Department of the Interior.</text>
 </paragraph></subsection></section><section id="H4AF391FE60F1481D91E53A2091482B6C"><enum>205.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H032C2AFD8E28430CBA7B08894A610035"><enum>(1)</enum><header>Coal economy</header><text>The term <term>coal economy</term> means the complete supply chain of coal reliant industries, including coal mining, coal-fired power plants, and related transportation, logistics, and manufacturing.</text>
 </paragraph><paragraph id="H7C7ABA0E6862495CBD93CF7DDA112FBC"><enum>(2)</enum><header>Covered program</header><text>The term <term>covered program</term> means any of the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4574F83722BB4A39A985470CEC0D6C5C"><enum>(A)</enum><text display-inline="yes-display-inline">The Assistance to Coal Communities, Economic Adjustment Assistance, and Partnership Planning program of the Economic Development Administration of the Department of Commerce.</text>
 </subparagraph><subparagraph id="HC0F880DD3F2E478A875DA808C70387B3"><enum>(B)</enum><text display-inline="yes-display-inline">The Dislocated Worker National Emergency Grants program of the Employment and Training Administration of the Department of Labor.</text>
 </subparagraph><subparagraph id="H7843057B74204B5A94A97EFED338C157"><enum>(C)</enum><text display-inline="yes-display-inline">The Regional Innovation Clusters and Growth Accelerators program of the Small Business Administration.</text>
 </subparagraph><subparagraph id="H6AC334B03934412B98CB1BE19C4EFB25"><enum>(D)</enum><text display-inline="yes-display-inline">The Technical Assistance and Demonstration Projects program of the Appalachian Regional Commission.</text> </subparagraph></paragraph><paragraph id="H6ED52A530E1A45B3B947B71726170879"><enum>(3)</enum><header>Impacted community</header><text display-inline="yes-display-inline">The term <term>impacted community</term> means a community or Indian tribe (as such term is defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)) in the United States that has been negatively impacted as a result of changes in the coal economy, including a negative impact on its economy, environment, employment, retirement benefits, infrastructure, public health, or education.</text>
 </paragraph><paragraph id="H5DCB60B7FA8A4A02A33D8E65C8F94DED"><enum>(4)</enum><header>Participating agency</header><text>The term <term>participating agency</term> means a Federal agency that has primary authority over a covered program.</text> </paragraph><paragraph id="H983E0A8EAABB415AA7791F05D674B92D"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text>
