<section id="HAED75646B33844B7ABA7734079DBEA07"><enum>101.</enum><header>Employment authorization for dependents of H–1B nonimmigrants</header><text display-inline="no-display-inline">Section 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>) is amended—</text> <paragraph id="HB99AFD7228D34DD6A39D6F9355D72F2A"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>; and</text></paragraph> 
<paragraph id="H566140B1644E4939B12F38B67794C098"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H8CDABCEE006C4B52A06DD29C05CD71BB" style="OLC"> <subparagraph id="H22A099F660514F2983180D9910670F77" indent="up2"><enum>(G)</enum> <clause commented="no" display-inline="yes-display-inline" id="H5EC261CE04B14EA080A76EB712A6DEBE"><enum>(i)</enum><text>If the principal alien has a pending or approved Application for Permanent Employment Certification or a pending or approved Immigrant Petition, the Secretary of Homeland Security shall—</text> 
<subclause id="H4CA943E22EA64A649FC87FBE05C40186" indent="up1"><enum>(I)</enum><text>authorize the alien spouse of such principal alien admitted under section 101(a)(15)(H)(i)(b) who is accompanying or following to join the principal alien to engage in employment in the United States; and</text></subclause> <subclause id="H247E8950810B4CF38606D8B0FE15E0B4" indent="up1"><enum>(II)</enum><text>provide the spouse with an <quote>employment authorized</quote> endorsement or other appropriate work permit.</text></subclause></clause> 
<clause id="HEC500E3FD6A54898B5F72ED11848D6EB" indent="up1"><enum>(ii)</enum><text>The employer of an alien spouse described in clause (i)(I) shall attest to the Secretary of Homeland Security that the employer is offering and will offer to the alien spouse, during the period of authorized employment, not less than the greater of—</text> <subclause id="HB56BCF260FB64CEFADD2E710B3C0A62D"><enum>(I)</enum><text>the actual wage level paid by the employer for the specific employment in question to all other individuals with similar experiences and qualifications; or</text></subclause> 
<subclause id="H953F28A03C794F958FF322D3E3E26690"><enum>(II)</enum><text>the prevailing wage level for the occupational classification in the area of employment, reflecting the education, experience, and level of supervision required for the job to be performed by the alien spouse, based on the best information available at the time the alien spouse is hired.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H36995CF5F49746A398C5152DA44AC460"><enum>102.</enum><header>Eliminating impediments to worker mobility</header> <subsection id="H83D85FFF9D1D4BD0B6D2B70A411F1A46"><enum>(a)</enum><header>Effect of new job site</header><text>Section 214(c)(10) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(10)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H5B740179AA814E678C34DFB328280B6D" style="OLC"> 
<paragraph id="HE39A692513E94186BEB5BA96D307F1F4" indent="up1"><enum>(10)</enum><text>An amended H–1B petition shall not be required if—</text> <subparagraph id="H79A180729BE9416CB27D1EC4EB4582D3"><enum>(A)</enum><text>the petitioning employer is involved in a corporate restructuring, including a merger, acquisition, or consolidation;</text></subparagraph> 
<subparagraph id="H7A99D2EC21A6451C8A467F799E21761B"><enum>(B)</enum><text>a new corporate entity succeeds to the interests and obligations of the original petitioning employer and the terms and conditions of employment remain the same except for the identity of the petitioner; or</text></subparagraph> <subparagraph id="H493D120336F34605BB31846B9892F9D1"><enum>(C)</enum><text>the nonimmigrant worker begins working at a new place of employment for which the petitioner has secured a valid, certified Labor Condition Application before the nonimmigrant worker began working at such place of employment.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9672B12C8B3C4DFEA22F60105020BA3C"><enum>(b)</enum><header>Deference to prior approvals</header><text>Section 214(c) of such Act, as amended by subsection (a) and section 101, is further amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H786B79BF5DC840829DCE5EA0391FE1D3" style="OLC"> <paragraph id="H2D6B861A5B9C4114973DC67F4468361D" indent="up1"><enum>(15)</enum><text>If the Secretary of Homeland Security or the Secretary of State approves a visa, petition, or application for admission on behalf of an alien described in subparagraph (H)(i)(b) or (L) of section 101(a)(15), the Secretary of Homeland Security or the Secretary of State may not deny a subsequent petition, visa, or application for admission involving the same employer and alien unless the applicant is provided with a written finding that explains the basis for the Government’s determination that—</text> 
<subparagraph id="HCE0AC78B0A444FC2BEDC9693A74BC546"><enum>(A)</enum><text>there was a material error with regard to the approval of the previous petition, visa, or application for admission;</text></subparagraph> <subparagraph id="HC4C6B423A7124D47ACC88A804E9FC729"><enum>(B)</enum><text>a substantial change in circumstances has taken place since the prior approval or admission that renders the nonimmigrant ineligible for such status under this Act; or</text></subparagraph> 
<subparagraph id="H12DD4C33C4DA411E8A3890E2EB8DCABA"><enum>(C)</enum><text>new material information has been discovered that adversely impacts the eligibility of the employer or the nonimmigrant.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H84BEC41BF8534B19B1631A1ADD6B93BD"><enum>(c)</enum><header>Effect of ending employment relationship</header><text display-inline="yes-display-inline">Section 214(n) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(n)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H41000D7E07CF4A759C39F44A317FE936" style="OLC"> 
<paragraph id="H10B36FD7F8844CD2832EECE903FE559A" indent="up1"><enum>(3)</enum><text>A nonimmigrant admitted under section 101(a)(15)(H)(i)(b) whose employment relationship ends (either voluntarily or involuntarily) before the expiration of the nonimmigrant’s period of authorized admission shall be deemed to have retained such legal status throughout the 60-day period beginning on such employment ending date if an employer files a petition to extend, change, or adjust the status of the nonimmigrant during such period.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H864655EB254948AEAA53BDE0EA14B48A"><enum>103.</enum><header>Definitions</header> <subsection id="HA3A61DC07200454188367EBD1B661475"><enum>(a)</enum><header>Intending immigrant</header><text display-inline="yes-display-inline">Section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H3E5D0AFF13B44BABA9430B87F6D4C805" style="OLC"> 
<paragraph id="HE9AABFB752EC4C9A8A15485EF7934097" indent="up1"><enum>(53)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HC2820E3CCAAA47D9B222D37EE915F946"><enum>(A)</enum><text>The term <term>intending immigrant</term> means, with respect to the number of aliens employed by an employer, an alien who intends to work and reside permanently in the United States, as evidenced by—</text> <clause id="HAD43D1815722450CA774850EAF7F93E9" indent="up1"><enum>(i)</enum><text>a pending or approved application for a labor certification filed for such alien by a covered employer; or</text></clause> 
<clause id="H0B7F89473E8041CAA3AC9A3026397139" indent="up1"><enum>(ii)</enum><text>a pending or approved immigrant status petition filed for such alien by a covered employer.</text></clause></subparagraph> <subparagraph id="H92016B79C7964B46A64D5FA678114539" indent="up1"><enum>(B)</enum><text>In this paragraph:</text> 
<clause id="H55536A3FFB934EFA8F3AA91331D648CD"><enum>(i)</enum><text>The term <term>covered employer</term> means an employer that has filed immigrant status petitions for not fewer than 90 percent of current employees who were the beneficiaries of applications for labor certification that were approved during the 1-year period ending 6 months before the filing of an application or petition for which the number of intending immigrants is relevant.</text></clause> <clause id="HB0D3B5E47FA845D5A86071C1A84DED7A"><enum>(ii)</enum><text>The term <term>immigrant status petition</term> means a petition filed under paragraph (1), (2), or (3) of section 203(b).</text></clause> 
<clause id="H3709C3F0D6204298ADCACE27258F922A"><enum>(iii)</enum><text>The term <term>labor certification</term> means an employment certification under section 212(a)(5)(A).</text></clause></subparagraph> <subparagraph id="HECA8F097A5EE45D4B396D0BDF910BF1C" indent="up1"><enum>(C)</enum><text>Notwithstanding any other provision of law—</text> 
<clause id="H8E25FFDC61BE4472B97CA7B1F1937EE8"><enum>(i)</enum><text>for all calculations of the number of aliens admitted pursuant to subparagraph (H)(i)(b) or (L) of paragraph (15), including calculations for the purposes set forth in section 203(i), an intending immigrant shall be counted as an alien lawfully admitted for permanent residence and shall not be counted as an employee admitted pursuant to such a subparagraph; and</text></clause> <clause id="H9DE970E6C65F46FAB1C756C5796F9E99"><enum>(ii)</enum><text>for all determinations of the number of employees or United States workers employed by an employer, all of the employees in any group treated as a single employer under subsection (b), (c), (m), or (o) of <external-xref legal-doc="usc" parsable-cite="usc/26/414">section 414</external-xref> of the Internal Revenue Code of 1986 shall be counted.</text></clause></subparagraph></paragraph> 
<paragraph id="H07DBD6657B4D48BDADF3FF07EFFE22EC" indent="up1"><enum>(54)</enum><text>The term <term>STEM</term> means the academic and professional disciplines of science (excluding social sciences), technology, engineering, and mathematics.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H8A9E66C68BCF4A6C88B84CCB75017CCC"><enum>(b)</enum><header>H–1B dependent employers; exempt H–1B nonimmigrants</header><text display-inline="yes-display-inline">Section 212(n) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)</external-xref>) is amended—</text> 
<paragraph id="H13AAE4820E5240DB8D3E10C4CE43007B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> <subparagraph id="HE1CCC3F0763B43F1BEBC2721388F55D4"><enum>(A)</enum><text>in subparagraph (E)—</text> 
<clause id="HAC86C5F1C7D64ED196728B07E4EB75D6"><enum>(i)</enum><text>in clause (i), by striking <quote>(as defined in paragraph (4))</quote>; and</text></clause> <clause id="HC2416A590282491FB3322766274A083F"><enum>(ii)</enum><text>by striking clause (ii) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF2EB61F64C65484CA9B126982E569A3E" style="OLC"> 
<clause id="H5534AC94AFCF4BF38CCD18ECF6CC8605" indent="up2"><enum>(ii)</enum><text>Except as provided in clause (iii), an application described in this clause is an application filed by—</text> <subclause id="H2D7DC6DC2FD7447A84F00ED3B4B76552"><enum>(I)</enum><text>an H–1B-dependent employer; or</text></subclause> 
<subclause id="H3D9E4397C5FC4229AAC4B6D34D9BCC37"><enum>(II)</enum><text>an employer that has been found under paragraph (2)(C) or (5) to have committed a willful failure or misrepresentation during the 5-year period preceding the filing of the application.</text></subclause></clause> <clause id="HE3F37DC0FC254BC5AE2621704B1D7D8F" indent="up2"><enum>(iii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="H2258F3FA13ED4EB29BE3AEFCCD6497AC"><enum>(I)</enum><text>Except as provided in subclause (II), an application is not described in clause (ii) if the only H–1B nonimmigrants sought in the application are exempt H–1B nonimmigrants.</text></subclause> 
<subclause id="H364BF35DCE6E437E918DCC0153D7EC8C" indent="up1"><enum>(II)</enum><text>Subclause (I) shall not apply if the employer has more than 50 employees and more than 50 percent of the employer’s employees are H–1B nonimmigrants.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="HD18A6EF8603549A4BEAD23F0452025B6"><enum>(2)</enum><text>in paragraph (2)(F)—</text> 
<subparagraph id="H5007D73DC6BB433DAF35168BDB815E5A"><enum>(A)</enum><text>by inserting <quote>(i)</quote> before <quote>Subject</quote>; and</text></subparagraph> <subparagraph id="H4A133162C9924B1E8EB63D486CF49295"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H0B095F0CD26F4A0785FAF5358409A392" style="OLC"> 
<clause id="H7A6AD75CEEB341E19C4694A6B8B32567" indent="up3"><enum>(ii)</enum><text>The Director of U.S. Citizenship and Immigration Services shall provide the Secretary of Labor with any information contained in the materials submitted by employers of H–1B nonimmigrants as part of the petition adjudication process that indicates that the employer is not complying with visa program requirements for H–1B nonimmigrants. The Secretary may initiate and conduct an investigation and hearing under this paragraph after receiving information of noncompliance under this subparagraph.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H2C7F75B0FFC64759B9C9131EC276CDEC"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text> 
<subparagraph id="H6B2208E315A9459898762C8CF73F0582"><enum>(A)</enum><text display-inline="yes-display-inline">by amending subparagraph (A) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H37C83435C3AB422CAD18CF172CA0BC68" style="OLC"> <subparagraph id="H14F8A8E6789449028DB6305C57B22AC9" indent="up2"><enum>(A)</enum> <clause commented="no" display-inline="yes-display-inline" id="H7056982808834B5487F1FF232A340B86"><enum>(i)</enum><text>For purposes of this subsection, the term <term>H–1B-dependent employer</term> means an employer that—</text> 
<subclause id="H051BC5E242114FF3BCFD424D9471CBED" indent="up1"><enum>(I)</enum><text>in the case of an employer that has 25 or fewer full-time equivalent employees who are employed in the United States, employs more than 7 H–1B nonimmigrants;</text></subclause> <subclause id="HAC990810A15E4ED2905DC368A54E3D52" indent="up1"><enum>(II)</enum><text>in the case of an employer that has at least 26 but not more than 50 full-time equivalent employees who are employed in the United States, employs more than 12 H–1B nonimmigrants; or</text></subclause> 
<subclause id="HDF98DD4FD572469F8D11987A817A12A9" indent="up1"><enum>(III)</enum><text>in the case of an employer that has at least 51 full-time equivalent employees who are employed in the United States, employs H–1B nonimmigrants in a number that is equal to at least 15 percent of the number of such full-time equivalent employees.</text></subclause></clause> <clause id="HF04692FBE3F947EAA75727AEF1BFA8BF" indent="up1"><enum>(ii)</enum><text>In determining the number of employees who are H–1B nonimmigrants under subparagraph (A), an intending immigrant employee shall not count toward such number.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H48FB7B795E394960A0E890BC46B5BD45"><enum>(B)</enum><text>in subparagraph (B)—</text> <clause id="H1B69B7B41E624BCF8ABC4422550E134D"><enum>(i)</enum><text>by amending clause (i) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HBD005C69A1114BE99EEA8C2B5AEAA535" style="OLC"> 
<clause id="H533C7F98B8634EFF8F77313C63592037" indent="up2"><enum>(i)</enum><text>the term <term>exempt H–1B nonimmigrant</term> means an H–1B nonimmigrant who—</text> <subclause id="HF6BFFF43AFDB4DEE94914CCBC4C220FD"><enum>(I)</enum><text>receives wages (including cash bonuses) at an annual rate equal to not less than the higher of—</text> 
<item id="HEE14B92E88B242EF92AF1C4A700E8A4B"><enum>(aa)</enum><text>105 percent of the occupational mean wage, as determined based on Bureau of Labor Statistics data for the geographic area of employment; or</text></item> <item id="HDB483F10877847618427D9E228AEF905"><enum>(bb)</enum><text>$100,000 (or the adjusted amount under clause (iii), if applicable); or</text></item></subclause> 
<subclause id="HFF5546D4A459420FBF5823D0744CE3D4"><enum>(II)</enum><text>has attained a doctoral degree from an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)) in the United States in a specialty related to the intended employment;</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause> <clause id="HB964F9C0AA134ECBB9DA1816E8015954"><enum>(ii)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause> 
<clause id="H287D5BFC3FDD4DCC992FBB3B144614A0"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HF2A53F1FDA0B4E05A5FA846E8BF1701A" style="OLC"> <clause id="HE6B63E27D6824F2E98FF66FA69E84DDA" indent="up2"><enum>(iii)</enum><text>the amount under clause (i)(I)(bb) shall be increased, for the third fiscal year beginning after the date of the enactment of this clause and for every third fiscal year thereafter, by the percentage (if any) by which the Consumer Price Index for the month of June preceding the date on which such increase takes effect exceeds the Consumer Price Index for the same month of the third preceding calendar year.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section> 
<section id="H75264F7DCA57482488A0FA6006499B44"><enum>104.</enum><header>Strengthening the prevailing wage system</header><text display-inline="no-display-inline">Section 212(p) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(p)</external-xref>) is amended—</text> <paragraph id="H671F00E614C14F2CA23E04F5CFC48C1D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by adding at the end the following: <quote>With regard to the prevailing wage required to be paid under subsections (a)(5)(A), (n)(1)(A)(i)(II), and (t)(1)(A)(i)(II) (as added by section 402(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/108/77">Public Law 108–77</external-xref>), the first level of wages shall be not less than the mean of the lowest 50 percent of the wages surveyed.</quote>; and</text></paragraph> 
<paragraph id="H81000ED9A3CA49329AC2E4BA5D789435"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HE6EFB761CEE542319AAF0AD4DE52B75A" style="OLC"> <paragraph id="H36E79879527A4E4FB7A716060AFB285E" indent="up1"><enum>(5)</enum><text>An employer may use an independent survey approved by the Secretary of Labor for purposes of this section. The Secretary shall approve such a survey if—</text> 
<subparagraph id="HE0F0E6B99B01400CB34941702ECD4C5E"><enum>(A)</enum><text>the survey was published during the most recent 2-year period;</text></subparagraph> <subparagraph id="H634A59215EB9419F8C1A4EDDD9AF81FE"><enum>(B)</enum><text>the survey has not been duplicated since its initial publication;</text></subparagraph> 
<subparagraph id="H5C54AC78682A46169AF8661032958318"><enum>(C)</enum><text>the data upon which the survey is based was collected during the 2-year period ending on the date on which the survey was published;</text></subparagraph> <subparagraph id="H39EDD668D3BD44F1AB9FA8386C3F4B09"><enum>(D)</enum><text>the survey reflects the area of intended employment;</text></subparagraph> 
<subparagraph id="H820A2A24736B4DA995249F4384556CB8"><enum>(E)</enum><text>the employer’s job description adequately matches the job description in the survey;</text></subparagraph> <subparagraph id="H447C68122CE7408F9AAD753E6B220CDA"><enum>(F)</enum><text>the survey is across industries that employ workers in the occupation;</text></subparagraph> 
<subparagraph id="H95D7D35D62074133A729396B38161C1F"><enum>(G)</enum><text>the wage determination is based on the arithmetic mean (weighted average); and</text></subparagraph> <subparagraph id="H6A8B505A18FE4B408A34FD56410E04B6"><enum>(H)</enum><text>the survey identifies a statistically valid methodology that was used to collect the data.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HB34AAA58784E4B4AB6C06989C1B6D45C"><enum>105.</enum><header>Schedule A study</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Labor, in cooperation with the Office of Foreign Labor Certification, shall—</text> <paragraph id="HF5225AD6D8184FBD9C98C4621540090C"><enum>(1)</enum><text>submit to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name> and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> the results of a study to determine whether the occupations listed in Schedule A (20 C.F.R. 656.5) should be modified or expanded; and</text></paragraph> 
<paragraph id="H7026FB65D41E4569BBB3C8957D6F9AC6"><enum>(2)</enum><text>if the study determines that Schedule A should be modified or expanded, publish a notice of proposed rulemaking in the Federal Register.</text></paragraph></section></title> <title id="H6C34E48BA6F9468D9A43774616903880"><enum>II</enum><header>Employment-Based Immigrant Visas </header> <section id="H61451006E333487091C2131E12ABBBA5"><enum>201.</enum><header>Ensuring the issuance of all preference employment-based immigrant visas</header> <subsection id="H47A10FB73ADC4F49A724D790A30F5824"><enum>(a)</enum><header>Backlog reduction</header> <paragraph id="H5577DC7EDFD34B93A05445A57FDD6736"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, beginning in fiscal year 2018, the number of employment-based immigrant visas that shall be issued under paragraph (1), (2), or (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) shall be increased by the number computed under paragraph (2).</text></paragraph> 
<paragraph id="H56B5F44755FA4589BBD94622421D8B48"><enum>(2)</enum><header>Number available</header> 
<subparagraph id="H7D37AC015B8045409C7583728AEE5EA4"><enum>(A)</enum><header>In general</header><text>The number computed under this paragraph is—</text> <clause id="H684B36FA832D45AC8D4D72D25CB145AC"><enum>(i)</enum><text>the greater of—</text> 
<subclause id="H983486A094594171981064B943D7D018"><enum>(I)</enum><text>the number of preference immigrant visas computed under section 201(d)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)(1)</external-xref>) for fiscal years 1992 to 2013 that were not issued to any preference immigrant for any of those fiscal years; or</text></subclause> <subclause id="HEA711F2B817A416E9642746D285D3DE3"><enum>(II)</enum><text>200,000; minus</text></subclause></clause> 
<clause id="H2F4449CC7CA44EC9A8317E09BF6CC908"><enum>(ii)</enum><text>the number described in subparagraph (B).</text></clause></subparagraph> <subparagraph id="HEA644BF928CC4A018EA38B0C59CC5756"><enum>(B)</enum><header>Reduction</header><text>The number described in subparagraph (A)(i) shall be reduced, for each fiscal year after fiscal year 2017, by the cumulative number of immigrant visas issued for previous fiscal years pursuant to the increase authorized under paragraph (1).</text></subparagraph> 
<subparagraph id="H030F97FC1DA74614898BD050AEB313A2"><enum>(C)</enum><header>Construction</header> 
<clause id="HC4D5F6B11CDF4A47B5DB998164E8423D"><enum>(i)</enum><header>In general</header><text>Nothing in this paragraph may be construed as affecting the application of section 201(c)(3)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(c)(3)(C)</external-xref>) with regard to immigrant visas other than the visas authorized by the increase computed under subparagraph (A).</text></clause> <clause id="H837A3A28F0244EC39FA1634D95707C30"><enum>(ii)</enum><header>Limitation</header><text>The visas authorized by the increase computed under subparagraph (A) may only be issued to aliens seeking immigrant visas pursuant to paragraph (1), (2), or (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H912DE431F7C34DD59A80F478D38EC4DF"><enum>(b)</enum><header>Preference immigration as directed by Congress</header><text>Section 201(c)(1)(B)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(c)(1)(B)(ii)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HF67B49F6D6254D31A32E496F40E10C9D" style="OLC"> <clause id="HB9E3A3A058A74A489AF705F24163EFDA" indent="up3"><enum>(ii)</enum><text>The number computed under subparagraph (A) shall not be less than the sum of—</text>

<subsection id="H524ECFAB68A849A3B91CAEC43C5183D5"><enum>(c)</enum><header>Ensuring full implementation</header><text>Section 203(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(g)</external-xref>) is amended by striking <quote>(g) <header-in-text level="subsection" style="OLC">Lists</header-in-text>.—For purposes of carrying out</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H333BE44217454B1F89C94E36135DE231" style="OLC"> <subsection id="H0C6892AAD5244A58AF522797E8D2A8DE"><enum>(g)</enum><header>Administration</header> <paragraph id="HCF7C7F35DC314367AE758F7ABFA14A80"><enum>(1)</enum><header>Obligation to issue all authorized visas</header> <subparagraph id="HAB476D5BC1BA44FCBDCD74D367F9AE23"><enum>(A)</enum><header>In general</header><text>The Secretary of State, in coordination with the Secretary of Homeland Security, shall administer this section in a manner that ensures that all immigrant visas authorized by Congress to be issued under this section are issued to qualified applicants.</text></subparagraph>

<paragraph id="H97CF15E15B524E9E8B5014C4AEA0748E"><enum>(2)</enum><header>Supplemental fee</header><text>If a visa is not immediately available at the time an application is filed under paragraph (1), the beneficiary of such application shall pay a supplemental fee of $500, which shall be deposited into the Promoting American Ingenuity Account established under section 286(w). This fee shall not be collected from any dependent accompanying or following to join such beneficiary.</text></paragraph> <paragraph id="H47527B6A42E740369DCB3A506452DB13"><enum>(3)</enum><header>Availability</header><text>An application filed under this subsection may not be approved until the date on which an immigrant visa becomes available.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<paragraph id="H63186EC241854836A9A2545FD71E902B"><enum>(4)</enum><text display-inline="yes-display-inline">for fiscal year 2019 and each subsequent fiscal year, conditional employment-based immigrants described in section 203(i) in a number not to exceed 35,000 for any fiscal year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HEB2846FC3FC24E809159641D0FB2A930"><enum>(b)</enum><header>Requirements</header><text>Section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) is amended—</text> 
<paragraph id="H405FBB4DB9D447268D8E8478754F0343"><enum>(1)</enum><text>in subsection (d), by striking <quote>or (c)</quote> and inserting <quote>(c), or (i)</quote>;</text></paragraph> <paragraph id="H0E394476B6E54B8488E9DE84D44BD98C"><enum>(2)</enum><text>in subsection (e)—</text> 
<subparagraph id="HC10D9581E3C54D32A285E35B745012FE"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph> <subparagraph id="H640A9556D7C04F9FBF3D4FA0F6FE20A7"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text>

<paragraph id="H4C1D3AD5DE904E7CB7A942736902397E" indent="up1"><enum>(3)</enum><text>Immigrant visa numbers made available under subsection (i) shall be issued to eligible immigrants in a manner and order established by the Secretary of Homeland Security, by regulations, in accordance with the requirements under such subsection.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H06FE3D2CD0E940DE9EB8D982D8F0D76A"><enum>(3)</enum><text>in subsection (f)—</text> 
<subparagraph id="H614F669E923C4E7A908A59E23BCF5099"><enum>(A)</enum><text>by striking <quote>his</quote> and inserting <quote>the alien’s</quote>;</text></subparagraph> <subparagraph id="H0C9C0528799C4DD49B1D5E7ECC439CDE"><enum>(B)</enum><text>by striking <quote>or (c) of this section</quote> and inserting <quote>(c), or (i)</quote>; and</text></subparagraph> 
<subparagraph id="H8B708124C5D947F0BA9FA4FEEA624CED"><enum>(C)</enum><text>by striking <quote>he</quote> and inserting <quote>the consular officer</quote>;</text></subparagraph></paragraph> <paragraph id="H3763AF8A1BB3435FB65423EB7EFC1437"><enum>(4)</enum><text>in subsection (g)(2), as amended by section 202(c), by striking <quote>and (c)</quote> and inserting <quote>(c), and (i)</quote>; and</text></paragraph> 
<paragraph id="H28B3D4973B874ECCB64BF9C78265B3D1"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H2D2AEDD80DAE4EAE932BF3F1C3063218" style="OLC"> <subsection id="H9D707BA50383492788D7BD1EE69A12BB"><enum>(i)</enum><header>Conditional employment-Based immigrants</header> <paragraph id="H66C14C6F1D734505AC82DEADF404B7ED"><enum>(1)</enum><header>Authorization</header><text>Conditional employment-based immigrant visas shall be made available in a number not to exceed 35,000 for each fiscal year, to any eligible alien (including any nonimmigrant lawfully residing in the United States) who—</text> 
<subparagraph id="H2C0DD6465DBC4523B2A33B9D556A4358"><enum>(A)</enum><text>has earned a university degree;</text></subparagraph> <subparagraph id="H630B03A55B6A4C05AD9917086CA92B20"><enum>(B)</enum><text>has received an offer of employment from a United States employer that has complied with the requirements under section 204(a)(1)(M); and</text></subparagraph> 
<subparagraph id="HF09D04774F384C08B0630EC5484999EC"><enum>(C)</enum><text>will satisfy the requirements for immigrant classification under paragraph (1), (2), or (3) of subsection (b).</text></subparagraph></paragraph> <paragraph id="H6A11E88F71A64BD2A4BFDEEBD57551F2"><enum>(2)</enum><header>Departure not required</header><text>The Secretary of Homeland Security may not require a nonimmigrant who is lawfully residing in the United States to leave the United States in order to obtain a conditional employment-based immigrant visa under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9FE09CB88DAB4232B724A903D79F5BF0"><enum>(c)</enum><header>Petitioning procedure</header> 
<paragraph id="H3DAB4D910C014586A73400CDFAABD399"><enum>(1)</enum><header>In general</header><text>Section 204(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>) is amended—</text> <subparagraph id="H16E5770AC4A34A88B010F94746C75761"><enum>(A)</enum><text>in subparagraph (F), by striking <quote>section 203(b)(1)(B), 203(b)(1)(C), 203(b)(2), or 203(b)(3)</quote> and inserting <quote>paragraph (1)(B), (1)(C), (2), or (3) of section 203(b) or section 203(i)</quote>;</text></subparagraph> 
<subparagraph id="HB1CF4015AB96455D8A688EAA0FF20A89"><enum>(B)</enum><text>by moving subparagraph (L) 4 ems to the left; and</text></subparagraph> <subparagraph id="HB14427B55B6E4CC1A4906E1944F7A6B5"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2CECB2E9B94947D6A0B633736312346D" style="OLC"> 
<subparagraph id="H47950453469D42B0A016E1EE08333630" indent="up2"><enum>(M)</enum><text>Each employer petitioning for a conditional employment-based immigrant visa on behalf of an alien under this subsection, or seeking to hire a conditional employment-based immigrant who was previously admitted—</text> <clause id="H33D1A88BE6664913B6B3DAF7F5BB1BC6"><enum>(i)</enum><text>shall file a petition with the Secretary of Homeland Security attesting that—</text> 
<subclause id="H0CCF4DF5E01B4F8F83AC233E7FA5D760"><enum>(I)</enum><text>the alien will be paid not less than a similarly situated United States worker;</text></subclause> <subclause id="HBD9A5D5CDCF34C39BC73F4299F94F6EA"><enum>(II)</enum><text>no United States worker has been or will be displaced by the alien;</text></subclause> 
<subclause id="HC178546E72B14B2D9AA891A37A897D68"><enum>(III)</enum><text>the employer has undertaken recruitment efforts to hire United States workers, in the alien’s same occupation or a similar occupation, who possess a bachelor’s degree or higher, including at least 3 types of targeted recruiting efforts, such as job fairs, on-campus recruiting, or job postings that attract applicants; and</text></subclause> <subclause id="HEB57085218C64C2EAC5D155DE50E0697"><enum>(IV)</enum><text>the employer is in compliance with the requirements under clauses (ii) through (vii);</text></subclause></clause> 
<clause id="H9967316989AD4247A6E46EA852481BE6"><enum>(ii)</enum><text>shall be prepared to document all recruitment efforts attested to under clause (i)(III), if audited by the Secretary;</text></clause> <clause id="HB5DDFE10488044D5B46E70C1F2D669ED"><enum>(iii)</enum><text>shall fully participate in the E-Verify Program established under section 403(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note);</text></clause> 
<clause id="H58826B07D84D4A0A90B620715B2CD10A"><enum>(iv)</enum><text>shall pay, for each petition filed under clause (i), a $10,000 fee, which shall be deposited into the Promoting American Ingenuity Account established under section 286(w);</text></clause> <clause id="H2E58DCCA7AEE43E7AD8C9A1CFB15F606"><enum>(v)</enum><text>shall pay an administrative fee in an amount that is sufficient to cover the average paperwork processing and other administrative costs of an alien participating in the program established under this subsection;</text></clause> 
<clause id="H2BA827A665454E2386A71243D9670B61"><enum>(vi)</enum><text>may not be an H–1B-dependent employer (as defined in section 212(n)(3)(A)); and</text></clause> <clause id="H48C6A03245104CBE8D2D873DBD641EEA"><enum>(vii)</enum><text>may not be debarred from any existing immigration program.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H186C73384A4145E2A666C793F2132418"><enum>(2)</enum><header>Adjudication of petitions</header><text>The Secretary of Homeland Security shall adjudicate all petitions filed under section 204(a)(1)(M)(i) of the Immigration and Nationality Act, as added by paragraph (1), not later than 60 days after receiving such petitions.</text></paragraph></subsection> <subsection id="HED867F10DFD5463B8AEEB6C4B8AF9032"><enum>(d)</enum><header>Labor certification based on prior competitive recruitment</header> <paragraph id="HB2D1136C86954A05857515A703698114"><enum>(1)</enum><header>In general</header><text>Section 212(a)(5)(A)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(5)(A)(ii)</external-xref>) is amended—</text> 
<subparagraph id="H633B04C22E484F8986C504B694322132"><enum>(A)</enum><text>in the clause heading, by inserting <quote><header-in-text level="clause" style="OLC">for special recruitment and documentation procedures</header-in-text></quote> after <quote><header-in-text level="clause" style="OLC">rule</header-in-text></quote>;</text></subparagraph> <subparagraph id="HB8A1571A47FC4D1C9A570E1BCD0986B8"><enum>(B)</enum><text>in subclause (I), by striking <quote>, or</quote> and inserting a semicolon;</text></subparagraph> 
<subparagraph id="H22EECF0CE2FB4A11AC29C5A298F35807"><enum>(C)</enum><text>in subclause (II), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph> <subparagraph id="H8514281882EE4208812040D2A21CAF45"><enum>(D)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H04A9228A8FBA4E12B66EA2B989F1E7F6" style="OLC"> 
<subclause id="HA9995250E5A949E58836607311C52C7A"><enum>(III)</enum><text>is a conditional permanent resident under section 216B and receives wages (including cash bonuses) at an annual rate equal to not less than $100,000.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HF822453DC39C4F9FA6BE496F6AA4DAAD"><enum>(2)</enum><header>Inflation adjustment</header><text>The amount specified in section 212(a)(5)(A)(ii)(III) of the Immigration and Nationality Act, as added by paragraph (1), shall be increased, on the first day of the third fiscal year beginning after the date of the enactment of this Act, and on the first day of every third fiscal year thereafter, by the percentage (if any) by which the Consumer Price Index for the month of June preceding the date on which such increase takes effect exceeds the Consumer Price Index for the same month of the third preceding calendar year.</text></paragraph></subsection> 
<subsection id="HA026CBF9E15D47F6B713ABDF7D3FBC31"><enum>(e)</enum><header>Conditional permanent residency</header> 
<paragraph id="H7D2CF5BD2E254D06BB7574B37FD0AE1A"><enum>(1)</enum><header>In general</header><text>Chapter 2 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1181">8 U.S.C. 1181</external-xref> et seq.) is amended by inserting after section 216A the following:</text> <quoted-block display-inline="no-display-inline" id="HDAC4507263744C978C45F6EB238582EE" style="OLC"> <section id="H64B2BC03DD3247C597A674ACB2626619"><enum>216B.</enum><header>Conditional permanent resident status for certain highly skilled professionals, spouses, and children</header> <subsection id="H132A40074B6346EDAD2F7361DD0054C0"><enum>(a)</enum><header>In general</header> <paragraph id="HC9D1C6BBAE394ACDBEF16043F47C4CDA"><enum>(1)</enum><header>Conditional basis for status</header><text>Notwithstanding any other provision of this Act, a conditional employment-based immigrant (as described in section 203(i)), and the alien spouse and alien children of such immigrant, shall each be provided the status of an alien lawfully admitted for permanent residence, and shall be considered to have obtained such status on a conditional basis subject to the provisions of this section.</text></paragraph> 
<paragraph id="H9762EFAC3B1B4358AF0A2ED684980659"><enum>(2)</enum><header>Notice of requirements</header><text>At the time a conditional employment-based immigrant, or the alien spouse or child of such immigrant, obtains permanent resident status on a conditional basis, the Secretary of Homeland Security shall notify such immigrant, spouse, or child of—</text> <subparagraph id="H3DB60C9FBAB643E3974E6696766D4982"><enum>(A)</enum><text>the provisions of this section;</text></subparagraph> 
<subparagraph id="H137E7ECC751D4AE3B734BC67F1D3BAB5"><enum>(B)</enum><text>the requirements for maintaining such conditional permanent resident status; and</text></subparagraph> <subparagraph id="H94220949724D4B2EB6E0ECC5DDEDD7DD"><enum>(C)</enum><text>the requirements to have the conditional basis of such status removed.</text></subparagraph></paragraph></subsection> 
<subsection id="H0B8B53196A244780A95D85F0B750F89F"><enum>(b)</enum><header>Annual review</header> 
<paragraph id="HFC6ABF391BEA4AA3A2CD71A22DB305B8"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall annually review the status of each alien receiving conditional permanent resident status under subsection (a) and shall require from the alien proof or evidence of—</text> <subparagraph id="HD66FA3A0978446A7BDCDD5FFC9855DE5"><enum>(A)</enum><text>ongoing employment in the occupation for which the alien was granted a conditional employment-based visa by an employer that has complied with the requirements under section 204(a)(1)(M);</text></subparagraph> 
<subparagraph id="HE6FBD510437E48C28AB862E5E29169D3"><enum>(B)</enum><text>the payment of all applicable income and Social Security taxes;</text></subparagraph> <subparagraph id="HD8D32F3023854CB6A97067E2966720B1"><enum>(C)</enum><text>at the first annual review—</text> 
<clause id="HE98F0401F1BD45738EAA81C0486BB77B"><enum>(i)</enum><text>a filing with the Department of Labor on the alien’s behalf of an Application for Permanent Employment Certification, if such certification is required for the alien to satisfy the requirements for immigrant classification under paragraph (1), (2), or (3) of section 203(b); or</text></clause> <clause id="HADACE36E56FA43A88E204EB086E2E806"><enum>(ii)</enum><text>a filing with the Department of Homeland Security on the alien’s behalf of an Immigrant Petition for Alien Worker, if such certification is not required for the alien to satisfy the requirements for immigrant classification under paragraph (1), (2), or (3) of section 203(b);</text></clause></subparagraph> 
<subparagraph id="HA4C5597E96F145888CC916537B6F01FE"><enum>(D)</enum><text>at the second annual review, a filing with the Department of Homeland Security on the alien’s behalf of an Immigrant Petition for Alien Worker, unless a pending Application for Permanent Employment Certification prevents the filing of an Immigrant Petition for Alien Worker on the alien’s behalf; and</text></subparagraph> <subparagraph id="H3FFC2CA001FE4E9D907D2CEB331DB90A"><enum>(E)</enum><text>at the third and subsequent annual reviews, an approval from the Department of Homeland Security of an Immigrant Petition for Alien Worker filed on the alien’s behalf.</text></subparagraph></paragraph> 
<paragraph id="H358357232F3C44F98A0E8F1EC989C87C"><enum>(2)</enum><header>Effect of denial</header><text>A filing with the Department of Labor on the alien’s behalf of an Application for Permanent Employment Certification or a filing with the Department of Homeland Security on the alien’s behalf of an Immigrant Petition for Alien Worker shall not qualify as proof or evidence under paragraph (1) if—</text> <subparagraph id="H851A33CB038845D99AAEBF7C7ADE8356"><enum>(A)</enum><text>the Application for Permanent Employment Certification or the Immigrant Petition for Alien Worker has been denied by a final agency action; or</text></subparagraph> 
<subparagraph id="H2DBDDD9E0B94495295B739D9ACF9EBA2"><enum>(B)</enum><text>an approved Immigrant Petition for Alien Worker filed on the alien’s behalf was revoked for cause under section 205.</text></subparagraph></paragraph></subsection> <subsection id="HF188D517009842FC8E87D4C14A930337"><enum>(c)</enum><header>Transfers</header> <paragraph id="H77345FDB107947C3B14619A28C20A8C0"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), an alien receiving conditional permanent resident status under subsection (a) may begin employment with a new employer without affecting his or her status if the new employer complies with the requirements set forth in section 204(a)(1)(M).</text></paragraph> 
<paragraph id="H1150B0AEE906420EBF9667A922039618"><enum>(2)</enum><header>Fee</header><text>Notwithstanding section 204(a)(1)(M), the fee payable by the new employer for each alien shall be—</text> <subparagraph id="H8B8F427EA196408583E71E6E68526C03"><enum>(A)</enum><text>$10,000 if the new employer hires the alien during the 1-year period beginning on the date on which the alien obtained conditional permanent resident status under subsection (a);</text></subparagraph> 
<subparagraph id="H8C591E6C1A8A4C179EA21125A4972A48"><enum>(B)</enum><text>$5,000 if the new employer hires the alien during the 1-year period beginning at the end of the period described in subparagraph (A);</text></subparagraph> <subparagraph id="HF717202E2F5C487CB68A348F49C6CA1E"><enum>(C)</enum><text>$2,500 if the new employer hires the alien during the 1-year period beginning at the end of the period described in subparagraph (B); and</text></subparagraph> 
<subparagraph id="HBE79736701524CEF8B537108BF845DCD"><enum>(D)</enum><text>zero if the new employer hires the alien after the end of the period described in subparagraph (C).</text></subparagraph></paragraph></subsection> <subsection id="H8B18200A262247FE98A8216E05E9C93B"><enum>(d)</enum><header>Termination</header><text>The Secretary of Homeland Security shall terminate the conditional permanent resident status of an alien who received such status under subsection (a) if—</text> 
<paragraph id="H23472909AE0B4A4399C9F2A58F775847"><enum>(1)</enum><text>the alien—</text> <subparagraph id="H69EFD9A08F2A4C358367ED0D1FB43B16"><enum>(A)</enum><text>fails to submit the required proof or evidence at the annual review in accordance with subsection (b); or</text></subparagraph> 
<subparagraph id="HF0A1232E0B894479818A8A47CBCA1120"><enum>(B)</enum><text>submits proof or evidence at such a review that fails to satisfy the requirements under subsection (b);</text></subparagraph></paragraph> <paragraph id="HC1DDC6624C8A4677BE0BA822B0077424"><enum>(2)</enum><text>the alien has been unemployed or employed other than in the occupation for which the alien was granted a conditional employment-based immigrant visa for a cumulative total of 180 days while holding conditional permanent resident status under subsection (a);</text></paragraph> 
<paragraph id="H4AB9B8E9773E41479F8EF20765C0AE43"><enum>(3)</enum><text>the alien is employed by an employer that is not in compliance with the requirements under section 204(a)(1)(M);</text></paragraph> <paragraph id="H8E827A428B914B51B34213F6B23D9059"><enum>(4)</enum><text>the alien does not apply to remove the conditions attached to his or her permanent resident status within 1 year after an immigrant visa would be available for such alien under paragraph (1), (2), or (3) of section 203(b) based on the alien’s preference category and country of chargeability if the alien did not have conditional permanent resident status; or</text></paragraph> 
<paragraph id="H821E31AF6AC9423BA68D402FF55942A1"><enum>(5)</enum><text>an application submitted by the alien to remove the conditions attached to his or her permanent resident status is denied in a final agency action.</text></paragraph></subsection> <subsection id="HC2FDC074767C40AF8BD12792306881D7"><enum>(e)</enum><header>Removal of conditions</header><text>Any alien receiving conditional permanent resident status under subsection (a) may file an application to have the conditions removed on or after the date on which an immigrant visa would be available for such alien under paragraph (1), (2), or (3) of section 203(b) based on the alien’s preference category and country of chargeability if the alien did not have conditional permanent resident status. Such application shall include the same proof or evidence that would be required for an annual review under subsection (b) if such review occurred on the date on which the application was filed.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

Amounts deposited into the account shall remain available to the Secretary of Education until expended.</text></paragraph> <paragraph id="H3D2B76D94AFD49FFB6077CDC840CEBC2"><enum>(2)</enum><header>Purposes</header><text>The purposes of the Promoting American Ingenuity Account are to enhance the economic competitiveness of the United States by—</text> 
<subparagraph id="H7D27CD94E7C047E992EF860E1F1FBB83"><enum>(A)</enum><text>strengthening academic achievement standards in science, technology, engineering, and mathematics (STEM), including computer science, at all levels;</text></subparagraph> <subparagraph id="H3DA3A4F925EF4AF9954F960295AD5F1A"><enum>(B)</enum><text>ensuring that schools have access to well-trained and effective STEM teachers through improved strategies for the recruitment, training, placement, and retention of teachers in STEM fields, including computer science;</text></subparagraph> 
<subparagraph id="HE00336B1A4074C26ADFF94741BAE2059"><enum>(C)</enum><text>supporting efforts to strengthen the elementary and secondary STEM curriculum, including efforts to make courses in computer science more broadly available;</text></subparagraph> <subparagraph id="H57D9D501131C41EB8E827F84148331BD"><enum>(D)</enum><text>helping colleges and universities produce more graduates in fields needed by American employers, including assistance for students in postsecondary STEM programs;</text></subparagraph> 
<subparagraph id="H54923C95AE7545158109022DA68C932A"><enum>(E)</enum><text>improving availability of and access to STEM-related worker training programs, including community college-based courses and programs;</text></subparagraph> <subparagraph id="H0CCBA7985BA1474E93DDAF7066A267F2"><enum>(F)</enum><text>providing employment-based STEM education and training programs, including apprenticeship programs; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF25CE405EBC541BD85924C776578CB1E"><enum>(G)</enum><text>carrying out other activities approved by the Secretary of Education to improve STEM education and training.</text></subparagraph></paragraph> <paragraph id="H6C11B7ABC1B245459EF77320A7B3189E"><enum>(3)</enum><header>Allocation of funds</header> <subparagraph id="H6BEC6A0AE24E4809B1E0E14D59A783A6"><enum>(A)</enum><header>National activities</header><text>The Secretary of Education may reserve up to 2 percent of the amounts deposited into the Promoting American Ingenuity Account for national research, development, demonstration, evaluation, and dissemination activities carried out directly or through grants, contracts, or cooperative agreements, including—</text> 
<clause id="H0FB2107318784F0E89CAB746063A5327"><enum>(i)</enum><text>activities undertaken jointly with other Federal agencies, such as STEM mission agencies; and</text></clause> <clause id="H5F40C654024C425BA9B7086164BE4A14"><enum>(ii)</enum><text>grants to nonprofit organizations for nationally significant activities consistent with the purposes of the <short-title>Immigration Innovation Act of 2018</short-title>.</text></clause></subparagraph> 
<subparagraph id="H0B75A3A23B2844BF853295EEA9166EB9"><enum>(B)</enum><header>American dream accounts</header> 
<clause id="HC779FC4EA83D48E6843A608EF2455F2F"><enum>(i)</enum><header>Grants authorized</header><text>The Secretary of Education shall allocate 5 percent of the amounts deposited into the Promoting American Ingenuity Account to award grants, on a competitive basis, to eligible entities to enable such entities to establish and administer American Dream Accounts.</text></clause> <clause id="HA3FD95674CA845719A7B9D8D991FB722"><enum>(ii)</enum><header>Purpose of accounts</header><text>American Dream Accounts shall be personal, online accounts for low-income students, who are, at the time of application, attending a grade not higher than ninth grade, that include a college savings account, monitor progress toward higher education, and provide opportunities, including mentoring—</text> 
<subclause id="HFC722DC2E807427C9C145639173F47B8"><enum>(I)</enum><text>to gain financial literacy skills;</text></subclause> <subclause id="H0A636D5D85F946848E8C07BCD916451D"><enum>(II)</enum><text>to learn about preparing for enrollment in an institution of higher education; and</text></subclause> 
<subclause id="H10A93FD355FF484485574BBA6E3C303D"><enum>(III)</enum><text>to identify career interests.</text></subclause></clause> <clause id="HF21752799FDD47C78BAD9990030790C7"><enum>(iii)</enum><header>Priority</header><text>The Secretary shall give priority to applicants that demonstrate one or more of the following:</text> 
<subclause id="H339CEE93D4A749A690A2CEE1C38383F0"><enum>(I)</enum><text>An intention to focus on STEM education and careers.</text></subclause> <subclause id="H8C0A93025B5C477BA440F67CB4A3629C"><enum>(II)</enum><text>The ability to serve a large number of low-income students.</text></subclause> 
<subclause id="H5F5EFD5C366D40BBAD333EBC1BCF88A3"><enum>(III)</enum><text>In the case of eligible entities described in subclause (I) or (II) of clause (iv), the provision of opportunities for students to participate in a dual or concurrent enrollment program or early college high school program at no cost to the student or to the student’s family.</text></subclause></clause> <clause id="HCDA83C200AE9440FB20969DBA2F2E59E"><enum>(iv)</enum><header>Eligible entities</header><text>An eligible entity may be a partnership of two or more of the following entities:</text> 
<subclause id="H4ECB0E48F5464EC0BFDD2C3673C11115"><enum>(I)</enum><text>A State educational agency.</text></subclause> <subclause id="H10CF80F0F50246E088CA909AE1C2CFF7"><enum>(II)</enum><text>A local educational agency, including a charter school that operates as its own educational agency.</text></subclause> 
<subclause id="H97565CA7879049A6974F850CF9D7492D"><enum>(III)</enum><text>A charter management organization or charter school authorizer.</text></subclause> <subclause id="H90B8881A3755458E8BD39AB29BE26921"><enum>(IV)</enum><text>An institution of higher education or a Tribal college or university.</text></subclause> 
<subclause id="H8AC0D201A8A14E8385CFD456EF2ABE36"><enum>(V)</enum><text>A nonprofit organization.</text></subclause> <subclause id="H67D85082B1C84069A23F1C029C5D31D0"><enum>(VI)</enum><text>An organization with demonstrated experience in educational savings or in preparing low-income students for higher education.</text></subclause></clause> 
<clause id="HC6EE223D29F147A8AF9EC7AC6719E8D4"><enum>(v)</enum><header>Reports and evaluations</header><text>Not later than 1 year after the date on which the Secretary of Education disburses grants under this Act, and annually thereafter until each grant disbursed under this Act has ended, the Secretary shall prepare and submit a report to the appropriate committees of Congress, which shall include an evaluation of the effectiveness of the grant program established under this Act, including in building financial capability.</text></clause> <clause id="H3682A1C9E78848D2B8C8B6151B086C58"><enum>(vi)</enum><header>Eligibility to receive federal student financial aid</header><text>Notwithstanding any other provision of law, any funds that are in the college savings account portion of a student’s American Dream Account—</text> 
<subclause id="H713B350FE3454DF4966FE88DB498AE49"><enum>(I)</enum><text>shall not affect such student’s eligibility to receive Federal student financial aid, including any Federal student financial aid under the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> et seq.); and</text></subclause> <subclause id="H1DD155B2A357493CB6A6F2EEA87CF54E"><enum>(II)</enum><text>shall not be considered in determining the amount of any such Federal student aid.</text></subclause></clause> 
<clause id="HDD71796DB2CB4EF695D9F4BD7604344B"><enum>(vii)</enum><header>Rulemaking</header><text>The Secretary of Education shall promulgate regulations, through notice and comment rulemaking in compliance with section 553 of title 5, United States Code, to implement the American Dream Account competitive grant program authorized under this subparagraph. The Secretary shall issue a notice of proposed rulemaking in the Federal Register not later than 1 year after the date of the enactment of this subsection.</text></clause></subparagraph> <subparagraph id="H1DC20C97ACB64102BBD85083F6FBDA68"><enum>(C)</enum><header>Allocations to states</header> <clause id="H31E0DEA4201648BFB951FC4B3FDF180D"><enum>(i)</enum><header>In general</header><text>Subject to clause (iii), the Secretary of Education, after making the allocations under subparagraphs (A) and (B), shall proportionately allocate the remaining amount deposited into the Promoting American Ingenuity Account in each fiscal year to each State that submits an application under subparagraph (D) in an amount that bears the same relationship to such remaining amount as the amount the State received under subpart 2 of part A of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6331">20 U.S.C. 6331</external-xref> et seq.) for the preceding fiscal year bears to the amount all States received under that subpart for the preceding fiscal year.</text></clause> 
<clause id="H83460A9938F448589BB78A9B4674BF26"><enum>(ii)</enum><header>Authorized use of state allocations</header><text>Of the amount each State receives under clause (i) in each fiscal year, the State shall allocate—</text> <subclause id="H60F2AB6BDF6D44508123EF0DA3C4A31A"><enum>(I)</enum><text>50 percent for the activities described in subparagraphs (A), (B), (C), (D), and (G) of paragraph (2); and</text></subclause> 
<subclause id="H31A7BFFAEE924FE292DFB9ED535DDDC6"><enum>(II)</enum><text>50 percent for the activities described in subparagraphs (E), (F), and (G) of paragraph (2).</text></subclause></clause> <clause id="H0B692CBADE4B40C9BAE3A9319BE3E651"><enum>(iii)</enum><header>Minimum allocations</header> <subclause id="HD9BF2B7F038F4FED87863DEC28A738FF"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), no State shall receive less than 0.5 percent of the total amount made available to all States under this subparagraph from the Promoting American Ingenuity Account.</text></subclause> 
<subclause id="HA350155C4D7245ECB7F374C80E4BED8C"><enum>(II)</enum><header>Reallocation</header><text>If a State does not submit an application in accordance with subparagraph (D) in a fiscal year, the Secretary of Education shall reallocate the State’s allocation to the remaining States in accordance with this subsection.</text></subclause></clause></subparagraph> <subparagraph id="H7AC342B58DB04C289DF035DB9D130BD1"><enum>(D)</enum><header>STEM education grant application process</header> <clause id="H98E29D3375264CAAB554EDA1653007D5"><enum>(i)</enum><header>Application</header><text>Each State desiring to receive an allocation from the Promoting American Ingenuity Account shall submit an application to the Secretary of Education at such time, in such form, and including such information as the Secretary may prescribe. The application shall describe how the State plans to improve STEM education and training to meet the needs of employers in the State, in accordance with paragraph (2).</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HEFC3606F2B2446E2B8671E4FEF34D734"><enum>(ii)</enum><header>Approval</header><text>The Secretary of Education shall approve any application submitted under clause (i) that meets the requirements prescribed by the Secretary if the Secretary determines, after evaluating the recommendations of peer reviewers, that the State’s plan for the use of funds would be successful in making progress toward meeting the purposes set forth in paragraph (2).</text></clause></subparagraph></paragraph> <paragraph id="H4F153049F78047E0B09B8E3654999E6F"><enum>(4)</enum><header>Federal funds to supplement, not supplant, non-federal funds</header> <subparagraph id="HF28618E7B28E4ECD88C62F0ACA18008C"><enum>(A)</enum><header>In general</header><text>A State educational agency or local educational agency shall use Federal funds received under this subsection only to supplement the funds that would, in the absence of such Federal funds, be made available from State and local sources for the education of students participating in programs assisted under this part, and not to supplant such funds.</text></subparagraph> 
<subparagraph id="H120E7580C08545C4A3E4580561429CF6"><enum>(B)</enum><header>Compliance</header><text>To demonstrate compliance with this paragraph, a local educational agency shall demonstrate that the methodology used to allocate State and local funds to each school receiving assistance under this part ensures that such school receives all of the State and local funds it would otherwise receive if it were not receiving assistance under this subsection.</text></subparagraph> <subparagraph id="H5138C4CE2C784E429343420DA7D4BA2A"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to authorize or permit the Secretary of Education to prescribe the specific methodology a local education agency uses to allocate State and local funds to each school receiving assistance under this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H317E9790B25740F880174EA97C91CC2A"><enum>402.</enum><header>National evaluation</header> 
<subsection id="H1D80419FE2F9411BAA7E5A58B0F545C7"><enum>(a)</enum><header>In general</header><text>Using amounts reserved under section 286(w)(3)(A) of the Immigration and Nationality Act, as added by section 402, the Secretary of Education shall conduct, directly or through a grant or contract, an annual evaluation of the implementation and impact of the activities funded by the Promoting American Ingenuity Account.</text></subsection> <subsection id="H3C0FC7A41A7A40F09EA5F7AF19138880"><enum>(b)</enum><header>Annual Report</header><text>The Secretary shall submit a report describing the results of each evaluation conducted under subsection (a) to—</text> 
<paragraph id="H3936476EC948427D82ADD3454E073DF6"><enum>(1)</enum><text>the President;</text></paragraph> <paragraph id="H481870EF7F9E45AC9935D58642D8636D"><enum>(2)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></paragraph> 
<paragraph id="H7499BCDB36354CC994DC3DC2D615D69A"><enum>(3)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>;</text></paragraph> <paragraph id="HD4AA0AFF5E384D4EA039B8E78D2F1226"><enum>(4)</enum><text>the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>; and</text></paragraph> 
<paragraph id="H845594A522394D38BECB6AF73E58818F"><enum>(5)</enum><text>the <committee-name committee-id="">Committee on Education and the Workforce of the House of Representatives</committee-name>.</text></paragraph></subsection> <subsection id="H5E3E14E64D7B47869D11AA4A0A32F969"><enum>(c)</enum><header>Dissemination</header><text>The Secretary shall make the findings of the evaluation widely available to educators, the business community, and the public.</text></subsection></section> 
<section id="H8613AD37CC5C4AAEB105BA6AA6D8A1A6"><enum>403.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this title may be construed to permit the Secretary of Education or any other Federal official to approve the content or academic achievement standards of a State.</text></section></title> <title id="HC5FFE76CADED4CAAAD6EB0B21B06CA15"><enum>V</enum><header>Reforms Affecting Immigrant and Nonimmigrant Visas</header> <section id="H141E51FC45BB4783868C306B810109D4"><enum>501.</enum><header>Streamlining petitions for established employers and other requirements</header> <subsection id="H24DD1FEFD7814646BCE4BB23BAFCF61F"><enum>(a)</enum><header>In general</header><text>Section 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>), as amended by titles I and IV, is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H13503F1E9AE7411E88DCFC81C25D7B20" style="OLC"> 
<paragraph id="H23584018005B451DA9FE75C0FE573120" indent="up1"><enum>(16)</enum><text>The Secretary of Homeland Security shall establish a pre-certification procedure for employers who file multiple petitions under this subsection or section 204(a)(1)(F) that enables an employer—</text> <subparagraph id="H245624E15C824D02936AD1C42972E5EC"><enum>(A)</enum><text>to avoid repeatedly submitting documentation that is common to multiple petitions; and</text></subparagraph> 
<subparagraph id="HC8F14B580D954D0AA6F268AA8B6C70D4"><enum>(B)</enum><text>to establish, through a single filing, criteria relating to the employer and the offered employment opportunity.</text></subparagraph></paragraph> <paragraph id="HD377B3B8655647849C027FF54E6872F6" indent="up1"><enum>(17)</enum><text>The Secretary of Homeland Security shall promulgate regulations that allow a petitioner to opt to electronically sign, file, and store any report, form, or supporting document required to be submitted to U.S. Citizenship and Immigration Services.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0B24A3E27F6544EB8439A83FD3175314"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act, and shall apply to petitions filed under section 204(a)(1)(F) or 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(F)</external-xref> and 1184(c)) beginning 180 days after such date.</text></subsection></section></title> </legis-body></bill>
